reached agreement in London onMarch 13 on a Program of Action on interdiction of theflow of arms to Gaza. Text of the Program of Action isin paragraph six. Department requests USNATO,in coordination with the Canadian and UK missions,to brief the North Atlantic Council (NAC), or at post'sdiscretion the most appropriate forum, on the outcomeof the london conference, the agreed Program of Action,and the planned onawaconference scheduled for June 10·1,.

2. (U) Objectiw: To encourage NATO members' sup~ forthe Program of Action on Gaza arms smuggling interdiction,as agreed upon in London March 13, and a successfulfollow-up meeting in Ottawa.

3. (SBU) Background: Building on theFebruary 4·5 discussions in Copenhagen,representatives of nine governments(Canada, Denmark, France, Germany, Italy,the Netherlands, NOIway, the UK, and the U.S.)met in london on March 13 and reached agreementon a Program of Action for measuresto help prevent and interdict arms smuggling to Gaza.The Program of Action aims to enhance coordination ofinformation and intelligence sharing, diplomaticengagement, and military and law enforcement activities.Text of the Program of Action appears in paragraph six.

4. (U) Next Steps: Canada has agreed to host the nextmeeting of participating govemments June 10·11. Thismeeting willinclude a table top planning exercise to enable participantsto betterunderstand national capabilities and authorities undervarious scenarios.

5. (SaU) Egypt and Israel: As was the case in Copenhagen,the UK invited both Israel and Egypt to send observersto the London meeting. The Israelis accepted theinvitation; the Egyptians did not. We will continue toupdatethe Egyptians privately about this effort.

6. (SaU) Begin Text Program of Action:

This initiative constitutes a response to persistentconcerns over the flow of weapons to the Gaza Strip.These efforts should be seen in the context of effortsto support an immediate and durable cease·fire, includinga cessation of aU violence such as rocket attacks againstIsrael and all other hostilities directed againstcivilians, and the unimpeded provision of humanitarianassistance to Gaza as well as the sustained re-opening ofcrossing points on the basis of the

2005 Agreement on Movement and Access. The initiativeaims to develop an effective framework for internationalcooperation. supplementary to measures taken by regionalstales to prevent and interdict the illicit flow of arms,amlT'MJnition, and wea~ns components. to Gaza.

Participating governments seek to enhance effortsto prevent and interdict the illicit trafficking of arms,ammunition and weapons components to Gaza and withintheir jurisdiction 10 prevent the facilitation of suchtransfers. The Governments confirm their corrmitment10 support efforts of regional states through activitiesfarther afield. The Gowmments reaffirm that theintemational corrvnunity has a responsibility to supportprevention and interdiction efforts and that such effortsmay involve a broad range of tools to include dipklmatic.mlitary, intelligence, and law enforcement components.These efforts build upon UNSCR 1860 and the principlesand obligations pursuant to transfers of arms or relatedmaterials established in relevant UNSCRs including 1747.They recognize that these efforts include measuresto prevent, disrupt, delay, stop, or seize illicittransfers of arms, ammunition and weapons componentsand offer a range of roles for merrbers of theintemational community, taking into accountcounter·terrorism and non-proliferation conventionsand regimes. Sharing Information and Intelligence

- Enhance information gathering and sharingto support effective and timely prevention andinterdiction measures, while protecting the confidentialcharacter of classified information. Such sharing wouldinclude the broadest possible array of relevant informationabout points of origin, contents, carriers and transitroutes of suspect shipments.

Operating within existing or supplementalauthorities and resources

- Review and provide information on current authoritiesand resources, inclUding customary intemationallaw andother regimes and initiatives; consider the potentialmeans to enhance them and ways to develop additionaltools, including through bilateral ship-boarding agreementsand national legislation. Conduct regular consultationsamong legal experts aimed at efficient implementation of

Coordinating diplomatic engagement

- Coordinate approaches to flag, port, transit, originand other states as appropriate to encourage fullcooperation for prevention and interdiction efforts,to dissuade transit states from allowing their territoryfrom being used to transfer arms, ammunition and weaponscomponents and 10 prevent such transfers, includingthrough cooperation based on bilateral agreements.

-- Share best practices, including point of contactinformation, from their engagement with flag, port,transit, and origin states.

-- Engage with regional partners that have sharedinterests in preventing illicit flows of arms,ammunition and weapons components.

Coordinating military and law enforcement activities

_. Examine whether additional national assets mightcontribute to prevention and interdiction efforts.

-- Identify assets with responsibilities in existingmissions as well as additional resources that couldbe made available.

-- Take action, to the extent that national legalauthorities permit and consistent withinternational law, to support interdiction efforts.Such efforts may include inquiry, boarding, searching,stopping, seizing or other efforts necessary to preventtransfers of arms, ammunition and weapons components.

- Encourage transit states to prevent suspectedtransfers and support such efforts as necessary.

Establishing a regular mechanism to review common efforts

•• Meet on a regular basis to review efforts and evaluateresults. These meetings would be open to other governmentsprepared to support prevention and interdiction efforts.

•- Provide appropriate point(s) of contact for preventionand interdiction activities.
