The Cheyenne County Board of Commissioners and Board of Equalization held an open and public meeting on Monday, August 15, 2016 in the Commissioners Meeting Room, Cheyenne County Court House, 1000 10th Avenue, Sidney, Nebraska. A notice of this meeting was published in the Sidney Sun-Telegraph, aired on KSID Radio, posted on the bul-letin board in the County Court House and on the Cheyenne County website. The Monthly Fee Reports for the month of July were submit-ted by the Clerk, Treasurer, Clerk of the District Court and Highway Superintendent and for the month of June for the Sheriff. The Reports were approved as reviewed.

The Board next reviewed and considered a request from Schuh Rentals, LLC for an increase in the monthly rent from $125.00 to $135.00 for the storage unit used as evi-dence storage for the Cheyenne County Sheriff. The storage unit

is owned by Schuh Rentals,LLC. Pursuant to the

Accountability and Disclosure Commission, a full disclosure is presented on an annual basis stating that the sole member of Schuh Rentals, LLC is Cheyenne County Clerk Beth Fiegenschuh. A motion was made by Olson, seconded by Sanders declaring that the Board is fully aware of the relationship between Fiegenschuh and Schuh Rentals, LLC and further moves to approve the request from Schuh Rentals, LLC for an increase in the monthly rent from $125.00 to $135.00 for the storage unit used as evidence storage for the Cheyenne County Sheriff. Roll Call: Aye: Sanders, Johnson, Olson. Nay: None.

Inventories for the follow-ing departments were reviewed and approved: Extension, Highway, Veterans Service, Building and Grounds, County Court, Cheyenne County Emergency Communications Center, Treasurer, Assessor, Visitors Committee, Clerk of the District Court, Sheriff, Region 21 Emergency Management, Weed, County Attorney, Commissioners, Election and Clerk.

At 8:15 A.M., a motion was made by Sanders, seconded by Olson to recess the Board of Commissioners and reconvene as the Board of Equalization. Roll Call: Aye: Johnson, Olson, Sanders. Nay: None.

County Assessor Louella Pippitt presented a tax list cor-rection for Clifford E. Beyer for the tax years 2013, 2014 and 2015. Assessor Pippitt stated that a pole building had been assessed twice. A motion was made by Olson, seconded by Sanders to approve the tax listcorrection as presented. Roll Call: Aye: Olson, Sanders, Johnson. Nay: None.

At 8:18 A.M., a motion was made by Olson, seconded by Sanders to adjourn the Board of Equalization and reconvene as the Board of Commissioners. Roll Call: Aye: Sanders, Johnson, Olson. Nay: None.

County Assessor Louella Pippitt then presented a Contract between Cheyenne County and-Stanard Appraisal Services, Inc., for the purpose of con-ducting appraisals for residen-tial and commercial properties. County Attorney Paul Schaub approved the Contract. After a discussion, a motion was made by Sanders, seconded by Olson to approve the Contract as pre-sented. Roll Call: Aye: Johnson, Olson, Sanders. Nay: None.

Next, Assessor Pippitt presented a Contract for Professional appraisal servic-es from Pritchard & Abbott, Inc. The Contract covers the appraisal of mineral interests for the 2017 and 2018 tax years and is in the amount of $13,750.00 for each year. County Attorney Paul Schaub has reviewed and approved the Contract. A motion was made by Olson, seconded by Sanders to approve the Contract with Pritchard & Abbott, Inc. Roll Call: Aye: Olson, Sanders, Johnson. Nay: None.

At 8:30 A.M., Chairman Johnson declared the public hearing open to review and consider approval of an appli-cation from Peetz Cooperative Telephone Company requesting a Conditional Use Permit to con-struct a 30’ pole for an Internet repeater on property owned by Cassandra Lynn Reedich in an A Agricultural zone located in the Southwest Quarter of Section 24, Township 14 North, Range 48 West of the 6th P.M., Cheyenne County, Nebraska. Planning and Zoning Administrator Colleen Terman stated that all docu-mentation was in order. Randy Kottwitz spoke on behalf of Peetz Cooperative Telephone Company. On July 25, 2016,

the Cheyenne County Planning and Zoning Commission approved the Conditional Use Permit with the recommenda-tion it be forwarded to the County Commissioners for final approval. A motion was made by Sanders, seconded by Olson to adopt Resolution 2016-22 approving the Conditional Use Permit as requested.

Roll Call: Aye: Sanders, Johnson, Olson. Nay: None. A complete copy of the Resolution as adopted is on file at the Office of the County Clerk.

At 8:35 A.M., Chairman Johnson declared the public hearing closed.

The Board reviewed a General Relief Application from Michael and Sunshine Coberley for assistance with hous-ing. This application was first considered at the August 1, 2016 Board meeting. County Attorney Schaub stated that he had mailed a letter to Mr. and Mrs. Coberley and the letter was returned with no forwarding address. A motion was made by Sanders, seconded by Olson to deny the Coberley’s request for housing assistance. Roll Call: Aye: Johnson, Olson, Sanders. Nay: None.

Next, the Board considered an application from Larry and Shirley Mitchell for assistance with housing. No one was pres-ent on behalf of Mr. and Mrs. Mitchell. According to the guide-lines for County General Relief, the payment of rent may be authorized only if it is necessary to alleviate a crisis situation. Due to the fact that no one was present on behalf of the Mitchells, a motion was made by Olson, seconded by Sanders to the deny request for hous-ing assistance. Roll Call: Aye: Olson, Sanders, Johnson. Nay: None.

County Treasurer Diane Scott and County Sheriff John Jenson presented the Distress Warrants Report. Treasurer Scott stat-ed that the 2013 taxes on Distress Warrant #86, Property ID #170129292, Raymond R. Walker; and Distress Warrant #90, Property ID #170106586, Rafael Zazueta were eligible to be stricken from the tax rolls. A motion was made by Sanders, seconded by Olson to strike the 2013 taxes on Distress Warrant #86 and Distress Warrant #90 from the tax rolls. Roll Call: Aye: Sanders, Johnson, Olson. Nay: None.

The Board reviewed an Application for Construction and Operating Permit for Animal Feeding Operation at E/2 Section 18, Township 15 North, Range 52 West of the 6th P.M., Cheyenne County, Nebraska. Planning and Zoning Administrator Colleen Terman was present. A motion was made by Johnson, seconded by Olson to forward the matter to the County Planning and Zoning Commission for its review and report back to the Board. Roll Call: Aye: Johnson, Olson, Sanders. Nay: None.

Next, the Board addressed the clarification of the rental fees for use of the Cheyenne County Pavilion. Jason Juracek, Gerald Frerichs and Anita Pennel from the Cheyenne County Fair Board were present. After a discussion, a motion was made by Sanders, seconded by Olson to set the rental fee for the Cheyenne County Pavilion at $400.00 plus a $500.00 depos-it. The $500.00 deposit will be refunded if the building is returned in the same condition as when rented. Roll Call: Aye: Olson, Sanders, Johnson. Nay: None.

The Board discussed wheth-er the use of the camping sites at the Cheyenne County Fairgrounds would be allowed other than at the Cheyenne County Fair and the annu-al Oktoberfest Celebration. A

motion was made by Olson, seconded by Sanders to not allow any use of the camping sites at the Cheyenne County Fairgrounds except during the Cheyenne County Fair and the annual Oktoberfest Celebration. Roll Call: Aye: Sanders, Johnson, Olson. Nay: None.

Use of the Fair buildings by Fair Board members was addressed. A motion was made by Olson, seconded by Sanders that all rental fees, cleaning fees and deposit fees would apply to anyone using the fair buildings. Roll Call: Aye: Johnson, Olson, Sanders. Nay: None.

Highway Superintendent Doug Hart updated the Board on road activities.

The Board reviewed an Engagement Letter from Donald Wilson for a necessary Federal Single Audit of the County for the fiscal year ending June 30, 2016. The cost of the Audit is $3,400.00. A motion was made by Sanders, seconded by Olson to approve the Engagement let-ter for the Federal Single Audit as reviewed. Roll Call: Aye: Olson, Sanders, Johnson. Nay: None.

The Board reviewed a Management Representation letter from Fred A. Lockwood & Co., P.C., regarding the Cheyenne County Keno audit for the period of July 1, 2015 through June 30, 2016. The amount of the audit is $3595.00. A motion was made by Sanders, seconded by Olson to approve the Management Letter as reviewed. Roll Call: Aye:Sanders, Johnson, Olson. Nay: None.
