    Parshat Ki Teitzei August 17, 2013 11 Elul, 5773

    Parshas Ki Teitzeicontains one of theTorah's more perplexingchapters -- the laws ofthe Wayward andRebellious Son (BenSorer U'Moreh). Thesituation involves a malechild between the agesof 13 and 13 and a halfwho begins to "act out"in a very dangerousmanner. He steals fromhis parents. He isgluttonous in hisconsumption of meat andwine. The Torahprescribes very severepunishment: The parentsmust bring the child intocourt and the Beis Dinwill sentence him tostoning, the most severeof the capitalpunishments mentionedin the Torah.

    The Talmud in Sanhedrinasks why the Torah wasso harsh with the BenSorer U'Moreh forbehavior that certainlydoes not warrant thedeath penalty. TheGemara answers that theTorah realizes what theeventual outcome ofsuch an adolescent willbe. Eventually, he willnot be able to sustain hislifestyle financially and

    will come to rob from people.He will eventually get into analtercation in which he willtake someone's life. It is betterthat he be put to death whenhe is relatively innocent thanlet him come to thievery,robbery, and eventuallymurder when he would bedeserving of the deathpenalty!

    The Gemara adds at leastaccording to one opinion thatthe situation of a Ben SorerU'Moreh never actuallyoccurred and never couldoccur. The reason for this isthat the legal conditionsnecessary to execute such achild are so exacting andunlikely that it is virtuallyimpossible for them to evercome to fruition. The Gemarajustifies the fact that an"impossible" event is dealtwith at length in the Chumash

    and in the Talmud with theprinciple "come expound itslessons and receive reward forthat" (drosh v'kabel sechar).

    In one sense, this can beunderstood to mean that sinceit is part of the Torah, we willreceive reward for studying it,irrespective of the practicalapplication of these laws (inthe same way that we receivereward nowadays for studyingthe laws of the Temple or

    Rabbi Frand on Parshat Ki Teitzeiother ritual practices that weare no longer able toobserve on a practical level.)

    However, Rabbi Abraham JTwerski has a differentinsight in the expressiondrosh v'kabel sechar. Hemaintains that the Torah isteaching us a lesson herewhich should be expoundedand for which we will gain

    practical insight and advice.The Torah is talking hereabout a concept which hasperhaps become in vogueover the last 15 or 20 years,but was unheard of beforethat. This is the concept of"tough love," which theTorah introduced manymillennia before anypsychologist or social workerever came up with theexpression. Rabbi AbrahamJ. Twerski is himself apracticing psychiatrist and

    his area of specialization isaddictions. He deals with theproblem of drug addiction,which unfortunately, is not arare problem even in ourown community.

    As a practicing psychiatristwho has dealt with this, hemakes the statement thatthe only way a person whohas an addiction is going tobe cured is through "toughlove". That "tough love"

    means the parents who have such a child must at timesact in ways that seem insensitive and cruel to the child.The parents cannot just keep providing the child withmoney to feed his habit. If it means that the child will bearrested for stealing money from others or that he willhave to spend time in jail as a result of his crimes, so beit. The eventuality and the inevitability of a person whohas an addiction problem is that the only way it is goingto be ultimately dealt with is if it is to be cured once and

    for all. When the Torah records the Parsha of theWayward and Rebellious son, it is informing us of theprinciple of "tough love".

    No human being is more merciful than the All MercifulOne. How then can this Torah of Kindness whose waysare the ways of pleasantness proscribe that parentsshould take their children to court to have themexecuted? The answer is that this is the ultimate mercy,because the alternative is even worse than that.

    Just as if Heaven Forbid a child should have amalignancy on his leg and the only chance for survivalwould require amputation of the leg, the parents whobrought that child to the hospital to have his leg

    amputated would not be viewed as cruel parents but asmerciful parents, so too this idea applies to the(theoretical) case of parents who have to bring theirWayward and Rebellious son to Beis Din to undergo thepunishment proscribed for a Ben Sorer U'Moreh. This isthe only way, under those circumstances, to save atleast the "World to Come"- of this child. The "Droshv'kabel Sechar" of this chapter is that sometimes "toughlove" must be applied.

    I always say never to pasken halacha (act in practice)based on ideas and opinions presented in my lectures.Certainly, regarding interacting with children andapplying "tough love" to children acting out, no oneshould pasken from a lecture. But the concept is a valid

    one in certain situations of child rearing and it is a primelesson which we should be aware of in studying the lawsof Ben Sorer U'Moreh: Sometimes what appears to becruel, is the biggest salvation for a child.
