Royal Legislative Decree 2/2011, 5th September, which approves the consolidated
text of the Law on State Ports and Merchant Marine.
Royal Decree 1516/2007, 16th November, which determines the legal framework of
regular maritime cabotage lines and navigations of public interest.

Law 11/2010, 2nd November, regulating the maritime
transport of the Balearic Islands.
Decree 136/2008, 5th December, on the information
rights of passengers in the maritime transport between
islands.

BONUS RATES
Art. 245.5 Law on State Ports and Merchant Marine:
bonus rates of activity and use due to insularity
- Ship rates: up to 40%
- Passage rates: up 45% passengers and 60% vehicles
- Goods rates: up to 40%
The State Budget Act will establish the value of these
bonus and its application.

PUBLIC SERVICE CONTRACTS
The Council Regulation (CEE) 3577/1992, establishes the
liberalization of the maritime cabotage within the EU.
The Royal Decree 1516/2007, 16th November, which
determines the legal framework of regular maritime cabotage
lines and navigations of public interest , regulates the public
service contracts.
Current situation: Balearic Islands have no public service
since 1st October.

Favorable European regulatory framework:
Art. 4 of the Council Regulation (EEC) 3577/1992
Art. 93 of the Treaty on the Functioning of the European Union
Introduction of legislative improvements at European level:
•Extend the scope of application of art. 4 of the Council Regulation
(EEC) 3577/1992: provision of services with other Member States
•Enable island regions benefit from the current art. 81 of the
Guidelines on National Regional Aid
