Hello everyone, half the year has passed us and we have all faced a tough couple of month in our industry. We have had to once again educate our legislators on why some of the bills that are being put forward were not viable to our industry and to the state. With that said, our job is not done yet. There are bills that have passed out of their house of origin and have the potential of affecting our industry CAHSAH will be reaching out to you to help in meeting with your local legislative offices to continue the conversations. 5. The compensation paid to physicians over the term of the agreement is set in advance, is consistent with fair market value in arms-length transactions and is not determined in a manner that takes into account the volume or value of any referrals or business otherwise generated between the parties.

6. The services performed serve a commercially reasonable business purpose.

If all of these criteria are met, physicians and providers to which they make referrals are within the applicable safe harbor.

Providers whose services are defined as designated health services (DHS) must also meet the requirements of the contractual exception under Stark. DHS includes home health and HME services, among others. Hospice is not DHS. The requirements of this exception are basically the same as the safe harbor described above except that if the agreement is terminated in less than one (1) year, the parties may not enter into another agreement until a year after the agreement was effective.

In addition, some states have requirements that providers must meet in order to make payments to referring physicians. While these statutes vary from state to state, compliance with these so-called “mini Stark laws” is also essential.

There are many pitfalls for providers and physicians with regard to payments from providers to physicians who make referrals to them. Now is the time to dot the “i’s” and cross the “t’s” to get it right!

7CALIFORNIA ASSOCIATION FOR HEALTH SERVICES AT HOME

On June 9, 2015, the Office of Inspector General (OIG) of the U.S. Department of Health and Human Services, the primary enforcer of fraud and abuse prohibitions, issued a Special Fraud Alert entitled “Fraud Alert: Physician Compensation Arrangements May Result in Significant Liability.” In this Special Fraud Alert, the OIG encourages physicians to carefully consider the terms and conditions of medical directorships and other compensation arrangements with providers to which they make referrals before entering into them.

Specifically, the OIG stated that the following are violations of the anti-kickback statute:

• Payments to physicians that take into account the volume or value of referrals from physicians to providers who make them;

• Payments are in excess of fair market value for the services performed by physicians;

• Physicians who did not actually perform the services required by agreements with providers to which they make referrals; or

• Relieving physicians of expenses they would otherwise have incurred.

The OIG has clearly fired a warning shot over the bows of providers! Now is the time to get it right!

What does getting it right mean? At a minimum, providers should meet all of the requirements of the personal services and management contract safe harbor or exception under the federal anti-kickback statute.

This exception or “safe harbor” says that illegal remuneration does not include payments made by providers who receive referrals to physicians who make referrals as compensation for services provided by them, as long as all of the following standards are met:

1. The agreement is set out in writing and signed by both parties.

2. The agreement specifies the services to be provided by the physician.

3. The agreement must indicate whether physicians will provide services on a part-time basis for the term of the agreement and the charge for such services.

4. The term of the agreement is for not less than one year.

State Budget UpdateCalifornia legislators and Governor Jerry Brown reached a $115.4 billion budget deal that has several health care implications. Overall, the budget allocates nearly $32 billion for health care programs, including about $18 billion for Medi-Cal, Under the budget deal, the state beginning in May 2016 would extend Medi-Cal coverage to about 170,000 undocumented immigrant children under age 19. The expansion is projected to cost $40 million in the next fiscal year and about $132 million annually following implementation.

The budget deal also includes $226 million to restore for one year a 7% pay cut In-Home Supportive Services providers and includes provisions to fund Medi-Cal dental services. But the Governor rejected a provision set forth by the Legislature that would have increased Medi-Cal provider reimbursement rates by 5% for those providers who received a 10% reimbursement cut in 2011 (Home Health and Hospice were excluded from that initial 10% cut). The Governor cited concerns about costs to implement increases across-the-board for all Medi-Cal providers.

However, Governor Brown has announced that two special legislative sessions will be held sometime this Fall to address additional funding concerns related to the budget, one of which will address Medi-Cal reimbursements.

AB 1400 (Santiago) PRIORITY BIL LAB 1400 is scheduled to be heard on July 14th in the Senate Human Services Committee. CAHSAH is strongly opposed to this bill as it would require that 85% of all revenue in excess of $7 million billed to Regional Centers for respite care be designated to pay for wages and wage related expenses for caregivers leaving only 15% of that revenue available for all other costs.

CAHSAH has worked with the author to secure amendment language to exclude from the provisions of the bill respite care employer of record arrangements. Nevertheless, we continue to urge all our members to contact their legislators asking them to oppose this bill. Please continue to look for CAHSAH Action Alerts on this vital measure.

AB 465 (Hernandez) PRIORITY BIL L AB 465 has passed out of the Senate Judiciary Committee and moves to the Senate Floor. CAHSAH strongly opposes this bill which would render mandatory arbitration agreements no longer enforceable. Please contact your Senator and urge them to vote “No” on this bill.

AB 637 (Campos) PRIORITY BIL LAB 637 has moved to the Senate Floor. If passed, this bill would allow nurse practitioners and licensed physician assistants to create and sign Physician Orders for Life Sustaining Treatment (POLST) forms. CAHSAH has taken a “Support” position on this priority bill because it is an important step forward in ensuring that terminally ill patients receive the type of end-of-life care options they desire.

SB 3 (L eno) PRIORITY BIL LSB 3 is scheduled to be heard in the Assembly Labor and Employment Committee on Wednesday, July 8. If enacted, this measure would increase the minimum wage and link yearly increases to the Consumer Price Index as follows: $11 on January 1, 2016, $13 on July 1, 2017, and yearly increases to the Consumer Price Index after January 1, 2019. CAHSAH is strongly opposed to this measure and urges all members to educate their legislator on the importance of keeping home care accessible and affordable by opposing this measure.

AB 782 (Dababneh) PRIORITY BIL LAB 782 (Dababneh), the Domestic Referral Agency (DRA) licensure bill, was held on the Assembly Appropriations Committee Suspense File and is; therefore, dead for this year. CAHSAH vehemently opposed this measure because it created a licensure structure for these domestic referral agencies without sufficient consumer protection language. Thank you to all CAHSAH members for your hard work that led to this significant outcome.

Weekly News Updates for JuneCMS Issues Face-to-Face Probe

CMS has issued its plan for review of the home health face-to-face encounter requirement and plans to initiate a “Probe and Educate Review” process beginning October 1, 2015. These reviews will impact claims with a “from” date beginning 8/1/2015.

CMS will conduct pre-payment reviews of home health claims for episodes beginning on or after August 1, 2015. CMS contractors will conduct these reviews using a Probe and Educate strategy through an end date to be determined. The purpose of this Probe and Educate process is to ensure that home health agencies understand the new patient certification requirements. Because home health episodes have a 60-day certification, CMS anticipates the first documentation requests will be sent on or about October 1, 2015.

New Medicare HCPCS Codes

Change Request 9192, issued by the Center for Medicare and Medicaid Services (CMS) provides the quarterly update of Healthcare Common Procedure Coding System (HCPCS) codes used for home health consolidated billing.

The Department of Health Care Services has just announced that Medi-Cal providers will see checkwrites scheduled for the end of fiscal year 2014 – 2015 delayed until the start of fiscal year 2015 – 2016.

The FDA has issued a warning about serious risks with the drug Blincyto. This warning is being distributed to all health care provider associations, including home health associations. Blincyto is prescribed for the acute lymphoblastic leukemia(ALL). Details are here.

Medicare Hospice Item Set

AB 782 - DRA Licensure Dead

The Center for Medicare and Medicaid Services (CMS) held a training call for the revised Hospice Item Set (HIS) Manual. The revised manual, version 1.02, is effective June 28, 2015, and it includes HIS definition clarifications as well as some revised guidance.

As reported via the E-Alert that was sent, we are pleased to report that AB 782 (Dababneh), the DRA licensure bill, has been held on the Assembly Appropriations Committee suspense file and is therefore dead for the year.

Weekly News Updates for JuneDepartment of Public Health Prohibits On-Line Training for Home Health Aides

During CAHSAH’s regular quarterly meeting with the Department of Public Health’s Licensing and Certification Division we sought clarification about the use of on-line training for continuing education for a certified home health aide (CHHA) to renew their certification. Several home health agencies had questioned why the CHHA renewal form indicates that on-line training is not allowed when aides previously had submitted continuing education courses that were on-line. The Department indicated that on-line training for aides has always been prohibited because there are no statutes which allow on-line training but they did not previously have this instruction on the renewal form. The change was made on the renewal forms to ensure that aides were aware of the statutes. The Department further elaborated that in 2005 statutes (Health & Safety Code, Section 1337.6) were added to allow only certified nurse assistants to use on-line training. However, at the time the statutes were amended to allow certified nurse assistants to complete training on-line they did not include certified home health aides.

CAHSAH is developing a strategy to address this issue either through regulation or legislation.

All continuing education courses for CNAs and CHHAs must be provided by a Department approved continuing education provider to be counted toward the certification renewal requirements. Q: How does an employer determine the rate of compensation when an employee utilizes their sick leave benefit under the new AB 1522 law if the employee has multiple rates of pay and receives overtime compensation?

A: Under the current statute which falls under Labor Code, Section 246, if an employee works at different rates of pay the employer must average the wages by dividing total wages (Do NOT include any overtime compensation) by total hours worked for the prior 90 days.

For the past several years, Braden has been a senior policy manager with the California Department of Health Care Services and most recently headed up the Department’s implementation of the federal Affordable Care Act. In that capacity, he reported directly to the Department director, led a team of Department policy managers and analysts to write the policy and legislation to implement the Act, and was responsible for successfully shepherding that implementation legislative package through the Assembly and Senate and to the Governor for his signature. Home Health Skilled Nursing Services: Would remove the Title 22 requirement that specifies registered nurses and licensed vocational nurses shall have one year of prior professional nursing experience before being eligible for employment with a licensed home health agency and adds new requirements that a skills and competency training program be completed which includes at least 80 hours of clinical orientation, didactic, simulation, and hands-on training in the patient’s home.
