Denise Wilkinson, Cheyenne County Chamber CEO/President presented the First Quarter Update for Chamber Activities/Economic Development Assistance re: 1. Chamber restructure; 2. Update on retail incentive assis-tant contacts and action; 3.Outline of other activities in assisting the Economic Development Director; and 4. Update on Hickory Square project. Denise also thanked the City and their employees for their assis-tance during recent events. She also shared that the Chamber’s Economic Development Chairman is Greg Huck.

Library Director Andrew Sherman presented the Annual Library Report which included statistics and results achieved for the fiscal year of October 2016 through September 2017. Highlights were: increase in both the physical and digi-tal use of the library with the addition of the NiMC/Sidney Create Makerspace and the Sun-Telegraph Digital Newspaper Archive; and grants for which they are applying. Goals for the coming year were also reviewed.

Paula Abbott and Melissa Norgard gave a presentation re: Western Nebraska Community College’s Innovation & Entrepreneurship Center and Panhandle Resource meetings for start-ups and entrepreneurs.

Human Resources Director Jo Houser pro-vided information regard-ing bonus and longevity pay that City employees received. Both ben-efits are outlined in our employee handbook and are figured on a percent-age based on the length of time an employee has been with the City. These benefits have been a part of the Employee Handbook for many years and is approved during the bud-geting process each year. She reported that she was asked about other commu-nities – some provide only longevity, some provide only bonuses. The respons-es are all over the board with various ways of calcu-lating, but the short answer was yes other communi-ties provide these bene-fits. Council comments as well as one member of the public, Paul Kampfe, were supportive of incentives to encourage good employ-ees to stay longer which seems to work for the City of Sidney as evidenced by the longevity of many of their employees. Council Member Olsen, as one of the newer council persons, said he was responsible for asking the question about longevity and bonuses so he was appreciative of the information in order for him to understand the employee’s handbook, etc.

Melissa Norgard, Economic Development Director, asked the City Council to consider a grant request be made to the State of Nebraska for Agri-Plastics Site and

Building Development Fund. The City of Sidney will be granted $200,000 from the State Economic Development which in turn would be granted to Agri-Plastics. Gaston moved, Olsen seconded “That the grant application and entering a contract with the State of Nebraska for Agri-Plastics be approved.” Roll call vote: Yeas: All council members present. Absent: Arterburn.

T r a n s p o r t a t i o n Coordinator Dave Doty presented information on a grant application for the Transportation Department with the State of Nebraska. In conjunction with same, Dave provided pertinent information about the ser-vices that the City provides with their Transportation Department. Jeff Ellwanger on behalf of the Sidney Shooting Park re-quested use of the exhibit and 4-H buildings, kitch-en and restrooms for the Shooting Park annual ban-quet on April 27 and 28, 2018. A motion was made by Sanders, seconded by Miller to approve the rental of the fair buildings as re-quested. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None.

Commissioner Miller re-ported that the “In God We Trust” sign had been placed in the Commissioners meeting room and would soon be placed above the door to the District Court-room.

At 8:05 A.M., a motion was made by Miller, sec-onded by Sanders to go into executive session to discuss performance evalu-ations for Highway Superin-tendent Doug Hart, Tourism Director Heather Haus-mann and Veterans Service Officer Ron Gusman. Roll Call: Aye: Johnson, Miller, Sanders. Nay: None. Also present in executive ses-sion were County Attorney Schaub and Clerk Fiegen-schuh. Due to the absence of Building & Grounds Su-perintendent Roger Conley, his performance evaluation was postponed.

County Attorney Paul Schaub updated the Board on the remodel project at 921 Hickory Street, Sidney, Nebraska. There was an Addendum to the project plan drawings and a copy was provided to all of the bidders. County Attorney Schaub requested that the Board formally approve the Addendum. Accordingly, a motion was made by Miller, seconded by Sanders to approve the Addendum to the project plan drawings regarding the remodel pro-ject at 921 Hickory Street, Sidney, Nebraska. Roll Call:

Next, the County Attor-ney addressed the correc-tion to the bidding instruc-tions which were previously approved by the Board. The correction that needs to be made on the instructions is under the Commercial Gen-eral Liability Insurance sec-tion. The original instruc-tions stated that products/completed operations cov-erage is to be maintained for two years after final payment. The language should be stricken from the instructions. A motion was made by Miller, seconded by Sanders to approve the change to the bidding in-structions as above stated. Roll Call: Aye: Johnson, Miller, Sanders. Nay: None.

Finally, the Board re-viewed an Addendum to the Independent Contrac-tor Agreement entered into on August 7, 2017 between Cheyenne County and Tim O’Connell wherein Mr. O’Connell agreed to act as the Project Coordinator for the remodel project. The termination date included in that Agreement was De-cember 31, 2017. The Ad-dendum would extend the deadline to June 1, 2018 to allow the Project Coor-dinator to complete his re-sponsibilities. Doug Hart, Highway Su-perintendent, presented Resolution 2018-4 request-ing the Board of Public Roads Classifications and Standards grant a relaxa-tion of Minimum Design Standards for vertical curves on project C-17-(188) located on CR 18 from RD L17E to CR 139 and CR 139 from CR 18 to Hwy 30 south and east of Sunol, Nebraska. A mo-tion was made by Miller, seconded by Sanders to adopt Resolution 2018-4 as presented. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None. Next, Superintendent Hart presented Resolution 2018-5 regarding the in-stallation of active warn-ing devices by Union Pacific Railroad at CR 91 and CR 131. County Assessor Sybil Prosser submitted an Ex-emption Application for Tax Exemption on Real and Personal Property by Quali-fying Organizations from High Plains PAW (People for Animal Welfare) Inc. The property is located on Lots 1 and 2, Block 3, Sioux Meadows Industrial Park, Cheyenne County, Nebraska. The property is being renovated and will be used as an animal rescue facility. Assessor Prosser is the President of the or-ganization and also the As-sessor who recommended approval of the exemption application. A motion was made by Miller, seconded by Sanders to table the approval or disapproval of the exemption application pending further research by the County Attorney. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None.

Next to be reviewed was an Exemption Application for Tax Exemption on Real and Personal Property by Qualifying Organizations from Community Shep-herds. The property is lo-cated on Lot 7A, a Re-plat of Lots 7, 8 and 9, Block 14 Carrow’s Second Addition to Dalton, Cheyenne Coun-ty, Nebraska. The property is used for community ac-tivities such as food distri-bution, Christian education classes, Community Bible Studies and a gathering place for the youth of the community. The application was previously approved by Assessor Prosser. A mo-tion was made by Miller, seconded by Sanders to approve the tax exemption for the Community Shep-herds. Roll Call: Aye: John-son, Miller, Sanders. Nay: None.

Christy Kettle did not appear to discuss the tax evaluation.

Don Miller, County con-tracted Public Defender, appeared to discuss a proposal for a new Public Defender Contract. Un-der the proposal, the term of the Contract would be from April 1, 2018 through March 31, 2020. The com-pensation would be the sum of $12,450.00 per month from April 1, 2018 through March 31, 2019. There would be a 3% in-crease in the compensa-tion from April 1, 2019 through March 31, 2020 making the total compen-sation at $12,823.50 per month. After a discussion, a motion was made by Miller, seconded by Sand-ers to approve the proposal for a new Public Defender Contract as discussed. Roll Call: Aye: Sanders, John-son, Miller. Nay: None. A complete copy of the Con-tract as approved is on file at the Office of the County Clerk.

The Board again ad-dressed the lease of a skid steer loader for the High-way Department. Super-intendent Hart reported that the lease amount of $5,200.00 per year from Nebraska Machinery Com-pany was for a 2 year lease period. A motion was made by Sanders, seconded by Miller to award the lease of a skid steer loader to Ne-braska Machinery Company in the amount of $5,200.00 per year for a term of 2 years. County Attorney Schaub stated that the demand letter received from Stein Monast, L.L.P., had been withdrawn. There was no discussion.

The next item to come before the Board was the discussion of the Memo-randum of Understanding between Cheyenne County and Cheyenne County Hos-pital Association regard-ing a 340B Drug Pricing Program. This matter was previously discussed at the January 16, 2018 meeting. At that time, the matter was tabled to allow County Attorney Schaub time to review the document. Julie Slagle, Vice-President of Patient Care Services at Sidney Regional Medical Center, was present to ad-dress any questions from the Board. County Attor-ney Schaub had reviewed the document and recom-mended approval. After further discussion, a mo-tion was made by Sand-ers, seconded by Miller to approve the Memorandum of Understanding as pre-sented. Roll Call: Aye: Mill-er, Sanders, Johnson. Nay: None.

County Attorney Schaub then requested approval of a Child Support Subgrant Agreement. The Agreement is between the Nebraska Department of Health and Human Services and Chey-enne County. This Subgrant allows the County to be re-imbursed for the percent-age of time and expenses attributable to child sup-port enforcement activi-ties. The Cheyenne County Board of Commissioners held an open and public special meeting on Tues-day, February 13, 2018 in the Cheyenne County Com-missioners Meeting Room, Cheyenne County Court House, 1000 10th Avenue, Sidney, Nebraska. A notice of this meeting was pub-lished in the Sidney Sun-Telegraph, aired on KSID Radio, posted on the bul-letin board in the County Court House and on the Cheyenne County web-site. A copy of the agenda was transmitted to each Commissioner, posted on the Court House bulletin board and on the Cheyenne County website and kept current and available to the

public at the County Clerk’s Office. In the absence of Chairman Darrell J. John-son, Vice-Chairman Philip E. Sanders called the meet-ing to order at 8:00 A.M., with the following present:
