General Statement of Duties: The City Emergency Management Director shall have directresponsibility for the organization, administration and operation of the emergencypreparedness organization, subject to the direction and control of the City Council. TheDirector shall carry out all orders, rules, and regulations issued by the Mayor or CityAdministrator with reference to emergency management.

*Preparation of Comprehensive Emergency Management Plan - The Emergency ManagementDirector will work with the Public Safety Committee regarding the timely modifications of theplan which includes, but it not limited to, mutual aid agreements with other politicalsubdivisions of the State for reciprocal emergency management aid and assistance in anemergency too great to be dealt with unassisted and pandemic flu. Documents would becreated consistent with Federal, State, and Stearns County Emergency Plans. All agreementsand plans will be presented to City Council. The Director shall prepare and submit reports onemergency preparedness to the Public Safety Committee and/or Mayor.

*Training - which includes, but not limited to, instituting training programs, public informationprograms, coordinate and conduct practice warning alerts and emergency exercises as maybe necessary to assure prompt and effective operation of the Emergency Management Planwhen an emergency or disaster occurs. The Director will utilize the personnel, services,equipment, supplies, and facilities of existing departments of the City to the maximum extendpracticable. The Director shall, in cooperation with those City departments affected, assist inthe organizing, recruiting, and training of emergency management personnel, which may berequired on a volunteer basis to carry out the emergency plans of the City. To the extent thatemergency personnel are recruited to augment a regular City department of emergencies, theyshall be assigned to the department and shall be under the administration and control of thedepartment. These trainings will be consistent with the State emergency services law.

*Community Evaluation - which includes, but is not limited to, studies and surveys of thehuman resources, industries, resources, and facilities of the City as deemed necessary todetermine their adequacy for emergency management and to plan for their most efficient usein time ofan emergency or disaster. The Director shall establish the economic stabilization systems andmeasures, service staffs, boards, and sub-boards required, in accordance with State and

Mr. Wunderlich reported that the proposed monitoring well location was in a 3 foot wide grassmedian between a sidewalk and the curb of South Street. Placing a well in the narrow medianpresented a potential collision hazard to plows and road traffic.

Based on the information provided in the variance request and obtained during the MDH review ofyour request, and in accordance with Minnesota Rules, chapter 4725, your request for a varianceis granted to allow a monitoring well to be completed at-grade in the green area adjacent toSouth Street.

The variance is granted with the following conditions:

1. You must notify MDH district hydrologist Mr. Wunderlich at 320-223-7329 atleast 24 hours prior to beginning construction to the well so that an inspector may be presentduring this work.

2. The top of the well casing must terminate no lower than the ground surface.

3. The monitoring well at-grade completion must be made in accordance with the requirements inMinnesota Rules, part 4725.6850, subpart 3. A copy of these requirements is attached for yourconvenience.

4. The well must otherwise be constructed in accordance with Minnesota Rules, chapter 4725.

Alternative measures or conditions attached to a variance have the force of law and effect ofapplicable rule. If a party violates the alternative measures or conditions attached to the variance,the party is subject to enforcement actions and penalties provided in the applicable law or rule.

Mr. Wunderlich reported that the proposed monitoring well location was in a grassy area next toMill Street. Mr. Wunderlich observed a tree and signage in this same area. Extending the wellcasing above-grade at this location does not appear to create a risk in excess of otherobstructions. Mr. Wunderlich discussed the proposed work with Mr. Kanner and was informedthat this monitoring location does contain enough flexibility to move the well away from MillStreet.

Based on the information submitted in the variance request and obtained during the MDH reviewof your request, and in accordance with Minnesota Rules, chapter 4725, your request fora variance to construct an at-grade monitoring well at 121 Mill Street, Paynesville, isdenied. The request is denied because of the presence of other obstructions and the ability torelocate the well.

If specific remedial actions are scheduled for this site, and evidence is provided that theabove-grade welles) prevent access necessary to accomplish the proposed remediation, the MDHwill reconsider your variance request.

The decision to deny this variance is based on the information gathered during our investigationof your variance request. If you believe that any information in our reasons for denial isincorrect, or if you have other information that indicates that our decision should be modified,please respond in writing to this department within 15 days of receipt of this letter and we willfurther consider your request. • Provides general zoning, building and related code information and application forms· topermit applicants and the general public.

• Explains, interprets and provides guidance regarding building codes and land userequirements within area of responsibility to architects, engineers, contractors, developersand other interested parties.

• Conduct on-site inspections of all types ofconstruction for conformity with requirements.• Reviews and evaluates proposed building plans and specifications blueprints to insure that

proposed construction complies with applicable codes and Ordinances.• Applies valuations and permit costs for new projects based on codes, regulations and

policies.• Processes permit applications, monitors application progress for status reports, and

preparing permits for issuance; issues routine permits within scope of authority andresponsibility assigned. Pursue closure of issued permits.

• Administers the permitting function, including application, fee assessment and collection,permit issuance, inspection, and occupancy. Enforces building related codes and issuescorrection notices and citations.

• Review proposed subdivisions for code compliance.• Advises and assists property owners and contractors as to local zoning ordinances and the

- Attached is a Lease I have drafted between the City of Paynesville and Tim Wegner.

I have assumed that we still have approximately 112 acres and I have modified the legal description to reflectthe marking up that was done on the last lease. You will have to let me know if that was done correctly or ifthere are other changes there that should be made. Otherwise, I have set this up the way it has been done in thepast. I know a lot of farm leases now don't allow for the payments at the end of each year of the lease, but ifyou remain comfortable with that we can leave it the same. I know a lot of farm leases now provide that eachyear's rent is payable before the farmer gets into the field, but the City has never done it that way and unless youare uncomfortable with the Lessee, I don't have a problem leaving it the same.

Let me know if there are any changes that we should be making.

ASSIGNMENT AND SUBLElTING: That he will neither assign this Lease norsublet any part of said land without consent of said Lessor;

SECURITY AGREEMENT: That, to secure performance of the terms andconditions herein, Lessee hereby grants to Lessor, his heirs and assigns, a securityinterest in all crops of every kind which have been planted or are growing, orwhich may hereafter be planted or growing on the above-described land.

C. REMEDIES. In the event of a default, Lessor shall have the right, athis(her) option and without demand or notice, to declare all or any part of theobligations immediately due and payable; and, in addition, Lessor may exercise, inaddition to the rights and remedies granted hereby, all of the rights and remediesof a secured party under the. Uniform Commercial Code or any other applicablelaw. Lessee agrees in the event of a default to make the collateral available toLessor at a place to be designated by Lessor which is reasonably convenient.Lessee further agrees to pay all costs and expenses of Lessor, includingreasonable attorney's fees, in the collection of any of the obligations or theenforcement of any of Lessor's rights. If any notice of sale, disposition or otherintended action by Lessor is required by law to be given to Lessee, such noticeshall be deemed reasonably and properly given if mailed to Lessee at the homeaddress of Lessee, or at such other address of Lessee as may be shown onLessor's records, at least ten (10) days before such sale, disposition or otherintended action. Waiver of any default hereunder by Lessor shall not be waiver ofany other default or of a same default on a later occasion. No delay or failure byLessor to exercise any right of remedy shall be a waiver of such right or remedyand no single or partial exercise by Lessor of any right or remedy shall precludeother or further exercise thereof or the exercise of any other right or remedy atany other time.

D. TERMINATION. This Agreement and the security interest in the collateralcreated hereby shall terminate when the obligations have been paid in full. Attached please find a preliminary layout of a pl'opQsed booster station. This station would boost thepressure in the water distribution system forthe Project 55 area, which will increase the water pl'essure forthe properties in that arewand create~uaJpn~ssurtl~QnesintheCitY. This station wouldaUowthe in­home pressure stations thatsonie residentshaveinstalltldtobe removed iromtheir homes.

The booster station willoriginaHy pump 45 to 60gl1Uonspel' minute (gpm) to serve the residences in theProject 55 area. In addition, the facility would containhydl'o-pn.eumatic tanks so the pumps do not n.eedto run constantly. The building has adequate size to accommodate larger pumps (approximately 1,000gpm) that would be used in the future to fill a future water tower that would serve the upper elevations ofthe community to the south and east. The masonry building is approximately 500 square feet in area andwould need to be located in the vicinity of the Project 55 area. We will need to explore and evaluatepotential sites for the station that are available. The total estimated costofthe booster station is $630,000.

If and when the Council wants to move forward with this project, we CQuid explore potential fundingprograms to help fund the project.

NOW, THEREFORE, for valuable consideration, the sufficiency of which is herebyacknowledged by the parties, the parties agree to amend tlie Letter of Intent as follows:

1. The second to the last paragraph of the Letter of Intent is hereby stricken in itsentirety and replaced with the following:

"This letter is intended only to express the interest of the parties topurchase and sell the Property. Except as hereinafter set forth, neitherBuyer or Seller shall be legally obligated to purchase or sell the Propertyunless and until the Purchase Agreement is executed by the parties.Notwithstanding the foregoing, Seller hereby agrees not to solicit,entertain or accept any formal or informal offers to purchase the Property,or any part thereof, until the fIrst to occur of (a) mutual written revocationof this letter by both Buyer and Seller; or (b) one hundred twenty (120)days after the last party executes this letter."

2. All other provisions of the Letter of Intent shall remain in full force and effect.
