In May 2013, the MoJ published the ‘Transforming Rehabilitation: A strategy for reform’ (https://consult.justice.gov.uk/digital-communications/transforming-rehabilitation/results/transforming-rehabilitation-response.pdf).
This publication outlined the Government’s intended approach to driving down the rate of reoffending anddelivering better value for the taxpayer through a programme of reform and extension of competition andpayment by results within provision of probation services.
The Rehabilitation Programme involves the split of the current probation and offender resettlement servicesinto a single national public probation service (National Probation Service (NPS)) and the setting up ofa series of independently owned and operated Community Rehabilitation Companies (CRCs) which willdeliver rehabilitation (probation and resettlement) services in 21 Contract Package Areas (CPAs) acrossEngland and Wales. The MoJ is seeking to transfer the delivery of these CRC services to independentProviders via the award of contracts to and sale of the CRCs.
Indicative contract length will be between seven (7) and ten (10) years with an option to extend for a furtherperiod of three (3) years.

II.2 QUANTITY OR SCOPE OF THE CONTRACT
II.2.1 Total quantity or scopeThe CRCs will manage in scope offenders in the community (generally, those assessed as posing low ormedium risk of serious harm to the public) and will have flexibility to deliver innovative rehabilitativesupport. They will deliver the sentence of the court or post-custody licence/supervision for each offenderallocated to them, and will seek to rehabilitate offenders and reduce reoffending. A proportion of theirpayment for doing so will be dependent on their performance in reducing reoffending.
CRCs’ caseload will fall into two broad categories: offenders released from custody on a licence/supervision period; and offenders subject to Community Orders or Suspended Sentence Orders.
Intended changes to the sentencing framework, and to supervision/licence arrangements for offendersreleased from custody are being introduced in the Offender Rehabilitation Bill, currently before parliament.
Offenders released from custody will generally be subject to licence or supervision conditions, including,subject to the passage of the Offender Rehabilitation Bill, those given short custodial sentences, who are not
currently subject to such requirements on release. This will give Providers a very wide discretion to requirethem to undertake rehabilitative activities.
Some community orders will in future, subject to the passage of the Offender Rehabilitation Bill, include anew Rehabilitation Activity Requirement, which will give Providers a similar wide discretion to stipulaterehabilitative activities.
Additionally, in support of the reforms, the National Offender Management Service (NOMS) are realigningthe prison estate, designating a number of resettlement prisons for each CRC area (see information inAnnex B), which will release the great majority of offenders into the area in which they have served the lastthree months of their sentence.

The CRCs will work in resettlement prisons allocated to their area, delivering a resettlement service forevery offender before release. They will also have the opportunity to provide additional ‘through the gate’rehabilitation support to drive reductions in reoffending.
CRCs’ flexibility to determine rehabilitative support, the ability to require offenders to undertakerehabilitative activities, and these new custodial arrangements provide the foundation for the CRCs toreduce reoffending.
CRCs will also be required to manage the risk of harm posed to the public by each offender they manage,including identifying any potential escalations to high risk and referring them to the new National ProbationService (NPS). They will be required to monitor and support offenders’ compliance with their sentence orlicence conditions, and to take appropriate action in relation to any breaches, referring them to the NPS forcourt action or recall when necessary.
The NPS will provide advice to court on sentencing, will conduct risk assessments at the outset anddetermine the allocation of cases, and will manage offenders who pose a high risk of serious harm to thepublic or have committed the most serious offences. It will also respond to potential escalations in risk andtake appropriate enforcement action in cases referred to it by the CRCs.
It is the intention that the contract length shall be between seven (7) and ten (10) years with an option toextend for a further period of three (3) years.
The ITN will provide further detail on the possible requirement for potential future (related) services fromother Government Departments, including all Ministerial and non-Ministerial Departments, a list of whichcan be found at: https://www.gov.uk/government/organisations . Police and Crime Commissioners inEngland and Wales may also want to procure some limited similar rehabilitation services from their localCPA provider.

Description of particular conditionsRight of Audit
The Authority will require all Providers to comply with requirements relating to the transparency ofoperational and financial data in connection with the provision of services under the RehabilitationProgramme contracts. Providers are expected to operate with full transparency to the Authority. Furtherdetails are set out in the contract drafts which accompany the ITN, but Bidders should be aware that theyinclude a right to provide unfettered access to all matters in respect of the contract where the Authority hasgrounds to suspect any irregularity in the information supplied by the Provider in relation to the services.In those circumstances, access may include, depending on the circumstances: the capture of electronic maildata (including archives) of key personnel (current and former); relevant shared network data; computers;document management systems; notes from internal meetings; and financial records.
Also in those circumstances, providers would be required to sign hold harmless letters releasing theAuthority, its auditors and advisors from all liability in relation to the subsequent findings of any audit.Bidders should refer to the contractual documents at ITN for details of what is required.
The principal pieces of legislation and regulation applicable to the delivery of the services will be listed inthe ITN, along with other particular conditions that must be complied with.

This competition in relation to the Rehabilitation Programme concerns a mixed transaction containing PartB services and other elements. Although the Authority intends to run a process similar to the negotiatedprocedure, this is done on a voluntary basis and the MoJ reserves the right at any time without notice todepart from this procedure.
Information on variant bids will be provided in the ITN documentation.
