NARRATIVE

On 10-11-10 I attended a briefing at Chandler PD Headquarters lead by Detective Arias and Detective Sergeant Austin at 0430 hours. I was assigned to assist in the service of a search warrant of a motel room in Phoenix near 43rd Avenue and I-10. Detective Arias showed me a copy of the search warrant and we reviewed the items we were to search for. In addition to Arias and Austin, Detective Busse assisted in the service.

Access to the room was made by using an electronic key card Detective Arias provided me. Detective Busse took photographs and I assisted in searching. I left a listing of the seized items (2) along with a copy of the search warrant in the room. When the search was complete, I secured the room and Detective Arias took possession of the key card. Detective Busse took possession of the seized items.

As of the writing of this report, I have taken no further role in this investigation.

NARRATIVE

SUPPLEMENTAL NARRATIVE:

On Sunday, 101010, at about 1845 hours I assisted with this case by providing scene security. Upon my arrival to the scene, at 300 W. Fairview St., I relieved Ofc. Mendez #596 on the west perimeter position on Fairview St. just west of 320 W. Fairview St. There was no entry / exit log transferred to me by Ofc. Mendez. There was also already yellow "police" tape closing off the street from eastbound travel. I remained at the scene until 2245 hours when the investigation at the scene was concluded.

While present, at about 2140 hours, a vehicle was removed with permission from Sgt. Austin #S38 from within the closed scene area. The vehicle was parked under the covered parking area just southeast of the 300 W. Fairview building under the covered parking. The vehicle was described as a Silver 2003 Dodge Stratus four-door sedan. It had already been processed by evidence technicians earlier as evidenced by the black residue on various areas of the car left over from the search for latent prints. The responsible party for the vehicle, Adolfo Merez, requested permission to retrieve his vehicle so he could drive to his home in Tucson. Adolfo was not the registered owner, but lived with the registered owner in Tucson and had possession of the keys to the vehicle. He left the scene westbound on Fairview as he drove away.

I entered the scene various times to retrieve refreshments from the Mobile Command Center, but I never entered the property of 300 W. Fairview St. Also, at one point, I lowered the yellow tape to allow the County Medical Examiner's office van to exit the scene after having retrieved the body. The van had entered the scene from the east side of Fairview St.

Other than the aforementioned information, no one else entered or exited the west perimeter of the scene during my posting.

This concluded my involvement in this case at this time.

CONCLUSION:

This case is pending to the assigned case officer.

NARRATIVE

This is a supplement to original report #10-11857.

On October 10, 2010 at approximately 1300 hours, I was contacted by Detective Spielman reference a homicide that occurred in Chandler. Detective Spielman requested the assistance of the Criminal Apprehension Unit to assist with the investigation. He asked that I respond to the Chandler Police Department and meet with Sergeant Potter to obtain additional information. I then contacted Detective Frias and asked if he could respond to assist as well.

Upon my arrival at the police department, I met with Sgt. Potter who provided the following information. He stated a subject identified as Martin Alejandro Cota Monroy had been found stabbed and decapitated at 300 W. Fairview Street #1 in Chandler. Sgt. Potter advised patrol had located one suspect who was in custody, but there were three suspects still outstanding. Sgt. Potter stated the suspects fled the area in a red Ford Expedition bearing an unknown California license plate. He stated there was a witness that was cooperating with police, but they were still in the initial phases of obtaining information from him. Sgt. Potter stated they had received information from the witness, the suspects and victim had been staying at a hotel called Value Place located at 43rd Avenue and I10 in Phoenix. He requested Detective Frias and myself respond to that location to look for the Ford Expedition.

I then spoke to Detective Arias who provided the following information about the three outstanding suspects. He stated suspect #1 was named David Castro. He was described as a hispanic male, approximately 26 years of age, clean shaven, 5'10 in height, 180 pounds, and last seen wearing a long sleeve button down shirt, with a white tant top underneath and denim jeans. Suspect #2 went by the name of Juan Campos. He was described as a hispanic male, approximately 21 years of age, thin mustache, short black hair, 5'10 in height, 220 pounds and last seen wearing a black long sleeve shirt, black jeans and white shoes. Suspect #3 was only known by the nickname of "Joto." He was described as a hispanic male in his twenties, 5'2 to 5'4 in height, thin build with short spiky hair. He was last seen wearing a white t-shirt with a dark pattern on the shirt, stone wash jeans and white shoes. Detective Arias stated these three suspects were last seen with the victim inside the apartment before he was killed. Detective Arias also advised they had received information the suspects were possibly from Perris, California.

I responded to the Value Place hotel located at 1360 N. 43rd Avenue in Phoenix. Upon my arrival at 1500 hours, I drove through the parking lot looking for a red Ford Expedition. I was unable to locate the vehicle in the parking lot. I then made contact with Manager Mike Neely inside the hotel. I identified myself and told him I was looking for information on one of the guests at the hotel reference an on-going investigation in Chandler. I provided him with the victims name and asked him to check their data base for him. Neely stated there was no one by that name staying in the hotel. I asked him if I could see a list of names for subjects who had rented a room since October 4th-October 10th. Neely began listing off guests and he came by the name of Jose David Castro Reyes. Upon hearing that name, I recognized it to be the same as one of our suspects, David Castro.

I asked for information on that subject and what room he was staying in. Neely stated he was staying in room #305 with another subject by the name of Isai Aguilar Morales. Neely stated Isai Morales arrived first and rented the room on October 6th through October 14th. He said David Castro arrived two days later and accompanied Morales in the room. Neely said all guests are required to provided

identification prior to staying in the room. He stated Morales came down with Castro's identification card and they made a copy of it for hotel records. Neely provided me photocopies of the identification cards both subjects provided to the hotel. Both subjects provided Mexican Identification cards as their form of ID to the hotel. He then provided me with a copy of the room receipt which listed the amount they rented their room for, linen services, phone calls made during their stay, etc. While staying at the hotel, three separate phone calls were made to the following numbers:

The receipt stated Morales had paid for the room in cash and did not provide a credit card number. Neither of the suspects provided a contact telephone number to the hotel. Isai Morales provided his vehicle information to the hotel. He told them he was driving a Ford Expedition bearing California license 6FWR784. He did not provide a color to the hotel staff. It should be noted, upon running the license plate information on that vehicle it came back registered to a Filomeno Aguiar out of an address in Perris, California. I asked Neely if he was able to determine when the last time any of the guests in room #305 came or went from there. He stated they could use a card reader to determine that information, but the employee who was able to do that was not going to be into work until later that evening. Neely said he could call up to the room to see if anyone answered. Neely called the room but, there was no answer. Neely stated housecleaning staff checks the rooms daily and they could do a housecleaning check in the room to see if anyone was there.

I accompanied Neely up to the third floor and walked to room #305 where he knocked on the room and announced "housecleaning" four times. No one answered the door. Neely opened the door to room #305, but it was unoccupied. I stood outside the door and looked inside the room where I observed an unmade bed, a black backpack and shoes on the floor, two pizza boxes on the counter and all of the lights were on inside the room. It appeared as if additional personal items were still in the room as well. Neely closed the door to the room. I accompanied Neely back to the management office where I provided him my cell phone number. I told him we would be waiting in the parking lot for a few hours and asked him to call me when the other employee arrived who could assist me.

I then parked my unmarked police vehicle in the Value Place parking lot and began doing surveillance on the hotel waiting for the Expedition to arrive. Detective(s) Deanda and Frias arrived a short while later to assist with the surveillance. At approximately 1800 hours, Neely called me and stated his employee, Gabriel, had arrived to assist with the card reader function. I went inside the hotel with Detective Deanda and met with the hotel employees. Detective Deanda accompanied the hotel employee up the room #305 where they used a card reader on the door to download the information. I was provided with a printout of the "openings" of lock #305. The printout shows a new guest on 10/07/10 at 4:31p.m opening the door to the room. The last time the door was opened by a guest in that room was on 10/09/10 at 10:46 p.m. There were two additional lock entries made after the one on 10/09/10, but they were made by Mike Neely on 10/10/10 at 3:26 p.m. in my presence for the housecleaning check and on 10/10/10 at 7:06 p.m. for the card reader download. A copy of this printout was provided to Detective Arias.

Gabriel, the hotel employee, was also able to access the surveillance video from the hotel. He was able to locate surveillance video of the victim and suspects coming and going from the hotel. A copy of

this surveillance tape was later given to Detective Arias. After viewing the surveillance footage and obtaining the card reader printout, we resumed our surveillance positions in the hotel parking lot.

At approximately 2100 hours that evening, Detective Spielman contacted me via telephone. He asked that members of CAU continue surveillance on the hotel until the following morning when detectives arrived to serve a search warrant on the hotel room. He requested we watch the hotel to see if the suspects would return. It was decided myself, Detective(s) Deanda, Frias and Mejia would stay at the hotel. We conducted surveillance on the hotel from 1500 hours on October 10th until approximately 0645 hours on October 11th when we were relieved by assisting detectives. The suspects and Expedition never returned to the hotel. I met with Detective Arias and provided him with the information and paperwork I had been given by the hotel manager. I told him to contact hotel employee, Gabriel, once inside to obtain the surveillance footage from the hotel. This concluded my involvement.

Disposition:

This case is pending to Detective Spielman.

Narrative:

On 10-12-10 I was requested to contact the Manager of Filiberto's, located at 930 E. Pecos Rd., Chandler, to inquire about any video surveillance for the date of 10-10-10. Upon arrival I spoke with the Manager who advised me there was not any video surveillance footage available, because all the video camera's were fake and non-operational. I returned to the Chandler Police Department and advised Sgt. Potter of this information.

Incident Report

NARRATIVE

On Sunday October 10, 2010 at 0530 hours, I was dispatched to 300 W. Fairview St #1 Chandler, AZ regarding an unknown problem. Upon arrival, I observed two hispanic males standing on the sidewalk in front of the apartment. Neither male spoke english so I referred them to spanish translator Officer S. Peterson #582. As I looked at the apartment I observed the front door was open with a subject lying on the floor. As I walked closer, I observed the male head was decapitated and lying next to the body.

I immediately advised dispatch of the status of the male and request the channel be restricted for this incident. I then informed the officers on scene that we needed to check welfare of any possible injured victims as well as any threats inside of the apartment. At 0535 hours, Officer K. O' Berry #559, Officer D. Parks #576, Officer S. Peterson and I checked the apartment. Finding the apartment empty, at 0536 hours, I initiated a crime scene. I then recorded (via dispatch) the license plates of vehicles parked in the parking lot of 298 W. Fairview and 300 W. Fairview.

After voicing the license plates, I contacted the residents of 298 W. Fairview St. #2. The two residents were identified as Jesus Daniel Lopez and his father, Casper Lopez-Morales. Jesus translated for his spanish speaking father. Jesus and Gasper noted there are two males who live at the 300 W. Fairview address. Though they have knows these subjects for four to five years, Jesus and Gasper only know them by their nicknames of "Palales" and "Preitolin". Jesus gave Panales' phone number of 480-709-0723.

Jesus advised the last time he saw Panales was the evening before at 1830 hours. Preitolin was changing the oil on his black Honda Civic which he shares with Panales. Gasper, as translated by his son, told me he last observed Preitolin and Panales at 2000 hours when they returned from playing a soccer game. Preitolin and Panales were in front of their apartment. This was all the information Jesus and Gasper were able to provide regarding the last time they saw Panales and Preitolin. During the course of the evening neither Jesus not Gasper heard or saw anything suspicious.

NARRATIVE

NARRATIVE:

On 10-10-10 I was dispatched to assist other officers at 300 W Fairview St #1 in Chandler, AZ. I was asked to maintain the north side of a crime scene in the alley behind 300 E Fairview St #1. I arrived and while in the alley I noted a white Kia Sophia bearing AZ plate #AKP4269.parked in the alley on the north side of the complex. While in the alley, at 0605 hours, I noticed a Hispanic male that appeared to be hiding behind a van just north of my location at 301 W Whitten St. I contacted the subject who verbally identified himself as Luis Enrique Armenta. Luis was intoxicated and had no shoes on his feet but advised he lived in apartment one and pointed toward the crime scene. Luis spoke broken English and I asked Officer Holmes to assist with talking to him. Officer Holmes told me, Luis advised he actually lived in 320 W Fairview #1 and had been dropped off by his sister. Luis further explained he had been drinking at his sitters home in Queen Creek and had left his shoes there. Based on the crime scene tape being around his apartment he was dropped off somewhere else and Luis was trying to figure out a way to get back to his apartment, which was why he was looking around the apartments. Luis advised due to being at his sitters house all night and did not know anything about the situation the police were there on. Officer Holmes escorted Luis to his apartment. While following I saw a male subject looking out of 300 W Fairview #3 and contacted him.

I contacted the subject in #3 who verbally identified himself as Orlando Mejia. Orlando asked what had happened and I told him someone was found deceased. At first Orlando thought I was talking about a different apartment and advised "Ricardo" lived there. Orlando advised he did not know Ricardo and did not hear or see anything suspicious that night. Later, Orlando realized we were talking about #1 and advised he was friends with the people who lived there. Orlando advised three cousins lived there named Jorge Moreno, Daniel Moreno and "Chuga." Orlando advised their father, Ronnie Moreno, was visiting from Tucson, AZ and was also at the residence. Orlando was at the residence at approximately 2130 hours and advised they had just returned from a soccer game and were in the process of cleaning up to get ready to go to El Coyote Bar in Chandler. Orlando was invited by the men however he stayed at home. Orlando left and returned to his residence. According to Orlando, he had not heard of anyone any of the cousins may have had any problems with and did not see or hear anything happen throughout the night.

Orlando described Jorge is 24-27 years of age, approximately 180 lbs, 5'8'' inches tall, with short dark hair . Daniel was described as 24-27 years of age, approximately 180 lbs, 5'8'' inches tall, with a shaved head. "Chuga" is described as also having a shaved head, 5'7'', 150 lbs, with a Yaki dancer tattoo on one of his shoulder and an unknown tattoo on his other should but he did not recall which side they were on. "Ronnie" was described as 5'5'', 180, approximately 50- years old with dark short curly hair. It should be noted that while speaking with Orlando he saw "Ronnie" walking with Officer Peterson.

Genevieve Dominguez, Orlando's girlfriend, was also contacted and advised she had not been at the residence and did not hear or see anything that night or morning.

After relaying this information to Det. Spielman, I was asked to transport Jorge Moreno to the Chandler Police Department to voluntarily speak to detectives. While transporting Jorge he advised he had been at the casino on Kyrene and Loop 202 freeway. Jorge advised his cousin, Daniel, called him 20

minutes before he arrived and was crying and afraid. Daniel told him there was a knife fight and to come back to the apartment to talk to the police. According to Jorge Daniel old him someone got cut, but did not say who. Jorge told me that he gone to the casino at 0230 had returned to the apartment at about 0400 hours and several people were thee drinking, but Daniel was sleeping in the back room. Jorge then advised he went back to the casino. Jorge advised "Chuga" does live at the apartment and is Daniel's cousin. Daniel was then asked to wait in a interview room.

On 10/10/2010 at 1230 hours, I responded to 300 W Fairview St to relief Ofc M. Jordan on perimeter in the alley on the north side of the residence. At 1235 hours, I arrived and stayed on the perimeter of the north side and did not allow anyone in the immediate crime scene. However to the persons whom live in adjacent apartments at 320 W Fairview St. I walked the subjects to their respective apartments.

At 1827 hours, I left the area as Ofc Boos relieve me at the location.

NARRATIVE

This is a supplement to report #10-111857.

On 10/10/10 at 0532 hours, I was dispatched to an unknown problem at 300 W. Fairview St. #1 where Daniel Moreno had called 911 and reported that a male subject was down inside the apartment and possibly dead. Information was vague as the reporting person was a Spanish speaker and not very forthcoming with information.

I arrived on scene at the same time was Officers Olivier, O'Berry and Peterson. We approached the apartment together and found the reporting person and one other Hispanic male standing in the parking lot in front of it. Officer Peterson began to speak with them while Officers Oliver, O'Berry and I approached the apartment to render aid if necessary. The door was slightly ajar and as we entered, Officer Olivier suddenly drew his weapon and said we needed to clear the apartment immediately. The reason became quickly obvious as I looked around him and saw a male body laying on the floor in the living room with it's head severed and laying on the floor next to it. I called out to Officer Peterson to make him aware of the seriousness of the situation and we searched the apartment for any other people, injured or otherwise. No one else was located and we exited the apartment to preserve the seen.

Officers Peterson and Olivier began to question the reporting party and Officer O'Berry and I recovered crime scene tape from our vehicles and began to form a perimeter around the apartment and surrounding areas. As additional units arrived, I assigned them to perimeter control positions around the apartment building. The outer perimeter was established as follows: From Fairview St. north to the alleyway adjacent to 300 W. Fairview St.; From the east side of 298 W. Fairview St. to the west side of 320 W. Fairview St.

Once the perimeter was established, Sergeant Cooper ordered me to retrieve the Mobile Command Center and deploy it for the detectives that would be arriving shortly. I left the scene and returned with the Mobile Command Center at 0656 hours. Once Back on scene, I assumed a support role to the investigation. While performing my duties, Officer Lewis requested assistance as she was speaking with a neighbor at 320 W. Fairview St. #1. I responded to her location and she told me that the subject had flagged her down and pointed out a pair of bloody shoes that were sitting in front of his apartment. He said that the owner of the shoes was inside asleep. I requested more officers to assist and Officer Lewis and I ordered all of the occupants out of the house. Once everyone had exited, I helped clear the apartment to make sure no one else was inside. I stood by outside with the occupants of the apartment while Officer Lewis spoke with them (they were Spanish speakers). One of the occupants was placed under arrest and transported to the police station. The other occupants elected to be transported to the station to make interviews easier.

I remained on scene until 1322 hours, at which point I was relieved by Officer Quinn. This ends my involvement in this case.

NARRATIVE

THIS IS A SUPPLIMENT TO THE ORIGINAL REPORT NUMBER 10111857.

NARRATIVE:

ON 10/10/10 at 0530 hours, I responded to an unknown problem at 300 W Fairview #1. The reporting person, Daniel Moreno, stated a subject was down and possibly dead in the apartment. Daniel stated he would be waiting outside the apartment. I was dispatched to the call because it was reported that Daniel was a Spanish speaker and I am a certified translator. I arrived at the location with Officer Olivier 497, Officer O'Berry 599, and Officer Parks 576.

I arrived at the residence and located two Hispanic males in front of the apartment and they were pointing inside the residence. Olivier went to the door and stated we needed to clear the apartment immediately. I began interviewing the males in front of the residence when Parks called me into the apartment and stated I was needed inside. I entered the residence and I was careful not to touch the door or anything else inside the apartment. As I entered, I saw a Hispanic male laying face down in the family room and his head was severed from the body. The head was approximately 1 to 2 feet away from the body and I could only see that it was a Hispanic male with black hair. I noticed that one of the victim's feet was missing the shoe and sock and I was able to see his skin that was very pale and lifeless. It was clear that the subject was decided and no medical attention was necessary. I stood by while the rest of the apartment was cleared for subjects and once cleared we backed out of the apartment.

I took the subjects away from the scene and began interviewing them separately and I recorded the interviews.

Interview with Daniel Moreno Jocobi -

I interviewed Daniel and he stated he did not know the subject that was lying on the floor of the apartment. Daniel stated he did not witness the incident and has no idea how it occurred. Daniel stated he has lived at the apartment for the last 3 years with a subject named Manuel Alberto Romero Jocobi, and Jorge Moreno Hernandez. Daniel stated Manuel was working a seasonal field job and hasn't been staying in the apartment for the last month and Jorge was with his girlfriend. Daniel stated Jorge's father was the other subject with him at the scene and stated he is visiting from Tucson. Daniel stated they went to the Lone Butte Casino located at 1077 S Kyrene Road, from 1500 hours on the day prior until just before they called the police. Daniel stated when they returned the front door was open and they walked in and saw the deceased subject in the family room. Daniel again stated he had no idea who the subject was or where he came from. Daniel stated no one else has access to the residence and it is not normal for people to enter.

Interview with Adolfo Moreno Meraz -

I contacted Adolfo and interviewed him separately. Adolfo also stated he was visiting from Tucson and his son, Jorge Morneo Hernandez, was a resident at the apartment. Adolfo stated they went to the Coyote Bar at approximately 1830 hours and then they were at the casino for the remainder of the night. Adolfo also stated they returned home and found the door slightly open and located the

deceased subject inside. During my interview with Adolfo I was informed that someone may have taken off from the scene in a black vehicle and I asked Adolfo what type of vehicle they drove and he stated a black Honda. We looked but no black vehicle was located. I asked Adolfo where the vehicle was and he stated his son, Jorge, might have left in the vehicle. I asked Adolfo how Jorge left in the vehicle when he told me he was with his girlfriend. Adolfo stated, "Let me tell you the truth". Adolfo stated he was scared to admit he was at the residence during the incident but agreed to tell me the truth.

Adolfo stated he went to the Coyote bar with Daniel until about 0200 hours. Adolfo met a few subjects at Coyote that returned home with them. Adolfo did not know any of their names but stated there were 3 other males and 2 females. Adolfo got tiered and went to bed and left the other subjects in the family room drinking. Adolfo wok up sometime around 0500 and saw the dead body. Adolfo got Daniel and they agreed to call the police.

I was about to re-interview Daniel when I was advised to stop questioning. Both Daniel and Adolfo agreed to go to the Chandler Police Department for further questioning and I transported Adolfo. I waited with Adolfo and Daniel at the Chandler Police Department until the investigating detectives arrived and assumed the interviews and the investigation.

A number of other subjects that lived in 320 W Fairview #1 were also brought into the Chandler Police Department and I was advised they were also Spanish speakers. I was tasked with interviewing Luis Vasquez Rivera and Rufino Armando Perez Vasquez.

Interview with Luis Vasquez Rivera

Luis stated he has been a resident at 320 W Fairview #1 for the past 5 months and he lives there with subjects he only knows as Manuel, Rubin, Rufino, Nicolas, and Muneco. Luis stated he came home from work at 1900 hours and went to bed at 2100 hours. Luis stated he did not see Muneco home when he went to bed. Luis stated he woke up at 0600 exactly and noticed a lot of police vehicles outside. Luis walked out to the family room and noticed Muneco was not inside the residence. Luis stated a short time later Muneco returned home with out any shoes on. Luis asked Muneco where his shoes were and he was told, "the police took them". Luis stated Muneco appeared to be nervous and jumpy at the time. A short time later Manuel informed the other residents that Muneco's shoes were next to the front door and they were covered with blood. Luis stated he saw the shoes and they were in fact Muneco's. Luis stated no one at the residence wears similar shoes and he was sure they were Muneco's. Luis stated they decided to advise the police and Manuel flagged them down and Muneco was asleep at the time.

Interview Rufino Armando Perez Vasquez,

I interviewed another resident of 320 W Fairview #1, Rufino Perez Vasquez. Rufino did not have any pertinent information about the investigation. Rufino stated he worked the day prior until 2200 hours and returned home and went to bed. Rufino stated he thinks that Muneco was not home at the time. Rufino next remembered being woken up by the police to come outside the residence. Rufino did not see the shoes and did not have any interaction with Muneco.

I informed the other investigating officers of my findings and that concludes my involvement in this case.

NARRATIVE

Narrative:

On 10-10-10 at approximately 1220 hours I was dispatched to 300 West Fairview Street #1, where a death investigation was being conducted.

Upon my arrival at approximately 1223 hours I relieved Officer Holmes #638, who was already on scene on West Fairview Street securing the west side of a crime scene established with yellow crime scene tape.

At approximately 1348 hours I was approached by a male, who provided me a Mexican consular identification card and was identified as Jesus Munguia-Lopez. He told me he lived at 300 West Fairview Street #2 and needed to get his pick-up truck out of the crime scene. He then pointed out a white colored 1998 Ford F150 bearing Arizona license plate number AFV2585, which was parked in front of 320 West Fairview Street in a parking stall identified with white colored spray paint as 320=2.

I told Munguia-Lopez I would need to search the pick-up truck before it was removed. He provided me with the keys and told me it was not problem. I conducted a search of the pick-up truck to look for any blood stained evidence or weapons that may be related to this incident and I found none.

Munguia-Lopez then entered the crime scene with me and drove the pick-up truck out of the crime scene.

I maintained my position until I was relieved by Detective Kee #327 at approximately 1913 hours.

I then went to the City of Chandler Police Department and met with Officer Dunn #602 and fed Crisantos Moroyoqui, who was being held in a holding cell, three slices of pizza and gave him a glass of water to drink at the request of Sergeant Potter #S30.

At approximately 1944 hours I left the City of Chandler Police Department Main Station concluding my involvement in this incident.

NARRATIVE:

On 10/10/10, at 0849 hours, I was dispatched to 300 W. Fairview St., #1, Chandler, AZ to assist with scene security. At 0918 hours, I was directed by Det. Spielman #333 to place Suspect / Cristos Moroyoqui under arrest. Cristos was handcuffed (the handcuffs were checked for tightness, and double locked) and placed in the back of a patrol car. I transported Cristos to the Chandler Police Department Main Station, CIB-Interview Rooms. Upon arrival, I monitored the suspect while incustody.

I fingerprinted Cristos, and photographed him. Baldwin, I226 conducted an AFIS check, and no record was located.

I did not conduct any interviews, nor did I hear Cristos making any statements.

At 1800 hours when I was relieved by Ofc. Schlicting #639.

This is a supplemental report to OR# 10-111857.

On 10/10/10 at about 0533 hours I was dispatched to 300 W. Fairview Apartment #1to assist with a male subject possibly deceased inside the apartment. When I arrived there were two Hispanic males outside the apartment. I attempted to speak with them but due to them only speaking Spanish I was unable to effectively communicate.

At this time I heard Ofc. Olivier #497 advise we needed to clear the apartment. I followed Ofc. Olivier inside the apartment. Immediately inside the apartment I saw the body of what appeared to be a Hispanic male who way laying on the ground face down. The male's head had been completely severed from his body and was lying next to him. Ofc. Olivier, Ofc. Parks #576, Ofc. Peterson #582 and I cleared the apartment. Once it was deemed no one else was inside the apartment we backed out and established a crime scene.

I placed crime scene tape to the east and north perimeter while Ofc. parks did the same for the western perimeter. The southern perimeter was a chain link fence that ran the entire length of our scene.

While I was placing crime scene tape, a neighbor came out and was getting ready to start his truck and leave for work. I attempted to interview but was again unable to effectively communicate with him because he spoke only Spanish. The gentleman went inside his apartment and got his son, who was both English and Spanish speaking to help translate. Ofc. Olivier came over and spoke with both of these neighbors while I finished quarantining off our crime scene.

I secured the Eastern perimeter while Ofc. Peterson conducted Spanish interviews.

Ofc. Peterson asked if I was able to transport Daniel Moreno back to the Chandler Police Department Interview Rooms. Ofc. Peterson also stated Daniel agreed to come on his own volition. I transported Daniel back to the Chandler Police Department and had him wait in the interview room.

At this time I started the video and audio recording in two of the interview rooms. A short tine later Ofc. Kallberg brought in a third person to wait in the third interview room. I also started the audio and video recording for that interview room.

A short time later I cleared the call and had no further involvement.

This investigation is pending tot he Robbery/Homicide Unit.

NARRATIVE

This is a supplemental report.

On 10-10-10 at approximately 0849 hours, I was dispatched to 300 and 320 W Fairview St to assist with securing a scene because of additional evidence being located.

I arrived at the location and spoke to Officer Parks who indicated the evidence was outside of the door at 320 W Fairview St, #1. Along with Officer Parks and Detective Spielman, I assisted checking the apartment for any other occupants or intruders. The check yielded negative results.

I then stood by outside of both apartments to make sure nobody tampered with any part of the scene.

I was then repositioned to the east side of the taped off area to watch the rear door to 300 W Fairview, #1, to make sure nobody entered the apartment from the rear.

I was also given the crime scene log by Sgt Nichols.

The crime scene log was maintained until the scene was cleared.

Supplemental Report:

On 10-10-10 at approximately 0618 hours I responded to 300 West Fairview #1, Chandler, Arizona after being advised additional translators had been requested on scene. I am a certified translator for the City of Chandler.

Upon arrival, I was advised that the door to door contact had already been made and it was requested I standby if translation was necessary at some point.

Shortly after my arrival, a subject who was later identified as Jose Alfredo Carrillo contacted me and asked why police were present. Jose identified himself as a resident and the current manager of 65 West Fairview Street, Chandler, Arizona. The trailer park Jose resides in is directly south of the listed location. I advised Jose I was not at liberty to discuss the incident as the investigation was on going. When asked, Jose stated he did not hear or see anything unusual the evening prior to my contact with him. Jose pointed to the listed apartment and stated that often times there are several males outside drinking during the evening hours.

For a brief period I was responsible for the crime scene log. Once translation was needed, I passed the log onto Officer D. Parks.

While standing near the command van at this incident, a man later identified to me as Jose Manuel Mesa Lopez flagged me down and motioned for me to come to him. Jose had walked as far as the crime scene tape would allow him. Jose was standing near 320 West Fairview Street, Chandler, Arizona.

Upon approaching Jose, he asked me if I spoke Spanish and I told him that I did. Jose told me that he found boots outside of his front door. Jose led me to his residence which is located at 320 West Fairview Street #1, Chandler, Arizona.

Jose pointed to the boots which were on the south side of the door frame, placed side by side and upright. The boots were tan in color and the toes of the boots were covered in a red substance which appeared to be blood. I asked Jose who was in the apartment and he stated there were several people inside.

The door to the apartment was ajar. I stated in Spanish that everyone within the apartment needed to step out immediately. All subjects vacated the apartment at my request except for one. One subject, who was later identified as Cisantos Moroyoqui, remained on a small bed directly inside the front door of the apartment and to the left (south). Cisantos Moroyoqui was faced away from me and appeared to be sleeping. I nudged Cisantos Moroyoqui who eventually acknowledged my request to step outside.

All occupants of the residence were led out towards the roadway and asked to have a seat. I explained to the subjects that I would be speaking with them individually and that they were not to discuss anything until after the interviews were completed.

All of the subjects who reside at 320 West Fairview Street #1, Chandler, Arizona knew Cisantos Moroyoqui as either "Luis" or "Muneca". For better understanding, Cisantos Moroyoqui will be referred to by his name throughout most of the report although in video/audio interviews he is frequently referred to as "Muneca" or "Luis".

INTERVIEW WITH NICOLAS JACINTO PEDRO:

I first contacted Nicolas Jacinto Pedro. I asked Nicolas about the shoes that were located in front of his apartment. He stated that they belonged to a subject known to him as "Muneca" (Cisantos Moroyoqui). Nicolas indicated to me the subject "Muneca" (Cisantos Moroyoqui) was the subject police later identified as Cisantos Moroyoqui. Nicolas added that Cisantos Moroyoqui has been living with them for approximately 3-4 months. Nicolas stated that he has been with his ex-girlfriend since Friday evening and he just returned home at about 0630 that morning. Nicolas did not notice the shoes until they were pointed out to him shortly before police were flagged down.

While speaking with Nicolas, I advised Officer Holmes to do a pat down of the subjects we were contacting. Due to the possibility of one or more subjects being involved, there was a concern for the presence of weapons.

INTERVIEW WITH JOSE MANUEL MESA LOPEZ:

I contacted Jose Manuel Mesa Lopez next. Jose was the subject who had flagged me down and shown me the boots outside of his residence. Jose stated that he was leaving his apartment and he noticed the boots covered in what he thought was blood. Jose stated he knows the boots belong to Luis. Jose pointed out a subject in a black long sleeved shirt as Luis. Luis is the same subject Nicolas identified as "Muneca" who police later identified as Cisantos. Jose stated that he was at home all evening and that Ruben, Luis (another Luis) and Rufino were at home all evening with him as well. Jose stated that Luis (Cisantos/Muneca) had left to go to El Coyote that evening. Jose suspects Nicolas was with his girlfriend. Jose is unsure who Cisantos went to Coyote with. Jose did not hear or see anything strange during the night time hours. Jose stated he woke up around 0530 hours at which time he observed several patrol cars in the street.

INTERVIEW WITH RUBEN MORALES REYES:

I contacted Ruben Morales Reyes. Ruben stated that he woke up later than usual at which point he was advised of the boots outside the apartment door. Ruben stated that he was at his residence from 1400 hours until contacted by police the following morning. Ruben stated he is unsure who the shoes belong to. Ruben did not report hearing or seeing anything the previous evening that he felt was unusual or suspicious.

INTERVIEW WITH LUIS VASQUEZ RIVERA:

I contacted Luis Vasquez Rivera who stated that he was advised of the boots outside of the apartment. Upon looking, he saw they were covered in blood. Luis stated that they decided that police needed to be notified. Luis stated that he knows the boots belong to a man he knows as Luis (Cisantos Moroyoqui). Luis stated the subject at the end of the line (which is Cisantos Moroqui) was the owner of

the shoes. Luis stated he was at home around 1900 hours on 10-09-10 and did not wake up until 0600 hours. Luis did not report hearing or seeing anything strange the evening prior to this report.

INTERVIEW WITH RUFINO ARMANDO PEREZ VASQUEZ:

I contacted Rufino Armando Perez Vasquez. Rufino stated he did not notice the boots until he was advised that they were there. Rufino stated they agreed it would look as though they were hiding something if they did not immediately notify police of the boots. Rufino stated he has seen Luis (Cisantos Moroqui) wearing the boots before when he has gone out. Rufino stated he arrived home from work at 2100 hours. That night, he did not hear or see anything out of the ordinary.

With the information that had been provided at that point, Cisantos Moroqui was placed under arrest at 0918 hours and transported to the Chandler Police Department.

We requested that Luis, Rufino, Jose, Ruben and Nicolas respond to the Chandler Police Department for a more in depth interview. They all agreed. They were transported to the Chandler Police Department as they did not have their own method of transportation.

The interviews with Luis, Rufino, Jose, Ruben and Nicolas were audio and video recorded. The following is a summary of my interviews with them. For a complete transcript, please refer to the video.

INTERVIEW WITH RUBEN MORALES REYES:

I first contacted Ruben Morales Reyes. Ruben stated that he arrived home from work on 09-09-10 around 1400 hours. Jose Manuel was at home when he got home. He left his residence located at 320 West Fairview Street #1, Chandler, Arizona to send money back to Mexico around 1500 hours. Ruben returned home, got his clothing and then went to do laundry. Around 1730 hours, Ruben returned home.

Around 2130 hours Ruben stated he went to bed. Ruben did not hear or see anything that evening that was out of the ordinary. Ruben stated he woke up around 0600 hours the following morning. Ruben recalls seeing police on scene when he woke up. Later in the morning, Jose Manuel found boots in front of their apartment that appeared bloodied.

Ruben stated the boots that were found belong to a subject who has resided in their apartment for approximately 3-4 months. Ruben stated the subject is known as "Luis" or "Muneca" (Cisantos Moroyoqui).

Ruben belives Cisantos Moroqui left alone when he went out that evening. Ruben stated when he got up in the morning, Cisantos Moroyoqui was already home. Ruben stated he did not speak with Cisantos Moroyoqui on the morning of this report. Ruben stated he did exit the apartment briefly earlier in the morning but did not notice the boots. Ruben stated when Jose Manuel located the boots, he stated that the police needed to be advised. Ruben added that Jose Manuel is in charge of the apartment.

he arrived at his residence from work. When he arrived home, there was nobody home at that time. Jose Manuel stated he and his friend Ruben went to the laundromat together shortly after they arrived at home.

Jose Manuel states that he thinks Luis arrived home around 1900 hours and Muneca (Cisantos Moroyoqui) arrived home around 1900. After arriving home, Cisantos Moroyoqui invited Jose Manuel to go with him to El Coyote bar. Jose Manuel states he declined the invitation. Jose Manuel stated that Cisantos Moroyoqui left the residence around 2100 hours for the bar. Cisantos left alone. Jose Manuel added that before leaving the residence, Cisantos Moroyoqui seemed agitated.

Jose Manuel also stated that Ruben disclosed to him that he saw Cisantos Moroyoqui enter the residence around 0400 hours to 0430 hours, grab something from the living room area, and leave the house quickly. Jose Manuel does not know what Cisantos Moroyoqui took from the residence. When later confronted with this information, Ruben denied having seen this incident. Jose Manuel suspects Ruben is afraid due to the circumstances and that is why he would not relay this information to police.

Jose Manuel stated an officer knocked at his door early in the morning and at that time, Cisantos Moroyoqui had not yet arrived home.

Jose Manuel stated later in the morning, he and other occupants of the home were going to leave the apartment as they were given permission by an officer to leave. Jose Manuel stated that he exited his home and at that time he observed the boots on his door step covered in blood. Jose Manuel stated that he and his room mates briefly discussed what may have happened but nobody knew. Jose Manuel stated that he almost immediately notified police as he thought it may appear as though they were hiding something if they did not.

Jose Manuel noted that he observed blood on the legs of Cisantos Moroyoqui's pants. Jose Manuel knows the boots belong to Cisantos Moroyoqui. Jose Manuel has seen Cisantos Moroyoqui wear them on more than one occasion and Cisantos Moroyoqui told Jose Manuel that he bought the boots approximately 3 weeks ago.

Jose Manuel has never seen Cisantos Moroyoqui in a car and is not familiar with any of Cisantos Moroyoqui's friends. When asked, Jose Manuel disclosed that there are numerous knives of various sizes in the residence and Jose Manuel has a hatchet in his bedroom near the television. Jose Manuel stated that Cisantos Moroyoqui has no business in his room and should not have access to that hatchet.

INTERVIEW WITH NICOLAS JACINTO PEDRO:

Next, I contacted Nicolas Jacinto Pedro. Nicolas stated that around 1900 hours on Friday October 8, 2010, he left to spend time with his ex-girlfriend. Nicolas stated that he arrived home on 10-10-10 around 0630 hours. Nicolas believes that all of his roommates were home when he arrived there.

Nicolas stated upon entering the apartment, he did not notice if the boots were there or not. Nicolas stated shortly thereafter, Jose Manuel located the boots when he was leaving. Nicolas was called to the doorway to observe the boots. Jose Manuel told the group that had come to observe the boots that they needed to notify police.

Nicolas stated that he has seen Cisantos Moroyoqui wear the boots that were located by the front door when he goes out. Nicolas added that they were new and Cisantos Moroyoqui bought them about 15 days ago. Nicolas stated that Cisantos Moroyoqui usually leaves the apartment alone. Nicolas has met Cisantos Moroyoqui's cousins before but otherwise is not acquainted with his friends.

I was asked to contact Edna Tiznado in the interview room shortly after she had arrived. This interview was also video/audio recorded.

INTERVIEW WITH EDNA MARIANA TIZNADO:

Edna stated that around 0330-0400 hours on 10-10-10 she and her friend Natalie arrived at 300 West Fairview Street #1, Chandler, Arizona. Edna stated she was there to see her friend "Chugo". The door to this location was answered by a subject Edna recognized to be a neighbor of Chugo's. Edna described the male as having a sparkled black long sleeved shirt with knives on it. This description matches that of Cisantos Moroyoqui.

Edna stated a male subject in an orange colored shirt called to her and Natalie from inside the apartment and invited them inside. Edna stated she declined the invitation. Chugo eventually returned to the apartment. Chugo commented to Edna that he had been at a friend's house, not buying food. Edna commented to me that while at the apartment, she remained outside of the door. Edna emphasized that on this day, she had not been inside. Edna stated that Chugo periodically went in and out of the residence. The door to the apartment had been left open so Edna could converse with those inside.

Edna stated while outside, the subject she believed to be the decedent came outside and engaged her and Natalie in conversation. Edna stated they talked about where in Mexico they were all from. Edna asked the decedent to send out a male subject in a white tank top. Edna commented that her friend Natalie wanted to get to know this subject.

Edna stated the decedent entered the apartment and shut the door. Edna stated that she then opened the door and yelled into the apartment for the man in the white tank top. Edna stated that he exited the apartment and asked Edna what she wanted. Edna told the subject she just wanted to talk to him. He introduced himself to her but she does not recall his name. Eventually, this subject enters the apartment after ceasing conversation with Edna.

Chugo exited the apartment and Edna and Chugo took Natalie to the residence she is staying at. Edna added that Natalie is visiting from Mexico and is staying with her sister in town. Edna believes they returned Natalie to her residence around 0430 hours.

Edna stated she and Chugo returned to 300 West Fairview Street #1, Chandler, Arizona after dropping Natalie off at home. Chugo and Edna waited outside in their vehicle in the parking lot. Edna stated that Chugo did not comment to her one way or another if Chugo was fearful of these individuals. Edna stated Chugo left the vehicle to go charge his phone and came out after a while when it had charged a little bit. Edna attempted to call her mother but could not recall the phone number. Edna stated she called a subject by the name of Beto and he did not answer her phone call. Edna explained that Beto has her mother's phone number.

Edna stated she and Chugo continued to wait in their vehicle for the subjects to leave. Edna stated they eventually left in a red Tahoe type vehicle east on Fairview towards Arizona Avenue. Edna did not see who got into the vehicle but hear 3-4 car doors slam. Edna stated that the subjects were most likely unaware that they had been in the parking lot waiting. Edna believes the subjects left around 0500 hours.

Edna added that Chugo made a comment to her after they left about how strange it was they left so fast.

Edna stated that Chugo entered the apartment after the subjects left. Chugo exited again, quickly, and told Edna to leave. Edna stated she thought his rapid change in demeanor was odd and pressed him for more information. Chugo told her that "he" was on the floor dead. Daniel, who had apparently been in the apartment at the time, called 911 upon discovering the body.

Chugo told Edna that when he entered the apartment, Daniel exited his room about the same time at which point they both discovered the body. Edna convinced Chugo to come to her house after discovering the body.

Edna described the neighbor as a Hispanic male, tall, average build, brown hair and in his 40's. Edna remembers this subject wearing a sparkled black shirt with swords on it.

While describing the neighbor, Edna recalled that he left at one point during the party for about 7-10 minutes. Edna stated she asked him where he was going when he left and he told her "un negocio".

Edna described a second subject as a Hispanic male in his 20's, light skinned, "cacheton" or chubby cheeks, about 5'04 if not taller, a hair style similar to Chugo and very dark brown or black eyes. She last saw the subject wearing black pants, a belt with orange colored leather strips and metal, iron looking pieces on it, a white muscle shirt. Edna remembers this subject having a blue blook in his hand and being very animated when he spoke with her. Edna stated that he is from the same place Chugo is (in Mexico) but currently resides in California.

A third subject is described as a skinny Hispanic male in his early to mid 20's, longer black/brown hair slicked back, with a white shirt and black pants. This subject is about 5'04 tall.

Edna recalled another subject who was present that she did not observe well. Edna stated this subject was wearing a white shirt but she could not recall anything else about this subject.

Edna stated a fifth subject was a Hispanic male in his 40's, chubby cheeks, short, last seen wearing light colored jean pants and an orange shirt.

Edna believes the subject who had been killed was in a red shirt but she was not sure. Although Edna was referring to one subject during the interview as "muerto", I was unable to confirm if the person she spoke of was in fact the victim.

Edna stated in her opinion, the subject in the white muscle shirt looked as though he was looking for a fight that evening. Edna did overhear subjects arguing while she was there but she is unsure what they

were fighting about.

Following the interviews, I responded to the initial incident location to standby if further translation was required.

Sergeant Potter requested I assist in obtaining video at El Coyote and Filiberto's.

First, I responded to El Coyote located at 479 North Arizona Avenue, Chandler, Arizona.

I contacted the bar tender who verbally identified herself to me as Abigail Moreno.

Abigail stated she was not working the evening prior. She contacted her manager, Ruben, and allowed me to speak with him by phone. Ruben stated there are no cameras in the business. I explained to Ruben that police were currently investigating a crime and that the suspects were possibly in the bar the evening prior. Furthermore, there was information to suggest that security at El Coyote may have interacted with these subjects.

Ruben stated that he would have his security contact police. I advised Ruben that the pertinent information would be left with Abigail at the bar. I left with Abigail a card containing the report number, the contact number to the police department, and the names of the detectives investigating this incident.

I responded to Filiberto's located at 930 East Pecos Road, Chandler, Arizona. I spoke with a subject who verbally identified himself as Bernadino Rufino. He advised that video surveillance was available in the drive through but a manager would need to access the tapes. I left the time from of about 0145 hours to 0500 hours on 10-10-10 for the drive through window surveillance. Bernadino advised he would pass that information along to the manager. The report number and contact information was also provided.

I returned to the scene and advised Sergeant Potter of my findings. I later was contacted by Jose Manuel who was later escorted to his apartment. I gave him his copy of the search warrant and explained what was taken from the residence at the direction of Detective Moffat.

At this time, this concludes my involvement in this case.

Disposition:

Pending to robbery/homicide.

On 10-10-2010 at approximately 0627 hours, I was dispatched to 300 W. Fairview St. #1 to assist with the investigation. When I arrived on scene, I was assigned to watch the front door area to make sure nothing was disturbed. I looked inside the residence from behind the police tape and observed what appeared to be a male's head decapitated from his body. While on scene, nothing was disturbed until the detectives arrived on scene and proceeded inside the residence. I stayed on scene until approximately 0720 hours.

NARRATIVE:

On 10-10-10 at 0548 hours, I was dispatched to assist at 300 W. Fairview St. unit #1 in Chandler, reference and Unknown incident, which was later discovered to be a Homicide incident. The initial information I received via dispatch and my car computer stated that a male subject was inside the location and possibly dead.

Upon my arrival, several other assisting Officers were already on scene. I saw that a crime scene area was already established, using police crime scene tape. I was then advised by Officers already on scene to assist by starting a crime scene log and also to maintain a position on the outer crime scene perimeter. I maintain a position on W. Fairview St., just to the west of the location.

(It should be noted that while I was on this call, I did not enter the inner crime scene area, which was the apartment unit of the incident.)

I maintained my position and the crime scene log until I was relieved of my position by a supervisor. On 10-10-10 at 0720 hours, I cleared from this call. This concludes my involvement with this case. This report will be Pending to the Case Officer.

Narrative:

On 10/10/10 at 0544 hours I was dispatched to 300 W Fairview #1 to assist in translating and interviewing neighbors. Upon my arrival I was directed to contact and interview those residents who live in the apartments at 320 W Fairview #1-4 and 300 W Fairview #2-4.

At 320 W Fairview #1 I contacted Ruben Moreles-Reyes, Luis Vasquez-Rivera, Jose Manuel Mesa-Lopez and Rofino Armando Martinez-Jimenez. These residents explained there was a fifth and sixth roommate who were not there but only knew them as by their first name's of Nicholas and Luis. Nicholas had gone out yesterday afternoon with his girlfriend and has not returned and they did not know where Luis was at.

All parties stated they went to bed last night at about 2130 hours and heard nothing during the night out of the ordinary. When asked if they knew the neighbors across the walkway at 300 W Fairview #1, they explained they knew them only in passing but did not know their names.

I spoke with Edan Saldivar-Garcia, Nicolas Garcia Nava and Marco Gonzales-Morales at 320 W Fairview #2. They explained there were a total of five men who lived here but Sergio and Lorenzo had not returned home last night. They explained they heard nothing out of the ordinary last night and were woken up this morning when they heard police officers talking near their apartment.

I spoke with Norma Alvarado and Omar Beloso (boyfriend and girlfriend) who lives at 320 W Fairview #3 with Norma's three young children. Norma and Omar went to bed about 2330 hours. Norma informed me she was up at about 0300 hours this morning using the restroom when she heard several female running between the two apartment building's. One of these females yelled "Wait for me" in English. At this time she opened the front door and observed two females near a white Chevrolet Avalanche in the alley to the north of their apartment. She closed the door and believes they left in the truck but does not know since she went back to bed. At about 0530 hours she woke up to hear a male's voice on the westside of her apartment say "We're going to call the police" in Spanish. She did not think anything of this since she knows she lives in a bad neighborhood and is accustom to people yelling during the night.

While speaking with Norma Ofc. Kallberg asked me to help her speak with a male who she was with in the alley north of the complex. Ofc. Kallberg informed me she observe a male, later identified as Luis Armenta, looking in her direction behind a parked car. The car was parked in the parking lot of an apartment building off of Whitten St. She watched as he walked between two different vehicles and looking in her direction. She confronted him and noticed he had no shoes on. At this time I talked to Luis and he explained the following:

He had been in Queen Creek with his sister drinking. His brother-in-law drove him back home but when they got into the area the scene was marked off with police tape so he was dropped of nearby. When

asked about his lack of shoes he stated his sister became upset with him and did not give them back to him. He explained he lived at 320 W Fairview #1 with several of his roommates. I recalled the occupants of that unit said one of their roommates was Luis and walked him back to the apartment.

I knocked on 320 W Fairview #4 and there was no answer.

I was asked to speak with the occupants of 320 W Fairview #4 and spoke with Eric Michell Ortiz, Luis Carlos Jacobo and Leonel Castro Montor. Eric was wanting to leave in his Chevrolet truck which was parked just south of 320 W Fairview #1 Eric stated he returned home from work this morning at about 0400 hours and went to bed. He woke up at about 0800 hours and explained he heard nor saw nothing unusual during the night. Upon obtaining his permission to search the truck and finding no signs of evidentiary value, he was escorted out of the scene.

I spoke with Luis Carlos Jacobo who stated he was out drinking with friends at El Coyote Bar until about 0300 hours and walked home from there. He got home at about 0400 hours and did not wake up until about 0800 hours to eat breakfast.

I spoke with Leonel Castro Montor who reported he was in Phoenix with a friend Omar Perez who lives in the area of 24th St and Oak in Phoenix. They were at a bar until about 0430 hours and he was dropped off at his house at about 0500 hours. He went straight to bed until he was woken up by Luis to speak with me.

At 300 W Fairview #4 I spoke with Gloria Ogas, Maria Ogas and Alexander Alonso. Gloria reported she went to El Coyote bar and returned home at about 0300 hours.After returning home she passed out since she was intoxicated and remembers hearing nothing while she slept until I woke her up knocking on the door. Maria stated she was at the house since last night since her boyfriend was working and she did not feel comfortable staying at her apartment at 868 S Arizona Ave #1177. They had just moved in there and she stayed at her mom's house with her infant child. She explained she was awake the whole night since Alex was working from last night until about 0500 hours this morning. I spoke with Alex who stated he went to work last night. He works as Saracha Bar on Boston and was there until about 0500 cleaning up. After returning home at 0500 hours he went to bed until he was woken up by his girlfriend saying the police wanted to talk to him.

Ofc. Kallberg interviewed the residents of 300 W Fairview #3.

I spoke with Janet Pe±a -Almejo, Sergio Mungoea-Lopez, Miguel Angel Mungoea and Ramon Leon Escamilla who live at 300 W Fairview #2. Janet and Sergio are married and they live there with Miguel, Sergio's nephew and Ramon who is Sergio's friend. They were all home last night and heard nothing out of the ordinary while they slept. They explained they know the residents of apartment #1 but only in passing. They do not remember there names but state since they are all from Hermosillo Mexico they would sometimes talk about this on occasion.

After interviewing the residents of the two apartment buildings, I maintained scene security by parking my vehicle so I could observed the area between the two buildings of 320 and 300 W Fairview so as to preserve any possible evidence.

At approximately 0800 hours I was asked to speak with the occupants of 320 W Fairview who had

I stayed on as scene security monitoring the area until about 1300 hours which concluded my involvement in the incident.

NARRATIVE

This is a supplement to the original report.

Observations:

On 10-10-10 at 0532 hours, I was dispatched to 300 W. Fairview St. #1, in reference a male subject down on the ground, and possibly dead. Upon our arrival, the officers on scene and I located a male victim laying on the living floor decapitated. It appeared the victim's head was cut away from his body. There was blood on the floor, with significant foot prints leading from the body to the front door. The body was laying stomach down facing to the western portion of the room. The victim's head was approximately 1-2 feet away facing to the southwest. I was not able to observe the victims face, but the victim appeared to be Hispanic. After the officers searched the apartment to ensure no additional victims or suspects were located inside, the apartment was secured.

On the patio of the apartment, I observed a large kitchen knife on a white in color plastic lawn chair. I directed the officers on scene to set up a crime scene and secure the immediate area. In addition, Officer Peterson separated the witnesses and interviewed them in Spanish. Additional officers on scene started an area canvass, contacting neighbors in an attempt to collect information.

I then contacted the on-call Person's Crimes Sergeant. Sergeant Potter advised he and Robbery/Homicide detectives would respond to assume the investigation. While conducting scene command, Sergeants Potter and Nichols arrived on scene. Once detective Spielman arrived, I briefed him and directed him the victim's location. At 0657 hours, I released the scene to Sergeant Potter. This concludes my involvement in the investigation.

CHARGING SUMMARY

CHANDLER POLICE DEPARTMENT

HOMICIDE CASE #10-111857

VICTIM:

Martin Alejandro Cota-Monroy (DOB 72)

SUSPECTS:

Crisantos Moroyoqui (DOB -73)Jose David Castro Reyes (DOB -84)Isai Morales Aguilar (DOB -87) aka Juan Jose Aguiar Campos (DOB -88)Subject only known as "Chilango or Joto."

NARRATIVE:

On 10-10-2010 at approximately 0530 hours, Daniel Moreno called the Chandler Police Department via a 911 call to report there was a man down inside his apartment located at 300 West Fairview Street #1, Chandler, Arizona. Daniel stated during the call that the man inside the apartment was possibly dead. When the 911 dispatcher asked Daniel to check on the victim, he stated he did not wish to go back inside the apartment and instead waited outside for Officers to arrive.

At approximately 0530 hours, several Patrol Officers were dispatched to the location to investigate. At approximately 0533 hours, Patrol Officer Marc Olivier arrived on-scene and was met outside the apartment by the reporting party, Daniel Moreno and his Uncle, Adolfo Moreno. As other Officers were arriving at approximately 0534 hours, Olivier entered apartment number 1 to check on the victim. Upon entry, Officer Olivier located a Hispanic male subject lying on his chest on the living room floor with his head completely severed and lying a few feet from the torso. There was a large amount of blood on and around the torso indicating the victim was killed and decapitated at this location. As other Officers arrived, the apartment was checked for other possible victims. When the house was confirmed empty of any other persons, the apartment and the surrounding area outside the apartment were immediately secured as a crime scene.

Once the crime scene was secured, Daniel Moreno and Adolfo Moreno were transported to the Chandler Police Main Station for questioning. Once at the Police Station, Daniel and Adolfo gave initial statements to Officer Petersen. When Peterson learned two other roommates were outstanding, Peterson used Daniels cellular telephone to call Jorge Moreno and requested he respond to the police station to be interviewed, which he did. After Jorge arrived, Daniel and Jorge called the last roommate, Manuel Jacobi [aka Chuga], and advised him to also respond to the police station to give a statement, which he did as well. Adolfo Moreno, Daniel Moreno and Manuel Jacobi were all interviewed by Detective Arias #494. Jorge Moreno was interviewed by Detective Moffat #493.

INTERVIEW WITH ADOLFO MORENO:

The first person Arias interviewed was Adolfo Moreno. In summary, Adolfo told Arias that he resides in Tucson and was visiting his son, Jorge Moreno and nephew, Daniel Moreno, who both live at 300 West Fairview Street #1, Chandler, Arizona. Adolfo said he arrived for his visit on 10-7-10. On the evening of his arrival, Adolfo met four men from California who were at the apartment. One of the subjects was a childhood friend of Manuel Jacobi. Two of the men spent the night at the apartment in anticipation for an overnight trip to Las Vegas, Nv. The other two subjects went back to their hotel in west Phoenix. The next morning the four California subjects and Manuel Jacobi left for Las Vegas and returned on Saturday evening, 10-9-10. Adolfo could not remember the California subject's names at the time of this interview.

Adolfo stated that on 10-9-10 at approximately 1900 hours, he and Daniel went to Phoenix to watch Jorge play an adult soccer game. When the game ended they returned home at 300 West Fairview Street #1 arriving at approximately 2100 hours. Once home, Adolfo, Jorge and Daniel all showered and dressed in preparation for their evening out. While at the apartment, a neighbor who was later identified as Crisantos Moroyoqui walked over to catch a ride to the El Coyote. At approximately 2200 hours Adolfo, Daniel, Jorge and Moroyoqui all drove to the El Coyote bar located at 479 North Arizona Avenue in Chandler.

Once at the El Coyote, Adolfo said he, Daniel, Jorge and Moroyoqui met up with Manuel Jacobi, and the four subjects from California. Adolfo said Manuel and the California subjects were already at the El Coyote Bar when they arrived.

Adolfo said they all remained together at the El Coyote Bar drinking beer throughout the evening. At some point late in the evening one of the subjects from California had an unknown altercation and was kicked out of the bar for a brief period of time, but was later allowed to return for the remainder of the evening. When the El Coyote closed at approximately 0200 hours, Adolfo, Daniel and Jorge all drove to the Filibertos Taco Shop located at 930 East Pecos Road in Chandler. When they arrived, they ordered food via the drive-up window then drove to their apartment at 300 West Fairview Street #1 in Chandler to eat.

When they arrived at the apartment, Manuel was home with the four subjects from California as well as the neighbor, Crisantos Moroyoqui. All of the subjects were drinking beer and wine in the living room. A short time later two female subjects who were friends of Manuel's showed up at the apartment to visit Manuel. The females were later identified as Edna Tiznado and Natalie [unknown last]. Because Edna and Natalie did not want to enter the apartment, Manuel went outside to visit with them. At approximately 0300 hours Manuel went with Edna in her vehicle to take Natalie home to a nearby residence in Chandler. At nearly the same time, Jorge was picked up by his girlfriend so he could give her a ride home. Once Daniel and Adolfo were finished eating at approximately 0330 hours, they went to bed leaving the four subjects from California and Moroyoqui drinking in the living room. Adolfo stated that he slept until 0530 hours at which time he was woken up by Daniel who told him someone was dead in the living room.

INTERVIEW WITH DANIEL MORENO:

The next interview Arias conducted was with Daniel Moreno. Daniel stated that he and Adolfo went to

Phoenix to watch Jorge play soccer. When the game was over they returned to their apartment to get ready to go out. While they were there, Moroyoqui arrived and asked for a ride to the El Coyote.

When they arrived at the El Coyote, they met up with Manuel and his four friends from California. The group all partied at the El Coyote until closing time at 0200 hours. When they left the bar, they drove to the Filibertos located at McQueen Road and Pecos Road in Chandler where they bought food then returned home to eat. When they arrived, Manuel was home along with his four friends from California and Moroyoqui, who were all drinking inside the residence. Daniel said shortly after he arrived home, Jorge was picked up by his girlfriend who had just gotten off work. At around the same time, two female friends of Manuel's showed up to visit, and they too left a short time later. When Daniel and Adolfo were finished eating, they both went to bed leaving the four California subjects and Moroyoqui drinking in the living room. Daniel said he slept until approximately 0530 hours and woke up for an unknown reason. When Daniel got up and walked out into the living room, he discovered the headless body lying on his living room floor. Daniel said he went into the other bedroom and woke up his uncle, Adolfo, and advised him what had happened. Just as Daniel and Adolfo were calling 911 for assistance, Manuel walked into the residence and saw the headless body as well.

Daniel, Adolfo and Manuel all exited the residence to wait for police. Because Manuel had an active warrant out for his arrest, he elected to leave the area prior to the police arriving. Daniel then called Jorge and advised him what had happened. Jorge advised Daniel he was at a casino and did not wish to return to the residence.

INTERVIEW WITH MANUEL JACOBI:

The last person Arias interviewed was Manuel Jacobi. Manuel told Arias that he knew the four subjects from California as well as the neighbor, Crisantos Moroyoqui. Manuel could only provide the names of two of the California subjects as David Castro, and Isai Morales. Manuel knew one of the other subjects only by his nicknames "Chilango or Joto." The fourth subject he knew only by face and did not remember his name. While providing information about the California subjects, Manuel explained that David Castro was a childhood friend from Mexico and only recently got in touch with him. According to Manuel, David called him several weeks ago and advised he would be in the Phoenix area. On Friday, October 8th, Manuel and the subjects from California all took an overnight trip to Las Vegas, traveling in a maroon Ford Expedition. They returned on Saturday, October 9th in the evening. Manuel stated that the subjects were staying in a hotel in the area of 43rd Avenue and the I10 freeway. Manuel said he had been to the hotel on previous occasions with the subjects but could not remember the name of the hotel. Using Google Maps, Manuel was able to identify the hotel as "Value Place" which is located at 1360 North 43rd Avenue in Phoenix. Manuel did not remember the room number but described where the room was located within the hotel. Manuel also provided the telephone number that David called him from, 602-441-6246.

Manuel then explained that when he and the California subjects returned from Las Vegas on October 9th, they all went out drinking at the El Coyote Bar in Chandler. While there, they met up with Adolfo, Daniel, Jorge and Moroyoqui. Manuel said they all stayed at the El Coyote until closing time. When they left, Manuel, his friends from California and Moroyoqui all returned to Manuel's apartment at 300 West Fairview Street #1 in Chandler. Manuel said shortly after he arrived home, his girlfriend, Edna Tiznado arrived with a friend named Natalie. Because Edna and Natalie did not want to enter the apartment, Manuel went outside to speak to them. At approximately 0430 hours Manuel went with

Edna in her vehicle to take Natalie home. Manuel said when they returned, he wanted to charge his telephone so he went into his apartment to plug his phone into the charger. While inside, his California friends and Moroyoqui were all talking drunk about Santa Muerte, which means the Saint of Death in Spanish, and were acting so strangely that Manuel felt uncomfortable enough to leave the apartment a few minutes later. While waiting for the subjects to leave, Manuel waited in Edna's vehicle which was parked just outside in the parking lot. At approximately 0525 hours, Manuel and Edna observed three of his California friends leaving the apartment. The subjects got into their maroon Ford Expedition and abruptly left the area. Manuel was suspicious of their actions so he entered his apartment to investigate. Upon entering, Manuel discovered a body lying on the living room floor with a severed head. At approximately the same time, Daniel exited his bedroom and met Manuel in the living room. After the police were notified, Daniel left the area for fear he would be arrested on an outstanding arrest warrant.

INVESTIGATION:

After Manuel provided the names of David Castro and Isai Morales and the location of their hotel in Phoenix, Chandler Detectives responded to the Value Place Hotel. When they arrived they contacted the management who provided them with the names of the above subjects who had rented the hotel room. In addition, the hotel had copies of Castro and Morales's Mexican ID cards as well as the license plate number to the maroon Ford Expedition they were driving (CA lic #6FWR784). The hotel also provided video surveillance footage that captured the victim with the three suspect's just days earlier. There is one suspect who has not yet been identified. He goes by the name of "Chilango or Joto." Two of the suspects were identified as Jose David Castro Reyes (DOB -84) and Isai Aguilar Morales ( -87).

Once still photos were obtained from the video surveillance, the photos were shown to Daniel, Adolfo, Jorge and Manuel. They were able to positively identify the subjects as David Castro and Isai Morales. The victim was later identified by his Mexican ID as Martin Alejandro Cota Monroy (DOB -72). The other suspect was identified only by his nickname, "Chilango or Joto."

INTERVIEW WITH JORGE MORENO:

Detective Moffat conducted an interview with Jorge Moreno, which was also digitally recorded. In summary, Jorge told Moffat that his father, Adolfo, was visiting from Tucson for a few days. On 10-9-10 Jorge had a soccer game in Phoenix so Adolfo and Daniel went to watch him play. When the game was over, at approximately 2100 hours, Jorge, Adolfo and Daniel all returned home at 300 West Fairview Street #1 in Chandler. While getting cleaned up, a neighbor he knows as Moroyoqui arrived at the residence to catch a ride to the El Coyote Bar. At approximately 2200 hours they arrived at the bar where they met up with Manuel and his friends from California. Jorge said they remained at the bar until closing at which time they went to buy food at a local Filibertos. When they arrived home at approximately 0230 hours, Manuel, his friends from California and Moroyoqui were all drinking beer in the living room. Jorge said he then received a telephone call from his girlfriend who advised she had just gotten off work and was on her way to return his car to him. When Jorge's girlfriend arrived at approximately 0230 hours, he drove her home in his vehicle, then drove to the Lone Butte Casino located at the 202 Freeway and Kyrene Blvd arriving at approximately 0308 hours.

Incident Report

Jorge said he remained at the Casino playing games until he won $2,400.00 on a slot machine. When Jorge went to collect his winnings, he was unable to collect because he did not have a photo ID on him. Jorge said he immediately left the casino and drove home so he could retrieve his ID. When he arrived he looked at his clock and noted that it was 0426 hours. When Jorge entered the house, the four subjects from California and his neighbor, Moroyoqui, were all sitting on the back porch drinking beer and talking. Jorge heard Moroyoqui asking the victim "Who are you? Who are you?" in an aggressive tone. Jorge said he was focused on retrieving his ID and did not care what the others were doing or talking about. Once he had his ID, Jorge got back into his vehicle and drove back to the Lone Butte Casino and collected his winnings which were approximately $1,700 after taxes.

Jorge said he was still at the casino at approximately 0530 hours when he received a telephone call from Daniel who told him one of the California suspects had been killed and decapitated in their living room. Jorge said he advised Daniel to hang up and call the police, which he did. Jorge said he remained at the casino until he received a telephone call requesting he respond to the Chandler Police Station for questioning.

CONTINUING INVESTIGATION:

While interviews were being conducted at the Police Station, Detectives wrote a search warrant to enter 300 West Fairview Street #1 to conduct a Homicide Investigation. Once the warrant was signed, the initial crime scene investigation began.

At approximately 0930 hours, Patrol Officer Ashley Lewis #604 was helping to maintain the exterior crime scene. While standing on West Fairview Street in front of the crime scene, Officer Lewis was contacted by a Hispanic male subject who was standing on the northern end of the crime scene and waving her over to his location. Lewis walked over and spoke to the subject who was identified as Jose Manuel Mesa Lopez. Lopez told Lewis that he lived at 320 West Fairview Street #1, Chandler, Arizona, which was only one building west of the crime scene location. [320 West Fairview Street #1 faces east directly in-front of 300 West Fairview Street #1]. Lopez went on to tell Lewis that when he got up this morning and walked out of his apartment to see what was going on with all the Police presence, he observed a pair of men's shoes lying next to his front door that were covered in what he believed to be blood. Lopez went on to say that he recognized the shoes as belonging to a subject who lives at his apartment he knows as "Muneca." Lopez then led Lewis over to his apartment to show her the shoes. When Lewis arrived at the front door and observed the shoes, she too believed the red substance on the shoes to be blood. Lopez advised that "Muneca" was still inside the apartment with four other subjects who also reside at this location. Officer Lewis summonsed the assistance of other Officers to assist her with contacting the remaining subject inside the apartment. Officer Lewis then made contact with the four remaining occupants of the apartment and had them exit the apartment and sit along the sidewalk while this investigation was conducted.

Officer Lewis then contacted Homicide Detective Spielman #333 who was working near-by, and advised him of this development. Spielman walked over to 320 West Fairview Street #1 and looked at the shoes lying next to the door. Spielman noted that the shoes were covered in a red substance that appeared to be of the same color and consistency as blood.

320 West Fairview Street #1 was then checked for further subjects inside. When no other subjects were found inside, the apartment was secured as a crime scene.

Incident Report

Officer Lewis then interviewed the five of the six subjects that were removed from the residence. Lewis did not interview the suspect, Crisantos Moroyoqui. In summary, four of the subjects identified the owner of the shoes as Crisantos Moroyoqui [aka Muneca or Luis]. Moroyoqui's roommates have seen him wearing the shoes on numerous occasions and saw Moroyoqui leaving the apartment in them last on the night of this incident when he left to catch a ride to the El Coyote Bar in Chandler. Moroyoqui was subsequently arrested and transported to the Chandler Police Department for further investigation.

After Moroyoqui was arrested, Officer Kallberg recognized Moroyoqui and advised that she had stopped out with Moroyoqui when she arrived on-scene and observed Moroyoqui hiding behind a vehicle just north of the crime scene. When Kallberg stopped Moroyoqui, he falsely identified himself as Luis Enrique Armenta. Kallberg noted that Moroyoqui appeared to be intoxicated and was not wearing any shoes or socks. When Kallberg asked Moroyoqui about his clothing and demeanor, Moroyoqui told Kallberg that he had spent the night at his sister's house in Queen Creek, Arizona, and that he had forgotten his shoes at her house when she gave him a ride home and dropped him off. Moroyoqui told Kallberg that he lived at 320 West Fairview Street #1.

Detective Arias read Moroyoqui his Miranda rights and attempted to interview him about this incident. Moroyoqui exercised his right to remain silent and did not wish to be interviewed.

A court order was granted to seize Moroyoqui's clothing items and DNA. When the clothing items were seized, Detective Moffat noted that Moroyoqui's pants had what appeared to be blood on them below the knees.

SUMMARY CONCLUSION:

On 10-10-2010 at approximately 0530 hours, Martin Cota Monroy (DOB 72) was found inside 300 West Fairview Street #1 with his head severed from his body. Just moments before his body was discovered, witnesses saw Martin Cota Monroy alive with four other subjects inside the residence, three of which were identified as Crisantos Moroyoqui (DOB -73), Jose David Castro Reyes (DOB

84) and Isai Morales Aguilar (DOB -87). As of 10-12-2010, the fourth suspect is only known as "Chilango or Joto.
