ASSET DECLARATION RULES 2012In exercise of the powers conferred by the Anti-Corruption Act of Bhutan 2011, sections 38 sub-section (8) and section 171 of the Act 2011,andtoprovidefortheeffectiveandefficientadministrationofasset declarations, the Anti-Corruption Commission, hereby frames and adopts the Asset Declaration Rules 2012 as follows:

(ཀ) གཞ་གནས་གསལ་སན་བཅའ་ཡག་༢༠༡༢ ཅན་མ་ཟར་ བརད་དགཔ་དང་།(ཁ) རང་ལགས་གནམ་ལ་ ལགས་མ་ཡས་ལ་ཟ་༡༡ པའ་ཚས་༡༥ ལའམ་ས་ལ་༢༠༡༢

Asset Declaration Rules 2012

CHAPTER IPRELIMINARY

Title, extent and commencement1. The Rules:

(a) Shall be called the ASSET DECLARATION RULES 2012; and

(b) Shall come into force on the 15th Day of the 11th Month of the Iron Female Rabbit Year of the Bhutanese Calendar corresponding to the 9th Day of 1st Month 2012.

Repeal 2. The Rules repeals the Asset Declaration Rules 2008.

Principal objective 3. The principal objective of these Rules is to implement section

(38) of the Act by:(a) Specifying the frequency of declarations to be made by

a covered person of his or her personal assets, income and liabilities, as well as, that of his or her spouse, child and/or an unemployed dependant who is not a covered person;

(b) Prescribing an asset declaration form and its contents including the e-declaration system;

(c) Stipulating how declarations shall be examined, audited and investigated;

(d) Establishing procedures for processing, registering and

ག་དན་ལན་ཐངས།༤. བཅའ་ཡག་འད་ནང་ ལག་ལན་འཐབ་ཡད་པའ་ གཅག་ཚག་གས་མང་ཚག་ལ་ཡང་ ག་དག༥. བཅའ་ཡག་འད་ག་ ལའ་དང་འག་ཡག་ཚ་ རབ་རན་བད་ཧང་ག་དན་ལ་རངམ་ཅག་མ་

གཏགས་ ཚག་ག་ག་དན་འགལཝ་མན།༦. བཅའ་ཡག་འད་ནང་ལག་ལན་འཐབ་ཡད་པའ་ མང་ཚག་ཚ་ དན་ཚན་(༥༨) པའ་ནང་ ངས་

ཚག་འགལ་ཡད་ན་མ་གཏགས་ ད་མན་ མང་ཚག་ད་ག་ག་དན་ཚ་ བཅའ་ཁམས་ནང་བཀད་པ་ལར་ གཅག་མཚངས་ས་ག་བ་ལན་དག།

maintaining declarations;(e) Prescribing the contents of registration, the period

for which the information in the declarations shall be maintained, and public access thereto;

(f) DefiningactswhichamounttobreachoftheActand/orthis Rules and penalties thereof; and

(g) Providing appropriate guidance necessary for the effective management of the Asset Declaration System.

Rules of construction4. In these Rules, any term used in singular form may include the

plural.5. The headings and chapters mentioned in these Rules are for

ease of reference only and do not constitute interpretations of the text thereof.

6. UnlessatermusedintheseRulesisdefinedinsection(57),thatterm shall bear the same meaning with the Act.

Application7. The provisions of these Rules shall apply to any covered person,

except for Rule (48) regarding accomplice liabilities which shall apply to any person.

བར་ན།(ག) དབང་ཁབ་ལ་ཚད་ཡད་པའ་མ་ངའ་གས་ལས་ རན་བཅད་མ་འབད་བའ་ ས་གང་

ལས།༩. ར་མཚན་གང་རང་ལས་བརན་ ཟར་དབ་དང་པ་ ཡང་ན་ ཟར་དབ་གཉས་པའ་ཐ་ན་ མ་ཚད་

པའ་ཚ་ དབང་ཁབ་ལ་ཚད་ཡད་པའ་མ་ངའ་གས་ལས་ རན་བཅད་འབདཝ་ས་བར་ན་ཨན།༡༠. བཅའ་ཡག་འད་ག་དན་ཚན་(༨ ) པའ་(ཁ) པའ་ནང་ གསལ་བཀད་འབད་ཡད་ད་བཟམ་ས་

མ་ང་ཅག་གས་ ལ་བསར་བཞན་ད་ གསལ་སན་ཚར་ར་ལས་བརལ་འབད་མ་དག།༡༡. མ་ང་ཅག་གས་ ལན་ཚགས་ལ་ ཟ་ང་༣ ག་ནང་འཁད་ སན་ཞ་འབད་དགཔ་འད་ཡང་ གལ་

སད།(ཀ) རང་སའ་ཟར་དབ་ནང་ག་དབ་བ་ལ་ འགར་བ་འབང་ཚ་ ཡང་ན།(ཁ) རང་ག་ འག་གནས་འཐབ་འཆང་ཚ།

༡༢. ལན་ཚགས་ཀས་ བཅའ་ཡག་འད་ག་དན་ཚན་(༡༡) པ་དང་བསན་ ད་བཟམ་མའ་གནས་ཚལ་ཐབ་པའ་ཤལ་ལས་ གཞ་གནས་གསལ་སན་ལམ་ལགས་ནང་ ཁ་/མའ་གནས་ཚལ་ཚ་དས་མཐན་བཟ་དག།

གསལ་སན་ག་འགན་ཁར།༡༣. དན་ཚན་(༡༤) པའ་ནང་འཁད་ཡད་པ་ལར་ཨན་ན་མ་གཏགས་ བཅའ་ཡག་འདའ་དབང་ཁབ་

CHAPTER IIFREQUENCY OF DECLARATION

Frequency of declaration8. Subject to Rules (9) (10) and (11), a covered person shall declare

his or her asset, income and liabilities, as well as, that of his or her spouse, child and/or an unemployed dependant who is not a covered person:(a) Within three months after becoming a covered person;(b) Annually thereafter between February 1 and March 31;

and(c) Before ceasing to become a covered person.

9. A person shall cease to be a covered person once he or she no longer fall within the list under Schedule I or Schedule II for any reason.

10. A person shall not be required to declare his or her assets more thanonceintheannualperiodspecifiedunderRule8(b).

11. A person shall inform the commission within three months if: (a) Hisorherclassificationinthescheduleschanges;or(b) He or she assumes an additional portfolio.

12. The Commission shall, upon receiving such information under Rule (11), update his or her information in the Asset Declaration System.

Declaration obligations13. Subject to Rule (14), a covered person shall declare completely

གསལ་སན་དབ་རམ།༡༥. ཟར་དབ་དང་པའ་ནང་ཚད་ཡད་པའ་མ་ང་གས་ ལན་ཚགས་ལ་གསལ་སན་འབད་དག།༡༦. ཟར་དབ་གཉས་པའ་ནང་ཚད་ཡད་པའ་མ་ང་ཚ་གས་ རང་སའ་ལས་ས་ལ་གསལ་སན་འབད་

and truthfully his or her personal assets, income and liabilities, as well as, that of his or her spouse, child and/or an unemployed dependant who is not a covered person in the form prescribed in these Rules.

14. A covered person is not required to declare the assets of his or her spouse, child and/or an employed dependant if they are required to declare their assets under these Rules.

Tiers of declarations15. A covered person under Schedule I shall file the declaration

with the Commission.16. AcoveredpersonunderSchedule II shallfile thedeclaration

with the concerned agency.

(ང་) ལ་གཡག་དང་ཁང་ག་/གར་སད་ལས་བརན་པའ་འཐས་ སད་ བདག་གཏད་ བག་བཤའ་ གར་སད་ཀ་འཐས་ ར་དངས་ཚང་བསར་ལས་བརན་པའ་རན་གང་ གས་སན་ག་ལ་/ཚང་ལའ་ཁ་འབབ་ ད་ལས་ འབང་ཁངས་གཞན་ལས་ཐབ་པའ་ འང་འབབ་ཚ་དང་ ད་ལས།

(ཅ) བསན་འགལ་དང་ གཏའ་མ་ ཨ་ལའ་ཤས་ཡན་ག༌ཟད་འག་བར༌བའ༌འཁ་བ་ཚ།

CHAPTER IIICONTENTS OF DECLARATIONS

Declaration contents17. A covered person’s declaration shall contain:

(a) Personal information including his or her spouse, child and/or dependant;

(b) Reason for the declaration;(c) Asset comprising of immovable properties such as land

and building, shares and stocks, vehicle/machineries, bank accounts, convertible assets, intellectual property rights, commercial activities and other assets including their mode of acquisition, source of finance, location,registration number and estimated value;

(d) Income from employment, rental/lease, interest, securities, shares, hiring, sale of properties, consultancy/business and other sources; and

(e) Liabilities including loans, mortgages and children’s education expenses.

Roles and responsibilities of agency heads18. The head of agency shall within his or her agency:

(a) Designate an Asset Declaration Administrator;(b) Monitor and supervise the implementation of these

Rules;(c) Enforce provisions of these Rules for non-declaration

and disproportionate asset;

(ཅ) གཞ་གནས་བདག་སང་པ་ གནས་སར་འག་དག་པའ་གནས་སངས་འབང་ཚ་ རས་སད་ལན་ཚ་ ཚལ་མཐན་ག་ས་ལས་ འབད་དགཔ་ ངས་བརན་བཟ་ན།

(ཆ) བདན་དཔད་ཀ་དན་ལ་ དབང་ནས་ལན་པའ་དབང་འཛན་ལ་ རབ་སར་དང་ གནས་ཚལ་ཚ་ བར་སར་འབད་དག།

(ཇ) རང་སའ་ལས་ས་ནང་ ལས་བདཔ་ཚ་ལ་ གཞ་གནས་གསལ་སན་ག་ཤས་ཡན་བན་ནའ་དན་ལ་ ག་བ་བར་སད་ཀ་ལས་རམ་ཚ་ འག་འདན་འཐབ་དག།

གཞ་གནས་གསལ་སན་བདག་སང་པའ་ ལ་འགན་དང་འགན་ཁར།༡༩. ལས་སའ་གཞ་གནས་བདག་སང་པ་ཚ་གས་ འབད་དགཔ་ཚ་ཡང་།

(ཀ) གཞ་གནས་གསལ་སན་དང་འབལ་བའ་གནད་དན་ཚ་ག་དན་ལ་ ང་ཚབ་འབད་ན།(ཁ) དས་ཚད༌ཁར༌རང་སའ་དབང་ཁབ་ལ་ཡད་པའ་ ལས་གཡགཔ་ཚ་ལ་ འབ་ཤག་དང་

གསང་ཡག་ཚ་སན་ན།(ག) དབང་ཁབ་ལ་ཚད་ཡད་པའ་མ་ང་ཚ་ལ་ བཅའ་ཡག་འད་ནང་འཁད་ཡད་པའ་དས་

ཚད་དང་ རམ་གཞག་ཐག་ལས་ རང་སའ་གསལ་སན་འབད་དག་པའ་དན་གས་འབད་ན།

(ང་) དས་རན༌ གསལ་སན་ཚ་ལན་ན་དང་ འཛན༌སང༌འཐབ༌ན༌ ད༌ལས༌ རན་སང་འཐབ་ན།

(ཅ) སར་ག་གནས་ཚལ་ འང་འབབ་ གཞ་གནས་དང་འཁ་བ་ཚ་བརས་ཏ་ ཡག་ཐག་ལ་ཐབ་པའ་གནད་དན་ཚ་ གནས༌སད༌གཞ་མཛད་ནང་བཙག་ན།

(ཆ) གཞ་གནས་གསལ་སན་ཚ་དས་ཚད་ཁར་ ཆ་ཚང་ཡད་མད་དང་ ཆ་ཚད་སམས་མ་སམས་ཚ་ དབ་ཞབ་འབད་ན་དང་ ལས་སའ་འག་འཛན་པ་ལ་ སན་ཞ་འབད་ན།

(ཇ) བཅའ་ཡག་འད་ག་དབང་ཁབ་ལ་ཚད་ཡད་པའ་མ་ང་ཅག་གས་ རན་མཚན་ལན་པའ་

(d) Ensure that the declaration or information contained therein is secured and inaccessible to any person except as otherwise provided in these Rules;

(e) Ensure proper handing and taking over of the asset declaration in case of transfer of the Asset Declaration Administrator;

(f) Support and share information with competent authority forverification;and

(g) Initiate educational programs within the agency to educate their employees on Asset Declaration System.

Roles and responsibilities of Asset Declaration Administrator19. The Asset Declaration Administrator of an agency shall:

(a) Be the focal person for all matters relating to asset declarations;

(b) Distribute forms and assign passwords to employees under his or her jurisdiction on time;

(c) Remindacoveredperson tofiledeclarationwithin thetimeandinamannerspecifiedintheseRules;

(d) Receive, manage and maintain declaration at all times;(e) Enter particulars of the declaration received in hard

copy, including personal information, income, asset and liabilities into the e-database;

(f) Examine the timeliness, completeness and proportionality of assets in the declaration and report to the head of the agency;

(g) Remind head of agency to take necessary action against

CHAPTER IVPROCEDURE FOR DECLARATION

Processing of asset declaration20. A declaration of assets shall be deemed proper only if a covered

person provides all applicable information or details required therein.

21. The Asset Declaration Administrator shall evaluate the declaration to determine if a covered person has complied with the provisions of these Rules.

22. The head of agency shall, within two months of expiry of the due date, prepare and submit to the Commission a report on any covered person who:(a) Failstofiledeclaration;and/or(b) Has disproportionate assets.

23. The head of agency shall by order, direct a covered person who has not declared or falsely declared, to declare or correct a false declaration within thirty days after expiry of the due date.

24. If a covered person, without reasonable justification, fails todeclare or provide a complete information from the expiry of due date, he/she shall be subject to Rule (43).

25. If a covered person possesses assets disproportionate to his or her lawful income, as determined by the Asset Declaration System, he or she shall be subject to investigation by the Commission.

Compliance auditing 26. The Royal Audit Authority shall carry out compliance auditing

of the asset declaration in agencies.27. For the purpose of Rule (26), the concerned agency shall

provide information to the Royal Audit Authority on the Asset Declaration System.

Asset verification28. The verification of asset declaration shall be based onAsset

Verification Protocol provided under Annexure III of theseRules.

29. The Commission shall determine the level of disproportionate assets.

30. The Asset Declaration Administrator shall, in respect of a covered person under Schedule II of these Rules, examine the declaration and submit the report of any disproportionate assets to the head of the agency.

31. The head of agency shall review the report under Rule (30) and report to the Commission.

32. The Commission may upon receipt of the report under Rule (31), initiate investigation against the covered person.

Illegal acquisitions to be State property33. Any asset acquired by a covered person shall be considered

illegal unless:(a) The asset is proved commensurate with his or her lawful

source of income; and(b) There is a valid explanation about how the asset was

acquired.

34. If a covered person fails to furnish valid explanation under Rule (33), he or she shall be deemed to be in possession of unexplained wealth under the Act.

35. Any income or asset acquired illegally shall belong to the Government and become State property.

36. For the purpose of these Rules, the burden of proof of a preponderance of evidence to show legal acquisition of the asset shall lie with the covered person.

Preservation of declaration37. A declaration made under these Rules shall be preserved for a

period of ten years after which the head of agency may destroy it.

38. The concerned agency shall ensure the safety of a declaration made by a covered person and the Commission shall ensure the safety of data archived in the online Asset Declaration System.

CHAPTER VCOMPLAINT

Complaint against an agency39. Any person may lodge a complaint concerning an allegation

or suspected contravention of the provisions of these Rules to:(a) The Ethics and Credential Committee of the National

Assembly, if a complaint is against the Commission; (b) The Commission, if a complaint is against a covered

person under Schedule I; and(c) The head of agency, if a complaint is against a covered

person under Schedule II.

Investigation upon complaint40. The Ethics and Credential Committee of the National Assembly,

the Commission or the head of agency shall investigate a complaint under this Rule unless the person against whom the complaint has been lodged makes a written admission of the contravention.

41. The Ethics and Credential Committee of the National Assembly, the Commission or the head of agency shall upon investigation act in accordance with the provisions of Chapter VI of these Rules if the matter relates to non-declaration or false declaration and forward the matter to the Commission if it relates to disproportionate assets.

CHAPTER VIPENALTY FOR BREACH

Penalty43. If a covered person fails to declare or provide complete

information under these Rules within thirty days from the expiryoftheduedatewithoutreasonablejustifications,heorsheshallbeleviedafineequivalenttooneday’snationaldailyminimum wage every day until such failure subsists.

44. If a covered person, knowingly makes a false declaration with a view to conceal his or her asset, income and liabilities, he or she shall be guilty of an offence under the Act.

45. If a covered person fails to declare or provide complete information under these Rules after the expiry of a month after theduedatewithoutreasonablejustifications,heorsheshallbeleviedafineequivalenttooneyear’sdailyminimumnationalwage.

46. Ifacoveredperson,withoutreasonablejustifications,commitsan offence under Rule (43) and Rule (45) more than once, in addition to fines, he or she shall be subject to appropriatedisciplinary action.

47. If an Asset Declaration Administrator fails to perform his or her roles and responsibilities under Rule (19) of these Rules withoutreasonablejustifications,heorsheshallbeleviedafineequivalent to one month’s national daily minimum wage.

48. If the head of agency fails to perform functions in relation to the administration of declaration in his or her agency without

reasonable justifications, he or she shall be levied a fineequivalent to one month’s gross salary.

49. Any person, who acts as an accomplice to a covered person in violation of these Rules, shall be subject to a penalty as per the Penal Code of Bhutan.

Collection and deposit of fine 50. The fines levied against a covered person shall be collected

through the issuance of a receipt and accordingly deposited with the Government Revenue Account.

CHAPTER VIIPUBLIC ACCESS TO DECLARATION

Public access to declarations52. Any declaration or copy thereof may be made available to any

personafterfiveworkingdaysfromthedayofreceiptofsuchapplication by an agency, subject to the conditions that it is: (a) Only in person;(b) Duringofficehours;and(c) Only upon a written application by such a person.

53. The agency shall inform the covered person whose declaration the applicant, in writing, has sought.

Prohibitions of unlawful use54. A person shall not obtain or use a declaration for:

(a) Any unlawful purpose; (b) Any commercial purpose; (c) Determiningthefinancialsoundnessofanyindividual;

or (d) Use of solicitation of money for any purpose directly or

indirectly.

Penalty for unlawful use55. If a person violates Rule (54), he/she shall be levied a fine

equivalent to one year national daily minimum wage.

CHAPTER VIIIMISCELLANEOUS

Amendment56. The Commission as deemed necessary from time to time

shall affect the amendment of these Rules by way of addition, variation or repeal.

Authoritative text57. The Dzongkha text and the English translation are equally

authoritative, except that, in any instance of difference in meaning between the two texts, Dzongkha text shall prevail.

Definitions58. Unless the context requires otherwise:

(a) “Accomplice” means any person who purposefully or knowingly engages in conduct that helps another person commit an offense under the Act and the Rules;

(b) “Act” means the Anti-Corruption Act of Bhutan 2011;(c) “Agency” means the Legislature, Judiciary, Ministry,

Constitutional Offices, Autonomous Agency,Corporation, Civil Society Organization, Religious Organization, Dzongkhags, Gewogs, Thromde or a statutory body of the Royal Government;

(d) “Armed Forces” means the Royal Body Guard and Royal Bhutan Army;

(e) “Asset” has the same meaning as in the Act;(f) “Autonomous agency” means an agency established

(ཉ) ཞ་བའ་མ་ས་ལས་ཚགས་ཟར་མ་འད་ ཞ་བའ་མ་ས་ལས་ཚགས་ཀ་བཅའ་ཁམས་ནང་འཁད་མ་ ག་དན་དང་ཅག་འཐད།

(ཏ) ལན་ཚགས་ཟར་མ་འད་ ར་ཁམས་ཆན་མ་ ཡང་ན་ བཅའ་ཁམས་ཀ་ནང་གསལ་ལར་ གཞ་བཙགས་འབད་ཡད་མ་ ངན་ལད་བཀག་སམ་ལན་ཚགས་ལ་ག།

(ད) ར་ཁམས་ཅན་ག་ག་གནས་འཆང་མ་ ཟར་མ་འད་ ར་ཁམས་ཆན་མ་ནང་ འཁད་ཡད་པའ་ ག་དན་དང་ཅག་འཐད།

(ན) སར་སར་འས་པའ་གཞ་གནས་ཟར་མ་འད་ ས་རལ་ག་ལ་ རན་ཆ་ གསར་དང་ཅ་དངས་ ཁམ་ག་ཚད་རས་ དངལ་ཀམ་ ༡༠༠,༠༠༠/-(གཅག་འབམ)ཐམ་པ་ལས་ལག་མ་ལ་ག།

(པ) དབང་ཁབ་ལ་ཚད་ཡད་པའ་མ་ང་ཟར་མ་འད་ ཟར་དབ་དང་པ་དང་གཉས་པའ་ནང་ ཚད་ཡད་པའ་ མ་ང་གང་རང་ལ་ག།

(ཕ) ལས་འཛན་ཟར་མ་འད་ རལ་ཁམས་ཀ་ཁམས་ཚ་ག་ནང་གསལ་ལར་ ཁམས་མཐན་ལས་ས་ས་ས་ས་གཞ་བཙགས་འབད་ནའ་དན་ལ་ ལས་སའ་འཐས་མ་ལས་ ཁ་དབང་དང་འཁ་བ་ཚ་ ས་ས་ཡདཔ་ས་ བཟ་བཀད་འབད་ཡད་པའ་ ཁམས་མཐན་ལས་ས་ལ་ག།

(བ) གསལ་སན་ཟར་མ་འད་ བཅའ་ཡག་ག་དགངས་དན་དང་འཁལ་ རང་སའ་འབབ་ཁངས་དང་ གཞ་གནས་ ད་ལས་ འཁ་བ་ཚ་གསལ་སན་འབད་ཡད་མ་ལ་ག།

and mandated to function with autonomy by the Royal Charters, Royal Kashos, Executive Orders or Acts of Parliament;

(g) “Child” means a person under the age of 18 years, including step-child or child lawfully adopted of a covered person;

(h) “Civil Society Organization” shall have the same meaning as provided in the Civil Society Organization Act;

(i) “Commission” means the Anti-Corruption Commission established under the Constitution or the Act;

(j) “Competent Authority” means an individual or agency with a legal right to control or act concerning a particular area or activity;

(k) “Constitutional Office Holders” shall have the same meaning as in the Constitution;

(l) “Convertible asset” includes works of art, jewellery, gold, and other objects exceeding estimated fair market value of Nu.100, 000 per item;

(m) “Covered person” means any person using public resources or any person listed in Annexure I and Annexure II;

(n) “Corporation” means a legal entity that is created under the laws of a State designed to establish the entity as a separate legal entity having its own privileges and liabilities distinct from those of its members;

(o) “Declaration” means the act of accounting one’s income, asset and liabilities in accordance with these Rules;

(ཚ) འབ་ཤག་ཟར་མ་འད་ བཅའ་ཡག་འད་ནང་ཆད་ད་བཀད་ཡད་པའ་ འང་འབབ་དང་ གཞ་གནས་ ད་ལས་ འཁ་བ་ཚ་ག་གསལ་སན་ འབ་ཤག་ལ་ག།

(ཞ) རལ་ཡངས་ཉན་རའ་ཉང་མཐའ་ག་ཚད་ཟར་མ་འད་ དས་དང་དས་ས་ གཞང་གས་ཉན་ལར་ག་ཆ་ ཆད་ད་བཀད་མ་ ག་ཚད་ལ་ག།

(ཟ) ར་མཚན་ལན་པའ་ར་ཁངས་ཟར་མ་འད་ དབང་ཁབ་ལ་ཚད་ཡད་པའ་མ་ང་དང་ གཞ་གནས་གསལ་སན་བདག་སང་པ་ ད་ལས་ ལས་སའ་འག་འཛན་པ་ཚ་ བཅའ་ཡག་ནང་བཀད་ཡད་པའ་ རང་སའ་ལ་འགན་དང་འགན་ཁར་བསབ་མ་ཚགས་པའ་ ར་མཚན་ཚ་ལ་ག།

(འ) ཆས་སའ་གཙག་ས་ཟར་མ་འད་ ཆས་ས་གཙག་སའ་བཅའ་ཁམས་ནང་ འཁད་ཡད་མ་ ག་དན་དང་ཅག་འཐད།

(ཡ) དངལ་འབལ་གཙག་ས་ཟར་མ་འད་ བཅའ་ཁམས་ནང་ འཁད་ཡད་མ་ ག་དན་དང་ཅག་འཐད།

(p) “Dependant” includes a covered person’s children entirely dependent on the income of such covered person;

(q) “Disproportionate asset” means an asset obtained or acquired disproportionate to lawful sources of income;

(r) “Form” means the income, asset and liabilities declaration form prescribed by these Rules;

(s) “Income” means all receipts by way of salary, TA/DA, mileage, fees, wages, perquisites, profits, gain,emoluments, rents and interests whether or not they are received as money or money’s worth, commission, dividends,bonus,pension,gratuity,annuityorbenefit;

(t) “False declaration” means the act of declaring assets, income and liabilities with a view to conceal their disproportionate assets by providing incomplete or incorrect information intentionally;

(u) “National Daily Minimum wage” refers to the daily wage prescribed by the Government from time to time;

(v) “Reasonable justification” means reasons that prevented a covered person, Asset Declaration Administrator or head of agency from performing his or her role and responsibilities contained therein;

(w) “Religious Organization” shall have the same meaning as in the Religious Organization Act;

(x) “Financial institutions” shall have the same meaning as the Act; and
