Update on book issue: Some issues with books such as cost factor and being out of print. Each student does have a book to use in school, but not all have books to bring home.

Report from State Monitor – Thomas EganAudit is just about completed. Auditor will be making presentation at December Board Meeting to address findings. Resolution on addendum addresses facilities – all public safety issues to be addressed not infrastructure.

Remarks by Citizens – AGENDA ITEMS ONLY (Public Participation Session 1): Vincent Frantantoni: Happy Thanksgiving. Resolution C30 – hourly rate for Schwartz, Simon and Edelstein (Counsel: $150 per hour). No maximum amount? (Counsel: Case mostly covered by insurance) Why Dress down days? Should be teaching students respect. (Dr. Tomko: Dress down days are to raise funds)

Tom McCrohan: Resolution A12 – why are teachers doing an extra period? (Dr. Tomko: Teacher was let go, unable to fill position). Was teacher leaving on agenda? (Yes) Resolution A22 – current position or created? (Dr. Tomko: In contract)

Michael Sheldon: Happy Thanksgiving. Resolution C33 “Good to Great” What is this group? (Mr. Egan: Consulting group of retired BA’s. Will come up with sound recommendations.) Resolution D4 – can he get copy of contract? Board cannot make certain decisions during lame duck period. (Counsel: Rules which restricted board from acting where when elections were in April and it was a three week time period. Don’t fit for a three month period.)

WHEREAS, the Belleville Board of Education (the "Board ") has determined that it is necessary to make repairs at Schools Four and Seven; and

WHEREAS, the Board seeks to formally recognize that making such repairs is a priority for the District;

NOW, THEREFORE, BE IT RESOLVED that the following repairs shall be made as funds become available, whether by referendum or otherwise, in the order listed below:

30. Approve the following resolution regarding representation Belleville Board of Education:

WHEREAS, the Belleville Board of Education is a Defendant in the action entitled A.S. v. Belleville Township Public Schools et al., Docket No. MER-L-1601-1 6 (the "Complaint"); and

WHEREAS, the Complaint contains allegations of both negligent and intentional conduct by the Board and its employees; and

WHEREAS, the Complaint seeks punitive damages, which are not covered by the Board 's insurance policy;

NOW, THEREFORE, BE IT RESOLVED that the Belleville Board of Education hereby directs Schwartz Simon Edelstein & Celso LLC to represent the interests of the Board as well as

BE IT FURTHER RESOLVED that Schwartz Simon Edelstein & Celso LLC shall assist insurance counsel in representing the Board's interests with respect to those claims which are covered by insurance; and

BE IT FURTHER RESOLVED that the Belleville Board of Education authorizes the Board President; Business Administrator/Board Secretary; and any other personnel to take steps as may be necessary to carry out this action of the Board.

33. Utilize the services of Good to Great, LLC., Oradell, NJ to provide consulting and an independent analysis/ plan on all district overtime and overtime schedules in order to ensure compliance at an hourly rate of $99.00, not to exceed $7000.

D. PURCHASING & BUSINESS SERVICES: Moved by Mr. Kuebler, seconded by Mrs. Torres, the Board passed the following resolutions D1-D4

by a roll call vote of 7-0.

RESOLVED, that the Board of Education, upon the recommendation of Dr. Richard D. Tomko, Superintendent of Schools:

1. Confirm the use of the professional services of Aspire Payroll, Madison, NJ, fee not to exceed $9,600.

2. Whereas, The Board of Education of Belleville in the County of Essex, New Jersey (the “Board”), desires to proceed with a school facilities project consisting generally of:

FACILITY UPGRADES AT BELLEVILLE HIGH SCHOOL, BELLEVILLE MIDDLE SCHOOL, SCHOOL #3, SCHOOL #4, SCHOOL #5, SCHOOL #7, SCHOOL #8, SCHOOL #9 AND SCHOOL #10,

Whereas, the Board now seeks to take the initial steps in order to proceed with the Project:NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF EDUCATION OF THE TOWNSHIP OF BELLEVILLE IN THE COUNTY OF ESSEX, STATE OF NEW JERSEY, as follows:

Section 1. In accordance with the requirements of Section 6A:26–3 of the New Jersey Administrative Code, the Board hereby approves the List of Priority Projects, as attached hereto, prepared in connection with the project and the Board further authorizes the submission of same to the Essex County Superintendent of Schools and the New Jersey Department of Education for approval.

Section 2. In accordance with the requirements of Section 6A:26-3 of the New Jersey Administrative Code, the Board hereby approves that Schematic Plans be prepared by DiCara Rubino Architects in connection with the Project and the Board further authorizes the submission of same to the Essex County Superintendent of Schools and the New Jersey Department of Education for approval. The Board further authorizes the submission of the Schematic Plans to the Municipal planning board, if required, for its review.

Section 3. The Board hereby authorizes the amendment to its Long-Range Facilities Plan in order to reflect the proposed Project.

Section 4.The School Administration and such other officers and agents of the Board as are necessary, including the Board attorney, bond counsel and architect, are hereby authorized to perform such other acts, to execute such other documents and to do such other things as are necessary to implement the determinations of the Board set forth in this resolution, including the submission of Information to the New Jersey Department of Education as set forth in Section 5(d) of P.L. 2000, c72 in connection with receipt of debt service aid with respect to the proposed Project.

Section 5. This resolution shall take effect immediately.

3. Approve contract with Colditz & Zucca, LLC, Township of Washington, NJ, to provide accounting services. Contract on file in the Business Office.

4. Approve contract with Di Cara/Rubino Architects to provide professional services pertaining to pre- referendum services for the district. Contract on file in the Business Office.

E. FINANCE: Moved by Mr. Kuebler, seconded by Mrs. Torres, the Board passed the following resolutions E1-E9

by a roll call vote of 7-0.

RESOLVED, that the Board of Education, based upon the recommendation of Dr. Richard D. Tomko, Superintendent of Schools:

1. Approve payment of the List of Bills dated November 21, 2016 after the list has been approved by a majority of the members of the Board.

2. Approve the Workers Compensation Claims List for October 2016 in the amount of $23,622.98.

3. Approve the Appropriation Transfers and Budget Amendments from October 1, 2016 through October 31, 2016.

4. Approve the Secretary’s Financial Report for the month of JULY 2016 and the certifications as required by N.J.A.C. 6A:23-2.12, and that it be appended to and made part of the minutes of this meeting.

5. Approve the Treasurer’s Financial Report for the month of JULY 2016, and that it be appended and made part of the minutes of this meeting.

6. Pursuant to N.J.A.C. 6A:23-2.11©4, the Board of Education Secretary certifies that as of JULY 2016, after review of the District’s monthly financial reports major accounts have not been over expended as required by N.J.A.C. 6A:23-2.11(b)

8. Approve the Treasurer’s Financial Report for the month of AUGUST 2016, and that it be appended and made part of the minutes of this meeting.

9. Pursuant to N.J.A.C. 6A:23-2.11©4, the Board of Education Secretary certifies that as of AUGUST 2016, after review of the District’s monthly financial reports major accounts have not been over expended as required by N.J.A.C. 6A:23-2.11(b)

10. Approve the lease payment to DiCara Rubino Architects in the amount $16,240.60 and to C. Dougherty Construction Company in the amount of $92,433.60 for work completed regarding installation of boilers at School #8 and the Middle School.

11. Amend the resolution (E9) approved at the June 20, 2016 meeting of the Belleville Board of Education to read "the transfer of all excess surplus funds in excess of 1.5% of fund balance, as of June 30, 2016, as allowed by regulations and in accordance with Title 6A and 18A, to the Capital Reserve Account not to exceed $500,000 $675,000.”

Remarks by Citizens – ANY ITEM (Public Participation Session 2):Vincent Frantantoni: Shared history of Community Engagement officers who have volunteered their time in the past. District has to stop outrageous salaries that used to be done by volunteers. (Dr. Tomko: a lot of different academic things going through that office.) Recycling not being done.

Michael Sheldon: PARCC testing 2016 – abysmal performance. A lot has to be done for our students.

Arlene Schor: Resolution A12 – compensation to those filing position. Is district trying to find replacement for teacher? Total for fill-in teachers is $85,000. Are boilers on a time clock? Heating problem in high school today. Thank you for letting students wear warmer clothing. Please check out “Good to Great”. Happy Thanksgiving.

Jeff Mattingly: Happy Thanksgiving. Any word on OFAC report yet? (Mr. Egan: still working on it.) Building and Grounds have been grossly neglected. Hire an engineer to oversee projects and perhaps save millions of dollars. Town is tax stressed.

GeorgeAnn Polite: Resolution C6 – technology plan, what is it? Approved tutors for SAT – how did they gain access to students addresses? School #8 has had many principals, what is the status on permanent principal? Are all adult volunteers fingerprinted? Changes to agenda are not on printed agenda for public. (Dr. Tomko: Only changes to agenda were ones that were announced. Technology plan used to be a requirement. Is a living growing document. Very important for QSAC. Mr. D’Elia is doing a great job at School #8. Volunteers are fingerprinted. SAT tutors were here previously.)

Mrs. Torres: Happy Thanksgiving.

Mrs. Lamparello: Fall athletics end of season: Girls Cross Country great season 7-4 record; Boys Cross Country captain recognized for sportsmanship. Team continuing to improve. Boys Soccer made 1st round of Essex County Tournament. Football won more games this year than it has in the last 5 seasons. Girls Tennis finished season at 11-9. Fantastic group of scholar-athletes who would never give up. Girls Volleyball 15 wins this season. SEPAC (Special Education Parents Advisory Council) partnering with Nutley to provide workshops for parents. Special services working on many improvements for Special Ed students. Special Education classes are in every building in district except School #9.

Ms. Dolan: Congratulations to Daniel Castano. Article on his selfless act brought her to tears. Checked policy and had sign-in sheet corrected. Happy Thanksgiving.

Mr. Rivera: Favorite holiday, Happy Thanksgiving.

specifically, the discussion of personnel, staff evaluations, pending litigation, and negotiations. The results of these discussions will be acted upon at the next regularly scheduled business meeting of the

Board, or as soon as feasible and/or practicable thereafter.
