Section 7. Terms of Reference

1 PROJECTBACKGROUND

1.1 General Background The project is located in Tigoni Sub location of Limuru constituency and Githunguri constituency. Limuru and Githunguri are towns in central Kenya. They are also administrative divisions in Kiambu County. The county has ten constituencies:

• Githunguri Constituency

• Kiambaa Constituency

• Kabete Constituency

• Limuru Constituency

• Lari Constituency

• Gatundu North Constituency

• Gatundu South Constituency

• Ruiru Constituency

• Thika East Constituency

• Thika West Constituency

Kiambu County is an area with temperatures varying with altitude between 30° C maximum and 14° minimum. The climate of the area is generally cool throughout the year. The coolest period is between July and August while the hottest months are from November to April. Rainfall in the district is bi-modal, generally occurring in the months of March to May and October to December. The area receives reliable rains with a mean annual rainfall of 1100mm. the evaporation/evapo-transpiration is estimated to be between 1,450 and 2,200mm per annum. Limuru constituency consists ofKarambani, Limuru, Tigoni, Ndeiya, Ngecha and Rironi locations. Tigoni water project is aimed at providing domestic water to residents of Tigoni location. Tigoni location consists oflthanji and Red-Hill sub-locations. The project is in Kiambu-West district. The project will also serve Karanjee, a village near Limuru town which is in Mabrouke sub-location.

1.3 Limuru Water And Sewerage Company

Limuru Water and Sewerage Company Limited was incorporated on 13th March 2006 under the Companies Act (50) 1959 chapter 486 and is one of the Water Service Providers appointed by the Athi Water Services Board (AWSB) and responsible for the efficient and economical provision of water and sewerage services. The Company is wholly owned by the Municipal Council of Limuru.

The water arid sewerage company's designated area of supply is the Limuru Municipality, Kiambu West District and part of Lari District. The population of the service area of the WSP as defined by the WSP is expected to be 252,652 in 2015.

The Company is divided into three administrative schemes namely:

• Limuru-Urban • Bathi -Rural • Thigio-Rural

The company is also overseeing the operation of Bibirioni and Kamirithu community water projects through a Third Party Water Provision Agreement

The mandate and objectives of LIW ASCO are enshrined in the memorandum and articles of association. The principal objective of the company is to carry out the business of water and sewerage services provision within the area under its jurisdiction as provided for in the SPA withAWSB. .

1.4 Githunguri Water And Sewerage Company

Githunguri Water and Sewerage Company Limited was incorporated on 1st October, 2007 under the Companies Act (50) 1959 chapter 486 and is one of the Water Service Providers appointed by the Athi Water Services Board (AWSB) and responsible for the efficient and economical provision of water and sewerage services.

The water and sewerage company's designated area of supply is within Githunguri District and lower parts of Lari district and its environs. The area covered is approximately 247km2

with a total population of 200,009 people.

The mandate and objectives of GIWASCO are enshrined in the memorandum and articles of association. The principal objective of the company is to carry out the business of water and sewerage services provision within the area under its jurisdiction as provided for in the SPA withAWSB.

1.5 Existing Water Supply Situation

1.5.1 Limuru Water and Sewerage Company Limited (LIWASCO) As earlier mentioned, there are three (3 No.) existing main water supply schemes within the jurisdiction area of LIW ASCO namely:

• Limuru Water Supply Scheme which is supplied by boreholes with an approximate combined production of 3,000 m3 /day

• Bathi Water Supply Scheme which is supplied by water from Bathi Dam with an average production of 1,150 m3/day. The dam has a safe yield capacity of20,000 m3/day. The scheme has a full conventional treatment plant.

• Thigio Rural Scheme with an average production of 600 m3 /day

LIWASCO currently operates 17 boreholes with a present production of approximately 3,000 m3/day. Water from the boreholes is treated by disinfection using chlorine. Most of the boreholes pump to storage tanks and thereafter the supply water gravitates from the tanks to their respective supply areas, while some boreholes pump directly to the distribution. The Bathi River Water Scheme serves a total area of 197 km2

The distribution system is generally in good condition with exception of a few areas whose network is old and requires replacement. There are 4,683 registered connections, out of which 2,543 are active according to the WSP records. The consumers comprise a mix of domestic, commercial, institutions and a few industries. The majority of the consumers are domestic. The consumers categorised per supply area are summarised in the table below.

The distribution network in the three schemes is in fair condition with NR W estimated to be 34% in Limuru, 27% in Bathi Rural and 33% in Thigio Rural Schemes. There is need for expanding the network to adequately serve the underserved and unserved areas. The high NRW occurs due to mal-function of the consumer meters as well as physical losses due to pipelines in poor conditions in some schemes. LIWASCO's service area is developing at a relatively high rate with new areas having been allocated for development; other areas have already started development. The distribution system covers only part of the area of supply and comprises ofuPVC & HDPE pipes diameter ranging in size from Y2 inch (DN 15) to 6 inch (DN 150). Due to the insufficient coverage of the main distribution lines of 1 inch (DN 25) to ~ inch HDPE/uPVC pipes are used as distribution mains which connect several consumers. There are a number of community water projects (CWPs) under the WSP service areas, some of which the WSP has already taken over for operation. The Company has taken over 4 No. community water projects-CWPs; namely: Tigoni, Ndiuni, Kiawaroga and Thigio. In addition, LIW ASCO has constructed chambers to protect springs - namely Kijabe Springs where nearly 200 m31day is abstracted and treated at composite treatment units (CFUs) to serve consumers in Kijabe area. The Company has also signed a third party Service Provision Agreement (SPA) with Bibirioni and Kamirithu Community Water Projects.

1.5.2 Githunguri Water and Sewerage Company Limited GIWASCO

The main sources of water within GIWASCO's service area are boreholes and river intakes. There are 13 boreholes and 4 river intakes, while some areas are also supplied from the Sasumua and Ng'ethu bulk water supply under NCWSC. The current yield of the boreholes ranges between 5 m3/h to 16 m3/h with a present production of nearly 1,550 m3/day. The boreholes are low yielding and incur high electricity costs due to pumping. The total production from the water sources is estimated to be 2,550 m3/day based on the 2013/14 records.

The schemes are either supplied from boreholes or river sources. The borehole supply schemes include Githunguri, Gathaithi, Giatheko, Thoita, Kiratina, Mihuko, Waingere and Kiaria (1); whilst the river supply schemes include Komothai, Matimbei and Kagaa. There are also 4 offtakes which are currently inactive. These offtakes include: Kiaria (2), Gathanje, Gathigu and Kiambururu.

GIW ASCO currently operates 11 independent water supply schemes and 13 offtakes supplied from the NCWSC bulk supply from either Sasumua or Ngethu transmission mains. For the borehole schemes, no treatment is done for the water. Apart from Komothai water supply, the WSP supplies raw water to the residents. Most ofthe boreholes pump water to storage tanks where water gravitates from there to the consumers; however some boreholes pump water

directly to the distribution. The distribution system is generally in good condition with the exception of some areas whose network is old and the pipelines require replacement. There are 6,107 registered connections, out of which 3,012 are active as at March 2014.

There is an ongoing water rationing program due to inadequate water supply. Additional water sources are required to meet the increasing water demand and consequently increase access to water by extending the distribution system unserved and underserved areas. The average Non Revenue Water (NRW) is 47% over the year 2013/2014. The high NRW occurs due to under-registering of the consumer meters as well as physical losses due to pipelines in poor conditions in some schemes. A WSB is currently undertaking the rehabilitation and expansion of the existing Komothai water supply scheme. A number of water source development projects including the construction of the Matimbei and Mukuyu II small dams projects which is expected to abstract 2,000 m3/day and 4,000 m3/day respectively from the sources.

1.6 Location of the project

1.6.1 Limuru The project area is Tigoni Location of Limuru Constituency. It covers Ithanji, Red Hill and Parts of Mabrouke sub locations.

The project is located about 5km East ofLimuru town along Limuru-Banana road. The source of water is Tigoni Dam which is at an altitude of about 2000 meters above sea level. The project covers an area of about 7.0km2

• The project has all weather roads.

1.6.2 Githunguri The project area is in Nyanduma and kamburu wards in Lari sub-county and Komothai ward in Githunguri sub-County. The source of water is the Komothai water supply project.

1.7 Proposed Project Scope

1.7.1 Limuru The scope of the Project include construction of 1,000m3/d treatment plant using water from the Tigoni Dam. After treatment, the water will be pumped to the proposed elevated tank from where it will gravitate to the residents.

1.7.2 Githunguri The scope of the project includes laying of 100kms of water distribution network in the areas ofNyanduma, Komothai and Kamburu.

1.8 Current Sector Responsibilities

1.8.1 Athi Water Services Board (A WSB)

For many years, the institutional arrangements in the water sector in Kenya were unable to deliver and maintain basic water supply and sewerage infrastructure to the growing population. Following the publication of the National Water Policy in 1999, major reforms of the sector were initiated with the revision of the Water Act in 2002. The revised Kenya Water

Act officially became operational on 18th March 2003, providing a new legal and institutional framework for the management and development of Kenya's water resources as well as for the provision of water and wastewater services. The new Act defines clear roles for the different actors involved in the decentralized institutional framework that separates policy formulation from regulation and services provision.

The 2002 Water Act originally proposed the formation of seven regional Water Services Boards, but this was increased to eight Boards with the formation of the Tanathi Water Service Board (TAWSB) in 2008.

Under the Water'Act 2002, the Water Service Boards are licensed by the Water Services Regulatory Board, (WASREB) and are the asset holders of the water and sanitation infrastructure facilities within their areas of jurisdiction. The Boards were given the legal responsibility for the provision of water and sewerage services and are responsible for the planning and development of the water supply and sewerage services within their area. They were mandated to contract out delivery services to Water ~Service Providers (WSBs) to operate and maintain the infrastructure facilities. This situation has changed following the operationalization of the Constitution of Kenya 2010 in that water and sewerage services are the mandate of the County Governments. The WSPs therefore are now entities under the County Government. The asset holder of the water and sewerage infrastructure in the city of Nairobi is the Athi Water Services Board (A WSB). The Athi Water Services Board (A WSB) became operational in 2004 and has made great strides in improving water and sanitation services in its area of jurisdiction, which includes Nairobi County and the surrounding districts ofThika, Gatundu, Kiambu East and Kiambu West all in Kiambu County

1.8.2 Water Service Providers (WSPs)

(a) Limuru Water And Sewerage Company

Limuru Water and Sewerage Company Limited was incorporated on 13th March 2006 under the Companies Act (Cap. 486) and is one of the Water Service Providers appointed by the Athi Water Services Board (AWSB) and responsible for the efficient and economical provision of water and sewerage services. The Company is wholly owned by the Municipal Council of Limuru.

The water and sewerage company's designated area of supply is the Limuru Municipality, Kiambu West District and part ofLari District. The area covered is approximately 280km2

with a total population of 218,408 people within the two Districts. The population of the service area of the WSP as defined by the WSP is expected to be 252,652 in 2015.

Kiambu County is planning to cluster the WSPs operating in their area, into two. In this plan, it is proposed that Limuru be clustered with Kiambu, Kikuyu, Githunguri and Karuri. Progress on this plan is likely to follow on from the passing of County legislation, and new Water Act.

1.9 The 2010 Constitution

In 2010, the Government of the Republic of Kenya promulgated a new Constitution for the country and, in 2011 a new Water Bill was drafted to align the water sector and management of water affairs to the requirements of the new constitution. These recent changes might have significant implications on the policies and on the legal and institutional framework for the entire water sector, including wastewater. The administrative Provinces and Districts in the country have now been replaced by a system of County Governments whose responsibilities are not yet entirely clear but include provision of water and sanitation services.

After discussion with interested stakeholders, the Consultant is required to assess whether the institutional framework in the wastewater sector in Kenya is likely to change under the new Constitution and the proposed new Water Act. If so, the new framework sl}.ould be defined and the roles and responsibilities of the various players should be explained.

2 GOALS AND OBJECTIVES

Athi Water Services Board (AWSB) intends to employ Consultants to provide services to provide design review and construction supervision of the works. This is detailed as follows;

1. To fulfill the role of the Engineer's Representative in the supervision of the construction works;

2. To provide a detailed review of the design, the design investigations, the design assumptions and calculations and the design records, together with the contract documents, such that the review consultant shall fully endorse the design and the contract documents as his own, all prior to construction commencing;

3. To supervise, in accordance with the conditions of contract, specifications and drawings, works carried out by the selected contractor. The consultant will be responsible for ensuring that work is carried out in accordance with the designs, specifications and works contract documents while at all time ensuring quality, cost effectiveness and timely completion.

4. To provide the Client with regular status reports and other reports as per the Terms of Reference, together with all related necessary technical assistance and professional advice to the Client related to supervision of the construction of the said works.

3 SCOPE OF SERVICES

3.1 General

The works component under this assignment comprise

1. Design review of the Tigoni water supply project and reticulation system for Githunguri water supply project.

u. Supervision and coordination of works for the construction 'of Tigoni water supply and reticulation system for Githunguri water supply areas.

3.2 Services to be provided

The consultant shall be responsible for doing everything necessary to fully achieve the objectives of the services as stated above, and in so doing shall carry out not less than the following tasks;

To formally review and validate/update all the contractual documents: the design studies, results and reports and the design calculations. He should provide the client with formal recommendations to any amendments or clarifications considered necessary or desirable. The purpose of this task is to finalize without any ambiguity the permanent works to be executed. The consultant will prepare construction drawings as the contractual documents.

3.3 Detailed scope of services

3.3.1 General The works contract relevant for this assignment comprise the following:

• Raw water pipelines • 1000m3/day Treatment works at Tigoni consisting of 1 flocculation tank, 2 units of

sedimentation basins, 2 filter units, Chemical Building, Utility Building, 48 cubic meters steel elevated pressed steel backwash tank, backwash pump house and installation of backwash pumping units, and 225 cubic meters masonry clear water tank;

• Power mains supply • Ancillary works at the treatment works consisting of access roads, street lighting, site

drainage and water supply. • Treated water steel transmission pipeline • Laying of 1 OOkm of distribution network pipelines in Nyanduma, Komothai and

Kamburu

3.3.2 Design review for Tigoni water supply and Githunguri water supply

1. Identifying and confirming the water pipeline route and Tigoni water treatment site 11. Identifying all land parcels that will be affected by the construction of the water

pipelines and water treatment plant for purpose of easement or wayleave acquisition. Adequate information will be collected including size of easement or way leave required, land parcel number, land ownership and any other relevant information for purpose of land compensation.

111. Assessing and preparing a schedule for land compensation or easement in consultation with relevant government and local authority department.

IV. Identifying and documenting in the lay out drawings any geographical and hydro geological feature not shown on the available drawings.

v. Identifying and documenting physical features including buildings (temporary and permanent) trees, roads and other services that fall within the trunk sewer way leave.

VI. Identifying and recommending alternative water pipeline route in sections where prevailing situation may be an impediment to construction.

3.3.3 Construction supervision for Tigoni water project and Githunguri water project

(a) Construction Design Review

The Consultant will, on the basis of the Detailed Design reports and tender documents provided by the Client, his own experience and internationally accepted standards and practice, finalize such design criteria as he considers applicable to the construction design of the Tigoni and Githunguri water projects to meet operational objectives of the client. The consultant is expected to provide the Client with formal recommendations to any amendments or .clarifications considered necessary or desirable for the works to be executed.

(b) Reconnaissance and confirmation of pipeline route

The consultant shall undertake a reconnaissance and route survey to identify the pipeline route as defined in the drawings for Tigoni and Githunguri water projects. The consultant will be responsible for ensuring detailed identification and documentation of all features along the pipeline route including parcels of land, buildings, and services, geographical, hydrographical and others. In addition, the consultant shall undertake the following activities;

i. Identifying and confirming the pipeline route as shown on the drawings. ii. Temporary setting out and pegging of the pipeline route. iii. Assess and prepare schedule for land compensation or easement in consultation with

relevant government and local authority department IV. Identifying and documenting in the lay-out drawings, any geographical and hydro­

geological features not shown on the available drawings. v. Identifying and recommending to the Engineer alternative pipeline route in sections

where prevailing situation may be an impediment to construction.

(c) Preparation and submission of the construction drawings for the structural works The purpose of this task is to finalize without any ambiguity the permanent works to be executed.

These drawings are the Contractual Documents which define the works to be carried out by the Contractor.

The Consultant will prepare and submit the construction drawings for structural works on the basis of the Tender documents (specifications and tender drawings).

The Construction drawings will include the foundation drawings for permanent works and permanent earth works, construction drawings giving the requested instructions to the Contractor to execute the works.

The Consultant will submit the Construction drawings to the Contractor according to the Construction schedule.

(d) Examination of Drawings and Calculation, Notes drawn up by the Contractor(s) The Consultant will verify the drawings, check the calculation notes, standards and other documents produced by the contractors, giving particular attention to the compliance with Specifications and design criteria.

(e) Examination of drawings and other documents drawn up by the Manufacturer(s) The Consultant will review and analyse on the technical aspect the proposals of the Manufacturer(s) for supplying the various items of material and equipment to be incorporated into the project, giving particular attention to the compliance with the specifications.

(t) Quality assurance The objective is to assure the best quality of the Consultant's services during the whole period of design as well as during the supervision of the construction by contractor(s). To this aim the Consultant will implement a Quality Assurance Programme

(g) Works Supervision The Consultant will undertake works supervision including:

3.3.4 Coordination ofworks

Coordination of works will involve the following;

1. Organizing and directing execution of the works, by defining compliance with programmes and relations between stakeholders (A WSB, Engineer, Contractors, Suppliers and third parties). Coordination will be ensured mainly by holding regular meetings on site and general monthly meetings, with managers of the Contractors and Manufacturers, the A WSB and the Engineer.

n. Investigating, reporting and informing Client on unexpected circumstances which may arise during the construction period and advising and seeking the approval of Client for any necessary course of action.

iii. Maintaining a Site Diary and detailed record of the Contractor's manpower, materials, plant and equipment on Site, together with its deployment, availability and utilization,

while also recording the weather and any other pertinent facts which relate to the construction of the works and the progress thereof.

3.3.5 Supervision of field surveys:

The Consultant will supervise the Contractor( s) who should carry out field surveys such as topographic, engineering and geological surveys. The Consultant will prepare technical reports on all measurements made by the Contractor and will submit them to the Engineer.

3.3.6 Quality Control and Quality Assurance Plan.

1. Developing a quality control and quality assurance plan for engineering control necessary to ensure that the works are built and equipment installed in conformity with the Contractual Specifications, approved drawings, standards, agreed programme, good engineering practice and State-of-the-Art.

11. Review and approve drawings, materials and proposed construction methods submitted by the contractor to ensure compliance with the contract requirements. When the Contractor proposes a construction solution, the Consultant will examine and verify the related drawings and calculation notes, giving particular attention to the compliance with specifications and design criteria.

iii. Inspecting and testing of soils and materials supplied for incorporation in the works, and arranging and witnessing acceptance test. Continuously supervise, monitor, inspect, test, control and report on the Contractor's methods of working and the quality of the works, materials, soils and working practices for total compliance with the specifications, the contract documents and good international working practice.

IV. Aapproving or rejecting materials delivered on site and works performed by the contractor.

v. Advising Engineer on the need for special inspections or testing.

3.3.7 Project Cost Control

1. Developing a plan for project cost control on the basis of the field and quantity surveys required for determination of actual quantities of work accomplished by the Contractor.

11. Review each payment application and associated valuation of the Works prepared by the Contractor and, after making any necessary corrections, draw up and sign as approved a Payment Certificate for settlement by Client. All such Payment Certificates to include provisions for the recovery of the Advance Payment, and any other provisions such as interest, claims or liquidated damages.

iii. Prepare a payment schedule for the works up to completion, and up-date the same monthly and follow up cash flow.

IV. Making minor alterations to design as may be necessary or expedient, but the prior approval of the Engineer (subject to the no objection of the funding agency) shall be obtained for any substantial modification of the design and costs of the said works and

for any instruction of the contractor, which constitutes a major variation, omission or addition to the works. If, in the opinion of the Engineer, an emergency occurs affecting the safety of life or the works or of adjoining property, he may without relieving the contractor of any of his duties and responsibilities under the contract, instruct the contractor to execute all such work or to do all such thing as may, in the opinion of the Engineer, be necessary to abate or reduce the risk. The Engineer's Representative shall inform the Engineer immediately (less than 24 hours) of any order or instruction issued without the prior approval of the Engineer, which will result in additional cost to the Client - and shall provide the Engineer with a full justification of the need for the instruction, the detailed cost estimate, and the reason for not requesting the prior approval of the Engineer.

v. The detailed review of all claims and requests for an extension of time, with the Engineer's Representatives assessment and recommendations;

v1. Evaluation of claims including making recommendation to the Engineer and other matters concerning the contract and assistance in the settlement of disputes.

3.3.8 Plan for Project Progress Control

1. Using the same basic data as those established for project cost control, a progress chart will be maintained and updated in the Consultant's office. The work progress will be followed by the Consultant review especially during the weekly works meetings on sites. A monthly report of weekly meetings will be established by the Consultant.

n. The consultant will organize and coordinate monthly site progress meeting with the contractor, in the presence of a representative of the Client, and draw up and issue minutes of meeting.

iii. The consultant will also undertake continuous co-ordination and monitoring on the progress of the construction works and other development activities in the vicinity of the works which may affect the progress, safety and security standards.

tv. The Consultant will assist the Employer in supplying information/reports related to construction design and supervision and implementation for submission to Government and other financing agencies. This will be done in the regular monthly progress reports and quarterly progress reports to the Engineer. The quarterly progress reports will in particular include report on achievements made on the key aspects on the. project implementation as follows

• Abstraction volumes • Water production plant capacities and installations • Metering • Pipelines laid • Water storage capacities • Connections made

3.3.9 Works commissioning

The Consultant will implement works commissioning including:

a. Supervising the acceptance tests and preparing the Certificate of Completion.

Preparing the completion report for the works which will be based on the record maintained during construction design and work supervision phases. It will include the environmental completion report which will be submitted to NEMA for compliance with initial recommendations for environmental mitigation measures. The consultant will be expected to include a project outputs delivery report on areas agreed with the Engineer as a key component in the completion report. The outputs report will form the project operational baseline data summary report for operation improvement tracking purposes.

b. Prepare 'as-built drawings': The Consultant will ensure the preparation of 'as-built drawings' by the Contractor during construction of works. On completion of the Project, the Consultant will check, approve and submit to the Engineer for the Client's retention, five (5) complete sets of all detailed drawings and two (2) electronic CD-Rom copy and computations in accordance with revisions made during the construction.

c. Prepare Operation and Maintenance manuals: Based on the information and booklets received from the Contractors, Manufacturers, Suppliers and his own experience, the Consultant will ensure preparation and submission of the Operation and Maintenance Manuals by the Contractor. He will ensure the manuals are complete with the O&M recommendations identified during construction. Operation and maintenance manuals after approval by the Engineer will be submitted in four (4) printed copies and two (2) electronic CD-Rom.

3.3.10 Performance Control during the Defects Liability Period

The Consultant will carry out quarterly inspections during the one ,year (365days) defects liability period and instruct accordingly the contractors with regard to outstanding works and defects. The consultant will ensure preparation of the final account by the contractor before the end of the defects liability period and certify the final payment due to the contractor in accordance with the contract. After this period and satisfactory inspections, the Defects Liability Certificate will be issued to the contractor.

4 Consultant's Inputs and Resource Requirements

4.1 General

The consultant shall undertake the following

1. Provide personnel and all other necessary resources to supervise the construction of the WQrks throughout the period from signature of the Consulting services contract to completion of the whole works (which is the end of the defect remedial period)

n. Ensure that the work is carried out expeditiously and in accordance with conditions and standards set out in the contract. The consultant shall supply all expertise, technical advice and skills required for the supervision of the works.

111. Exercise all reasonable skill, care and diligence in the performance of the supervision of the works under the agreement and shall carry out all his responsibilities in accordance with recognized professional standards.

1v. Act as the Representative of the Engineer in all professional matters and, in so far as any of his duties are discretionary, act fairly as between Client and third parties. I

v. Supervise and coordinate construction of the works, including preparation of operation and maintenance manuals and as-built drawings. I

4.2 Equipment, logistics and facilities

The Consultant shall be responsible for the provision of all the necessary resources to carry out the Services; and shall make arrangements for the establishment of office, supporting office equipment and furniture, vehicles, accommodation, utilities, communications, and any other required resources. Under the construction contract, the Consultant will be provided with a furnished and maintained site office for the project supervision team in the project's area. It will be equipped with necessary computer(s), printing, communication, and other facilities. Under the works contract the Consultant will be provided with transportation means for the supervision team. 1 The consultant is advised to. familiarize themselves with the provisions the works contract with regard to equipments, logistics and facilities provided in the bills of quantities and specifications.

5 Duration and Timing of Services

The time period required for the provision of the services is envisaged as approximately 12 months for works supervision, and it allows for 1 man-month additional services (including costs for overheads, logistics and any additional costs incurred to conduct the services) for final inspection and issuance of completion certificate and a further 12 months limited consultancy inputs during the Defects Liability Period of the works including for the site inspection, identification of the unfulfilled obligations of the Contractor, if any, and assistance to the Client in issuing the Defects Liability Certificate.

a) The Inception Report shall include: full details of the Consultant's mobilization status, quoting a list of all key staff, the dates different members of the staff arrived on Site and the dates the offices and other facilities were established, together with the phone, fax, email and street address. Details shall also be recorded of the date of payment of the advance payment - and thereby the Date of Effectiveness of the Contract; the situation on­Site/in-country as compared to that envisaged in the Consultant's proposal and any changes proposed to the Terms ofReference as a result of the Consultant's findings; an updated work plan (including actual dates for submittal of deliverables) and staffing schedule showing actual dates (because by that time the date of contract effectiveness will be known); and base data for both the consulting services and the works contracts.

b) The Construction Design Review Report shall include: a detailed review of the design, the design investigations, the design review and records, together with the contract

documents and statement confirming that the consultant fully endorses the design and the contract documents with recommendations to the client on areas of improvement.

d) The Monthly Progress Reports shall contain all the data necessary to serve as a formal record document ofthe monthly status ofthe works and consultant's contract, including but not limited to: the contract base data; the detailed status of all aspects ofthe works; progress against/compared to agreed program; color progress photographs with detailed captions; typical test results against the specification criteria, plus all test results which do not meet specification and the action taken by the consultants; details of the Site record keeping system established and available for audit; equipment mobilization/demobilization data against the agreed equipment list; equipment availability records; key professional staffing bar chart for both the Consultant and Contractor, by position, name and duration/days of deployment; interim valuation of the works; payment status of both the Contractor and the Consultant; and full details of all claims, delays, requests for Extensions of Time and any other information the consultants may considered necessary to include in the report.

f) The Quarterly Report shall be a combination of the monthly reports, including an Monitoring and risk management section.

g) The Project Completion Report (PCR): The PCR shall be presented in draft form within two weeks of the issuance of the taking over certificate for Engineer's/Client's review and comments. The PCR shall be finalized when the final certificate has been certified by the Engineer/Consultant and all other matters have been concluded, and Client's comments have been received for accommodation. The PCR will form a comprehensive record of the Construction Work including:

• Details of the handing over of all the ER's Facilities and Resources to the Client and • Details of the handing over to the Client of all Site Records, As-Built Drawings and

other deliverables - which shall include but not be limited to a record of all test results of the key Soils and Material used in the construction; site photos; with a detailed text on how each of the records have been catalogued and referenced, and to whom they were handed over, to facilitate future use of the record data.

The Consultant should hand over the above-mentioned documents to the Engineer/Client duly bound in sequential manner with table of contents upfront and cover titles on the front cover. The As-Built drawings should be prepared in A-1 size hard copy as well as in CAD files specified by the Client. Specification of CAD shall be agreed with Client.

6.1 Reporting Format

All the reports shall be submitted in single sided A4 format, excepting only the Detailed Engineering Drawings which shall be presented in both A3 and A1 bound sets plus originals. Two electronic CD-R copies (plus one for the Funding Agency) shall also be provided along with hard copies of Schedule of Deliverables. All the deliverables shall be suitable for monochrome photocopying, i.e. figures and charts should not use color alone for

identification purposes. All reports shall include a signed and dated Letter of Submittal, a Table of Contents and an Executive Summary, in addition to the report text.

7 Client Inputs

The client input will be as follows:

• Assist the consultant to obtain licenses upon request and permits needed to carry out services.

• Avail relevant project data and reports. • Provide necessary liaison with Government departments, Limuru Water and Sewerage

Company (LIW ASCO) and local authorities.

8 Institutional Arrangements The A WSB will be officially the Client. The Client will appoint the A WSB Chief Manager Infrastructure Development or any other competent person notified to the consultant as "the Engineer". The Engineer will delegate appropriate duties and responsibilities to the consultant for the administration of the contract and supervisions and management of the project and notify the contractor. Engineer will be responsible for approving major options -taken from a technical point of view and decide contractual matters between the Client and the contractor. The Consultant is encouraged and requested to work in close collaboration with the existing service provider, the Limuru Water and Sewerage Company (LIWASCO) and Githunguri Water and Sewerage Company (GIW ASCCO).
