BOROUGH OF RUMSON
June 9, 2020
A regular meeting of the Borough Council of the Borough of Rumson was held (virtually)
on Tuesday, June 9, 2020 at 4:30 p.m.
Pledge of Allegiance.
Present: Mayor Hemphill, Council President Atwell, Councilmen Casazza, Conklin,
Kingsbery, and Swikart.
Absent: Councilman Rubin.
Thomas S. Rogers, Municipal Clerk/Administrator, was present.
Martin M. Barger, Borough Attorney, was present.
David Marks, Borough Engineer, was present.
Mayor Hemphill declared a quorum present and announced that the Notice Requirements
of the Open Public Meetings Act have been met for this meeting by the posting and mailing of a
notice at least 48 hours in advance thereof to the Asbury Park Press and the Two River Times.
On motion by Councilman Casazza, seconded by Council President Atwell, the minutes
of the previous meeting were approved as written, copies having been forwarded to all Council
members. All in favor.
COMMUNICATIONS:
NOTIFICATION RECEIVED FROM THE MONMOUTH COUNTY DIVISION OF
ENGINEERING AND TRAFFIC SAFETY ADVISING OF AN ONLINE PUBLIC
INFORMATION CENTER MEETING TO BE HELD. THE MEETING MATERIALS
AND VIDEO PRESENTATIONS WILL BE AVAILABLE FROM TUESDAY, JUNE 9,
2020 UNTIL FRIDAY, JULY 10, 2020 ON PUBLIC WEBSITE

The Municipal Clerk/Administrator received notification from the Monmouth County
Division of Engineering and Traffic Safety providing information for an upcoming meeting
regarding the Rumson Sea Bright Bridge. Interested parties should visit
www.rumsonseabrightbridge.com to gain access to all materials and video presentations.
Council President Atwell made a motion to accept the communication. Councilman
Casazza seconded the motion and this communication was ordered received. All in favor.

LETTER OF NOTIFICATION RECEIVED FROM KRISTIN WILDMAN, SENIOR
ENVIRONMENTAL CONSULTANT FOR DUBOIS & ASSOCIATES ADVISING OF AN
APPLICATION SUBMISSION TO THE NJDEP FOR A COASTAL GENERAL PERMIT
5 AND FRESHWATER WETLAND TAW. PROPERTY LOCATED AT BLOCK 122,

The Municipal Clerk/Administrator received a letter of notification from Kristin Wildman,
Senior Environmental Consultant for DuBois & Associates advising the Borough of Rumson of an
application submission to the New Jersey Department of Environmental Protection. Property
owners at Block 122, Lot 2 (115 Rumson Road) are applying for a Coastal General Permit 5 and a
Freshwater Wetland Transition Area Waiver.

2020 MUNICIPAL CLERK/ADMINISTRATOR’S BUDGET STATEMENT
2020 MUNICIPAL CLERK/ADMINISTRATOR’S
BUDGET STATEMENT
The Borough of Rumson’s portion of the tax rate for 2020 will decrease by 4.6% over the
2019 prior year’s rate.
It is our goal to preserve the high level of services our residents have come to expect.
Each year the Mayor and Council and the Borough’s Management Team work hard to manage
annual budgetary pressures, while looking for new and creative ways to continue or expand
services. Similar to last year, 2020’s budget climate is one where we are faced with rising costs
in conjunction with many flat revenue sources. In addition, we are currently dealing with a
worldwide pandemic from the virus known as COVID-19, which has added even more pressure
and uncertainty. After declaring a State of Emergency for our Borough, the Mayor and Finance
Committee Chairman sent the following letter to all Rumson Residents last month. The letter
outlines initial steps that have been taken to insure that we come out of the pandemic in a strong
financial position.

I would like to thank the Mayor and Council, and specifically would like to thank the
Finance Committee, Councilman and Chairman John Conklin and Councilmen Kingsbery and
Swikart for their help and support in drafting this budget. I would also like to thank Helen
Graves and the management team of the Borough for their continued help in containing costs and
looking for innovative ways to offer our services to the residents of the Borough of Rumson.

The Municipal Clerk/Administrator received a letter of notification from Stuart C.

for a Waterfront Development Individual and CAFRA General Permit.

OFFICERS AND CERTAIN BOROUGH EMPLOYEES IN THE BOROUGH OF RUMSON,
NEW JERSEY IN FIRST READING. PUBLIC HEARING SCHEDULED FOR JULY 14,
2020 AT 4:30 P.M.
The Municipal Clerk/Administrator read the following Ordinance by title only in first
reading:

AN ORDINANCE FIXING
COMPENSATION OF BOROUGH
OFFICERS AND CERTAIN
BOROUGH EMPLOYEES IN THE
BOROUGH OF RUMSON, NEW JERSEY.

Be It Ordained by the Mayor and Council of the Borough of Rumson that the annual
compensation ranges for offices listed below be amended as follows:
SECTION 1. The annual salary range effective January 1, 2020, which shall be paid semi-
monthly, unless otherwise stated, of the officers, employees and appointees shall be as follows:
66. Assistant Foreman $ 50,000.00 - $ 85,500.00
SECTION 2. Effective January 1, 2020, Ordinance 18-007 entitled “An Ordinance Fixing
Compensation of Borough Officers and Certain Borough Employees in the Borough of Rumson,
New Jersey,” passed and approved June 12, 2018 is hereby amended.
This ordinance shall take effect upon its passage and publication according to law.
Councilman Rubin moved the adoption of this Ordinance in first reading. Motion
seconded by Council President Atwell and carried on the following roll call vote:

RESOLUTION 2020-0609-78 AUTHORIZING THE ADOPTION OF THE 2020 BOROUGH
BUDGET AS INTRODUCED.

Councilman Rubin offered the following resolution and moved its adoption:
MUNICIPAL BUDGET NOTICE
Section 1.
Municipal Budget of the Borough of Rumson, County of Monmouth for the Fiscal Year
2020;
BE IT RESOLVED, that the following statements of revenues and appropriations shall
constitute the Municipal Budget for the year 2020;
BE IT FURTHER RESOLVED, that said Budget be published in the Two River Times in
the issue of June 18, 2020.
The Governing Body of the Borough of Rumson does hereby approve the following as
the Budget for the year 2020.

Notice is hereby given that the Budget and Tax Resolution was approved by the

A hearing on the Budget and Tax Resolution will be held virtually on July 14, 2020 at
4:30 o’clock (p.m.) at which time and place objections to said Budget and Tax Resolution for the
year 2020 may be presented by taxpayers or other interested persons.
RESOLUTION 2020-0609-79 DETERMINING TO READ THE 2020 MUNICIPAL BUDGET

Councilman Rubin offered the following resolution and moved its adoption:
RESOLUTION DETERMINING TO READ 2020 BUDGET BY TITLE
WHEREAS, the Rumson Borough Municipal Budget for 2020 was introduced and
approved by the Governing Body at its meeting on June 9, 2020; and
WHEREAS, the budget will be advertised at least 10 days prior to the hearing date of
July 14, 2020; and
WHEREAS, at least one week prior to the hearing date a complete copy of the approved
budget shall be made available for public inspections in the Oceanic Free Library and the
Monmouth County Library Eastern Branch; and
WHEREAS, Thomas S. Rogers, Municipal Clerk, will attest delivery of the 2020
Rumson Municipal Budget to both the Oceanic Free Library and Monmouth County Library
Eastern Branch; and
WHEREAS, at least one week prior to the hearing date a complete copy will be made
available to each person requesting the same, during said week and during the public hearing;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of
Rumson that, pursuant to N.J.S.A. 40A:4-8, the 2020 Municipal Budget shall be read by its title,
the conditions of publication referred to earlier in this resolution having been met.

RESOLUTION 2020-0609-80 AUTHORIZING ESTIMATED 3RD QUARTER PROPERTY
TAXES.

Councilman Rubin offered the following resolution and moved its adoption:

RESOLUTION AUTHORIZING
THE BOROUGH TAX COLLECTOR TO PROCESS
3RD QUARTER “ESTIMATED” TAX BILLS, DUE AUGUST 1, 2020
WHEREAS, in light of the disruption caused by the coronavirus outbreak, the State has
delayed the adoption of the State Fiscal Year 2021 Budget to September 30, 2020; and
WHERAS, the Division of Local Government Services (DLGS) cannot certify State Aid
allocations to municipal budgets until State Aid Appropriations are known; and
WHEREAS, the DLGS cannot approve municipal budgets and the County Board of
Taxation cannot certify taxes until long after the June 30, 2020 deadline to process third quarter
tax bills due August 1, 2020; and
WHEREAS, without an adopted 2020 Municipal Budget and without a 2020 Certified
Tax Rate, the Tax Collector cannot process the final 2020 Tax Levy; and
WHEREAS, the DLGS “strongly recommends” under Local Finance Notice 2020-07
“that municipalities prepare to issue estimated property tax bills for 2020;” and
WHEREAS, the Tax Collector, in consultation with the Chief Financial Officer,
computed and certified an estimated Tax Levy necessary to bill third quarter taxes due August 1,
2020 of $56,371,829.18.
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of Borough of
Rumson, County of Monmouth, State of New Jersey, that the Tax Collector is hereby authorized
and directed to process estimated tax bills for the third quarterly installment of 2020 taxes;
BE IT FURTHER RESOLVED that, the third quarterly installment of 2020 taxes shall
not be subject to interest until the later of August 10, 2020 or the twenty-fifth (25) calendar day
after the date the estimated tax bills were mailed. The estimated tax bills shall contain a notice
specifying the date on which interest may begin to accrue.

RESOLUTION 2020-0609-81 REFUNDING CERTAIN SPRING AND SUMMER
RECREATION FEES.

Councilman Rubin offered the following resolution and moved its adoption:

SPRING AND SUMMER RECREATION PROGRAMS
WITHOUT A CLAIMANT’S CERTIFICATION
WHEREAS, registration for Rumson Recreation Programs are paid by credit card using
an online processing system; and
WHEREAS, Resolution #2020-0101-8 authorized the pre-payment of Recreation Credit
Card Refunds; and

WHEREAS, due to the COVID19 Public Health Emergency, the Rumson Recreation
Spring and Summer programs have been cancelled; and
WHEREAS, the online registration system will only allow refunds by credit card up to
120 days from the registration date; and
WHEREAS, Kevin Delia, Rumson Recreation Director, has certified a list of 225 refunds
to be paid by check because the credit card payment was made more than 120 days prior to the
cancellation of the Spring and Summer Recreation Programs; and
WHEREAS, in order to expedite the refund, the Chief Financial Officer in consultation
with the Borough Administrator has authorized the processing of the refund without a Claimant’s
Certification and Declaration on the purchase order.
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of
Rumson that the Chief Financial Officer be and is hereby authorized to process refunds for
Spring and Summer Recreation programs without a Claimant’s Certification and Declaration on
the corresponding purchase order.

RESOLUTION 2020-0609-82 AUTHORIZING CHANGE ORDER NUMBER 4 AND
FINAL FOR THE 2018 ROAD IMPROVEMENT PROGRAM – PHASE II.

Councilman Rubin offered the following resolution and moved its adoption:
RESOLUTION TO AUTHORIZE CHANGE ORDER NUMBER 4 AND FINAL
FOR THE 2018 ROAD IMPROVEMENT PROGRAM – PHASE II
WHEREAS, S. Batata Construction, of 238 Ernston Road, Suite 1R, Parlin, New Jersey
08859, was awarded a contract with the Borough of Rumson for the Borough’s 2018 Road
Improvement Program – Phase II on August 21, 2018 in the amount of $588,658.00; and
WHEREAS, certain field changes and supplemental work was deemed necessary during
the project, and;
WHEREAS, quantities of certain items in the original contract have been adjusted to
reflect as-built quantities and actual field conditions;
NOW, THEREFORE, BE IT RESOLVED that the Borough Council of the Borough of
Rumson hereby approves Change Order Number 4 and Final of the Borough’s contract with S.
Batata Construction for the 2018 Road Improvement Program – Phase II, which change order
will reflect the reduction of certain bid items resulting in a decrease in the amount of $17,225.96
decreasing the total revised contract amount to $626,599.14. Said Change Order was
recommended by the Borough’s Consulting Engineer in a letter dated June 1, 2020, a copy of
which is on file in the Municipal Clerk’s office; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded to
the Chief Financial Officer.

RESOLUTION 2020-0609-83 AUTHORIZING REIMBURSEMENT AGREEMENT WITH
THE COUNTY OF MONMOUTH FOR MUNICIPAL CORONAVIRUS RELIEF FUND
PROGRAM.

Councilman Rubin offered the following resolution and moved its adoption:
RESOLUTION AUTHORIZING REIMBURSEMENT AGREEMENT
WITH THE COUNTY OF MOMOUTH FOR MUNICIPAL
CORONAVIRUS RELIEF FUND PROGRAM
WHEREAS, the United States of America, the State of New Jersey, the County of
Monmouth, and the Borough of Rumson (the “Borough”) are victims of the COVID-19
Virus and Pandemic (the “Coronavirus”); and
WHEREAS, on March 27, 2020, the Coronavirus Aid Relief and Economic Security Act
(the “CARES Act”) was signed into federal law; and
WHEREAS, the CARES Act was enacted, among other purposes, in order to combat the
economic damage to states, counties and municipalities caused by the Coronavirus; and
WHEREAS, the County of Monmouth has received CARES Act funds from the United
States Treasury (the “Funds”) to reimburse the County for economic damage caused by the
Coronavirus; and
WHEREAS, as the recipient of the Funds, it is the responsibility of the County of
Monmouth to disburse the Funds to eligible recipients in accordance with the terms and
provisions of the CARES Act and any guidelines or regulations issued by the federal
government; and
WHEREAS, the Board of Chosen Freeholders of the County of Monmouth have
determined that it is in the best interests of the citizens of the County to dedicate a share of the
Funds to reimburse municipalities, such as the Borough, for Coronavirus-related costs and
expenses under the Municipal Coronavirus Relief Fund Program (“the Program”); and
WHEREAS, the County of Monmouth has presented the Borough with a Reimbursement
Agreement, setting forth the terms and conditions of the Program under which the Borough may
choose to participate; and
WHEREAS, the Mayor & Council have determined that it is in the best interests of the
residents of the Borough to participate in the Program offered by the County of Monmouth;
NOW, THEREFORE, BE IT RESOLVED that the Mayor & Council of the Borough of
Rumson, County of Monmouth, State of New Jersey hereby approve the Reimbursement
Agreement with the County of Monmouth; and

BE IT FURTHER RESOLVED that the Mayor and Borough Administrator are hereby
authorized to execute the Reimbursement Agreement, which is attached hereto as Exhibit A; and
BE IT FURTHER RESOLVED that a copy of this Resolution, together with the executed
Reimbursement Agreement, shall be forwarded to the Chief Financial Officer, Auditor, and the
County of Monmouth.

RESOLUTION 2020-0609-84 TEMPORARY EMERGENCY APPROPRIATION.

Councilman Rubin offered the following resolution and moved its adoption:
TEMPORARY EMERGENCY APPROPRIATION RESOLUTION
WHEREAS, the temporary appropriations previously adopted will be inadequate to the
point when the 2020 Budget will be finally adopted; and
WHEREAS, N.J.S.A. 40A:4-20 states that the Governing Body may, by resolution
adopted by a 2/3 vote of full membership, make emergency temporary appropriations for any
purposes for which appropriations may lawfully be made for the period between the beginning of
the current fiscal year and the date of the adoption of the budget for said year; and
BE IT RESOLVED by the Mayor and Council of the Borough of Rumson that the
following emergency temporary appropriations, in addition to the temporary appropriations
already adopted, be adopted, and it is stated that these emergency temporary appropriations shall
be included in the 2020 Budget when adopted.
BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded to
the Borough Chief Financial Officer, and the Director of the Division of Local Government
Services.

WHEREAS, there is an Unappropriated OEM Grant balance in the amount of $9,987.69
for funds that were received in 2011; and
WHEREAS, Helen L. Graves, Borough Chief Financial Officer has researched and
confirmed that these funds were a reimbursement for a prior year Capital expenditure and were
posted to the Borough of Rumson Grant Fund, in error; and
WHEREAS, Helen L. Graves, recommends the cancellation of the Unappropriated OEM
Grant to Capital Surplus.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of
Rumson that the Unappropriated OEM Grant balance in the amount of $9,987.69 be cancelled to
Capital Surplus; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded to
the Borough Chief Financial Officer/Tax Collector.

WHEREAS, Monmouth County plans to replace the bridge S-32 known as the Rumson
Sea Bright Bridge; and
WHEREAS, the newly constructed bridge will require roadway improvements on the
westerly side of the bridge in the Borough of Rumson; and
WHEREAS, some of the adjacent properties are owned by the Borough of Rumson and
will require deeds and easements to reflect the changes and roadway improvements planned for
and as part of the newly constructed bridge; and
WHEREAS, these required deed conveyances shall be known as:

Conveyance 8B
Conveyance 8C
WHEREAS, in addition to the permanent changes due to the roadway improvements
there will also be a need for temporary easements to allow for access for the construction and
storage of the material needed for construction of the new S- 32 bridge; and

WHEREAS, there will be final conveyances done by deed once the new bridge is

WHEREAS, the Borough Attorney and Borough Engineer have reviewed the documents
submitted by the Monmouth County Engineer and Consulting Attorney and have found said
documents to be in order.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of
Rumson that the Mayor and Borough Administrator are hereby authorized to complete and sign
the revised deeds and temporary easements required to allow for the new S-32 bridge to be
constructed by Monmouth County; and
BE IT FURTHER RESOLVED, that completed and authorized documents be returned to
Monmouth County to be recorded along with a copy of this authorizing resolution; and
BE IT FURTHER RESOLVED, that a copy of the authorized and recorded documents be
kept on file in the Borough of Rumson.

RUMSON FOOD AND BEVERAGE ESTABLISHMENTS
WHEREAS, as a result of the COVID-19 Emergency, declared by the Governor
beginning March 8, 2020, many local businesses have been forced to close in order to comply
with the Governor’s various Executive Orders establishing numerous safety standards and
regulations intended to provide for greater public safety; and

WHEREAS, since that time, local businesses, including restaurants, have diligently
complied with the requirement to close their doors and only offer takeout and delivery of food;
and
WHEREAS, the result of these efforts have been a significant lowering of the rates of
infection over recent weeks, so much so, that most closed businesses have been allowed re-open;
and
WHEREAS, allowing temporary outdoor dining, will provide an opportunity for our
Borough restaurants and businesses to begin returning to their normal course of business, but in a
safe and orderly way.
NOW, THEREFORE, BE IT RESOLVED, that the Borough Council of the Borough or
Rumson does hereby authorize the temporary allowance of onsite outdoor dining for restaurants
and businesses within the Borough of Rumson, in accordance with the standards as outlined by
the Zoning Officer; and
BE IT FURTHER RESOLVED, that this allowance and these standards will expire by
Oct 15, 2020 or seven (7) days after the end of the declared emergency or when the State of New
Jersey permits restaurants to open for indoor dining, whichever should occur first, unless
extended by the Borough Council of the Borough of Rumson.

RESOLUTION 2020-0609-88 ASSESSING A LIEN FOR PROPERTY MAINTENANCE AT A
NUMBER OF RUMSON PROPERTIES WITH PROPERTY MAINTENANCE ISSUES.

RESOLUTION ASSESSING LIENS FOR
PROPERTY MAINTENANCE
WHEREAS, the Borough of Rumson adopted a property maintenance code for the
purpose of protecting the Borough and its residents from the increasing burden of costs incurred
by the Borough in maintaining neglected and/or abandoned properties which have become
dangerous and detrimental to the life, health, property and safety of its residents; and
WHEREAS, the Code Enforcement Officer notified the Administrator that properties at
91 Rumson Road (Block 124, Lot 31), 55 Shrewsbury Drive (Block 127, Lot 2), and 140
Rumson Road (Block 88, Lot 18), were found to be in violation of Borough Property
Maintenance Codes; and
WHEREAS, the Code Enforcement Officer and Administrator made several attempts to
reach the responsible parties to clean up the properties; and
WHEREAS, the Administrator has determined that it may be necessary to have the
Borough hire a contractor to complete the required work; and

WHEREAS, in accordance with the property maintenance code, the costs associated with
this work shall be certified to the Tax Collector to be assessed as a lien against the properties,
such costs to be assessed and levied against the properties, the same to bear interest at the same
rate as taxes, and shall be collected by the Tax Collector in the same manner as taxes;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of
Rumson that the Administrator and Tax Collector have the right to place a lien on the properties
located at 91 Rumson Road, 55 Shrewsbury Drive and 140 Rumson Road to recoup the costs
associated with the required work; and
BE IT FURTHER RESOLVED that the Administrator and Code Enforcement Officer
notify the homeowners that they have ten (10) days to complete the work required, and, if the
work is not completed in that period of time, the Administrator has the authority to hire a firm to
clean up the properties and
BE IT FURTHER RESOLVED that the Administrator is hereby directed to forward a
certified copy of this resolution to the Chief Financial Officer and Tax Collector; and
BE IT FURTHER RESOLVED that the Administrator shall send a certified copy
of this resolution via certified mail to the owners of record of the affected properties.

IN THE BOROUGH OF RUMSON DUE TO COVID-19
WHEREAS, the extensive interactions that would occur from in-store retail operations
continues to present a significant risk during the COVID-19 pandemic, and the restrictions on in-
store operations for non-essential retail businesses cannot be lifted at this time; and
WHEREAS, Executive Order No. 142, signed by Governor Murphy on May 13, 2020,
permits curbside pickup at non-essential retail businesses to avoid unnecessary contact between
customers and staff in enclosed spaces, and instead allows for limited contact while allowing
business to provide goods, while following CDC guidelines, including wearing face masks and
gloves and providing for proper social distancing; and
WHEREAS, Rumson Businesses have requested permission to set up tables and
merchandise in order to provide non-essential goods; and
WHEREAS, the Mayor and Council wish to ease regulations through October 15, 2020 or
until the State lifts the bans on shopping in stores, whichever happens first; and
WHEREAS, all temporary permits are subject to the successful approval of the
Temporary Use Permit Application found through the Municipal Clerk’s Office.

that retail businesses are hereby authorized to set up tables and merchandise to authorize said
activity is based on the Borough’s Emergency Declaration signed by Mayor Joseph K. Hemphill

FOR THE SHREWSBURY DRIVE RESILIENCY & DRAINAGE IMPROVEMENTS –
PHASE 2 PROJECT

WHEREAS, the Borough of Rumson is applying for funding to conduct roadway,
drainage, and infrastructure improvements to address frequent flooding and future sea level rise
on Shrewsbury Drive from Monmouth Avenue to Osprey Lane; and
WHEREAS, the project will continue efforts successfully completed by the Borough in
the previously NJDOT Discretionary Aid funded phase of the project; and
WHEREAS, the project will significantly improve the quality of life and safety of
residents impacted during flooding events; and
WHEREAS, the continuation of the previously completed project will help to continue
and improve the local roadway network for vehicular, bicycle, and pedestrian modes of travel
using the Borough’s Complete Streets Policy; and
WHEREAS, the Monmouth County Board of Chosen Freeholders supports the proposed
project as identified in their resolution.
NOW, THEREFORE, BE IT RESOLVED that the Council of the Borough of Rumson
formally approves the grant application for the above stated project; and
BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk/Administrator are
hereby authorized to submit an electronic grant application identified as MA-2021-Shrewsbury
Drive Resiliency & Drainage Improvements – Phase 2-00345 to the New Jersey Department
of Transportation on behalf of the Borough of Rumson; and
BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk/Administrator are
hereby authorized to sign the grant agreement on behalf of the Borough of Rumson and that their
signature constitutes acceptance of the terms and conditions of the grant agreement and approves
the execution of the grant agreement.

the after-the-fact Green Acres Approval for pipes installed under the park by New Jersey

COMMENTS FROM THE COUNCIL:
The Mayor afforded the members of the Council an opportunity to be heard at this time
and no one spoke.
COMMENTS FROM THE PUBLIC:
Municipal Clerk/Administrator Thomas Rogers read the instructions for anyone wishing
to make public comments on the virtual call.
The Mayor afforded the public an opportunity to be heard.
Jon Blatt of 89 Rumson Road asked for a status update on the Affordable Housing
Committee.
Mr. Rogers stated that the affordable housing fairness hearing was postponed due to
COVID-19 and is now coming up on Monday, June 15th. He also stated that the hearing would be
held in a “Zoom type” platform and that the Borough will send out a Constant Contact
notification with all of the information for anyone who would like to take part. Further, he noted
that the Borough’s Affordable Housing Committee has been in a holding pattern until the Judge’s
hearing Monday.
Mr. Blatt was concerned that he had not heard of any developments regarding affordable
housing for months now and he would have expected things to be moving in parallel instead of
waiting for the fairness hearing.
Mr. Rogers stated that two properties had been purchased since this began and the
Borough is in negotiations with others. The two purchased properties are being developed into
affordable housing.
Mr. Blatt asked if an actual Affordable Housing Committee has been formed.
Mr. Rogers stated that the Affordable Housing Committee is made up of members of
Council and all details are also discussed at a Council level at times.
Maureen Holahan Sailing of 156 Blackpoint Road asked if there was a valuation or
appraisal performed on the Carton Street property. Her concern was that the settlement
agreement with Yellowbrook shows a value of $1.7 million for the property and that there is a
possibility the property could contain contamination. She would like to know how this property
can be valued at this amount when it has yet to be determined whether or not the potential
contamination can or will be remediated.
Mr. Barger explained that the negotiations and the litigation in this matter are confidential
and are ongoing. He stated that the details will not and cannot be discussed publicly at this time.
Michael Farina of 24 Second Street thanked the Mayor and Council for the measures
taken for the community during the COVID-19 outbreak. He then discussed the recent letter
Borough residents received wherein the financial strains of municipalities were noted due to lack
of State funding. He asked if the Mayor and Council had considered disbanding the Borough’s
Police Department as a cost saving measure due to the low crime rate and the decrease in their
call rate. His main concern was the fact that the Police Department has a large budget line of
approximately $3.5 million with approximately $560,000 of that going to the pensions of retired
police officers who no longer serve the community. He added that this suggestion is purely a
financial suggestion and has nothing to do with the current events happening in the news.

Councilman Casazza responded stating that he has tremendous respect for the Borough’s
Police Department. Further, he stated that the Borough’s police officers work extremely hard and
are very fair. He is not aware of any discussions in regard to disbanding the Borough’s Police
Department.
Mayor Hemphill stated there have been no discussions on that topic. He feels the
Borough’s Police Department is above-board and very compassionate. Further, the Mayor stated
that history has made him very much aware of what is needed in the Police Department in order
to police the town, maintain the town and nothing has changed with that. He does not feel it is in
the public’s best interest to consider disbanding or even reducing staff.
Mr. Farina apologized and again stated that his comments have nothing to do with what is
currently in the news. He feels the Department is outstanding and his interactions with the
officers have always been positive. He would like it noted that he was simply asking the question
from a financial standpoint with his main concern being the budget line item of pensions for the
retired police officers.
Savros Memtsoudis of 135 Bingham Avenue inquired as to the public’s ability to
participate in the re-zoning and overlay ordinance proceedings.
Mr. Rogers stated that Judge Jones does a great job of allowing the public concerns to be
heard. Once Monday’s fairness hearing is completed, the Borough will begin the process of
introducing new ordinances and this should be completed by year end. The ordinances will be
introduced, published in full in the Two River Times, at minimum. A public hearing is scheduled
and at that time, the public comments and/or concerns will be addressed before adoption of the
ordinance.
Carolyn Desena of 3 Azalea Lane expressed her concerns as to the timing of public
information becoming available when the affordable housing issue started in the Borough. She
does not feel the public was given the opportunity to participate in a healthy discussion.
Mr. Rogers stated that the Mt. Laurel/COAH process has been ongoing for years and the
Council has adopted many ordinances and plans since he began working for the Borough in
2004. The meeting minutes have been public. The public notices have been placed in the
newspapers. However, when the Borough engages in a lawsuit, these actions are held
confidentially with a Judge. There have been many meetings with the residents regarding this
matter.
Ms. Desena doesn’t feel there is enough transparency regarding this matter. She also
stated that she spent a large amount of money to subdivide and beautify her property with the
town. She feels that the Yellowbrook settlement is no different from her own matter which had to
go through a long process with the Borough. When a matter in the Borough involves the amount
of money affordable housing does, she feels that the residents should be heard in a thoughtful
manner.
Mayor Hemphill stated that the residents are being heard in a thoughtful manner and no
one is taking that right away.
Tom Fuschetti of 67 Bingham Avenue asked if there is an environmental report available
on the Carton Street property.
Mr. Rogers stated there is no environmental report at this time.
Mr. Fuschetti questioned as to how a property closing can take place when there is
potential contamination.

Mr. Rogers advised that the closing has not taken place and is still under negotiation. He
also noted that all documents will be available at the time of closing.
Kristen Bunnell of 5 Azalea Lane asked for the names of the Affordable Housing
Committee members.
Mr. Rogers responded by stating that the Committee is currently made up of Mayor
Hemphill and Councilman John Conklin.
Ms. Bunnell asked how Borough taxpayers may get more involved with the Committee.
Mayor Hemphill advised Ms. Bunnell and any other interested parties to send a letter to
the Borough Administrator to be considered.
Ms. Bunnell stated she appreciates the good intentions but would ask that the Committee
become an action item and would like a timeframe.
Mayor Hemphill shared he would like to put together a group of interested citizens within
the next 5-6 months.
Maureen Holahan Sailing of 156 Blackpoint Road referred to wording in the
Yellowbrook settlement regarding possible contamination at the Carton Street site. She states
there is no mention of who or what body determines whether or not the property should be
remediated.
The Mayor states this will go back to negotiations and if they refuse to remediate, it is a
problem.
Ms. Sailing then stated the agreement shows the developer will need to pay the Borough
$3.15 million. She would like to know where the units will then be built.
The Mayor advised her that it has not yet been determined.
Ms. Sailing feels affordable housing on Carton Street is speculative.
Mr. Rogers asked Ms. Sailing if she had any other questions.
Ms. Sailing stated she does not feel the Councilmembers are available to members of
ROSAH even though they have been told the Mayor and Council are available to hear their ideas
and beliefs.
Mr. Rogers asked Ms. Sailing to have her attorney submit her ideas and beliefs in writing
to the Borough attorney.
Mr. Barger reminded Ms. Sailing that she identified herself as a member of ROSAH on a
conference call he attended last Friday and that the Borough is in litigation with her organization.
Don Devine of 10 Tuxedo Road asked whether or not the Council’s Executive Sessions
were recorded.
Mr. Rogers stated that there are minutes typed from the Executive Session but there are
no recordings. There are discussions held but no actions are taken. Public Council meeting
minutes are available on the Borough’s website and the Executive Session minutes may be
obtained through an OPRA request.
Mr. Devine is concerned that public policy is being decided behind closed doors without
the public being informed.

Mr. Devine stated that the Mayor and Council were urged by the public not to sign the
Yellowbrook agreement when it was discussed at a January 28th meeting however the public was
advised that it was a done deal.
Mr. Devine then asked why the Borough’s attorney would say “involving the public
would get nothing done and the public doesn’t deserve to know”.
Mr. Barger stated he was also on the call and he does not believe the attorney spoke those
words.
Mr. Devine stated he will obtain an audio transcript of the meeting.
Mr. Devine then recalled a meeting on January 28th wherein he felt that 99% of the town
was blindsided by the Borough’s entire affordable housing process. He did not feel there was a
gameplan in regard to the property at South Ward and felt that the public was being informed
only due to the requirement of public disclosure.
Mr. Devine continued by stating that he was asked if he would be interested in joining the
Affordable Housing Committee back on January 28th however, when he and his neighbor tried
repeatedly to meet with the Mayor and Councilman Conklin, they would not. He stated that now
the town’s attorney has advised them not to speak with anyone.
He asked if there is a gameplan as to the actual number of units, how Yellowbrook is
allowed to bypass density rules, and what happens if Carton Street is contaminated.
Stavros Memtsoudis of 135 Bingham Avenue requested the addresses for the properties
in which liens may be assessed according to Resolution #2020-0609-88 and asked how to report
other properties that the town may not be aware of.
Mr. Rogers shared the property addresses of: 91 Rumson Road, 55 Shrewsbury Drive and
140 Rumson Road. He stated they have received notices and will now receive another notice
with a copy of the Resolution. If they do not comply with the maintenance, the Borough will
maintain the property and place a lien on the subject property. He advised Mr. Memtsoudis to
inform the Borough of any other properties that need to be addressed.
Mike McCarty of 1 Blackpoint Horseshoe asked the Mayor and Council how they are
locating possible affordable housing properties in the Borough. He suggested Zillow, real estate
agents and an RFQ.
Mr. Rogers confirmed all of the above methods are being used and advised Mr. McCarty
to please contact the Borough if he knows of any properties that might be of interest.
Carolyn Desena of 3 Azalea Lane asked for the backup plan in case of contamination at
Carton Street that cannot be remediated.
The Mayor advised her that this topic had been covered today.
Mr. Rogers stated that the Borough has an extensive Mt. Laurel plan and there are a
number of mechanisms being used to create affordable housing units in the Borough. As an
example, he explained the recent purchase of a home on Maplewood Avenue which is being
utilized as market-to-affordable. Other properties are being looked at for potential assisted living.
As soon as the Borough goes before the Judge and has more information, it will be shared.
Don Devine of 10 Tuxedo Road again asked about a gameplan for properties not
associated with the Yellowbrook settlement.
The Mayor explained that plans are being developed in order to reach the 51 units of
required affordable housing. The Mayor also advised Mr. Devine that he understands he is trying

to make things appear as though the Borough representatives aren’t doing anything to work
towards progress with affordable housing and that is not the case. They are working diligently.
He then asked Mr. Devine what he has done to help in regard to affordable housing.
Mr. Devine responded that he has tried to have meetings with Councilman Conklin and
Mr. Rogers and they have refused.
The Mayor reminded Mr. Devine that they have purchased 2 more pieces of property and
are deciding how best to use the property for units and what category the units would fall into.
Jon Blatt of 89 Rumson Road asked the Mayor if municipal bonds are being considered
for the purpose of achieving the Borough’s affordable housing RDP should there be a deficit.
The Mayor stated that municipal bonds have not yet been considered as it is the
Borough’s objective not to borrow money, however everything is always an option.
Mr. Rogers read a letter submitted by Stu Sendall of 7D Lafayette Place. Mr. Sendell
asked for a report of the COVID-19 impact on Borough employees and the community. He
would like to know the number of cases diagnosed, number of hospitalizations and deaths.
Mr. Rogers noted that due to HIPAA laws, he will not disclose how many employees
were diagnosed, hospitalized, etc. during the pandemic. However, he referred Mr. Sendell and
the public to the Monmouth County Health Commission website. The website lists information
town by town.
Mr. Sendell’s letter also asked for a report of how many property owners in the Borough
had not paid their real estate taxes by the end of the June 1 grace period. He requested the
number and percentage.
Mr. Rogers shared 2019 data reflecting a collection rate of 94.79% at the end of the grace
period and 233 properties had not paid by the end of the grace period. In 2020, the collection rate
was 95.57% and the number of properties was 201.
Councilman Swikart noted that Mr. Sendell’s letter mentioned that he had tried to reach
out to Councilman Swikart to discuss the COVID-19 impact but was not able to get a response.
Councilman Swikart wanted it noted on record that he had never received any communication
from Mr. Sendell at all.
Councilman Casazza stated that he was also named in Mr. Sendell’s letter and it was
mentioned he too had been contacted by Mr. Sendell with no response received. Councilman
Casazza wanted it noted that he has no idea why Mr. Sendell would write that in a letter but just
as Councilman Swikart said, he wasn’t contacted by Mr. Sendell.
Mayor Hemphill brought the public comment session to a close.
ADJOURNMENT:
Councilman Rubin made a motion to adjourn the meeting which was seconded by
Councilman Casazza. The meeting adjourned at 5:53 p.m. All in favor.
