SAN DIMAS … a proud past and a bright future

Our City

San Dimas is located approximately 27 miles between Los Angeles and San Bernardino, and is situated between 580 to 1,618 feet above sea level at the base of the spectacular San Gabriel foothills. San Dimas has grown from a key center of citrus activity to a well-planned community offering industrial, commercial and beautiful residential and park areas. Superior access to freeways offers a centralized location from which to enjoy Southern California’s many excellent cultural and recreational activities. San Dimas is scheduled to have a Gold Line station by 2025. Travel time from San Dimas to Pasadena will take approximately 27 minutes and 56 minutes for downtown Los Angeles.

Our Government

San Dimas is a “general law” city. General Law cities operate under the basic laws established by California’s Codes for cities. San Dimas citizens receive a full range of services through the combined efforts of the City’s four departments and the contract services of Los Angeles County which include police and fire protection, the construction and maintenance of highways, streets, and other infrastructures, and recreational activities and cultural events.

Our City Council

The City of San Dimas was incorporated on August 4, 1960 with a Council-Manager form of government. Policy-making and legislative authority are vested in a governing council consisting of the Mayor and four Councilmembers responsible for establishing ordinances, adopting the budget, appointing committees, and appointing the City Manager and City Attorney. The City of San Dimas is empowered to levy a property tax on both real and personal properties located within its boundaries, and is also empowered by state statute to extend its corporate limits by annexation.

The appointed City Clerk is the local official for elections, local legislation, the Public Records Act, the Political Reform Act, the Brown Act, and serves as the liaison between the public and the City Council. With approximately 21,946 registered voters, the election process is an important element of the City’s democratic process.

About the Election – March 3, 2020

Three seats on the City Council will be filled at this municipal election including the Mayor's two-year term which is elected separately from the two City Councilmembers' four-year staggered terms. The ballot may include a measure for a ¾ cent sales tax.

Dear San Dimas Candidate for City Council: Congratulations on your decision to seek office for the March 3, 2020 City Council election. San Dimas residents will elect a Mayor and two Councilmembers. Thank you for your interest in the City of San Dimas and for expressing a desire to serve our community as a member of the City Council. Becoming a Candidate

Qualifications for Candidacy: To qualify as a candidate for mayor or member of the city council, you must reside and be registered to vote within the jurisdiction at the time papers are issued. More specifically, you must be 1) at least 18 years old, 2) a U.S. citizen, 3) a San Dimas resident, 4) registered to vote in the city, and 5) you must not be on parole or serving time for a felony conviction. Private versus Public: Becoming a candidate for public office means that information about you will become a matter of public record immediately. With a few exceptions which are described in this handbook, this includes any and all documents submitted to the city during the course of the election. As such, these documents must by law, be available to the public for inspection and/or copying. Filing Requirements: To become a candidate, you must first be issued a nomination paper which specifies the office you are seeking. A number of additional forms are required to be filed, as described below. Upon receipt, the City Clerk’s Department will compare the names, addresses and signatures on your nomination paper with voter registration records. At least 20 must match the records for you to qualify as a candidate. It is important that the candidate nomination form be turned in as soon as possible to address any nonqualified signatures before the filing deadline. You may withdraw your nomination paper, but only up through the deadline for filing. Once you have filed the nomination paper, you may not make any changes to it. If you fail to qualify as a candidate, a supplemental nomination paper can be issued to you, along with a photocopy of your nomination paper which will show which signatures are valid. There is no extension of the deadline for a supplemental nomination paper. Write-In Candidates: Write-in candidates must file a statement of write-in candidacy, a nomination paper and a Statement of Economic Interests form covering the period of January 1, 2020 to February 28, 2020. Signature and voter registration information on the nomination paper will be verified in the same manner as a regular nomination paper. Write-in candidates’ names do not appear on the ballot or in the sample ballot pamphlet. Forms Required to be Filed No Later than 4:30 pm on Friday, December 6th, 2019:

To have your candidate’s statement printed in the sample ballot pamphlet, also submit the following:

Official Forms to File

Eligibility to be elected: Unless otherwise specifically provided, no person is eligible to be elected or appointed to an elective office unless that person is a registered voter and otherwise qualified to vote for that office at the time that nomination papers are issued to the person or at the time of the person’s appointment. (§201, Elections Code). It is recommended that you schedule an appointment with the City Clerk’s Office to pull and file nomination papers at (909)394-6216. The nomination period which runs from 8:00 a.m. on Monday, November 11, 2019, until 4:30 p.m. on Friday, December 6, 2019. If an incumbent fails to file within the designated time frame, the nomination period is extended to 5:00 p.m. Wednesday, December 11, 2019 (any candidate other than an incumbent may file or withdraw by this date.) The candidate, or any other eligible voter on behalf of the candidate, may circulate the nomination petition among the registered voters of the jurisdiction. To qualify, a person must obtain the signatures of at least 20, but no more than 30 registered voters. A preliminary verification by the City Clerk’s Office at the time of filing will be done. All signatures will be officially verified by the Los Angeles County Registrar-Recorder’s Office. The circulator of a nomination petition must be 18 years of age, personally witness the signature of each sponsor, and execute the “Certificate of Circulator” under penalty of perjury. No person may sign more than once on a nomination paper for each seat open. At the time of filing the candidate must complete and sign the “Affidavit of Nominee and Oath or Affirmation of Allegiance” stating that he/she will accept the nomination, and if elected, the candidate must accept the office. The Affidavit also includes a section that lists the candidate’s name and “Ballot Designation,” which will appear on the Official Ballot and must not exceed three words. Included in the packet of information is a Ballot Designation Worksheet to ensure that the selected “occupation designation” meets the requirement of the California Elections Code

The City Clerk’s Office will be closed the following dates during the Nomination Period for the Thanksgiving Holiday:

• Thursday, November 28, 2019 • Friday, November 29, 2019

Form 501 - Candidate Intention Statement

State law requires an individual who intends to be a candidate for Mayor or City Council to file a Candidate Intention Statement (Form 501.) The Form 501 must be filed with the City Clerk prior to the solicitation or receipt of any contribution or the expenditure of any personal funds used for campaign purposes (excluding ballot statement fees.) In addition to filing a Candidate Intention Statement, prior to soliciting or receiving any contributions, or making any expenditure or prior to the use of any personal funds, a candidate must open a Campaign Bank Account (Form 410) and file it with the Secretary of State and provide a copy to the City Clerk. An exception to this filing requirement is if the candidate will not be receiving contributions and the only expenditure to be made will be from personal funds for the Candidate’s Statement. If you have any questions or wish assistance, please contact the Fair Political Practices Commission (FPPC) at the toll free number 1-866-ASK-FPPC (275-3772). NOTE: If a candidate is seeking re-election to the same office, he/she may re-designate the bank account established for that office by amending the Statement of Organization (Form 410) and designating that account for the upcoming election. A new Candidate Intention Statement (Form 501) must also be filed. Forms 501 and 410 are included in this packet.

Form 700 - Statement of Economic Interests Persons elected to city offices as well as officeholders will be required to file periodic statements disclosing their “economic interests”, which include investments, interests in real property, and any income received during the preceding 12 months. Exactly what must be disclosed is specified in Government Code §87100. Each candidate shall file no later than the final filing date of nomination papers, his or her statement disclosing his or her investments and his or her interests in real property with the City Clerk’s Office. The City Clerk’s Office shall make and retain a copy and forward the original to the Fair Political Practices Commission (see §87200, 87201, 87500 of the Government Code). Keep in mind that even though you may have filed a Form 700 in April 2019, all candidates for local office are required to disclose their financial interests during the 12 months prior to the date of filing their declaration of candidacy. Additionally, candidates for local elective office may not accept honoraria payments and gifts are limited by law to a value of $500 from any one source in a calendar year.

Candidate Statement The candidate’s statement is optional. It is an unverified statement written and paid for by the candidate. Candidates pay the actual cost of the statement to be included in the Voter’s Pamphlet. A $1200.00 deposit is required at the time of filing to guarantee payment toward the printing and mailing of the statement. In addition, the candidate will be required to pay an additional cost, to be determined, if the candidate chooses to translate and print into any foreign language that is not required, but requested as an option by the candidate (pursuant to State and Federal law). The statement may be withdrawn at any time (but may not be altered once filed) up to 5:00 p.m. of the next working day after the close of the nomination period (Friday, December 6, 2019 or extended to 5:00 p.m. Wednesday, December 11, 2019 if an incumbent does not file.) Candidate’s statements remain confidential until the close of nominations, after which there is a 10-day review period. Political Reform Act of 1974 All candidates for municipal offices, all local elected officeholders and all committees supporting or opposing State or local candidates or ballot measures are subject to the provisions of the State Political Reform Act of 1974 (Act), which went into effect January 1975. The statutory requirements of the Act are contained in Sections 87100 through 91015 of the California Government Code. Manuals, forms, information and assistance relating to campaign reporting obligations under the Act may be obtained from the City Clerk. You may also contact the Technical Assistance Division of the Fair Political Practices Commission (FPPC) at (866) 275-3772, or visit their web site at www.fppc.ca.gov. The Act requires candidates to file campaign statements disclosing contributions received and expenditures made. Throughout the course of this municipal election, candidates will be required to file with the City Clerk various campaign disclosure forms. The Fair Political Practices Commission (FPPC) has prepared an information manual, which will be made available to candidates. Candidates should obtain the manual as early as possible in his/her campaign and make certain that the candidate, the committee treasurer and other personnel involved in the financial side of the campaign are fully aware of their responsibilities under the law. Reporting form (and manuals for candidates who have not already obtained them) will be routinely issued to all candidates during the nomination period. Please be aware that some disclosure forms have changed. New forms have been introduced and some have been revised by the FPPC in order to simplify the filing of campaign statements. Those who are already familiar with the filing of campaign statements should read them carefully and take note of the introduction of new forms and the revision of older forms. All statements filed are a matter of public record. They may be inspected at the City Clerk’s office by anyone, and copies may be purchased for ten cents ($0.10) per page. Candidates and committee treasurers should keep complete records and be prepared to submit supporting documents if such are required. Record-keeping instructions are included in the FPPC information manual. Violations of the campaign disclosure law may result in criminal prosecution by the State Attorney General or the County District Attorney, or civil action by the FPPC, the District Attorney or a private citizen. Failure to file statements by the prescribed deadline can lead to late filing penalties of $10 per day. A statement, which is mailed, is considered filed on the date of the postmark, if it is sent by first-class mail.

Disclosure Forms Fair Political Practices Commission This is an introduction to some of the most common campaign disclosure forms filed by candidates early in their campaigns. It should be used as a supplement to (and not a replacement for) the Fair Political Practices Campaign Disclosure Manual 2 (available at the FPPC website at http://www.fppc.ca.gov.) The Political Reform Act requires the forms identified below. It is important to note that candidates may need to file a number of other documents in addition to campaign disclosure forms (e.g. Declaration of Intentions, Nomination Papers, and Statements of Economic Interests.)

Form 501 WHAT: Form 501 (Candidate Intention Statement)

WHEN: Form 501 must be filed prior to the solicitation or receipt of any

contribution or the expenditure of any personal funds used for campaign purposes (excluding ballot statement fees.)

WHERE: File the original with the City Clerk’s Office.

Form 410

WHAT: Form 410 (Statement of Organization Recipient Committee) WHEN: Form 410 must be filed within 10 days of receiving $1,000 in

contributions. (May be filed earlier.) After Form 410 is filed, you will receive notification from the Secretary of State’s Office of the identification number assigned to your campaign committee.

WHERE: File the original and one copy with the Secretary of State and one copy with the City Clerk.

Form 470

WHAT: Form 470 (Officeholder and Candidate Campaign Statement – Short

Form) This form may be used when a candidate does not have a controlled committee and does not anticipate raising or spending $1,000 or more (excluding ballot statement fees) in a calendar year.

Form 460 is used by a candidate who has a controlled committee, or has raised or spent, or will raise or spend $1,000 or more during a calendar year.

Laws Governing Campaign Practices The following code sections are excerpts that apply to candidates for local office:

Mass Mailing (Government Code Section 84305) 84305. (a) (1) Except as provided in subdivision (b), a candidate, candidate controlled committee established for an elective office for the controlling candidate, or political party committee shall not send a mass mailing unless the name, street address, and city of the candidate or committee are shown on the outside of each piece of mail in the mass mailing and on at least one of the inserts included within each piece of mail of the mailing in no less than 6-point type that is in a color or print that contrasts with the background so as to be easily legible. A post office box may be stated in lieu of a street address if the candidate’s, candidate’s controlled committee established for an elective office for the controlling candidate’s, or political party committee’s address is a matter of public record with the Secretary of State. (2) Except as provided in subdivision (b), a committee, other than a candidate controlled committee established for an elective office for the controlling candidate or a political party committee, shall not send a mass mailing that is not required to include a disclosure pursuant to Section 84502 unless the name, street address, and city of the committee is shown on the outside of each piece of mail in the mass mailing and on at least one of the inserts included within each piece of mail of the mailing in no less than 6-point type that is in a color or print that contrasts with the background so as to be easily legible. A post office box may be stated in lieu of a street address if the committee’s address is a matter of public record with the Secretary of State. (b) If the sender of the mass mailing is a single candidate or committee, the name, street address, and city of the candidate or committee need only be shown on the outside of each piece of mail. (c) (1) A candidate, candidate’s controlled committee established for an elective office for the controlling candidate, or political party committee shall not send a mass electronic mailing unless the name of the candidate or committee is shown in the electronic mailing preceded by the words “Paid for by” in at least the same size font as a majority of the text in the electronic mailing. (2) A committee, other than a candidate controlled committee established for an elective office for the controlling candidate or a political party committee, shall not send a mass electronic mailing that is not required to include a disclosure pursuant to Section 84502 or 84504.3 unless the name of the committee is shown in the electronic mailing preceded by the words “Paid for by” in at least the same size font as a majority of the text in the electronic mailing. (d) If the sender of a mass mailing is a controlled committee, the name of the person controlling the committee shall be included in addition to the information required by subdivision (a). NOTE: Mass mailing is defined as 200 or more identical or nearly identical pieces of mail sent

by an officeholder, candidate or committee in a calendar month. (See - separate handout - Literature and Mass Mailing Requirements - item 12.)

Political Advertisement Requirements (Elections Code Section 20008) Any paid political advertisement that refers to an election or to any candidate for state or local elective office contained in or distributed with a newspaper, shall bear on each surface or page thereof, in type or lettering at least half as large as the type or lettering of the advertisement or in 10-point roman type, whichever is larger, the words “Paid Political Advertisement.” The words shall be set apart from any printed matter. As used in this section “Paid political advertisement” shall mean and shall be limited to, published statements paid for by advertisers for purposes of supporting or defeating any person who has filed for an elective state or local office. Electioneering (Elections Code Section 18370) No person, on election day, or at any time that a voter may be casting a ballot, shall, within 100 feet of a vote center, a satellite location under Section 3018, or an elections official’s office:

(a) Circulate an initiative, referendum, recall, or nomination petition or any other petition.

(b) Solicit a vote or speak to a voter on the subject of marking his/her ballot.

(c) Place a sign relating to voters’ qualifications or speak to a voter on the subject of his/her qualifications except as provided in Elections Code Section 14240.

(d) Do any Electioneering as defined by section 319.5 of the Election Code.

As used in this section 100 feet of the vote center, satellite location under section 3018 or an elections official’s office, means a distance 100 feet from the room or rooms in which voters are signing the roster and casting ballots. Any person who violates any of the provisions of this section is guilty of a misdemeanor. Electioneering During Vote By Mail Voting (Elections Code 18371) (a) No candidate or representative of a candidate, and no proponent, opponent, or

representative of a proponent or opponent, of an initiative, referendum, or recall measure, shall solicit the vote of a vote by mail voter, or do any electioneering, while in the residence or in the immediate presence of the voter, and during the time he or she knows the absentee voter is voting.

(b) Any person who knowingly violates this section is guilty of a misdemeanor. (c) This section shall not be construed to conflict with any provision of the federal Voting Rights

Act of 1965, as amended, nor to preclude electioneering by mail or telephone or in public places, except as prohibited by Section 18370, or by any other provision of law.

City of San Dimas Regulations regarding Political Activity Government Code Section 3201 et seq. sets forth a policy that informs employees and other persons in City service of prohibited political activity. A copy of that regulation is included. (See separate handout - Political Activity by City Employees and Officers - item 13.) Political Signs San Dimas Municipal Code Chapter 18, Section 18.152 regulates political signs. A question and answer page of the most frequently asked questions regarding political signs and their placement is included in this nomination packet. (See separate handout - Political Sign Regulations Fact Sheet - item 14.) Question: When can I put up signs? Answer:

Any time prior to the election. It is requested that signs not be placed prior to January to avoid clutter during the holidays.

Question: When should signs be removed? Answer: No signs may remain longer than 10 calendar days after the election for

which the sign was posted; therefore, signs must be removed by Friday, March 10, 2019 (San Dimas Municipal Code Title 18, Chapter (18.152.200.)

Various code sections may govern political activity by individuals which are not referenced in this outline. Any person violating any additional law governing the conduct of elections and/or political activity is responsible for his/her actions.

Q. How often does the City Council meet?

A. The City Council holds its regular meeting on the second and fourth Tuesday of each month at 7:00 p.m. A study session may be held prior to any council meeting at 5:00 p.m.; or on any other date deemed necessary by the council and staff. Other adjourned or special meetings are scheduled as City business necessitates. 2019 had 23 regularly scheduled meetings, two special meetings, four study sessions, two budget study sessions and two retreat meetings.

Q. Do City Councilmembers Receive Compensation?

A. Yes. Councilmember salary is established by Government Code 36546, and the current monthly amount is $620.00. In addition, Councilmembers are eligible to receive the following benefits: Health Benefits

• City councilmembers are eligible to enroll in the City’s health, dental and vision insurance.

• Councilmembers are eligible to receive $1445.00 per month if they choose not to enroll in a city-provided health plan. (used toward deferred comp)

Q. Is there a filing fee involved in my candidacy? A. No! There is no filing fee for a candidate for municipal office in San Dimas. There is a fee for publishing a campaign statement in the sample ballot.

Q. Where can I obtain filing forms?

A. Campaign disclosure forms are available from the Office of the City Clerk as well as downloadable from the FPPC website at http://www.fppc.ca.gov click on Campaign Forms.

Q. Are extensions given for campaign disclosure filing deadlines?

A. Except for deadlines that fall on a Saturday, Sunday or official state holidays, no provisions exist for extensions of filing deadlines. A statement not filed on or before the deadline is considered late and is subject to late filing penalties.Penalties are $10 per day.

Q. When will sample ballots be mailed to the voters?

A. State law requires sample ballots to be mailed to all qualified voters between 40 and 21 days before the election.

Q. How can I find out the election results?

A. The ballots will be counted on election night after the polls are closed by the Los Angeles County Registrar/Recorder.

Q. Why is there so much paperwork involved in being a candidate?

A. State law requires that you file the appropriate materials to assure the voters that you are fully disclosing all information pertinent to your candidacy. The purpose of the requirement is to ensure a fair and democratic electoral process.

Q. Who can sign my nomination paper? A. Any registered voter in the jurisdiction, the City of San Dimas, may sign a

nomination paper. This includes the candidate and/or the circulator. No voter may sign more than one nomination paper for the same office. Each seat on the City Council is a separate office. Therefore, a citizen may sign a nomination paper for three different candidates for this election. Your nomination paper must contain at least 20 and not more than 30 signatures; a minimum of 20 must be verified for your nomination to be valid.

Q. What happens if some of the signatures I obtain on my Nomination Papers are not registered voters, or do not live within the City of San Dimas (incorporated area)?

A. These signatures will not be counted toward the 20 signatures required for

you to run for office. File your nomination paper early to avoid the consequences of this kind of problem. The City Clerk must verify the signatures on all nomination papers. If you wait until the last day to file and any sponsor signature for any reason is insufficient, it will not be counted toward the required signatures and you may not qualify as a candidate. If you file early, there will be time to check the signatures and notify you of any discrepancies, and you will then have an opportunity to circulate and submit a supplemental nomination paper.

Q. How soon will a list of candidates be available after the close of the nomination

period?

A. A complete list of candidates will be available the first working day following the close of the filing period, assuming all nomination paper signatures have been verified. 6-2

Q. When will I be informed of my candidate qualification status?

A. You will be informed by telephone and in writing as soon as your Nomination Papers are qualified or disqualified.

Q. May I sign my own nomination papers? A. Yes, you and any qualified relatives may sign your papers.

Q. What if I change my mind about being a candidate after filing nomination

papers?

A. You may withdraw as a candidate at any time PRIOR to the close of the nomination period, which is Friday, December 6, 2019 (or Wednesday, December 11, 2019, if the nomination period is extended.) You are NOT permitted to officially withdraw after that date, and your name will appear on the ballot.

Q. May I change or correct the spelling/wording on my Candidate’s Statement

after it has been submitted?

A. No, you may not. Check your Candidate’s Statement carefully before it is submitted. Q. May I circulate absentee ballot applications?

A. Yes, an individual, group or organization may distribute applications for absentee ballots. However, those distributing applications must use the uniform format approved by the Secretary of State. Completed applications must be turned in to the Los Angeles County Registrar/Recorders Office within 72 hours of your receipt of them.

Q. When officeholders or candidates receive contributions of $1,000 or more, are they required to have a committee?

A. Yes, an officeholder or candidate who receives contributions (including loans) that total $1,000 or more in a calendar year must file a Statement of Organization, Form 410.

Q. May my spouse, friend, or campaign manager pick up and file my

nomination documents? A. Although the Election Code does not specifically prohibit another person from

picking up or filing nomination papers on behalf of a candidate, it is very important for a candidate to appear in person so the Clerk can review all the requirements of the nomination documents with the candidate. An authorization form, available from the City Clerk, must be completed by the candidate before any documents will be issued to someone other than the candidate.

Q. If I am only spending my own money on my campaign, do I still need to file

campaign statements? A. Yes, you are still subject to the filing requirements of the Political Reform Act. If

you plan to use personal funds to pay for campaign expense you should first deposit those funds into a campaign bank account opened for the purpose of your campaign. PLEASE NOTE: You may only use personal funds to pay the cost of the candidate's statement without first depositing those funds into a campaign bank account.

Q. May I serve as my own campaign treasurer?

A. Yes, State law allows you to serve as your own treasurer, as long as this is designated on the Form 410 - Statement of Organization.

Q. When will the newly elected Councilmembers take office?

A. The newly elected Councilmembers will take office at the same meeting at which the City Council certifies the results of the Election, following the County certification. (Elections Code §10262, 10263).

Q. Must a committee wait until $1,000 is received to file a statement of

organization?

A. No, a committee may file a Statement of Organization before it is actually qualified. "Not yet qualified" should be entered in the "Date Qualified" space on the form.

Q. What happens if a candidate or treasurer is not available to sign a campaign

disclosure statement on or before the filing deadline?

A. An agent of the candidate or treasurer may sign the campaign disclosure statement. The agent must attach an explanatory note to the statement stating that, as soon as the candidate or treasurer is available, he/she will verify and sign the statement and an amendment with the proper signature will be filed. In the event a committee treasurer will be unavailable to carry out his/her duties for an extended period of time, a new treasurer should be designated and the committee's Statement of Organization, Form 410, amended.
