Colorado Foreclosure Consumer Rights The foreclosure process in Colorado is quite a bit different than in other states because here, the governor appoints a "Public Trustee" for each county in the state. The trustee must act as an impar>al party when handling a power of sale foreclosure. In Colorado, the non-judicial power of sale foreclosure is carried out as follows: The process begins when the aDorney represen>ng the lender files the required documents with the Office of the Public Trustee of the county where the property is located. The Public Trustee then files a "No>ce of Elec>on and Demand" with the county clerk and recorder of the county. Once recorded, the no>ce must be published in a newspaper of general circula>on within the county where the property is located for a period of five (5) consecu>ve weeks. The Public Trustee must also mail, within ten (10) days aQer the publica>on of the no>ce of elec>on and demand for sale, a copy of the same and a no>ce of sale as published in the newspaper, to the borrower and any owner or claimant of record, at the address given in the recorded instrument. The Public Trustee must also mail, at lease twenty-one (21) days before the foreclosure sale, a no>ce to the borrower describing how to redeem the property. The owner of the property may stop the foreclosure proceedings by filing an "Intent to Cure" with the Public Trustee's office at least fiQeen (15) days prior to the foreclosure sale and then paying the necessary amount to bring the loan current by noon the day before the foreclosure sale is scheduled. The foreclosure sale must take place between forty-five (45) and sixty (60) days aQer the recording of the elec>on and demand for sale with the county clerk and recorder. The Public Trustee may hold the sale at any entrance to the courthouse, unless other provisions were made in the deed of trust. The lender has the op>on to file a suit for deficiency in Colorado and the borrower has up to seventy five (75) days aQer the sale to redeem the property by paying the foreclosure sale amount, plus interest. DO NOT SIGN ANY DOCUMENT TO TRANSFER OWNERSHIP TO ANYONE without representaEon of an AGorney or Licensed Real Estate Agent. The Colorado AGorney General warns that various individuals may contact you to help you avoid foreclosure aLer you are in default on your mortgage. A foreclosure consultant is an individual you hire in a non-AGorney or non-Real Estate Agent relaEonship to assist you through the foreclosure process, and who is not affiliated with your lender. By law, these individuals are required to follow certain rules in the Act, which you should ensure are followed before agreeing to pay a foreclosure consultant a fee. A consultant is not allowed to charge or collect any fee from you unEl the consultant has fully performed his or her services. The AGorney General also warns against individuals and scams that offer short-term loans that allow you to cure the current default, but leave you unable to pay off the short-term loan. You should also be extremely cauEous of any individual who wants you to transfer Etle to your property with an opEon to repurchase at a later date.

1.   Putyourheadinthesand:Don’tdoanythingandthebankwillforecloseonthehome.Youwillreceiveaknockonyourdoorandtheywillaskyoutoleaveorevictyou.Unfortunately,thisiswhatmostdo.

7.   SellTheHome:Iftheotherop>onsarenotpossibleorifyounolongerdesiretokeepthepropertywecansellitbeforetheForeclosureSaleDate. Ifyoudecidetodothiswemusthurrytoinsurewecomplete the sale prior to the Sale Date. The bank usually will not extend this date. If the netproceedsfromsellingthepropertywillfallshortofthemortgageorliensagainsttheproperty,thisiscalledaShortSale.Inthiscase,thelienholdersagreetoacceptlessthantheamountowedonthedebt,asaleofthepropertycanbeaccomplished.
