    DOING BUSINESS IN THE NORTH AMERICAN ENERGY SECTOR

    Under what conditions are energy businesses operating in North America? What changes would boostexchanges? How are companies adapting their business strategies to the North American context?

    Jess F. Reyes-Heroles was Ambassador of Mexico to the United States of America from October 1997 to November30th, 2000. Before he was Secretary of Energy in President Ernesto Zedillos cabinet. In that capacity he wasPresident of the Board of diverse enterprises, such as PEMEX, CFE and Compaa de Luz y Fuerza del Centro. Earlierhe was Director General (CEO) of Banobras, the national development bank for infrastructure. From 1991 to 1994 he

    was President of the Board and Director General of Grupo de Economistas y Asociados (GEA). Member of the boardsof Banamex-Citigroup and Wal-Mart Mxico. Economist: ITAM (1976). Fulbright scholar. PhD in Economics: MIT(1980).

    JoAnne Butler is responsible for developing the companys presence in its newest identified market Mexico. Ms.Butler is also responsible for ensuring the successful operation of the Campeche and Chihuahua combined-cyclepower projects, and completion of future projects awarded to TransAlta in the region. Ms. Butler joined TransAlta in1999 as general manager, Western Canada Operations. Prior to joining TransAlta, Ms. Butler was with Amoco

    Corporation for 21 years, where her last assignment as General Manager, Engineering and Construction, had herleading multi-disciplined teams. Ms. Butler has a Bachelor of Science (honours) degree in Civil Engineering fromQueens University in Canada.

    relatively low, economies were strong and electricity demand was exceeding supply, and naturally priceswere rising. Electricity markets across North America and around the world were experimenting withderegulation. Many in the electricity business went on a crash build program. Unfortunately, it turnedout many of the industry players were building a house of cards. From the high point of 1999 and 2000,the foundation for that house was shaken by a broad global recession, corporate scandal and September11th . and that house of cards came crashing down.

    Markets across North America began backing away from electricity market liberalization, capital marketsbecame tougher, credit agencies downgraded the entire industry, and regional over- supply strandedmany generation companies investments.

    But through it all, foreign investment in the Mexican electricity system grew. Mexico was an oasis of success in a market filled with failures. The Independent Power Producer program has brought in morethan 7,000 megawatts of new power generation to Mexico -- 3,000 megawatts in the last year alone.Growth in electricity generation in Mexico has been on a blistering pace compared to the rest of North America. What has been integral to Mxico's success and what can Mxico do to sustain this success?

    Cintia Angulo has been working for 15 years at the core of Groupe lectricit de France (EDF), world leader inelectricity distribution and among the top five companies worldwide in electricity generation. She has been councilmember of the Commerce extrieur de France since 1998 and, since 1999, has been Vice President of the MexicanAssociation for Energy Economics (AMEE). Cintia Angulo is a graduate of the Sorbonne in Paris, the cole nationaledadministration, the University of Moncton (Canada), and the Universidad Nacional Autnoma de Mxico. She wasmade Chevalier of the Legion of Honour.

    ABSTRACT

    El marco legal actual permite la participacin privada en la generacin de electricidad bajo los esquemasde PEE, autoabastecimiento, cogeneracin, pequeo productor, exportacin e importacin (LSPEE, 1992)El 24% de la electricidad es producida por generadores privados, de los cuales slo un 13% es producidapor el esquema PEE-PPA con la CFE a travs de contratos a 25 aos (Produccin total aprox. 50 mil MW)

    - Los PEE-PPA con CFE han invertido ms de 5 mil millones de US$- 18 % del SEN se obtiene a partir de las centrales de Ciclo Combinado (CCC) Gas- Cas el 75 % de las CCC fueron instaladas por los PEE (IPP)

    Las mayores participaciones del mercado de los PEEs las tienen empresas Europeas

    El contexto en el que los IPPs estn trabajando es el de un crecimiento de la demanda de 5.4% para elperodo de 2003-2012, para el 2012 se necesitar un 56% ms de generacin para satisfacer la demanda,embotellamiento en la red elctrica e indefinicin de los costos por desabastecimiento elctrico y uncrecimiento estimado del PIB para el 2004 de 3.1% entre otros.

    Los PEEs deben lidiar con una serie de riesgos tales como: arantas limitadas, financiamientos altamentesensibles a las coyunturas polticas y econmicas del pas, riesgo de discrecionalidad que conlleva laexistencia de un comprador nico, deficiente infraestructura gasera y de suministro de agua, marcoregulatorio deficiente, marco legal incierto.

    Desde 1998, 20 proyectos PEE-PPA fueron licitados por la CFE y ganados por empresas transnacionales.Sin embargo, en 4 de las ltimas 5 licitaciones la cantidad de concursantes fue menor. Cales son losfactores claves de xito de los PEE? Cmo incentivar a los PEE para que sigan invirtiendo?

    Actualmente las empresas con operaciones en Mxico que exportan energa al mercado elctrico deEstados Unidos son Intergen, Sempra, AES y Coral Power,

    EDF en Mxico es uno de los lderes en el mercado de la produccin externa de energa (PEE) con cerca de22 % de participacin de mercado con una inversin total de 1.5 MM de USD.

    Marcelo CHAUVET SANCHEZDirector, Compaa Mexicana de GasThe engineer Marcelo Chauvet Sanchez is originally from the Federal District of Mexico and is an honours graduateof the Faculty of Chemistry from UNAM. He looks back on over 30 years of experience in the energy sector. Hewas CEO of VS Construcciones, a company that installed the first MTBE (Methyl Tertiary Butyl Ether) plant in Mexico.As Corporate Director of Planning of Groupe Diavaz, Mr. Chauvet was responsible for strategic planning andbusiness development. Currently, he is CEO of Compaa Mexicana de Gas, a natural gas distribution company inMonterrey. Since December 2003, he sits on the Board of Directors of the Asociacin Mexicana de Gas Natural, AC.
