BACKGROUND INFORMATION : Once a code enforcement action occurs and property owners: 1) have received notice of the violation, 2) have been provided an opportunity to correct, and 3) have failed to correct, the property owner is subject to fees established in Resolution No. 2006-248. Code Enforcement charges fees for costs related to time spent and actions performed abating public nuisances related to real property conditions. Property owners are notified both prior to and after fees are charged by certified mail and given an opportunity to appeal the fees. Per Elk Grove Municipal Code Chapter 16.18 and California Government Code Section 38773.5, any fees not paid are subject to a special 1

These special assessments may then be placed on the tax roll of the parcel by the Finance Director. The property will be subject to lien sale should the special assessment not be paid after three years. The attached Report identifies 275 properties that remain delinquent and identifies delinquent amounts to be recovered totaling $172,000. If full payment of any outstanding debt has been received by February 22, 2012, the Report will be amended to remove the parcel. FISCAL IMPACT: The special assessment levy on public nuisance abatement costs allows the City to recover funds spent in the enforcement of the Elk Grove Municipal Code. The placement of charges on the tax roll is found to be the most cost effective method of collection of unpaid fees. Utilizing the services of the County Tax Collector’s office to recover these fees saves the City both manpower and processing costs. To do otherwise would inhibit the City’s ability to recover much of the cost expended in abating public nuisances. The Fiscal Year 2011-12 administration cost of the levying and collecting of a new direct levy is expected to be a one-time charge of $50 plus $25.42 per levy, totaling approximately $7,000. This expense can be accommodated in the current approved budget. ATTACHMENTS:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK GROVE APPROVING AND CONFIRMING THE REPORT OF DELINQUENT SPECIAL

ASSESSMENT AND REQUESTING SACRAMENTO COUNTY TO COLLECT SUCH CHARGES ON THE FISCAL YEAR 2011-12 TAX ROLL

WHEREAS, the City of Elk Grove (the “City”) has adopted a Municipal Code to

establish standards for property maintenance; and

WHEREAS, the Elk Grove Municipal Code (EGMC) standards are intended to maintain public health and safety and quality of life for Elk Grove’s residents; and

WHEREAS, violations of the EGMC are enforced through notices, citations, fees and fines issued and assessed by the City’s Code Enforcement Division; and

WHEREAS, California Government Code section 38773.5 grants cities the authority to make costs related to abatement of nuisances a special assessment against a parcel; and

WHEREAS, EGMC Sections 16.18.1500 et seq. provide for the preparation of an abatement cost report and authorizes the Finance Director to impose a special assessment against delinquent property owners; and

WHEREAS, the below listed properties are delinquent in the payment of nuisance abatement costs and a notice of proposed action was mailed to the landowners listed in a report detailing such charges (Exhibit A) not less than ten days prior to the meeting; and

WHEREAS, at the time and place set forth in the notice this City Council held a hearing on the Report and duly considered all protests related thereto.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk Grove:

Section 1. Confirming the Report. The City Council directs the Code Enforcement Division to make any amendments to Exhibit A as necessary, removing parcels from Exhibit A for which payment has been made before February 22, 2012. The City Council hereby approves, confirms, and adopts Exhibit A, amended as authorized and attached hereto and incorporated herein by reference and determines that each such charge is proper and correct.

Section 2. Authorization. The City Council hereby directs the City Clerk to effectuate the delivery of a certified copy of the finalized report to the Sacramento County Auditor and to submit a certified copy of the Resolution (with Exhibit A) with the County Recorder for recordation.

Section 3. Services of Sacramento County. The offices of the Sacramento County Auditor and Sacramento County Recorder are requested to do any and all things necessary to provide for the placement of the charges on the tax roll and collecting said charges with the general taxes.

Section 4. General Authorization. The members of the City Council, the City Clerk, and the other officers of the City are hereby authorized and directed, individually and collectively, to do any and all things and to execute, deliver, and perform any and all agreements and documents that they deem necessary or advisable in order to effectuate the purposes of this Resolution. All actions heretofore taken by the officers and agents of the City that are in conformity with the purposes and intent of this Resolution are hereby ratified, confirmed, and approved in all respects.

Section 5. Effective Date. This resolution shall be effective on this 22nd day of February, 2012.
