David P. Baugh is one of the most respected and experienced criminal trial lawyers in the Commonwealth of Virginia. During his extensive criminal trial career he has appeared on behalf of clients in courtrooms around the nation. He is recognized for his advocacy skills and his vast knowledge

of statutory and case law. Mr. Baugh’s advocacy has led to a succession of innovative and intense defense strategies leading to favorable resolutions for his clients.

A graduate of Virginia State University, then Virginia State College, in Petersburg, Virginia in 1971, Mr. Baugh graduated from Texas Southern University School of Law in 1975. After three years with Bennett, Baugh and Bastide, Attorneys, a primarily criminal litigation practice in Houston, Texas, Mr. Baugh went on to be an Assistant United States Attorney for the Eastern District of Texas in Beaumont, Texas. In 1981 Mr. Baugh became an Assistant United States Attorney for the Eastern District of Virginia in Richmond, Virginia.

In 1983 Mr. Baugh resigned from that position as Assistant United States Attorney for the Eastern District of Virginia when he made inquiry of a judge as to why that judge incarcerated African American defendants. Mr. Baugh prosecuted as opposed to granting probation to white defendants convicted, often for the same offenses. From 1983 to 2008 Mr. Baugh was fortunate

to enjoy a stimulating and rewarding career in private practice, during which time he received numerous awards and accolades for his skills and dedication. In 2008 Mr. Baugh accepted a position as the Capital Defender for Central Virginia, representing indigent defendants facing the death penalty. For four and a half years, under his direction, no defendant received a death sentence in that region. In 2012 Mr. Baugh returned to private practice.

Mr. Baugh continues to live in Richmond, Virginia and travels around the nation representing defendants and teaching lawyers.

2021 Fall Conference Keynote: The Criminal Defense Attorney: The Modern Gunfighter Keynote Speaker: David P. Baugh (Richmond, VA)

2021 Fall Conference Keynote Address

The story of this nation is replete with fictional and factual characters, many of them gunfighters, defending and protecting those, often unfairly and unjustly, accused while opposed by the majority, often all. These heroes: Bass Reeves, the real Lone Ranger, Wyatt Earp, Maverick, Paladin of Have Gun, will Travel, the Man with no name, always fought alone, for a higher purpose.

Today, criminal defense attorneys supplant them. Allied only to a purpose and to those for whom they are champions. Criminal defense attorneys, we are the new gunfighters.

Whisper Stops

Kristyna Nunzio Grand Rapids, MI

Have you ever had a traffic stop that made you think, “Huh, this feels like there was an informant or a tip-off that led to this traffic stop?” Well, you might have been right! Whisper stops, or “Walled off” stops, are when one law enforcement agency “whispers” to another law enforcement agency that a vehicle in their jurisdiction has drugs, guns, or other contraband. This whisper triggers Law Enforcement to initiate a pretextual traffic stop. Learn about how different jurisdictions handle these stops, navigating discovery issues, and how you can work Whisper Stops into 4th Amendment arguments.
