SMART SERVICE TERMS AND CONDITIONS

1. This Brochure Terms and Conditions and the

Contract Terms and Conditions constitute a single

Contract for the services described herein. Additional

terms and conditions constituting a part of the

agreement are provided in the Contract Terms and

Conditions itself.

2. Coverage Limitations:

a. HVAC/Water Heater Equipment: This Contracts

does not cover roof top units; electric baseboard units;

air conditioners or heat pumps connected to earth

coupled or ground source heat pumps; electric radiant

heating; oil-fired or oil-condensing units; combination

solid fossil fuel units; commercial applications over

500,000 BTU/HR input; single heating systems that

supply more than two heating zones or heating/

cooling systems partially or completely powered by

solar energy; water heater tanks and water heating

systems partially or completely powered by solar

energy; refrigerant. Service to repair and/or replace

heat exchangers; outside temperature sensors; jacket

trim; decorative parts; chimneys; registers; add-on

power vents; vent connectors; air filters; fuel lines; fuel

storage tanks; fuel shutoff valves; circuit breakers or

exposed wiring; humidifiers and air cleaners (unless

covered under a separate service plan); insulation;

duct work; remote automatic water feed; boiler

sections; solution pumps; internal or external domestic

water heating coils and their associated parts; sealed

systems; or any otherwise covered part which is

inaccessible are not covered. Any service work or

replacement of parts caused by faulty system design

or installation, or the correction of any problem directly

pump or central air conditioner, boiler or furnace,

and water heater. Select Service Plans will cover

labor and covered parts on a heat pump or central

air conditioner, boiler or furnace, and water heater.

Whole House and Home Comfort Plans provide

one annual efficiency tune-up of the heating/cooling

system; Select Service Plans provide a 20% discount

on an annual efficiency tune-up. Kitchen Plans will

cover labor and covered parts on a refrigerator, range

and dishwasher. Laundry Plans will cover labor and

covered parts on a washer, dryer and water heater.

Whole House Limited Plans will cover labor and

covered parts on a refrigerator, range, washer, dryer,

dishwasher, and water heater. Home Comfort

Limited Plans will cover labor and covered parts on

a water heater. Whole House and Home Comfort

Limited Plans will cover labor and covered parts for

heating and cooling system during the manufacturer’s

warranty period and will provide one annual efficiency

tune-up of the heating/cooling system.

5. You must be an active Smart Service Whole House,

Home Comfort, Select Service, Kitchen or Laundry

customer in order to receive plan benefits. HVAC

discount is 10% off (up to $500), water heater discount

is 5% off (up to $100) and home improvement product

discount is 10% off (up to $250) in addition to any

advertised offer. All discounts are not applicable on

previous purchases or in conjunction with any other

discounts unless otherwise noted. HVAC discount

must be used towards high efficiency systems only.

6. To schedule service under this Contract or if you

have any questions, call 1-888-243-4663.

* Coverage excludes digital thermostat unless installed by BGE HOME.** Covered only under manufacturer’s warranty.

connected with the heating system itself, such as

venting air at radiators, expansion tank problems, flow

valves, balancing systems, surging steam systems

or zone valves and zone controls, thermal expansion

devices for water heaters, auto fill valves, flow checks,

boiler feed pumps or steam traps are not covered. Any

increase in utility bills resulting from use of emergency

heat is not covered under this Contract. Any energy

saving devices that are added onto the original

heating/cooling systems unless otherwise stated

above are not covered.

b. Appliances: This Contracts does not cover

appliances more than 15 years old (unless

inspected by BGE HOME, or currently covered by

a manufacturer’s warranty or a continuation of a

BGE HOME service plan); built-in connected,

multimedia or appliance accessories; pedestal

washers; heat pump dryers; multi-functional ranges;

microwaves (unless built-in component of range or

oven combinations).

3. One annual heating/cooling system efficiency

tune-up will be performed for Whole House, Home

Comfort, Whole House Limited, and Home Comfort

Limited plans. Efficiency tune-ups are scheduled at

the customer’s request, during normal business hours

between 7:30 a.m. and 5:00 p.m., Monday through

Saturday.

4. Whole House Plans will cover labor and covered

parts on a heat pump or central air conditioner,

boiler or furnace, water heater, refrigerator, range,

dishwasher, washer and dryer. Home Comfort

Plans will cover labor and covered parts on a heat

SMART SERVICE TERMS AND CONDITIONS1. This Brochure Terms and Conditions and the Contract Terms and Conditions constitute a single Contract for the services described herein. Additional terms and conditions constituting a part of the agreement are provided in the Contract Terms and Conditions itself.

2. Service made necessary as a result of fire, theft, flood, acts of God, accidental damage, abuse, neglect, vandalism, unauthorized alterations or any other abnormal conditions are not covered. Consequential or other damages resulting from the failure of the system or any part are not included. Systems with pre-existing conditions, faulty design or installation will not be covered.

3. This service plan will cover the adjustment or repair of any functional electrical, plumbing or well pump system part as specified in the brochure drawing. The service plan will cover the adjustment, repair or replacement of the covered water line or sewer line as specified in the brochure drawing. BGE HOME shall not be required to provide repairs exceeding a cost to BGE HOME of $2,000 per Contract year, unless a water line plan (up to $3,000 per Contract year) or sewer line plan (up to $4,000 per contract year).

4. Well pump, electrical/plumbing systems, water line and sewer line systems must meet code requirements and be in good working condition at the time service begins. Water line and sewer line plans are subject to begin 30 days from date of plan sale. Customer shall provide BGE HOME with safe access to and safe working conditions at and around covered products.

5. If an additional service technician, electrician or plumber must be called for assistance on a service call, the customer may be charged for the additional labor.

6. BGE HOME reserves the right to inspect and approve any equipment or system before issuing a new service plan. Any inspections are performed at our regular schedule of charges.

7. The Smart Service Electrical/Plumbing Plan shall cover the adjustment, repair or replacement of the following functional parts that fail through normal use: Electrical—exposed interior wiring; panels and sub-panels (repair only); breakers; fuses; receptacles; GFI receptacles; switches; bathroom built-in exhaust fans (repair only); ceiling fans (replacement will be like-for-like quality, coverage up to $100 per fixture); exposed junction boxes; light fixture repair; outdoor motion-sensor lights; photocells on outdoor lights (no underground wiring). Plumbing—leaks or breaks in water, drain, gas, vent or waste lines (exposed only); toilet mechanisms; toilet wax ring seals; toilet flanges (excluding lead bends); angle stops (if present); main shut-off valves; hose bib shut-off valves (if accessible); permanently installed sump pump (ground water only); drain cleaning (inside house); faucet repair to kitchen sink; disposal repair. The Well Pump System Plan shall cover the adjustment, repair or replacement of the following functional parts that fail through normal use: †well pump (up to $1,200 per contract term); drain valve (inside home only); brass nipple; relief valve (inside home only); pressure gauge; pressure switch; start control box; pump protector; ball valve. The Water Line Plan shall cover the repair or replacement of the primary outside water line that has the flow of water interrupted due to normal wear and tear, leaking or structural failure. Coverage begins at the point of public/well system connection to the point of entry of your home (water meter or main water shutoff valve). The Sewer Line Plan shall cover the repair or replacement of the primary outside sewer line that is impeded due to normal wear and tear, tree roots or structural failure. Coverage begins at the point of public/septic tank waste connection to the point of entry of your home.

8. This contract shall not cover: Electrical—service entrance cables; light fixture replacement; fire or security alarms; intercoms; doorbells; timers; inadequate wiring capacity; power surge or failure; failure due to rodents or insects; non-approved wiring connections or junctions; low voltage wiring systems; landscape lighting; attic power ventilators; associated masonry

or drywall work; central vacuum systems; direct current (D.C.) wiring or components; garage door openers; improper size of panel (overloaded); local, state or federal code violation; power failure; light bulbs; touch pad assemblies; remote transmitters. Plumbing—bathtubs or showers; leaks or breaks in lines caused by freezing; fixtures, faucet replacement, faucet repair (except kitchen sink); shower or tub valves; shower and tub drains; shower enclosures and base pans; caulking; grouting; septic tanks; pressure regulators; water purifiers; water softeners; toilet seat; inadequate water pressure supply; sauna and steam rooms; leaks or breaks caused by foundation movement; water storage tanks; dryer vents; all stoppages in vent and drain lines on outside of house; water heaters; boilers; any associated masonry or drywall work. Well Pump System—well pumps over 10 years old; above/underground piping; cables; ropes and/or electrical lines leading to or away from the pump (including inside of well casing); well casings; storage, holding or pressure tanks; secondary or booster pumps; redrilling of wells; any components (including well pumps) of geothermal and/or water source heat pumps regardless of location or relationship to covered parts. Water Line/Sewer Line—Any shared water or sewer line that supplies service to multiple residences; branch lines that supply secondary buildings; outdoor water systems (ex. sprinkler systems, pools, hot tubs, etc.); any repair or replacement of components associated with the water utility system (ex. meters, curb valves, etc.); well pump system (including the pitless adapter); public sanitation system or septic system; any primary sewer line that is greater than six inches in diameter; any storm sewer lines; sump, trash, grinder or lift pumps.

9. For Smart Service Electrical/Plumbing Plans only—in the event of a breakdown covered in this contract, you shall be required to pay a $50 per call, per item deductible. A deductible payment is required for each claim of an individual breakdown covered under this service agreement. The Smart Service 10% discount for electrical and plumbing service does not apply to the $50 per service call deductible.

10. If an electrical, plumbing or well pump system component covered by this contract is not repairable due to its general condition, or due to the inability of the manufacturer to provide suitable parts, BGE HOME shall have no liability. If service has been rendered, no refunds will be given. Replacement parts may not be available for products greater than ten years old. BGE HOME reserves the right to restrict specific makes of equipment from eligibility due to non-availability of parts, and the choice of parts to be used shall be at the discretion of BGE HOME. BGE HOME will put forth its best effort to provide replacement parts, components or systems of similar mechanical capabilities of the original (where available). However, BGE HOME is not liable to provide exact match in color, type or brand. BGE HOME is under no obligation to upgrade or make modifications to the original system, components or items covered by this Contract.

11. All replacement parts must be supplied by BGE HOME. Customer supplied parts will not be used. For any non-covered plumbing and electrical or well pump system repairs, Smart Service Electrical/Plumbing or Well Pump Service Plan customers shall receive a maximum discount of 15% to be applied against BGE HOME’s standard repair charges.

12. Electrical/Plumbing Smart Service Plans cover labor and covered parts as listed in this brochure. Well Pump Plans will cover labor and covered parts as listed in this brochure. Water Line and Sewer Line Plans include repair/replacement coverage (replacement shall be at the sole discretion of BGE HOME). Service will be performed during normal business hours. Repairs must be performed by BGE HOME technicians, electricians and plumbers.
