Accept the bid and award Contract No. 4585 between Alameda County Public Works Agency and MCK Services (Principal: Mark Hazen, President; Location: Martinez, CA), in the amount of $1,353,548.00, based on the unit prices stated in its bid proposal for the Pavement Rehabilitation of Redwood Road Between Castro Valley Boulevard and Camino Alta Mira in Castro Valley, Alameda County, California; Specification No. 2132; 2. Authorize the President of the Board to sign contract upon review by County Counsel, said work to be completed within forty (40) calendar days from the date of receipt of Notice to Proceed; and 3. Approve the encumbrance of an additional $135,355.00 as a Supplemental Work Allowance (SWA) for a total encumbered amount of $1,488,903.00 for the project, and authorize the Director of Public Works to approve contract changes as necessary against the SWA. SUMMARYIDISCUSSION: Your Board previously approved this project for advertisement on June 2,2009 with an estimated cost of $1,800,000.00. The project consists, in general, of removing and disposing of existing asphalt concrete pavement; perfonning asphalt concrete base failure repairs; installing pavement reinforcing fabric; providing asphalt concrete pavement overlay; implementing new traffic control plan and installing and/or adjusting other roadway appurtenances; and cleaning of the site at the end of the job. SELECTION CRITERJA AND PROCESS: In accordance with established bid procedures, the project was advertised in seven (7) general publications and eight (8) trade or minority publications. RECOMMENDATION:

A pre-bid conference was held for interested contractors, with attendance at the conference required for all general contractors, and encouraged for subcontractors. The conference was attended by ten (10) contractors. On September 1, 2009 eight (8) bids were received and opened. Table 1 shows an abstract ofthe bids received in response to the authorized advertisement. The bids will be forwarded to you under separate cover.

The bids were reviewed by Public Works staff and found to be in order. The lowest bidder, MCK Services, did not submit the UDBE Commitment form with their bid proposal at bid opening. Subsequently, upon review of the good faith efforts submittal (including the UDBE Commitment form), it was determined that the UDBE subcontractor information submitted is consistent with the subcontractor listing in the bid proposal. The good faith efforts were also deemed adequate. Upon consultation with County Counsel, it was determined that the irregularity in MCK's bid did not constitute an unfair bidding advantage for MCK Services.

In accordance with the project bid documents, award of the contract is based on the lowest base bid. After the lowest bidder was determined, Agency staff has elected to include the Rubberized Asphalt alternate bid item in the specifications. The total contract cost (including the alternate bid item) with MCK Services, will increase to $1,353,548.00, which is within the Engineer's Estimate.

FINANCING:

The project is financed by federal stimulus funds under the ARRA Recovery Act passed by the legislature earlier this year. The Auditor-Controller has established a special fund for tracking the ARRA grants. There will be no impact on the General Fund.
