2.01 ACCOMMODATION IN AIR HOSTESSES HOSTEL, KARACHI

2.01.01

2.01.02

Eligibility – All Air Hostesses/Air Hostess (Trainees) appointed/recruited from stations outside Karachi when based or, undergoing training in Karachi shall be eligible for accommodation/boarding facilities at Air Hostesses Hostel, Karachi, subject to availability of necessary accommodation at charges/rule as may be prescribed by the Management from time to time. Ineligibility – Air Hostesses/Air hostess Trainees appointed /recruited from Karachi shall not be eligible for accommodation/boarding facilities at Airhostess Hostel, Karachi, when based or undergoing training Karachi. They shall make their own boarding and lodging arrangements.

2.01.03 CHARGES ON ACCOUNT OF BOARDING/LODGING From Rs. 2000/- to an amount equivalent to 50% of applicable house rent per month which should not be less than Rs. 3000/- per month will be charge for providing accommodation/boarding facilities to Airhostesses (from other than Karachi), in PIA Airhostess Hostel Karachi.

2.02 ACCOMMODATION IN HOTELS

2.02.01

Accommodation in Hotel during training in respect of following categories shall be regulated as under:- (a) Airhostesses & Female Traffic Assistant from

outside Karachi Those Airhostesses who arrive from outstation for training in Karachi, when not provided hostel accommodation in Airhostesses hostel, and Female Traffic Assistance arriving for training in Karachi from outstations shall be put up in first class hotel as approved by the Management.

(b) Airhostesses Trainees and Female Traffic Assistance Trainees from outside Karachi

(i) Rs.700 per month. (ii) Boarding and lodging will be at Corporation’s

expense (c) Airhostesses Trainees & Female Traffic Assistance

Trainees from Karachi (i) Rs. 1575/= Per month.

(ii) Boarding and lodging will not be provided by Corporation.

(d) Flight Steward Trainees from Karachi or outside Karachi (i) Rs.1575/= per month. (ii) Boarding and Lodging neither shall nor be

provided on Corporation’s expense. They shall make their own arrangements.

(e) Trainee Cadet / Contract Pilots & Flight

Engineers Boarding / Lodging facility shall be provided to Cadet / Contract Pilots & Flight Engineers when detailed for training purpose at the station (s) other then station of selection within Pakistan. In addition stipend of Rs. 1, 000/ per month shall be paid to all such trainees. The resident Cadet / Contract Pilots / Flight Engineer who are not provided boarding / lodging facility during training shall be paid stipend @ Rs.2,500/- per month.

2.03 ACCOMMODATION IN CREW MESSES

2.03.01 The rules regulate the accommodation and other facilities to Cabin Crew/Cockpit Crew members and Aircraft Engineers on flying duties in Crew Messes at stations, wherever, these are available. (a) Aircraft Engineer shall be permitted to fly as crew

members when they are required to observe any aspect of the performance of the Aircraft in flight. Such flights shall be authorized by the Deputy Chief Engineers/Station Engineers of the respective Station /Divisions.

(b) All Aircraft Engineers when flying to any station as

crew members shall be permitted the use of crew mess, including dinging facilities subject to availability of Mess arrangements at that particular station.

(c) Where however, it may not be possible to provide the

same to all the crew members at a time the facilities shall be provided in the following order of priority:

(i) Captain and Co-Pilot of the aircraft (ii) Air Hostess or female purser (iii) Aircraft Engineers (iv) Flight Pursers

2.03.02 These members of the crew on flying duties, who can not be provided necessary facilities at Crew messes for reason of limited facilities shall be provided the same facilities, at any other hotel. a. Cockpit Mess accommodation at domestic stations

i. At domestic stations, where hotel accommodation

is not available at the cockpit crew have to stay in Army Messes/Rest House etc. On a scheduled or unscheduled staff. They shall be paid Rs 6000/- (Rupees Six Thousands only) per day in lieu of accommodation.

ii. The bills for meals and accommodation shall be

cleared by crew at the Rest Houses / Officers Masses etc. before the leaving the station.

iii. The period of stay the Scheduled or unscheduled

staff shall be treated over Lay/over. b. Cabin Crew Mess Accommodation at domestic stations

i. Domestic stations, where hotel accommodation is

not available and the Cabin Crew have to stay in Army Messes / Rest House etc. On a scheduled or unscheduled stop the Cabin Crew shall be paid at sum of Rs. 150/- (Rupees One Hundred and Fifty only) per day on consolidated basis in lieu of accommodation.

ii. The bills for messes and accommodation shall be

cleared by the crew at rest Houses/Officers Messes. Etc. before leaving the station.

iii. The period of stay at scheduled /unscheduled

stops shall be treated as lay-over.

2.03.05 Daily Allowance to officers /staff on their posting abroad On permanent posting aboard, employees will be entitled to Daily Allowance for a maximum period of 30 days but miscellaneous expenses i.e. 15% of Daily Allowance will not be admissible. Employees allowed daily allowance in lieu of accommodation or accommodation allowance will not be entitled to group wise accommodation allowance and accommodation at Corporation’’ expense, during the period Daily Allowance is paid.

2.03.06 Daily allowance to officers on their posting at stations in

Pakistan. (a) Officers entitled to free furnished / un-furnished

accommodation, when unable to get such accommodation on arrival at the new stations shall make their own accommodation arrangements. They shall be allowed consolidated applicable rate of daily allowance for a period of 30 days from the date of arrival new station. Thereafter, they shall be entitled to be prescribed group-wise accommodation allowance. Hotel bills will not be required.

(b) Officers Engineering, Aircraft Engineers, Flight

Engineers, Pilots and employees in Admin categories, who are allowed rental ceiling/group-wise accommodation allowance shall be entitled to50% of consolated rate of daily allowance in lieu of rental ceiling/group wise accommodation allowance in even of non-availability of station. The accommodation on joining the duty at new station. The payment will be for 30 days from the date of joining at new station. Employees may, however, opt to draw group-wise accommodation allowance instead of the daily allowance.

(c) In case of transfer on request, daily allowance shall

not be admissible to the categories mentioned at sub-paras-(i) and (ii) above. The employees who have been transferred on own request shall be paid the group-wise accommodation allowance.

2.04 RESIDENTIAL ACCOMMODATION /ACCOMMODATION ALLOWANCE/ RENTAL CEILING

2.04.02 Entitlement Rules

a. Entitlement of accommodation allowance / ceiling /house rent shall be same as approved by the complement authority for the officers at the Head Office / Foreign Stations/ Domestic Stations, from time to time.

b. Cockpit Crew shall be entitled to house rent /

accommodation allowance at the rates as agreed in their agreement.

2.04.03 a. Area Heads / Station Heads shall be entitled to furnished accommodation at the rental ceiling as approved by the Committee constituted clause 04.23 of Admin Order No.42/92, dated 10.9.1991, from time to tome. Lease agreement shall be property negotiated with the owners of the respective house(s) and executed by them on behalf of PIAC in accordance with the instructions of the Head Office received through Policies & Remuneration Division.

b. Furnishing shall be approved by Management through Finance Manager Marketing from time to time.

c. Only Unfurnished accommodation shall be rented for the officers who are entitled to furnished accommodation as per approved policy. The furniture shall be supplied by the Corporation in accordance with furnishing ceiling as approved by the Management through Finance Manager Marketing from time to time.

d. As a general rule, as far as possible the laid down/ approved accommodation ceiling by the Management from time to time shall not be acceded.

e. Officers on their permanent transfer to other stations shall be allowed to continue occupation of furnished accommodation Provided to them by the Corporation for the period not acceding 30 days from the date of joining duty of new incumbent at the station. If the accommodation is not vacated by the out-going officer within this period, full rent is paid by Corporation shall be recovered by him.

e. Employees availing of the Foreign Earned Leave shall be entitled to receive accommodation allowance in foreign exchange. This payment shall be made irrespective of place where the officer or staff concerned spends his leave.

Employees who have been allowed accommodation shall not be allowed to group-wise accommodation allowance while availing FEL during tenure of posting except 15 days leave granted after release and vacating the accommodation.

f. The accommodation entitlement of Area / Station Heads. District Sales Managers, Station Representative not below pay Group-V Managers in PG-VIII & IX other than those designated locally as Managers within Pakistan are detailed in Appendix ‘B’ to this Chapter.

g. All other employees shall only receive their normal monthly house rent entitlement which the Corporation pays towards subsidizing their actual rental payments

2.05 HOTEL ACCOMMODATION FOR COCKPIT.

a. Selection of hotel accommodation in respect of Cock pit Crew and Cabin Crew shall be arranged by Hotel Committee as authorise by the Management from time to time.

b. In case of making own arrangement at a domestic

station, the Cockpit Crew will be paid at the rate of Rs. 6,000/- per day. For foreign stations, hotel bills will be paid at actual.

c. Managers Disbursement shall authorise Accounts /

Finance Mangers cornered to effect payment in this connection, under intimation to all concerned.

d. General Mangers / Managers / District Mangers/

District Sales Managers / Station Managers execute a formal contract of hotel accommodation / allied service / facilities with the respective hotels after approval of the Committee / Management as mentioned at para (a) above. The contrasts thus executed will be initially valid for one to two years only shall be reviewed / renegotiated there after on the basses of slandered services provided by hotels in the past and any increase, decreases in consultation with Hotac committee.

2.06 PROCEDURE FOR ARRANGING RESIDENTIAL ACCOMMODATION

2.06.01

Accommodation arrangements for officers entitled to furnished / un furnished accommodation shall be made as show bellow: Policy

to Pilots / Flight Engineers / Aircraft Engineers / Officers, (Admin category) in PG –IX & above who are not entitled to furnished / un-furnished accommodation at Corporation expenses.

b. The facility of advance rent will not be automatic.

Requests for advance rent will be considered by Director General Services and Director Finance for decision on merits of each case on specific recommendations of Departmental Head.

c. The advance shall be paid with in approval rental

ceiling only in unavoidable circumstances on the following conditions;

i- For hired accommodation only.

ii- Maximum for period of one year. iii- Not for accommodation owned for self, Family member or parents.

d. Lease can be executed carrying a higher rent than

the approved residential rental ceiling of the respective officer provided the employee undertakes to reimburse to Corporation / pay from own pocket the portion of rent / advance so payable in excess of the normal entitlement.

e. Deleted

f. Lease Agreement shall normally be signed and

made effective from the date of occupying the house or at the most one month earlier from the date of occupation of the house.

g. No change, what soever, shall be incorporated in

the lease deed, during its validity period specifically for increase in the rental, accept where the entitlement of a house / Accommodation allowance of the employee has been raised by the Corporation retrospectively and specific request is made by the concerned employee for the revised agreement or addendum to the Lease Agreement. The revised Agreement or addendum to the lease

Agreement in such case shall not be allowed retrospectively for a period of more than the current financial year.

h. All cases pertaining to the initial fixation of rent and subsequent revision in the rental ceiling shall be directly referred to General Manager (Works).

i. General Managers (Works) shall arrange a survey through Estate Officer (Works) and take a final decision in consultation with General Manager (Personnel) / Director HRA&C / Director Finance.

j. A copy of such decision shall invariably be indorsed to Policies & Procedures Sections for records and reference.

Procedure: Procedure for procuring the house shall be as under :

i. An advertisement shall be given in the press for residential accommodation. In response to the advertisement, officers shall be received by the General Managers (Works). After receipt of offers a list of the same shall be prepared and furnished to the officers concerned for whom the residential accommodation is to be secured. The Officers shall select the houses and inform the General Manager (Works) of their final choice / selection. After this, works Division shall finalize the Agreement as per standard Lease Agreement as at Appendix “D” to this chapter.

ii. However, officers entitled to Corporations accommodation will inform the General Manager (Works) that they have selected a particular house for their residence, and Works Division shall make arrangements to lease the same for them, in such as case Works Division shall finalize Lease Agreement with parties concerned as par Appendix “D” with out making any advertisement in the Press.

iii. Payment of State Agents Commission and Registration charges shall be available to officer entitled to furnished / unfurnished accommodation in Pakistan only subject to following conditions:

a. Agency Commission upto a maximum of one

month’s rent and 50% of the Registration charges, if any, shall be allowed by the Director General Services and Director Finance, only where it is absolute necessary.

b. Accommodation proposed to be acquired is not owned by the spouse, family members are near relatives of officer concerned.

c. The lease should contain a provision that any

employee of the Corporation can occupy the premises during the currency of lease in case the first allottee vacates the premises earlier than the lease period.

d. Agency fee shall be paid directly to the State

Agent through a crossed cheque under proper receipt.

iv. All expenses incurred on day to day maintenance / upkeep of residential accommodation like replacement of electric bulbs, repair of locks / sanitary fittings / water taps etc. shall be borne by the officer himself. Corporation shall not accept any liability of such expenses.

2.06.02 Outstations: At out stations the following procedure shall be followed:

A) Accommodation at foreign stations shall be arranged / secured by those officers who are entitled to free furnished accommodations / rental ceiling in accordance with the approval of the committee constituted under clause 04.23 of Admin o order No. 42/91, dated 10th September 1991. Lease Agreement shall be finalized by the officers concerned and signed by the area / station Heads.

B) In countries where local law requires that occupants should execute the Lease deed the Agreement should not be signed by the officers concerned them selves and not by the Area / Station Heads may obtained separately in accordance with the approval received from Compensation & Benefits Section.

C) All expenses incurred on day-to-day maintenance / un-keep of residential accommodation like replacement of electric bulbs, repair of locks / stationary fittings/ water taps etc. shall be borne by the officer by him self. Corporation shall not accept any liability of such expenses.

2.07.01

ALLOTMENT POLICY – STAFF ACCOMMODATION Entitlement: Rules for allotment of Staff Flats shall apply to PIA employees Pay Groups I to iv including those on deputation.

2.07.02 Eligibility: Married / Single accommodation shall be allowed to employees of pay Group i to iv with the under mentioned martial status:

a. Married employees; b. Widow and Widower employees with Children;

c. I. Single female employees on compassionate

grounds (two single female employees will be given one flat jointly),

II. Single / unmarried female nurses shall be allowed to stay in the family flats with in their departmental quota (each quota shall accommodate four nurses).

d. Two single employees (Pay Group I to IV) shall be

allotted one room jointly in single quarter.

Note: if both husband and wife working in PIA and become entitled for married accommodation, only one staff flat shall be allotted.

2.07.03 Criteria: The allotment of married / single accommodation shall be made on point system. HR Managers shall be compile waiting list in accordance with the allotment points as outlined in clause 2.07.04 below. Accommodation shall be allotted to the entitled employees

according to their seniority on the waiting list. In case of a contractual employee, the remaining period of service should be at least six months.

2.07.04 Allotment of Points

a. Length of Service

i. 5points for each completed of service:

ii. 4 points for the service more than 6 months:

iii. 3 points for the service less than 6 Months but more than 3 months

b. Children:

i. 3 points for the first dependent child: ii. 2 points for each subsequent dependent

child: c. Staff Working in Shifts: 3 points for the each

working in shifts.

d. Widower Employees with children: 2 points for the widower employees with children.

e. Widow Employees with children: 4 points for

each widow employees with children.

f. Compassionate Grounds: Departmental Allotment committee’s at their discretion may award up to 5 points. This discretion shall be exercised according to the following system:

i. 3 points for less may be allowed for reasons of

serious illness of family members / dependent parents subject to the certification by chief Medical Officers.

ii. 2 points may be given on special compassionate

grounds. These points shall not any be given to an employee who owns any residential area accommodation in his dependant’s name in Karachi / at station where staff quarters are provided.

g. Period on waiting List: 2 points for each month

on the waiting list from the date of application for the allotment of staff flats.

2.07.05 Managing Director’s Discretions: Managing Director at his discretion may allot a quarter to any staff on his request, irrespective of his/her position on waiting list.

2.07.06 Director’s Discretion: Directors may reserve 2 quarters from their department quota for allotment (at their

2.07.07 Allotment Procedure: Application for allotment of staff quarter shall be made on the prescribed proforma as in Appendix “D”. Application for allotment of staff quarters shall be made on the prescribed proforma and Submitted to the respective HR Manager / Personnel Officers who will ensure that the marks earned by each applicant are accurately calculated and the applicant is placed on merit list accordingly. Where two or more individuals earn the same number of points their intersectional position on the waiting list shall be determined by their seniority in service.

2.07.08 a. Category of Accommodation: Type ‘A’ and ‘B’ are the two categories of flats which have been newly built for the PIA employees. The type ‘A’ flats shall be allotted to the employees pf pay Group II and IV where as the type ‘B’ shall be given to the employees belonging to Pay Group I and II. Waiting lists for these two types of flats will be maintained separately on two different rosters, one comprising of all Pay Group I and I employees and the other one of all the employees of Pay Group III and IV in accordance with the criteria as laid down in clause 2.07.03.

b. Maintenance of waiting List:

Waiting list shall be maintained by departmental DGM HR/HR Managers in accordance with the laid down rules. Updated waiting list shall be finalize and submitted to General Manager HR Management in June and December every year.

Accommodation available within departmental quota shall be allotted to entitled employees according to their seniority on the waiting list.

2.07.09 Flats Inappropriate to Pay Group: Director may allot surplus accommodation which is not appropriate to the group provided the employees undertakes to vacate the allotted accommodation when required for employee entitled to that type of accommodation. The competent Allotting Authority may allot an accommodation of one class lower or higher that the one to which an employee is entitled, for administrative reasons.

2.07.10 Distribution of Flats: a. Keeping in view the strength of staff in each Department

The flats reserved for allotment to PIA employees stranded in Bangladesh shall be allotted on temporary basses to other dissevering employees on the condition that they must vacate them on 15 days’ notice without provisioning of any alternate accommodation if and when required by the corporation. 2.07.11 Handing / Taking Over: Proper handing /taking over of the quarter shall take place at the time of occupation / vacation of the quarter. An authorized representative of the respective HR Managers of the Department along with a representative of Admin Services Division shall hand over / Take over the passion to/from the employee. An employee who hands over his/her quarter to a person other than the authorized representatives shall render himself/herself liable to disciplinary action under the rules of the corporation.

2.07.12 Tenure of Allotment: Allotment Period---The allotment of flats shall henceforth be for the period till the allottee’s transfer, secondment, redesignation, termination, dismissal and, in case of Pay Group V officers, requirement of the corporation for the vacation of the flat.

2.07.14 Retention of Flat by Spouse after Death of Allottees: In the case of death of Allottees, spouse having a no children shall be allowed to retain the flat for a period of 3 months and the widow or widower (with children) shall be allowed to retain the quarter for maximum period of 6 months.

2.07.15 (a) It shall be the duty of staff on the waiting list to keep their HR Managers Personnel Officers informed for any changes in their marital status, size of family or other occurrence that may result in change of points earned by them. (b) Mutual Transfer Sub-letting / sharing of accommodation:

i) Mutual transfer / Sub-letting / sharing of allotted accommodation without prior approval is strictly prohibited and shall render the employee liable for disciplinary action and cancellation of allotment order and imposition of major penalty as per rules. An employee vacating the flat shall hand-over its possession to concerned DGM HR / HR Manager or his / her authorized representative only.

ii) Mutual transfer / volunteering in favor of any other employee on extreme compassionate grounds which includes serious sickness of any family member, deteriorated law and order situations of the area in which employee is residing and transfer to head office from other station of PIA etc shall be considered by the management on case to case basis. The competent authority for approving mutual transfer / volunteering in favour of any employee will be Director HR, Admin & Coordination. (c) Staffs who own a house in Karachi / at station in his / her name or in the name of any dependent family member shall also not be eligible for allotment. Wrong declaration made in this regard shall render the staff liable to the disciplinary action.

2.07.16 Allotment of Flats to Officers in Pay Group V

02.07.19 Functions of Allotment Committee: The Allotment Committee shall perform the following duties:

To advice the respective DIRECTOR about cases deserving special consideration on special grounds for allotment of the quarter under the powers vested in him under clause2.07.04.

Property shall be purchased for offices and residences of Pak-based employees, within Pakistan and at foreign stations, wherever feasible. The policy end producers for acquisition of property shall be as follows:

Policy: Acquisition of property offices and residential units will constitute an asset in Pakistan and abroad, this will result in reduction station cost by saving payment exorbitant annual rentals.

2.08.03

Guideline For Selection Property

a. Offices

i. Space - Should be the same as presently occupied or slightly more Slightly more to cater for further expansion needs.

ii. Location - Should be economical and property located at Functionally and commercially viable area.

b. Residential Units Accommodation – Apartments / Flats comprising drawing, dining and two/three bed rooms should be Purchased. Proposals to acquire independent house in exceptional case, however, could be Considered. Location - Should be preferably closer place of work with available facilities of transport and schooling expensive location should be avoided. In case of preference for suburbs, justification should be given.

c. Financing

i. Proposals should be contain type of Acquisition, whether it free hold or on long lease.

ii. Cost of property pay back period whether

outright purchase Out of PIA’s own funds or through bank loan etc.

iii. Rate of installments-whether installments are

equal to rental Payment or more/less.

iv. Amount of down-payment. v. Other financing charges, if any.

-Determine those stations where acquisition of property for offices and residential units is considered feasible. -Evaluate proposals received from Departmental Sub-Committee and determine its viability for acquisition of property at a station considering financial impact, availability of funds and expected benefits. For this purpose the committee or its nominee shall visit the station and select the premises consider suitable for acquisition. - Request for the additional information to the department Sub-Committee, if so required. - Prepare and submit final proposals for obtaining approval of competent authority.

2.08.06 Competent Authority: Purchase of property in Pakistan and abroad, Involving amount up PKR 50 million or US $ 1.25 million or equivalent in local currency shall approved by the Chairman/MD PIA, whereas in cases exceeding the above amount, approval of PIA Board of Directors shall be required.

2.08.07 Execution of Purchase/Sale Deed: The Area/Station Head shall, on authorization from the Management, execute sale/purchase deed, mortgage/financing documents with bank and complete acquisition process considering the best interest of the corporation.

2.08.08

Handing/taking over property: Handing/taking over process of the acquired premises will be completed by the Station/area Head, who shall ensure preparation of inventory of the fitting, fixtures, equipments, and all requisite details/ drawing of the premises. Set of these documents shall be forwarded to the Secretary PIA, General Manager (general Accounting) and manager Estate.

2.08.09

MAINTENANCES a, Sales/Admin Offices

i. The maintenances, repairs and renovation of the premises will be undertaken with PIA funds. ii. No major repairers, renovation will be undertaken without prior approval of DIRECTOR Works.

b. Accommodation/Residential Units

i. Maintenances and repairs work will be undertaken only on the approval of the Outstation Works Committee.

ii. No renovation/addition/alteration will be

authorized by the Outstation Works Committee to premises without prior approval of the Director Works.

iii. No repairs to fixtures and fittings will be undertaken which has to be done by the occupant officer. Repairs to equipment/ machines will be undertaken by the Outstation Works Committee only after conform that:

- The damage has not occurred due to any operational fault.

- The equipment/machine has outlived its utility.

RULES AND PROCEDURE FOR LEASE OF OFFICE ACCOMMODATION AT DOMESTIC & FOREIGN STATIONS

2.09.01

The following approved rules and procedures shall henceforth be adhered to for hiring/ leasing office premises and establishments of the Corporation at Head Office and domestic/foreign stations:

2.09.02

EVALUATION OF ACCOMMODATION, REQUIREMENTS AND APPROVALS a. Whenever a necessity arises for acquiring/ Hiring of

additional space/ accommodation, the requirement shall be evaluated by the user department / division/ section at Head Office and stations, considering the feasibility and economics of the proposals, i.e., actual space required, financial impact , availability of funds and expected gains in terms of commercial value likely to accrue from the proposal.

b. The unit responsible for initiating proposals for

acquiring additional/ new office space and accommodation would obtain the approval of the head of the user department prior to processing the case.

2.09.03

SELECTION OF SPACE/ACCOMMODATION a. Required space/ accommodation would be sought and

selected by the user department / section at outstation in a suitable location, important from the commercial and functional point of view. Advertisements may also be released or assistance of the Estate Agents obtained. Estate Section of Works Division will coordinate and Assist the user department in finding suitable space/ accommodation if required.

b. A committee comprising Manager Estate or his nominee from the Works Division, and member nominated by the user department or the chief of the concern section at out stations within Pakistan would negotiate and finalize terms and conditions of the lease.

c. Terms and conditions for acquisition of

space/accommodation at foreign stations would be negotiated by a team of comprising the Stations Head. Finance Manager and admin Manager, where the annual lease money or rental of the lease does not exceed Rs. 500,000 or equivalent in foreign currency. in cases where the annual lease money/rental exceed this amount, Manager Estate or his nominee would be co-opted as member for negotiating the terms and conditions of the lease.

2.09.04

APPROVAL OF THE COMPETENT AUTHORITY AND EXECUTION OF LEASE a. The competent authority for approving case of annual

lease money/rentals upto Rs. 500,000 and above would be the Director General services and MD/DMD respectively. Once the terms and conditions recommended bye the committee are approved by the competent authority, the lease agreement would be executed by the area/station head at out station head at outstation and Manager Estate at Head office.

b. The annexed lease format that has been cleared by

Legal Service Division would be used for execution. nevertheless, should the terms and conditions between the parties necessitate some additions/modification in the subject lease format, clearance from the legal Services Division will be obtained before execution the farm is attached as appendix ’A’ to this chapter

c. The lease agreement at foreign station would be

finalized and executed as per the law of the land by the area/station head. Who will conceder all measure to safeguard the interest of the corporation, in coordinate within the locally appointed legal Consultants/Advisor.

d. A copy of the lease agreement executed at outstations

within Pakistan and at foreign station will be sent to Manager Estate for record.

2.09.05 PAYMENT RENTS AND CHARGES: Finance units of the respective department at Head office Outstations will be responsible or payment of rents/charge to owner, in accordance with terms and conditions of the lease, duty approved by competent authority, and provided for in the budget.

2.09.06 EXTENSION/RENEWAL OF THE AGREEMENT AND REVISION OF THE RENT The user department and area/station head would initiate and obtain approval of the competent authority for renewal/extension of existing lease agreement including revision of rent, if any, prior to its expiry

2.09.07 HANDING/TAKING OVER The handing and taking over the leased or hire premises, including preparation of the inventories of fittings and fixtures, equipment etc. at the time of commencement/termination of lease agreement would be responsibility of the user department and area/station head.

2.09.08 NEW STATION The hiring/leasing of office accommodation at new station will not be proceeding until and unless competent approval for opening new station is available.

ALLOTMENT OF CONTRACTUAL STAFF ACCOMMODATION (PG-1 TO IV) Contractual employees in staff cadre shall be eligible for allotment of accommodation available in PIA township. at par with regular employees Allotment of Contractual employees shall be made in accordance with laid down procedure, subject to the following provisions A) The remaining period of contract should be at least six months B) Security deposit of Rs.10,000/- (ten thousand), refundable, shall be required in each case.

2.11.01

Employees visiting Karachi on official duty / training shall continue to be provided boarding & lodging at Airport Hotel, Karachi, located near Terminal-I at Karachi Airport, as per agreed arrangements.

Procedure:

2.11.02 PIA Identity Cards shall be presented by the employees at

the hotel counter for availing boarding & lodging facilities.

2.11.03 All such employees shall draw advance from their base station and settle the hotel bills on check-out at their own. Single room charges (including breakfast / meals & taxes) as agreed between PIA and Airport Hotel are Rs.2550/- per day.

2.11.04 TA forms shall be submitted to the respective Accounts /

3. Competent Authority -The committee constitute under clause 4.22 of schedule of Administrative Power shall be empowered to approve the rents on the merit of each case, However, while approving such request following criteria shall be kept in mind;

a. Type of Accommodation - As far as possible only apartments should be chose in

reasonable localities.

b. Size of Accommodation - Only two/three bedrooms house, built on a plot of not more than 500 yards or one kanal to be hired in reasonable locality

c. Location – it should be nearer to the work place, however, those cases where Corporation

car/ fuel is provided, house may be hired in other acceptable localities.

d. Period of lease – The accommodation shall be hired for a minimum period of three years with a clause incorporated that during the currency of lease agreement, the rental shall not be enhanced and in case the incumbent is transferred his successor shall occupy the house of remaining period.

e. Maintenance of Accommodation – The lease agreement at domestic station within

Pakistan should contain a clause about the regular maintenance of accommodation, as such maintenance shall be the responsibility of concerned office/ landlord and corporation shall not be responsible for payment of any maintenance expenses.

4. Procedure – All case pertaining to initial fixation of rent and subsequent revision in the rental

ceiling shall be referred to policies and Remunerations Division, through concerned area/Station Head.

5. The existing incumbents in Pay Group VII and below (other than DSMs), who were permitted to

acquire accommodation, on lease between PIA and Landlord, shall not be affected.

a. That Lessee paying the rent and observing the covenants on its part to be performed shall peacefully enjoy the demised premises without any interruption by the Lessor or any person lawfully claiming under him.

b. That the Lessor shall pay all rates, assessment and impositions whether Government,

Municipal or local levied and payable in respect of the demised premises.

Appendix ‘D’ c. That if the demised premises shall at any time during the terms of this lease be destroyed or

rendered uninhabitable by cyclone, tempest, earth-quake, fire, strike, riot and civil commotion, violence of any army or mob, air raid, war of any irresistible force not caused by the act or default of the lessee its servant or agent the lease shall terminate, forth within, and in case of partial destruction of the demised premises as aforesaid, the Lease shall be terminable at the option of lessee provide written notice to this effect is given to Lessor within 20 days of such partial destruction. in case of total destruction no rent shall accrue to the lessee and Lessor shall make proportionate refund of the advance rent, if any, paid by the lessee, in case of partial destruction if the lessee elect to remain in the demised premises the Lessor shall allow a proportionate rebate in the rent to the lessee, until such time as the demised premises shall have been restored by the Lessor and again rendered fit for complete habitation.

d. The Lessor shall at his own cost keep the demised premises, including sanitary electrical fittings,

in good and tenantable repair and condition to satisfaction of lessee by caring out regularly all necessary repairs and maintenance and shall also fro time to time during the terms of this lease execute any work that may in opinion of the municipal or other competent authority or authorities be necessary to put the demised premises into good and sanitary orders and conditions, the lessee shall have right and in the event of Lessor failing to execute such repairs within 15 days after receipt of written notice in this behalf from the lessee , the shall have the right to execute the necessary repairs and/or work at sole cost and risk of Lessor and to deduct the full cost thereof (including supervisory and/or departmental expenses) from any sum due to the Lessor under this lease or otherwise or to terminate the lease forthwith for such failure on the part of the Lessor the exercise of either option to be without prejudice to any other rights and remedies of the lessee provide that if in opinion of lessee or its duty authorized representative any immediate repairs are necessary in order to safeguard the demised premises or the safety or health of the occupants thereof, the lessee shall be at liberty to execute such repairs without notifying the Lessor and to recover the cost thereof from any sums due to the Lessor under this lease or other wise.

e. The Lessor shall arrange for color and white washing and necessary repairs of the demised

premises once very ______ years.

f. The Lessor shall be responsible for and ensure adequate and regular supply of electricity, water and gas.

5. it is expressly agreed between the lessor and the lessee that the taking over and handing over of the

3. the lessee shall, in case of total destruction of the demised any deterioration in the demised premises, rendering in unfit for further tenancy, immediately terminate and case of partial destruction shall terminate at the option of the lessee provided a written notice is give to the lessor within 20 days after partial destruction referred to above. In case of make proportionate refund of the Advance rent, if any pay elects to remain in the demised premises the lessor shall allow proportionate rebate the rent to lessee until such time the damaged portion of the demised premises is made habituate by the lessor again.

5. The lessee shall have a right to sub lease the whole or part of the demised premises,

if so desired, without referring the meter the lessor, but such sub-lease shall not exceed the period of lease.

only electric water and gas charges consumed in the demised premises.

7. The demised premises shall be used for such purpose as desired by the lessee.

8. The lessee shall permit the lessor or hi dully authorize representative to enter upon a view and conditions of the demised premises with prior permission of the in writing.

9. The lessee shall hand-over vacant and peaceful possession of the demised premises

to the lessor upon the expiry/termination of this lease.

10. The lessee shall be entitled to make alternations attached fixtures and signs in or upon the demised premises and particularly to affix a flag staff and office signs, fixtures additions, structures so placed in upon or attached to the demised premises shall be and remain the property of the

Appendix ‘G’ Continued lessee and may be removed there form by the lessee prior to the expiry /termination or on expiry/termination of the lease, but the lessee shall restore the demised premises to the same conditions as that existing at time of execution of the lease and the shall have no right to claim cost of compensation of the items in the demised premise.

11. The lessee paying rent of and performing convents and stipulations contained herein shall enjoy and remain in peaceful procession of the demised promises during the lease period without let or hindrance from the lessor or any person claiming any interest through the lessor.

12. the lessor shall arrange for color and white washing and repairs of the demises

13. if the lessor sells, transfer, assigns, bequeath, mortgages or in any manner transfer ownership or control of the demised premises, then the full terms and conditions and option of this lease shall remain effect for full period of the lease and renewal thereto.

14. the lessor shall be reasonable for and ensure adequate and regular supply of

electricity, water gas in the demises premise.

15. it is expressively agreed between the lessor and lessee the taking over the handing over the premises at the commencement and termination of the lease shall be between Lessor and the PIA employee occupying the premises and that all inventories and claims, if any, shall be settled between the Lessor and the aforesaid PIA employee.

16. The lessor all times during the period of the lease of the demised premises. Keep that

his own expenses the demised premises including sanitary fittings such as WC basin, urinal etc, in good tenantable state of repairs and conditions to the satisfactions of the lessee and execute work which shall be necessary to keep the demised premises, in good sanitary repairs and conditions and on the event of the lessor failing to execute such repairs within 15 days after written notice by the lessee, the lessee shall have the right to execute the lessor and to deduct the necessary repairs and/or works at the cost of the lessor and deduct the full cost (including supervisor) and/or departmental expenses) from an sum due to the lessor under this lease without prejudice to any other rights and remedies of the lessee or to terminate the lease for such failure on the part of the lessor, provided further that wherein the option of the lessees or it’s

In the event of any dispute arising between the parties hitherto relating to arising out of these present such dispute shall be referred to the arbitration of two arbitrators, one to be appointed by each party and in the event of the disagreement between such arbitrators the matter shall be referred to an umpire whose some shale be agreed upon the arbitrators before entering upon the arbitration and the award of the arbitrators or umpire shall be final and binding upon the parties IN WITNESS WHEREOF, the parties aforementioned have sign this agreement of lease in token of acceptance of the terms thereof.
