1.0 INTRODUCTION

1.1 Property Description

The subject building is located at 4 Weir Road, Warragamba in the western suburbs of Sydney. It is lot 78 in DP 210649 and is on the south eastern side of Weir Road on the intersection with Fourth Street. It also has a frontage to Third Street. The structures on the site are currently a place of worship.

This report is for the assessment of compliance of the plans dated 19 December 2018 and proposed works against the current Building Code of Australia 2016 (BCA), Amendment 1.

The report is prepared based on the above documentation and the information provided by the client and is intended for their consideration and submission to the Accredited Certifier.

1.3 Current Legislation

The applicable legislation governing the design of buildings is the Environmental Planning and Assessment Act 1979 (EP & A Act 1979).

The provisions of Section 4.17(11) of this act and Clause 98 of the Environmental Planning and Assessment Regulation 2000 (EP & A Reg 2000) require that the building work be carried out in accordance with the Building Code of Australia (BCA).

1.4 Disability (Access to Premises — Buildings) Standards 2010

The Disability (Access to Premises — Buildings) Standards 2010 commenced on 1 May 2011. These take effect subject to subsection 31 (4) of the Disability Discrimination Act 1992. The objects of these Standards are:

(a) to ensure that dignified, equitable, cost-effective and reasonably achievable access to buildings, and facilities and services within buildings, is provided for people with a disability; and

(b) to give certainty to building certifiers, building developers and building managers that, if access to buildings is provided in accordance with these Standards, the provision of that access, to the extent covered by these Standards, will not be unlawful under the Act.

This Standards is to be applied to a new buildings (including Class 3, 5, 6, 7, 8, 9 or 10), a new part of a building (an extension to the building or a modified part of the building) and an affected part. An affected part is defined as:

(a) the principal pedestrian entrance of an existing building that contains a new part; and

(b) any part of an existing building, that contains a new part, that is necessary to provide a continuous accessible path of travel from the entrance to the new part.

The Standards apply to the following persons to the extent that they are responsible for, or have control over, matters in the Access Code for a relevant building:

(a) a building certifier;

(b) a building developer (includes property developers, property owners, building designers, builders, project managers and property lessees);

(c) a building manager (includes property owners, property lessees, property managers and operational staff).

2.1 Schedule of Existing Fire Services The existing structures are to be demolished and being Class 9b building that does not appear to have been altered since construction will not have a Fire Safety Schedule.

3.0 BUILDING DESCRIPTION

3.1 The Premises

The existing structures are to be demolished and a new two storey building and carpark is to be built on the site.

The building is to have six indoor play areas a terrace on the first floor and associated administration, kitchens and amenities. There are out door areas and 18 car spaces

The plans show brick veneer walls with metal sheet roofing. The floors are expected to be concrete on the ground floor and timber flooring on the first floor.

4.0 BCA ASSESSMENT OF DOCUMENTATION

4.1 BCA Assessment –Interpretation Notes

• Classification: A Development Application is to be submitted to construction and use of the building to a child care centre. This would be considered a Class 9b building requiring assessment to Volume 1 of the BCA.

• Early childhood centre means a preschool, kindergarten or child-minding centre for the care or training of more than 5 children.

1. Informational Structural Design (BCA Part B1)

All buildings and structures are to be designed by appropriately qualified and experience structural engineers.

Issues such as glazing, damp proofing, masonry and pest control etc are also included.

Section C “Fire Resistance”

2. DOES NOT COMPLY

Fire Resistance of Building Elements (BCA Part C1)

The building is required to be constructed in Type B Construction. As the building is setback less than 18.0 m (approx. 14 m from the north-eastern boundary) from a fire source feature the fire resistance levels (FRL) of the external walls will generally be required to be 120/30/ -, all loadbearing parts 120/ - /- (ground floor only). Full brick walls should achieve this required rating but brick veneer is shown. The ceiling will also require a rating under Clause 4.1(d) of Spec C1.1

3. Informational Fire Hazard Properties (BCA Clause C1.10 & Spec C1.10)

The fire hazard properties of all materials and assemblies used in the building must comply with this clause and specification. Test reports for each of the materials used will be required to be provided.

The building is less than the maximum compartment size.

Protection of Openings (BCA Part C3)

Openings for services in the ground floor ceiling or fire rated walls will require protection such as seals or fire collars.

Pedestrian Ramps & Thresholds (BCA Clause D2.10 & D2.15)

• All ramps must have slip resistance classification of not less than listed in Table D2.14.

• Grade must be not steeper than 1:8 or to AS 1428.1 if required to be accessible.

• All doors in a building required to be accessible must be provided with a threshold ramp or step ramp.

11. COMPLIANCE REQUIRED

Doors, Door Swings & Latches (BCA Clause D2.19, D2.20 & D2.21)

• All required exits swing in the direction of egress.

• The BCA provides a concession for latching of egress doors in an early childhood centre. A system of latching and training of staff will be required to be detailed with the construction certificate submission.

12. COMPLIANCE REQUIRED

Egress Generally (Part D2)

• Non-Slip Finishes – All accessible paths of travel, including walkways, stairways, ramps, platforms, footbridges etc must be provided with a non-slip finish that complies with BCA D2.10, AS4586-2004 and AS1428.1-2009.

• Balustrades – Where there is a fall of greater than 1m, balustrades must be at least 1m in height above landings and stair nosings and contain no gaps that would allow a 125mm sphere to pass through. The proposed design appears to generally comply. Where there is a fall of greater

than 4m, balustrades must not contain climbable elements between 150mm to 760mm above floor level.

• Handrails – All stairs and ramps require a handrail.

• Enclosure under stairs – The cupboard under the stairs is

to be FRL 120/60/60 and the door a self-closing fire door with FRL - /60/30.

• Protection of Openable Windows – All first floor windows are to be restricted to provide openings less than 125 mm or a screen with secure fixings.

Parts D3, E3.6 and Clause F2.4 ‘Access & Facilities for People with a Disability”

13. COMPLIANCE REQUIRED / DOES NOT COMPLY

Access for Persons with a Disability has not specifically been addressed in this report as there is insufficient details to assess the requirements for compliance with the BCA.

The plans will be updated to incorporate the features required including corridor widths, door clear opening widths, circulation space, floor finishes, lift and sanitary facilities dimensions.

Details of, handrails, tactile indicators and signage should also be provided.

The accessible carspace does not comply with AS 2890.6 as these are not used for angle parking (and grades, bollards and shared space details are required for the new design).

Section E “Services and Equipment”

12. COMPLIANCE REQUIRED

The following services and equipment are required to be installed to the building

to comply with Section E of the BCA:

• Fire hydrants – Should be installed in accordance with

E1.3 of the BCA and AS 2419.1 - 2005. It is likely that the street system will provide coverage if pressures and flows are available but this should be checked by a hydraulic engineer.

• Fire hose reels – Should be selected and installed in accordance with E1.4 of the BCA and AS 2441-2005. These will be required within 4.0 m of the exit.

• Portable fire extinguishers – Should be selected and

installed in accordance with E1.6 of the BCA and AS 2444-2001.

• Smoke hazard management – Table E 2.2a of the BCA requires no smoke hazard management but residential smoke alarms / smoke detectors are to be provided and if these are to be retained they are to be operable and tested. These will be required under Childcare Regulations.

If a ducted air conditioning system is installed it will be required to shut-down by a smoke detection system.

• Exit & Directional Signs – Emergency lighting is required including over the stairs. As the floor are is over 300 m2 illuminated exit signs are required. Where these are provided must highlight the exit stair locations should be provided in accordance with E4.5 and E4.6 of the BCA & AS 2293.1-2005.

Damp and Weatherproofing (BCA Part F1)

Stormwater drainage, wet areas and damp-proofing is required to comply.

Sanitary Facilities (BCA Clause F2.3)

Sanitary facilities must be provided in accordance with BCA Table F2.3, including sanitary facilities for the disabled. The proposed design does not propose to alter the existing facilities.

A class 9b early childhood centre must be provided with-

(i) a kitchen or food preparation area with a kitchen sink, separate hand washing facilities, space for a refrigerator and space for cooking facilities with –

(A) the facilities protected by a door or gate with child proof latches to prevent unsupervised access to the facilities by children younger than 5 years old

(B) the ability to facilitate supervision of children from the facilities if the early childhood centre accommodates children younger than 2 years old

(ii) One bath, shower or shower bath. NOT PROVIDED

(iii) Nappy change area and laundry.

Staff and children numbers are to be provided for review of Table F2.3.

15. Complies Ceiling Heights (BCA Part F3)

The minimum ceiling heights must typically be no less than the following to satisfy BCA Part F3:

Generally 2.7 m ceiling.

Stairs – no less than 2 m

The building complies.

16. COMPLIANCE REQUIRED

Lighting (BCA Clause F4.2 and F4.4)

Artificial lighting in accordance with BCA Part F4 and AS1680.0 must be provided throughout the building.

In a Class 9b early childhood centre, the sills of 50% of windows in children’s rooms must be located not more than 500mm above the floor level.

17. Informational Ventilation (BCA Clause F4.5)

Natural ventilation constituting not less than 5% of the floor area of the room being served or artificial ventilation in accordance with BCA Part F4 and AS1668.2-1991 must be provided throughout the staff facilities areas. The proposed design does not propose to alter the existing facilities but the protection of openings must address this.

The building is to be located in Climate Zone 6 and the showroom area must comply with the following parts of Section J “Energy Efficiency”. Compliance should be confirmed by the designing engineers with the relevant provisions as follows:

• Part J3 – Building Sealing

• Part J5 – Air-conditioning & Ventilation

• Part J6 - Artificial Lighting and Power

5.0 SUMMARY

5.1 BCA Issues

Based on the assessment provided in Part 4.2 of this report and the extent of areas where the proposed building either ‘complies’ or ‘compliance is required’ to meet the requirements of the BCA.

The construction plans must address the following compliance issues that are required to be addressed to ensure compliance with the BCA:

• Protection of Openings (BCA Part C3)

• Egress Width (BCA Clause D1.6)

• Discharge from Exits (BCA Clause D1.10)

• Pedestrian Ramps & Thresholds (BCA Clause D2.10 & D2.15)

• Doors, Door Swings & Latches (BCA Clause D2.19, D2.20 & D2.21)

• Egress Generally (Part D2)

• Section E “Services and Equipment”

• Damp and Weatherproofing (BCA Part F1)

• Lighting (BCA Clause F4.2 and F4.4)

• Outdoor Play Spaces (BCA Clause G1.3)

The following issues are expected to be required to be updated on the Development Application plans to ensure the Construction Certificate Plans reflect the DA Approved plans:

(a) Fire Resistance of Building Elements (BCA Part C1): The building is required to be in Type B Construction with the load bearing parts on the ground floor to achieve an FRL of 120/ - / -, the ground floor ceiling (and supports) an FRL of 30/30/30 and the northern elevation to achieve an FRL of 120/30/ -.

(b) Parts D3, E3.6 and Clause F2.4 ‘Access & Facilities for People with a Disability”: The plans will be updated to incorporate the features required including corridor widths, door clear opening widths, circulation space, floor finishes, lift and sanitary facilities dimensions. Details of, handrails, tactile indicators and signage should also be provided. The accessible car space does not comply with AS 2890.6 as these are not used for angle parking (and grades, bollards and shared space details are required for the new design).

(a) Sanitary Facilities (BCA Clause F2.3): The kitchen requires a separate hand wash basin and either a bath or shower is required as part of the sanitary facilities. Staff and children numbers are required for review of Table F2.3.

5.2 Conclusion

The report provides an assessment of the building at 4 Weir Road, Warragamba under the significant provisions of the BCA.

The proposed works will be required to comply with the current deemed-to-satisfy provisions of the BCA, which are detailed in Section 4.2 and 5.1 of this report. The requirement for a compliant disabled access may require significate changes to be made to the design.

APPENDIX B CONDITIONS OF APPROVAL 4.1 Preliminary Subsequent to careful consideration and a full review of the existing premises and the requirements of the BCA the following assessment has been made in regards to the proposed works and how it may affect the remainder of the building.

All works approved under the Construction Certificate (CC) must be completed and certified (Occupation Certificate) within 12 months of the date of the CC. Where delays are unavoidable, the authority must be notified of the revised completion date. 4.2 Schedule of Compliance 4.2.1 General (1) That compliance shall be given to the provisions of the Environmental Planning and Assessment

(EP&A) Act, 1979, EP&A Regulation 2000 and the Building code of Australia (BCA) 2016, Amendment 1;

(2) That all materials, linings and surface finishes used in this fit out shall comply with Specification

C1.10 of the BCA;

(3) A procedure for unlocking doors is to be provided and this must comply with the requirements of Part C2.21 of the BCA;

(4) Based on our assessment of the plans provided we are of the view that compliance to the travel distance and distance between exits provisions (Parts D1.4, D1.5, D1.14 and D1.15) of the BCA have been complied with in full;

4.2.2 Disable Access Provisions (See Appendix C attached) (5) That compliance shall be given to the provisions of the Premises Standards - 2010, AS 1428.1-

2009 and Part D3 (Disable Access) of the BCA;

Please refer to Appendix C for other compliance matters that may affect these works; (6) Disable Access has not been provided to various areas and a concession under Clause D3.4

of the BCA has been provided by the access consultant. Appropriate documentation will be required prior to issue of the occupation certificate;

4.2.2 Fire Services (7) The building is to be provided with coverage from fire hydrant, fire hose reel and portable fire

extinguishers to E1.3 of the BCA and AS 2419.1 – 2005, . E1.4 of the BCA and AS 2441-2005 and E1.6 of the BCA and AS 2444-2001.

(8) smoke alarms / smoke detectors are to be provided and if these are to be retained they are to

be operable and tested. These will be required under Childcare Regulations. If a ducted air conditioning system is installed it will be required to shut-down by a smoke detection system.

(9) The Emergency Lighting and Exit Sign System shall be carried out in accordance with the

requirements of AS 2293.1 and Part E4 of the BCA;

4.2.3 Health (10) Any air conditioning and mechanical ventilation system shall be carried out in accordance with

the requirements of AS 1668.2 and part F4 of the BCA. Where installed specialised equipment has specific requirements this must also be considered.

4.2.3 Energy Efficiency (11) The building fabric, glazing and sealing must comply with Pars J1, J2 and J3 of the BCA;

(12) The air conditioning and mechanical ventilation system within the building shall be carried out

in accordance with the requirements of Part F5 (Energy Efficiency) of the BCA. (13) The artificial lighting system must comply with the requirements of Part F6 (Energy Efficiency)

of the BCA.

APPENDIX C

Part D3 D3.1

D3.1 General building access requirements Buildings and parts of buildings must be accessible as required by Table D3.1, unless exempted by clause D3.4.

Class 5 To and within all areas normally used by the Occupants. Existing non-compliant areas will be further investigated if any upgrade requirements are required or a hardship application be lodged when building works occur on the floors.

Application of the Premises Standard only applies to the new part and the

affected part.

Part D3 D3.2

D3.2 Access to buildings (1) An accessway must be provided: (a) to a building required to be accessible; (b) from the main points of a pedestrian entry at the allotment boundary; and

(i) from another accessible building connected by a pedestrian link; and

(ii) from any required accessible carparking space on the allotment.

This part does not apply as the new works only require affected parts to

be upgraded. It is not a new building and there are works proposed for the area between the principal pedestrian entrance of the building and the allotment boundary

(2) In a building required to be accessible, an accessway must be provided through the principal pedestrian entrance, and:

(a) through not less than 50% of all pedestrian entrances including the principal pedestrian entrance; and

(b) in a building with a total floor area more than 500 m2, a pedestrian entrance which is not accessible must not be located more than 50 m from an accessible pedestrian entrance;

Except for pedestrian entrances serving only areas exempted by clause D3.4.

The affected part includes the principal pedestrian entry. The principal pedestrian entry to the building is required as an accessway or a continuous accessible path of travel (as defined in AS 1428.1), into the building. Where a doorway on an accessway has multiple leaves except an automatic opening door one of those leaves must have a clear opening width of not less than 850mm in accordance with AS1428.1. Refer to AS1428.1-2009.

Part D3 D3.3

D3.3 Parts of buildings to be accessible In a building required to be accessible:

(ii) for a stairway, except a fire-isolated stairway, clause 11 of AS 1428.1;

(iii) for a fire-isolated stairway, clause 11.1(f) and (g) of AS 1428.1;

Passing and turning spaces

In a building required to be accessible: (c) accessways must have: (i) passing spaces complying with AS 1428.1 at maximum 20 m intervals on those parts of an accessway where a direct line of sight is not available; and (ii) turning spaces complying with AS 1428.1, Part 6.4 which requires that the passing space for 2 person using wheelchairs shall be a minimum width of 1800mm for a minimum length of 2000mm. End of accessways part 6.5 of AS1428.1 The circulation space required for a wheelchair to make a 60 degree to 90 degree turn shall have a gradient no steeper than 1 in 40 and shall be not less than 1500mm wide and 1500mm long in the direction of travel. The space may be splayed across the internal corner. Where the angle of turn is 30 degrees to less than 60 degrees and the width of the path of travel is less than 1200mm, a splay of at least 500mm x 500mm shall be made on the internal corner. The space required for a wheelchair to make a 90 degree to 180 degree turn shall be not less than 2070mm in the direction of travel and not less than 1540mm wide. (A) within 2 m of the end of accessways where it is not possible to continue travelling along the accessway; and (B) at maximum 20 m intervals along the accessway; (d) an intersection of accessways satisfies the spatial requirements for a passing and turning space; (e) a passing space may serve as a turning space;

Part D3 D3.4

D3.4 Exemptions (a) an area where access would be inappropriate because of the

particular purpose for which the area is used. (b) an area that would pose a health or safety risk for people with a

disability. (c) any path of travel providing access only to an area exempted by this clause.

Part D3 D3.6

D3.6 Signage (a) Braille and tactile signage complying with Part 4 and incorporating the international symbol of access or deafness, as appropriate in accordance with AS1428.1 must identify each

• The type of hearing augmentation and

• The area covered within the room and

• If receivers are being used and where the receivers can be obtained; and

4. Signage in accordance with AS1428.1 must be provided for accessible unisex sanitary facilities to identify if the facility is suitable for left or right handed use; and

5. Signage to identify an ambulant accessible sanitary facility in accordance with AS1428.1 must be located on the door of the facility and;

6. Where a pedestrian entrance is not accessible, directional signage incorporating the international symbol of access in accordance with AS1428.1 must be provided to direct a person to the location of the nearest accessible pedestrian entrance and;

7. Where a bank of sanitary facilities is not provided with an accessible unisex sanitary facility, directional signage incorporating the international symbol of access in accordance with AS1428.1 must be placed at the location of the sanitary facilities that are not accessible to direct a person to the location of the nearest accessible unisex sanitary facility.

Part D3 D3.7

D3.7 Hearing Augmentation If the room or space accommodates up to 500 persons, 1 receiver for every 25 persons or 2 receivers whichever is the greater and If the room or space accommodates more than 500 persons but not more than 1000 persons. 20 receivers plus 1 receiver for every 33 persons in excess of 500 persons and If the room or space accommodates more than 1000 persons but not more than 2000 persons, 35 receivers plus 1 receiver for every 50 persons in excess of 2000 persons and If the room or space accommodates more than 2000 persons 55 receivers plus 1 receiver for every 100 persons in excess of 2000 persons. The number of persons accommodated in the room or space served by an inbuilt amplification system must be calculated according to clause D1.13 of the BCA. Any screen or scoreboard associated with a class 9b building and capable of displaying public announcements must be capable of supplementing any public address system, other than a public address system used for emergency warning purposes only.

D3.8 Tactile Indicators For a building required to be accessible, tactile ground surface indicators must be provided to warn people who are blind or have a vision impairment that they are approaching:-

1. a stairway other than a fire isolated stairway; 2. an escalator; 3. a passenger conveyor or moving walk; 4. a ramp other than a fire-isolated ramp, a step ramp, a kerb ramp

and 5. in the absence of a suitable barrier an overhead obstruction less

than 2m above floor level, other than a doorway and 6. an accessway meeting a vehicular way adjacent to any pedestrian

entrance to a building, excluding a pedestrian entrance serving an area referred to in clause D3.4 if there is no kerb or kerb ramp at that point.

Tactile ground surface indicators required by the above must comply with sections 1 and 2 of AS/NZS 1428.4.1. capable of displaying public announcements must be capable of supplementing any public address system, other than a public address system used for emergency warning purposes only

D3.12 Glazing on a accessway On a accessway, where there is no chair rail, handrail or transom, all frameless or fully glazed doors, sidelights and any glazing capable of being mistaken for a doorway or opening must be clearly marked in accordance with AS1428.1

D4.1 Scope This part sets out the requirements for the design and installation of braille and tactile signage as required by clause D3.6

D4.2 Location of braille and tactile signs Signs including symbols, numbering and lettering must be designed and installed as follows:

1. braille and tactile components of a sign must be located not less than 1200mm and not higher than 1600mm above the floor or ground surface;

2. signs with single lines of characters must have the line of tactile characters not less than 1250mm and not more than 1350mm above the floor or ground surface;

3. signs identifying rooms containing features or facilities listed in clause D3.6 must be located on the wall on the latch side of the door with the leading edge of the sign located between 50mm and 300mm from the architrave and where it is not possible the sign may be placed on the door itself.

Part D4 D4.3

D4.3 Braille and tactile sign specification Tactile characters must be raised or embossed to a height of not less than 1mm and not more than 1.5mm. Sentence case upper case for the first letter of each main word and lower case for all other letters must be used for all tactile characters and upper case tactile characters must have a height of not less than 15mm and not more than 55mm and lower case tactile characters must have a height of 50% of the related upper case characters. Tactile characters, symbols and the like must have rounded edges. The entire sign including any frame must have all edges rounded. The background negative space or fill of signs must be of matt or low sheen finish. The characters symbols logos and other features on signs must be matt or low sheen finish. The minimum letter spacing of tactile characters on signs must be 2mm. the minimum word spacing of tactile characters on signs must be 10mm. the thickness of letter strokes must be not less than 2mm and not more than 7mm. Tactile text must be left justified, except that single words maybe be centre justified. Tactile text must be Arial typeface.

D4.4 Luminance Contrast The following apply to luminance contrast. The background negative space, fill of a sign or border with a minimum width of 5mm must have a luminance contrast with the surface on which it is mounted of not less than 30%. Tactile characters, icons and symbols must have a minimum luminance contrast of 30% to the surface on which the characters are mounted. Luminance contrasts must be met under the lighting conditions in which the sign is to be located

Part D4 D4.5

D4.5 Lighting Braille and tactile signs must be illuminated to ensure luminance contrast requirements are met all times during which the sign is required to be read.

Part D4 D4.6

D4.5 Braille The following applies to braille. The braille must be grade 1 braille uncontracted in accordance with the criteria set out by the Australian Braille Authority. Braille must be raised and domed, braille must be located 8mm below the bottom line of text not including descenders. Braille must be left justified, where an arrow is used in the tactile sign, a solid arrow must be provided for braille readers. On signs with multiple lines of text and characters, a semicircular braille located at the left margin must be horizontally aligned with the first line of braille text.

F2.2 Calculation of number of occupants and fixtures The number of persons accommodated must be calculated according to the clause D1.13 of the BCA if it cannot be more accurately determined by other means.

F2.4 Accessible Sanitary Facilities In a building required to be accessible

1. accessible unisex sanitary compartments must be provided in accessible parts of the building in accordance with Table F2.4a and;

2. accessible unisex showers must be provided in accordance with table F2.4b and;

3. at each bank of toilets where there is one or more toilets in addition to an accessible unisex sanitary compartment at that bank of toilets a sanitary compartment suitable for a person with an ambulant disability in accordance with AS1428.1 must be provide for use by males and females and;

4. an accessible unisex sanitary compartment must contain a closet pan, washbasin, shelf or bench top and adequate means of disposal of sanitary towels and;

5. the circulation spaces, fixtures and fittings of all accessible sanitary facilities provided in accordance with table F2.4a and b must comply with the requirements of AS1428.1 and;

6. an accessible unisex sanitary facility must be located so that it can be entered without crossing an area reserved for one sex only and;

7. where two or more of each type of accessible unisex sanitary facility are provided, the number of left and right handed mirror image facilities must be provided as evenly as possible and;

8. where male sanitary facilities are provided at a separate location to female sanitary facilities, accessible unisex sanitary facilities are only required at one of those locations and;

9. an accessible unisex sanitary compartment or an accessible unisex shower need not be provided on a storey or level that is not required by D3.3g to be provided with a passenger lift or ramp complying with AS1428.1;
