TO THE HONORABLE JUDGE OF SAID COURT:

The City of Dallas, Ptaintiff (the "City''), files this Original Petition, Request for

Temporary and Permanent Injunction and Request for Disclosure and respectfully shows the

Court the following:

1. Discovery is intended to be conducted under Level 2 of Rule 190 of the Texas Rules of

Civil Procedure.

2. Defendants are requested to disclose, within fifty (50) days of service of this request, the

information and material described in Rule 194.2 of the Texas Rules of Civil Procedure.

II. PARTIES

3. The City is a home-rule municipal corporation situated in Dallas County, Texas,

incorporated and operating under the laws of the State of Texas.

4. Defendant Buckley Oil Company ("Buckley") is a corporation owning real property in

the City of Dallas, Dallas County, Texas. Service of process may be made upon Buckley

through its registered agent and president, Robert E. Dodson, at 1809 Rock Island Street, Dallas,

Texas 75207.

5. Defendant Rosebud Holding, L.L.C. ("Rosebud") is a limited liability company. owning

real property in the City of Dallas, Dallas County, Texas. Service of process may be made upon

Rosebud through its registered agent and president, Matthew Blake Harglove, at tO4 Corsicana

Street, Hillsboro, Texas 76645.

III. VENIJE AND JURISDICTION

6. The City brings this cause of action to obtain temporary and permanent injunctive relief

and recover civil penalties against Defendants pursuant to Subchapter B of Chapter 54 of the

Texas Local Government Code.

7. Venue is proper and this Court has jurisdiction pursuant to Section 54.013 of the Texas

Local Government Code.

IV. FACTS

8. Buckley owns and controls the land and structures on the properties located at 1803 and

1809 Rock Island Street (the "Buckley Properties"). Rosebud owns the property located at 1811

Rock Island Street where Buckley operates its business (the "Rosebud Property") (collectively

the "Properties").

9. The City's fire marshal has determined that various existing structures, facilities, and

conditions on the Properties constitute distinct hazards to life and property. Specifically, the

following violations of the Dallas Fire Code exist and/or have existed at the Buckley Property

including but not limited to:

1. Failure to provide and maintain approved required transfer and process transferoperations in violation of Section 3406.5.t through 3406.5.4.4.

2. Failure to separate tank vehicles and tank car transfer facilities by a distance of 25feet for Class I liquids and 15 feet for Class II and III liquids from buildings, above-ground storage tanks, combustible materials, property lines, public streets, publicalleys or public ways in violation of Section 3406.5.1.1.

Maintenance of weather protection canopies within 15 feet of a building or

combustible material and within 25 feet of building openings, property lines, public

streets, public alleys or public ways in violation of Section 3406.5.I.2.

4. Failure to prevent smoking and open flames around flammable and combustibleliquids in violation of Section 3404.2.4.

Failure to provide and maintain spill control and secondary containment designed

with a capacity capable of containing the capaclty of the largest tank compartment

located within an area in violation of Section 3406.5.1.5.

Failure to provide and maintain foam fire protection for aboveground storage tanksthat are less than 50 feet apart in violation of Section 3404.2.9.1.I.

Failure to prevent the accumulation of static charges during transfer operations inviolation of Section 3406.5.I.7.

Failure to remove ignition sources (such as wiring and electrical equipment) from anarea within 25 feet of a loading rack in violation of Section 3406.5.1.4.

Failure to provide and maintain all caps or plugs on all points of connection toprevent leaking or spilling of fluids from transfer pipes in violation of Section3406.5.3.r.

Failure to provide and maintain shutoff valves to portions of the piping system(specifically piping passing through fire rated walls) in violation of Section3406.5.3.rJ.

Failure to provide separation of tanks containing Class I or II liquids that arecompacted in three or more rows or in an irregular pattern in a diked area in violationof Section 3404.2.9.5.2.

Failure to provide guard posts or other approved barriers to protect piping, valves, orfittings from vehicle impacts in violation of Section 3403.6.4.

Failure to provide and maintain normal and emergency vents to discharge vaporsoutside and 5 feet away from building openings and property lines in violation ofSection 3404.2.7.3.3.

Failure to provide and maintain labels and placards identifying the materials withinall permanently installed or mounted tanks having more than 100 gallons in capacityfor the storage of Class I, II, or IIIA liquids in violation of Section3404.2.3.2.

Failure to demonstrate compliance with the National Fire Protection Association("NFPA") standards pertaining to flammable and combustible liquids and indicate thestandard used as a basis of design in violation of Section 3404.2.7.

18. Failure to provide and maintain spill control for outside use, dispensing, and handlingof flammable and combustible liquids in violation of Section 3405.3.8.1 through3405.3.8.3.

25. Failure to provide adequate overfill prevention in violation of Section 2206.6.2.3 formotor fuel-dispensing liquid storage tanks.

26. Failure to provide a proper fill-pipe connection in violation of Section 2206.6.2.2.

27. Failure to provide a spill container for each spill connection in violation of Section2206.6.2.6.

28. Failure to post waming signs and identification signs in the fuel-dispensing area thatclearly identify hazards in violation of Section 2205.6.

29. Failure to provide dispenser hoses and breakaway devices meeting the requirementsof Section 2206.7 .5 and 2206.7 .5.1.

30. Failure to provide an approved anti-siphon device in each external pipe connected toa tank when the pipe extends below the level of the top of the tank in violation ofSection 2206.6.2.4.

Failure to demonstrate acceptance testing of tanks prior to being placed into service in

violation of Section 3404.2.12.2.

Failure to demonstrate tanks have been placed into service with testing done in

accordance with Section4.4 of NFPA 30 and in violation of Section 3404.2.12.2.

Failure to demonstrate that piping has been pneumatically tested at lt}Vo of themaximum anticipated pressue or hydrostatically tested at t50%o of the maximumanticipated pressure and that all piping, valves, fittings, and ancillary equipment foruse with flammable or combustible liquids have been tested in violation of Section3403.6.2, Section 2206.6, and NFPA 30.

Failure to provide adequate fire department access roads and/or fire hydrantavailability in violation of Chapter 5, Section 3403.2.2., and Section 3504.2.2.

Failure to provide an emergency disconnect switch for external fuel dispensingoperations within 100 feet of, but not less than 20 feet from, the fuel dispensing areain violation of Section 2203.2.

Additionally, the following violations of the Dallas Fire Code exist and/or have existed at the

Rosebud Property including but not limited to:

36. Failure to provide adequate fire department access roads and/or fire hydrantavailability in violation of Chapter 5, Section 3403.2.2., and Section 3504.2.2.

Copies of the ordinances that Buckley and Rosebud have violated are attached.

10. These ordinances relate to:

a. The preservation of public safety, relating to the material or methods used to construct a

building or other structure or improvement, including the foundation, structural elements,

electrical wiring or apparatus, plumbing fixtures, entrances, or exits (Tex. Loc. Gov't Code $

54.012 (1)), and

b. the preservation of public health or to the fire safety of a building or other strucflre or

improvement (Tex. [-oc. Gov't Code $ 54.012 (2).

11. Persons other than Buckley and Rosebud and property other than that of the Buckley and

Rosebud's will continue to suffer adverse health impacts andlor risk substantial danger of injury

unless Buckley and Rosebud comply with these ordinances. Among other risks, there are many

storage tanks containing flammable and combustible liquids that are too close to each other. If

certain types of accidents occurred on the Property, the vast majority of the tanks could explode

and thereafter burn for many days. Such an event risks significant damage to the Property and

nearby properties, loss of life, air pollution, and contamination of the Trinity River.

V. CAUSE OF ACTION

12. Subchapter B of Chapter 54 of the Texas Local Government Code applies to these

ordinances.

13. Pursuant to Sections 54.0L6 and 54.018 of the Texas Local Government Code, the City

requests temporary and permanent injunctive relief, ordering Buckley and Rosebud to remedy or

repair the conditions of the Property to bring it into compliance with the Dallas City Code.

14. Pursuant to Section 54.017 of the Texas Local Govemment Code, the City requests civil

penalties not to exceed $1,000 per day for each violation of the ordinances.

VII. PRAYER

WHEREFORE, PREMISES CONSIDERED, the City, prays rhat court:

1) Grant the City temporary and permanent injunctive relief as requested herein;

2) Award the City with a judgment for civil penalties not to exceed $1,000 per day for

each violation on the Property;

3) Grant the City a judgment for all costs of court;

4) Grant the City a judgment for post-judgment interest at the highest legal rate; and

5) Grant such other and further relief, both general or special, at law or in equity, to

which the City may be justly entitled.

?2044 Supervision of dispensing. The dispensing of fuel atmotor fuel-dispensing facilities shall be conducted by a quali-fied attend'ant oi shall be under the supervision of a qualifiedattendant at all times or shall be in, accordance with Section2204.3.

?.2}4.2Attended self-service motor fuel-dispensing facili-ties. Attended self-service motor fuel-dispeising flitti"tshall comply with Sections 2204.2.1 through 2204.2.5.Attended self-service motor fuel-dispensing facilities shallhave at least one qualified attendant on duty while the facility isopen for business. The attendant's primary function shall be tosupendse, observe and control the dispensing of firel. Theattendant shall prevent the dispensing of fuel into containersthat do not comply with Section ,204.4,.L, control sources ofignition; give immediate attention to 4ccidental spills orreleases, and be prepared to use fue extinguishers.

2204.2.1 Special-type dispensers. Approved special-dis-pensing devices and systems such as, but not limited to,card- or coin-operated and remote-preset types, are allowedat motor fuel-dispensing facilities provided there is at leastone qualified attendant on duty while the facility is open tothe public. Remote preset-type devices shall be set in the"off'position while not in use so that the dispenser cannotbe activated without the knowledge of the attendant.

2204.2.2 Emergency controls. Approved emergency con-trols shall be provided in accordance with Section Z\OZ.Z.2204.2.3 Operating instructions. Dispenser operatinginstructions shall be conspicuously posted in approved loca--tions on every dispenser.

2204.2.4 Obstructions to view. Dispensing devices shallbe in clear view of the afiendant a{ all times. Obstructionsshall not be placed between the dispensing area and theattendant.

2204,2.5 Communications. The attendant shall be able tocommunicate with persons in the dispensing area at all!mcs. An approved method of communicating with the firedepartrrent shall be provided for the afiendant

2204.3 Unattended self-service motor fuel-dispensing facil-ities. Unattended sblf-service motor fuel-dispensing faiilitiesshall comply with Sections 2204.3.L through22A4.1-7.
