4. Registered Comments from the Public

No registered comments.

5. Committee Reports

Public Safety and Building & Code Enforcement: Mazzocco stated that there was a meeting on January 18. Discussions included Lexipol and the Complaint Policy. Also discussed updating procedures for dealing with snow removal and grass height. Chief Davis is working on wording for an ordinance.

The next meeting will be February 15.

There was a meeting on the 21st for a discussion on the Healthy Streets for this year.

Business District Relations and Development: Abel stated there was a meeting in January. They discussed the Vacant Property Ordinance. There were a couple of CDC updates and a reorganization meeting last week. There will be a CDC meeting tomorrow to discuss some events during covid.

The Library has been hosting a food drive for the Free Pantry. There were some funds left over from the Holiday Fund Drive; it was used to purchase two more cabinets for downstairs.

Planning, Sustainability, and Inclusion: Bouldin stated that the committee met on January 19th. Discussion included the Strategic Plan and the possibility of a non-discrimination ordinance.

The next meeting will February 16th.

Finance and Legal: Moore stated that the committee met last Tuesday. Hilary Taylor from Papernick and Gefsky gave a presentation on the eviction moratorium for leases in Allegheny County.

There was also a discussion on the opening of the Dormont Pool for 2021.

Recreation and Community Affairs: Ventresca stated that the committee met on January 11th. There was discussion on opening the pool this year and recreation events for the year.

The next meeting will be on February 8th at 6pm.

Lehman spoke about Black History Month and its origin.

Property, Supplies, and Public Works: Fabus stated that there was a meeting and discussion of the Dormont Stormwater Authority proposal to add a rain garden.

6. Comments from the Mayor

Mayor Walsh stated he attended a couple MRTSA meetings, they are still searching for a new chief.

Permit Parking will be addressed at the March meeting.

Walsh thanked Council for the police department's new car which was approved last year. It was picked up a couple of weeks ago.

Walsh discussed the passing of James "Big Jim" Harrod. He was a Life Member of the Fire Department, and member of the Historical Society, VFW, and Parade Committee. He will be missed by many.

7. Junior Council Report

Ethan VonHedemann stated that the KOSD teachers announced that they will be going on strike this month.

8. Council President's Report

Fabus stated that the numbers for covid seem to be dropping in Allegheny County. The vaccine is starting to get around to the public.

Fabus asked that residents help their neighbors if they need help with the snow removal on their sidewalks.

Fabus asked that residents please shop local for Valentine's Day gifts.

Fabus stated that the borough lost a true ambassador last month, Rich Zange. He was a member of DABA for over 30 years, he was known as Mr. 50/50. He has a couple family members that work for the borough. He will be missed.

9. Borough Manager's Report

Estell briefed on his meetings involving the Martial Plan and Climate Action within our region. One of the Connect Interns was able to collect usage from the local utilities.

Estell stated that there is planning for the next Glass Recycling Event which hopefully will be held in the Dormont Pool Parking Lot in late February.

Estell briefed on the new borough app Access Dormont. Estell asked residents to not use Dormont Delivers app, we can't access it to change anything in there.

Estell stated that he will be meeting with other managers in the area to discuss operations for pools this season.

Estell stated that the zoning rewrite is almost complete. As soon as there is a completed document, he will notify Council and the Planning Commission. Then the document will become available for public review.

Estell is submitting an award application for the borough and Mt. Lebanon for the Neighborhood Aid Project which helped greatly during the pandemic.

Estell stated that he will participate in Representative Dan Miller's next Economic Development Forum. Discussions will include the new zoning ordinance and TOD opportunities.

No action was taken. The resumes Scott Haling, Priscilla Mosesso and Monica Tomaszewski, will be forwarded to the Traffic and Parking Planning Commission.

The two Planning Commission applications will be forwarded to the Planning Commission.

Lehman had a question regarding the striping of parking spaces on the roads. Estell stated that the Traffic and Parking Planning Commission will develop a policy regarding the issue.

February 1, 2021: Attended CONNECT Marshall Plan Regional Climate Action Planning alignment meeting.

February 3, 2021: Met with Jennifer LaForge of Tyler Technology to discuss transition of software systems.

February 5, 2021: Hosted a regional meeting of municipal managers, assistant managers, and recreation department employees to discuss possible pool operations in 2021. Agreed to follow-up meetings.

February 10, 2021: Met with Jennifer LaForge of Tyler Technology to discuss transition of software systems.

February 17, 2021: Attended Mobilify meeting to discuss PAAC NexTransit and other regional transit projects.

February 17, 2021: Met Dormont auditors to discuss 2020 finances.

February 19, 2021: Attended CONNECT Environmental and Economic Development Working Group agenda planning meeting.

February 19, 2021: Met with Beth Bachman to discuss 2021 pool operations.

February 22, 2021: Met with CONNECT staff and E&E Working Group Co-Chair to review new Materials Management Video.

STATEMENT OF INTEREST:

My name is Lillie Gabreski and I am responding to a call for resumes regarding openings on the

Planning Commission and the Traffic and Parking Commissions in the Borough of Dormont. My

fiancée and I bought our first home in the borough this fall, prior to that we lived in Mount

Washington for two years. We absolutely love Dormont, and almost exclusively looked at homes

in the borough as we knew it was where we wanted to be for the foreseeable future.

While I have not lived in Dormont long, I have a deep interest in civic participation. As the

project development planner at the Southwestern Pennsylvania Commission, the region's

federally-designated Metropolitan Planning Organization, I assist agencies and communities

across the ten-county region in receiving and utilizing federal and state transportation funding.

My position focuses on project delivery, which involves serving on project steering committees,

consultant-selection committees, meeting with various transportation bodies (FHWA, PennDOT,

municipalities, and nonprofit organizations), and coordinating to ensure that transportation

projects are accomplished in a timely matter and with the municipality or community’s best

interests in mind. Because of my work in both transportation planning and more general project

development planning, I have experience that I believe would add value to either the Planning or

the Traffic and Parking Commissions.

In my spare time, I also serve as a board member of the Young Preservationists Association of

Pittsburgh, which assists communities and local advocates in utilizing historic preservation

practices to spur economic development and restore or repurpose dilapidated structures.

If you have any questions regarding my history or resume, please do not hesitate to contact me. I

would love to apply the work I do on a regional level to the needs of the community in which I

Meeting Called to order at 6:01 PM by Mr. Massery.

Tennessee resident contacted committee regarding an issue of vehicles turning onto the dead-end side

of the street, not realizing it is “no outlet.” The existing “No Outlet” sign is set back from the corner

intersection, that drivers are not seeing it. Committee discussed moving existing sign closer to the

intersection for better sight, and adding additional sign across from this sign, on the back of the stop

sign.

Mr. Massery made motion to recommend:

- Moving existing “No Outlet” sign to the corner of Tennessee and Annex Avenues.

- Install additional “No Outlet” sign on other side of the street; on the back of the existing

stop sign.

Motion passed 5-0.

Mr. Estell received resident complaints regarding Ordinance Avenue. Two car accidents in the past

month from cars losing control during inclement weather and crashing into homes on Ordinance and

Connecticut Avenues. He has asked Borough Engineer to look into the issue, but does not believe there

is much that can be done to rectify situation, as Ordinance is very steep hill. He noted street had been

paved in the last few years, after PA American did work on the street. Committee discussed ideas of

installing compressed barricades, to absorb impact of car coming down Ordinance into existing concrete

barrier, making the concrete barrier more visible. Councilman Fabus suggested considering making

Ordinance Avenue a one-way street, possible seasonally. Mayor Walsh stated that the fire department

at times has blocked off Ordinance Avenue if weather conditions worsen quickly, but that it is not

always possible to do this. He indicated that there have been 4 reportable accidents in this area in the

last 10 years.

Mr. Massery made motion to recommend:

- Explore safety/warning options including: signage behind existing concrete barrier;

Review of Quotes

In my memo of January 14, 2021, I discussed my preliminary investigation of the

landslide at the eastern end of Dwight Avenue that began in November of 2020. I

finished my preliminary investigation with the recommendation that the borough reach

out to engineering firms that specialize in landslide investigation and remediation. With

your authorization I than contacted several firms that the borough had used in the past to

solicit quotes. I was able to get quotes from 3 firms, namely Gateway Engineers,

Remington & Vernick Engineers and Gannett Fleming, Inc.

In my request for quotes I advised that I was looking for a firm to perform a field

investigation of the slide, generate a report based upon the investigation, make

recommendations for slide remediation; and for each option, provide a budgetary cost

estimate for the repairs. A detailed design of the recommended option was not included

at this time.

The quotes I received ranged from a high of $35,350.00 from Remington & Vernick

Engineers, to a low of $16,839.50 (excludes field survey) from Gateway Engineers.

Copies of the 3 quotes are attached along with my comparison spreadsheet.

For this initial investigation and preliminary design stage, I would recommend Gateway

Engineers at a cost of $16,839.50.

For informational purposes, I estimate the later final design at approximately $10,000

plus a topographic survey estimated at $5,000. Gateway Engineers provided a price of

$5,450. At this time, I am just recommending award of the initial investigation and

preliminary design stage as the final design may vary as it is dependent upon the

rehabilitation option that may be selected by the borough. Plus, we may be able to get

the field survey from an alternate professional at a lower price.

We understand that the project entails evaluating a

landslide at the east terminus of Dwight Avenue. The

landslide is about 80 ft long and extends approximately

40 ft in elevation downslope of the roadway surface. In

order to assist you with the successful and timely

completion of the project, Gateway will undertake a

geotechnical investigation and prepare a report

describing the findings of the investigation, and

presenting remediation options and a range of costs for

each.

We propose to drill three (3) test borings to delineate

subsurface conditions at the site - two (2) along the

roadway and one (1) in the slide mass below the

roadway, if conditions have not changed from the time

we visited the site on January 14, 2021. On that date, it

was possible to advance a drill rig to the lower portion of

the slide mass with assistance from an excavator. If the

slide mass moved further downslope, we may not be able

to access that boring location, in which case the boring

would be eliminated. After we stake the boring locations

in the field, we will contact the PA One Call system to

attempt to locate public underground utilities in the

vicinity of the boring locations. However, as utility

companies responding to the system only locate their

public utilities on public property, your personnel should

locate all underground utilities in the vicinity of the

boring locations to provide safe drill rig access. An

excavator will be required to provide access to the boring

in the slide mass. The boreholes will be backfilled with

auger cuttings.

Once the borings have been completed, the samples will

be delivered to our office where they will be visually

classified. The project drawings and boring information

are then analyzed to develop remediaon options and a

range of costs for each, which will be presented in a

report. We will provide two (2) hours of post-report

consultation and/or meeting time to discuss our findings

and recommendations with the project team.

In support of the geotechnical services, we will utilize

conventional field surveying methods to obtain existing

conditions information and locating the test borings. We

will include the locations of the most current field

conditions and features such as roadways, curbs, walls,

sidewalks, fences, surface utility locations, storm and

sanitary structures, topographic spot elevations, and

other planimetric and topographic features. Contours for

the site will be provided at an interval of 2 feet. Property

line information will be shown on the plan using

evidence found in the field, the latest property

information obtained from Allegheny County, and by

rationalizing boundary evidence found during the field

survey phase. Existing underground utility information

will be shown on the plan based on record drawings

provided by utility companies involved in the area, as

well as by markings placed in the field by the utility

companies as a result of the One-Call process.

We assume with the current COVID-19 restrictions, all

meetings will be virtual and we have estimated our hours

accordingly. We do assume that our geotechnical and

surveying field crews will be permitted on the site with

no delays.

Please refer to the “Scope of Services” section of this

proposal for additional information pertaining to the

project requirements. Additional services, if requested,

would be completed under a separate work authorization.

Scope of Services

Geotechnical Investigation

1. Subsurface Explorations

a. Drill a total of three (3) test borings to delineate subsurface conditions at the site - two (2) along the

roadway and one (1) in the slide mass if the site conditions have not changed from the time we visited the

site on January 14, 2021. If the slide mass moved further downslope, we may not be able to access that

boring location, in which case the boring would be eliminated.

b. Standard penetration tests (SPTs) will be conducted continuously in the soil mantle (both cohesive and

cohesionless soils) of all borings in compliance with ASTM International Test Designation: D1586-11.

The SPTs will be continued to refusal on bedrock from which level at least five (5) feet of continuous NQ-2

(2-in-dia) rock core will be procured from each.

c. Backfill the boreholes with auger cuttings.

2. Engineering Services

a. Plan and program the subsurface explorations.

b. Stake the test boring locations in the field and determine their ground surface elevations with respect to

existing site features.

c. Review available published documentation to determine if underground hazards, such as abandoned mines,

have been identified as being present below the site.

d. Direct field sampling and testing operations.

e. Determine the groundwater table elevation, if any is encountered in the test borings.

f. Conduct soil and rock laboratory physical classification tests.

g. Correlate and analyze the field and laboratory test results.

h. Prepare a report describing the findings of the investigation, and presenting remediation options and a range

of costs for each.

i. Provide two (2) hours of post-report consultation and/or meeting time to discuss our recommendations with

the project team.

Existing Conditions Survey

1. Field Surveying Services

a. Obtain existing planimetric and topographic features for the subject property, which are evident on the

ground surface.

b. Locate existing ground surface utility structures, including top and flow line elevations of storm and

sanitary structures, as well as the next upstream and downstream structures.

c. Locate property and right of way control evidence for the subject property and on the adjoining property.

d. Locate the test borings and obtain their ground surface elevations.

e. Perform a field check of the plan for verification of obtained information.

2. Office Surveying Services

a. Perform property research at the Allegheny County Courthouse for existing deeds and/or recorded plans

of the subject property.

b. Place a PA-One Call for markings to be placed in the field within the area of the subject property.

c. Obtain underground utility information by way of written correspondence only and show utility lines

as per the information provided by the utility companies.

d. Perform property line rationalization, which will entail the review of physical control points located

during the field survey, as well as deeds and recorded plans on record.

e. Establish the right of way and boundary lines for the subject properties.

f. Prepare a final Existing Conditions Survey showing planimetric and topographic features.

g. Perform a QA/QC office check of the plan.

h. Submit final digital files and hardcopies of the survey.

Attachment

General Terms and Conditions

Invoicing and Payment Invoicing for this project will occur monthly as work is performed. Payment is due thirty (30) days after receipt of the invoice. The

Gateway Engineers, Inc. (hereinafter referred to as “Gateway”) must be notified in writing of any questions concerning an invoice within ten (10) days. Failure to

do so within the prescribed time frame constitutes acceptance of the invoice. Gateway reserves the right to stop work immediately on any project and hold work

in progress (if applicable), if an invoice is 60 days past due or older. If Gateway initiates legal proceedings to collect delinquent invoices, Gateway shall be

permitted to recover all legal fees and costs associated with collecting such delinquent invoices.

Rate Escalation If the attached scope of work is performed on a time and materials basis and work extends beyond the calendar year of the acceptance of this

contract, Gateway will adjust the hourly billing rates to its newly-adopted standard hourly rate schedule.

Additional Work If any additional work is required beyond the scope of the agreement, the cost for the additional work will be presented for your approval prior

to commencement of work. Additional work may be completed under this contract upon receipt of an Additional Work Authorization Form signed by the Client.

Additional work will be invoiced monthly as work is performed in accordance with the standard hourly rate schedule in force at that time.

Direct Expenses Printing/plotting costs for the project are not included in the proposal price. The cost for these services is $0.20 per 8½x11 color laser copy,

$0.35 per 11x17 color laser copy, $0.12 per square foot for prints, $0.75 per square foot for color prints and $0.95 per square foot for mylars.

Subconsultants In the completion of this contract, Gateway may use subconsultants at its discretion in order to complete the scope of work in a timely and

efficient manner. The costs of these subconsultants are included in the estimated fee of the project, if provided.

Work Product All plans, specifications, letters, reports and other products provided by Gateway are intended to satisfy the scope of this project only. Gateway is

not liable for the use of its work product by anyone for any purpose other than by the Client for this project and in accordance with this contract.

Changed Conditions Gateway will promptly notify the Client in writing if it discovers conditions or circumstances that were not contemplated at the

commencement of this contract, which in Gateway’s judgment significantly affect or may affect the services or the recommended scope of services. Subsequent

to that notification, the Client and Gateway will either negotiate a revised scope and estimated fee or terminate the contract.

Assumptions, Services and Information Provided By Others This contract assumes the base conditions to be true as set forth in the proposal, and likewise

assumes that services and/or information provided by the Client or their agents is accurate and in a useable form. If these assumptions are found to be untrue, an

additional fee may be required to compensate Gateway for any extra work.

Hazardous Materials The Client agrees to advise Gateway about the presence of any known hazardous substances or any known condition existing in, on, or near

the site presenting a potential danger to human health or the environment. Gateway does not have any responsibility to locate, identify, evaluate, treat or

otherwise consider or deal with hazardous materials.

Access/Right of Entry Unless otherwise agreed, the Client will provide access to the land and/or facilities for Gateway and its subconsultants. Gateway will take

reasonable precautions to minimize damage to said land or facilities by its personnel and/or equipment.

Termination This contract may be terminated by either party upon fourteen (14) days prior written notice. In the event of termination, Gateway shall be

compensated by the Client for all costs incurred and services performed up to and including the termination date.

Limitation of Liability Gateway, its shareholders, directors, officers, employees and agents, shall not be liable to the client for any special, consequential,

incidental or penal losses or damages.

Indemnification Gateway agrees to indemnify and hold harmless the Client and its officers, directors, and employees from and against any and all claims, suits,

liability, damages, injunctive or equitable relief, expenses including reasonable attorneys’ fees, or other loss to the extent caused by Gateway’s negligent

performance of services. The Client agrees to indemnify and hold harmless Gateway and its agents, subcontractors, directors, officers and employees from and

against any and all claims, suits, liability, damages, injunctive or equitable relief, expenses including reasonable attorneys’ fees, or other loss arising from

damage to subterranean structures or utilities unless correctly shown on plans furnished by the Client, or arising from any negligence, gross negligence or willful

misconduct by the Client and/or its officers, directors, employees and agents.

Insurance During the terms of any contract which might result from this proposal, Gateway will have in force the following types of minimum insurance

coverages: A) professional liability – $4,000,000 per claim/$4,000,000 aggregate limit, B) workman’s compensation – statutory limits, C) general liability –

bodily injury/property damage $1,000,000 per occurrence, D) automobile liability – bodily injury/property damage $1,000,000 combined; uninsured and under

insured motorist $35,000, and E) excess liability $8,000,000.

Laws and Severability This contract shall be subject to, interpreted, and enforced according to the laws of the Commonwealth of Pennsylvania. If any part of this

contract shall be held illegal, unenforceable, void, or voidable by any court of competent jurisdiction, each of the remainder of the provisions shall nevertheless

remain in full force and effect and shall in no way be affected, impaired, or invalidated.

Assignment The Client and Gateway respectively bind themselves, their successors, assigns and legal representatives to the other party to this agreement and to

the partners, successors, assigns and legal representatives of such parties with respect to all covenants of this contract. Neither the Client nor Gateway shall

assign, sublet or transfer any interest in this contract without the consent of the other.

2021 Open Cut Spot Repair Project

In February the Borough advertised for bids for the 2019 Open Cut Repair Contract. On

Wednesday, February 27, 2019, the Borough received bids for the project. Three sets of bid

documents were issued/sold and two bids were received. The following are the results of the bids

received. A bid tabulation for project is attached:

1. NIANDO Construction, Inc. Base Bid: $ 84,039.00

Pittsburgh, PA 15235

2. Stafanic's Next Generation Base Bid: $226,940.00

Aliquippa, PA 15001

3. S.E.T., Inc. Base Bid: $172,063.07

Aliquippa, PA 15001

My review of the bids indicates that all totals are mathematically correct and do contain all required

documentation properly executed in accordance with the requirements of the bid specifications.

The Borough is familiar with the work of the low bidder, NIANDO Construction, Inc., having

worked with them in the past, most recently on the 2019 Open Cut Spot Repair Project and the

Comprehensive Sewer Rehabilitation Project. My experience with this contractor is that they

compete the projects within budget in a timely professional manner.

After review of the bids, I find the apparent low bidder, NIANDO Construction, Inc., to be the

lowest responsive and responsible bidder. Based upon the Borough’s experience with this bidder

and the value of the bid, I would recommend award of the Contract to NIANDO Construction,

Inc. in the amount of $84,039.00.

CENTRAL BUSINESS DISTRICT

VACANT PROPERTY ORDINANCE

AN ORDINANCE OF THE BOROUGH OF DORMONT, ALLEGHENY COUNTY, STATE OF PENNSYLVANIA, ENACTING REGULATIONS RELATING TO VACANT BUILDINGS IN THE CENTRAL BUSINESS DISTRICT, IN ADDITION TO THE

PROVISIONS SET FORTH IN THE ADOPTED INTERNATIONAL PROPERTY MAINTENANCE CODE.

The Borough finds as follows: A. The central business district (contained in the C Zoning District) is the most publicly visible area in this

community. The condition of this district has significant economic and social impact on the community. B. When the owner of a vacant property in the central business district (C Zoning District) fails to actively

maintain its condition and appearance, and does not strive to keep the property occupied with legally permitted uses, the building can become a major cause of blight to this community. Vacant buildings discourage economic development and negatively impact appreciation of property values.

C. It is the responsibility of property ownership to prevent their property from becoming a burden to this

community and to the public health, safety, or welfare. D. One vacant property that is not well maintained and managed can be the core and cause of spreading

blight. Section 1. Applicability and Scope: The requirements of this ordinance shall be applicable to every property in the “C” zoning district in the Borough of Dormont, and to each owner of any property in the “C” zoning district that has a vacant “ground floor” space, as defined by this ordinance.

Section 2. Definitions: As used in this Ordinance the following words and phrases shall have the meanings indicated unless the context clearly indicates a different meaning: Property: Improved real estate including buildings or structures. Vacant: A building or structure space shall be deemed to be vacant if no person or persons

currently conduct a lawfully licensed use in said space. Ground Floor: Any floor of a building with direct access to grade, that is located less than one story

above, or less than one story below grade, provided that no portion of a floor that constitutes a cellar (as defined in this article) shall constitute a “ground floor”.

Cellar: A room typically used for storage and mechanical equipment that is located in the basement of a building and is not used for commercial or residential purposes.

Section 3. Vacant Property Monitoring Fee: During each calendar year, the municipality will identify ground-floor spaces in the “C” Zoning District that are deemed vacant as defined by this ordinance. The vacancy “Start Date” shall be the date of mailing of a written notification by the municipality that the subject property’s ground-floor space has been identified as vacant. On the 45th day after the “Start Date”, should said ground floor space remain vacant as defined in this ordinance, the owner of the building in which said vacant space is present shall be required to pay a vacant property monitoring fee, to be established by resolution of the municipal government. There shall be no pro-ration of the monitoring fee. The monitoring fee shall not be imposed on vacant properties, as defined in this ordinance, that are the subject of an active building permit for repair or rehabilitation, and the owner is progressing diligently to complete said repair or rehabilitation.

Section 4. Vacant Property Monitoring Fee Waiver: The monitoring fee, as required herein, shall be waived in full by the municipality if, by the 45th day after written notification as described in Section 3 herein, all of the following conditions are present: 1. The street-level exterior building components in which said ground-floor vacancy is identified are clean (including glass inside and out). A minimum of 70% window transparency must be maintained. 2. The property is not in violation of any provision of the Township’s property maintenance code(s), or any other municipal ordinance. 3. A professionally produced legal sign is prominently displayed promoting the vacant space for sale and/or for lease, providing (at least) a contact phone number for information and showings. Said sign must be incompliance with applicable sign ordinance(s), and at minimum it’s font size must be reasonably readable from the adjacent roadway. Handwritten signs are not permitted relative to this requirement. 4. All local real estate taxes are paid in full. The monitoring fee waiver may be revoked by the municipality if any of the above required conditions is not in place continuously until the vacant condition no longer exists. Section 5. Severability: If any section, subsection, sentence, or clause of this Ordinance is held, for any reason, to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance.

MEMORANDUM OF AGREEMENT BETWEEN THE INTERNATIONAL ASSOCIATION

OF FIRE FIGHTERS, LOCAL NO. 3584 AND THE BOROUGH OF DORMONT

Whereas, I.A.F.F., Local No. 3584 (“Local 3584”) and the Borough of Dormont

(“the Borough”) are parties to a collective bargaining agreement that became effective

January 1, 2020 and remains effective until December 31, 2023 ("CBA");

Whereas, within the CBA, Local 3584 and the Borough agreed that they would

reopen the CBA for the purpose of implementing a cost neutral Deferred Retirement

Option Plan (“Drop Plan”) and that the pension calculation shall be based upon the

highest 36 months of consecutive earnings;

Whereas, in preparation for the re-opener, the Borough requested an actuarial

study from the Borough’s pension actuary and both parties have reviewed and relied

upon such actuarial study in reaching an agreement as to the terms and conditions of

the Drop Plan that will be implemented;

Whereas, the Borough and Local 3584 were able to agree upon the following

terms to resolve the outstanding issues with regard to the Drop Plan reopener and

agree to add the following provision into Article V, Section E. of the CBA as follows:

E. The Borough and the Union agree to implement a Deferred Retirement Option Plan, here in referred to as a DROP Plan on January 1, 2021. The Borough will amend the Borough’s Pension Plan to provide the following Drop Plan for all bargaining unit employees and the Fire Chief who qualify and voluntarily elect to participate:

1. Eligibility: A member may become a participant in the DROP after attainment of Age 57 and completion of 20 years of service. 2. Election of Participation: Election to participate in the DROP is irrevocable. The member shall make the election by using forms and procedures prescribed by the Borough’s Non-Police Employee Pension Board.

3. DROP Pension Payments: Upon entry into the DROP; a member's service and average applicable compensation shall be frozen and his/her DROP pension payment shall be calculated as if he/she actually retired on the date he/she entered the DROP. The monthly DROP pension payment shall be credited to the member's individual DROP account. No assets shall be segregated due to the establishment of individual DROP accounts. There shall be no additional costs other than administrative costs to the Borough’s Non-Police Employee Pension Plan. 4. Individual DROP Account: A member's individual DROP account at any time is equal to the sum of the monthly DROP pension payments credited to the

account, accumulated with interest at the rates of a minimum of 0% to a maximum of 4% compounded monthly, based on the performance of the investments in the fund.

5. Maximum Participation: The maximum participation in the DROP is thirty-six (36) months. Once the maximum participation has been achieved, the member must terminate employment and separate from service. Upon separation from service, the monthly payments shall be paid directly to the member and will no longer be credited to the member’s individual DROP account. 6. Minimum Participation: There shall be no minimum participation in the DROP. The member may terminate employment and separate from service with no restriction. Upon separation from service, the monthly payments shall be paid directly to the member and no longer credited to the member's individual DROP account. 7. Distribution Options: Commensurate with DROP participation, a member shall make an election, on forms designated by the Borough’s Non-Police Employee Pension Board, of the payout option(s) he/she wishes at the termination of the DROP period. This election may be changed at any time prior to termination. The distribution Options are as follows:

1) A full lump sum distribution; 2) Rollover to another qualified retirement plan (as permitted by law) or to an IRA; or 3) Any other distribution provided by the Borough’s Non-Police Employee Pension Board/Third Party Administrator.

8. Beneficiary Designation: Commensurate with DROP participation, a member shall make an election, on forms designated by the Borough’s Non-Police Employee Pension Board, of the beneficiaries he/she wishes to receive the monies in his/her individual DROP account in the event of his/her death before all monies have been distributed.

9. Disability: A member who becomes permanently disabled during the DROP

period and retires from service shall revert to his/her normal retirement pension and to directly receive these pension payments which were being deposited into his/her individual DROP account.

10. Employee Pension Contribution: Effective January 1, 2021, if the total number of firefighters and the Fire Chief exceeds the number seven (7), any such newly hired employee shall pay $27.47 per pay (26 pays during a year) into the pension plan. Effective January 1, 2023, all of the employed firefighters and the Fire Chief shall each pay $27.47 per pay (26 pays during a year) into the pension plan. The employee pension contributions shall be a pre-tax deduction

and the pay stubs and all other applicable payroll documentation shall designate the deduction as a “Drop Pension Contribution.” 11. All firefighters shall continue to receive compensation increases while participating in the drop, however no such increases shall be factored into pension calculations once they have formally entered into the Drop Program.

Whereas, as a matter of housekeeping, the Borough and Local 3584 agree to move the pension calculation language (highest 36 months of consecutive earnings) to Article V, B, which shall be amended to provide as follows: B. Said pension is to be calculated on the basis of the highest thirty-six (36) months of consecutive earnings said employee worked or was paid prior to retirement. Whereas, all other terms and conditions within the CBA shall remain as is.

67 Definitions.

DROP – The Deferred Retirement Option Plan is created as an optional form of benefit

under the existing Borough of Dormont Fire Retirement Plan.

DROP Account – An interest-bearing, ledger account in a separate pension trust fund

established for a DROP participant.

Member – A full-time Borough of Dormont Fire officer covered by the Plan.

Participant – A Member who is eligible for DROP retirement, having reached fifty-seven

years of age and attained twenty years of service, and who has elected to participate in the DROP

program.

Plan – The Borough of Dormont Non-Uniformed Pension Plan.

68 DROP Provisions.

(1) Deferred Retirement Option Provision (DROP) Overview – The Plan shall provide for

a deferred retirement option provision, hereafter referred to as “DROP” for Participants who

qualify for and apply for such option pursuant to this Article. In general, the DROP provides

Participants who are eligible for DROP Retirement and meet the DROP Eligibility requirements

in Section 2, the opportunity to continue working and still be entitled to their pension benefit. Such

a Participant would “retire” from the Plan on the date of their choosing and would agree to finally

separate from active service at a date no more than 36 months later. A calculation is made of the

monthly Normal Retirement Benefit as of the DROP Participation Date. The DROP Participant is

then considered retired for all pension plan purposes. The amount of each monthly benefit is

credited to the Participant’s DROP Account, along with interest, while the Participant is still

actively employed. When the Participant finally leaves employment, the value of the DROP

account is distributed to the Participant (either a lump-sum, rollover) and the monthly benefits are

paid directly to the Participant.

(2) Eligibility. Starting on January 1, 2021, Members of the Borough of Dormont Fire

Department bargaining unit who have not retired prior to the implementation of the DROP

program, who have reached fifty-seven years of age and completed 20 or more years of credited

service with the Borough of Dormont, or who will meet those requirements prior to participation

in the DROP, will be eligible to participate in the DROP. A Member’s maximum DROP

participation period shall be 36 months.

Participation in the DROP does not guarantee the DROP Participant’s employment by the

Borough during the specified DROP period.

(3) Written Election. An eligible Member of the Plan electing to participate in the DROP

program must complete and execute a “DROP Election Form” prepared by the Borough of

Dormont, which shall evidence the Member’s participation in the DROP program, and document

the participant’s rights and obligations under the DROP. The form must be signed and notarized

by the Member and submitted to the Borough of Dormont at least 30 days prior to the Member’s

effective date of retirement. Such Election must detail a DROP Participant’s rights and obligations

under the DROP and include an agreement to forego: a) active Membership in the Plan; b) any

growth in the salary base used for calculating the retirement benefit; and c) any additional benefit

accrual for retirement purposes, including any length-of-service increments. The DROP

Participant shall be required to provide any other information required by the Plan Administrator.

The DROP Election Form shall include an irrevocable notice to the Borough of Dormont

by the Member that the Member shall terminate from employment with Borough of Dormont Fire

Department effective on a specific date no later than three years from the effective date of the

DROP election. A Member’s maximum DROP participation period shall be 36 months. A Member

shall cease work as a Borough of Dormont Fire Officer on the Member’s resignation date, unless

the Borough terminates or honorably discharges the Member prior to the resignation date. In

addition, all retirement documents required by the Plan Administrator must be filed and presented

to the Borough Council. Once the retirement application has been approved by the Borough, it

shall become irrevocable.

After a Member enters the DROP Program, contributions to the pension plan by the

Participant and the Borough will cease, and the amount of the monthly benefit will be frozen.

Members are hereby advised to consult a Tax Advisor, of their choice, prior to considering

the DROP program, as there may be serious tax implications and/or consequences to participating

in the DROP program.

(4) Limitation on Pension Accrual. After the effective date of the DROP election, the

Participant shall no longer earn or accrue additional years of continuous service for pension

purposes.

(5) Benefit Calculation. Upon receipt of a Participant’s Election form to participate in

DROP, the Employer shall calculate the Normal Retirement Benefit based on the Employee’s

years of Aggregate Service and Average Monthly Compensation for the Employee’s highest thirty-

six (36) months of consecutive earnings as of the Employee’s DROP Participation Date. The

monthly benefit shall be fixed at that time for the duration of the DROP participation and for the

rest of the retiree’s life thereafter. For all Plan purposes, continuous service of a Member

participating in the DROP program shall remain as it existed on the effective date of the

commencement of participation in the DROP program. Service thereafter shall not be recognized

or used for the calculation or determination of any benefits payable by the Plan. Earnings or

increases in earnings after the effective date of commencement of participation in the DROP

program shall not be recognized or used for the calculation or determination of any benefits

payable by the Plan.

(6) Payments to DROP Account. A DROP Account shall be established as an interest-

bearing ledger account in the pension trust fund in the name of the DROP Participant for purposes

of accumulating DROP Retirement Benefits during DROP Participation. The account balance shall

be accounted for separately but need not be physically segregated from other pension trust fund

assets. Whether or not a DROP Account is physically segregated from other trust fund assets shall

be at the sole discretion of the Plan Administrator. Starting with the calendar month following the

DROP Participation Date, the amount of the DROP Retirement Benefit shall be credited to the

DROP Participant’s DROP Account each month during the DROP Participation. Interest shall be

credited to the DROP Account. The rate of interest shall be the actual rate of return on the DROP

Account, but no less than zero percent (0%) and no more than four (4%) per year. This will be

accomplished by use of a fixed rate of return, guaranteed investment vehicle with a rate of return

between 0% and 4%, such as a certificate of deposit or other similar investment.

(7) Early Termination. A DROP Participant may change the DROP termination date to

an earlier date and no penalty shall be imposed for early termination of DROP participation. Notice

should be provided to the Borough at least 60 days prior to any such early termination, unless the

reason for the early termination is due to a Total and Permanent Disability. Upon either early or

regular termination of DROP participation, the DROP Participant shall be separated from

employment with the Borough and the retirement Plan shall pay the balance in the DROP

Participant’s DROP Account to the terminating Participant as provided in section 8 and the DROP

Participant shall be ineligible to re-enroll in the DROP thereafter even if the former DROP

Participant is re-employed by the Borough.

(8) Payout. Upon the termination date set forth in the DROP Election Form or on such

date as the participant withdraws or is terminated from the DROP program, if earlier, the normal

retirement benefits payable to the participant or the participant’s beneficiary, if applicable, shall

be paid directly to the participant or beneficiary and shall no longer be credited to the DROP

Account. Within 45 days following the actual termination of a participant’s employment with

Borough of Dormont, the accumulated balance in the DROP Account shall be paid to the

participant in a single lump-sum payment or rolled over into another qualified retirement plan or

to an IRA. At the option of the participant, such payment shall be made either in cash, subject to

any federal withholding as may be required, or as a direct rollover to an Individual Retirement

Account (IRA) or other qualified retirement account as permitted by law. If the participant selects

the rollover option, he or she must also submit the appropriate paperwork from the IRA or other

qualified retirement plan custodian within 20 days following termination or within the required

election period, whichever is shorter. If the Participant, Participant’s survivor or beneficiary fails

to elect a method of payment within 60 days after the Participant’s termination date, the Borough

shall pay the balance as a lump sum.

Following termination of DROP participation, the subsequently paid normal retirement

benefits payable to the Participant, Participant’s survivor or the Participant’s beneficiary shall no

longer be credited to the DROP Account but shall be distributed monthly pursuant to normal

retirement benefit plan rules.

Following termination of DROP participation, the DROP Participant shall be ineligible to

re-enroll in the DROP thereafter even if the former DROP Participant is re-employed by the

Employer.

(9) Disability During DROP. If a participant becomes eligible for a disability pension

benefit and terminates employment, the monthly normal retirement benefit to the DROP

participant shall terminate.

(10) Death. A DROP participant’s eligibility to participate in the DROP terminates if the

DROP participant dies. The monthly benefit credited to the participant’s DROP Account during

the month of the participant’s death shall be the final monthly benefit for DROP participation. If a

participant dies before the DROP account balance is paid, the participant’s beneficiary shall have

the same rights as the participant to withdraw the DROP Account balance. Except for those

benefits specifically payable as a result of death incurred in the course of performing a hazardous

public duty, the survivors of a DROP participant who dies shall not be eligible to receive retirement

system death benefits payable in the event of the death of an active Member. The DROP

participant’s survivor shall be eligible to receive retirement system death benefits normally

payable in the event of the death of a retired employee.

(11) Amendment. Any amendments to the DROP Ordinance shall be consistent with the

provisions covering deferred retirement option plans set forth in any applicable collective

bargaining agreement or state or federal law, and shall be binding upon all future participants and

upon all participants who have balances in their DROP Accounts.

69 Effective Date.

The effective date of the DROP program will be January 1, 2021.

70 Expiration of DROP Provisions.

If at any time it is determined that the Borough has incurred actual costs in connection with

the DROP benefit, this DROP Benefit provision shall automatically expire and be removed from

the parties’ Collective Bargaining Agreement.

If, the Borough determines that there has been a cost incurred due to the DROP benefit

such that the Borough takes the position that the DROP benefit should immediately expire (sunset),

the parties shall meet to discuss whether there is a way to mitigate the cost identified by the

Borough. If, within three months of the Borough’s notification to the Union, the parties are unable

to mitigate the cost to the satisfaction of both the Borough and the Union, then the DROP benefit

shall expire (sunset) immediately.

71 Severability.

The provisions of this ARTICLE XIV, IAFF DEFFERED RETIREMENT OPTION

PLAN, shall be severable, and if any of its provisions shall be held to be unconstitutional or illegal,

the validity of any of the remaining provisions of this Section shall not be affected thereby. It is

hereby expressly declared as the intent of the Borough of Dormont that this Section has been

adopted as if such unconstitutional or illegal provision or provisions had not been included herein.

72 DROP Legislation.

DROP benefits pursuant to this Article shall at all times comply with Act 205 of 1984, as

amended by Act 44 of 2009 and any subsequent amendments.

Borough of Dormont COVID-19 LEAVE POLICY

DEFINITIONS:

• Quarantine keeps someone who might have been exposed to the virus away from others. • Quarantine time period is typically 10-14 days from the date of last exposure to a COVID-

19 positive person, but can vary based on the facts of the individual case. • Quarantine periods are determined based on CDC/Pennsylvania Department of

Health/Allegheny County Health Department guidance and the health circumstances of each individual.

• COVID-19 Leave shall be up to ten (10) days of administrative leave. Said leave shall be in addition to an employee's sick leave.

ELIGIBILITY The COVID-19 Leave is available to all full-time staff as outlined below.

The staff member must contact the Borough Manager immediately regarding COVID-19 exposure, symptoms, positive COVID-19 tests, or quarantine orders. Eligible staff members who meet the following criteria will qualify for the COVID-19 Leave: • A staff member who is diagnosed with the COVID-19 virus and is unable work remotely

or too ill to work; • A staff member who is experiencing symptoms of COVID-19 as defined by the Centers

for Disease Control, has been tested and is awaiting test results in quarantine at home; • A staff member who has been advised by Borough Manager, local health authority, or

their medical provider to quarantine due to concerns related to possible COVID-19 exposure, and is waiting for the test result and is unable to work remotely or too ill to work;

• A staff member who is subject to a federal, state, or local quarantine or isolation order related to COVID-19 and is unable to work remotely or is too ill to work; or,

• A staff member who is advised by a household member's medical provider to quarantine due to concerns related to COVID-19 and is unable to work remotely or is too ill to work.

PROCESS Staff members eligible for COVID-19 Leave shall:

1. Make a request to the Borough Manager to use COVID-19 Leave. 2. Staff must provide documentation supporting their request. Documentation may take the

form of a doctor's note, other similar medical documentation, or the employee's attestation.

EXPIRATION This policy shall expire on December 31, 2021.

RESOLUTION NO. 4, 2021

RESOLUTION OF THE COUNCIL OF THE BOROUGH OF DORMONT ESTABLISHING RATES OF PAY FOR NON-UNION BOROUGH OF DORMONT CROSSING GUARDS FOR THE YEAR 2021. Whereas, the Borough of Dormont employs both union and non-union employees; and Whereas, non-union pay rates and benefits are required to be annually approved by Council of the Borough of Dormont; and NOW, THEREFORE, BE IT RESOLVED, that the Council of the Borough of Dormont approves the following monthly salaries for non-union Borough of Dormont employees for the year 2021, to begin on January 1, 2021, with compensation payable in bi-weekly installments in a manner identical to all Borough employees: Position Hourly Salary Crossing Guard-Less than One Year of Service $14.00 Crossing Guard-More than One Year of Service $15.00 Guards shall be paid a minimum of four hours for each day worked. AND BE IT FURTHER RESOLVED, that the Council of the Borough of Dormont approves the following benefits for non-union Borough of Dormont crossing guards for the year 2021, to begin on March 1, 2021:

A. PERSONAL LEAVE

All crossing guards are entitled to three (3) days (four hours per day) of personal leave per year. These days do not accumulate and cannot be sold back.

B. BEREAVEMENT All crossing guards are entitled to three (3) days of bereavement leave for the death of: spouse, children, parents.
