matters asserted herein.

2. The Bureau of Indian Affairs (the “BIA”) provided numerous documents

pursuant to a Freedom of Information Act (“FOIA”) request by Wapato Heritage,

LLC. Wapato Heritage, LLC provided these documents for Plaintiffs to copy pursuant

to permission by United States Attorney Pamela DeRusha. Many of these documents

were numbered by the BIA. Attached as Exhibit A to this declaration is a true and

correct copy of BIA document number 1060 which lists the beneficial MA-8

landowners on August 14, 1991.

4. Attached to this declaration as Exhibit C is a true and correct copy of a

patent filed with the United States Department of the Interior General Land Office that
