MINUTES OF THE CITY COUNCIL REGULAR AND EXECUTIVE SESSIONS HELD DECEMBER 12, 2017 IN THE CITY HALL COUNCIL CHAMBERS, 303 PALO PINTO STREET, WEATHERFORD, TEXAS. INVOCATION Pastor Jon Reeves of The Oaks United Methodist Church led the invocation. CALL TO ORDER & ANNOUNCEMENT OF A QUORUM Mayor Craig Swancy called the meeting to order at 6:30 p.m. Present were: Mayor Craig Swancy, Mayor Pro Tem Jeff Robinson, Heidi Wilder, Dale Fleeger, and Kevin Cleveland. City staff included: City Manager Sharon Hayes, Deputy City Manager James Hotopp, Assistant City Manager Brad Burnett, City Attorney Ed Zellers, and City Secretary Malinda Nowell. PLEDGES OF ALLEGIANCE TO THE UNITED STATES & TEXAS FLAGS Mayor Swancy led the pledges. ITEMS OF COMMUNITY INTEREST City Manager Sharon Hayes spoke about Holiday in the Park which was held on December 8th. Ms. Hayes stated this was the fourth year and that there were approximately 8,000 visitors to the event. CONSENT AGENDA ITEMS On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to approve the following items on the Consent Agenda. Motion carried 5 - 0.

• Approved the minutes of the City Council meeting held November 14, 2017. • Acted upon a request from the Municipal Utility Board to approve an Interlocal Agreement with

Parker County for reimbursement of three easements necessary for the construction of the CenterPoint Waterline Relocation project.

• Acted upon a request from the Weatherford Municipal Utility Board to adopt Ordinance 881-2017-65 to release and abandon three City of Weatherford utility easements - recorded in Book 2719, Page 505; Book 2733, Page 590; and Book 2708, Page 1816, Deed Records, Parker County, Texas - in exchange for three new easements; and authorize the City Manager to execute a quitclaim deed for the three abandoned easements to the Texas Department of Transportation. The ordinance is captioned as follows:

Hold a PUBLIC HEARING and consider approval of ordinance 882-2017-66, a zoning change for property currently zoned R1 One-Family Residential to R1 One-Family Residential with a Conditional Use Permit (CUP) for an accessory structure larger than 400 square feet for property located at 317 W Owens Street, and described as being 4.257 acres out of the P.S. Hall Survey, Abstract 659, City of Weatherford, Parker County, Texas. ZCH2017-0034. Development and Neighborhood Services Director Craig Farmer presented this item. Mr. Farmer stated that an adjacent property owner voiced concern that the accessory structure might be used for commercial business or as a business storage facility. The Planning and Zoning Commission (PZC) approved the CUP with the following conditions: 1) The structure shall be 75 percent masonry siding, or shall match the main house lap-siding; 2) The structure shall not be used as a residence, or living quarters, or for a commercial business; 3) The structure shall not have separate utilities; 4) The structure shall not be used for commercial business storage of any kind. Mayor Swancy opened the public hearing at 6:37 p.m. As there were no speakers, Mayor Swancy closed the hearing at 6:37 p.m. On the motion of Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve the Conditional Use Permit with the stated conditions. Motion carried 5 - 0. The ordinance is captioned as follows:

ORDINANCE 882-2017-66 AN ORDINANCE AMENDING THE ZONING DISTRICT BOUNDARIES OF THE ZONING DISTRICT MAP OF THE CITY OF WEATHERFORD, TEXAS, CONCERNING CERTAIN PARCELS OR TRACTS OF LAND IDENTIFIED IN AS BEING 4.257 ACRES OUT OF THE P.S. Denton Street, and described as being a part of Lots 3, 4, 5, and 6 in Block 2 of the Millsap Addition, an addition to the City of Weatherford, Parker County, Texas. ZCH2017-0035. Mr. Farmer presented this item as well. This property is located on the northwest corner of North Denton Street and Fort Worth Highway. The request is for a CUP for a bail bondsman on the rear of the property. The frontage of the same parcel is a used car lot. The used car lot had some high weeds and grass; however, since the PZC meeting, the owner has cleaned it up. This parcel is approximately two blocks east of the Parker County Jail. Mayor Swancy opened the public hearing at 6:40 p.m. As there were no speakers, Mayor Swancy closed the hearing at 6:40 p.m. Council discussed the drive/entrance to the property. The front of the property proposed for use as a bail bondsman fronts on Denton Street. The CUP, if approved, would extend for the entire lot, not just the portion that is presently being requested for use as a bail bondsman.

On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to approve the ordinance for the property zoned commercial to C1 commercial with a CUP with the addition that it is only for the back 150 feet that fronts on Denton Street. Motion carried 5 - 0. The ordinance is captioned as follows:

ORDINANCE 883-2017-67 AN ORDINANCE AMENDING THE ZONING DISTRICT BOUNDARIES OF THE ZONING DISTRICT MAP OF THE CITY OF WEATHERFORD, TEXAS, CONCERNING CERTAIN PARCELS OR TRACTS OF LAND IDENTIFIED IN AS BEING A PORTION OF LOTS 3, 4, 5, AND 6 IN BLOCK 2, MILLSAP ADDITION, AND LOCATED AT 104 N. DENTON STREET WITHIN THE CORPORATE LIMITS OF THE CITY OF WEATHERFORD, TEXAS; HERETOFORE ZONED C1 COMMERCIAL SHALL HENCEFORTH BE ZONED C1 COMMERCIAL WITH A CONDITIONAL USE PERMIT (CUP) FOR BAIL BONDS, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; AND PROVIDING A SAVINGS CLAUSE. Hold a PUBLIC HEARING and consider approval of ordinance 884-2017-68, a zoning change for property currently zoned AG Agricultural to a PD Planned Development for Multi-Family for property located at approximately the 300 block of Kirkpatrick Drive, and described as being the north 14.204 acres situated in and being a portion of the T.W. Beall Survey, Abstract 166, City of Weatherford, Parker County, Texas. ZCH2017-0036 Mr. Farmer presented this item as well. This tract of land sits on Kirkpatrick Drive. The applicant is proposing approximately 249 units; the density is approximately 18 units per acre. A draft ordinance with very tough standards was provided in the agenda packet. There are no efficiency apartments, 46 percent are one-bedroom, 42 percent are two-bedroom, and 13 percent are three-bedroom. The development will have fewer garages and fewer carports. The layout of the buildings is dictated by the terrain. The applicant proposes a detention pond, a pool, a recreation area, and other amenities. Kirkpatrick Drive will be extended to the west so that the development can access it for their public safety emergency access. The applicant has no plans for an exit from the north of the property. There are some terrain issues and ultimately a major street will run along the north of the property. Kirkpatrick Drive will be extended for the emergency access and eventually will extend all the way to Bethel Road. The development will be built in two phases, but overall, the request is for approval of the 249 units, and as much as 336 eventually. The presented site plan includes phases I and II. Council discussed the means of ingress/egress. Fire Marshal Bob Hopkins stated that the Fire Department preliminarily reviewed this proposal. Mr. Farmer stated that this property is one parcel, so it does not fall into the single-family category requiring a second way in/out, but that the fire code states with 200 or more units, there must be a second means of emergency access. Deputy City Manager James Hotopp stated that staff has discussed with the applicant the ability to connect to the future arterial to the north whenever it is developed. The applicant desires to connect to that future arterial. Mr. Hotopp also stated that the proposed development and layout is typical of other apartment complexes in Weatherford and the surrounding area. Mr. Farmer stated that none of the adjacent properties have any road systems, so it would be a "guess" as to where to provide stub-outs in this development, and they would not connect to anything for a long time. Mr. Hotopp estimated the timeline for the development of the arterial would be five to ten years depending on development that occurs in the area and the availability of capital. The City does have plans for an arterial in that area; it starts on the north side of Wal-Mart, continues through this property extending all the way to Bethel Road. Mr. Hopkins stated the fire code requires a second egress, but it does not specify the distance between egresses. Mr. Hotopp noted that the City is discussing right-of-way dedication with the adjacent property owner so that the City can build out the remainder of Kirkpatrick Drive as part of a Tax Increment Reinvestment Zone (TIRZ) project. This development is located within the TIRZ area and will have a substantial impact. If Kirkpatrick Drive is extended all the

way to Bethel Road, it would open the area for additional development. Fire Chief Paul Rust clarified that regardless in which building a person resides, they can exit that building and have two paths by which to make their way to the main or secondary entrance/exit of the complex. Council further discussed the idea of a stub-out towards the back of the property. Mr. Farmer suggested leaving the exact location of that stub-out up to the applicant. Mayor Swancy opened the public hearing at 7:01 p.m. As there were no speakers, Mayor Swancy closed the hearing at 7:01 p.m. On the motion of Heidi Wilder, second by Dale Fleeger, the Council voted unanimously to approve this item. Motion carried 5 - 0. The ordinance is captioned as follows:

ORDINANCE 884-2017-68 AN ORDINANCE AMENDING THE ZONING DISTRICT BOUNDARIES OF THE ZONING DISTRICT MAP OF THE CITY OF WEATHERFORD, TEXAS, CONCERNING CERTAIN PARCELS OR TRACTS OF LAND IDENTIFIED IN AN APPROXIMATELY 14.20ACRE TRACT OF LAND OUT OF THE T.W. BEALL SURVEY, A-166, LOCATED IN THE 300 BLOCK OF KIRKPATRICK DRIVE WITHIN THE CORPORATE LIMITS OF THE CITY OF WEATHERFORD, TEXAS; HERETOFORE ZONED AGRICULTURE SHALL HENCEFORTH BE ZONED PD PLANNED DEVELOPMENT FOR R3 MULTI-FAMILY USES, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; AND PROVIDING A SAVINGS CLAUSE. Hold a PUBLIC HEARING and consider approval of ordinance 885-2017-69, a zoning change for property currently zoned R2 Two-Family Residential to R1 One-Family Residential for property described as being all of Lot 3, Block 1, Tower Street Addition No. 2, recorded in Plat Cabinet C, Slide 102 and all of Lots 1 through 6; Lots 9 through 19 and a portion of Lot 7, Block 1; all of Block 2 and Clover Circle, Prince and Park Addition, an addition to the City of Weatherford, and a 0.08 acre tract of land situated in the Oliver Davis Survey, Abstract 372, in the City of Weatherford, Parker County, Texas. ZCH2017-0037. Mr. Farmer presented this item as well. This parcel is approximately seven acres. The applicant is proposing a unique subdivision with approximately 32 single-family lots. This zoning case is for SF1 (single-family 1) which has a 6,500 square-foot lot minimum. The threshold for a mandatory second way in/out is 50 units. Mayor Swancy opened the public hearing at 7:04 p.m. As there were no speakers, Mayor Swancy closed the hearing at 7:04 p.m. The ordinance is captioned as follows:

SBD2017-0036. Mr. Farmer presented this item as well. The applicant is proposing nine two-acre lots. This is a rural subdivision and the applicant was allowed waivers on water and sewer. The PZC recommended approval at their last meeting. On the motion of Heidi Wilder, second by Dale Fleeger, the Council voted unanimously to approve the final plat. Motion carried 5 - 0. Consider a request to Master Plat the Cedar Mountain Estates, located west of Tucker Drive just north of Azle Hwy. more generally described as being approximately 94 acres of land situated in the Martha E. Tucker Survey, Abstract No. 2510, Extra-Territorial Jurisdiction, Parker County, Texas. SBD2017-0045 Mr. Farmer presented this item. The subject property has 41 lots, each of which is two acres or more. The Fire Department is comfortable with the emergency access because the fire code does not extend into the City's ETJ. The subdivision ordinance does apply outside the City limits and that threshold is 50 dwelling units for the required second ingress/egress. The PZC recommended approval subject to the developer providing an additional access point to the west since the proposed road to the south is so far in the future. This plat is located in ESD1 and does not affect the Weatherford Fire Department. On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to approve the master plat. Motion carried 5 - 0. Consider a request to Final Plat the Heights of Weatherford, Phase 2, located south of B.B. Fielder Drive, and west of Bethel Road, more generally described as being approximately 37.388 acres of land situated in the John Davis Survey, Abstract No. 349, City of Weatherford, Parker County,

Texas. SBD2017-0054 Mr. Farmer presented this item as well. This plat is approximately 215 lots and is the next phase in the Heights of Weatherford. Mr. Farmer mentioned traffic flow improvements for the area including the traffic signal at BB Fielder and Bethel Road, the extension of Kaitlyn Drive near the new Gunn Honda Dealership, and the extension of BB Fielder Road west to Dennis Road. All required public improvements are in place and the PZC recommended approval at their last meeting. Mark Donahue with Donahue Consulting spoke as the project engineer. Mr. Donahue stated that there is a split in the size of the lots. Some of the lots are 60 x 120 and others are 50 x 110. Generally, it works out to a 60/40 split with 60 percent smaller lots and 40 percent larger lots. On the motion of Jeff Robinson, second by Dale Fleeger, the Council voted unanimously to approve the final plat. Motion carried 5 - 0. Discussion of changes and recommendation for adoption of the General Plan. Mr. Farmer presented this item as well. He provided a quick overview of the chapters. The PZC has not made a recommendation to the Council yet. Mr. Farmer will bring some changes to the PZC at their January 10th meeting and Council will receive the final draft at their January 23rd meeting. Chapter 12 is the implementation chapter and it has been reduced to the top 25 priorities out of 100. Mr. Farmer is working on a strategy to implement the Council's strategic plan priorities and the City Manager's and City Council's priorities into chapter 12. Discuss and consider acceptance of the final report regarding the 2017 comprehensive compensation study and analysis conducted by Ray and Associates. City Manager Sharon Hayes presented this item. Ms. Hayes stated that Katherine Ray of Ray and Associates gave a presentation to the Council at the November meeting. Diana Allen, Director of Human Resources, provided details about the process that she and Tim Todd, Communications and Marketing Coordinator, went through with Ms. Ray during this study. Ms. Allen stated that of the 12 comparison cities the Council chose, Lancaster was the only one from whom we could not obtain data. Ms. Allen stated that she is very comfortable with the final document and staff's ability to use it moving forward. Ms. Hayes stated that it was important for the City to undergo this process so that we could determine where all the positions fell within the market. One area for correction was the fact that some of the pay ranges were more out of line than the actual salaries. Obtaining information from other cities delayed our study by several weeks. Ms. Hayes mentioned the issue with compression within some positions. During the budget process, Council budgeted three percent for pay adjustments resultant from this study. Ms. Ray's recommendation was 3.1 percent. Implementation is doable at this time since the Council budgeted three percent for the 12-month Fiscal Year and only nine months remain in this Fiscal Year. Ms. Hayes briefly reviewed Ms. Ray's recommendations which were as follows: 1) adopt classification recommendations; 2) adopt the recommended Fiscal Year 2017-2018 Pay Schedules; 3) authorize salary adjustments for those employees whose newly adjusted current salary is still below the market-based recommended entry level for the position; 4) approve additional adjustments recommended by the City Manager to alleviate compression; 5) in future years, beginning in the 2018-2019 Fiscal Year, make annual across-the-board adjustments, even if they are small, based on a percentage of base pay, and that those adjustments always be applied to each of the City’s pay schedules; 6) employees whose documented performance is not acceptable should be given a limited amount of time to bring their performance up to acceptable levels before receiving a market adjustment; and 7) conduct a detailed benefits survey, using the same cities used in this salary survey, to determine whether its benefits package is competitive. Ms. Hayes suggested the implementation of a policy to help the City maintain better control of positions and salaries moving forward.

Discussion included that this is a good study; that it answers a lot of questions; that it was lengthy and there was not enough time to read all of it; that all cities’ comparison data was averaged together; that some positions were over market and will be frozen and will not receive a cost of living adjustment (COLA) or a merit increase until such time as the market has caught up with those positions; the potential effect this will have on the next budget year; that the steps within the pay scale will occur annually if funds are available; that the step increases should be one of the first pieces of the budget planning process every year; that each year after this is a 2.5 percent increase if the employee is eligible; that police and fire do not have as many steps so they will top out sooner; that if there is a shortage one budget year and the 2.5 percent steps cannot be accommodated then an across-the-board COLA would be the better option; that if the City falls on tough economic times we may not be able to stick to the plan; that employees are the most important asset of the City; that if the City consistently gives a 2.5 percent step then we should stay within the market; that COLAs would be applied to the entire plan; that another study should be conducted within a couple of years to make sure that the City does not get out of market; that staff should verify a certain number of positions with these same comparison cities each year; that staff will develop a plan going forward and that we should not have any trouble adhering to the plan in normal years; that employees are our best asset but we need to make sure we are meeting the needs of the citizens as well; and that this study is a tool to help the staff make a recommendation to the Council. On the motion of Dale Fleeger, second by Jeff Robinson, the Council voted to accept the report as presented. Motion carried 3 - 2. Mr. Cleveland voted in opposition. [See further discussion below under Future Agenda Items.] CITIZEN COMMENTS ON NON-AGENDA ITEMS None FUTURE AGENDA ITEMS Ms. Wilder requested a workshop before voting on any recommendation about going forward with the salary adjustments. Mr. Cleveland stated he did not need a workshop, he just needed more time to read the study. Ms. Hayes asked for clarification since staff asked for acceptance of the report and the recommendations. City Secretary Malinda Nowell read the text of the previous motion which was typed as “accept the report as presented.” Ms. Wilder stated she did not vote for the recommendations. Mr. Fleeger clarified that his motion was to accept the report and the recommendations were listed in that report. Ms. Wilder changed her vote to nay. Mayor Swancy announced the vote for the previous item is now 3 - 2. Ms. Wilder and Mr. Cleveland voted in opposition. Ms. Hayes asked Council to let her know if they still desire a workshop. There are a total of four locations wheretraffic control signs are warranted per the Texas Manual of Uniform Traffic Control Devices (TXMUTCD). Staffpresented traffic count data, aerial and street views of locations to the Transportation Advisory Board (TAB) showingproposed traffic control signs. TAB did not have any concerns and unanimously voted to recommend placing traffic controlsigns at all four locations per staff’s recommendation.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEATHERFORD, TEXAS, AMENDING WEATHERFORD CODE OF ORDINANCES, TITLE X MOTOR VEHICLES AND TRAFFIC, CHAPTER 3 TRAFFIC-CONTROL DEVICES, SECTION 10-3-12 SPECIFICALLY CONTROLLED STREETS BY ADDING THERETO CERTAIN INTERSECTIONS FOR THE ENFORCEMENT OF TRAFFIC CONTROL DEVICES ON RIGHT-OF-WAYS IN THE CITY OF WEATHERFORD, TEXAS, PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; AND PROVIDING A SAVINGS CLAUSE, ESTABLISHING A PENALTY.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEATHERFORD, TEXAS:

SECTION 1: That the Weatherford Code of Ordinances, Title X Motor Vehicles and Traffic, Chapter 3 Traffic-Control Devices, Section 10-3-12 Specifically Controlled Streets be amended by adding the following intersections, ALPHABETICALLY, to-wit:

SECTION 4: All ordinances and parts of ordinances in conflict with this ordinance shall be and the same are hereby repealed to the extent of said conflict only.

SECTION 5: If any section, subsection, paragraph, sentence, clause, phrase or word of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council hereby declares that it would have passed such remaining portions despite such invalidity or unconstitutionality and it is accordingly so ordained.

The foregoing ordinance was introduced, read, and passed by a vote of ayes nayes at a meeting of the City Council of the City of Weatherford, Texas, at its meeting held on the 9thday of January 2018.

Municipal services to the area annexed in the ordinance attached hereto shall be furnished after the effective date of annexation by the City of Weatherford, Texas, (“City”) at the following levels and in accordance with the following schedule:

1. Upon the effective date of annexation the City will provide the following services to the newly annexed area:

A. Police ServicesThe City will provide police services to the newly annexed area at the same or similar level of service now being provided to other areas of the City with similar topography, land use and population. The City will respond to all dispatched police calls and requests for service or assistance within the newly annexed area.

B. Fire Protection and Emergency Medical ServiceThe City will provide fire protection to the newly annexed area at the same or similar level of service now being provided to other areas of the City with similar topography, land use, and population. The City will respond to all dispatched calls and requests for service or assistance within the newly annexed area.

C. Solid Waste CollectionThe City will provide for the collection of solid waste and refuse in the newly annexed area at the same fee as paid by other citizens within the city limits for the same service by the franchised solid waste provider.

D. Maintenance of Water and Waste Water FacilitiesThe City Council is not aware of the existence of any water or wastewater facilities now located in or serving the area proposed for annexation. If publicly owned water or wastewater facilities do exist in the area such facilities owned or maintained by the City at the time of the proposed annexation shall continue to be maintained by the City. Any water or wastewater facilities, which the City may acquire subsequent to the annexation of the proposed area, shall be maintained by the City to the extent of its ownership. It is the intent of the City to maintain all public water and wastewater facilities in the annexed area that are not within the service area of any other water or wastewater utility. The City does own and maintain municipal water service along East Bankhead Highway adjacent to the area proposed for annexation, and wastewater service approximately 500 feet to the east.

E. Maintenance of Roads and StreetsRoad, streets, or alleyways which have been dedicated to the City or whichare owned by the City shall be maintained to the same degree and extent that other roads, streets and alleyways are maintained in areas with similar

topography, land use, and population density. Lighting of roads, streets, and alleyways that may be positioned in a right-of-way, roadway, or utility company easement shall be maintained by the applicable utility company servicing the City pursuant to the rules, regulations, and fees of the utility.

F. Maintenance of Parks, Playgrounds and Swimming PoolsThe City Council is not aware of the existence of any parks, playgrounds or swimming pools now located in the area proposed for annexation. If parks, playgrounds, or swimming pools do exist and are public facilities, the City will maintain the areas to the same extent and degree that it maintains parks, playgrounds, swimming pools, and other similar areas of the City.

G. Maintenance of Publicly-Owned Facility, Building, or Municipal ServiceThe City Council is not aware of the existence of any publicly-owned facility, building, or municipal service now located in or serving the area proposed for annexation. If publicly-owned facilities, buildings, or municipal services do exist, the City will maintain the facilities and services to the same extent and degree that it maintains similar facilities and services in other similar areas of the City.

H. ElectricThe City Council is not aware of the existence of City-owned electric facilities now located in and serving the area proposed for annexation. Any City-owned electric facilities that exist in the area at the time of the proposed annexation shall continue to be maintained by the City to the same extent and degree that it maintains similar facilities and services in other similar areas of the City.

2. Program for construction or acquisition of any capital improvementsnecessary for providing municipal service for the area:

A. In General1. The City policy for extending water and wastewater service is to

extend service on an as required basis when development applications or subdivision plats are submitted to the City in accordance with the City’s subdivision and development ordinances and utility extension regulations.

2. Landowners may be required to fund capital improvements necessary to provide service in a manner consistent with Chapter 395, Texas Local Government Code. Nothing in this plan shall be interpreted to require a landowner within the newly annexed area to fund capital improvements necessary to provide municipal services in a manner inconsistent with Chapter 395 of the Local Government Code, unless otherwise agreed to by the landowner.

3. There appear to be no public improvements of any kind other than existing State and county roads presently located in the area to be annexed.

B. Police and Fire Protection ServicesThe City Council finds and determines it to be unnecessary to acquire or construct any capital improvements for the purposes of providing police or fire protection services and that it has at the present time adequate facilities to provide the same type, kind, and level of protection and service which is presently being administered to other areas already incorporated in the City with the same or similar topography, land use, and population density, without reducing by more than a negligible amount the level of police or fire services provided within the corporate limits of the City.

C. Water Facilities and ServicesMunicipal water service is available through a 20” water main located in the public right-of-way of East Bankhead Highway on the southern boundary of the area proposed for annexation. Developers will be required to connect to the water main and extend service to the proposed development pursuant to the ordinances and utility policies of the City. Upon connection to existing mains, water will be provided at the rates established by the City.

D. Waste Water Facilities and ServiceMunicipal wastewater service is available through an 8” gravity wastewater main located along East Bankhead Highway, approximately 500 feet east of the area proposed for annexation. Developers will be required to extend and/or expand the wastewater main or facilities pursuant to the ordinances and utility policies of the City. Upon connection to existing mains, wastewater will be provided at the rates established by the City.

E. Roads and StreetsWhen development occurs within the area, maintenance of properly dedicated roads and streets will be consistent with the maintenance provided by the City to other roads and streets in areas of similar topography, land use, and development as the annexed area. Developers will be required pursuant to the ordinances of the City to provide internal and peripheral streets and to construct those streets in accordance with the specifications required by the City for a properly dedicated street. The City will undertake to provide the same degree of road and street lighting as is provided in areas of similar topography, land use, and population density within the present corporate limits of the City.

F. ElectricThe City of Weatherford Municipal Utility System has the ability to serve electric to the proposed annexation area determined by its certified electric service territory as granted by the Public Utility Commission of Texas. Anyelectric service provided would be according to the City’s most current Electric Service Policy.

SPECIFIC FINDINGS

The City Council finds and determines that this proposed Service Plan will not provide any fewer services, and it will not provide a lower level of service in the area, including maintenance of infrastructure, proposed to be annexed than were in existence in the area at the time immediately preceding the annexation process, or within areas of the corporate limits of the City with similar topography, land use and population density, nor will it result in reduction the level of fire and police protection and emergency medical services provided within corporate limits before annexation.

Because of the differing characteristics of topography, land utilization and population density, the service levels which may ultimately be provided in the newly annexed area may differ somewhat from services provided to other areas of the City of Weatherford, Texas. These differences are specifically dictated because of differing characteristics of the property and the City of Weatherford, Texas will undertake to perform consistent with this contract so as to provide the newly annexed area with the same type, kind and quality of service presently enjoyed by the citizens of the City of Weatherford, Texas who reside in areas of similar topography, land utilization and population.

Houston PolyBag had the lowest overall bid that complied with requirements for delivered 22,000 rolls of 50 LDPE plastic bags at $4.37per roll. In FY 2016-17 plastic bags were $4.25 per roll from Waste Zero Inc.

FINANCIAL IMPACTThis purchase is funded in the FY2017-18 Solid Waste budget. The 22,000 LDPE plastic bag rolls total $96,140.00.

The City of Weatherford (Weatherford) and Parker CountyEmergency Services District #7 (ESD 7) currently provide fire protection and other types of emergency response servicesto local residents in their respective jurisdictions or service areas. This contract formalizes the practice with defined terms. The basic terms are that as a fire department we can call for assistance from other fire departments within Parker Countyin our times of need. In return, other fire departments can request our assistance in their times of need. Each departmentremains responsible for their employees and equipment and continues to operate under their own policies and procedures. Again, this has been the previous normal practices within Parker County.

AGREEMENT FOR AUTOMATIC AID ASSISTANCE BETWEEN THE CITY OF WEATHERFORD AND PARKER COUNTY EMERGENCY SERVICES

DISTRICT #7

RECITALS

The City of Weatherford (Weatherford) and Parker County Emergency Services District #7 (ESD 7) currently provide fire protection and other types of emergency responseservices to local residents in their respective jurisdictions or service areas.

Weatherford and ESD 7 have previously cooperated in the provision of emergency and fire protection services through the practice of mutual aid.

Weatherford and ESD 7 desire to augment resources and capabilities within the geographic boundaries of their respective service areas by responding to and dispatching emergency calls on an automatic assistance basis so that the nearest available unit respondsto the incidents specified in this agreement, regardless of the jurisdiction involved.

It is the intent of this “Agreement for Automatic Aid Assistance Between Weatherford andESD 7” (Agreement) that the capabilities and coordination of the each party’s abilities toprotect lives and property be efficiently enhanced.

TERMS

1. The parties to this Agreement are ESD 7, acting by and through its Greenwood Rural Volunteer Fire Department (GRVFD) and Weatherford, acting by and through its Weatherford Fire Department (WFD). The initial term of this Agreement shall be for one year, effective February 1st, 2018, unless terminated earlier pursuant to Section 17, and may be renewed for up to four (4) additional one-year terms by mutual written consent of ESD 7 and Weatherford.

2. Upon dispatch notification, the Parties agree to automatically respond the nearestavailable unit(s) to the scene of an emergency within the automatic aid agreement servicearea. The service areas are shown on the maps attached as Exhibit A and Exhibit B, whichare attached to and incorporated into this Agreement. The “nearest available unit” shallmean that unit of either party that meets the requirements for that type of emergency andis capable of responding quickest to a call. A party shall respond only to the extent that a unit is readily available.

3. WFD and GRVFD shall respond to all call types within the automatic aid agreementservice areas shown on Exhibit A and respond on reported fires call types in Exhibit B. GRVFD shall respond to all call types within the automatic aid agreement service areas shown on Exhibit C when resources for WFD Fire Station 1 and Fire Station 4 are depleted.

4. The parties agree to follow the National Incident Management System (NIMS) as promulgated by the U.S. Department of Homeland Security to provide for the efficient management of emergencies and for the safety of firefighters through the use of standard terminology, reporting relationships, and support structures for those emergencies requiring the use of units from the parties.

5. The parties agree to cooperatively acquire equipment designed to maximize the compatibility of the equipment held by both parties. Each party shall be solely responsible for its equipment or property, including any losses or damages, in the performance of this Agreement.

6. WFD and GRVFD agree that all full-time, part-time, or reserve fire fighters shall have current certifications as structural firefighters from the Texas Commission on Fire Protection. It is also agreed that all volunteer firefighters must meet the introductory training requirements as listed by the State Firemen’s and Fire Marshal’s Association ofTexas before providing emergency services under this Agreement. First responders of both departments who provide medical services must be certified with the Texas Department of State Health Services at the minimum level of Emergency Care Attendant (ECA).

7. NO DEPARTMENT SHALL BE RESPONSIBLE FOR THE ACTS OR OMISSIONS OF ANY OTHER DEPARTMENT’S EMPLOYEES, VOLUNTEERS OR PERSONNEL. IT IS EXPRESSLY UNDERSTOOD THAT THE DEPARTMENTS DO NOT WAIVE, AND SHALL NOT BE DEEMED TO WAIVE, ANY IMMUNITY OR DEFENSE THAT WOULD OTHERWISE BE AVAILABLE TO THEM AGAINST CLAIMS ARISING IN THE EXERCISE OF THEIR POWERS AND FUNCTIONS, OR THAT MIGHT OTHERWISE BE AVAILABLE AT LAW OR IN EQUITY. THE PROVISIONS OF THIS SECTION WILL SURVIVE THE EXPIRATION OR EARLY TERMINATION OF THIS AGREEMENT. NO PARTY WILL BE RESPONSIBLE FOR CLAIMS ARISING OUT OF THE SOLE NEGLIGENCE OF ANY OTHER PARTY. Anemployee or volunteer shall be deemed to be performing services when en route to, enroute from, or at the scene of a call or emergency.

8. Specifically citing Texas Government Code Section 791.006 (a-1), the parties agree that, for purposes of determining civil liability for non-party claims, the act of any person while fighting fires, providing rescue services, providing first response EMS services, traveling to or from any type of emergency call or emergency scene, or in any manner furnishing services in accordance with this Agreement, shall be the act of the party that employs such person or for which such person is engaged as a volunteer. The payment of any and all civil or other liability, including negligence, resulting from the furnishing of services under this Agreement is the responsibility of the party performing such acts. This shall specifically include, but not be limited to, the payment of court costs, expenses, and attorneys’ fees resulting from any such claim or lawsuit. The parties agree that the assignment of liability described in this Section is intended to be different than liability otherwise assigned under Section 791.006 (a) of the Texas Government Code.

9. The parties agree to cooperate in the development of procedures and protocols, including but not limited to dispatch, communications coordination, training, health and 33

safety, fire prevention, public education, fire investigations and other activities that will enhance the ability of the both parties to fulfill their missions.

10. When responding to a call for automatic aid outside of its jurisdictional territory, the assisting party shall keep a record of “time of dispatch” and “response time” for each call and such other necessary information or reports required by the receiving party for its record-keeping purposes.

11. The parties agree to comply with all applicable state, local and federal laws and regulations in providing services under this Agreement. The parties agree to cooperate in executing such further or subsidiary agreements as may be required.

12. No term or provision of this Agreement is intended to, or shall, create any rights in any person, firm, corporation or other entity not a party hereto, and no such person or entity shall have any cause of action hereunder.

13. The parties agree to respond with appropriate resources, but only if available, as if the call was in their service area. As soon as possible after the situation is stabilized, the responding entity must be released. Any Automatic Aid response under this Agreement is considered to be the first operational period of four hours, and after four hours, any response will be considered a Mutual Aid response and subject to reimbursement, as appropriate. Noparty shall have any right to any payment or reimbursement from any other party under thisAgreement. The parties agree to cooperate with each other in seeking reimbursement from state or federal authorities to the extent such opportunities are available.

14. The parties shall each provide Automatic Aid hereunder in its sole discretion and only with resources that are available at the time of the dispatch. If no resources are available to respond hereunder, the responding department will notify dispatch and the requesting department so that other arrangements may be made to obtain the necessary resources.

15. This Agreement supersedes any previous automatic aid agreement between the parties. Any previous statement or understanding regarding automatic aid that is not included in this Agreement shall be of no force or effect until executed as an amendment to this Agreement.

16. The parties agree to cooperate in an annual evaluation of this Agreement in order to ensure that terms of the Agreement are providing an efficient enhancement of the parties’ability to protect lives and property.

17. This Agreement may be terminated by either party, with or without cause, upon 120 days written notice. Notice shall be provided by certified mail, return receipt requested, at the following addresses:

18. No term or provision in this Agreement is intended to create a partnership or joint venture.

19. The parties agree to schedule joint training exercises between the stations likely to provide services under this Agreement as soon as possible, to periodically meet to review procedures and operations, and to recommend amendments to this Agreement.

20. If for any reason any provision of this Agreement is held invalid by a court of competent jurisdiction, such holding shall not affect, impair or invalidate the remaining provisions of this Agreement but shall be confined in its operations to the specific sections, sentences, clauses or parts of this Agreement and shall not affect or prejudice in any way the validity of this Agreement in any other instance.
