Proclamation of Kids to Parks Day

May 2020

WHEREAS, May 16, 2020, is the tenth Kids to Parks Day organized and launched by the National Park Trust held annually on the third Saturday of May is now Parks to Kids Day; and

WHEREAS, Parks to Kids Day empowers kids and encourages families to embrace what they can do outdoors at America's parks, public lands and waters; and

WHEREAS, we should encourage children to lead a more active lifestyle to combat issues of childhood obesity, diabetes, hypertension and hypercholesterolemia; and

WHEREAS, Parks to Kids Day will broaden children's appreciation for nature and outdoors; and

WHEREAS, Parks to Kids Day will recognize the importance of social distancing while enjoying the benefits of the outdoors during the COVI9-19 crisis; and

ITEM BACKGROUND:Robert J. (Jeff) Curtis has submitted an application for a car sales operation and relocation of theexisting utility building sales business to the adjoining property. The Special Exception request requiresa public hearing with both the Planning Commission and the City Council. Both the PlanningCommission and City Council held public hearings on this matter on April 28. There were no commentsby the public at the public hearings, nor has our office received any oral or written comments. ThePlanning Commission voted on its recommendation to the City Council at its meeting following thepublic hearing on April 28.

PREVIOUS RELEVANT ACTION:City Council approved a special exception application in April 2016 for the utility building sales at thislocation.

STAFF RECOMMENDATION:The Planning Commission voted on April 28 to recommend approval of the Special Exception with thefollowing conditions: 1) A landscape buffer of plantings shall be located along the rear property linealong Circle Drive. 2) Any exterior lighting shall avoid illumination or glare onto nearby residentialproperties, 3) The hours of operation for the business shall be limited to Monday through Saturday from9 a.m. to 7 p.m., 4) No car washing shall be done without proper and approved accommodation of thegray water, and 5) the placement of the utility buildings shall avoid sight distance problems. 8) Request: Robert J. (Jeff) Curtis has submitted an application for a Special Exception for automotive (used car) sales to be located at 873 Old Airport Road. The property is in the company name of Cardinal Enterprises LLC which is owned by Mr. Curtis and his wife, Sheryl. The proposed location for the businessis zoned B-1 (Neighborhood Shopping). Bristol City Code section 50-107 lists the permitted uses for this district and “automotive sales” is not a land use permitted by right in this zone. In addition, because the utility building sales will be relocated to an adjoining lot (which was not in the applicant’s ownership at the time the 2016 permit was granted), the Special Exception request also involves approval for this relocation.

Bristol City Code (BCC) does allow a property owner or applicant to request a Special Exception to allow a “use of the property which would not otherwise be permitted” (Section 50-39 of BCC). This is not a rezoning request. The special exception process allows for a specific use to occur without changing the zoning district.

9) Background and Existing Conditions: The original property was purchased by Cardinal Enterprises in 2016 and is about one acre in size. In April of 2016, the Bristol City Council approved a Special Exception for outside retail sales of utility buildings and garden statues on the original tract. Sheryl Curtis operates a real estate office in the existing building and previously had operated a household goods retail operation, although that is no longer active. Both of those two uses were permitted by right in the B-1 zone while the outside utility building sales required a special exception. The adjoining tract bordering on the north side (between the original tract and Sonic restaurant) is about 0.6 acres in size and was purchased by Robert J. and Sheryl Curtis in July 2019 and is also zoned B-1.

10) Project Description: The proposed request is to allow the establishment of automotive (used car) sales on the original tract in front of the existing building which will house the business office for the auto salesalong with the existing real estate office. No other structures are proposed. Due to the purchase of the adjoining tract, Mr. Curtis is proposing to move the location of the existing utility buildings from the original tract to occupy the newly acquired property, allowing room for his new business of automotive sales. The total road frontage along Old Airport Road is approximately 330 feet, plus additional frontage along the corner and side road where New York Street intersects Old Airport Road. There are two entrances onto the original tract and a third entrance on the adjoining tract.

The site plan submitted with the application shows a total of 35 spaces for displaying cars for sale, and ten spaces for customers located next to the existing office building, including two handicapped spaces. It also shows that the utility buildings will be moved to the adjoining area and placed in a perimeter around the lot. The applicant plans to add more gravel to that area, while the car sales area is already paved.

11) Previous Planning Commission Actions:

2015 – Robert J. (Jeff) Curtis submitted a Special Exception application (SE#03-2015) in the name of Bristol Automotive LLC for used car sales at this same location but withdrew the request prior to a public hearing due to a change in his business plans.

2016 - Sheryl Curtis (Cardinal Enterprises LLC) submitted a new special exception application (SE#01-2016) for the establishment of outside retail sales of utility buildings and garden statues at the same location. Following a joint public hearing held on April 12, 2016, the Planning Commission voted to recommend the Special Exception with conditions and the City Council subsequently approved the resolution granting the Special Exception.

12) Authority to Act: Virginia Code §15.2-2286 (A) (3) provides the authority to City Council to grant special exceptions “under suitable regulations and safeguards.” The process for granting an exception is largely left to the local ordinance or code to define. City Code §50-39 stipulates that a special exception

may be granted following due consideration of eight (8) particular questions regarding the impact of the proposed use and the availability of local services for the planned use. A complete application is required along with the applicable fee.

The Planning Commission is required to provide a positive or negative recommendation to the City Council following a public hearing of the Council and the Planning Commission. Normally, the city does those hearings in a joint session, however due to precautionary standards with the current COVID-19 health crisis, it was decided that it would be better to have separate hearing. The public hearings were advertised in accordance with Virginia Code with two public notices in the newspaper (April 17 and 23) and letters to adjoining property owners. The applicant has paid the cost of the public notices.

The City Council, after hearing comments from the public and receiving the recommendation of the Planning Commission, shall decide to grant or deny the request based on the facts and evidence presented by the staff, the Planning Commission and the public. Conditions may be attached to the granting of a special exception to address impacts of the proposed use.

13) City and State Code Requirements: City Code §50-39 stipulates that a special exception may be granted following due consideration of eight (8) particular questions regarding the impact of the proposed use and the availability of local services for the planned use. The Planning Department will circulate the application materials and solicited responses from the various departments responsible for providing services and will evaluate the request based on the following criteria:

1. The sufficiency of streets and public ways to accommodate increased traffic flow, the considered opinion of the City Engineer and of any certified traffic engineer being given particular weight by the council. According to Jay Detrick, city transportation planner, “the current street system is sufficient to accommodate the proposed special exception request.” The subject property is located on the four-lane section of Old Airport Road and has three wide entrances providing ingress and egress to that roadway along the parcel frontage.

2. The sufficiency of electrical, sewer and water services for the proposed project, the considered opinion of the general manager of the utility board being given particular weight by the council. BVU staff responded that they have no issues with the proposed use. The property is currently served with water, sewer, and electric services that are adequate to meet the needs of the proposed business.

3. The sufficiency of fire, police, garbage, and other services of the City to meet the needs of the proposed project, the opinion of the department head of each department providing such City service being given particular weight. The fire marshal has assessed the proposed request and made determination that access to fire hydrants and water flow is acceptable, and states that “the use of this lot for automotive sales would not increase issues or demand from the present retail sales of utility buildings.” There are also no concerns regarding law enforcement or garbage services for the proposed use.

4. The adequacy of protection to adjoining properties and to the air and water of the commonwealth from noise, odor, pollution and health hazards, the opinion of the state health department, state air pollution control board, state water quality control board, being given particular weight by the council. There are no anticipated impacts from noise, odor, pollution, or health hazards. The applicant has stated that he will be washing vehicles off-site in order to eliminate any water run-off impacts. There will be only minimal noise when car interiors are vacuumed.

5. The impact of the proposed project upon the property values of contiguous property owners as evidenced by the testimony or written opinion of the city's Economic Development Committee Director, a certified property appraiser, or opinion of a realtor licensed by the Commonwealth and regularly listing and selling properties within the City. The city’s Economic Development Director

does not anticipate any negative impact on surrounding residential property values, because the proposed use is consistent with the current existing use. He believes the proposed business will have a positive economic impact for the city.

6. Whether the natural topography, natural screening or proposed screening to be put in place by theapplicant is sufficient to promote the health, safety and general welfare of the community, to protect and conserve the value of contiguous properties and to encourage the most appropriate use of contiguous properties. Because there are residences relatively close to the subject property located just across Circle Drive behind the existing building, the applicant has agreed to plant a landscape buffer in a row along the rear property line. This was proposed when the 2016 special exception was granted for the utility buildings, however it was never done. It would be more for aesthetics than providing actual screening due to the elevation differences between the subject property and the residences.

7. Any other factor materially affecting the health, safety and general welfare of other citizens. Any outdoor lighting of the business should be downlit to prevent impacts on nearby residences, and hours should be limited to normal daytime working hours.

8. If the project is to construct a parking garage or a parking lot as a primary use of a property in the B-2 district, certain additional requirements must be met, as defined in section 50-108(c)(1) and (2). Not applicable.

14) Staff Analysis:

Staff has reviewed the circumstances surrounding the application for a special exception at 837 Old Airport Road and has the following analysis:

Consistency with the Comprehensive Plan:

The future land use map in the 2017 Comprehensive Plan designates the subject property as Regional Commercial as part of the entire corridor along Old Airport Road from Exit 7 to New York Street. The plan recognizes the Exit 7 area as one of commercial cores of the city. With easy access to the Interstate and frontage along four lane Old Airport Road, this area is appropriate for commercial development. A significant amount of traffic uses this arterial roadway for access to businesses on this side of the city as well as travel between the Interstate and city and county residential areas.

The Planning Commission has drafted a revised zoning map based on the 2017 Comprehensive Plan and has proposed that this property be rezoned to B-3 from B-1. Because that revision project is still under consideration and has not gone to public hearing yet, the applicant chose to proceed with the special exception application. (Note: If the property were zoned B-3, the proposed use of automotive sales would be permitted by right).

Compatibility with Surrounding Uses:

The surrounding land uses are multi-family and single family residential, and commercial. The closest homes are located on Circle Drive adjacent to or across the street from the subject property. There are also townhouses immediately across New York Street from the site. The townhouse property is zoned B-1 and not residential. According to older city zoning maps, the B-1 zoning in this area has existed for many years. It was likely zoned in this manner to provide a buffer to the surrounding subdivisions. Just to the north of this property and zoned B-1 is the Sonic restaurant, the Highlands Union Bank, and the Shell convenience store -- all of which generate substantially more traffic flow than automotive sales or utility building sales -- and are typically located in high traffic area.

Old Airport Road was a two-lane road until the mid-1990’s when it was widened as well as re-aligned. Traffic has increased on this roadway as development and employment growth occurred at the Old Airport Road Industrial Park and at nearby businesses and employers, in addition to the commercial development at Exit 7. This segment of the roadway carries approximately 10,000 average daily vehicles per day and isclassified as a minor arterial highway. The proposed use will not be a large traffic generator, so there are no concerns about traffic impacts.

There may be some concerns from adjoining property owners due to proximity to the nearby residences, although there have not been any complaints about the utility building sales. Although B-1 is designed to encourage “neighborhood-type stores, services, and commercial centers compatible with residential development,” the permitted use list contained in Section 50-107 of City Code includes restaurants, automobile service stations, and retail stores – land uses that generate more traffic than automotive sales.

The Old Airport Road corridor from Exit 7 to Bonham Road and Kings Mill Pike is a major transportation route for residents, employees, and business traffic. It makes sense that this corridor will continue to develop commercially. It is recognized, however, that there are well-established single-family neighborhoods adjacent to this roadway and conflicts between commercial and residential use need to be avoided or mitigated as much as possible.

The purpose of the B-1 district is to provide “attractive areas for the medium density development of office buildings and restricted commercial uses.” (City Code Section 50-72). The property owner has made some improvements to the property since purchasing it in 2016, but the open space is virtually filled-up with the utility buildings. The conceptual site plan submitted with the application shows the relocation of the utility buildings to the north side of the property, and the placement of the vehicles for sale in the area in front of the building. (It appears that a substantial number of the storage buildings will need to be removed from the site to implement this site plan).

16) Conclusion:

Following complete evaluation of the application, staff finds that due to the conformity with the Comprehensive Plan, the lack of issues regarding city services, and the fact that the proposed use will generate substantially less traffic than other B-1 uses that are permitted by right, the requested special exception is warranted. However due to the proximity of the subject property to adjoining R-1 zoned areas, there need to be measures taken to lessen any impacts on nearby residences.

The staff recommendation is for approval with the following conditions:

1) A landscape buffer of plantings shall be located along the rear property line along Circle Drive.2) Any exterior lighting shall avoid illumination or glare onto nearby residential properties.3) The hours of operation for the business will be limited to Monday through Saturday from 9 a.m. to 7

p.m.4) No car washing shall be done on site without proper and approved accommodation of the gray water.5) As required with the 2016 special exception permit, the utility buildings should be limited to one-

story in height and their placement shall avoid any sight distance problem.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRISTOL, VIRGINIA GRANTING A SPECIAL EXCEPTION (SE #02-2020) FOR 837 OLD AIRPORT ROAD FOR AUTOMOTIVE SALES AND RELOCATION OF EXISTING UTILITY BUILDING SALES

WHEREAS, Robert J. (Jeff) Curtis is planning to establish a car sales business on property he owns at 837 Old Airport Road, in addition to relocating his existing utility building sales operation to the adjoining site (Map Parcels 269-4-235 to 243A; 269-1-A-1, 269-A-A2, and 269-A-23); and

WHEREAS, the applicant submitted the required application to the Department of Community Development in accordance with City Code; and

WHEREAS, the Planning Commission of Bristol, Virginia voted on March 16 to forward the special exception request for a public hearing; and

WHEREAS, the Planning Commission held a public hearing which was properly advertised and held on April 28, 2020 at Noon in accordance with Virginia Code §15.2-2204, as amended; and

WHEREAS, the City Council held a public hearing which was properly advertised and held on April 28, 2020 at 6 p.m. in accordance with Virginia Code §15.2-2204, as amended; and

WHEREAS, property owners adjoining 837 Old Airport Road, Bristol, VA have been properly notified pursuant to Virginia Code §15.2-2204, as amended; and

WHEREAS, the City Council of Bristol, Virginia reserves unto itself the right to grant special exception permits; and

WHEREAS, the City Council considered the circumstances of Bristol, Virginia City Code §50-39(g) prior to approval of the special exception request.

1 Public hearing on Special Exception #02-2020 for 873 Old Airport Road to allow an automotive sales business and the relocation of the existing utility building sales to adjoining lot

Mayor Osborne opened the public hearing. City Planner Sally Morgan said that the Planning Commission held their public hearing earlier in the day with no comments made, and made a recommendation that the special exception be approved with the following conditions:Mayor Osborne closed the public hearing with no comments made. The applicant spoke about his plans for the business.

2 Resolution authorizing the refinancing of general obligation bonds. City Manager Randall Eads said that the refinancing discussed in January had gone out for proposals with rates more favorable than anticipated. He said that David Rose of Davenport and Megan Gilliland, bond counsel, were available for questions from council.

3 Resolution approving Special Exception #01-2020 for Transitional Housing at 617 Moore Street.City Planner Sally Morgan gave an overview of the proposed transitional housing project. She said that the Planning Commission had recommended the special exception application at the March 16, 2020 meeting by a vote of 4-0 and that no opposition was heard. However, since that date the Virginia Business College had sent a letter against the proposal. City Clerk Nicole Storm read three public comments provided in writing in advance of the meeting, all in opposition to the proposal: the letter from Virginia Business College President Gene Couch, a letter from resident Geno Laneiro, and a letter from resident Lee Blackwell. Nancy Marney spoke against the proposal.

The motion to approve failed with no second made.

4 Resolution supporting a grant application for funds from the Virginia Department of Housing and Community Development through the Industrial Revitalization Fund for Birthplace of Country Music Annex.

City Planner Sally Morgan presented information about the application, which would provide $600,000 from the Industrial Revitalization Fund to support the Birthplace of Country Music annex building. The museum raised more than $2 million dollars in private and public funds for the project. They had previously applied for IRF funding in 2017 but did not receive the award. The City would act as applicant and pass the funds through to the museum if awarded. Council members asked questions about the proposal, which were answered by Brett Davis of the museum. Nancy Marney and Michael Pollard asked additional questions.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRISTOL, VA AUTHORIZING SUBMISSION OF AN APPLICATION TO THE VIRGINIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT ON BEHALF OF THE BIRTHPLACE OF COUNTRY MUSIC MUSEUM EXPANSION PROJECTWHEREAS, the City of Bristol, VA is eligible to apply for funding from the Industrial Revitalization Fund (IRF Program) of the Virginia Department of Housing and Community Development; and WHEREAS, the Birthplace of Country Music (BCM) has been a catalyst for economic development in downtown Bristol and the Tri-Cities region by increasing visitors to the area, fostering pride in the city’s music heritage, and generating local spending and private investment in the City; and WHEREAS, the Birthplace of Country Music has determined that more space is needed in order to expand events, education, recording, archives, and office space, and purchased the building adjacent to its Museum (known as theAnnex building”) for that purpose; and WHEREAS, the building has been vacant for many years and is dilapidated, deteriorated, and violates minimum health and safety standards. This structure is considered to be Spot Blight and is centrally located in the middle of the City’s Cumberland Avenue redevelopment area, devaluing other nearby investments including the Bristol Hotel and the Cumberland Building; and WHEREAS, the BCM has spent considerable time and funds developing the architectural plans and studies needed to renovate the Annex building; and WHEREAS the Birthplace of Country Music has secured for this project a total of $2,942,688 in matching funds including $300,000 from Joseph Gregory (dba The Master’s Table), $500,000 from the Virginia Tobacco Region Revitalization Commission funds, $1,317,688 from Historic Tax Credits, $550,000 allocated from the Commonwealth of Virginia Budget; $ 275,000 from Cabell Foundation (with secured 2:1 match); and WHEREAS, the IRF program can provide a grant of up to $600,000 for the readapted reuse of vacant industrial and commercial buildings which will meet funding gap; and WHEREAS, the anticipated end-result of the project will be increased visitation and use of the Museum facility, increased travel-related expenditures and private investment in the city, and reduced blight.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCILOF BRISTOL, VIRGINIA: The council does hereby authorize and direct City Manager, Randy Eads, to sign and submit appropriate documents for the grant application to the Virginia Department of Housing and Community Development 2020 Industrial Revitalization Fund on behalf of the Birthplace of Country Music’s renovation and expansion project, such grant request is to total $600,000.
