CODES OF CONDUCT, GUIDELINES AND BEST PRACTICES,
AND/OR STANDARDS AND COMMUNITY PROTOCOLS ON ACCESS
AND BENEFIT-SHARING SPECIFICALLY ADDRESSING GENETIC
RESOURCES FOR FOOD AND AGRICULTURE
The Commission, at its last session, invited Members to submit information on use and exchange
practices, relevant voluntary codes of conduct, guidelines and best practices and/or standards and
community protocols on access and benefit-sharing specifically addressing genetic resources for food
and agriculture and requested the Secretary to compile this information. Consequently, FAOinvited
Members through Circular State Letter C/X/DDN-6 to submit such information by 1 December 2016.
As for the previous session1, the submissions received were compiled; they are presented in this
document in alphabetical order of countries and in the language in which they were received.

Into animal genetic resources development in Africa
Challenges and Opportunities for the Nagoya Protocol
Executive Summary
This report examines the implementation of access and benefit sharing (ABS) measures for Animal
genetic resources (AnGR) in Africa, in particular as it relates to the Nagoya Protocol on Access to
Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization
(Nagoya Protocol).
AnGR make globally important social, cultural and economic contributions to food and agriculture,
sustaining rural production systems and community livelihoods. For many African communities their
distinctive livestock breeds are an integral part of their collective identity and their biocultural
relationship with their land and environment. Genetic resources from Africa have to be protected and
valorised to ensure that benefits arising from their utilisation will flow to local communities who are
the custodians of these resources and the associated traditional knowledge.
The report starts by briefly describing how human-induced environmental changes have led to current
crises such as climate change, land degradation, desertification, stressed water supplies and
biodiversity loss, which are also impacting exchange patterns of AnGR and associated trends in their
conservation and utilisation.
The report then details relevant international policy responses that could impact future trends in
relation to the conservation and utilisation of AnGR, particularly the ABS provisions under the
Convention on Biological Diversity, the provisions and obligations set out in the Nagoya Protocol on
ABS, ongoing international processes under the FAO Commission on Genetic Resources for Food and
Agriculture, and the African Union Guidelines for the Coordinated Implementation of the Nagoya
Protocol in Africa.
The implementation of ABS measures at the national level, which incorporates all aspects involved in
the management of genetic resources and associated traditional knowledge, including capacity
development, technology transfer, contractual model clauses and codes of conduct, is directly relevant
to conservation and utilization of AnGR, including facilitated access to a wider variety of these
resources, particularly for research and development (including breeding).
The livestock industry has for decades used genetic resources from Africa. Today, development and
use of biotechnology accelerates generation intervals and selection intensities; although different
between species and breeds the general trend is to increase gene flow. Zoosanitary regulation, animal
welfare considerations, freight costs, and exchange and inflation rates have become major restrictions
on gene flow, affecting importing and exporting parties differently.
Given the predominant North-South gene flow in Africa, benefits potentially arising from the use of
genetic resources accessed from the South may not be sufficient to encourage breed conservation in
the South. Other measures may need to be explored to encourage the conservation of these breeds. As
intensive production based on a few global and trans-boundary breeds continues to supply the bulk of
global production, and the threat of extinction for local breeds increases particularly in regions of fast
structural change, defensive measures to reduce gene flow related threats to genetic diversity may be
more appropriate. The usefulness and applicability of market-based tools such as a levy on
international movement of animal genetic material to support developing-country communities,
breeding associations, and breeding and conservation programmes could be investigated.

An assessment of the legal environment for exchange and movement of AnGR in Africa reveals that
there is little recognition in terms of Intellectual Property Rights (IPRs) of those livestock breeders
who have dedicated so much of their time and energies to the development of these breeds. Issues
related to ownership and free choice, such as livestock keepers’ rights to land and producers’ choice of
genetic stock for use in vertically integrated production systems, are also of great importance.
Furthermore, the trans-boundary nature of AnGR makes it imperative to have workable systems for
ABS as well as IPR where applicable. This is particularly important where transhumance and trade in
AnGR are practiced with animals moving back and forth across national borders as well as globally.
Additionally, relevant codes of conduct are needed to guarantee sound gene flows between different
production environments.
A large number of African countries have ratified or acceded to the Nagoya Protocol. The Nagoya
Protocol, to be operational, requires effective implementation at the national level. Parties to the
Protocol need to:
a. Revise legislative, administrative or policy measures on access and benefit-sharing (ABS) already
in place or develop new measures in order to meet the obligations set out under the Protocol;
b. Establish relevant institutional structures, including the designation of a national focal point on
access and benefit-sharing, one or more competent national authorities, and one or more
checkpoints; and
c. Make relevant information available to the ABS clearing house.
A number of African countries have now embarked on the process of developing new or amending
existing legislative, administrative and policy measures to meet the obligations set out in the Nagoya
Protocol. However, the majority of African countries still face a number of challenges in relation to
ratification and implementation of the Protocol. Some challenges identified include:
Lengthy legal procedures and requirements for ratification, as well as complexity associated with
stakeholder consultations, have delayed ratification/accession processes in some countries
Lack of inventory of genetic resources and lack of knowledge about their potential economic/
commercial value
Limited capacity in the area of negotiation of mutually agreed terms
Limited capacity to implement systems for monitoring the utilization of genetic resources.
In countries where national ABS legal frameworks exist, the specific needs of the AnGR sector – as
they differ from those of other genetic resource sectors such as crops and wildlife – are not on the
whole well accounted for. The implementation of the Nagoya Protocol nonetheless provides an
opportunity for countries to further examine how AnGr related standards and protocols could be taken
into account as part of broader ABS measures.
Finally, reports from several African countries also indicate that no country has to date put in place
national legal framework for regulating access to AnGR. Some list the development of such
frameworks among their priority actions for the future. Most African countries still lack the legal,
institutional and policy frameworks to manage the characterization, inventory and monitoring
mechanisms needed to adequately regulate inflow and outflow of AnGR. The challenges faced by
countries in this regard also include:
Lack of priority given to issues related to AnGR
Indigenous knowledge on AnGR is fast disappearing yet there are no systems for capturing,
transmitting and verifying such knowledge
Actors involved in the management of AnGR generally have low awareness of ABS
There are few comprehensive inventories of AnGR
Valuation (better utilization) of AnGR is required
Identification, recording and traceability systems for AnGR are needed to prove production values
and enable effective ABS.

В природных экосистемах Азербайджана имеются ценные генетические ресурсы
растений для производства продовольствия и ведения сельского хозяйства, включая
эндемичные, и находящиеся под угрозой исчезновения дикорастущие сородичи культурных
растений.
Для создания научных и организационных основ сохранения и устойчивого
использования национальных генетических ресурсов были проанализированы международные
законодательные инициативы, правовые нормы и методологические разработки в области
охраны биоресурсов. Результаты исследования позволили определить приоритетные виды
деятельности и механизмы их реализации, гармонически сочетающие сохранение коллекций
культурных растений в ex-situ условиях c мобилизацией их диких сородичей и охраной редких,
исчезающих видов природной флоры пищевого, лекарственного, кормового назначения в in-
situ/on-farm условиях. Особенности решения проблемы сохранения и восстановления
генетических ресурсов растений для Азербайджана предопределены Национальной Программой
сохранения биоразнообразия, которая определила стратегию сохранения и рационального
использования всего генетического разнообразия растительных ресурсов на национальном
уровне и их интегрирования во всемирную систему охраны природных ресурсов.
Вся работа по использованию и обмену, доступу и распределению генетических ресурсов
растений ведется в соответствии с Законом Азербайджанской Республики «О сохранении и
устойчивом использовании генетических ресурсов культурных растений» (2011 год). В
соответствии с этим Законом Решением Кабинета Министров Азербайджанской Республики в
2012 году был создан Научно-технический совет по ГРР, входящий в систему управления по
охране и рациональному использованию генетических ресурсов культурных растений.
Координационную деятельность по работе Научно-Технического Совета, Экспертных Советов,
а также рабочих групп (по отдельным видам деятельности в области сохранения ex situ/in situ/on
farm коллекций генетических ресурсов растений), входящих в этот Совет осуществляет Институт
Генетических Ресурсов АН Азербайджана.
Согласно статье 17 Закона «О сохранении и устойчивом использовании генетических
ресурсов культурных растений» право использования генетических ресурсов растений для
обмена, изучения, исследования, селекции, обучения и другой деятельности дается
пользователям на основе двусторонних или многосторонних соглашений о передаче материала
заверенных председателем Научно-технического Совета. В Соглашении оговариваются права и
обязанности сторон договора, срок действия, количество и качество материала, области
предполагаемого использования материала и справедливого распределения доходов от его
последующего использования между донором и пользователем, а также запрет о последующей
передаче материала без разрешения донора.
Примером обмена генетическим материалом в течение года может служить таблица
движения семенного материала в Национальном Генбанке Азербайджана в 2016 году:

Согласно статье 13 Закона «О сохранении и устойчивом использовании генетических
ресурсов культурных растений» обмен и распределение генетического материала
осуществляется в соответствии с национальным законодательством, международными
соглашениями и конвенциями. Обмен осуществляется путем подписания соглашения между
сторонами, в котором оговаривается необходимость оплаты расходов по распределению и
обмену семян со стороны пользователя.
В случае импорта генетического материала необходимыми документами являются:
фитосанитарный сертификат, выданный соответствующими органами; документ,
подтверждающий отсутствие генетически модифицированного материала; документ,
показывающий происхождение образца; документ о коммерческой ценности образца;
разрешение на импорт образца Государственной службы фитосанитарного контроля при
Министерстве сельского хозяйства Азербайджана; список импортируемых образцов.
Разрешение на вывоз генетического материала выдается Научно-техническим Советом на
официальном бланке Национального координатора (Институт генетических ресурсов
Национальной Академии Наук Азербайджана), подписанном председателем Научно-
технического Совета.
На данный момент подписаны Соглашения о сотрудничестве и обмене генетическим
материалом с Турцией, Ираном, Россией, Беларусью, Узбекистаном, Украиной, Англией,
Казахстаном, Австрией, Венгрией, Бельгией и др.
Устойчивое использование генетических ресурсов растений соответствующими научно
исследовательскими институтами, лабораториями, частными компаниями, отдельными
исследователями осуществляется в теоретических и практических исследованиях путем
применения современных селекционных программ и новых биотехнологических методов с
применением ДНК-маркеров, что позволяет создавать новые приспособленные к местным
условиям высокопродуктивные, высококачественные, стресс-устойчивые сорта и формы ряда
культурных растений.
Согласно 6 статье Закона Азербайджанской Республики «О селекционных достижениях»,
семена любых вновь созданных сортов не могут быть приняты в Государственную Службу

Регистрации и Семенного Контроля Сортов Растений при Министерстве Сельского Хозяйства
Азербайджанской Республики без письма от Национального Координатора о принятии образцов
семян в Национальный Генбанк. Так, в 2016 году было создано и принято для сохранения в
камерах среднесрочного хранения 13 сортов зерновых, бобовых и овощных культур.
В рамках программы по использованию генетических ресурсов растений в Республике
проводится скрининг генетических ресурсов растений в национальных ex situ коллекциях для
создания новых источников и доноров хозяйственно-ценных признаков и их привлечения в
селекции новых сортов и гибридов, проводятся исследования по выявлению генетического
потенциала редких стародавних сортов, видов растений и их диких сородичей, определение
экономической целесообразности их использования в сельских сообществах и пригородных
частных хозяйствах, сохранение в условиях on farm этих растительных ресурсов и воссоздание
на их основе микроагроэкосистем.
Ученые Азербайджана, устанавливая тесное сотрудничество с авторитетными между-
народными организациями в области генетических ресурсов растений (Организация
Продовольствия и Сельского Хозяйства ООН - FAO, Программа Сотрудничества Европы по
Генетическим Ресурсам Растений - ECPGR, Международный Институт Биоразнообразия,
Международный центр по исследованиям сельского хозяйства в засушливых районах - ICARDA,
Международный центр по улучшению пшеницы и кукурузы – CIMMYT, Международный
Институт Овощеводства, Фонд Международного Доверия по ГРР, Центр Сельскохозяйственных
исследований Франции – İNRA и др.), научными учреждениями, университетами и генбанками
зарубежных стран (США, Россия, Турция, Австралия, Иран, Италия, Республики Центральной
Азии, Япония, Германия, Индия, Великобритания, Франция, Мексика и др.), проводят
совместные научные изыскания.
Информация о любых мероприятиях по использованию ГРР включается в Национальную
Центральную Базу Данных, созданную и функционирующую при Национальном Генбанке
Азербайджана. Селекционеры и исследователи используя базу данных могут заказать
необходимые образцы семян. В то же время, Национальный Генбанк координирует процесс
комплексных исследований генофонда, обеспечивает сбор характеристических, оценочных
данных и данных о геномике образцов растений в едином центре.
В настоящее время в Национальной Центральной Базе Данных сохраняется информация
о паспортных данных 12593 образцов семян различных групп растений, относящихся к 113
семействам, 443 родам, 871 видам и 304 внутривидовым разновидностям. Из них 4522 –
зерновые-злаки, 1528 - бобовые, 774 - кормовые, 899-овоще-бахчевые, 1936 - технические, 2420
- садовые, 810-лекарственные и другие растения. По биологическому статусу 4685 сортов
научной селекции, 2365 сорт народной селекции, 3288-исследовательский материал, 2247-дикие
виды.
При поддержке Глобального траст-фонда по разнообразию сельскохозяйственных
культур (Global Crop Diversity Trust), для страхования образцов зерновых злаков и бобовых
растений азербайджанского происхождения от стихийных бедствий, в различных
Международных Генбанках, а также в Северном Банке генов (Svalbard Global Seed Vault)
созданы дуплетные коллекции.
BELARUS
Министерством сельского хозяйства и продовольствия совместно с Национальной
академии наук Беларуси в рамках компетенции рассмотрена информация Комиссии по
генетическим ресурсам для производства продовольствия и ведения сельского хозяйства
Продовольственной и сельскохозяйственной организации Объедененных Нации и сообщается
следующее.

Республика Беларусь является участником ряда международных договоров, касающихся
сохранения и устойчового использования биологического раснообразия. Страна участвует в
деятельности международной сети по гетеническим ресурсам растений. Расработан Договор о
сотрудничестве в области сбора, сохранения и использования генетических ресурсов культурных
растений. На его основе осуществляется долгосрочное научное партнерство с ведущими
селексионными центрами и международными генетическими банками, налажен обмен
генофондом.
С 2005 года поддерживаются контакты с Международным институтом генетических ресурсов
растений (Рим, Италия). С 2008 года республика является участником Европейской
кооперативной программы по генетическим ресурсам растений (ECPGR).
В Беларуси функции Контрольного пункта мониторинга использования генетических ресурсов
восложены на Национальный координационный центр, созданный в соответствии с
постановлением Совета Министров Республики Беларусь <<О создании Национального
коoрдинационного центра по вопросам доступа к генетическим ресурсам и совместного
использования выгод>> от 1.10.2014 N° 933, действуюжий при ГНУ <<Институт генетики и
цитологии НАН Беларуси>>.
BURKINA FASO
Me référant à la lettre citée en référence de Monsieur le Chargé d'Affaires ai. auprès de l'Ambassade
du Burkina Faso à Rome, j'ai l'honneur de vous faire parvenir les informations sur les usages en
matière d'utilisation et d'échanges, les directives et codes de conduite d'application volontaires et les
pratiques optimales, ainsi que sur les normes et protocoles communautaires relatifs à l'accès et au
partage des avantages sur les ressources génétiques pour l'alimentation et l'agriculture.
En effet, le Burkina Faso en tant que membre de la Commission des ressources génétiques pour
l'alimentation et l'agriculture et ayant ratifié la Convention sur la diversité biologique (CDB), le Traité
international sur les ressources phytogénétiques (TIRPGAA) et le Protocole de Nagoya sur l'accès aux
ressources génétiques et le partage juste et équitable des avantages découlant de leur utilisation (APA),
s'intéresse à la question de l'accès aux ressources et du partage des avantages. Ainsi, le Gouvernement
soucieux de formuler des mesures législatives et administratives a désigné des Points focaux en vue de
coordonner l'opérationnalisation du mécanisme dans les différents sous-secteurs.
En attendant de formaliser ce mécanisme, le Burkina Faso veille à ce que les ressources génétiques
soient disponibles et accessibles en quantité et en qualité en vue d'assurer conséquemment la sécurité
alimentaire et nutritionnelle des populations.
Par conséquent, il a développé des stratégies visant l'utilisation et la conservation de ces ressources
parmi lesquelles on peut citer :
- la stratégie et le plan d'actions sur la diversité biologique dont un des objectifs spécifiques est
d'assurer un partage équitable des bénéfices découlant de la valorisation des ressources
biologiques surtout génétiques;
- la loi portant sur la réglementation des semences végétales qui prévoit l'implication des
communautés autochtones et locales pour la gestion des ressources génétiques.
C'est vous assurer donc, Madame la Secrétaire, que les éléments visant la concrétisation au niveau
national de l'accès aux ressources pour l'alimentation et l'agriculture et le partage des avantages en
découlant ne sont pas encore effectifs.
En attendant la tenue de la 16ème session de la Commission au cours de laquelle les informations
relatives à l'accès et au partage des avantages sur les ressources génétiques seront examinées, le
Gouvernement du Burkina Faso saisit l'occasion pour renouveler à la Commission des ressources
génétiques pour l'alimentation et l'agriculture à travers la Représentation nationale de la FAO, ses
sincères remerciements pour son soutien à notre pays.

COLOMBIA
Teniendo en cuenta la comunicación C/X/DDN-6 del 4 de octubre de 2016, nos permitimos informar
que en lo relacionado con las “Prácticas de utilización e intercambio, los códigos de conducta voluntarios
pertinentes, las directrices y mejores prácticas y las normas o los protocolos comunitarios sobre acceso
y distribución de beneficios específicamente referidos a los recursos genéticos para la alimentación y la
agricultura” el Ministerio de Agricultura y Desarrollo Rural no ha implementado actividad alguna sobre
el tema mencionado. Sin embargo, se espera la implementación de diferentes programas de la entidad
en los cuales puedan incluirse las actividades relacionadas con el objetivo planteado dentro del CDB en
coordinación con otras entidades públicas y con el acompañamiento de la oficina de la FAO en
Colombia.
Es importante mencionar, que el país es consciente de los retos necesarios para abordar el tema por lo
que ha recibido con gran acogida los Elementos del ADB y espera que ellos sirvan de fundamento para
los programas que se tiene previsto desarrollar.

En atención a la nota C/X/DDN-6 del 4 de octbre anterior, sírvanse encontrar la información remitida por nuestro punto focal nacional ante la CRGAA, Ing. Argerie Cruz, sobre los documentos que la legislación costarricense aplica para el acceso y distribución de beneficios:

GERMANY
With respect to your letter C/X/DDN-6 (4 October 2016) Germany provides the following information
on use and exchange practices, relevant voluntary codes of conduct, guidelines and best practices
and/or standards and community protocols on access and benefit-sharing specifically addressing
genetic resources for food and agriculture:
I. Conditions under which genetic resources for food and agriculture are exchanged and
used
An overview of exchange practices and standards in terms of Standardized Material Transfer
Agreements in Germany was given in our answer from 3 December 2013 to your letter C/NRD-5 from
8 August 2013 (see Attachment).

Implementation of the International Treaty on Plant Genetic Resources for Food and
Agriculture
Germany is Party to the International Treaty on Plant Genetic Resources for Food and Agriculture.
The Plant Treaty was endorsed by a national law, published on 16 September 2003. Germany has
ratified the Treaty on 31 March 2004. Details on the implementation of the Plant Treaty have been
provided to the Secretariat of the Treaty in the first Compliance Report in November 2016.
Germany has included in the Multilateral System of Access and Benefit-Sharing all PGRFA listed in
Annex I to the Treaty that are under the management and control of the German Government and in
the public domain.
Germany reported in detail about the steps and the appropriate measures within these steps taken to
provide facilitated access to Annex I PGRFA, during the 2nd technical consultation on information
technology support for the implementation of the MLS of ABS of the international Treaty in Rome, 2-
3 December 2008. This is documented as German case study in document IT/GB-3/TCIT-2/08/Inf.1.
As member of AEGIS (A European Genebank Integrated Network) Germany supports the facilitated
access even to Non-Annex-I-Crops that are under the management and control of the German
Government and in the public domain. The German Genebanks supply this material via SMTA.
Implementation of the Nagoya-Protocol:
The European Union adopted Regulation (EU) 511/2014 of the European Parliament and of the
Council on compliance measures for users from the Nagoya Protocol on Access to Genetic Resources
and the Fair and Equitable Sharing of Benefits Arising from their Utilisation in the Union. The
Regulation is directly applicable in all 28 EU Member States. It implements the compliance "pillar" of
the Protocol, based on the principle of due diligence and more specifically it provides for
establishment of two checkpoints: one at the stage of receiving funding for research involving
utilisation of genetic resources and traditional knowledge associated with genetic resources, and
another at the stage of final development of a product developed via the utilisation of genetic resources
or traditional knowledge associated with such resources.
Germany ratified the Nagoya Protocol on 21 April 2016. The EU legislation is supplemented in
Germany by the Act Implementing the Obligations under the Nagoya Protocol and Transposing
Regulation (EU) No 511/2014. The Implementing Act entered into force on 1 July 2016.
Access to Genetic resources in Germany according to the Nagoya-Protocol:
Germany has not adopted legislation specifically regulating access to genetic resources or questions of
benefit sharing within German national jurisdiction. Access to genetic resources in Germany is
therefore not subject to prior informed consent (PIC) and mutually agreed terms (MAT) within the
meaning of the Convention on Biological Diversity (CBD) and the Nagoya Protocol. Consequently,
access to genetic resources collected in situ within the national jurisdiction of the Federal Republic of
Germany is generally free. It is solely subject to the general restrictions of public law and private law.
With regard to Articles 15 and 16 of the NP:
The EU legislation and the German Implementing Act provide for appropriate, effective and
proportionate compliance measures foreseen under Articles 15 and 16 of the NP.
Measures to address situations of non-compliance (Articles 15(2) and 16(2)) are foreseen under
Sections 2, 4 and 5 of the Implementing Act and include orders and remedial action, administrative
fines as well as confiscations. Intervention and where necessary imposition of sanctions is foreseen in
the event of failure by users to comply with due diligence, declaration and cooperation related
obligations.

In view of Articles 15(3) and 16(3) of the NP, compliance checks of users of genetic
resources/associated traditional knowledge will be undertaken on the basis of substantiated concerns
(triggered e.g. through cooperation with CNAs of provider states) as well as based on periodically
reviewed control plans.
With regard to Article 17 of the NP:
Utilization of genetic resources/associated traditional knowledge is monitored by the German Federal
Agency for Nature Conservation (BfN) as the competent national authority. BfN responsibilities
include in particular:
Receipt of due diligence declarations to be submitted by users at two stages in the chain of
utilization (checkpoint 1 at the stage of research funding, checkpoint 2 at the final stage of
product development),
Receipt of reports related to disclosure of origin in patent applications from the German Patent
Office (which is collecting information related to the source of genetic resources and therefore
acting as an additional checkpoint),
Submission of check point communiqués to the ABS CH and CNAs of provider countries,
Cooperation with CNAs of provider countries,
Collection of ABS-relevant information from users of genetic resources/associated traditional
knowledge based on periodically reviewed and risk-based control plans as well as on the basis
of substantiated concerns,
Receipt and examination of requests for inclusion in the EU register of collections and regular
verification that registration criteria are met.
II. Relevant voluntary codes of conduct, guidelines and best practices and/or standards and
community protocols on access and benefit-sharing specifically addressing genetic
resources for food and agriculture
Through Article 8 of the Regulation (EU) 511/2014 (EU ABS Regulation) German user associations
and other interested parties are encouraged and incentivized to develop ABS best practices as foreseen
under Article 20(1) of the NP. These may include amongst others model contractual clauses as
foreseen under Article 19(1) of the NP. There is a lot of ongoing work from several user groups in this
field.
On European Level, Germany is involved in the ABS activities of the European Regional Focal Point
for Animal Genetic Resources (ERFP), such as the establishment of a European Genebank Network
for AnGR (EUGENA) and the development of a standardized Material Acquisition Agreement and a
standardized Material Transfer Agreement.
GUATEMALA
Tengo el agrado de dirigìrme usted, en referencia a su solicitud información requerida por intermedio
del Ministerio de Relaciones Exteriores, segun oficio DIPOM/SUBONU/No.140-001, acerca de las
pràcticas de utilización e intercambio, códigos de conducta voluntarios pertinentes, directrices y
mejores pràcticas y normas o protocolos comunitarios sobre acceso y distribución de beneficios,
especlficamente referidos a los recursos genéticos para la alimentación y la agricultura.
Sobre el particular, me permito remitirle la Providencia DSA-VISAR 01/01-12- 2016 de la Dirección
de Sanidad Animai y el oficio DFRN-00-R-002-11-12-2016 de la Dìrección de Fitozoogenética y
Recursos Nativos, mediante los cuales se manifiestan en cuanto al tema antes mencionado.

JORDAN
Referring to the formal letter of the Minister of Agriculture of Jordan No. 429/1/30300 date of
18/10/2016 regarding inviting members of the states who ratified the international treaty to provide
information on use and voluntary practicing the protocols of communities for access and benefit-
sharing related to genetic resources for food and agriculture (PGRFA), I kindly inform you that Jordan
has signed the international Treaty Convention on PGRFA and implements Article (12) in the area of
facilitating access PGRFA under a multilateral system the exchange by means of Standard Material
Transfer Agreement (SMTA) included in Annex (1). With respect to crops outside the Annex (1) to be
contracted within a bilateral agreement between the related countries (Bilateral system).
Regarding the regulations or policies on the implementation of the above mentioned conventions,
Jordan is progressing toward adoption of a set of regulations in the near future through the national
committee for Plant genetic Resources for Food and Agriculture , regulations under progress
Regarding previous and current collaboration between Jordan represented by the National Center for
Agricultural Research and Extension, I here enlist two examples:
- National Center for Agriculture Research And Extension (NCARE) , KEW ABS:
Access and benefit sharing agreement between NCARE and RBG/Kew, UK, it is in
effect until 2021, includes collaborative collection of seeds and herbarium specimens,
conservation and capacity building of the staff, this includes all wild flora.
- NCARE, CGN: Memorandum of Understanding between NCARE and Center of
Genetic Resources/ the Netherlands, this includes conservation and utilization of crop
wild relatives native to Jordan occurring in wild, this imply commitment of the CGN
in capacity building of NCARE staff, collaborative exploration and sampling,
monetary benefits goes to a bank account allocated to support various conservation
approaches on the levels of the institute (NCARE) and farmers as custodians of
biodiversity.
MADAGASCAR
Suite à votre correspondance sus référencée, j’ai l’honneur de vous communiquer les informations sur
les usages en matière d’utilisation et d’échange, les directives et codes de conduite d’application
volontaire et les pratiques optimales ainsi que sur les normes et protocoles communautaires relatifs à
l’accès et au partage des avantages concernant particulièrement les Ressources Génétiques pour
l’Alimentation et l’Agriculture.
Contexte
D'une manière générale, les pratiques en matière d'accès et de partage des avantages (APA) sur les
ressources génétiques pour l’alimentation et l’agriculture sont conformes aux obligations stipulées dans
les différentes dispositions des instruments juridiques internationaux ratifiés par Madagascar à savoir :
- La Convention sur la Diversité Biologique (CDB) en 1995
- Le Traité International sur les Ressources Phytogénétiques pour l’Alimentation et l’Agriculture
(TIRPAA), ratifié en mars 2006
- le Protocole de Nagoya sur l’Accès aux Ressources génétiques et le Partage juste et équitable des
Avantages (APA) découlant de leur utilisation, ratifié en juillet 2014.
1. TIRPAA
- La demande d’accès aux Ressources Phytogénétiques pour l’Alimentation et l’Agriculture
(RPGAA) de l’Annexe 1, couvertes par le Système multilatéral (SML) est à adresser aux détenteurs

des RPGAA mentionnés dans la notification d’insertion des RPGAA dans le SML suivant le lien :

- Utilisation systématique de l’Accord de type de Transfert de Matériel (ATTM) du TIRPAA
- Un projet d’Arrêté portant sur les mesures/procédures intérimaires de demande d’accès aux
RPGAA et de partage des avantages dans le cadre du Système Multilatéral du TIRPAA est en
cours de validation.
2. CDB/ Protocole de Nagoya/APA
- L’accès aux RPGAA hors Annexe 1 est régi par la CDB et le Protocole de Nagoya.
- Bien qu’étant partie contractante, Madagascar ne dispose pas encore de mécanisme pour mettre en
œuvre ces deux accords internationaux. Madagascar ne dispose pas non plus de feuille de route, ni
de cadre juridique précis définissant les droits du pays, particulièrement ceux des communautés
locales « gardiens/détenteurs de la biodiversité » et ceux qui détiennent les connaissances
traditionnelles rattachées à ces ressources.
- Il en est ainsi notamment des conditions spécifiques de la collecte et de l’exploitation des ressources
biologiques, ainsi que du partage des bénéfices/avantages qui en découlent, tels que définis par le
Protocole de Nagoya. Actuellement, l’accès à ces ressources se base essentiellement sur des contrats
de bio prospection (au cas par cas)
3. Dans le cadre du projet : « Mise en œuvre mutuellement soutenue du Protocole de Nagoya
et du TIRPAA » conçu par Bioversity International et conjointement mis en œuvre par
SAGE/MEEF et SECC/MPAE (2015-2018)
- L’objectif du projet consiste à aider Madagascar à assurer la mise en œuvre synergique et efficace
de ces deux accords de sorte qu’un certain nombre des partenaires puissent signer des accords

3.1- Les produits/ réalisations du projet
3.1.1- Le livre blanc
- Pour le Protocole de Nagoya/APA, ce livre blanc met en exergue les normes de base APA selon la
Lettre de politique nationale sur l’APA, validée par le gouvernement malgache en 2012. Cette Lettre
définit les orientations et les stratégies de la mise en œuvre de l’APA à Madagascar
Les directives élaborées dans les 18 mois concernent les renforcements de capacités des acteurs
clés, les analyses des meilleures pratiques d’utilisation et de la valorisation des ressources. Un
des grands points parmi les activités priorisées est la mise en place du cadre juridique APA. Un
projet de décret pour les mesures transitoires, en cours de validation auprès du gouvernement a
été élaboré par un juriste national, financé par le GIZ/PAGE avec l’appui d’un consultant
international de l’Initiative APA.
Les directives à élaborer pour les prochains 18 mois sont axés sur la présentation de ce projet
de décret au gouvernement suivie de l’élaboration de texte d’application y afférents ainsi que
l’élaboration d’une loi spécifique APA durant l’année 2017.
- Concernant la partie du livre blanc sur le TIRPAA, les points suivants sont à retenir:
L’élaboration de l’Arrêté des mesures transitoires en 2016 et le projet de loi sur les RPGAA en
2017. La formulation des différentes dispositions de l’Arrêté a été basée sur les suggestions et
recommandations des parties prenantes recueillies lors des ateliers de consultation et de
sensibilisation.

Le projet d’arrêté comporte essentiellement des dispositions concernant les conditions et
procédures d’accès aux RPGAA au sein du Système multilatéral.
En ce qui concerne particulièrement les procédures d’accès aux RPGAA au sein du Système
multilatéral, tout demandeur doit remplir un formulaire disponible auprès du site web du
Ministère en charge de l’Agriculture, ou auprès du Point Focal National du TIRPAA.
3.1.2- Protocole bio culturel (PBC)/Protocole Communautaire
- Les mécanismes appropriés reposant sur le registre de la biodiversité et protocole communautaire
ont été initiés aux communautés et sont en cours de réalisation. Des renforcements de capacités
s’imposent afin de mettre en place ces mécanismes et d'en comprendre les tenants et aboutissants
de ces instruments, puisque pour les communautés, il n'y a jamais eu d'échanges par ce type
d'instruments, mais il s'agissait de ventes de semences entre elles ou vente directe au marché
depuis longtemps.
- Le sujet sur les PBC étant plus ou moins nouveau, un consultant national a été mandaté par le
Natural Justice pour appuyer Madagascar dans la réalisation de cette activité. Les droits des
agriculteurs stipulés dans l’Art 9 du Traité pourraient être appliqués suivant des PBC
3.1.3- Organigramme : L’organigramme présenté ci-dessous est la fusion des mécanismes d’APA
dans le cadre de l’APA/PN et du SML/TIRPAA, proposé dans le cadre du projet PN/APA/TIRPAA

MEXICO
En atención a la invitación de la Comisión de Recursos Genéticos para la Alimentación y la
Agricultura de la FAO para presentar información sobre las prácticas de utilización e intercambio, los
códigos de conducta voluntarios, las directrices y mejores prácticas y las normas o los protocolos
comunitarios sobre acceso y distribución de beneficios específicamente referidos a los recursos
genéticos para la alimentación y la agricultura, en base a los elementos ADB.
Al respecto el Servicio Nacional de Inspección y Certificación de Semillas, Órgano Desconcentrado
de la Secretaria de Agricultura, Ganadería, Desarrollo Rural, Pesca y Alimentación, con base en el
Artículo 102 de la Ley de Desarrollo Rural Sustentable tiene entre sus atribuciones establecer y en su
caso proponer, conjuntamente con las demás dependencias e instituciones vinculadas, políticas,
acciones y acuerdos sobre conservación, acceso, uso y manejo integral de los recursos fitogenéticos,
además de ser la Autoridad Nacional Competente en RFAA. Para lo cual se han generado los
siguientes documentos, mismos que se adjuntan:
1. PUBLICACIÓN DE UN COMPENDIO DE CUATRO PUBLICACIONES CON LA LÍNEA
BASE CONFORME AL SEGUNDO PLAN DE ACCIÓN MUNDIAL PARA LOS RFAA
DE LA FAO, QUE SERVIRÁN PARA FACILITAR EL ACCESO Y TRANSFERENCIA
DE LOS RFAA.

Conservación y aprovechamiento sostenible de especies ornamentals nativas de
México
Conservación y aprovechamiento sostenible de frutales nativos de México
Conservación y utilización sostenible de las Hortalizas Nativas de México
2. PROPUESTA DE PROTOCOLO TRANSITORIO DE ACTUACIÓN INTERNO PARA
DAR ATENCIÓN A LAS SOLICITUDES DE ACCESO DE RFAA, EN TANTO ENTRA
EN VIGOR EL INSTRUMENTO JURÍDICO CORRESPONDIENTE:
PROTOCOLO DE ACTUACIÓN INTERNO PARA DAR ATENCION A LAS
SOLICITUDES DE ACCESO DE RECURSOS FITOGÉNETICOS
El presente documento es un instrumento que establece los pasos a seguir por parte de la Secretaria de
Agricultura Ganadería Desarrollo Rural Pesca y Alimentación SAGARPA) y el Servicio Nacional de
Inspección y Certificación de Semillas para atender las solicitud de acceso de materiales de recursos
fitogénicos, esto como medida transitoria en tanto se aprueba la Ley de la materia que atienda las
disposiciones del Protocolo de Nagoya sobre Acceso a los Recursos Genéticos y Participación Justa y
Equitativa en los Beneficios que se Deriven de su Utilización. Se aplicara a las solicitudes de acceso
de recursos fitogenéticos en condiciones in situ y ex situ.
FUNDAMENTO
Los principios estipulados en la Constitución Política de los Estados Unidos Mexicanos, establecen
que ”El estado promoverá las condiciones para el desarrollo rural integral, con el propósito de generar
empleo y garantizar a la población campesina el bienestar y su participación e incorporación en el
desarrollo nacional, y fomentará la actividad agropecuaria y forestal para el óptimo uso de la tierra,
con obras de infraestructura, insumos, créditos, servicios de capacitación y asistencia técnica…”
La Ley de Desarrollo Rural Sustentable, Artículo 102, Fracción I señala: que “el Servicio Nacional
de Inspección y Certificación de Semillas (SNICS) es el responsable de establecer y en su caso
proponer, conjuntamente con las demás dependencias e instituciones vinculadas, políticas, acciones y
acuerdos internacionales sobre conservación, acceso, uso y manejo integral de los recursos
fitogenéticos, derechos de protección de los obtentores y análisis de calidad de semillas. En virtud de

lo anterior el SNICS en calidad de instancia facultativa para coordinar acciones en torno a los Recursos
Fitogenéticos para la Alimentación y la Agricultura (RFAA).
La Ley Federal de Producción, Certificación y Comercio de Semillas, Artículo 5, Fracción V estipula:
“Establecer y ejecutar programas, acciones y acuerdos sobre análisis, conservación, calificación,
certificación, fomento, abasto, comercio y uso de semillas, procurando la participación y colaboración
de las dependencias e instituciones vinculadas”.
El Reglamento Interior de la SAGARPA, establece en su Artículo 53, Fracción II establece que el
Servicio Nacional de Inspección y Certificación de Semillas tendrá como atribución; “Proponer
conjuntamente con las demás dependencias e instituciones vinculadas, las políticas, acciones y
acuerdos sobre conservación, acceso, uso y manejo integral de los recursos fitogenéticos para la
alimentación y la agricultura, protección de los derechos de los obtentores, análisis, conservación,
calificación, certificación, fomento, abasto, comercio y uso de semillas”.
TÉRMINOS UTILIZADOS
Para efectos del presente se entenderá por:
Acceso: Es la obtención y utilización de los recursos fitogenéticos conservados en condiciones ex situ
e in situ, de sus derivados o de ser el caso, de los conocimientos tradicionales asociados a ellos.
Accesión: Material de origen vegetal que representa la diversidad genética de una población o línea
resguardada en un Centro de Conservación o programa de fitomejoramiento para su conservación y
uso;
Banco de Germoplasma, Colección de largo plazo, Colección Activa o Colección de Trabajo: se
refiere a espacios físicos que resguardan recursos fitogenéticos en condiciones ex situ.
Convenio de acceso a los recursos fitogenéticos: es el instrumento legal que suscribe el proveedores
y el usuarios, para conceder el acceso a los recursos fitogenéticos, sus derivados o el conocimiento
tradicional asociado a ellos.
Conocimiento Tradicional Asociado a los recursos fitogenéticos: Conocimientos dinámicos y en
constante evolución que se crean en un contexto tradicional, se preservan colectivamente y se
transmiten de generación en generación, que incluyen entre otros, los conocimientos especializados,
capacidades, innovación, prácticas y enseñanzas que perviven en relación con la utilización de los
recursos fitogenéticos;
Acceso ex situ: el usuario obtiene los recursos fitogenéticos de bancos de germoplasma, colecciones
vivas, jardines botánicos, entre otros.
Acceso in situ: el usuario obtiene los recursos de los hábitats naturales, el mantenimiento y
recuperación de poblaciones viables de especies en sus entornos naturales y, en el caso de las especies
domesticadas y cultivadas, en los entornos en que hayan desarrollado sus propiedades específicas o
bancos comunitarios.
Producto Derivado: Molécula, combinación o mezcla de moléculas naturales, incluyendo extractos
crudos de organismos vivos o muertos de origen biológico, provenientes del metabolismo de seres
vivos. Beneficio obtenido de una innovación o práctica individual o colectiva, con valor real o
potencial, asociado al Recurso fitogenético.
Proveedor: Persona y/o instancia que proporciona el Recurso Fitogénetico, sus productos derivados
y/o Conocimiento Tradicional Asociado.
Recursos Fitogenéticos se definen como el material genético de origen vegetal que tiene un valor real
o potencial, estos recursos han sido conservados y desarrollados por los agricultores de forma
tradicional y son la base para desarrollar nuevas variedades y tecnologías.
Usuario: Persona que solicita y recibe el Recurso Fitogénetico, sus productos derivados y/o
Conocimiento Tradicional Asociado.

Utilización de los Recursos Fitogenéticos y sus derivados: La realización de actividades de
investigación y desarrollo sobre la composición genética y/o composición bioquímica de los recursos
fitogenéticos, incluyendo mediante la aplicación de biotecnología;
SAGARPA: La Secretaría de Agricultura, Ganadería, Desarrollo Rural, Pesca y Alimentación;
SNICS: El Servicio Nacional de Inspección y Certificación de Semillas: Órgano Administrativo
desconcentrado de la SAGARPA.
OBJETO DEL PROTOCOLO
El presente Protocolo de actuación interno tiene por objeto establecer los pasos internos que deberá
atender la SAGARPA y SNICS para dar atención a las solicitudes de acceso a los recursos
fitogenéticos, en condiciones in situ y ex situ, incluyendo sus productos derivados y/o conocimiento
tradicional asociado.
LAS PARTES QUE INTERVIENEN EN EL PROCESO.
La Secretaria de Medio Ambiente y Recursos Naturales como punto Focal Nacional ante el
Protocolo de Nagoya a quien acude el interesado e ingresa la solicitud.
La Secretaría de Agricultura, Ganadería, Desarrollo Rural, Pesca y Alimentación (SAGARPA)
como Autoridad encargada de atender formular, conducir y evaluar la política general de desarrollo
rural.
El Servicio Nacional de Inspección y Certificación de Semillas (SNICS), como autoridad nacional
competente y agente técnico para el análisis de solicitudes de acceso al recurso fitogenético que le
atribuye el artículo 102 de la Ley de Desarrollo Rural Sustentable.
Proveedor del recurso fitogenético, es la persona y/o instancia que dispone del recurso fitogenético,
sus derivados y/o conocimiento tradicional asociado para proveer al usuario, se puede considerar dentro
de esta categoría a las personas físicas o morales.
Usuario del recurso fitogenético, es la personas física o moral que solicita el acceso a los recursos
fitogenéticos, los productos derivados o el conocimiento tradicional asociado al recurso, para su
utilización.
PASOS A SEGUIR.
Los pasos a seguir en el presente protocolo de actuación interno para el acceso a los recursos
fitogenéticos, atenderá conforme a lo siguiente:
I. Solicitud
Paso 1: El interesado acude a la SEMARNAT como punto focal del protocolo de Nagoya, con la
solicitud que tiene los requisitos mínimos señalados en el Anexo I.
Paso 2: SEMARNAT, recibe la solicitud de acceso a recursos genéticos y remite al SNICS junto con el
expediente para dar conocimiento y trámite.
II. Evaluación
Paso 3: El SNICS realizará un examen preliminar de la solicitud de acceso, tanto jurídico como
técnicamente.
Paso 4: El SNICS convoca a grupo de trabajo a la OAG, a la Subsecretaria de Agricultura, SENASICA,
El Proveedor y cualquier otra dependencia o instancia que pudiese tener relación con el acceso.
Paso 5: Derivado de la reunión del grupo de trabajo señalada en el paso anterior, se determinará si se
requiere que el usuario aclare o presente documentación complementaria, en caso de requerirlo, se le
notificará para los efectos de que en el término de no mayor a 30 dias de contestación o presente lo
solicitado.

Paso 6.- Con todos los elementos que se tengan el SNICS emitirá una opinión preliminar la cual se
someterá a revisión y validación de la OAG quien emitirá las recomendaciones necesarias o en su caso
validara lo correspondiente y remitirá al SNICS.
III. Emisión de Constancia
Paso 7: Una vez completado el expediente y los dictámenes a que haya lugar, el SNICS emitirá su
opinión final (constancia de acceso) y notificara al Usuario y a la SEMARNAT tal situación. Para el
caso del usuario la SAGARPA a través del SNICS propondrá los contratos o convenios según sea el
caso a suscribir entre el usuario y el proveedor, señalándole la necesidad de información al SNICS los
alcances y resultados derivados del acceso.
Paso 7: El SNICS informara al proveedor del recurso genético para efectos de hacerse saber que la
solicitud de accesos se realizó conforme a la normatividad existente así como informarle de los derechos
que se podrían obtener en caso de que dicho acceso resultare en un producto o aplicación
comercializable, por lo que el dará los modelos de contratos/convenios que se han generado para efectos
del PIC-MAT.
Paso 8: En caso de que tanto el poseedor como el usuario llegaren a un acuerdo por escrito relaciodo
con el cambio de intención, deberán acercarse a la Sagarpa a través del SNICS para efectos de retira una
copia del contrato/convenio que se haya celebrado con motivo del cambio de intención.
IV. Cambio de intención
Paso 11: En caso de que las investigaciones si deriven en un producto o aplicación comercializable se
debe de firmar un ABS, las partes deberán acercarse al SNICS para hacer el aviso del cambio de
intención para que ésta a su vez les otorgue el modelo de contrato.
Paso 12: Si lo celebran, deberán dar aviso al SNICS, proporcionando una copia del mismo para que
sea analizado y en su caso se emita una constancia de presentación del ABS y sería en fin del Proceso
para la Sagarpa.
V. Seguimiento
Paso 10. El SNICS dará seguimiento del acceso para lo cual el usuario entregar informe al 50% de
avance y el informe final del proyecto de acceso.
Paso A: En caso de que el interesado en los recursos llegare a solicitar ante el SNICs el otorgamiento
de la constancia de cumplimiento para efectos de tramitar ante el Punto Focal, el certificado de
cumplimiento reconocido internacionalmente, se recibirá la solicitud se analizará preliminarmente y se
mandará a pedir la opinión y visto bueno tanto de la OAG y ésta a su vez a las demás áreas que hayan
participado en el dictamen previo.
Paso B: Una vez reunida la opinión de los participantes, la OAG remitirá expediente con el Visto bueno
y los antecedentes a la SEMARNAT para los efectos legales a que haya lugar.
ANEXO UNICO.
Elementos que deben contener las solicitudes de acceso en condiciones in situ y condiciones
ex situ de recursos fitogenéticos.
Para iniciar con el proceso de solicitud de acceso al recurso fitogenético se debe presentar una
solicitud escrita donde se deben especificar los siguientes datos:
I. Nombre, denominación o razón social del solicitante y en su caso nombre del representante
legal.
II. Domicilio para oír y recibir notificaciones, así como el nombre de la persona o personas
autorizadas para recibirlas.
III. Si es nacional o internacional
IV. Modalidad de la actividad que involucre acceso al recurso fitogenético solicitado, sus

productos derivados o conocimiento tradicional y la justificación de la solicitud de
acceso.
V. Tipo de conservación en la que se encuentra el recurso fitogenético solicitado (in situ o
ex situ)
VI. Indicar si el recurso fitogenético está disponible antes o después de la implementación del
protocolo de Nagoya en México, bajo condiciones ex situ.
VII. Indicar la Autoridad competente a la que se dirige la solicitud
VIII. Lugar y fecha
IX. Firma del solicitante o representante legal.
Requisitos que se deben adjuntar a la solicitud de acceso a recursos fitogenéticos.
I. Documentos oficiales que acrediten la personalidad del solicitante (Identificación oficial,
RFC, acta constitutiva, según proceda).
II. Proyecto que contiene como mínimo: introducción del proyecto, justificación objetivos
generales y específicos, hipótesis, materiales y método, instancias participantes,
resultados esperados, cronograma de trabajo, literatura citada. Dentro del cuerpo del
proyecto se deberá especificar: datos precisos del proveedor, datos generales de la
colección o del lugar de donde se obtendrá el recurso fitogenético; en el caso de
productos derivados indicar el nombre reconocido científicamente; en el caso del
conocimiento tradicional asociado nombre o forma de obtenerlo; número y/o volumen
de muestras que se pretende obtener; periodo durante el cual se pretende llevar a cabo el
acceso
III. El consentimiento fundamentado previo de los proveedores de los materiales.
3. PROPUESTA DEL MODELO DE CONVENIO PARA EL ACCESO A RECURSOS
FITOGENÉTICOS.
CONVENIO PARA EL ACCESO A RECURSOS FITOGENÉTICOS SUJETO A
CONDICIÓN SUSPENSIVA, QUE CELEBRAN POR UNA PARTE, (señalar a la persona que
intenta acceder), REPRESENTADA LEGALMENTE EN ESTE ACTO POR (señalar al
representante en caso de persona moral o persona física), EN LO SUCESIVO DENOMINADO EL
“USUARIO”, Y EL (señalar al propietario) EN SU CALIDAD DE POSEEDOR DE LOS
RECURSOS FITOGENÉTICOS, EN LO SUCESIVO DENOMINADO COMO EL
“PROVEEDOR” Y A QUIENES DE MANERA CONJUNTA SERÁN REFERIDOS COMO “LAS
PARTES”, AL TENOR DE LOS SIGUIENTES:
ANTECEDENTES:
1. Con fecha 13 de junio de 1992, los Estados Unidos Mexicanos, a través de su entonces
Plenipotenciario suscribió el Convenio sobre la Diversidad Biológica, publicado mediante
Decreto Promulgatorio en el Diario Oficial de la Federación el 07 de mayo de 1993.
2. Con fecha 24 de febrero de 2011, los Estados Unidos Mexicanos, a través de su entonces
Plenipotenciario suscribió el Protocolo de Nagoya sobre Accesos a los Recursos Genéticos y
Participación Justa y Equitativa en los Beneficios que se Deriven de su Utilización al Convenio
sobre la Diversidad Biológica, publicado mediante Decreto Promulgatorio en el Diario Oficial
de la Federación el 10 de octubre de 2014, en lo sucesivo el “PROTOCOLO”.
3. Con fecha 12 de enero de 2012 se PUBLICO EN EL Diario Oficial de la Federación la nueva
Ley de Desarrollo Rural Sustentable, señalando en su Artículo 102, Fracción I que “el Servicio
Nacional de Inspección y Certificación de Semillas tendrá como objetivos el el “establecer y en
su caso proponer, conjuntamente con las demás dependencias e instituciones vinculadas,
políticas, acciones y acuerdos internacionales sobre conservación, acceso, uso y manejo integral
de los recursos fitogenéticos, derechos de protección de los obtentores y análisis de calidad de

semillas”.
4. Con fecha 24 de abril de 2012, se publico en el Diario Oficial de la Federación El Reglamento
Interior de la SAGARPA, el cual establece en su Artículo 53 , Fracción II establece que el
Servicio Nacional de Inpeccion y Certificacion de Semillas tendrá como atribución; “Proponer
conjuntamente con las demás dependencias e instituciones vinculadas, las políticas, acciones y
acuerdos sobre conservación, acceso, uso y manejo integral de los recursos
fitogenéticos para la alimentación y la agricultura, protección de los derechos de los obtentores,
análisis, conservación, calificación, certificación, fomento, abasto, comercio y uso de semillas.
. Con fecha (señalar fecha) del presente año, el “USUARIO” presentó ante la Secretaria de
Medio Ambiente y Recurtsos Naturales en lo sucesivo la “SEMARNAT” como Dependencia
señalada cono punto focal del protocolo de Nagoya, su intención para realizar el acceso a los
recursos fitogeneticos de (Señalar el o los recursos fitogenéticos) en lo sucesivo los
“RECURSOS” con fines de (señalar fines si es investigación básica o investigación avanzada
con posterior fines de comercialización) en este sentido la SEMARNAT remitio a la Secretaría
de Agricultura, Ganadería, Desarrollo Rural Pesca y Alimentación (en lo sucesivo, la
“SAGARPA”) a través del Servicio Nacional de Inspección y Certificación de Semillas, en lo
sucesivo el “SNICSsu intención.
4. La “SAGARPA” a través del SNICS con fecha (señalar fecha) del presente año, emitió un
oficio por medio del cual se da por enterado de las intenciones y de las actividades e investigación a
desarrollar por parte del “USUARIO” a los “RECURSOS”.
DECLARACIONES
I.- Declara el “PROVEEDOR”:
1. Que es una persona (señalar física o moral), de nacionalidad (referir su nacionalidad), lo que
acredita con (identificación oficial tales, como credencial para votar expedida por el
Instituto Nacional Electoral, Cartilla Militar, Cedula Profesional, etc. Si es persona moral
el resgitro de legal constitución), número (número de folio de la identificación), expedida
por el (nombre de la institución de gobierno que la expidió), y que tiene plena capacidad
jurídica para contratar, manifestando que es (señalar su calidad el propietario, poseedor o
resguardante) de los “RECURSOS”.
2. Que dentro del núcleo de (señalar ubicación de los RECURSOS) lugar donde se realizará la
colecta de los “RECURSOS” en lo sucesivo “EL PREDIO” (condiciones in situ) o
ubicación del Banco de Germoplasma (condiciones ex situ).
3. Que su domicilio para efectos del presente contrato es el ubicado en (señalar domicilio)
II. Declara el “USUARIO”:
1. Que es una persona (señalar física o moral), constituida de conformidad con las Leyes de
(señalar país), según consta en el documento público número (núm. documento), de fecha
(día, mes y año), otorgada ante la fe del Notario Público número (número de Notario) de
(ciudad), Lic. (nombre del Notario), misma que se encuentra inscrita en el Registro Público
de la Propiedad y del Comercio bajo el número de folio mercantil (número de folio mercantil
o bien señalar apostilla), teniendo plena capacidad y recursos técnicos, materiales y jurídicos
suficientes para obligarse en los términos de éste contrato. (Tratándose de persona moral)
2. Que (señalar en caso de que sea persona moral su objeto social o persona física señalar su
actividad) es la realización de cualquier acto o actividad lícita para la cual puedan
constituirse sociedades conforme a la (Señalar los ordenamientos legales a que haya lugar).
3. Que dentro de sus proyectos, se encuentra el denominado (indicar el Título del proyecto a
investigar), que considera las especies (indicar el nombre común y nombre científico) (cuando
aplique”) y que se localizan en áreas en “EL PREDIO” (Dirección y coordenadas
geográficos o ubicación del Banco de Germoplasma). Proyecto que se adjunta al presente
como ANEXO 2.

4. Que el C. (nombre del representante y cargo que tiene en la persona moral o fisica), cuenta
con señalar (poderes amplios o facultades suficientes para suscribir el presente contrato,
representando legalmente a (señalar la empresa de ser el caso de persona moral), personalidad
que acredita con el testimonio de la Escritura Pública (número de escritura), de (fecha de
protocolo), otorgada ante la fe del Lic. (nombre del notario), Notario Público (número del
notario), de la Ciudad de (Ciudad y/o Entidad Federativa), manifestando bajo protesta de
decir verdad, que las facultades que le han sido otorgadas, a la fecha no le han sido
modificadas, revocadas, canceladas ni limitadas en forma alguna. (Tratándose de persona
moral)
5. Que señala como su domicilio para oír y recibir todo tipo de notificaciones y todo lo
relacionado con el presente contrato en (indicar el domicilio: Calle, número, Colonia,
Delegación y/o Municipio, Código Postal y Entidad Federativa)
6. Que se identifica con credencial de elector o copia de pasaporte con número de folio (señalar
número de folio) expedido por el (señalar autoridad emisora).
7. Que tiene capacidad jurídica y no se encuentra imposibilitado para suscribir el presente
contrato.,.
III. Declaran las “PARTES”:
III.1. Por mutuo acuerdo se comprometen a cumplir con las opiniones de las autoridades
competentes en la materia, entre ellas la Secretaría de Agricultura, Ganadería, Desarrollo
Rural, Pesca y Alimentación (en lo sucesivo, “SAGARPA”) a través del “SNICS” e informar
del seguimiento de acceso obtenido y de sus resultados.
III.2. Que garantizan a la otra parte que tienen la intención y la libre voluntad para celebrar el
presente Contrato, y que no existe vicio, dolo o mala fe, que afecte la existencia y validez de
los acuerdos tomados en el presente Acuerdo.
C L Á U S U L A S
PRIMERA. OBJETO.- El presente contrato tiene por objeto establecer las bases para el acceso a
recursos fitogeneticos través del cual el “PROVEEDOR” otorgará en favor del “USUARIO” los
“RECURSOS” que se encuetran ubicados en (señalar predio o en adelante el “PREDIO” o Banco
de Germoplasma) donde se encuentran ubicados los “RECURSOS”, cuyos datos de pasaporte, así
como cantidades de las muestras se detallan en el ANEXO 1 con la finalidad de acceder a la toma de
muestras necesarias para efectos de realizar (indicar el Título del proyecto a investigar), misma que
tiene el carácter meramente de investigación científica y que tiene el objeto principal para (Señalar o
enumerar los componentes u objetivos del Proyecto)
SEGUNDA.- CARÁCTER DE LA INVESTIGACIÓN. El “USUARIO” manifiesta
que únicamente empleará los “RECURSOS” con el fin específico de desarrollar estudios e
investigaciones científicas básicas, conforme lo establecido en el Anexo 2, y se obliga a no
comercializar o beneficiarse de forma alguna de los resultados que deriven de dichas investigaciones,
salvo lo establecido en el párrafo siguiente.
En caso de que “EL USUARIO” requiera un cambio de intención, es decir, que las investigaciones
no sólo tengan como finalidad generar conocimiento, sino que, derivado de su estudio y análisis
científico, pueda recaer en un uso y goce comercial, de un producto o de un servicio con fines
comerciales o de lucro o bien, conlleve a un beneficio, dicho cambio deberá notificarse al
“PROVEEDOR” y se firmara el instrumento jurídico de cambio de intención y se dará aviso a
la “SAGARPA” a través del “SNICS”. Lo anterior tomándose como condición suspensiva por lo
que, de acuerdo a lo anterior “EL USUARIO” firmará con el “PROVEEDOR” el instrumento
jurídico que tenga como finalidad el establecer la distribución justa y equitativa de los beneficios,
conforme a lo estipulado en el Anexo del “Protocolo”.

En caso de que se requiera una modificación al “PROYECTO” y sus líneas de investigación, “EL
USUARIO” notificará por escrito al “PROVEEDOR” y suscribirá el instrumento jurídico de
cambio de intención correspondiente y darán aviso a la “SAGARPA” a través del “SNICS”.
TERCERA. PARTICIPACIÓN DE TERCEROS. “EL USUARIO” podrá celebrar los
instrumentos jurídicos con terceros, que sean necesarios para el desarrollo de las investigaciones
amparadas por este Contrato únicamente para las actividades establecidas en el “PROYECTO”,
previa notificación al “PROVEEDOR”, previo aviso a la “SAGARPA” a través del “SNICS” para
lo cual “EL USUARIO” se asegurará de que en dichos contratos con terceros, éstos se celebren con
cláusulas de confidencialidad estrictas, que limiten el libre uso de los “RECURSOS”, de lo contrario
será responsable de las consecuencias legales a que haya lugar frente al “PROVEEDOR” dando
aviso a la “SAGARPA” a través del “SNICS”. En los instrumentos jurídicos que “EL USUARIO”
celebre con los terceros participantes en el “PROYECTO”, se deberá garantizar la utilización de los
“RECURSOS” por parte de los terceros para los fines exclusivos del mismo, así como la restricción
de la transferencia a partes ajenas al “PROYECTO” y a “EL USUARIO”.
CUARTA. DEPÓSITO. En el caso de acceso in situ “EL USUARIO” se obliga a realizar un
depósito de las muestras recolectadas de los RECURSOS” ya sea en el Centro Nacional de Recursos
Genéticos y/o en los Centros de Conservación que le indique por escrito la “SAGARPA” a través
del “SNICS” para su resguardo, cumpliendo “EL USUARIO” las disposiciones que dicho Servicio
le sugiera para la consecución de dicho fin. La entrega de las muestras se deberá realizar dentro de
los 20 días hábiles contados a partir a de la última recolecta de las muestras descritas en el ANEXO
1.
QUINTA. USO DE LAS TIERRAS. (Esta cláusula será aplicable únicamente para el caso de acceso
in situ) Este Contrato no otorga al “USUARIO” ningún derecho, salvo el de acceder a los
“RECURSOS” por lo que no podrá hacer uso, goce o disfrute de forma alguna del “PREDIO”.
SEXTA. DE LA CONFIDENCIALIDAD. “LAS PARTES” acuerdan que durante el desarrollo del
presente Contrato podrán compartir “Información Confidencial” misma que deberá ser identificada
como tal, para lo cual se empleará el término “Confidencial”. Asimismo, “LAS PARTES” se
comprometen a tomar todas las medidas que sean necesarias para preservar la secrecía respecto de
cualquier información relacionada y mantener restringido el acceso a la misma.
“LAS PARTES” se comprometen a mantener la secrecía respecto a las actividades materia de este
Contrato, hasta dos años después del término de la vigencia del mismo.
SÉPTIMA. INFORMES.- “El USUARIO” debe garantizar al “PROVEEDOR” y dar aviso a la
“SAGARPA” a través del “SNICS”, el acceso a la información resultante de la investigación
amparada por este Contrato y sus anexos. Para tal efecto presentará un informe al avance del 50% y
el informe final del proyecto de cada una de las líneas de investigación al “PROVEEDOR”, de igual
manera dando aviso la “SAGARPA” a través del “SNICS”, informe que contendrá, entre otros
aspectos:
1.- Cumplimiento de los objetivos propuestos.
2.- Resultados obtenidos.
3.- Cumplimiento del programa inicialmente establecido.
Con la finalización del “PROYECTO”, “EL USUARIO” presentará al “PROVEEDOR” un
informe final con todos los resultados obtenidos y posibles desarrollos científicos y de aplicación
futura, dentro de un plazo que no exceda de seis meses contados a partir de su finalización, además
se remitirá copia de dicho informe a la “SAGARPA” a través del “SNICS”.

OCTAVA. DERECHOS DE PROPIEDAD INTELECTUAL. Los derechos de propiedad
intelectual que pudieran surgir con motivo de las actividades desarrolladas y derivadas del objeto del
presente Contrato, corresponderán a “LAS PARTES” en términos de su participación, formalizando
dicho reconocimiento a través de los instrumentos jurídicos que correspondan, otorgando en todo
momento el reconocimiento moral a las personas que hayan intervenido en la realización o generación
de algún derecho de propiedad intelectual que se encuentre regulado en la Ley Federal del Derecho de
Autor y/o en la Ley de la Propiedad Industrial y la Ley Federal de Variedades Vegetales
“LAS PARTES” acuerdan que podrán utilizar la información o resultado de los trabajos que se
deriven del presente instrumento y que no sea de carácter confidencial, para los fines propios de su
naturaleza académica, de docencia y/o investigación.
Las publicaciones y productos que lleguen a emitirse como resultado de los trabajos conjuntos, se
realizarán de común acuerdo y previa protección legal que proceda, gozando conjuntamente de los
reconocimientos que por este concepto se generen.
Asimismo, “LAS PARTES” acuerdan que las actividades relacionadas con las estrategias de
protección de la propiedad intelectual, la designación de los encargados de realizar las gestiones de
la protección ante las oficinas de la propiedad intelectual, el pago de los costos de la protección y las
fechas en las que se decida iniciar el proceso de dicha protección, serán realizados por mutuo acuerdo
y determinados en el instrumento jurídico correspondiente.
NOVENA. DIVULGACIÓN DE RESULTADOS.- “LAS PARTES” convienen que cualquiera
de ellas podrá publicar los resultados en sus labores académicas o de investigación o de las actividades
motivo del presente Contrato, dando el debido reconocimiento a los autores, previa autorización por
escrito de la otra parte.
Para ello someterá el manuscrito con treinta días de anterioridad a la fecha en que pretenda publicar.
Si pasado ese tiempo no tuviera respuesta de la otra parte, se entenderá que aquélla ha dado su
autorización. Cualquier publicación derivada del estudio de los “RECURSOS” deberá reconocer
expresamente su origen
DÉCIMA. INTERPRETACIONES TÉCNICAS.- En caso de dudas o discrepancias de carácter
técnico entre “LAS PARTES” relativas a la ejecución del “PROYECTO” o bien del presente
contrato podrán solicitar la opinión que corresponda a las autoridades competentes en la materia a
efecto de lograr entre las mismas una solución consensuada.
DÉCIMA PRIMERA. RESTRICCIONES DE USO.- Los “RECURSOS” deberán utilizarse
exclusivamente en los términos del “PROYECTO”, no podrán emplearse como armas biológicas o
en prácticas nocivas al ambiente o a la salud humana, ni para el desarrollo de actividades prohibidas
en cualquier ordenamiento jurídico nacional e internacional.
DÉCIMA SEGUNDA. RESPONSABILIDAD.- “El PROVEEDOR” se reserva el derecho de
ejercer acciones administrativas, civiles y penales en contra de “EL USUARIO” o cualquier tercero a
que hubiere lugar, tanto a nivel nacional como internacional por el uso no autorizado de los
“RECURSOS” sus derivados tangibles e intangibles, conocimiento tradicional asociado y productos
accedidos a través de este Contrato.
DÉCIMA TERCERA. CESIÓN.- Los derechos derivados del presente contrato no podrán ser
cedidos en todo ni en parte a ninguna persona física o moral, nacional o extranjera, salvo previo
consentimiento y por escrito de “El PROVEEDOR”, debiendo notificar a la SAGARPA a través del
SNICS tal Cesion.

DÉCIMA CUARTA. AVISOS.- “LAS PARTES” manifiestan su voluntad para dar aviso y remitir
un tanto en original del presente Contrato y sus Anexos a la “SAGARPA” a través del “SNICS” para
los efectos legales a que haya lugar.
DÉCIMA QUINTA. MODIFICACIONES.- El presente Contrato sólo podrá ser modificado y/o
adicionado mediante la firma del Convenio Modificatorio correspondiente, suscrito por quienes
cuenten con facultades para ello y formarán parte integrante del presente instrumento, debiendo avisar
por escrito a la “SAGARPA” a través del “SNICS” respecto a dichas modificaciones.
DÉCIMA SEXTA. RESCISIÓN.- “LAS PARTES” convienen que será motivo de rescisión del
presente Contrato:
a) El que alguna declaración de este documento sea falsa.
b) El incumplimiento de alguna de las obligaciones consignadas en este instrumento.
c) La imposibilidad material de ejecutar las obligaciones y derechos vertidos en el presente
contrato derivados de caso fortuito o bien de fuerza mayor.
DÉCIMA SÉPTIMA. PROCEDIMIENTO DE RESCISIÓN.- Si alguna de “LAS PARTES”
consideran que la contraparte ha incurrido en algunas de las causas de rescisión que se consignan en
este instrumento, lo comunicará por escrito a la otra, a fin de que la misma, en un plazo de quince días
hábiles, exponga lo que a su derecho convenga. Si después de analizar las razones aducidas, la parte
demandante estima que las mismas no son satisfactorias, podrá optar por exigir elcumplimiento del
Contrato, o bien la rescisión del mismo. En caso de rescisión, las partes tomarán todas las medidas
necesarias para evitarse perjuicios.
DÉCIMA OCTAVA. TERMINACIÓN.- Cualquiera de “LAS PARTES” podrá dar por terminado
el presente instrumento con antelación a su vencimiento mediante aviso por escrito a su contraparte,
notificándola con 15 (quince) días naturales de anticipación siempre y cuando no existan obligaciones
pendientes entre ellas. En tal caso, “LAS PARTES” tomarán las medidas necesarias para evitarse
perjuicios. Adicionalmente deberán dar aviso de la terminación del Contrato al “SNICS”.
DÉCIMA NOVENA. VIGENCIA.- El presente Contrato entrará en vigor a partir de la fecha de su
firma y tendrá una vigencia ( selalra la vigencia acorde a lo estipulado en el proyecto), pudiendo ser
prorrogable por periodos de igual duración, mediante acuerdo por escrito de “LAS PARTES”, con
una anticipación mínima de 10 días hábiles antes de la fecha de terminación, mismo que deberá ser
firmado por los representantes legales de cada una de ellas o por las personas que cuenten con
personalidad jurídica para hacerlo o bien al final se celebrará un nuevo contrato o bien si hay
desarrollo comercial y de beneficios derivados de los estudios de investigación, se deberá firmar el
contrato para establecer los beneficios entre “LAS PARTES”.
VIGÉSIMA. JURISDICCIÓN.- Para la interpretación, ejecución y cumplimiento del presente
Contrato, así como para todo lo no previsto en el mismo, “LAS PARTES” se someten a la
jurisdicción de los Tribunales Federales competentes de la Ciudad de México por lo que renuncian a
cualquier otro fuero que por razón de su domicilio actual o futuro pudiera corresponderles.
Leído que fue el presente Contrato y enteradas las partes de su contenido y alcances, lo firman por
en la Ciudad de México, , el día del mes de de .

“LAS PARTES”, AL TENOR DE LOS SIGUIENTES:
ANTECEDENTES:
1. Que con fecha (señalar fecha) “LAS PARTES”, suscribieron un convenio de Acceso a
Recursos Fitogenéticos Sujetos a Condición Suspensiva, que tiene como objetivo el acceder a
(Señalar el o los recursos genéticos a los cuales se tuvo acceso) en lo sucesivo los
“RECURSOS”, en lo sucesivo el “CONVENIO”.
2. Que con fecha (señalar fecha) “LAS PARTES”, presentaron ante la Secretaría de Agricultura,
Ganadería, Desarrollo Rural, Pesca y Alimentación, (“SAGARPA”) a través del SNICS el
“CONVENIO”, resultando acorde con los requisitos mínimos indispensables que señala la
normatividad en la materia.
3. Que con fecha (señalar fecha) la “SAGARPA” a través del SNICS emitió la constancia de
“Acceso y Condiciones Mutuamente Acordadas”, que se deriva de la presentación ante la
“SAGARPA” del “CONVENIO”.
De conformidad con las declaraciones vertidas en el “CONVENIO”, así como no existiendo cambios
en la representación, ni en las declaraciones ni en sus domicilios, las “PARTES” en este acto se
reconocen mutuamente y se obligan conforme a las siguientes:
C L Á U S U L A S
PRIMERA. OBJETO.- El presente contrato tiene por objeto establecer las bases para establecer las
condiciones mutuamente acordadas para la distribución de beneficios justa y equitativa derivada del
uso del “RECURSOS”, mismas que han demostrado la posibilidad de desarrollar un producto o
aplicación comercializable, mismo que consiste en el desarrollo de (indicar el producto a
desarrollar) que se anexa al presente como Anexo “A”.
SEGUNDA.- Share benefits. El “USUARIO” se obliga frente al “PROVEEDOR” de hacerlo
partícipe en los beneficios que dicho desarrollo de producto o aplicación (derivado del uso de los
“RECURSOS”) generen en el mercado, para lo cual lo incluirá los beneficios monetarios y no
monetarios consistentes en:

a. Intercambio de resultados de investigación y desarrollo.
b. Colaboración, cooperación y contribución en programas de investigación y desarrollo
científicos, particularmente actividades de investigación biotecnológica

d. Colaboración, cooperación y contribución a la formación y capacitación.
e. Admisión en las instalaciones ex situ de recursos genéticos y base de datos.
f. Conocimientos y uso de tecnologías sobre el uso de los recursos genéticos para la
biotecnología o bien para conservación y utilización sostenible de la diversidad

biológica.
g. Fortalecimiento de capacidades para transferencia de tecnología.
h. Creación de capacidad institucional.
i. Recursos humanos y materiales para fortalecer capacidades para la administración y
aplicación de reglamentación en materia de acceso.
j. Capacitacion con dichos recursos genéticos con la intervención de países que los
aportan
k. Acceso a la información científica pertinente a la conservación y utilización sostenible
de la biodiversidad biológica, inventarios biologicos y estudios taxonómicos.
l. Aportes a la economía local.
m. Investigación dirigida a necesidades prioritarias.
n. Propiedad conjunta de derechos de propiedad intelectual pertinentes.
Los cuales se desglosan a detalle en el Anexo “A”.
TERCERA. PARTICIPACIÓN DE TERCEROS. “EL USUARIO” podrá celebrar los instrumentos
jurídicos con terceros, que sean necesarios para el desarrollo de los productos o aplicaciones que se
amparen por medio de este Contrato únicamente para desarrollarlo conforme al ANEXO “B”.
En caso de que el usuario ceda los derechos que deriven de su investigación para fines comerciales a
una persona física o moral, esta sesión de derechos deberá comprenden la distribución de beneficios
a favor del “PROVEEDOR” conforme a lo siguiente:

“EL USUARIO” se asegurará de que en dichos contratos con terceros, éstos se celebren con cláusulas
de confidencialidad estrictas, que limiten el libre uso de los “RECURSOS”, de lo contrario será
responsable de las consecuencias legales a que haya lugar frente al “PROVEEDOR” dando aviso a
la “SAGARPA” a través del “SNICS”. Por lo anterior se entiende que la información vertida en el
presente contrato es de carácter confidencial, siendo que cualquier información o documentación que
“EL USUARIO” genere como parte de sus archivos a la conclusión de los trabajos de desarrollo que
efectúe, son propiedad de “EL USUARIO” sin dejar de reconocer en ningún momento al
“PROVEEDOR”; y éste último se obliga a no divulgar los informes, datos y resultados obtenidos
de los trabajo materia del presente contrato y del “CONVENIO”.
En los instrumentos jurídicos que “EL USUARIO” celebre con los terceros participantes en el
“PROYECTO”, garantizarán que la utilización de los “RECURSOS” por parte de los terceros será
estrictamente para los fines exclusivos del mismo, así como la restricción de la transferencia a partes
ajenas al “PROYECTO” y a “EL USUARIO”. En caso contrario será responsable ante el
“PROVEEDOR” de las consecuencias que se deriven de la no observancia de la presente clausula,
sacando en paz y a salvo al “USUARIO” de cualquier controversia, reclamo que se le pudiere
instaurar.
CUARTA.- INFORMES. “El USUARIO” debe garantizar al “PROVEEDOR” y éstos a su vez,
remitirán copia de dicho informe a la “SAGARPA” a través del SNICS la información que se genere
a la conclusión de los desarrollos de los productos o aplicaciones..
QUINTA. DERECHOS DE PROPIEDAD INTELECTUAL. Los derechos de propiedad
intelectual que pudieran surgir con motivo de las actividades desarrolladas y derivadas del objeto del
presente Contrato, corresponderán a “LAS PARTES” en términos de su participación, es decir, “El
USUARIO” le corresponderá un (señalar porcentaje) y para el “PROVEEDOR” corresponderá un
(señalar porcentaje).
SEXTA. DIVULGACIÓN DE RESULTADOS.- “LAS PARTES” convienen que cualquiera
de ellas podrá publicar los resultados en sus labores académicas o de investigación o de las actividades

motivo del presente Contrato, dando el debido reconocimiento a los autores, previa autorización por
escrito de la otra parte.
Para ello someterá el manuscrito con treinta días de anterioridad a la fecha en que pretenda publicar.
Si pasado ese tiempo no tuviera respuesta de la otra parte, se entenderá que aquélla ha dado su
autorización. Cualquier publicación derivada del estudio de los “RECURSOS” deberá reconocer
expresamente su origen
SÉPTIMA. INTERPRETACIONES TÉCNICAS.- En caso de dudas o discrepancias de carácter
técnico entre “LAS PARTES” relativas a la ejecución del producto o de la aplicación, podrán
solicitar la opinión que corresponda a las autoridades competentes en la materia a efecto de lograr
entre las mismas una solución consensuada.
OCTAVA. “El PROVEEDOR” se reserva el derecho de ejercer acciones administrativas, civiles y
penales en contra de “EL USUARIO” o cualquier tercero a que hubiere lugar, tanto a nivel
nacional como internacional por el uso no autorizado de los “RECURSOS” y sus derivados,
productos accedidos a través de este Convenio.
NOVENA. CESIÓN.- Los derechos derivados del presente contrato podrán cederse en todo o en parte
a la persona física o moral, nacional o extranjera que “LAS PARTES” designen previo
consentimiento y por escrito.
DÉCIMA. AVISOS.- “LAS PARTES” manifiestan su voluntad para dar aviso y remitir un tanto en
original del presente Contrato y sus Anexos a la “SAGARPA” a través del “SNICS” para los efectos
legales a que haya lugar.
DÉCIMA PRIMERA. MODIFICACIONES.- El presente Contrato sólo podrá ser modificado y/o
adicionado mediante la firma del Convenio Modificatorio correspondiente, suscrito por quienes
cuenten con facultades para ello y formarán parte integrante del presente instrumento, debiendo avisar
por escrito a la “SAGARPA” a través del “SNICS” respecto a dichas modificaciones.
DÉCIMA SEGUNDA.- “LAS PARTES” convienen que será motivo de rescisión del presente
Contrato:
a) El que alguna declaración de este documento sea falsa.
b) El incumplimiento de alguna de las obligaciones consignadas en este instrumento.
c) La imposibilidad material de ejecutar las obligaciones y derechos vertidos en el presente
contrato derivados de caso fortuito o bien de fuerza mayor.
DÉCIMA TERCERA. PROCEDIMIENTO DE RESCISIÓN.- Si alguna de “LAS PARTES”
consideran que la contraparte ha incurrido en algunas de las causas de rescisión que se consignan en
este instrumento, lo comunicará por escrito a la otra, a fin de que la misma, en un plazo de quince días
hábiles, exponga lo que a su derecho convenga. Si después de analizar las razones aducidas, la parte
demandante estima que las mismas no son satisfactorias, podrá optar por exigir el cumplimiento del
Contrato, o bien la rescisión del mismo. En caso de rescisión, las partes tomarán todas las medidas
necesarias para evitarse perjuicios.
DÉCIMA CUARTA. TERMINACIÓN.- Cualquiera de “LAS PARTES” podrá dar por terminado
el presente instrumento con antelación a su vencimiento mediante aviso por escrito a su contraparte,
notificándola con 15 (quince) días naturales de anticipación siempre y cuando no existan obligaciones
pendientes entre ellas. En tal caso, “LAS PARTES” tomarán las medidas necesarias para evitarse
perjuicios. Adicionalmente deberán dar aviso de la terminación del Contrato al “SNICS”.DÉCIMA
QUINTA. VIGENCIA.- El presente Contrato entrará en vigor a partir de la fecha de su firma y tendrá
una vigencia de (señalar plazo).

DÉCIMA SEXTA. JURISDICCIÓN.- Para la interpretación, ejecución y cumplimiento del presente
Contrato, así como para todo lo no previsto en el mismo, “LAS PARTES” se someten a la
jurisdicción de los Tribunales Federales competentes de la Ciudad de México, por lo que renuncian a
cualquier otro fuero que por razón de su domicilio actual o futuro pudiera corresponderles.

invitation to send information on the use and exchange practices, relevant voluntary codes of conduct,
guidelines and best practices and / or standards and community protocols on access and benefit - sharing
specifically addressing genetic resources for food and agriculture and discussion concerning document:
„Elements to Facilitate Domestic Implementation of Access and Benefit-sharing for Different
Subsectors of Genetic Resources for Food and Agriculture (ABS Elements)” http://www.fao.org/3/a-

Poland, as the member of the UE is implementing directly the REGULATION (EU) No 511/2014 OF
THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 16 April 2014 on compliance
measures for users from the Nagoya Protocol on Access to Genetic Resources and the Fair and
Equitable Sharing of Benefits Arising from their Utilization in the Union
The issue of access to genetic resources is addressed in the Act of 19 July 2016 on access to genetic
resources and sharing of benefits from their utilisation, where Poland decided not to regulate access to
its genetic resources, including livestock genetic resources . The Minister of the Environment is
responsible for implementation of this law, as Competent National Authority under Nagoya Protocol.
This Act established a national monitoring system designed to ensure control of the use of genetic
resources obtained from the States which, in accordance with the Nagoya Protocol regulate access to
its genetic resources in national legislation.
It should be noted that the current system of exchange and trade of genetic resources and the breeding
material works well and is based on civil law contracts, that are established to safeguard the interests of
both parties. National genetic material, derived from breeding programmes implemented by
organizations that were authorized to keep herdbooks and to conduct performance recording and other
tasks in the area of breeding and reproduction of animals, partly meets the demand for breeding stock,
that is supplemented by import of genetics from international breeding companies.
Preparation of the ABS law was preceded by sectoral assessments contracted by the Ministry of
Environment, including development of detailed sector-specific studies, that have been made available
on the Portal "Information Exchange System on Biological Diversity in Poland" -

Among others a couple of studies concerning genetic resources for food and agriculture were
prepared. The first one: "Crops in agriculture and horticulture, forestry, botanical gardens for the impact
of the introduction in Poland of new regulations on access to genetic resources and sharing benefits

arising from the utilization of these resources (ABS) under the provisions of the Protocol on access to
genetic resources and the fair and equitable sharing benefits arising from the utilization of these
resources (Nagoya Protocol) to the Convention on biological diversity".
Section 1.2. of abovementioned expertise includes examples of the best practices in the plant
sector, related to the ABS, e.g.:
1) " Exchange of plant genetic resources in national gene banks, regarding both species listed
in Annex 1 of the International Treaty, as well as species outside of the Annex, is based on
the Multilateral System (MLS), using a standard material transfer agreement (SMTA).
SMTA allows for three types of concluding agreements: the signing of the agreement by
the two parties on paper, "click-wrap" for acceptance of online orders, and the acceptance
of "shrink-wrap" (current practice used by Polish gene bank), where a copy of the SMTA is
attached to a package containing material, and the adoption of the material by the recipient
constitutes acceptance of SMTA.
2) Conducting joint action at the European level, allowing for facilitated access to genetic
resources by:
a. cooperation within the framework of the European Cooperative Programme for Plant
Genetic Resources (ECPGR).
b. the work on A European Genebank Integrated System (AEGIS), in order to create a
European collection, which will operate as a virtual European genebank
(http://aegis.cgiar.org/).
c. the work on the European catalogue of genetic resources EURISCO
(http://eurisco.ecpgr.org/).
3) In the case of collecting genetic material during collection missions abroad, employees of
gene banks, including Polish units, follow the rules set out in the International Code of
Conduct for collection and transfer of plant germplasm (FAO) in order to promote
conservation, collection and utilization of plant genetic resources collected in their natural
sites with respect for the environment, local traditions and culture.
The second one was addressing the potential the impact of the new regulation on access to
genetic resources and sharing of benefits arising from the utilization of these resources in livestock
sector under the provisions of the Nagoya Protocol on access to genetic resources and the fair and
equitable sharing of benefits arising from the utilization of these resources The study was based on
questionnaires directed to organizations operating in the animal breeding and reproduction sector. The
study showed that the current system of marketing breeding stock is functioning well, and practices
applied in the sector are efficient.
Submitting above information, Ministry notes that the Act of 19 July 2016 on access to genetic
resources and sharing of benefits from their utilisation is in force for only four months, therefore, the
experience with its implementation is very limited.
SENEGAL
Suite à la réquisition de la CGRFA de la FAO, portant demande d'information sur l'application des
dispositions juridiques sur l'accès et le partage des avantages sur les ressources génétiques pour
l'alimentation et l'agriculture auxquelles le Sénégal est partie. Nous avons essayé d’apporter une
contribution en nous basant sur deux questions :
A) Quel est le cadre juridique international de l'accès et du partage des avantages appliqué aux
PGRFA en vigueur au Sénégal ?
B) Quel est l’état de leur mise en application au Sénégal ?
Ainsi,
1. La Convention sur la diversité biologique (CBD), adoptée en 1992, est le premier accord
international qui traite de l'accès et du partage des avantages sur les ressources génétiques.

Elle reconnaît les droits souverains des États sur leurs ressources naturelles et affirme le pouvoir
des gouvernements à déterminer l'accès aux ressources génétiques en tant que principe. En
conséquence, elle nécessite une législation nationale sur les ressources génétiques.
- Cette convention est portée pour sa mise en œuvre au Sénégal, par le Ministère en charge
de l’Environnement à travers la Direction des Parcs Nationaux (DPN), mais à ce jour la
législation nationale portant opérationnalisation de l’accès et donnerait, entre autres, le
statut juridique des ressources génétiques et des savoirs traditionnels y relatifs
conformément à la disposition 8.j) n’existe pas encore au Sénégal.
2. Pour opérationnaliser ledit principe, le Traité international sur les ressources phytogénétiques
pour l'alimentation et l'agriculture (PGRFA), qui est le premier instrument international
opérationnel juridiquement contraignant sur l'accès aux ressources génétiques et le partage des
avantages en découlanttenant compte des savoirs traditionnels y relatifs et adopté en 2001 est
entrée en vigueur au Sénégal.
La reconnaissance des droits souverains nationaux étant consacrée par la CBD, le nouveau
système multilatéral d’accès facilité (MLS) qui précise aussi bien les dispositions en matière
d'accès aux ressources phytogénétiques et aux savoirs traditionnels y relatifs qu’en matière de
partage des avantages découlant de leur utilisation est opérationnel à travers : (i) une
catégorisation du statut des ressources génétiques y compris le statut juridique de la
conversation des collections de ressources génétiques ; (ii) une caractérisation des utilisations
déclenchant l’application des mesures d’accès ; (iii) des procédures administratives
d’autorisation et de tracking des ressources génétiques ; (iv) un mécanisme de communication
et d’échange d’informations permettant entre autres, de déclencher les procédures de tracking ;
(v) les procédures de traitement des cas de non-respect et leur application.
- Ce traité de la FAO est, pour sa mise en œuvre au Sénégal, porté par le Ministère en charge
de l’Agriculture à travers la Direction de l’Agriculture (DA). Mais à ce jour, aucune des
procédures édictées ou des instruments administratifs complémentaires à créer n’a encore
fait l’objet d’application sur le territoire de la République du Sénégal.
- Au demeurant, pour mettre à la disposition du public les informations de gestion et
d’utilisation des ressources génétiques et,entre autres, pallier à certaine situation de non-
application qui permettrait au Sénégal de développer des actions de non-respect du Traité
dans la catégorie d’accès en connaissance de cause, l’ISRA a finalisé et mis en place en
2007, pour le compte du Ministère de l’agriculture un mécanisme de communication et
d’échange d’informations relatif aux PGRFA, qui est régulièrement évalué et disponible sur
le Web pour l’accès au public des informations de gestion et d’utilisation des PGRFA au
Sénégal. Le site Web d’échange et de partage d’information est en pleine mutation donc
accessible par mot de passe, en attendant sa remise au grand public, comme depuis 2007.
- Egalement, l’ISRA a récemment commencé à faire signer des contrats, uniquement de type
SMTA, aux demandeurs d’accès qui le lui proposent. Cependant, même dans ces situations,
le contrat n’a pas encore la valeur administrative relative aux dispositions internationales
en vigueur au Sénégal, pour la raison qu’il n’est pas communiqué au dispositif d’échange
d’information qu’il gère, pour préparer une notification légale à l’administration de gestion
des contrats de type SMTA relatifs à la catégorie des ressources génétiques du MLS-PGR.
C’est également une des raisons pour laquelle, qu’il soit difficile de fournir les preuves qui
sont demandées dans les documents de la Commission CGRFA de la FAO ni en faire la
situation quant à la catégorie de ressources génétiques et à l’utilisation qui doivent y être
mentionnées.
- Enfin, la grande majorité des conventions de recherches signée intégrant un accès n’est pas
accompagnée de contrat portant sur les aspects et les critères définis par les conventions et
traités touchant les ressources génétiques et pour lesquels le Sénégal est partie.

3. Les Lignes directrices de Bonn sur l'accès aux ressources génétiques et le partage juste et
équitable des avantages résultant de leur utilisation, adoptées en 2002, a pour but d’aider les
Parties à l’atteinte du troisième objectif de la CBD qui est l’accès aux ressources génétiques et
le partage des avantages découlant de leur utilisation. Malgré son caractère volontaire et non-
contraignant, il est un auxiliaire précieux pour les Parties, notamment pour ceux qui concerne
leur droit et leurs obligations pour la mise en œuvre des principes de la CBD en matière d’accès.
4. Dernier à être élaboré et adopté en 2015, le Protocole de Nagoya sur l'accès aux ressources
génétiques et le partage juste et équitable des avantages découlant de leur utilisation relatif à
la Convention sur la diversité biologique est un Accord complémentaire de la CDB. Il fournit
un cadre juridique de mise en œuvre efficace du troisième objectif de la CDB et de l’utilisation
de clauses contractuelles types sectorielles et intersectorielles pour les conditions convenues
d’un commun accord. Le dispositif du régime international d’accès et de partage des avantages
est ainsi mis en place au niveau international et au Sénégal qui est partie à tous les instruments
qui le constitue.
Le Sénégal a signé le Protocole de Nagoya, le 26 Janvier 2012 et ratifié le 03 Mars 2016. Ce protocole
encadre juridiquement l'accès et l'utilisation des ressources génétiques, mais aussi la recherche, le
transfert de technologies, la valorisation des connaissances traditionnelles et le partage juste et équitable
des avantages monétaires et ou non monétaires associés à l'utilisation de ces ressources. La Loi n°2016-
03 du 06 janvier 2016 a autorisé le Président de la République à ratifier ce Protocole.
L’accès aux ressources génétiques et des avantages qui peuvent en découler est défini dans ledit sur le
chapitre accès aux ressources génétiques et le partage juste et équitable des avantages découlant de leurs
utilisations. Article 6. - Accès aux ressources génétiques
Article 7. - Accès aux connaissances traditionnelles associées aux ressources génétiques
Article 8. - Considérations spéciales
Article Article 11. - Coopération transfrontière.
Les bénéfices découlant de l’exploitation des ressources génétiques sont abordés dans l’Article 9 du
même Protocole.
Ces dispositions du Protocole doivent être traduites au niveau national par des mesures administratives
et législatives pour sa mise en œuvre.
- Ce protocole est porté par la Direction des parcs nationaux pour le ministère de
l’environnement.
- Comme indiqué, les instruments du régime international étant complémentaires, le Traité y
est consacré au titre de la spécificité des PGRFA. La catégorisation aussi bien des PRGFA
que des usages, détermine l’instrument à appliquer et ces caractéristiques finales sont
reprises dans les clauses contractuelles mutuellement convenues, pour qu’à l’issue de la
communication et de la notification à l’autorité de gestion, permettre le tracking et le partage
des avantages qui en sera issu. Le critère fondamental mais non-essentiel applicable au
partage des avantages, repose sur la qualité du droit de propriété intellectuelle qui est utilisé
au final des travaux.

According formal aspects of collecting, access to plant genetic resources is not yet regulated
on the national level, except for the protected species and protected areas.
We propose the co-organization of joint collecting mission with the employees from the plant
gene bank, faculties and research institutes. If collecting is on somebodies private property there must
be a consent/agreement between collector and the landowner. As a good habit we consider also the
gentlemen agreement that we will share collected material, and preparation of the letter signed by both
sides with attached list of accessions that the collected material is available for research, education and
breeding.
There are also the phytosanitary issues to be regulated with competent offices. In our country
this is Plant Protection Directorate under the Ministry of Agriculture and Environmental Protection.

access and benefit sharing specifically addressing genetic resources for food and agriculture in
Sweden as requested.
I. Assessment of the concerned subsectors of GRFA, including their activities, socio-economic environments and use and exchange practices
Distinctive features of GRFA
From the perspective of access and benefit sharing, Sweden considers the proposed features relevant,
justified and ample.
Different forms of utilization of subsectors and variations within subsectors of GRFA
GRFA: Use comprises R&D, breeding, training/education and ’direct use’ towards consumers (e.g.
through designated networks aiming towards the market, seed production for sale to home gardens,
etc.).
Legal, policy and administrative measures, including existing practices
Plant GRFA: Parties holding collections, such as e.g. the Nordic Genetic Resource Centre (NordGen),
follow the terms of the ITPGRFA. The commercial plant breeding industry has, in line with the
provisions of the of the Nagoya protocol, implemented its own internal procedures to manage both the
plant material itself and the associated information.
Animal GRFA: Most AnGRFA are privately owned, often on farm level.
Relevant national legislation, referring both to the ITPGRFA and the Nagoya protocol, is in place.
Sweden does not regulate access to genetic resources.
Possible implications of the scope, including subject-matter and temporal scope, of ABS measures
GRFA: Sweden takes active part in the on-going development of guiding documents for different
subsectors (plant breeding, bio-control, pharmaceuticals, animal breeding, etc.). In accordance with
the ministerial declaration from 2003 (the ‘Kalmar Declaration’) concerning rights and access to
genetic resources, all PGR conserved at NordGen are under common Nordic management and in the
public domain, and part of the Multilateral System (MLS). This also accounts for non-Annex I crops.

made on the terms of the SMTA. Sweden has decided not to regulate access to our genetic resources
when implementing the Nagoya Protocol.
Flows of germplasm, including international flows, within the different subsectors
PGRFA: Sweden’s dependence on access to genetic resources from other parts of the world than the
Nordic region will persist. To that effect, not only the foreseen consequences of on-going climate
change present challenges, but also the need to develop new plant varieties for an agriculture under
constant evolution (sustainability, low-input agriculture, biofuels, etc.).
AnGRFA: Breeding programs are dependent on access to material from out-side Sweden. Breeding
materials are extensively traded.
Possible gaps in ABS measures
PGRFA: Current legislation is deemed to be appropriate and sufficient. However, additional
information campaigns may be needed regarding access to PGR currently only conserved in situ, as
well as the principles and implementation of the Nagoya Protocol. The latter represents new and
complex legislation, and certain misconceptions that have arisen among some stakeholder groups need
to be addressed.
AnGRFA: Additional information campaigns concerning the Nagoya protocol is needed.
II. Identification and consultation of relevant governmental entities and non-governmental stakeholders holding, providing or using GRFA
PGRFA: Since 2000 Sweden has a national program for cultivated plants with the purpose of
conserving, and using sustainably, domestic genetic resources (cultivars and crop wild relatives). Most
relevant stakeholders are members of its Programme Council. Those that are not formal members of
the Council collaborate through associated networks.
AnGRFA: Breeding organisations and breeding associations and associated networks. Sweden also
has a national program for animal genetic resources with the purpose of conservation, use and
development. Integration of ABS measures with broader food security and sustainable agricultural
development policies and strategies.
The integration of ABS measures with policies and strategies in general, as well as food security and
sustainable agriculture development in particular is the ultimate responsibility of the government. All
policy decisions are based on consultations and negotiations between the expert authorities and the
ministries as well as between the ministries. A close cooperation between the Ministry of Environment
& Energy and the Ministry of Enterprise and Innovation (where agricultural questions are handled) are
present in these issues. Other Ministries are also consulted as appropriate. Policies are always cleared
by all involved sector-ministries in Sweden.
IV. Consideration and evaluation of options for ABS measures
GRFA: National legislation is in place (c.f. I).
V. Integration of implementation of ABS measures into the institutional landscape
PGRFA: Sweden operates in a Nordic context which results in synergy and cost-efficiency. All
genetic material is provided expeditiously and free of charge. The added value of consecutively
coordinating policy development and implementation (i.e. ITPGRFA vs. Nagoya protocol) at the
political level is strongly emphasized.

VI. Communication of, and awareness-raising regarding, ABS measures for potential providers and users of GRFA
PGRFA: Since the entry into force of the ITPGRFA low-intensive, but persistent, awareness-raising
activities have taken place. We argue that knowledge about the ITPGRFA is reasonably well spread
today among relevant stakeholder groups. The national ABS-legislation, as part of the implementation
of the Nagoya Protocol, is new and an important part of the implementation is related to information
on user compliance. The designated national competent authority – the Swedish Environmental
Protection Agency – collaborates closely with other national authorities of relevance to the Protocol. It
also maintains a close dialogue with stakeholder groups aiming at raising awareness (cf. p. 2, last para)
and facilitating due diligence among users.
VII. Ex ante assessment and monitoring of the effectiveness and impact of ABS measures for GRFA
Sector ministries and relevant agencies maintain a straightforward dialogue with industry and targeted stakeholders aiming at building understanding and confidence in internationally agreed ABS measures. Forest genetic resources
The ownership, access and benefit system of forest genetic resources is a well-functioning and open
system in Sweden and the Nordic countries. There are currently no patents on forest reproductive
material. There are also no guidelines or best practise for ABS-measurements in place for forest
genetic resources in place. However, at present no such need has been identified.
SWITZERLAND

I. Background Access to genetic resources and benefit-sharing arising from their utilisation as related to the
International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA) and the Nagoya
Protocol is regulated mainly by the following statutory rules in Switzerland:
The Ordinance of 28 October 2015 on the Conservation and Sustainable Use of Plant Genetic
Resources for Food and Agriculture (Ordonnance sur la conservation et l'utilisation durable de
ressources phytogenetiques pour l'alimentation et l'agriculture (ORPGAA)) entered into force on 1
January 2016 and implements the ITPGRFA. With regards to its scope, the ordinance is an interface
between the ITPGRFA and the Nagoya Protocol.
Switzerland has entered all plant genetic resources for food and agriculture which are under its control
and management and in the public domain into the multilateral system of the ITPGRFA. Material
stored in the National Gene Bank can be obtained through an online ordering system (www.bdn.ch) on
condition that the standard material transfer agreement is accepted by the receiver. If the intended use
goes beyond food and agriculture, an individually-negotiated material transfer agreement has to be
elaborated.
Based on the Federal Act on the Protection of Nature and Cultural Heritage (NCHA, Loi federale sur
la protection de la nature et du paysage (LPN)), the Ordinance of 11 December 2015 on the Nagoya
Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising
from their Utilization (Nagoya Ordinance, Ordonnance sur l'accès aux ressources génétiques et le
partage juste et équitable des avantages découlant de leur utilisation (Ordonnance de Nagoya, ONag))
implements the due diligence provisions of the Nagoya Protocol in Switzerland. It stipulates also a

legal requirement for notification in the case of a commercialisation of a product arising from the use
of a genetic resource accessed in Switzerland.
