The Empowered Committee held its 55th meeting on 29.06.2016 under the Convenership of the Commr/Secretary to Government, Finance Department. The following officers attended:

Out of One hundred & sixty nine (169) cases, the Empowered Committee found One hundred & twelve (112) cases eligible on the basis of documents, certificates furnished by the concerned Departments. Fifty seven (57) cases were found deficient on account of certain information/ clarification or documents from the concerned Departments. The Members/ Representatives of the concerned departments present in the meeting were advised to expedite the requisite deficient information / documents in these cases so that the Empowered Committee could decide these cases as well. Abstract details are given in Annexure "A" to these minutes.

With regard to Thirty five (35) consolidated Class IV workers of CA&PD department the committee observed that these workers have neither been appointed against clear vacancies nor they are working against any posts, as such these cases cannot be considered for regularization as per Section 5 (i) of J&K CS (Special Provision) Act, 2010.

The cases cleared by the Committee are, however, subject to verification of genuineness of certificates/appointment orders and other documents provided by the Department. The departments will further reverify that:

i) The appointments have originally been made against clear vacancy;

ii) Appointments have been made by the Competent Authority or initial appointment by authority not competent to engage is got regularised.

iii) The status of appointment is only contractual, consolidated or adhoc;

iv) That the employee continuous as such on the appointed date;

v) That the appointees possessed the requisite qualifications and eligibility for the post on the date of initial appointment as prescribed under recruitment rules.

vi) That no disciplinary or criminal proceedings are pending against them;

vii) That the appointees have completed seven years of service on the appointed date;

viii) That the appointees are not parttime or seasonal including those whose wages are paid out of local funds or contingent grants.

These workers have been engaged under a due recruitment process with prescribed eligibility criteria of a B.E/ B.Tech Degree in Electrical/ Electronics/ Computer Engineering OR Masters Degree in Compuer Apllication from a regognised Universty. However, if no candidate having the above qualification was available from within the block, then candidates from within the block having B.Sc degree with Science and Mathematics subjects along with post graduate diploma/ certificate from DOEACC accredited institution/ NIIT/STG/Aptech or any other well known private computer training institution could also be considered.

These centres as well as posts have been taken over by the State Government in the year 2009 onwards, the goverment vide cabinet decision No. 72/06/2014 dated 21.05.2014 transferred these CIC centres alongwith staff and assets to the Rural Development Department. However, there is no prescribed pay scale for the posts of CIC operators against which they can be regularised. The Empowered Commitee is of the opinion that the department in the first instance shall have to approach the Finance Department for creation of required number of posts in a suitable pay scale to be worked out in consultation with Finance Department against which these workers can be recommended to b e-fegularized.
