Committee Reasoning

The Historic Preservation Review Board ("HPRB") was established by Mayor's Orderspursuant to section 4 of the Historic Landmark and Historic District Protection Act of 1978 (D.C.Law 2-144; D.C. Official Code § 6-1103). The HPRB is statutorily charged with theresponsibility for:

(1) advising the Mayor on the compatibility of permit applications to alter, demolish,subdivide or newly construct a structure that either is designated as a historic landmark or islocated within a historic district;

(2) performing the functions and duties of State Review Board as set forth in regulationsissued by the U.S. Secretary of the Interior pursuant to the National Historic Preservation Act (16U.S.C. § 470 et seq., effective October 15, 1966);

(3) designating and maintaining a current inventory of historic landmarks and historicdistricts within the District of Columbia; and

(4) performing such other functions and duties relating to the protection, preservation,enhancement, and perpetuation of the historic, architectural, archeological, cultural and aestheticheritage of the District of Columbia as the Mayor may assign.

Currently, there are 41 designated historic districts within the city and approximately30,000 structures locally designated as landmarks.

The Mayor's appointment and the Council's confirmation of highly qualified citizens toserve on the Historic Preservation Review Board provides an important opportunity to improvethe land use planning and preservation functions of the District government.

Impact on Existing Law

PR 17-75 fulfills the Council's statutory responsibility, established pursuant to section 4of the Historic Landmark and Historic District Protection Act of 1978 (D.C. Law 12-144;effective March 3, 1979 to consider confirmation of the Mayor's nomination of a member of theHistoric Preservation Review Board. The adoption of PR 17-75 would have no impact onexisting law.

Section-by-Section Analysis

Section 1 provides the short title of the resolution.

Section 2 provides Council confirmation of the Mayor's appointment of Andrew PhillipAurbach, a resident of Ward 3, as a historian member of the Historic Preservation Review Board,for a term to end July 21, 2009.

Section 3 requires the Council to transmit a copy of the adopted resolution to thenominee and to the Office of the Mayor.

Section 4 provides that the resolution shall take effect immediately.

Fiscal Impact

The 9 members of the Historic Preservation Review Board are compensated, pursuant tosection 1-611.08 of the D.C. Official Code, at the hourly rate of $25 per meeting, not to exceed$1,800 for each board member per year, with an additional 20% annual compensation ($360)provided to the chairperson. Funding has been provided in the Fiscal Year 2007 budget and theDistrict's financial plan for this compensation, at the annually capped level of $16,560. Theadoption of PR 17-75 would have no adverse fiscal impact on the District of Columbia.

Position of the Executive Branch

PR 17-75 was introduced by the Chairman of the Council of the District of Columbia atthe request of the Mayor, whose comments relating to it are contained in the attached lettertransmitting the nomination to the Council by the Mayor.

Committee Action

On March 13, 2007, the Committee of the Whole held a public roundtable on the Mayor'sappointment of Andrew Phillip Aurbach to the Historic Preservation Review Board ("HPRB").Attached is a copy of the nominee's resume, the nominee's response to questions asked of allnominees, and written comments received by the Committee on this nomination. The followingpersons submitted comments or testimony to the Committee in support of PR 17-75: NancySkinkle, architect; Judy Hubbard, citizen; Don Hawkins, architect; Joan Habib, Cleveland ParkHistorical Society; Martin Murray, citizen; and Andrew Aurbach, the nominee.

The following persons submitted comments or testimony to the Committee whichexpressed a concern that neither this nor a second pendng HPRB nominee is an architect, and thatonly one of the other members of the HPRB has architectural expertise: Rebecca Miller, D.C.Preservation League; Nancy Metzger, Capitol Hill Restoration Society; Richard Busch, DupontCircle Conservancy; Don Hawkins, citizen; and Fay Armstrong, Historic Mount Pleasant. TheD.C. Preservation League also expressed concern about the geographic and demographiccomposition of the HPRB. The Committee notes that the terms of the remaining seven members

of the HPRB expire on July 21, 2007, and encourages the Mayor to use this upcomingopportunity to address these concerns. Attached is a letter to the Mayor from Chairman Gray onthis matter.

On March 20, 2007, the Committee of the Whole met at its regular meeting to considerPR 17-75. Chairman Gray moved approval of PR 17-75 and this Report, which were approvedby voice votes (Chairman Gray and Councilmembers Brown, Catania, Cheh, Evans, Graham,Mendelson, Schwartz and Wells present; Councilmembers Barry and Thomas absent).
