    The regular meeting of the Town of Franklin Board of Aldermen was held on Tuesday,September 3, 2013 at 7:00 P.M. in the Town Hall Board Room. Mayor Joe Collins presided.Aldermen Verlin Curtis, Joyce Handley, Farrell Jamison, Billy Mashburn, Carolyn Pattillo andBob Scott were present.Approval of the MinutesMotion was made by Handley, seconded by Jamison to approve the minutes for the August5, 2013 meeting as presented. Motion carried. Vote: 6 to 0.Public SessionDan Williams - Dogwood Drive needs to be cleaned up.Angela Moore - I would like to thank each nonprofit for the services they provide to ourcommunity. I am here tonight to ask the Town Board to reconsider their decision to give taxdollars to nonprofit organizations. The Town Board should consider placing this money back inthe Town of Franklin's general fund. I f he Town Board did this they could lower taxes.New Business - Proclamation for Constitution WeekMotion was made by Scott, seconded by Curtis to proclaim September 17 - 23, 2013 asConstitution Week in Franklin. Motion carried. Vote: 6 to 0. A copy of the proclamationis attached.New Business - Resolution Honoring S. Ellis HankinsMotion was made by Handley, seconded by Pattillo to approve a resolution honoring S.Ellis Hankins of the North Carolina League of Municipalities for faithful service andlasting contributions to municipal government. Motion carried. Vote: 6 to 0. A copy ofthe resolution is attached.New Business - Proclamation for International Institute of Municipal ClerksMotion was made by Scott, seconded by Mashburn to proclaim support for the City ofGreensboro to host the 2018 International Institute of Municipal Clerks AnnualConference to be held sometime in May. Motion carried. Vote: 6 to 0. A copy of theproclamation is attached.

    New Bnsiness - Pnblic Hearing for Panline Avenue II Rezoning ReguestMotion was made by Curtis, seconded by Pattillo to set a public hearing for the PaulineAvenue II rezoning request for Monday, October 7, 2013 at 7:10 P.M. Motion carried.Vote: 6 to 0.New Business - Presentation of Southwestern Community CollegeDr. Don Tomas - Southwestern Community College is seeing an increase in the number ofstudents attending the Cecil Groves Center located at the Macon County campus. This yearalone there has been a 7.3 percent growth in the number of students. There has also been a 2.0percent increase in the number of course hours students are taking. The college is working tosecure grants from various state and local organizations to help expand programs.New Business - Presentations by Applicants for Fiscal Year 2013-2014 Nonprofit FundingPoolAngel Medical Center - Don Capaforte - Our request is for $5,000.00. It will be used formedication assistance for low income patients and senior citizens living inside the town limits ofFranklin.Community Care Clinic ofFranklin- Franklin Ingram- Our request is for $10,000.00. It will beused for operating costs associated with the clinic. For three years the clinic received fundingfrom the North Carolina Department ofRural Health. The funds have been depleted.Franklin Garden Club - Susan Simmons - Our request is for $3,000.00. It will be used forupgrades and maintenance to the Clock Tower and Rankin Square. We try to make the gardensat the Clock Tower and Rankin Square one of the highlights of the downtown area.KIDS Place - Alisa Ashe - Our request is for $5,000.00. It will be used to provide services tochild victims of abuse. KIDS Place conducts forensic interviews, medical evaluations, traumafocused therapy, case management and community education for abused children.Macon County Care Network- Shaina Adkins - Our request is for $5,000.00. $3,700.00 will beused for an air conditioning unit in the food pantry warehouse. $1,300.00 will be used to assistresidents with water bills.Macon County Habitat for Humanity- Rick Westerman - Our request is for $5,000.00. It will beused to rehabilitate housing. The funding will be used to build wheel chair ramps, roof repairsand other improvements in terms of accessibility.

    Macon County Historical Society Museum - Bob Poindexter - Our request is for $5,000.00. Itwill be used for renovations on the third floor of the museum. We did not receive last yearfunding that was allotted to the museum. We would like to formally request this funding at thistime.Macon County Public Library - Carol Bryce - Our request is for $5,000.00. It will be used forthe Reading Rover. It goes to six child care centers each month.R.E.A.C.H. ofMacon County- Jennifer Turner Lynn- Our request is for $5,000.00. It will beused for court advocacy, counseling and shelter costs. We provide services to victims andchildren of domestic violence and sexual assault. In the past year we provided shelter to fiftyfour women and children. We provided 5,475 meals to victims of domestic violence and sexualassault.Read2Me - Gary Dills - Our request is for $6,000.00. It will be used for the Dolly PartonImagination Library. The library delivers one book per month to a child from birth to the age offive.Scottish Tartans Museum - Nancy Deeks - Our request is for $2,829.25. It will be used topurchase a security system and one year basic digital security service for the museum. Thismuseum is the only one in the world besides the one located in Scotland. We need to borrowexhibits from other museums and will be able to do so with a security system.Smoky Mountain Pregnancy Care Center - Jenny Golding - Our request is for $4,000.00. It willbe used to educate the public about pregnancy and parenting. Today the center did threepregnancy tests.The Board took no action.RecessMayor Collins recessed the meeting at 8:20 P.M.Mayor Collins reconvened the meeting at 8:25 P.M.

    New Business - Lease on Old Land FillWarren Cabe - Town Manager - We still own the property where the old land fill is located.Macon County is leasing this property. A charter club of the Academy of Model Aeronauticscalled Franklin 111/C Flyers is using the property as an airfield for model airplanes. MaconCounty wants to enter into a lease with this group. We need to be a part of the lease.John Henning, Jr. - Town Attorney - I have reviewed the agreement and it is more of a licenseagreement. This agreement would protect the Town if someone gets hurt on the property.Motion was made by Scott, seconded by Jamison to approve the license agreement aspresented between the Town of Franklin, Macon County and the Franklin 111/C Flyers#4643. Motion carried. Vote: 6 to 0. A copy of the agreement is attached.New Business - Tax ReleaseWarren Cabe - Town Manager - Thomas C. Cole's property was annexed into town. This Parcel#6594456703 is a total of7.75 acres. Only 1.75 acres of this parcel is inside town according tothe Macon County tax records. Mr. Cole has sent a written request asking for a release.Motion was made by Handley, seconded by Pattillo to release the portion outside the townlimits in the amount of$593.35 from Thomas C. Cole's tax bill. Motion carried. Vote: 6 too.

    New Business - Update on Street Maintenance Ranking SystemWarren Cabe - Town Manager - Land Use Administrator Derek Roland and I have startedranking the streets. At next month's meeting we will be presenting more information on thestreets needing repairs.Legal - Attorney ContractWarren Cabe - Town Manager - John Henning, Jr. is currently under contract as the Townattorney. His contract has expired and he is currently working month to month. The newcontract is exactly the same as the one you approved in 2009. The term of the contract remainsat three years with a one year option. My recommendation is to approve the contract.Motion was made by Jamison, seconded by Handley to approve the contract with Henningand Henning Law Firm for three years beginning on September 3, 2013 with a one yearoption. Motion carried. Vote: 6 to 0.

We have been parkingour cars at Sonic where the public can come. We have gotten too big for this location. We wouldlike to start using the location where Pickin' on the Square is done. Our plans are to do an eventon October 11, 2013 from 6:00 P.M. to 9:30 P.M.Motion was made by Handley, seconded by Pattillo to close Main Street and lotla Street forthe car event on October 11, 2013 from 6:00 P.M. to 9:30 P.M. Motion carried. Vote: 6 to0.New Business -Tax ReleaseMotion was made by Pattillo, seconded by Curtis to release $175.69 on Stanley EugeneSchauf property located at 460 Trimont Trail due to the age exemption approved byMacon County. Motion carried. Vote: 6 to 0. Information copies are attached.New Business - Discussion on the Nonprofit Funding Pool ApplicationsWarren Cabe - Town Manager - The total request for funds totaled $68,829.25. We only have$40,000.00 budgeted. I adjusted two requests down to $5,000.00 since $5,000.00 is themaximum amount that can be given according to the rules. I then adjusted the amounts toseventy-four percent to get the amounts below $40,000.00. A copy is attached.

    New Business - Macon County Historical Society Museum -Allocation FY 2012-2013Robert Shook - Macon County Historical Society Museum - I have been doing permanentdisplays at the museum. Two rooms on the third floor have been finished. I do not know thecircumstances about the funding from last year.Warren Cabe - Town Manager -The museum should have provided paid invoices to the Town.We received the paid invoices in July 2013. Also, their contract had not been signed. Oneoption is to tell them it too late to receive these funds. Option two is to authorize the manager tosign the contract and take the $5,000.00 out of contingency.Motion was made by Scott, seconded by Handley to authorize Town Manager WarrenCabe to sign the contract, to pay the $5,000.00 and to do a budget amendment out ofcontingency. Motion carried. Vote: 4 to 2. Voting yes: Handley, Jamison, Pattillo andScott. Voting no: Curtis and Mashburn.AdjournmentMotion was made by Handley, seconded by Curtis to adjourn the meeting at 6:20 P.M.Motion carried. Vote: 6 to 0.

    ProclamationPancreatic Cancer Awareness Month

    WHEREAS over 42,000 people will be diagnosed with pancreatic cancer this year in the United States and over35,000 will die from the disease with incidence of pancreatic cancer;WHEREAS pancreatic cancer is the deadliest cancer and the fourth leading cause of cancer death in the UnitedStates and approximately over 1000 deaths will occur in North Carolina;WHEREAS 76 percent of pancreatic cancer patients die within the first year of their diagnosis and 95 percent ofpancreatic cancer patients die within the first five years; though pancreatic cancer kills twice as many Americans asAIDS, it receives 39 times less funding for research;WHEREAS there is no cure for pancreatic cancer and there have been no significant improvements in earlydetection, treatment methods, or survival rates in the last 30 years;WHEREAS when symptoms of pancreatic cancer present themselves, it is usually too late for an optimisticprognosis, and the average life expectancy of those diagnosed with metastasis disease is only three to six months;WHEREAS the Federal Government invests less money in pancreatic cancer research than it does in any of theother leading cancer killers;WHEREAS the good health and well-being of the residents of Macon County, North Carolina are enhanced as adirect result of increased awareness about pancreatic cancer and research into early detection, causes, and effectivetreatments;WHEREAS the Pancreatic Cancer Action Network is the first and only national patient advocacy organization thatserves the pancreatic cancer community in Macon County, North Carolina and nationwide by focusing its efforts onpublic policy, research funding, patient services, and public awareness and education related to developing effectivetreatments and a cure for pancreatic cancer;WHEREAS the Pancreatic Cancer Action Network and its affiliates in Macon County, North Carolina support thosepatients currently battling pancreatic cancer, as well as to those who have lost their lives to the disease, and arecommitted to nothing less than a cure;THEREFORE, BE IT RESOLVED that the Macon County Board of Commissioners designate the month ofNovember, 2013, "Pancreatic Cancer Awareness Month" and specifically November 15'" 2013 as Pancreatic CancerAwareness Day in Macon County, North Carolina.

    Residents of Pauline A venue have submitted petitions requesting the zoning of saidcorridor to be changed from Residential (R-2) to Residential (R-1)The Residential (R-2) zoning district provides areas for medium to high density singleand multi-family dwellings with a maximum density of eight dwelling units per acre,where adequate water and sewer facilities are available to serve the development.Permitted housing types within this classification, unlike the R-1 district, includemanufactured homes and manufactured home parks. Aside from prohibitingmanufactured homes the R-1 Residential District differs from R-2 in the way that itpromotes low density single family residential development, with larger lot sizes.Currently in the proposed area to be re-zoned, all parcels with the exception of fourcontain only a single dwelling unit with two parcels having two dwelling units andtwo parcels being vacant, according to records provided by the Macon County TaxOffice.The R-2 and R-1 districts share the same setback, building height, open space andgross floor area requirements. R-1 lots differ from those in R-2 however, in the waythat R-1 minimum lot size for single family is 10,000 sq. ft. R-2 minimum lot size forsingle family is 8,000 sq. ft. According to records provided by the Macon County TaxOffice, all 32 lots would meet the minimum size requirements, if rezoned from R-1 toR-2 (added 6/06/13).As indicated by the attachment, 16 of the submitted applications were provided byindividual property owners. The remaining 16 applications were submitted by a thirdparty Mr. Richard Brady. North Carolina General Statute 160A-384 thus requires Mr.Brady to certify that each landowner has received "actual notice" concerning both thesubmission of their application, and the public hearing when and if one is scheduled.The statute defines "actual notice" as notice which is personally delivered or sentregistered, certified or delivery-receipt mail. Prior to consideration of this mapamendment, Mr. Brady must provide certification that "actual notice" concerning theapplications has been provided to the 16 applicants for which he has submittedapplications. Prior to Public Hearing, if scheduled, Mr. Brady must also provide theseapplicants with "actual notice" regarding the hearing.

    Findings Applicant- Pauline Avenue Residents Original applications were submitted on May 17, 2013 (32) with applications being consolidated by Town

    Staff on May 23, 2013 for administrative purposes Applicants have requested rezoning of properties along Pauline Avenue from R-2 Residential to R-1

    Residential 16 of 32 applications were submitted by third party. R-2 district is established for medium-high density residential development, while R-1 is intended for low

    density residential development. Manufactured homes are prohibited from locating in the R-1 Residential District, while permissible in the

    R-2 Residential District. According to Macon County Tax Office, all 32 lots would meet the minimum size requirements if rezoned

    from R-2 to R-1.Recommendation Considerations:152.163 (A)1. The proposal will place all property similarly situated in the area in the same, category, or in appropriatecomplementary categories. Yes. Properties located to the southwest of this proposed re-zoning are currentlyzoned R-1.

    2. There is convincing demonstration that all uses permi tted under the proposed distric t classification would be inthe general public interest and not merely in the interest of an individual or small group. Yes. This proposal is inthe general public interest.

    3. There is convincing demonstration that all uses permitted under the proposed district classification would beappropriate in the area included in the proposed change. Yes. Properties petitioning to be re-zoned from R-2 to R-1are currently R-1 in nature, as they are stick bui lt homes. Furthermore all 32 lots wil l meet size requirements forthe R-1 district.

    4. There is convincing demonstration that the character of any neighborhood will not be materially and adverselyaffected by any use permitted in the proposed change. Yes. Uses permitted in R-1 district will not adversely affectthe character of the neighborhood.

    This rezoning request contains petitions requesting the zoning change of 5 propertieslocated along Pauline Circle, Oakwood Drive and Oakwood Circle from Residential(R-2) to Residential (R-1)The Residential (R-2) zoning district provides areas for medium to high density singleand multi-family dwellings with a maximum density of eight dwelling units per acre,where adequate water and sewer facilities are available to serve the development.Permitted housing types within this classification, unlike the R-1 district, includemanufactured homes and manufactured home parks. Aside from prohibitingmanufactured homes the R-1 Residential District differs from R-2 in the way that itpromotes low density single family residential development, with larger lot sizes.Currently in the proposed area to be re-zoned, all parcels with the exception of fourcontain only a single dwelling unit with two parcels having two dwelling units andtwo parcels being vacant, according to records provided by the Macon County TaxOffice.The R-2 and R-1 districts share the same setback, building height, open space andgross floor area requirements. R-1 lots differ from those in R-2 however, in the waythat R-1 minimum lot size for single family is 10,000 SF. R-2 minimum lot size forsingle family is 8,000 SF. According to records provided by the Macon County TaxOffice, 11 Pauline Circle, and 97 Pauline Circle are each 9,523 SF in area meeting the8,000 SF minimum lot size requirements of their current R-2 designation. Upon there-classification of these properties to R-1 however, they will become non-conformingas the R-1 district requires a minimum lot size of 10,000 SF. Each of these lotscurrently has residences constructed upon them.This re-zoning request is the second request which has been submitted by Mr. RichardBrady, a resident of the Pauline Avenue area. The five applications which are part ofthis request are properties that were left out ofhis original request submitted in May.Said request involved the re-zoning of 32 parcels of property along the PaulineAvenue Corridor from R-2 to R-1. Public hearing on August 5, 2013 regarding thisrequest was postponed by the Town ofFranklin Board ofAldermen due to the factthat Mr. Brady had not met the actual notice requirements as set forth in NCGS 160A-384.Two of the five applications submitted list the property owners as applicants. Theremaining three applications were submitted by a third party Mr. Richard Brady.North Carolina General Statute 160A-384 thus requires Mr. Brady to certify that eachlandowner has received "actual notice" concerning both the submission of theirapplication, and the public hearing when and if one is scheduled. The statute defines"actual notice" as notice which is personally delivered or sent registered, certified ordelivery-receipt mail. Prior to consideration of this map amendment, Mr. Brady mustprovide certification that "actual notice" concerning the applications has beenprovided to the three applicants for which he has submitted applications. Prior toPublic Hearing, if scheduled, Mr. Brady must provide these applicants with "actualnotice" regarding the hearing.

    1~Statement of Problem IThe Franklin Police Department has experienced changes in management that in tum shown in its production in 2012. Our newChief is a believer in GHSP and has requested new initiatives to expand our role in the safety for our citizens and guests whotravel on our roadways. Franklin Police department has expanded its role in participating in multi-jurisdictional safety checkpoints, DWI check points and saturation patrols with Jackson County SO, Macon County SO and Highlands PD. However wehave very limited supply in traffic safety equipment that is essential for setting up safe motor vehicle checking stations; especiallyafter dark. Franklin has continued to grow in population and territory due to annexations. Last year the Town Franklin absorbedan 8 mile stretch of highway (US 23/ 441 N) that travels through Macon county. This highway serves as a major thorough fare tothe Smokies, Cherokee and Harrah's Casino. Three (3) of our five (5) fatalities have happened on this highway. Franklin has3,854 full time residences with the number rising to near 5,000 during the summer tourist season.
