CODE OF ORDINANCE ENFORCEMENT BOARDMEETING MINUTES
August 11, 2020
A regular meeting of the City of Hopkinsville Code of Ordinance Enforcement Board was held Tuesday,
August 11, 2020, at 5:45 p.m. in the Council Chambers of the Hopkinsville Municipal Center. ChairmanRodney Davis presided at the meeting and asked for roll call. Those present were:

Also present were: Peter Wood, CDS Procedural Services Coordinator
Zak Dunn, CDS Code Enforcement OfficerDarnell West, CDS Code Enforcement OfficerDoug Willen, City AttorneyLynn Powell, CDS Staff
A quorum was declared.
PLEDGE OF ALLEGIANCE:
Mr. Davis led all members present in the Pledge of Allegiance.
APPROVAL OF MINUTES:
Mr. Howell moved to approve the minutes of the March 10, 2020 regular meeting. The motion was
seconded by Mr. Spurr. All committee members present voted aye. The motion passed.

Allen Hageman (Tenant), 302 Wayne Dr., Hopkinsville, KY presented his case.
Mr. Bruce moved that a violation existed. The motion was seconded by Mr. Howell. All
committee members present voted aye. The motion passed.
Mr. Howell moved to issue a final order in the amount of $200.00 plus a $50.00 administrative
fee. All committee members present voted aye. The motion passed.

Jason Burse, 743 Dillon Dr., Douglasville, GA 30134, presented his case. He advised that the lot
pictured is not the lot he owns.
Rodney Davis recommended that the case be dismissed.
Mr. Bruce moved to dismiss the citation based on the evidence presented. The motion was
seconded by Mr. Spurr. All committee members present voted aye. The motion passed.

Chad Jones (son of owner), 2455 Happy Hollow Rd., Hopkinsville, KY, presented his case.
Mr. Howell moved that a violation existed. The motion died for lack of a second.
Mr. Bruce moved to dismiss the citation based on the evidence presented. The motion was
seconded by Mr. Spurr. All committee members presented voted aye. The motion passed.

not receive the message before it was posted. He advised that Case 2020-05-1958 had been sold.
Mr. Bruce moved to dismiss the above citations based on the information presented. The motion
was seconded by Mr. Spurr. All committee members present voted aye. The motion passed.

NOTICE OF HEARING
As outlined in City of Hopkinsville Executive Order 39-2020, pursuant to your request, and asrequired by KRS 65.8828 and Chapter 33.189 of the City of Hopkinsville, Kentucky Code of Ordinances,you are hereby formally notified to appear before the Code of Ordinance Enforcement Board at 715 SouthVirginia Street, Hopkinsville Municipal Center, Council Chambers Room (#148), on the 8TH ofSEPTEMBER, 2020, at 5:45 p.m. for a public hearing in reference to the citation issued to ANTHONY D.CATLEU, by Rusty Pyle, Code Enforcement Officer, for a violation at 900 E 19 ST of code section(s)163, which is more particularly as follows: Property Maintenance Code.
The Board will receive evidence at the public hearing and will make such findings of fact andconclusions of law as are supported by the evidence pertaining to the mailers alleged in the citation.During the hearing, you will have the opportunity to testify, to present witnesses, and to cross-examine any witnesses who may testify against you. Although it is not required, you may obtain anattorney, at your own expense, to represent you at the hearing.
If you fail to appear at the time and place of the hearing, you shall be deemed to havewaive the right to a hearing to contest the citation, and the determination a yiolation wascommitted shall be final. In this event, the Code of Ordinance Enforcement Board shall enter a finalorder determining that the violation was committed and may impose a civil fine up to the maximum setforth in the citation.
