IT IS ORDERED that in the event a United States Magistrate Judge is not readily available,

an arrested person able to post bail may do so in the amount set for the offense in the schedule of

collateral (attached hereto as Exhibit A), or if no amount is set then Five Hundred Dollars ($500.00),

unless the person is taken without necessary delay before a state or local judicial officer authorized by

Title 18, United States Code, Section 3041, who may then set bail and/or other conditions of release;

IT IS FURTHER ORDERED that any such release on the posting of bail in the aforesaid

amount shall further be evidenced by execution of the approved form of ORDER FOR APPEARANCE

BOND, setting forth the written conditions that the cited and released offender is required to appear

before the United States Magistrate Judge on a day and time certain. Such ORDER FOR

APPEARANCE BOND, along with their attachments, should be substantially similar to Exhibit B

attached hereto and made a part of hereof; and

IT IS FURTHER ORDERED AND DIRECTED that the agencies set forth in the caption

shall only accept cash bail in the said authorized and prescribed amounts against official receipt

(attached hereto as Exhibit C), noting the case incident number on the official receipt, VIOLATION

NOTICE form and the APPEARANCE BOND form; and

IT IS FURTHER ORDERED that the aforementioned agencies shall promptly and fully

deposit and make accounting for all posted and received bail monies accepted by them as above

provided, together with related notices of citation and APPEARANCE BOND FORM, to the Clerk of

the Court, United States District Court, District of Arizona, on the very next succeeding workday from

and after the date of acceptance of receipt of any such posted bail monies; and

IT IS FURTHER ORDERED that persons arrested and charged with misdemeanor violations

of Titles 33, 36, 38, 41, 43, 46 and 50 of the Code of Federal Regulations, Titles 16, 18, 21, and 43 of

the United States Code, the Arizona Revised Statutes, or under applicable state statute by virtue of the

Assimilative Crime Act (Title 18, United States Code, Section 13) listed herein may waive an

appearance before a United States Magistrate Judge and dispose of the matter by forfeiting pre-set

collateral to the United States District Court for the District of Arizona. When such collateral is

forfeited, it will terminate the proceeding. Forfeiture of collateral shall not apply to those persons

issued a citation requiring a mandatory appearance before a United States Magistrate Judge on a

specified date and time. Those persons issued a citation requiring a mandatory appearance before a

United States Magistrate Judge on a specified date and time are required to appear before said United

States Magistrate Judge as directed on the citation.

IT IS FURTHER ORDERED that there be an automatic adoption of the Maricopa County Bail

Schedules for Appendix B, Title 28 - Traffic; Appendix C, Title 5 - Boating; and Appendix D, Title 17 -

Game & Fish Laws of Arizona, as they are revised.

Nothing contained in this Order shall prohibit a law enforcement officer from arresting any

person for the commission of any offense, including those for which collateral may be posted and

forfeited, and, upon such arrest, taking the person immediately before a specifically designated United

States Magistrate Judge, or requiring the person charged to make a mandatory appearance before a

specifically designated United States Magistrate Judge or the posting of a custody release bond.

This General Order supersedes GENERAL ORDER 02-10 filed September 13, 2002.
