ADMINISTRATIVE MATTERS

EXCERPT FROM THE BFP PROGRAM ON AWARDS AND INCENTIVES FOR SERVICE EXCELLENCE (PRAISE) PARA 9 THE REQUIREMENTS AND PROCEDURES:

9.1 Requirements for Nomination-Chiefs of offices and units shall nominate or recommend employees for awards or incentives with the following supporting documents:

9.1.1. Regional PRAISE Committee Resolution9.1.2. Endorsement/Recommendation from concerned officer(s)9.1.3. Proof(s) of achievement(s) (photos, news clippings, and affidavit of

victim, post activity report and others)9.1.4. Highlights of accomplishments from August of the preceding year to July

of the issuing year arranged according to significance with descriptions and dates (items 9.1.4 to 9.1.9 shall apply for Best Employee Awards Category only)

9.1.5 Performance evaluation sheets with VS rating for the last two (2) consecutive rating periods with the recommendation or endorsement of superior

officers

9.1.6. Personal data sheet(s) with 1x1 photo(s) of the nominee(s) duly subscribed and sworn to before the Human Resource Management Officer.

9.1.7. Latest Statement of Assets and Liabilities9.1.8. Certificate of Non-pending Case9.1.9. Certificate of Good Moral Character

Failure to submit any of the foregoing requirements, where applicable, shall constitute a ground for automatic disqualification from the search.

9.2 Selection Procedure9.2.1 Recommendation/nomination folders must be submitted to BFP PRAISE

Committee Secretariat in the BFP National Headquarters (Morale and Welfare Section, HRDD) for pre-screening

9.2.2. Upon screening, the Secretariat shall submit the result of pre-screening to the BFP PRAISE Committee for final evaluation

9.2.3. After careful deliberation, the BFP PRAISE Committee shall recommend prospective awardees through resolution concurred by the majority of its members for approval of the BFP Chief

9.2.4 Upon approval, the resolution shall be transmitted to the Secretariat (Morale and Welfare Section, HRDD) for preparation of citation, awards and incentives

9.2.5. The citations shall be coursed through the staffs (CSW) for approval/signature of the BFP Chief and/or other signatories.

SUBJECT: POLICIES AND GUIDELINES IN THE RECRUITMENT, SELECTION AND APPOINTMENT OF FIRE OFFICER 1 (FO1), NON-UNIFORMED PERSONNEL (NUP) AND COMMISSIONED OFFICER VIA LATERAL

ENTRY IN THE BUREAU OF FIRE PROTECTION (BFP).

I. SCOPE:This Memorandum Circular shall cover applicants for Fire Officer 1 (FO1), Non-

Uniformed Personnel (NUP) in the National Headquarters (NHQs) and Regional Offices (ROs) and Commissioned Officer via Lateral Entry in the National Headquarters (NHQs).

II. OBJECTIVES:a. To establish the implementing policies, guidelines and standard procedures

in the recruitment, selection, and appointment of Fire Officer 1 (FO1), Non-Uniformed Personnel (NUP) and Commissioned Officer via Lateral Entry;

b. To promulgate equal opportunity to all qualified men and women for appointment in the BFP; and

c. To ensure that all appointments are in accordance with the approved guidelines and existing rules and regulations.

III. DEFINITION OF TERMSBFP Personnel Selection Board (PSB) – refers to National and Regional Personnel Selection Boards created to screen, evaluate, and recommend applicants for recruitment in accordance with established policies and guidelines.

Committee of Examiners – composed of selected BFP members tasked to formulate questionnaires intended for the qualifying examinations.

Drug Test - a test or series of test administered to applicants to determine whether they are free or not free from use or abuse of any regulated or prohibited drugs.

Eligible- a person who obtained a passing grade in any examination administered by the Civil Service Commission (CSC) or other authorized entities and whose name appears in the register of eligibles.

Fire Officer 1 (FO1)- the initial rank of appointment for Non-Officer rank (NOR) personnel in the BFP.

Hospital/ Clinics/ Laboratories - refers to any legitimate private or public medical institution duly accredited by the Department of Health (DOH).

Lateral Entry from the Outside – the process of appointing Officers in the BFP which commence with the rank of Fire Inspector or Senior Inspector as the case may be.

Merit Selection Plan- a policy created and administered in accordance with the provisions of Civil Service rules and standards. It includes provisions designed for an unambiguous screening process, which may include tests of fitness.

Non-Uniformed Personnel (NUP) – refers to any civilian employee in the BFP.

Original appointment – a warrant in wriring extended by a competent authority allowing the appointee or person who meets all the requirements for initial appointment to the BFP to accupy the position stated in the appointment and to perform the duties arising from it, effective at a specified date or time and usually with a definite compensation.

Outstanding Accomplishment -proven excellence in academic, public service and volunteer work.

Personality Traits- refers to the characteristics and ways or behaviour that define the uniqueness of an individual.

Potential- refers to the person’s inherent capability to perform the duties and functions of the aspired position. .

Psychosocial attributes – refer to the psychological and social characteristics or traits of a peson. It denotes a person’s ideas, belief or individual perception.

Psychological and/or Neuro-Psychiatric Test- a test design to determine whether or not the applicant suffers from any mental or psychological disorder.

Physical and Medical/Dental Examination -the series of examination undertaken to completely determine whether the applicant is in good health condition.

Physical Agility Test- a test design to determine whether the applicant possesses the required coordination, strength and speed of movement necessary for the service.

Recruitment- the process of attracting potential applicants who have the minimum qualifications to fill up the vacant positions in the BFP.

Regional Personnel Selection Board (RPSB)- A regional committee counterpart of the BFP NQH PSB.

Selection- the systematic method of determining the best qualified applicant for the position based on merit and fitness.

Waiver- the act of foregoing the minimum requirements for applicants, subject to conditions provided under this Circular.

IV. POLICIES:1. Recruitment of the rank of Fire Officer 1 (FO1) and Non-Uniformed Personnel (NUP),

and Promotion via lateral Entry shall be opened to all qualified applicants based on the principle of merit and fitness;

2. There shall be no discrimination in the recruitment, selection, promotion, and appointment on account of gender, religion, ethnicity or political affiliation;

3. Applicants, who are competent, qualified and possess the required minimum requirement shall be considered for appointment. The status of appointment in the BFP shall be temporary until completion of the mandatory course/training set for a definite position;

4. All candidates shall be screened by the PSB. The board shall be responsible for evaluating the qualifications and competencies of all applicants fairly and consistently;

5. Recruitment and hiring of Fire Officer 1 (FO1) and Non-Uniformed Personnel (NUP) shall be decentralized. Vacant Psoitions in the NHQs and ROs shall be filled up from among the applicants who are residents of the regions concerned. However, in case of lack of qualified applicants, those coming from the nearby regions shall be considered;

6. The screening, assessment and evaluation of all the requirements including the conduct of qualifying written examination, physical agility test, physical and medical/ dental examinations to include the neuro-psychiatric examinations, shall be done within the concerned region;

7. The Regional Director shall facilitate the provision of a testing center where the qualifying examination is to be conducted, taking into consideration the accessibility to the applicants to the place or testing center; and

8. The age, height and weight requirements may be waived only when the number of qualified applicant falls below the quota or number of vacancies. Applicants for waiver may be approved by the appointing authority throught eh recommendation of the concerned PSB taking into consideration any or a combination of factors specified in Section VII of this circular.

V. IMPLEMENTING GUIDELINES AND PROCEDURE:

a. The personnel Selection Board (PSB) shall be composed of the following:

Representatives from a Non-Government Organization (NGO) shall be invited as Observers during Board Deliberations.

The Board shall be responsible in the preliminary/ initial evaluation of applicants in their respective regions, taking into account the mandatory and/or minimum requirements prescribed in this circular.

b. The allocation of recruitment quota shall be based on existing vacancies and actual need of operating units/ NHQs as determined by the respective Regional Directors, to be consolidated by the Personnel Records Management Division (PRMD), and for the approval of the Chief, BFP. The distribution list, which shall be approved by the concerned PSB shall be strictly in accordance with the approved recruitment quota and shall be submitted to the Secretary, thru USPO, for his information and/or appropriate action prior to the start of any recruitment process; c. All vacant positions marked for filling, Quota for Recruitment (QR), and the Program Distribution List (PDL), shall be published in accordance with Republic Act 7041 Publication Law in addition to the posting requirements under the existing CSC rules and regulations. The selection line-up of qualified applicants shall likewise be posted in the DILG and the BFP NHQs and ROs websites and in three (3) conspicuous places within their respective Areas of Responsibility for the duration of ten (10) calendar days.

c.1 Position held by a temporary appointee, for whatever cause, shall be deemed vacant and subject for regular publication until filled up by a qualified applicant, except for non-compliance of mandatory training within one (1) year reckoning from the date of appointment. Unjustified and/or deliberate failure of the appointee to undergo the mandatory training within the given period hsall forthwith consider his position vacant and hence subject for replacement; and

C.2 It shall be the duty of the Chief, Career Development Division (CDD, NHQ) to evaluate and issue a certification on grounds of unjustified and/or deliberate failure of the appointee to undergo the mandatory training within the prescribed period. Such issuance shall serve as basisn for the RAO and PRMD to announce the position vacant.

d. The concerned PSB shall determine the final ranking of applicants to be recommended for appointment and for approval of the appointing authority. To

ensure proper documentation of proceedings, the records of the concerned PSB shall be available for inspection when required by appropriate authorities;

e. Once the list of qualified applicants is approved, the appointment forms (KSS Porma BLg 33) shall be prepared by the concerned RAO and HRMD in three (3) copies. Upon approval of the appointing authority, a photocopy of appointment shall be initially issued to the appointee, pending attestation by the CSC;

f. The appointment shall be acknowledged and accepted by taking and signing the Oath of Office (Panunumpa sa Katungkulan). An appointment issued, by the appointing authority and attested by the CSC shall be effective upon actual assumption of duty, but not earlier than the date of signing of appointment;

g. As an internal personnel action and for record purposes, as soon as the appointment is approved/signed by the appointing authority and attested by the CSC, the Directorate for Personnel shall issue an order announcing the appointment of the new appointees in the BFP. The announcement order shall be posted in at least three (3) conspicuous places at the NHQs, regional, provincial and/or city/municipal fire offices and in the DILG and BFP websites and bulletin boards.

VI. GENERAL QUALIFICATIONS FOR APPOINTMENT TO FO1 RANK1. A citizen of the Republic of the Philippines2. A person of good moral character;

3. Must have passed the psychiatric/psychological, drug and physical test for the purpose of determining his/her physical and mental health

4. Msut not have been convicted by final judgement of an offense or crime involving moral turpitude;

5. Fire Officer 1 (FO1) Applicants must possess the following:

a. Must possess the appropriate civil service eligibility;

b. Must have not been honourably discharged or dismissed for cause from previous employment;

c. Must be at least one meter and sixty-two centimetres (1.62 m.) in height for male, and one meter and fifty-seven centimetres (1.57 m.) for

female: However, a waiver for height and age requirements shall be automatically granted to applicants belonging to the cultural communities.

d. Must weigh not more or less than five kilograms (5 kgs.) from the standard weight corresponding to his/her height, age and sex; and

e. Must not be less than twenty-one (21) nor more than thirty (30) years on the date of actual assumption of duty/oath of office.

Note: One day before the 21st birthday is less than 21 years of age 21 years of age must be exactly on 21st birthday) and three hundred sixty four days after the 30 th birthday, not being 31, is not more than but still 30 years of age (31 years of age is on the 31 st

birthday)

6. Non-Uniformed Personnel (NUP) Applicants must possess the minimum requirements based on the approved Qualification Statndards (QS) which involve education, training, work experience and appropriate eligibility set forth by the Civil Service Commission (CSC).

7. Applicants for Lateral Entry Promotion must possess highly specialized and technical qualification such as but not limited to civil engineers, mechanical engineers, electrical engineers, chemical engineers, chemist, architects, criminologists, certified public accountants, nurses, physical therapists, dentists, teachers, computer programmers, law graduates, doctors of medicine members of the Philippine Bar and Chaplain; and

8. Graduates of Philippine National Police Academy (PNPA) shall be automatically appointed to the initial rank of Fire Inspectors.

VII. GUIDELINES FOR RECRUITMENT/HIRING

1. Initial Screening1.1 Applicants shall submit one (1) folder containing his/her application Letter,

duly filled-out Personal Data Sheet (PDS) and Authenticated copies of credentials mentioned in Section VI hereof:

1.2 The concerned RAO or HRMD shall conduct preliminary/ initial screening of applicants’ documents based on the following mandatory requirements:

a. Educationb. Eligibilityc. For Fire Officer 1 (FO1) and Lateral Entry Applicant

- Age requirement (not more than 30 years old), subject to the rules and regulations of the height waiver; and

- Height requirement ( for male-atleast 1.62 m; for female-atleast 1.57 m, subject to the rules and regulations on the grant of height waiver.

d. Clearances issued by the concerned Barangay, Police, Municipal Trial Court and National Bureau of Investigation (NBI)

1.3 The Regional EMS shall facilitate the initital assessment of applicant based on the required height and weight as stipulated in Section VI (e).

1.4 The PSB in the ROs and the HRMD in the NHQ shall prepare a matrix containing the list of applicants based on the result of the preliminary screening, and submit a copy of its final Selection Liine-up of Qualified applicants to the Office of the director for Personnel (ODP) for posting in the DILG and the BFP-NHQ websites, and in three (3) conspicuous places for the duration of ten (100 days. The respective RPSBs shall likewise strictly observe the said posting requirement for a more transparent selection process; and

1.5 Notification in writing shall be made to all applicants who failed and to those who qualified for the next stage, which is the written qualifying examination.

1.6 Failure of the applicants to present themselves for the said examination shall mean waiver of their opportunity to be qualified for the aspired position.

2. Written examination

2.1 The written examination shall be 40% of the corresponding maximum percentage points. The questionnaire to be utilized for the written examination for vacancy thru Attrition shall be formulated by the concerned Regional Personnel Selection Board which the Chief, BFP shall be furnished with a copy thereof. Whereas for regular quota, the questionnaire shall be formulated by the Committee of Examiners in the NHQ, which shall be available upon written request of the concerned PSB. It shall be sent by the ODP to the RD and/or to a PSB member, preferably a DILG

member, who shall have custody and charge of facilitating the opening of the sealed questionnaires during the scheduled examination.

2.2 The Examination shall be administered by the concerned PSB, in the presence of the representatives from DILG, NGO and priest chaplain.

2.3 The concerned PSB shall convene for the checking of examination papers/booklets, which shall be done in the respective ROs.

2.4 The final result shall be endorsed to the Rao/ HRMD who shall cost the posting announcement and notification of successful examinees.

2.5 Only applicants who passed the written examinations shall proceed to the next stage, which is the Physical Agility Test.

3. Physical Agility Test

3.1 Prior the conduct of Physical Agility Test, initial physical assessment (blood pressure, heart rate, pulse rate) shall be conducted to applicants by the concerned BFP medical Officers.

3.2 The RAO or HRMD shall conduct the physical agility test in the presence of BFP Medical Officers/s.

3.3 The following percentage system shall be used during the test.

3.4 The concerned Rao or HRMD who conducted the test shall finalized the result thru a matrix taking into account the ranking of all applicants, and submit the same to the PSB: and

3.5 Applicants who passed and failed in the test shall be notified in writing.

4. Panel Interview

4.1 The oral examination shall be 60% of the corresponding maximum percentage points based on the following criteria:

4.1.1 Potential ( physical and intellectual attributes) 30%4.1.2 Psychosocial Attributes 20%4.1.3 Personality Traits 10%

Total 60%4.2 The Panel Interview shall be conducted by the concerned PSB.

4.3 Applicants are required to bring seven (7) sets of documents enumerated in Section VII – 1.2 hereof ;

4.4 Only those applicants who passed the Panel Interview shall be subjected to Background Check.

5. Complete Background Investigation (CBI)

5.1 The PSB through the Intelligence and Investigation Division (IID) (NHQ) and Regional Intelligence Branches (RIB) of the BFP shall conduct a comprehensive Background

Investigation within two to three weeks to verify the Authenticity of the submitted documents and to check the personal background of the applicants ;

5.2 The concerned IID/RIB shall endorse and submit a certified result of the CBI directly to the PSB ; and

5.3 Only those who haved passed the CBI shall undergo the Nuero-Psychiatric examination.

6. Nuero-psychiatric Examination (NPE)

6.1 The list of applicants due for Nuero-psychiatric Examination (NPE) shall be endorsed by the PSB to the in-house psychiatrist/psychologist or if none to the government accredited hospitals or diagnostics clinic within the region, to undergo the said examination, and

6.2 The persons responsible for the conduct of NPE shall endorse the certified result directly to the PSB concerned. List of applicants who passed the NPE shall be posted in the BFP website and respective bulletin boards.

7. Medical Examinations (ME)

7.1 Medical Examinations (ME) shall be conducted by any hospitals or clinics or laboratories within the region.

7.2 Applicants who will undergo Medical/ Dental Exam including Drug Test and other pertinent laboratory examinations shall be formally endorsed by the PSB to the designated BFP Medical Officers who shall make proper coordination and constant supervision with any accredited medical institution during and after tye conduct of ME.

7.3 Results of ME, together with the individual medical certificate contained in CSC Form # 211, shall be forwarded by the concerned medical institution/s to the designated BFP Medical Officers who shall then make direct evaluation and confirmation as to the completeness of the ME prior its endorsement to the concerned PSB ;

7.4 The designated BFP Medical Officers shall formally endorse the documents mentioned in the preceding paragraph to thr PSB; and

7.5 Applicants who failed and/ or found to be physically and mentally unfit shall be excluded in the final ranking of applicants.

8. Final Ranking of Applicants

8.1 Concerned PSB shall convene, deliberate and prepare the final ranking of applicants through the resolution signed by all PSB members, for subsequent recommendation to the appointing authority shall appoint only those who were included in the final ranking prepared by the PSB;

8.2 Final result/ranking shall be posted in the DILG and BFP website and respective bulletin boards; and

8.3 All appointments made by the appointing authority must be postedin three (3) conspicuous places in their respective AORs, a day after the issuance of the appointment for

at least (15) calendar days. It shall likewise be posted in the DILG and BFP websites and bulletin boards as required under existing CSC rules and regulations

VII. WAIVER FOR INITIAL APPOINTMENT AS FIRE OFFICER 1 (FO1) AND COMMISSIONED OFFICER VIA LATERAL ENTRY IN THE BFP

1. Waiver for height and age requirement shall be automatically granted by the Chief, BFP to applicants belonging to the cultural communities. Provided, that applicants who belong to cultural communities must submit proof of their membership in a particular cultural minority as certified by National Commission on Indigenous People (NCIP) or the Office of the Muslim Affairs (OMA)

2. In all other cases, as may be determined and upon recommendation of the PSB, waiver of age height requirements may be granted by the C, BFP to applicant who possess any of the following:

1.1 Outstanding scholastic accomplishments, such as being honor graduates, consistent academic scholars, board/bar

topnotchers and the like,

1.2 Possession of special skills in fire suppression, fire prevention, knowledge and skill in operation of heavy equipment,

such as aerial ladder, squirt lighting tower truck, rescue tender, and other apparatus and equipment, rescue and emergency medical services.

1.3 Holder of professional driver’s license with 2-3 restriction codes

1.4 Mechanic with TESDA mechanic trade test certificate with expertise in pump operation, auto diesel engine and auto electrical troubleshooting: or

1.5 Other skills that will sustain the tradition/ other demands of the uniformed service

3. Waiver of age requirement under Section VIII paragraph @ hereof may be granted provided that the applicant shall not be over thirty-five (35) years of age.

One is considered to be over thirty-five (35) years old if he/ she has not yet reached his/ or her thirty-sixth (36th) birthday on the date of effectivity of his/ her appointment; Provided that in case an applicant was previously in the government service, age age difference as to the number of years in the government is subtracted from his/ her actual age at the time of appointment must not exceed forty (40) years; provided, finally, that his/ her previous separation from the government service was not for a cause;

4. Waiver of age requirement under section VIII paragraph 2 hereof may be granted to a male applicant who is at least 1 meter and 57 centimetres (1.57m) and to a female applicant who is at least 1 meter and 52 centimetres !1.52m); and

5. The height and age requirements shall only be waived subject to the conditions that the applicant meets all other requirements based on the approved qualification standards.

IX. REEMPLOYMENT OF SEPARATED BFP MEMBER

A BFP member who had been separated for non-disciplinary causes may be reemployed provided he/ she meets the minimum requirements prescribed in section VI of his Circular, Except for age requirement wherin subject applicant for reemployment must have a cumulative service with the BFP of not less than twenty (20) years of service computed at compulsory retirement age fifty six (56).

Priority is given to those who had completed the mandatory training or its equivalent.

X. SANCTIONS

Regional Directors, Heads of Offices and other officials who failed to strictly comply with the aforementioned provisions shall be relieved immediately and shall be meted with appropriate sanctions after due process.

XI. SEPARABILITY CLAUSE

All memoranda, orders, SOP’s and circulars inconsistent with these provisions are hereby rescinded, amended, and modified accordingly.

XII. EFFECTIVITY ;

This memorandum Circular shall take effect upon approval.

1.3. Applicants who passed the interview shall be subsequently subjected to the physical agility test and background investigation. The RPSB through the Regional Intelligence and Investigation of the applicants in the region to verify the authenticity of the submitted documents and to check personal background of the applicants.

1.4. Applicants shall submit their initial physical examination conducted by the Regional Emergency Medical Services (REMS) before they take their physical agility test. The following point system shall be used:

e. Pick-up and carry on shoulder (45 kilograms for men, 20 kilograms for women) walking 25 meters up and down, without dropping) =18 pts.

1.5. The Regional Directors Shall endorse those applicants who passed the evaluation/interview, physical agility test and initial Medical/Dental examination (BP, height, weight, dental and medical history duly certified by the Regional Chief, EMS) according to earned scores in the form of RPSB resolution to the BFP NHQ PSB thru the Medical/ Dental Services, BFP National Headquarters (MDS, BFP NHQ) to administer the following

1.5.1. Psychological and/or neuro-psychiatric examination; and1.5.2. Medical/ Dental examination including drug test and other pertinent

laboratory examinations.1.6. The Chief, MDS, BFP NHQ shallthen endorse to the Office of the Director for

Personnel, BFP National Headquarters (ODP, BFP NHQ) the result of the above mentioned examinations.

1.7. The BFP NHQ PSB shall prepare a Board Resolution recommending the appointment to FO1 of applicants who subsequently passed the medical examination for approval of the appointing authority.

2. National Headquarters2.1. Evaluations of credentials and qualifications shall be done at the Human Resource

Management Division, BFP National Headquarters (HRMD, BFP NHQ)

2.2. The BFP NHQ PSB shall conduct evaluation/interview using the same criteria applied in the regional offices.

2.3. Applicants who passed the interview shall be subsequently subjected to the background investigation and medical examination. The HRMD, BFP NHQ through the intelligence and Investigation Division, BFP National Headquarters (IID, BFP NHQ) shall conduct background investigation of the applicants to verify the authenticity of the submitted documents and personal background of the applicants.

2.4. Applicants shall be endorsed to the MDS, BFP NHQ for the conduct of psychological/neuro-psychiatric, medical and dental examination including drug test.

2.5. The Chief, MDS, BFP NHQ shall then endorse to the ODP, BFP NHQ the result of the above mentioned examinations.

2.6. Using the same criteria applied in the regional offices, applicants who have passed the medical examination shall be subjected to the physical agility test.

2.7. After the final deliberation, the BFP NHQ PSB shall prepare a Board Resolution recommending the appointment to FO1 for approval by the approaching authority.

VIII. APPOINTMENT UNDER A WAIVER PROGRAM

1. Conditions on waivers for Initial Appointment to the BFP1.1. Age or height for initial appointment to the BFP may be waived when the

number of qualified applicants falls below the minimum vacancy/quota.

1.2. Age and height waiver may be granted by the Chief, BFP through the recommendation of the majority members of the BFP NHQ PSB.

1.3. Age waiver may be granted, provided, that the applicant shall net be more than thirty-five (35) years of age.Note: One is considered to be not over thirty five (35) years old if he/she has not yet reached his/her thirty-sixth (36) birthday on the date of effectivityof his/her appointment. Provided, further, that in case an applicant was previously on with the fire government service, the age difference when the number of years in the government service is subtracted from his/her actual age at the time of appointment must not exceed forty (40) years. Provided, finally, that his/her previous separation from the government service was not due to disciplinary causes.

1.4. Height waiver may be granted to a male applicant who isat least 1 meter and 57 cm. (1.57 m.) and to a female applicant who is at least 1 meter and 52 cm. (1.52 m.); provided that the applicants belongs to cultural minorities duly certified by the Office of Muslim Affairs (OMA), National Commission on Indigenous People (NCIP), the Office of the Northern and Southern Cultural Minorities or other appropriate government entity in charge of the welfare

and the development of cultural minorities. Provide further, that the applicant shall submit appropriate proof of their membership in a particular cultural minority.

2. Factors to be Considered for Grant of Waivers2.1. Outstanding accomplishment or possession of special skills in fire service, such

as fire fighting, fire prevention, rescue and emergency medical services.2.2. Driver with Professional Driver’s Licence2.3. Mechanic with TESDA Mechanic Trade Test Certificate2.4. Other skills that will sustain the traditions/ other demands of uniformed

service

3. Selection Criteria under the waiver program3.1. In case there are numerous applicants who possess the least disqualification

shall be prioritized over those who possess more disqualifications.

3.2. The order of consideration of applicants under the waiver program shall be as follows:3.2.1. Age3.2.2. Height

IX. REEMPLOYMENT OF SEPARATED BFP MEMBERBFP personnel who had been separated for non-disciplinary causes may be reemployed provided he/she met the minimum requirements prescribed in Section VI of this Circular, except for age requirement wherein subject applicant for reemployment must have cumulative service with the BFP of not less than twenty (20) years of service computed at compulsory retirement age of fifty six (56) years old.Priority is given to those who had completed the Public Safety Basic Recruit Course (PSBRC)/Fire Basic Recruit Course (FBRC) or its equivalent training.

X. SEPARABILITY CLAUSE: All memoranda, orders, SOPs, and circulars inconsistent with this provision are hereby rescinded, amended, and modified accordingly.

MEMORANDUM CIRCULAR NUMBER: SOP-2012-001

SUBJECT: STANDARD OPERATING PROCEDURE (SOP) IN THE PREPARATION AND ISSUANCE OF INSPECTION ORDER, AFTER INSPECTION REPORT AND LEVEL OF AUTHORITY OF CITY/MUNICIPAL FIRE STATION, PROVINCIAL/ DISTRICT OFFICES AND REGIONAL HEADQUARTERS IN THE CONDUCT OF FIRE SAFETY INSPECTION

I. ApplicabilityThis SOP shall apply to the conduct of fire safety inspections and

remedial measures to be taken by the Fire Safety Inspectors, Plan Evaluators, and Chief of concerned fire safety unit / section/branch in the municipality/city, district/province, region and national levels. It governs the jurisdictional/relationships be- tween and among the BFP organizational units and the Fire Code of the Philippines of 2008 and its Implementing Rules and Regulations (IRR). This also applies to all officers and personnel of the BFP whose duties and responsibilities pertain to the enforcement of the Code.

II. POLICIES AND PROCEDURESA. Inspection Order (IO)

1. Issuance of IO.All fire safety inspection conducted by any BFP office and personnel duly authorized to perform inspection shall be covered by an Inspection Order (IO) issued for the specific purpose and place to be inspected. The IO should not contain any all-embracing purpose such as “valid for inspections of any building, business, commercial or industrial establishments within area of jurisdiction”.

2. Format of IO. The IO shall be in the FORM shown in Annex “A” hereof, and no inspection shall be conducted using any other form of IO not conforming thereto.

The IO shall contain the names of Fire Safety Inspector (FSI) or Inspectors who shall conduct the inspections and no inspection shall be performed by any personnel whose name is not indicated therein and any other unauthorized personnel be allowed to participate in the inspection.

3. Purpose of IO. Inspection Order shall be issued for the following purposes: a. To conduct inspection during construction, renovation, modification

or alteration on the basis of issued Fire Safety Clearance to deter-mine whether the plans and specifications are being followed and safety precautions are being observed;

b. To conduct Fire Safety Inspection required under RA 9514, known as Fire Code of the Philip-pines of 2008 and its Implementing Rules and Regulations prior to the issuance of Fire Safety Inspection Certificate;

c. To conduct business and routine inspection required under Section 9.0.2.4 of the IRR of RA 9514;

d. To conduct Fire Safety Inspection prior the issuance of Fire Safety Clearance required under Division 5 of Section 9.0.4.2 of the IRR of RA 9514;

e. To conduct inspection prior to the issuance of Installation Clearance required under Section 10.2.7.6 of the IRR of RA 9514;

f. To conduct re-inspection required under Section 13.0.0.4 of the IRR of RA 9514; and

g. Other inspection that may be issued by the duly authorized representative of the Chief, BFP for the purpose of the enforcement of RA 9514 and its IRR.

4. Administrative Control on Issuance of IO. Every IO shall be chronologically numbered and recorded in an official log book. Computer based recording of IO is likewise encouraged. Entries in the log book shall contain the IO Number; the name(s) of the FSI’s who will conduct the inspection; the exact address of building/establishment subject of inspection; the purpose of inspection - whether for supervisory inspection of building under construction, or final inspection of newly constructed/modified/ renovated building, or initial inspection of business, commercial or industrial establishments, or verification or investigation of com- plain, etc.; the date of issuance and actually received by the FSI’s; and date it was served or cancelled, as the case maybe.

5. Service of IO and Limitation of its Issuance a. Service of IO shall mean the conduct of actual inspection and

submission of necessary report to the Chief, Fire Safety Enforcement Section (C, FSES) of the respective Province/District/ City/Municipal fire station for his evaluation. In case the FSI was not allowed by the owner/occupant/administrator or his duly authorized representative to conduct inspection, the FSI shall write “Addressee Refuses to Receive the IO and Allow Inspection” in the remarks portion of the IO, and shall immediately return the same to the ISSUING office.

b. The inspector whose IO was not accepted and not al- lowed to conduct inspection shall be required to prepare a letter signed by the

head of office (Municipal/City Fire Marshal, Provincial/District Fire Marshal or

Regional Director) authorizing the inspection, notifying addressee that ten (10) days upon receipt of letter, actual inspection of subject place shall be conducted un- der a new IO, copy of which shall be attached to the letter. The letter together with the IO shall be sent thru registered mail and SHALL BE CONSIDERED SERVED upon receipt of the registered mail.

c. Actual inspection shall be conducted during the actual operation of the business establishment or any structure, facilities, and hazardous operation.

d. Issued IO shall be immediately conducted within two (2) days from its issuance. Concerned fire safety inspector shall prepare and submit the necessary report within twenty-four (24) hours after the conduct of actual inspection. Where the

period falls during non-working days, the report shall be submitted immediately on the following working day.

e. Any IO which was not served within five (5) days upon its issuance shall be accordingly cancelled and the cancellation shall be likewise recorded in the logbook.

f. Issuance of IO shall be limited only to five (5) IOs for every individual or team of fire safety inspectors in a day. How- ever, no IO shall be issued to individual or team of fire safety inspectors who still have two (2) pending IO to be served.

g. IO shall not be issued to FSI who is actually absent from work. 6. Wearing of Proper Attire and BFP ID. All BFP personnel issued with IO shall

wear their proper uniform with BFP ID during the conduct of actual inspection: GOA for Uniformed BFP Personnel Barong for Non-uniformed BFP Personnel.

B. AFTER INSPECTION REPORT (AIR)

1. Inspection during Construction. The frequency and result of fire safety inspection conducted to monitor compliance of building under construction with the approved plans shall be re- corded in the Construction Logbook Sheet kept in the site by whoever is responsible for the construction. Whenever the result shows any violation or non-compliance with the approved plans, the City/Municipal Fire Marshal shall issue a written notice informing the person (responsible for the construction) of the violation noted. A copy of the notice shall also be sent to the Building Official.

2. Inspection after Construction. The procedure in the preparation and issuance of AIR after construction shall be in accordance to Section 9.0.2.3 of the IRR of RA 9514 or the Fire Code of the Philippines of 2008.

3. Periodic Inspections of Occupancy.

a. The result of actual inspection conducted under issued IO shall be duly recorded in the prescribed and standard form for AIR which shall be accomplished by the FSI upon conclusion of his inspection and prior leaving the premises of the place inspected.

b. The AIR shall be accomplished in three (3) copies, one for BFP, 2nd for the Building Official or Business Licensing Office, as the case maybe, and 3rd for the owner/administrator)

c. In case the AIR is refused to be signed, the FSI should write the phrase “REFUSED TO SIGN” over the portion of the AIR where the name and signature of the receiving party is indicated.

d. In case the AIR is not accepted, the FSI may leave the copy to the guard or any occupant of the place found therein with sufficient discernment or understanding, or may send it by registered mail, in cases where personal service cannot be made upon the addressee, or upon his representative or any other occupant of the place inspected.

C. FIRE SAFETY INSPECTION

1. Authority of Fire Safety Inspectors. As provided under the Code, fire safety inspection shall be done by the Fire Safety Inspectors, and in places where there are no such inspectors, the Fire Marshal shall, in addition to his duties and functions, act as safety inspectors.

2. Jurisdiction of Inspection by City/Municipal Fire Stations. The City/Municipal Fire Stations shall conduct fire safety inspection thru duly designated FSI of its Fire Safety Enforcement Branch/Unit. The inspection shall be limited to the following:

a. Inspection of buildings, structures or facilities during construction, renovation or modification to determine whether the approved

plans are followed and safety measures are observed in the working areas.

b. Inspection of the buildings, structures or facilities after completion of construction, renovation or modification and prior to the issuance of Occupancy Permit by the Building Official to determine compliance with approved plans and with the working condition of the installed fire protective and/or warning system, IF ANY.

c. Inspection on all industrial, commercial or business establishments in connection with their application for permits and/or licenses with the local governments or other government agencies, and during their on-going operations.

d. Inspection on storage, handling and/or use of explosives or of combustible, flammable, toxic and other hazardous materials.

e. Inspection conducted periodically on all existing buildings, structures or facilities, including all industrial, commercial or business operations, to determine the presence of any fire hazards; the type of occupancy; the prohibited acts being committed or tolerated therein; and to check or test the required fire protective and/or warning system.

3. Jurisdiction of District/Provincial Offices. The district/ provincial offices shall also conduct fire safety inspections within the areas under their jurisdiction thru duly DESIGNATED FSI of its Fire Safety Enforcement Section. Inspection shall be limited to the following:

a. Re-inspection or verification inspection of the building, structure or facility initially inspected by the city/municipal FSI when the result of which indicate no compliance with the requirements and/or where there is deficiency in its compliance, as indicated in the AIR submitted to the District/Provincial Offices

b. Inspection of buildings, structures or facilities and industrial, commercial or business establishment’s subject of any complaints, where the act or omission being complained of pertains to the inspections conducted by the city/municipal FSI’s.

4. Jurisdiction of BFP Regional Headquarters. The Regional Headquarters may constitute a composite team or “Task Force”, which may be composed of personnel from their Operations Division, Fire Safety Enforcement Section and Fire Safety Inspectors from district/provincial offices and city/municipal fire stations, inspection shall be limited to the following cases;

a. Processing of requests for alternative and/or remedial fire safety measures endorsed by the District/Provincial Offices prior endorsement to BFP-National Headquarters;

b. Re-inspection of actual conditions in buildings, structures or facilities, industrial, commercial or business establishments on controversies appealed/elevated by the owner/administrator to Region.

c. Re-inspection/verification of the fire safety inspection of buildings, structures, or facilities inspected by the FSI’s of district/provincial offices but did not comply with the fire safety requirements or when there is deficiency with the compliance;

d. In cases of an aftermath of natural or man-made disaster where fire safety and life safety situations in buildings, structures or facilities are adversely affected; and

e. To cover areas where there is a failure in the enforcement of the Fire Code.

5. Jurisdiction of BFP National Headquarters. The BFP National Headquarters thru the Directorate for Fire Safety and Prevention MAY conduct inspection on all buildings, structures and facilities and in any industrial, commercial or business establishments in any city, municipality, province or region, limited to the following cases:

a. Evaluation of basis of recommendations for the summary abatement of fire hazards involving alteration, renovation or modification of buildings, structures or facilities, or its closure or demolition declared as public nuisance;

b. Re-inspection/verification of the fire safety inspection of buildings, structures, or facilities inspected by the composite team or task force of the Regional Offices.

c. Random Validation of the administrative action taken in the field offices to determine if the procedure has been properly observed

III. EFFECTIVITY This SOP shall take effect immediately upon approval.

The Bureau of Fire Protection (BFP) has been receiving is- sues and concerns pertaining to clients who are engaged in handling and transporting of petroleum products from one place to another. Purportedly, clients who already acquired Conveyance Clearance from a certain BFP local station were required to pay for another set of Conveyance Clearance Fees by the station that has jurisdiction on the area of destination of intended delivery.

During the Management Committee (MANCOM) Meeting held last July 4, 2012, the body agreed that Conveyance Clearance issued by Fire Marshals having operational jurisdiction thereat be considered valid and effective nationwide, in the absence of any violation specified by existing laws and policies.

In view hereof, you are directed to advise all City/ Municipal Fire Marshals, within your respective areas of responsibility, to acknowledge and accept Conveyance Clearances is- sued to clients by a local BFP station, where said clearance was originally applied. They are not, however, barred from conducting verification and inspection on the actual condition of the flammable, combustible and hazardous materials being trans- ported, in accordance to the packaging and other safety standard requirements set forth by the Fire Code of the Philippines (RA 9514) and other pertinent laws on fire safety. Should violations be found, the City/Municipal Fire Marshal must notify the Issuing Officer of such and recommend for the outright cancellation or revocation of the subject clearance. Failure to comply with this directive shall be dealt with accordingly.

II. PURPOSEa) To ensure that all personnel shall adhere to the prescribed standard of the

approved GOA uniform of the Bureau.b) To ensure that all personnel shall wear the authorized uniform, their accessories

and accountrement consistent with NHI approved BFP uniforms.c) To avoid confusion from among members of the BFP as to when, where and how

to use the GOA uniform and additional Bush Jacket uniform for officers.

III. GUIDELINESIn consonance with Uniform, Badge and Insignia Board Resolution Nos. 2002-01

and 2002-02, both dated 10 October 2002 and National Historical Institute approved design

of BFP GOA uniform and other accessories and accountrements, the hereunder guidelines shall be prescribed to all personnel of the Bureau wearing GOA/Bush Jacket uniforms.

GENERAL OFFICE ATTIRE (GOA)a) Composition

The GOA uniform is comprised of midnight blue dress shirt, the dress trouser, black necktie, and accessories and accountrements as authorized. The short sleeve shirt is worn tucked into the trouser, so that the front row of buttons (the gig line) lines up with the belt buckle and closure of the pants. Same has two (2) breast pockets (five (5) inches wide, six (6) inches long) with flaps and black buttons to close the pockets and six (6) inches long shoulder straps. The breast pocket shall have a vertical seam sewn at the center.

b) Accessories and Accountrements1. BELT- the black web belt is worn with the buckle edge aligned with the

closure edges of the shirt and pants, the color of the brass buckle for officers is gold while silver is for the personnel with non-officer rank.

2. INSIGNIA OF GRADE- rank insignia for officers should be worn centered on the wshoulder loop while the rank insignia for non-officers (chevron) is placed at both shirt’s sleeves.

The Malta Cross (knighthood emblem) is the symbol of protection; a badge of honour courage and pride; and a representation of ideals of the Fire Service in saving lives and property and the extinguishment of destructive fires.

The monkey-eating eagle, which is the country’s national bird, is the symbol of swiftness, ferocity, power, courage and immortality.

The number of outward rays inside the Malta Cross represent the 75 provinces while the number of laurel leaves which was represented into two branches, signifies the country’s 14 regions during the year BFP was conceived as a separate bureau under the Department of Interior and Local Government (DILG).

The badge also features the major firefighting tools and equipment was embedded on each part of the cross.

The image of Lapu-lapu, who was the first Filipino who led the country in fighting the Spanish conquistadors, signifies bravery, leadership and heroism. The national flag was also included in the background of Lapu-lapu.
