SUMMARY OF INDIVIDUAL SUBMISSIONS – AMENDMENT C111 – REVIEW OF THE SPECIAL BUILDING OVERLAY PAGE 1
SUMMARY OF SUBMISSIONS AMENDMENT C111 – REVIEW OF THE SPECIAL BUILDING OVERLAY The following table summarises the individual submissions received during the exhibition period of Amendment C111. Please refer to the ‘Consultation Report’ for an overview of the issues raised in the submissions.
Submission No. & Location
Effect of Amendment on Property (if relevant) Summary of the submission Seeks changes to
Amendment?
111-SUB001 Nightingale Street, Balaclava
SBO1 (Melbourne Water)
Existing SBO (with changes to the floodshape)
Amendment would not be necessary if the main drains were able to cope with heavy rainfall. There is a history of localised flooding in their area and this occurs more frequently than 1 in
100 years. Drains appear to be blocked or inadequate and should be replaced or cleaned. Question why the drains can’t cope with heavy rainfall, how this can be rectified, whether
planning applications would be free of charge and whether Melbourne Water is financially liable for flood damage caused to properties. Melbourne Water responded to these questions by email on 1 April 2015.
No
111-SUB002 Barak Road, Port Melbourne
SBO1 (Melbourne Water)
Existing SBO (with no change to floodshape)
Question whether the flood shape is caused by a lack of maintenance of the outfall drain to the Bay.
The outfall drain should be upgraded to reduce flood and other risks. Increase in non-permeable development in Fishermans Bend will worsen flooding impacts –
further necessitating the need to upgrade the outfall drain. Oppose any move to make planning more difficult for residents, including a requirement to
refer applications to Melbourne Water.
Yes Abandon Amendment
111-SUB003 Balston Street, Balaclava
SBO1 (Melbourne Water)
Existing SBO (with no change to floodshape)
Problem with specific drain near their property continually being blocked and lack of maintenance to that drain. Existing customer request from earlier in February, response to customer provided from Maintenance and Renewal Unit in early March about cleaning of the drain and future upgrades.
No
111-SUB004 City Road, South Melbourne
SBO2 (Council) Added to the SBO Significant coverage of
the SBO
No flooding has occurred to the property in previous 20 years. Property should not be subject to this administrative restriction.
Yes Modify Amendment to
remove the property
111-SUB005 Henderson Street, South Melbourne
SBO3 (Melbourne Water)
Existing SBO (with no change to floodshape)
Support that the issue of possible flooding is being carefully investigated. Not clear what other actions Council is undertaking to reduce flooding. Problem with specific drain near their property that is in need of maintenance. Customer
request logged. Action was taken in early March to clean the drain. Drain has been scheduled for future regular cleaning.

Amendment?
111-SUB006 Nelson Road, South Melbourne
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
Problem with specific drains near their property and provided a detailed list of design improvements. Customer request was logged that included this detailed list. Maintenance issues were noted and location was noted for possible improvements or upgrades in the next financial year. Future works may involve new pits in the lowest location to cater to 1 in 5 year flooding where minor ponding occurs.

SUMMARY OF INDIVIDUAL SUBMISSIONS – AMENDMENT C111 – REVIEW OF THE SPECIAL BUILDING OVERLAY PAGE 3
Submission No. & Location
Effect of Amendment on Property (if relevant) Summary of the submission Seeks changes to
Amendment?
111-SUB014 Young Street, St Kilda East
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
A minor part of the property is proposed to be included in the SBO. Buildings on the land would not be affected (only fences) and a permit is not required to
construct replacement fences to the same height and of similar materials. Property should be removed from the SBO or provide assurance that the substantive
property is unaffected by the overlay. Submitter was advised about the extent of the proposed SBO over the property and that a planning permit is only required if buildings or works are proposed within the SBO boundaries.
Yes Modify Amendment to
remove the property
111-SUB015 Rainsford Street, Elwood
SBO1 (Melbourne Water)
Added to the SBO Significant coverage of
the SBO
No flooding has occurred to the property or the adjoining property in the previous 30-38 years.
Recent flood events did not impact on property.
Yes Modify Amendment to
remove the property and other properties
111-SUB016 Kerferd Street, Albert Park
SBO2 (Council) Existing SBO (with
changes to the floodshape)
Minor additional coverage of the SBO
No flooding has occurred to the property in the previous 5 years or earlier (according to the previous owner).
Other properties further up the road have been affected. The revised flood modelling does not reflect actual flood events.
Yes Modify Amendment to
remove the property
111-SUB017 Milton Street, Elwood
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
Objects to the inclusion of the property in the SBO. No reasons specified.
Yes Modify Amendment to
remove the property
111-SUB018 Raglan Street, Port Melbourne
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
Surveyed levels demonstrate that the property is well above the flood level. Anomaly should be corrected to remove the property from the proposed SBO.
Yes Modify Amendment to
remove the property (and correct anomaly)
111-SUB019 Lambeth Place, St Kilda
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
Flood modelling indicates very limited inundation to the rear of the property. Flood water is not expected to cross the boundary due to existing fences. Lack of rear access means that no entrance to a basement car park would be proposed at
the rear of the property. Amendment proposes an unnecessary administrative burden and restriction on future
development.

SUMMARY OF INDIVIDUAL SUBMISSIONS – AMENDMENT C111 – REVIEW OF THE SPECIAL BUILDING OVERLAY PAGE 4
Submission No. & Location
Effect of Amendment on Property (if relevant) Summary of the submission Seeks changes to
Amendment?
111-SUB020 Moore Street, Elwood
SBO1 (Melbourne Water)
Added to the SBO All of the property is
covered
Property and the immediate neighbourhood should not be included in the SBO. Modelling undertaken by Melbourne Water is inaccurate because the property has never
flooded. The modelling does not take into account recent upgrades to the local drainage in the street. Council should concentrate on engineering solutions to fix the flooding issues instead of
making changes to the planning scheme.
Yes Modify Amendment to
remove the property and other properties
111-SUB021 Station Street, Port Melbourne
SBO2 (Council) Added to the SBO Very Minor coverage of
the SBO
Coverage of the proposed SBO is very minor (17mm). Anomaly should be corrected to remove the property from the proposed SBO.
Yes Modify Amendment to
remove the property (and correct anomaly)
111-SUB022 Phyllis Street, Elwood
SBO2 (Council) Added to the SBO Moderate coverage of
the SBO
Coverage of the proposed SBO is minor at the front of the property. No building would be constructed in that location due to the requirement for buildings to be
set back from the front boundary. Council should be upgrading the local drainage system to cater for flooding events by levying
costs on affected property owners. There are increased costs associated with future development to increase floor levels. The inclusion of the property in the SBO may impact on the value of the property.
Yes Modify Amendment to
remove the property
111-SUB023 South East Water
Submission relates broadly to the Amendment
Supports the Amendment. Requested not to be contacted further about the Amendment by Council or Planning Panels
Victoria.
No
111-SUB024 Glen Huntly Road, Elwood
SBO1 (Melbourne Water)
Existing SBO (with no change to floodshape)
Problem with stormwater drains working very slowly. The property has been previously (partially) flooded.
No
111-SUB025 Glen Eira Road, Ripponlea
SBO2 (Council) Added to the SBO Moderate coverage of
the SBO
Objects to the inclusion of the property in the SBO. The SBO would inhibit redevelopment and may impact on the value of the property.

Submission No. & Location
Effect of Amendment on Property (if relevant) Summary of the submission Seeks changes to
Amendment?
111-SUB026 Dow Street, Port Melbourne
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
No flooding has occurred to the property in previous 72 years. Coverage of the proposed SBO is minor at the front of the property. The remainder of the property should be exempted from the Amendment. Including the entire property in the Amendment will increase insurance premiums and
reduce the value of the property. Submitter was advised that the effect of the SBO is limited to the part of the land that is covered by the SBO.
Yes Modify Amendment to
remove the property
111-SUB027 Brunning Street, Balaclava
SBO2 (Council) Added to the SBO
Supports initiatives to address local flooding. Buildings should be constructed on stumps to allow for water to pass underneath. New buildings with solid slabs or masonry foundations may exacerbate flood risk to
adjoining properties.
Yes Modify Amendment to
include further policy development
111-SUB028 Pakington Street, St Kilda
SBO1 (Melbourne Water)
Existing SBO (with change to floodshape)
Significant reduction of SBO over property (minor amount of SBO remaining)
The modelling did not consider sea level rise associated with climate change but did consider climate change impacts on predicted rainfall.
The significant removal of properties in their area from the SBO is puzzling considering the impacts of climate change and past flood events.
The street was subject to previous flooding in 2011. The modelling contradicts previous work undertaken that highlights flood risk to additional
properties in this area. The existing SBO should be retained in this area pending further investigation.
Yes Modify Amendment to
keep all of property in SBO
111-SUB029 Ormond Esplanade, Elwood
SBO2 (Council) Added to the SBO Significant
Objects to the inclusion of the property in the SBO. The building has been constructed with floor levels greater than 300mm above the flood
level (and no basement), which has meant that it was unaffected by previous flood events.
Yes Modify Amendment to
remove the property
111-SUB030 Esplanade West, Port Melbourne
SBO2 (Council) Added to the SBO
Design and location of the local drains are inadequate and unable to deal with flood water. Existing customer request lodged in January. Additional note provided containing the submission about the drains and request to contact the submitter.
No
111-SUB031 Richardson Street, Middle Park
SBO2 (Council) Added to the SBO Moderate coverage of
the SBO
Objects to the inclusion of the property in the SBO. The property has a significant slope from the front of the site to the rear. The floor to the garage is raised slightly and the boundary wall would prevent flood waters
from entering the property.

Submission No. & Location
Effect of Amendment on Property (if relevant) Summary of the submission Seeks changes to
Amendment?
111-SUB032 Eildon Road, St Kilda
SBO2 (Council) Added to the SBO Moderate coverage of
the SBO
No flooding has occurred to the property in previous 20 years. Some ponding occurred to the drains immediately outside of the property but this was from
the drains being blocked. The encroachment of the flood modelling where the driveway is located may be incorrect as
the driveway is higher up than the adjoining property. The inclusion of the property in the SBO may impact on insurance premiums and the value
of the property.
Yes Modify Amendment to
remove the property
111-SUB033 Little O’Grady Street, Albert Park
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
Flooding extends mostly to the rear easement, which resembles a laneway. The remainder of the property is above the flood level. The model does not analyse topography or built form. The overlay would place a significant restriction on future development. The ability to raise floor levels is restricted through the Heritage Overlay.
Yes Modify Amendment to
remove the property
111-SUB034 Park Street, South Melbourne
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
Objects to the inclusion of the property in the SBO. Drains should be upgraded with sufficient capacity to avoid flooding risks. Amendment proposes an unnecessary administrative burden and restriction on future
development. Special levies should be introduced to pay for upgrades. The inclusion of the property in the SBO may impact on the value of the property.
Yes Modify Amendment to
remove the property
111-SUB035 Cruikshank Street, Port Melbourne
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
Objects to the inclusion of the property in the SBO. No flooding has occurred to the property in previous 15 years. The inclusion of the property in the SBO may impact on the value of the property.
Yes Modify Amendment to
remove the property
111-SUB036 Southey Street, Elwood
SBO2 (Council) Added to the SBO Moderate coverage of
the SBO
Objects to the inclusion of the property in the SBO. Previous floods in the area only came up to the level of the bricks of the front fence.

remove the property
111-SUB037 Gourlay Street, Balaclava
SBO1 (Melbourne Water)
Added to the SBO Minor coverage of the
SBO
Objects to the inclusion of the property in the SBO. The property contains an apartment building. Only apartments affected by flooding should be
included in the overlay. Council and Melbourne Water advised submitter that a planning permit (and referral to Melbourne Water) is only required if proposed buildings and works are on the land within covered by the SBO.
Amendment proposes an unnecessary administrative burden.

111-SUB040 Edina Close, Port Melbourne
SBO2 (Council) Added to the SBO Moderate coverage of

Existing built form would prevent flood waters from entering the property. Questioned how the floodshape was generated. The inclusion of the property in the SBO may impact on insurance premiums and the value
of the property.

SBO2 (Council) Added to the SBO Moderate coverage of
the SBO
Questioned the accuracy, dates and methodology of the LIDAR points that were generated, and the qualifications of the officers undertaking that work.
Questioned whether a resident could use a land surveyor to provide more accurate levels to replace the LIDAR points.

111-SUB047
Submission relates broadly to the Amendment
Climate change will mean that future flood levels will be higher due to predicted sea level rise and increased rainfall intensity.
The use historical rainfall data made sense in the past to predict the impact of 1 in 100 year storm events.
The modelling of possible climate change effects are not conservative and they really may be more severe.
The SBO will be used to guide the design of buildings with a lifespan of 50-100 years. There is no justification for not incorporating the impacts of climate change because:
o Climate change increases rainfall intensity o Higher sea levels reduces the capacity of the drainage system o Future impacts of coastal climate change have already informed planning
decisions. The SBO should be based on flood levels derived from modelling for the assumed impacts of
climate change.

111-SUB049 Gibbs Street, Balaclava
SBO1 (Melbourne Water)
Added to the SBO Minor coverage of the
SBO
Objects to the inclusion of the property in the SBO. No flooding has occurred to the property in the past 34 years. The modelling may not have considered changes to the drainage along the street to the rear
of their property, or the speed hump to a nearby street. The flood depth on the property is shallow and may be within the margin of error for the
LIDAR data points.

111-SUB050 Spray Street, Elwood
SBO2 (Council) Added to the SBO Minor coverage of the
SBO
Objects to the inclusion of the property in the SBO. No flooding has occurred to the property to their knowledge. Flooding has occurred to other nearby areas, including areas already covered by the SBO. SES flood guide in 2013 showed their property as being outside of the areas affected by
flooding. The proposal imposes an unnecessary and unreasonable burden on their property.
