EB-5 Visa Program Overview
Two types of projects andinvestments qualify for EB-5:
The EB-5 Visa Program was
established by the United States
Citizenship and Immigration
Service (USCIS) in 1990 to offer
immigrant investors and their
families the opportunity to obtain
a U.S. Green Card (Permanent
Residence Status ) in a relatively
short period of time, via their
commercial investment in the
U.S. Successful applicants and
their families can settle
anywhere they choose in the
$ 1 million in newly and recently
c r e a t e d b u s i n e s s e s .

high-unemployment, Targeted

investment, the program requires
the completion of 10 full-time jobs
created directly by the project
( exc lud ing the ind i rec t jobs
calculated by economic modeling).
However, if the project is from a
regional center (such as the EB-5
Charter School Projects) , the
calculation of indirect and induced
jobs based on an approved
e c o n o m i c m e t h o d o l o g y i s
accepted, making the criteria much
easier to meet.
EB-5 Charter School Projects
mandate an independent analyst
to estimate the job creation
required to remove the condition
attached to the Green Card (report
available).
USCIS bases its decision on a
comparison between the investor’s
job creation forecast indicated in
the I-526 petition and the actual
job creat ion at the t ime of
submission of the petition for the
removal of the condition (I-829
petition).
Full-time means working 35 hours
or more per week Workers must be

What kind of benefits andconveniences doesa U.S. Green Cardprovide?
The immigration officer assesses
wh e t h e r t h e in v e s t m e n t o f
$500,000 has indeed been invested
in the manner indicated in the
I-526 and has led to the creation of
the least 10 full-time jobs and
whether it is realistic to expect that
the jobs created will be sustained
for a reasonable period. If the
answers to those questions are
positive, the I-829 petition should
be approved and the condition
removed.
E v e r y o n e h a s t h e i r o w n
motivations for resettling in the
U.S. Having a Green Card greatly
facilitates this plan and brings
many conveniences. People with
the permanent right to settle in the
U.S. through the EB-5 Immigrant
Investor Visa Program are granted
the same rights as other U.S.
citizens. The Green Card also gives
you, your spouse and children
under 21 the right to sett le
anywhere in the U.S. and exit and
visit the country as you please.
The United States is home to many
of the world’s best international
institutions for basic education and
post-graduate study. As a U.S.
res ident , inves to r s can pay
relatively lower tuition fees at these
elite schools. The cost of living in
the United States is less than many
other large, advanced countries.
Consumer goods, services, and
housing are also much cheaper
than in many countries.
American citizens are entitled to
many social rights and goods, such
as public schooling, health and
medical assistance, social security
for retirement and more. As a
permanent Green Card holder, you
are granted these same basic
entitlements.
Permanent residents do not need
to update and reapply for work or
residence status in the U.S. Other
U . S . n o n - i m m i g r a n t v i s a
categories, such as E-2 and H, are
not often granted permanent
residency. These visa categories
usually have time limits, which
require you to resubmit additional
materials to the Department of
I m m i g r a t i o n o r e x t e r n a l
departments for visa renewal. And
there is always the chance that
your renewal will not be approved.
Permanent residency with an
unrestricted green card means
your status never needs to be
renewed.
