HE CALIFORNIA LEGISLATURE in1976 continued the progressive course it had set inthe previous year with respect to the needs ofworking people.

Yet, the cancer of unemployment continues asthe dread disease of the state. We appreciate thatthe primary burden of economic recovery rests withWashington. But, not all of it. State governmentmust do more than it has.

In sum, the two years of the 1975-1976 sessionbrought a remarkably high measure of social andeconomic progress to the workers of the state. Indeed,a higher measure than in any comparable periodof the past.

But with nearly a million Californians out of workmonth after month, words like "progress" losetheir meaning.

lHE 1976 SESSION of the State Legislature was markedby the achievement of a generation-long struggle by thestate labor movement to extend disability insurance bene-fits to pregnant working women and by a record increasein California's workers' compensation benefits.

The pregnancy benefits measure was first proposed bythe California State Federation of Labor in 1947. The 1976law provides up to three weeks of benefits before and threeweeks after delivery.

The 1976 liberalization of California's workers' com-pensation law provided the largest boost in weekly disa-bility benefits in the 63-year history of the program. Bothmaximum temporary and maximum permanent disabilitybenefits were increased by $35 a week - from $119 to$154.

This legislation also increased the death benefit of awidow from $40,000 to $50,000 and the benefit for awidow with one or more dependents from $45,000 to$55,000. State officials have estimated that the new lawwill result in the payment of an additional $75 million ayear in benefits to California workers.

Further progress was realized in 1976 with the enact-ment of a law to require California's minimum wage tobe kept at least as high as the federal minimum.

These and other 1976 gains followed the unprece-dented advances won in 1975, the first half of the two-year session. They included the enactment of a collectivebargaining law for farm workers, a state ban on profes-sional strikebreakers, the outlawing of industrial home-work in the garment industry, a collective bargaining lawfor teachers and other school employees, a curb on theunfair use by employers of injunctions in labor disputes,and free choice of doctors under workers' compensation.

Taken together, they made the 1975-76 session the mostproductive in the 75-year history of the Federation.

A total of 38 major labor measures was enacted in the1975-76 session, 14 of them in 1976. The 24 labor meas-ures enacted in the first half of the session were reviewedin detail in "Force for Progress - 1975." The 14 meas-ures enacted this year are reviewed in the body of thisreport below.

Certain disturbing reversals, however, were sufferedin the 1976 session. Perhaps the most critical was the fail-ure of the legislature to enact a collective bargaining lawfor public employees.

The State Compensation Insurance Fund assumed anew and dangerous role in calling for removal of workers'injury rights won by Labor in the courts. Unfortunately,Governor Brown signed that anti-worker restriction intolaw.

And the state government failed to relieve the unem-ployment crisis that still plagues California.

Despite the cited reversals, liberal history was writtenduring 1975-1976.

Particular thanks for the successes are due GovernorEdmund G. Brown, Jr. and the Democratic leadership inboth houses as represented by Speaker Leo McCarthy inthe Assembly and President Pro-Tem James Mills in theSenate. Many individual legislators also deserve praise forcarrying Federation-backed bills through the various com-mittees and on to the floor for passage. This review docu-ments the voting records of all state legislators. (See votetabulations beginning on Page 6).

The strong support and cooperation of local unionand central body officials were, of course, two majorfactors in Labor's success in the 1976 session.

The basic strength of the Federation in the 1976 ses-

sion was in the 1,700,000 members on the home front. Thehopes of all California workers for greater progress in thefuture, as in the past, rest on the mobilized vigor of theunion movement.

Following are summaries of the 14 measures enactedin the 1976 session:

LABOR RELATIONS1. Successor agreements. SB 1341 (Alquist) makes any

collective bargaining agreement existing between an employerand a labor organization binding on any successor employer forthe duration of that agreement or up to three years.

2. Wage claims. AB 3249 (Foran) authorizes union bargain-ing representatives to handle union members' wage claimsbefore the State Labor Commissioner.

3. Teachers seniority. SB 1615 (Rodda) protects the tenureand seniority rights of teachers and other employees of theCalifornia State University and Colleges.

SOCIAL INSURANCE4. Workers' compensation. AB 467 (McAlister) provides the

largest boost in temporary disability benefits in the 63-yearhistory of California's workers' compensation program. It in-creases both the maximum temporary disability benefit and themaximum permanent total disability benefit by $35 a week-from $119 to $154. It also boosts the death benefit for a widowfrom $40,000 to $50,000 and for a widow with one or more de-pendents from $45,000 to $55,000. In addition, it increases theminimum weekly benefit for permanent partial disability from$20 to $30. The new benefits apply to job connected disabilitiesincurred after Jan. 1, 1977.

5. Pregnancy benefits. AB 3881 (Fazio) provides pregnancybenefits under the state's disability insurance program for upto three weeks before delivery and three weeks after delivery.

WORKING CONDITIONS6. Minimum wage. AB 2812 (Lockyer) assures that Cali-

fornia's minimum wage will be kept at least as high as the fed-ei-al minimum.

7. Personnel file access. SB 1588 (Roberti) gives state em-ployees the right to see material in their personnel files and to

request amendment of errors in such files.8. Owner-operators. SB 1684 (Stiern) will require owner-

operators to withhold state income taxes from wages due justas other employers are required to do. It specifies that suchwages shall include all remuneration, other than equipmentrent, which is paid to individuals who are owner-operators oftheir equipment or tools used in the performance of servicefor their employer.

9. Farm workers. AB 3603 (Lockyer) requires farm workersto be paid once every two weeks and bars employers fromforcing farm workers to forfeit their vested vacation time ifthey quit or are terminated.

10. Farm labor contractors. AB 3730 (Lockyer) requiresfarm labor contractors to supply growers with a payroll list con-taining data on all employees working for a grower.

11. Wage claim enforcement. AB 1522 (Berman) gives theState Labor Commissioner authority to issue a final order forpayment of wages due workers, with the order enforceable byfiling in superior court. It requires employers to go to court tochallenge the court-backed judgment.

12. Equal pay. SB 1051 (Rodda) strengthens the state'sequal pay laws which forbid pay differentials based on sex forjobs requiring equal skill, effort, and responsibility, and per-formed under similar working conditions. It also permits classaction suits on behalf of workers discriminated against andextends to two years the statute of limitations on legal actionto recover wages.

GENERAL13. Industrial Welfare Commission. AB 2238 (Goggin) re-

quires the State Industrial Welfare Commission to be composedof two labor, two management and one public representativeand stipulates that members of both sexes shall serve on thecommission.

14. Directory assistance. AB 3368 (Robinson) prohibits theState Public Utilities Commission from granting telephonecompanies the right to charge customers for directory assist-ance service.
