Date: Agenda Item No: July 27, 2020 City of Anderson Council Agenda Title/Description: Election of Mayor Pro Tem Request the election of Mayor Pro Tem for one-year term beginning July 2020. ______________________________________________________________________________ Executive Summary: The Anderson City Code specifies that the mayor pro tem shall be elected from the council membership and shall serve a term of one year. The mayor pro tem serves in the absence of the Mayor and as a representative of the City and Council at events, functions, speaking engagements and other such duties and responsibilities otherwise attached to the office of Mayor. As per Sec. 2-220. Mayor pro tempore.

(a) Prior to July 1st of each year, or as soon thereafter as may be practicable, the council shall elect from its membership a mayor pro tempore for a term of one year to run from July 1st to June 30th or until his or her successor is officially named and designated. The council shall elect the member who has served the longest period of time as council person and is willing to serve as mayor pro tempore. The person elected shall not serve consecutive terms. The person elected shall have a minimum of two years service on council. The person elected shall be succeeded by the person next in length of service who is willing to serve as mayor pro tempore. Should two members of council have equal service, the member with the earliest birth date shall serve first. The council shall have an election each year to name the next eligible member in the rotation. Should circumstances prevent the eligible member from serving, the member may maintain his position of seniority in the rotation for subsequent elections.

Based upon Sec. 2-220, the next Council member in rotation is Rick Laughridge, who is willing to serve as Mayor Pro Tem. ____________________________________________________________________________ Action Requested: X General Approval

City Council Work Session July 13, 2020

The City Council held a work session at 5:10 pm to receive an administrative report on the COVID-19 update. David Baker, Anderson County Emergency Management and AnMed CEO Bill Manson both provided City Council with updated information on the COVID crisis in Anderson County. City Manager David McCuen provided City Council with an update of the Anderson Strong Promise public campaign. The work session concluded at 6:15 pm and Council went into their Regular meeting.

Regular Meeting July 13, 2020

The regular meeting of City Council was held this date in City Hall Council Chambers at 6:25 pm. In attendance were Mayor Terence Roberts, Mayor Pro Tem Stewart, Council Members Thompson, Laughridge, Chapman, Harbin, Newton, John Roberts, and Jeff Roberts. Also, in attendance were City Manager, David McCuen; Assistant City Manager, Andrew Strickland; Finance Director, Margot Martin; City Attorney, Frankie McClain; City Planner, Jeff Guilbault, and Transit Director, Keith Scott. The invocation was given by Councilman Harbin and respect to the flag was given by Councilman John Roberts.

APPROVAL OF MINUTES A motion by Mayor Pro Tem Stewart seconded by Councilman Laughridge carried unanimously (9-0) to approve the minutes of both the June 22 2020 meeting and July 1, 2020 meeting as presented.

REQUEST SECOND READING OF ORDINANCE 20-17 AMENDING THE 2019 -2020 ANNUAL BUDGET

Finance Director, Margot Martin said City Staff requests approval of Ordinance 20-17 amending the 2019 - 2020 Annual Budget by increasing the General Fund budget $488,160 and Transit Fund Budget $ 62,394.

The City Council adopted the 2019-2020 Annual Budget by Ordinance 19-06 on June 24, 2019. This Budget amendment request is to reflect City Council approval of revenues and expenditures that occurred after the original budget was implemented. The Budget amendment includes:

(1) Increasing professional fees for the NuStrat Contact, as these additional revenues and commission fees were not in the original budget ($69,589)

(2) Increasing Transit fund budget to reflect capital grants from FTA and SCDOT for the purchase of a van ($62,394)

(3) Increasing Street repairs for the Ella Street Extension Rehabilitation project ($71,472), which was paid from unrestricted fund balances of General fund carried over from prior year

(4) Increasing Specialized supplies to purchase 30 Tasers ($9,341), which was paid from carry over of Pay Tel funds in detention

(5) Increasing Building department specialized supplies for View Point software ($12,751) (6) Reflecting use of General fund’s prior year E share funds for monies received in FYE 2019

but spent in FYE 2020 for a Dodge Durango ($28,767) (7) Increasing Confiscated funds revenue and related expenditures for 2 Ford F150’s

($76,240) (8) Increasing Special projects reflecting use of General fund unrestricted fund balance for

the purchase of parking lot at 118 E Earle Street ($220,000) These amendments allow the budget and audit to more accurately reflect actual revenues received and expenditures made that were unknown when the budget was originally adopted. Therefore, comparisons between budget and actual are more meaningful. City Council gave approval on first reading June 22, 2020. A motion by Councilman Chapman seconded by Councilman Newton carried unanimously (9-0) to approve Ordinance 20-17 amending the 2019-2020 Annual Budget by increasing the General Fund budget $488,160 and Transit Fund Budget $ 62,394 on second reading. REQUEST CONSIDERATION OF AN ORDINANCE TO REZONE 304 EAST HIGHLAND AVENUE

FROM RM-10, MULTI-FAMILY RESIDENTIAL TO LO, LIMITED OFFICE City Planner, Jeff Guilbault stated that the applicant is seeking to rezone the subject property in order to operate a day spa. LO, Limited Office allows low-intensity commercial uses that are compatible with a neighboring residential environment, and a day spa fits into this zoning classification. The current use of the property is a single-family dwelling. Surrounding zoning along East Highland Avenue includes both RM-10, Multi-Family Residential and LO, Limited Office.

The Planning Commission considered this request at their July 7th meeting and recommended approval. If rezoned, all applicable building codes and parking guidelines must be met. A motion by Mayor Pro Tem Stewart seconded by Council member Thompson carried unanimously (9-0) to approve an ordinance to rezone 304 East Highland Avenue from RM-10, Multi-Family Residential to LO, Limited Office on first reading.

REQUEST CONSIDERSATION OF AN ORDINANCE TO REZONE 1310 EAST RIVER STREET FROM GC, GENERAL COMMERICAL TO HI, HEAVY INDUSTRIAL

City Planner, Jeff Guilbault stated that the applicant is seeking to rezone the subject property in order to operate an automotive repair business along with towing and a storage yard for vehicles. Although the current zoning allows an automotive service station as a conditional use, the guidelines require that operations involving repairs, bodywork, painting, salvage or storage of automotive vehicles must be conducted within a fully enclosed building. In addition, outdoor storage of junk, scrap, unlicensed, uninspected, wrecked, crushed, dismantled, or partially dismantled automotive vehicles are prohibited. The applicant has expressed the need to store such vehicles in the vacant area of the property. In order to conduct a business with this type of automotive storage, a HI, Heavy Industrial zoning classification is required. No HI zoning exists in the general area, so it would be considered a spot zone. The Planning Commission considered this request at their July 7th meeting and recommended denial. Since East River Street is a major corridor into the City and because the uses in the area are predominately commercial and residential, HI, Heavy Industrial land uses do not fit.

A motion by Mayor Pro Tem Stewart seconded by Councilman Newton carried unanimously (9-0) to deny approval of an ordinance to rezone 304 East Highland Avenue from RM-10, Multi-Family Residential to LO, Limited Office on first reading.

REQUEST CONSIDERATION OF AN ORDINANCE TO REZONE 500 BLECKLEY STREET FROM RM-10, MULTI-FAMILY RESIDENTIAL TO NC, NEIGHBORHOOD COMMERCIAL

City Planner, Jeff Guilbault stated that the applicant is seeking to rezone the subject property in order to operate a car wash/hand detailing business on the site. On the parcel is a commercial-

style building but the zoning currently does not allow for commercial uses. Previously, this building occupied a non-conforming hair salon. The proposed NC, Neighborhood Commercial zoning allows for a variety of residential, office and lower intensity retail uses. This zoning is the lowest level of commercial zoning that allows a car wash. The applicant, Torre Donaldson, was present.

The Planning Commission considered this request at their July 7th meeting and recommended approval.

A motion by Council member Thompson seconded by Councilman Laughridge carried unanimously (9-0) to approve an ordinance to rezone 500 Bleckley Street RM-10, Multi-Family Residential to NC, Neighborhood Commercial on first reading.

REQUEST CONSIDERATION OF AN ORDINANCE TO ANNEX AND ZONE 1.78 ACRES GENERALLY LOCATED AT SOUTHWOOD STREET AND CRESCENT DRIVE TO RM-10, MULTI-FAMILY

RESIDENTIAL, AND TO REZEONE AN ABUTTING 3.2 ACRE PARCEL FROM R-5, SINGLE FAMILY RESIDENTIAL TO RM-1O, MULTI-FAMILY RESIDENTIAL

City Planner, Jeff Guilbault stated that the applicant is seeking to rezone property that is currently inside the City and to annex additional property in order to construct a 40-unit townhouse development. RM-10, Multi-Family Residential allows up to 10 units per acre, so this classification permits the number of units that are proposed. This site has multiple street frontages and is in close proximity to properties zoned R-5, Single-Family Residential, RM-10, Multi-Family Residential and NC, Neighborhood Commercial. Although a conceptual plan has been created, final site drawings will be reviewed by staff, if rezoned. The Planning Commission considered this request at their July 7th meeting and recommended approval

A motion by Councilman Jeff Roberts seconded by Councilman Harbin carried unanimously (9-0) to approve an ordinance to annex and zone 1.78 acres generally located at Southwood Street and Crescent Drive to RM-10, Multi-Family Residential, and to rezone an abutting 3.2 acre parcel from R-5, Single Family to RM-10, Multi-Family Residential on first reading. Mayor Pro Tem Stewart requested that the parking issues are addressed when bringing this item back for second reading.

REQUEST CONSIDERATION OF AN ORDINANCE TO REZONE 796 AND 798 WILSON STREET FROM R-15, SINGLE FAMILY RESIDENTIAL TO RM-18, MULTI-FAMILY RESIDENITAL

City Planner, Jeff Guilbault stated that the applicant, Anderson University, wishes to rezone the single-family dwellings that are in their ownership in order to better utilize them for university-related uses. The requested zoning of RM-18, Multi-Family Residential will allow them more flexibility and is also consistent with the majority of their campus. Currently, the University houses 4 students in each of the dwellings, which is permitted under the City’s single-family zoning guidelines. Their current plans are to increase the number of students in each dwelling, possibly adding two additional people in one house and 4 more in another house. Because the houses are controlled by the University, they intend to limit the number of vehicles to two per house. The remaining vehicles will be parked elsewhere in designated campus parking lots. The Planning Commission considered this request at their July 7th meeting and recommended approval. If rezoned, any building code items due to the increase in occupancy must be met. Omar Rashed spoke on behalf of Anderson University and explained about the possible development of parking area behind the houses. A motion by Councilman Jeff Roberts member seconded by Councilman John Roberts carried unanimously (9-0) to approve an ordinance to rezone 796 and 798 Wilson Street from R-15, Single Family Residential to RM-18, Multi-Family Residential on first reading. REQUEST CONSIDERATION OF AN ORDINANCE TO REZONE 209-217 WILLIAMSTON ROAD FROM

RM-10, MULTI-FAMILY RESIDENITAL TO RM-18, MULTI-FAMILY RESIDENTIAL

City Planner, Jeff Guilbault stated that the applicant, Anderson University, wishes to rezone the subject properties that are currently in use as residence halls (Stringer Commons). Although the current zoning of RM-10, Multi-Family Residential allows the existing residence halls, the University wishes to change it to RM-18, Multi-Family Residential in order to develop a more consistent zoning pattern for the campus properties. The Planning Commission considered this request at their July 7th meeting and recommended approval.

A motion by Councilman Harbin seconded by Council member Thompson carried unanimously (9-0) to approve an ordinance to rezone 209-217 Williamston Road to RM-18, Multi-Family Residential on first reading.

REQUEST CONSIDERATION OF AN ORDINANCE TO REZONE APPROXIMATELY 4.27 ACRES AT 328 KINGSLEY ROAD FROM R-15, SINGLE FAMILY RESIDENTIAL TO RM-18, MULTI-FAMILY

RESIDENTIAL

City Planner, Jeff Guilbault stated that the applicant, Anderson University, is seeking to rezone the 4.27-acre property in order to operate their campus ministries program. A single-family dwelling is located on the site, which will be converted to office/university space to meet their needs. RM-18, Multi-Family Residential zoning is requested because it allows uses associated with colleges and universities and is their predominant zoning classification. The property abuts RM-18 zoned property owned by Anderson University. Other abutting properties are zoned R-15, Single-Family Residential, so any changes to the site must adhere to the City’s landscaping/screening guidelines. The Planning Commission considered this request at their July 7th meeting and recommended approval. If rezoned, all building codes and site-related requirements must be met. A motion by Councilman Chapman seconded by Councilman Laughridge carried unanimously (9-0) to approve an ordinance to rezone 328 Kingsley Road from R-15, Single-Family Residential to RM-18, Multi-Family Residential on first reading.

REQUEST APPROVAL TO PURCHASE TWO NEW TRANSIT BUSES

Transit Director, Keith Scott, requests approval to purchase two new transit buses. One CNG (Compressed Natural Gas) bus, 35 ft. low floor and one Diesel bus, 32 ft. low floor for regular service routes. The City Transit system has eight buses in its fleet. An Invitation for Bid was advertised, with Creative Bus Sales/El Dorado National being the only bidder. This purchase is part of the City’s bus replacement plan. The 35 ft. CNG bus will replace a 2011 El Dorado National 32 ft. diesel bus that has met its FTA useful life of ten years and 350,000 miles. The new 32 ft. diesel bus will be added to the fleet for expansion. Both buses are ADA accessible with bike racks. The fleet will now consist of nine buses.

By replacing one bus that has met its useful life, maintenance cost will be reduced. The City of Anderson is the only system in the SC to operate CNG transit buses. Fuel costs will be reduced by using natural gas buses on shorter routes, while the diesel bus will operate more efficiently and get better gas mileage on the longer routes. The total cost of these buses is $848,647. Federal Transit Administration (FTA) CARES ACT grant funds will pay 100% of $848,647 on the buses. There will be no local cost to the City. All FTA CARES ACT grant funds have been approved and are available for use. A motion by Councilman Chapman seconded by Councilman John Roberts carried unanimously (9-0) to approve the purchase of two transit buses for $848,647. Prior to adjournment, Mayor Pro Tem Stewart requested the City staff bring back a face covering ordinance for council’s consideration. City Manager McCuen stated he could email several draft options for council to consider. Mayor Terence Roberts encouraged council to contact the local delegation and encourage a state wide face covering mandate. The City Election will be July 14, 2020. The original election was moved from April 2020 due to COVID-19 as an order from the Governor.

ORDINANCE NO. 20-18 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF ANDERSON TO AMEND THE CITY OF ANDERSON ZONING ORDINANCE BY REZONING 304 EAST HIGHLAND AVENUE FROM RM-10, MULTI-FAMILY RESIDENTIAL TO LO, LIMITED OFFICE. WHEREAS, the City of Anderson has been petitioned by Cynthia Whitfield to rezone 304 East Highland Avenue from RM-10, Multi-Family Residential to LO, Limited Office which is more specifically described as follows: All that certain piece, parcel or lot of land, with all improvements thereon, situate, lying and being in the County of Anderson, State of South Carolina, fronting seventy-five and eight tenths feet on Highland Avenue, and running back to a depth of 122 feet along the Southern boundary line, having a width in the rear of 75 feet, running back to a depth along the Northern boundary line of 129.4 feet; being known and designated as Lot No. Two (2) on a plat of C.C. Andrews, Surveyor, recorded in the Office of the Clerk of Court for Anderson County, SC in Plat Book 20 at page 61.

WHEREAS, the City of Anderson Planning Commission reviewed the petition and

recommended approval of the request. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF ANDERSON THAT:

1. The Zoning Ordinance of the City of Anderson, dated January 12, 1998, and amendments thereto, be amended by rezoning 304 East Highland Avenue from RM-10, Multi-Family Residential to LO, Limited Office.

2. All ordinances or parts of ordinances inconsistent or in conflict with the provisions of this ordinance are hereby repealed to the extent of such inconsistency or conflict.

3. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Anderson.

WHEREAS, the City of Anderson has been petitioned by Torre Donaldson to rezone 500 Bleckley Street from RM-10, Multi-Family Residential to NC, Neighborhood Commercial which is more specifically described as follows: Beginning at a point in the concrete at the intersection of Bleckley Street and Tribble Street and running along Bleckley Street S79 42 39W for a distance of 60.54 feet to a corner; thence turning and running N18 56 14W for a distance of 88.62 feet to a corner; thence turning and running N75 34 46E for a distance of 60.04 feet to a ½ pin; thence turning and running along Tribble Street S18 56 14E for a distance of 93 feet to the point of beginning.

WHEREAS, the City of Anderson Planning Commission reviewed the petition and recommended approval of the request. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF ANDERSON THAT:

Title/Description: Old Business Request: Consideration of Ordinance 20-21 to rezone 796 and 798 Wilson Street from R-15, Single-Family Residential to RM-18, Multi-Family Residential. ________________________________________________________________________ Executive Summary: Background: The applicant, Anderson University, wishes to rezone the single-family dwellings that are in their ownership in order to better utilize them for university-related uses. The requested zoning of RM-18, Multi-Family Residential will allow them more flexibility and is also consistent with the majority of their campus. Currently, the University houses 4 students in each of the dwellings, which is permitted under the City’s single-family zoning guidelines. Their current plans are to increase the number of students in each dwelling, possibly adding two additional people in one house and 4 more in another house. The applicant is actively working with city staff to develop plans for a parking lot behind the houses in order to accommodate residents. If the total number of new spaces cannot accommodate all the vehicles for the residents, the remaining ones will be parked elsewhere in designated campus parking lots. Title/Description: New Business Request consideration to amend the City of Anderson’s Sewer Use Ordinance (SUO). ______________________________________________________________________________ Executive Summary: Request: The Utilities Division requests consideration of an ordinance amending Ordinance 19-02 to comply with comments received as part of our SCDHEC Pretreatment Program Update. Background: Article II of this ordinance pertains to the Sewers and Sewage Disposal. Specifically, this ordinance includes the permissive and prohibited use of Public Sewer, sewer extension policies, fees, requirements for non-domestic wastewater (industrial, commercial, and food service establishments) as well as enforcement and penalties for violations to the ordinance.

The Pretreatment Update has received the general approval of SCDHEC. As part of the review of the SUO in our Pretreatment Program update submittal, SCDHEC is requiring a minor change to Section 34-10, paragraph C, regarding Specific Prohibitions as follows:

5. Any liquid wastes in which the concentration of pollutants exceeds those listed in Division 4, Sec. 34-28 except as otherwise specified in an industrial wastewater discharge permit.

As required, a legal notice was publicly advertised for 30 days to make the entire Pretreatment update along with this SUO change available for comment. No comments were received. Benefit: The approval of this change to the SUO completes the requirements for SCDHECs official approval. Date: July 27, 2020 Agenda Item No: B-2 City of Anderson Council Agenda Title/Description: New Business Request consideration of a proposal for professional engineering services regarding the Year 3 Continuing Sewer Assessment Program. ______________________________________________________________________________ Executive Summary: Background: In June 2014, the City began to develop several Capacity, Management, Operation and Maintenance (CMOM) programs with the goal to eliminate all discharges of untreated wastewater known as Sanitary Sewer Overflows. One of the programs involves assessing the sewer system using various techniques. The goal of this program is to assess 10% of the system each year. On average, this equates to 27 miles of sewer line and over 600 manholes each year. Plans include CCTV assessment of approximately 17 miles of gravity sewer and 400 manholes. The assessment data is used to prioritize future capital projects under the Infrastructure Rehabilitation Program. The City requested proposals from three engineers-of-record, and we received two proposals. Our wastewater department crews will perform the balance of the required 10% assessment using CCTV, SLRAT, flow monitoring and smoke testing techniques. Benefit: Moving forward with this project will allow the City to meet the goals of the CMOM programs. Funding: The Continuing Sewer Assessment Program is funded in the FY21 Sewer Lines budget. Recommendation: Approve the proposal from Design South Professionals in the amount of $54,610.00 __________________________________________________________________________ Action Requested: X General Approval
