Legal & Legislative Updates by Walt Lachenmayr, MBA, SPHR NLRB Ambush Election Rule- The U.S Senate narrowly approved a Congressional Review Act Resolution on March 4 to stop the NLRB from implementing the "ambush election rule. However, President Obama is expected to veto the Congressional Resolution. The ambush election rule is scheduled for implementation on April 14. The rule will shorten the time in which the labor union certification is held from the current median of 38 days to as little as 11 days. The rule also requires the employer to provide union organizers with employee personal contact information. Maryland Healthy Working Families Act- This act is pending before the Maryland Senate. It requires employers with 10 or more employees to provide paid sick and safe leave; employers with 9 or less employees are required to provide this leave on an unpaid basis. The bill also includes these provisions:

• 7 days leave to employees working at least 8 hours weekly i.e. 1 hour for each 30 worked

• Permit employees to use the leave for preventive care, illness, and domestic violence for themselves or for a family member.

Inclement Weather Poses FLSA challenges- When work closes because of weather, exempt and nonexempt employees are treated differently under the Fair Labor and Standards Act (FLSA). See the link for policy guidelines and options under the law: Weather & the FLSA.

o Support safety initiatives to achieve corporate goals and OSHA guidelines for 7 manufacturing sites: o Works with Facilities and Safety Manager to ensure OSHA standards and regulatory requirements are met and

Mrs. Wuenschel is the executive director of human resources for Hood College and an adjunct professor in the Economics and Business Administration Department. She is responsible for the strategic positioning and empowerment of the most important asset of the institution---its people. Carol is a past director of the Maryland SHRM State Council and past MD SHRM Diversity Chair. She has also served in the president’s role for the Frederick County Society of Human Resource Chapter, the Hanover Area Human Resources Association, and the Chesapeake Chapter of the Quality and Participation Association (AQP). Carol also has served as a founding member of the leadership team for the Hanover Area Health Care Alliance and past co-chair of the Ward’s Chapel United Methodist Church Strategic Planning Team. Carol received her undergraduate degree from Towson University, her master’s degree from the Johns Hopkins University, and earned both the Senior Professional in Human Resources (SPHR) and Global Professional in Human Resource certifications (GPHR), the highest certifications in the HR profession.

A. Full Regular Member Those eligible for applying for Full, Regular membership include:

Those who devote at least 50% of their time to Human Resources and/or Industrial Relations activities. Those who possess at least three years exempt-level human resource management experience.

Full Regular members shall:

a. Have voting rights (one vote) on any matter of chapter business. b. Be eligible to seek election to and hold any office, serve as a Committee Chairman or

member, and be eligible to be a member of the Board of Directors.

B. Associate Member Those eligible for applying for Associate membership include:

Those persons actively engaged in bonafide Human Resource work and who devote at least 30% of their time to Human Resource and/or Industrial Relations activities.

Individuals in non-exempt human resource management positions. Persons having the primary responsibility for HR activities in small organizations where there may not

be a discreet HR function. These shall, in special circumstances, be eligible for membership in this category, regardless of the amount of time devoted to HR activities.

Non-practitioners having an interest in the HR profession and the activities of our chapter. These individuals must be eligible for membership in National SHRM in order to be eligible for Associate membership in the Cumberland Valley Chapter.

Associate members shall:

a. Have voting rights on matters of chapter business. b. Be eligible to serve on any of the standing committees.

C. Student Members 1. Student members are defined as an individual enrolled in an accredited two or four year college (or above) who have the desire to pursue a career in the HR profession. 2. Student Member shall: a. Not have voting rights on the matters of chapter business. b. Be eligible to serve on any of the standing committees for educational purposes.
