ARTICLEI:GENERALINFORMATION

1. IntroductionThe Architecture and Landscape Committee (ALC) is a standing committee of theSaddleBrooke Homeowners’ Association #2 (hereinafter called SBHOA#2) Board ofDirectors. The ALC is responsible for administering the Architecture and LandscapeRequirementsandGuidelines(hereaftercalledALCRequirementsandGuidelines)underthedirectionoftheBoardofDirectorsforallprivatepropertyoftheresidentsofSBHOA#2.

ThedeveloperofSaddleBrooke,SaddleBrookeDevelopmentCompany(SDI),envisionedandcreatedthisplannedcommunityspecificallyaroundaSonoranDesert/Southwesterntheme,incorporatingarchitecture,plants, textureandcolorsof the surroundingarea to createacohesive, pleasing environment. The Board of Directors and the Architecture andLandscapingCommittee(ALC)areresponsibleforassuringthisthemeismaintainedinourcommunity.

TheseALCRequirementsandGuidelinesareusedasthebasisfordecisionsbytheALCfortheapprovalordisapprovalofPermitApplications,asrequiredfortheinitialinstallationormodifications to landscaping, and exterior architecture changes. Additionally, they areintendedtoprotectandpreservetheappearance,aestheticsandvalueofourcommunity,includingadherencetothedevelopermodelelevationexteriordesign.AprimaryALCgoalis to assist homeowners in meeting these Board-approved ALC Requirements andGuidelines.

Nothingcontainedhereinshallbeconstruedasaltering,amendingorchangingtheCC&Rs,asrecordedwiththeCountyofPinal,ortheArticlesofIncorporationandBylawsofSBHOA#2.Intheeventofaconflict,thefollowingrepresentstheorderofpriority:CC&Rs,Articles,BylawsandtheseALCRequirementsandGuidelines.Totheextentthatanylocalgovernmentordinance,buildingcodeorregulationrequiresamorerestrictivestandardthanthatfoundintheseALCRequirementsandGuidelinesortheCC&Rs,thelocalgovernmentstandardsshallprevail.TotheextentthatthelocalordinanceislessrestrictivethantheseALCRequirementsandGuidelinesortheCC&Rs,thentheseALCRequirementsandGuidelinesandCC&Rsshallprevail,exceptasprovidedbyArizonaRevisedStatutes(ARS).

A. Theremaybespecialorunusualcaseswhichwerenotanticipatednordefinedinthisdocument.Suchcaseswillbeconsideredontheirownmeritandparticularcircumstances.

2. ThePreserve:Units42-45

ThePreserveiscomprisedofUnits42-45andisapartofSBHOA#2. ThePreserveincludessomeDeveloper-introducedfeaturesthatarenotavailablethroughouttherestofSBHOA#2.

Any specific variations in theseALCRequirements andGuidelines relating to ThePreserve are to be found in the appropriate sections inARTICLE III: SPECIFICGUIDELINESANDREQUIREMENTS.

3. TheVillas

Units35-35AThesetwoUnitscollectivelycompriseoneAssociationknownasSaddlebrookeTwoVillasAssociation35/35A,Inc.(SBVA)ThisAssociationispartofSBHOA#2buthasitsownBoardofDirectors,TractDeclaration,CC&Rs,Bylaws,Rules,ArchitecturalRules,LandscapingRegulations,andGuidelines.

Homeowners are subject to BOTH SBHOA#2 and SBVA governing documents.PermitsfromtheSBHOA#2ALCarerequiredforexteriormodificationstohomesinSBVAbasedonproceduresinplaceatthetimeofapplication.Theseproceduresmaybemodifiedfromtime-to-time.

Unit50TheUnit50Villasareapartof SBHOA#2, although theyhave theirownBoardofDirectors and CC&Rs. Homeowners are subject to these ALC Requirements andGuidelinesforSBHOA#2,aswellasanyadditionalGuidelinesuniquetoUnit50.

PermitsfromtheSBHOA#2ALCarerequiredforexteriormodificationstohomesinTheVillas.ResidentswillsendtheirapplicationtotheSBHOA#2ALC,thenitwillbesenttoaUnit50boardmemberandapprovedordeclined,thentotheUnit50ALCmemberforapermit.

6. WhenisanALCPermitRequiredandwhenisitnot?

Consideryourprojectorplans.Areyouplanninganimprovement/replacement,orareyoudoingarepair?Agoodruleofthumbis: Ifyouareaddinganewitem,orupgradinganexistingitem,thenitisusuallyconsideredanimprovementandanALCPermitisrequired.

APermit isrequired forany improvementorreplacementmadetotheexteriorofyourdwelling,wallsoronyourlot.Animprovementorreplacementisconsideredsomethingthatenhancesthevalueand/ormakessomethingbetter.Examplescouldbeinstallinganewgatetoreplaceyouroldrustyone;paintingyourhouse;plantinganewtreeinyourfrontyard;installinganewexteriorsecurityscreenonyourfrontentry;installingnewwalkway,patioordrivewaypavers;replacingawindowraisingoraddingawall;oranything that requiresaPinalCountypermit. Foranyproject

requiring a county permit, that permit must be submitted with the ALC PermitApplicationbeforeanALCpermitwillbeapproved.

RepairsdonotrequireaPermit.Arepairisconsideredreturningsomethingworn,damagedornotworkingcorrectlybacktoitsoriginalcondition,tomakeitworkagainor restore its appearance. Examples could be touching up rusty areas on a gate;replacingadyingshrubwithahealthyone;relayingliftedorsunkenpaversonyourwalkway or patio; mending cracks in a concrete patio, driveway or walkway;replacinganexistingairconditioner;orreplacingabrokenwindowpane.

Ifyouareunsure,itisalwaysbesttoinquirewiththeALCdirectly.Giveusacallorsendanemail.

7. ALCPermits

A. It is the responsibilityof thehomeowner toobtainALCPermitsas required intheseALCRequirementsandGuidelinesprior tomakingany improvementsoralteringtheexteriorappearanceofanypropertyorstructure,includingexteriorpaintingorinstallinganylandscaping,exceptforthefollowingitems.AlthoughinsomecasesanALCpermitisnotrequiredforitemssuchasYardArt,WallArt,etc.,all itemsmust comply and fit within the standards set in Article III of theseGuidelines.Itemsthatmaynotrequireapermit,butmuststillcomplywithArticleIIIareasfollows:

• LightningProtectionSystem(includingAirTerminals/lightningrods) -ALCCoordinationFormRequired

• Birdfeeders

• Bushes

• FireplaceChimney(internal)

• PottedPlants

• SkylightsorLightTubes

• StorageContainers

• Non-motorizedWindowSunscreens(seeArticleIII,Section5.Awnings)

• YardandWallArtmustcomplywithArticleIII,Section53

Anyimprovementsorotherworkonpropertyorstructuresthatinanywayalterthe exterior appearance, whether or not a permit or coordination form is

required,must adhere to the CC&Rs, these ALC Requirements andGuidelines,and/oranyapplicablestatute,ordinanceorregulationhavingjurisdiction.

B. Permit Applications must be completed and signed by the homeowner, orcontractor if aContractorasHomeowner’sAuthorizedAgent form is attached.PermitApplicationsmaybeconsideredforreviewpriortotheclosingdateonthehome.However,noworkmaybeginpriortoALCissuanceofaPermitanduntilaftertheclosingdate.

C. For complete details on ALC Permits and the Permit Application Process, andCompletionofLandscapeProjects,pleaseseeARTICLEIV.

D. All homeowners must fully landscape their property as defined in these ALCRequirementsandGuidelines.SeeAppendixJformoreinformation.

1. Allinitial,newhomeconstructionlandscapingmustbecompletedwithin90calendardaysafterthecloseofescrow.Toexpeditethisprocess,ownersinescrow may meet with the ALC to obtain pre-approval, however, no ALCPermitwillbeissueduntilthedayofCloseofEscrow.(SeeAppendixJ–NewBuildMandatory90DayLandscaping.)

2. Allprojects,otherthaninitiallandscaping,withanapprovedALCPermitmustbecompletedwithin90daysafterthePermitisissued.

3. If the Full Landscape or other Permitted work cannot be completedwithin the stated time a written request for an extension must besubmittedto,andissubjecttoapprovalby,theALC.TheprocessandfeesforextensionsarelistedinFeesandFines,ArticleIV.8.

8. ContractorSelection

A. Homeowners should exercise due diligencewhen selecting a contractor for alllandscape and construction needs. The final responsibility for selecting acontractorisuptoeachhomeowner.Licensedcontractorsarerecommended.PerAZ statute,only contractors licensedwith theArizonaRegistrarofContractorsmayperformworkcosting$1000ormore.Nocontractorsignscanbeplacedintheyard.

TheALCmaintainsabinderofContractorEvaluationsfromhomeownersabouttheirexperienceswithvariouscontractors.Thebindermaybereviewedat theSBHOA#2AdministrationOfficereceptiondesk.Thebindermaynotbetakenoffsite for review and no Contractor Evaluations may be removed unless by anauthorizedperson.

B. NeithertheSBHOA#2BoardofDirectorsnortheALChasanyworkethicauthorityoveranycontractorconductingbusinessinSaddleBrookeandisnotinvolvedinthelicensingofcontractors.ThisfunctionistheresponsibilityoftheARIZONAREGISTRAROFCONTRACTORS.Priortoselectingacontractor,homeownersareurgedtocheckthelicensingstatusandrecordsofanycomplaintsagainstspecificcontractorsbycallingtheARIZONAREGISTRAROFCONTRACTORSat(602)542-1525inPhoenixoron-lineathttps://roc.az.gov/contractor-search.TheALCwillnotinterveneonbehalfofthehomeownerifaproblemarisesbetweenthehomeownerandthecontractor.ThemembersoftheALCarediscouragedfromrecommendingspecificcontractors.

C. Ahomeownermayrequest theircontractoractontheirbehalfwiththeALC inplan/drawing review, submitting Permit Applications and obtaining approvedPermits,however,thehomeownermustfirstcompleteandsigna“ContractorasHomeowners’AuthorizedAgent”form.ThisformexpiresattheexpirationofthePermit,orsoonerifterminatedbythehomeownerinwriting.ThisformmustbesubmittedwitheachPermitApplication.

9. ViewsHomeowners cannot expect views, which exist at the time of purchase, to remainunchangedovertime.Propertymayeventuallybeimproveduponandlandscaping,bothonresidentiallotsandcommonareas,(includinggolfcourses)willmature.Treelocation,numberandspeciesarekey considerations in theALC landscapeplanapprovalprocess. Neither the ALC nor SBHOA#2 shall be under a duty to homeowners for theprotectionorenforcementofviewsorviewexpectations. However,maintainingviewsinthecommunityisacourtesytoyourneighborsandpreservingtheoverallpropertyvaluesinthedevelopmentisaSBHOA#2goal. It is the responsibility ofhomeowners to see that no shrub, tree, exterior addition to ormodificationoftheirproperty,adverselyaffectstheirneighborsorthecommunity.AlthoughtheALCreviewandapprovalprocessattemptstopreventsuchsituations,neithertheALCnorSBHOA#2canensurethathomeowners’viewswillbeprotected.Shouldconditionsleadtoaconflictordisputebetweenneighbors,theaffectedpartiesmusttrytoresolvethematter.Either party may request, in writing, that the ALC review a homeowner’s landscape orconstructionplanforpriorALCapproval.Afterexaminationoftherecords,thecommitteewillnotifyboththerequestingpartyandthepartywhosepropertyisbeingquestionedofitsfindings.However,neithertheALCnorSBHOA#2willbeapartytoanydisputeorlitigationthat arisesbetweenneighborspursuant topersonalproperty rights stemming fromsuchviewdisputes.

ARTICLEII:ARCHITECTUREANDLANDSCAPESTANDARDSANDREQUIREMENTS

1. ArchitectureStandardsandRequirementsA. PinalCountyPermitsarerequiredformostexterioradditionsandmodifications.

It is the responsibility of the homeowner to obtain all necessary Pinal CountyPermitsprior toapplying foranALCpermit.AnapprovedPinalCountypermitdoesnotnegatetherequirementforanALCpermit.

B. The design, style, detailing, materials and color of any addition or exteriorrenovation must conform to that of the house. Changes must adhere to thedeveloper’selevationdesignstyle.

C. Anyadditiontotheoriginalhome,includingbutnotlimitedto,casitas,golfcartgarages,roomadditions,andpergolas/ramadas(free-standingorattached)requiresanALCpermit.Theseadditionscannotbebuiltwithinthebuildingset-backlines(BSLs),asmeasuredfromthepropertyline.Additionally,forthefront,noconstructionispermittedfurtherthan5’infrontoftheexistingstructure(usuallytheGarage).Theheightofanyadditiontoanexistinghomemustnotexceedthatoftheoriginalrooforparapetline.

D. Allmaterialsusedinadditions,alterationsandlandscapingmustconformtothoseintheALCRequirementsandGuidelines.TheALCmayallowsubstitutematerialsthatareconsideredcompatiblewiththethemeofthecommunity.SubstitutionsareapprovedbasedonthejudgmentoftheCommittee.

E. Whenanybuildingadditions,alterationsorrenovationsaremadetoanexisting

home,thelotdrainagetothestreet,asestablishedbytheDeveloper,mustbemaintained.Allroofsorgutterinstallationsmustdraintothegroundsolelywithinthedeededlotline.Drainagetocommonareasisprohibited(refertoArticleIIISections9Drainageand21GuttersandDownspouts).

2.LandscapeStandardsandRequirements

A. In planning landscape and construction, accessmust be given to allow for themaintenanceofareasthathaveTVcable,electricalboxes,watermeters,etc.Noplantings are allowed thatwill hinder utilitymaintenance personnel ormeterreaders.Plantssoplacedmayberemovedbytheutilitycompanies.Theuseofnativeand/ordroughttolerantspeciesisrecommendedforalllandscape.Highwaterconsumingplantsshouldbeconfinedtosmallareasclosetotheresidenceas recommended in Xeriscape Landscape planning. (SeeAppendixA for plantmaterials and trees that are prohibited in SBHOA#2). Compatible community

groupingsshouldbetakenintoconsiderationtoallowforappropriateirrigationsystemplanning.Undergroundirrigationisrecommendedbutnotrequired.

B. Minimumplantingrequirements:Sufficientlandscapematerialsmustbeusedtomaintainharmonywithsurroundingareas.Everyfrontyardmusthaveafocaltreefivefeethigh(ortaller)measuredfromthegroundafterplantingandhaveatrunknolessthan2”indiameter;thefocaltreemustbeanapprovedtreeorasaguarocactus. In addition, there must be 20 five-gallon plants (or equivalent) asapprovedbytheALC.TheALC,initsjudgment,mayrequireadditionalplantingsorgrantvariancestothenumberoflivingplantmaterials,predicatedonthesizeandshapeoflotandfrontpatioorentrywalkinstallation.Therearenominimumplantingrequirementsforbackyards.

C. Gravel/Rock:Allgroundnotcoveredbyplantingsorhardscape,includingfront,sideandbackyards,mustbecoveredwithcrushednativecoloredrock(withthefinedustremoved)inshadesofbrownsandgrays.Therangeofcrushedrocksizeallowedis,forthefrontyardaminimumof½inchtoamaximumofoneinch,andforthesideandbackyardsaminimumof3/8inchtoamaximumofoneinch.Rockcolorsarelimitedtotwocolorchoices,onebasecolorandonecolorforaccentanddecorativepurposes.Ifanaccentcolorschemeisused,theaccentcolorcancovernomore than10%of the relevant landscapearea available. If no accent colorscheme is used, the base can only consist of one color. Native river rock andbouldersmaybeusedforaccentpurposes.Whiterock,artificiallycoloredrockorcrushedman-madematerial,arenotallowed.Lavarockmaybeusedasanaccentcoloronly.

Roadbaseorfoundationbasematerials(gravelorABC)andminus(decomposedand/or epoxied) granite, and any similarmaterials are prohibited for groundcoverorpathwayswhicharevisiblefromthefrontofthehouseorthestreet.Itisallowedbehindreturnwalls;ifnoreturnwallsarepresent,itisallowedintherearofthehouse,nofurtherforwardthanthebackcornerofthehouse.

D. Weed growth or other nuisance plant materials must be controlled withherbicides and/ormanualweeding. Plastic sheetingmay not be placed undercrushed rock for weed control since it is ineffective and causes the coveringcrushed rock to wash away (SeePlant and tree pruning andWeeds in theIndex).

E. Wildflowerswhichspringupintheyardarenotconsideredweedsuntiltheydieoff.Ifwildflowersaretobepropagated,theyshouldbelocatedintherearorside

yards, so that when each plant dies off, it will not become an obvious weednuisance.

F. Placing material on the street/roadway for any length of time isPROHIBITED.

A$200Citation/Finewillbeassessedtothehomeownerforeachdaymaterialsareplacedonthestreet.TheFinemaybeissuedbyPatrolorbytheALCasaNoticeoffine.

G. Caremustbeusedwhen landscapingalong roadsor corners toavoid creatingvisualobstructions thatmaycompromise thesafetyofpedestrians,bicyclesorothervehicles.

H. General Provision: The ALC reserves the right to consider and approve ordisapproveanyhomeownerlandscaperequestwhichisnotcoveredbytheentireALC Requirements and Guidelines as incorporated within this document andwhich, in the judgment of the full Committee, does not meet theArchitecture/LandscapeaestheticsofthegreaterSaddleBrookecommunity.

3.MaintenanceofProperty

I. Allhomeowners,includingthosenotinfull-timeresidence,areresponsibleformaintaining the appearance of their home and related landscaping so that itcontributestotheoverallappearanceandaestheticvalueoftheneighborhoodandthecommunity.Alllotsmustbekeptfreeofweedsandtrash/debris,andplantsandtreesmustbeneatlytrimmed.(SeealsoWildflowers.)

Everybuildingorstructuremustalwaysbekeptingoodconditionandrepair,andadequately painted or otherwise finished. All awnings and screens shall bemaintained ingoodconditionandnotallowed tobe tornorweathered. In theevent any building or structure is damaged or destroyed, it shall be promptlyrepaired,rebuilt,replaced,orremoved.

J. OverheadEncroachments.Trees,shrubsorplantingofanykindonanyLot,parcel,orotherareamustnotoverhangorotherwisetoencroachuponanyneighbor’sproperty,commonarea,sidewalk,street,golfcourse,orotherareafromthegroundleveltoaheightdeterminedbytheBoardorALC,butnotlessthanofeight(8)feetwithoutthepriorconsentoftheBoardortheALC.

K. ForproceduresrelatingtoawrittenReportofViolationthatapropertydoesnotmeet theALCRequirements andGuidelines or the CC&Rs, see the sections onReportsofViolations,FeesandFinesandWeedsinARTICLEIV:ALCPROCESSESANDPROCEDURES.

4.DebrisandMaterialsonVacantLotsandCommonAreas

Rubbish, debris ormaterials fromhomeowner landscape or construction projectsmaynotbestoredorleftonanycommonarea.SBHOA#2hastheauthoritytohavetherubbish,debrisormaterialsremovedandtobillthehomeowner.Anydamagetoaneighbor’spropertybyacontractorretainedbyahomeowneristheresponsibilityofthehomeownerwhoretainedthatcontractor.

5.CommonAreaSectionsOwnedbyHomeowner

In some cases, portions of common areas are owned by homeowners, wherelandscapingwasnotoriginallyinstalledbytheDeveloper.TheALCrecommendsthathomeowners use good judgment in the number of plants, trees, bushes and cactiwhen landscaping or upgrading such homeowner-owned common areas. Alllandscapingmustbedesertvarietiesthatdonotrequireirrigation.Gravelandrockdesignsmustcomplementtheowner’slandscapedproperty.

ARTICLEIII:SPECIFICREQUIREMENTSANDGUIDELINES

1. AirConditioners/EvaporativeCoolers–ALCPermitRequired

Allairconditioningunitsand/orevaporativecoolersinstalledbyhomeownersmustbegroundmountedonanimpermeablebase,SantaFestylehomesexcepted.Thetopoftheunitmustbenohigherthan(48”)forty-eightinchesabovegradelevel.Allunitsmustbescreenedfromstreetvieweitherbyreturnwalls(preferable)orplantings.Ifplantsareusedasascreen,theymustprovide50%immediatevisualscreeningoftheairconditionerwithagoalof100%coveragewithinthefirst12monthsthereafter.Visual screening is determined from the street view looking directly at the airconditioningunit.Portablewindow-typeairconditioningunitsareprohibitedforuseinanystructure,includinginstallationinawindow,throughawall,ormountedontheground.

2. AlternativeEnergyDevices

A. SolarPanelsandCollectors–ALCPermitRequired1. APinalCountypermitisrequiredfortheinstallationofsolarcollectorsand

ancillaryequipment.Theinstallermustbealicensedsolarcontractorwiththeappropriategeneralandcontractor’slicense.

2. Allexteriorplumbinglinesmustbepaintedtomatchthecolorofadjacentroofmaterial and walls. For Photovoltaic Systems, the exterior wall mountedequipmentmust be painted tomatch the house, except for the inverter(s)whichmustremainassuppliedbythemanufacturer.

3. Anillustratedbrochureoftheproposedsolarunit,depictingthematerialstobe used, and drawings showing the location and number of collectors, themethod of attachment to the roof structure, the angle and the location ofexteriorsystemcomponents,mustbesubmittedwiththePermitApplication.

4. Thepreferredlocationforsolarpanelsinontheroofandflushmounted.Thecoveredpatio isnot consideredapreferred locationand isonlyacceptablewhereroofmounted isnot feasible forefficiencyorstructuralpurposes. Aletter fromthehomeownerandsolarpanelcompany isrequiredexplainingtherationale for thepatiocoverbeingutilized, thepercentefficiency lost ifrequired to mount on the roof, and the difference in cost between thepreferredandsecondarylocation.Anysolarpanelsoapprovedforplacementon a patio roof must be flat/flush mounted if visible from neighboringpropertyorthegolfcourse.

ScreeningPlan-Intheeventanexceptionismadeallowingotherthanflushmount,and/orthepanelsareattachedonthepatiorooftop,thepanelsmustbeshieldedattheopenendandsidesbyuseofaParapetorsecurelyfasteningametalmesh,matchingthehousecolor,tomaintaintheestheticviewfromtheneighboringproperty.

5. GroundmountedSolarPanels/CollectorsareprohibitedexceptincaseswhererooftopinstallationwouldadverselyaffectthecostorefficiencyofthedeviceperARS33-1816Paragraph“B”.Theinstallingcompanymustprovidealetterstatingthepercentageofefficiencylostifthepanelswereroofmountedandthedifferenceincostbetweenthepreferredandgroundmountedlocation.ScreeningPlan–Groundmountedsolarpanelinstallationsmustbeshieldedfromtheviewoftheneighborsandstreet,andgolfcoursepreferablybyuseofablockwall.AplanmustbesubmittedtoandapprovedbytheALCpriortoinstallation.

6. All installations must meet the applicable fire, safety and building codes.NeithertheALCnortheSaddleBrookeTWOBoardofDirectorsisliabletothehomeownersforroofdamageorforaffectingroofwarranties.

7. Solar tube skylightsdonot requireanALCPermit. However,homeownersshouldbeawarethatsuchinstallationsmightaffecttheroofwarrantyfromthe Developer. Homeowners are urged to check the impact on their roofwarrantypriortoinstallation.

B. WindTurbines

WindTurbinesarenotpermittedwithinSaddleBrookeTWO.

3. AnimalsA. BirdFeedersandBirdhouses:Birdfeedersandbirdhousesmaynotbelocated

more than six feet aboveoriginal grade level.Theymaybe locatedonly in thebackyardoftheproperty.Placementincommonareasisprohibited.Amaximumoftwoareallowedineachyardtolimitthepotentialofanuisancetoneighboringproperties.Hummingbirdfeedersarenotincludedinthismaximum.

B. DogRuns-ALCPermitRequired:Whileconstructionofdogrunsisdiscouragedduetooursevereclimate,preferredplacementisatthesideofthehome.Theymaynotbehigherthanthepartywallsandmustnotbevisiblefromneighboringproperties,thestreetorgolfcourses.Theymaynothaveconcreteslabsasabase.Extremecaremustbetakenforabatementofnoiseandodor.Dogrunsmusthavesometypeofsunshelterconstructedfordogsuseatalltimes.Wood,chickenwire

andchainlinkfencingconstructionareprohibited.Dogrunsmustbeconstructedofwroughtironor“AlumaWood”paintedtomatchthehousecolor.ConstructionissubjecttoALCapproval.

4. Arches-ALCPermitRequiredA. Archesmustbeconstructedofconcreteblockandmustbestuccoedandpainted

to match the house. The outside contour of an arch may be curved orangular/square,providedthestructureisproportionatewiththehouse,blendswithneighboringarchitectureandaddstotheoverallqualityandaestheticsoftheneighborhoodandcommunity.Undernocircumstancesshallthedesignexceedtheheight,widthorareaofarchesbeingconstructedasstandardoptionstothespecifichomesbeingbuiltby theDeveloper. (SeeAppendixF forexamplesofacceptabledesigns).

B. Theinsidewidthofthearchmustbenogreaterthanfive(5)feet.(SeeAppendixFforexamplesofacceptabledesigns).

C. Themaximumoutsideheightofarchesmustnotexceedeight(8)feetfromgradelevel. Archesmust be attached to an adjoiningwall. Themaximumwidth andthicknessofarchlegsmustnotexceed16inches.Toprovideflexibility,rangesforalldimensionsareshowninAppendixF.

D. HomeownersmustprovidetheALCwithdrawingsshowingthelocationonthepropertyandanelevation(frontview)withfulldimensionsofthearch.Also,itisnecessary to provide a detailed landscape plan. Plot plans are included in theclosingdocumentsandprovidedbytheRCIsalesoffice.Thisrequirementmayincludeadesigndonebyalicensedprofessional.Homeownersmusthavethesedrawings prepared prior to coming to the committee for a Permit. Thehomeownermustdemonstratethatthedesignisstructurallysoundandmeetsallbuildingcodeshavingjurisdictionoverthisdevelopment.

E. ThePreserve:OncertainmodelsinThePreserveanarchwithawoodenlintelisallowedwhereitreplicatesaspartofaponywallthearchitecturefeaturesofthefrontdoor.ThisexceptionappliestoThePreserveonly.

5. Awnings–ALCPermitRequired

A. Awningsmustbeasolidcolorfabricapproximatingthecolorofthehouseortrim.Theymay be of a slanted or rounded style. Supporting parts of fixedwindowawningsmayprojectnomorethanfourfeetfromthehouse.Awningsofalltypesmustbenomorethansix incheswiderthanthewindowopening. Allawnings

shall bemaintained andmust be replaced or removed if they become torn orweathered.

B. MetalawningsareprovidedbytheDeveloperonsomemodelsandelevationsinThePreserve.TheseareavailableinThePreserveonly.

C. Retractableawningsarerestrictedtotherearofthehomeandmustbeasolidcolor fabric,approximatingthecolorof thehouseor trimandmustnotexceed120totalsquarefeetandnotextendmorethan8feetfromthestructure.

6. BarbecuesandGrills

A. FixedBarbecues/Grills–ALCPermitRequiredFixedbarbecues/grillsmustnotexceedfivefeetinheightandareonlyallowedinbackyards.Theymaybeconstructedofconcreteblockorapprovedweatherproofmaterialwithstuccofinishandpaintedtomatchthecolorofthehouse.Theonlyfuels allowed are electricity, natural gas, propane or charcoal. Wood burningbarbeques or grills are not allowed under any circumstance because of thepotential fire hazard. It is the responsibility of the homeowner to obtain allnecessaryPinalCountypermits.MoreinformationonPinalCountypermitscanbefoundinARTICLEIV,Section3PinalCountyPermits.Allgaslinesinstalledmusthaveasafetyshut-offvalve installed. In thecasewheretheDeveloperorlandscaperinstalledagaslineatthetimeofhomepurchaseandametalflexlineislaterconnectedtoit,thelinemustbesix(6)feetorlesstothegasconnectiononthebarbecue.

B. PortableBarbecues/GrillsPortablebarbecues,grillsandovensareallowedinbackyardsonly.Theymayuseonlythesamefuelsas fixed installationsabove. Ifnaturalgas isused,asafetyshut-offvalvemustbeinstalledandthemetalflexlinelengthmustbewithinthemanufacturer’sspecifications. If there isno lengthspecification, themetal flexlinemustbesix(6)feetorless.

C. LocationofallBarbecues/GrillsFollowingseveralcasesofbarbecuessettingfiretopatioroofs,andconsequentrequestsfromtheFireDepartment,itisrecommendedthatbarbecuesandgrillsshouldnotbeinstalledunderthepatioroof.Homeownersareadvisedtoconsultwiththeirinsurancecarrier.

7. CasitasandBuildingAdditions–ALCPermitRequired

AcasitaorGuestHouseisdefinedasanattachedordetachedaccessorybuildingwithnocookingfacilities,usedtohouseguestsoftheoccupantsoftheprincipalbuilding,

and which is never rented or offered for rent. Because they do not contain anycookingfacilitiessuchasastoveoroven,theyarenotconsidered“Dwellings”.

A. APinalCountypermitisrequiredfortheconstructionofanycasitaorbuildingaddition. Pinal County zoning laws strictly regulate the inclusion of kitchenfacilities incasitasorguesthousesandenforceminimalspacerequirements foringressandegress.

B. TheconstructionoradditionofallcasitasandbuildingadditionsnotcompletedpriortothefirstclosingwiththeDeveloperrequiresreviewandapprovalbytheALC. Any casita or building additionmust conform to the design features andaestheticappearanceoftheoriginalstructure.Asacommoncourtesy,neighborsshouldbeinformed.

C. TheplansforconstructingeachcasitaorbuildingadditionwillbeevaluatedbytheALConacasebycasebasiswithregardtoplacementonthelotrelativetotheexisting structure, the set-back lines as shown on the plot plan from theDeveloper,anddistancefromthestreet.

D. PursuanttoPinalCountyCode:

1. heightrestrictionmustbethesameasthemainhouse.

2. maynotbeservedbyseparateutilitymetersfromthemainhouse.

3. onlyoneshallbeallowedperLotandmustusethesamestreetaccessasthemainhouse.

F. Acasitaorroomaddition,includingtheoverhangassociatedwiththeprojectcannotextendfurtherthan5’infrontoftheexistingresidence(usuallybutnotlimitedtothegarage).Nocasitaorroomaddition(includinganyoverhangassociatedwiththeproject)canbebuiltwithintherearorsideBSL(BuildingSetbackLines)asmeasuredfromtherearorsidepropertylines.RefertoAppendixN.

G.A complete set of stamped county-approved construction documents, includingfloorplans,elevations,drainageplan,siteplan,plotplanfromtheDevelopershowingthe set-back lines, and all drawings to scale with indicated dimensions, must besubmitted for approval alongwith the color of the house andmaterial schedules.DrawingsmustbedroppedoffattheAdministrationofficeoneweekinadvanceofrequestinganappointmentwiththeALCforissuingaPermit.Thedrawingswillbereviewed,andanon-sitevisitmayberequired,priortoissuingaPermit.

H.ThePreserve:Ifawallisusedtoattachthecasitatotheoriginaldwelling,itmaybefivefootsixinches(5’6”)inheight.

8. Doors–ALCPermitRequiredEntry/FrontDoorandSide/UtilityDoor:Maybeconstructedofanymaterial;woodand fiberglass aremost common. Colormust be naturalwoodgrain (browns)orpaintedtheStuccoorTrimcolor.Accentcolorsforentry/frontdoorsaresubjecttoapprovalbytheALC. Thearchitecturestyleof thehouseandthevisibilitywillbeconsideredinrenderingadecision.

GarageDoor: PermitRequired-seeGarages,GarageDoors,GarageAdditionsandModifications.

SecurityDoor:PermitRequired–seeScreenDoorsandSecurityDoors

9. Drainage–ALCPermitRequired

A. Introduction: Improper drainage from homeowner lots can undermine thestreetandhasbeenfoundtocausefoundationliftleadingtostructuraldamagetothe home andfoundations associated with wall footings. The SaddleBrookemastersiteplanfordrainageisthateachhomelotshoulddraintothestreeteitherthrough underground drainage piping or, in fewer cases, with grades throughartificialriverrockwashesthatdraintothestreet. Innocaseshouldstormordrainwaterbeallowed topoolorbediverted tootherhomeowner’spropertylines.

B. Scope:ThisDrainageGuidelineappliesinitstotalitytoallnewlandscapingandany construction of a casita, building extension, swimming pool or spa. Itsapplicationalsoappliestoinstallationofguttersanddownspoutswithinexistinglandscaping,ortoalterationstoexistinglandscaping.Non-compliancewiththisguidelinewillbeconsideredbytheALCasaviolation.Ifasituationexistswhere

compliancecannotbelogicallyachieved,theALCwillreviewtheseonacasebycasebasis.

C. Drainage tostreet: All lots inSBHOA#2mustdrainover thegutter into thestreetandmustnotdraintoadjacentlotsorcommonareas.

D. Definitionofterms:

1. MasterDrainageReport: Whenconstructiononanewhomeiscomplete,thisdocumentispreparedtocertifythatthedrainageonthelotconformstotherequirementsofdrainageintothestreet.Thisdocumentisincludedintheclosingdocuments.Inthecaseofresales,thenewhomeownershouldreceivethisdocumentfromtheseller.

2. Swale:Anindentationinthegroundwhichformsadrainagechannelalongeachsideofthelot,situatedbetweenthehouseandtheperimeterwall.ItisprovidedbytheDeveloper.

E. Mandatory Requirement 1: No homeowner shall alter, interfere with orobstructthedrainagepatternoverthelot,asestablishedintheMasterDrainageReport. TheDeveloper grades each lot to drain away from the building in alldirectionsandtowardthestreet.Thisiscalled“positivedrainage”.Anyalterationof the grades from that at completion of the original home constructionmustmaintaintheoriginaldrainagedesign.

F. Mandatory Requirement 2: Once the homeowner begins landscaping, theDeveloper no longer has responsibility for positive drainage on the lot, and itbecomesthehomeowner’sresponsibility.

G. MandatoryRequirement3:Eachhomeownerisresponsibleforensuringthatthelandscapingoradditionalconstructiononthehomeowner’slotprovidesforappropriate drainage away from the foundation of the residence and otherstructuresandthatitcomplieswiththeMasterDrainageReport.Nolotshalldrainontoaneighboring lotorparcel,unlessspecificallyprovided for in theMasterDrainageReport.

H. ALCPermits: TheALCmay require thatdrawingsandother relateddatabesubmittedthatwilldemonstratethatproperdrainageistobeprovidedpriortoissuinganALCPermit.Thismayrequiretheservicesofanengineer.Theissuanceof an ALC Permit and/or the completion of landscaping (or construction of acasita,buildingextension,poolorspa)inaccordancewithanALCPermitmustnotbe deemed a representation, warranty, guarantee or other approval that the

drainage after the completion of such landscaping (or construction) will beconsistentwiththeoriginaldrainagebytheDeveloperorisotherwiseacceptable.

I. Ongoing Mandatory Requirements: Upon completion of landscaping (orconstructionof a casita,buildingextension,poolorspa), andat all times, eachhomeownerisresponsibleforensuringthatthedrainageonthehomeowner’slotcomplieswiththefollowingcriteria:

1. Thegradingmustmaintainaproperlycompactedslopeofnotlessthan5%,foradistanceofnotless than3 feet,orto thedrainageswale,whichever isgreater. Water must be directed away from the home’s foundation in alldirectionstoadefineddrainageswale.

2. Allsurfacewaterdrainagemustbedirectedawayfromthepropertylinetotheestablisheddrainageswale,soasnottorunontotheadjacentproperties.

3. Nosidewalksorotherobstaclescanbeaddednexttothehome(exceptthoseprovidedbytheDeveloper)thatcreateatrappedplanterareathatimpedestheflowofwaterawayfromthehome’sfoundationtothedesignateddrainageswale.

4. Weepholesarerequiredinponywallsandreturnwallstofacilitatedrainage.

5. Each lotmust have a pronounced surface drainage system that consists ofswalesand/ordrainstocreatepositivedrainagefalltoappropriatedischargepointsoverthecurbintothestreet.

6. Noplantsorotherlandscapefeaturesareallowedtoexistinthepronounceddrainage swale. No plants can be located closer than 24” to the home’sfoundationforlowwater(ornoirrigation)usageplantsandshrubs,and36”for higher water usage plants and shrubs except when being planted toprovide AC coverage from the front sight line. Trees should be located aminimumof8feetfromthefoundationstolimitpotentialfoundationdamageinthefuture.

7. The homeowner must maintain proper management and control over theirrigation system throughout theyear soas toavoidover-saturationof thesoilsonthehomeowner’sorneighboringlots.

8. Allirrigationvalves,pressureregulators,andbackflowpreventiondevicesaretobeinstalledontheoppositesideofthedrainageswaleawayfromthehouse.These devices must not be installed between the house and the drainageswale.

J. Drainageintothestreet:Localfrontyarddrainagefrommounds,etc.maydrainoverthecurbnaturally.Alldrainagepipesmustbecarriedtothefrontyardcurblineandbeterminatedasfollows:

1. Theendofthepipemustbeterminatedapproximately2feetfromthecurbandbeembeddedinaconcretelippedapron,contiguouswith,andabovethelevelof,thecurb.Thisforcestheflowofwaterfromthepipeoverthecurb.Theconcreteapronmustbelinedwithriverrock,andriverrockusedtoconcealtheexposedpipe(SeeAppendixD).

2. Thefollowingmethodcanalsobeused,especiallyforretrofittinganexistingdrainagepipeinstallation:

A90-degreepop-uplid,embeddedinaconcretelippedbaseextendingtothecurb,withthecircleofthelidbeingtangentialtothecurblineandthegroutedbasebeingflushwiththecurb.Theremustbeone“weep-hole”inthebottomofthepipeattheelbowtopreventstandingwateraftertheflowhasended(SeeAppendixD).

3. Exceptfortheone"weep-hole"inthepop-upmethod,noneofthepipesmaycontainholes.

4. Introduction: GuttersandDownspoutsare closely related to the issueofdrainage;pleaserefertotheGuidelineonDrainageabove.AnALCPermitisrequiredforanyinstallationofguttersand/ordownspouts.

5. Drainpipes: In all cases where gutters and downspouts are in place,undergrounddrainpipestocarrytheflowofwatertothecurbaremandatory.AlloftheRequirementsandGuidelinesonDrainageapplywithoutexception.

6. Downspout outflow: Downspouts must be connected directly into thedrainpipenetwork.Theuseofsplashblocksisprohibited(exceptforUnits35and35A).Downspoutsmaynotfeedwaterinto“rivers”orswalesandmustfeeddirectlyintoadrainpipe.Thisrequirementisnotretro-activetoexistinginstallations.

7. Colors: Guttersanddownspoutsmustmatchorapproximatethehouseortrim color using approved color choices.When gutter installation includesfasciaboard,thefasciaboardmaybealuminumorwoodmaterialandmustmatchthehouseortrimcolor.

K. Excavationbelow grade: Landscapers and homeowners are not allowed toremovedirt along the sideof the curbor sidewalkwithin the right-of-way for

layingriverrock,creating“rivers”orforanyotherpurposeexceptinstalling“pop-up” drains (See Appendix D) or for driveway extensions or for utilityinstallations.Aftersuchinstallations,theoriginalgrademustberestored.“Rivers”maynotbeexcavatedbelowtheexistinggradecreatedbytheDeveloper.

L. Special situations: Steeply graded lots and road configurations can presentsituationswhereeffectivedrainagemaynotbeachievedbystrictadherencetothis Drainage guideline. In such circumstances, the ALC may grant waiversregarding“rivers”.

10. Driveway-ALCPermitRequired

A. Drivewaycoating:AnALCPermitisrequiredforanyalterationorreplacementofany driveway including the application of coating or change of color to thedriveway. Implementationcanbecoloredconcreteoverlay,replacementofthedriveway by pavers or the application of paint. The acid stain method isprohibited. The color must complement the color of the house, and requiresapprovalof theALC.Patterndesignshouldbeunobtrusiveandmustcovertheentiredrivewayinaneven,consistent,parallelpattern.Stripsofpatterndesignsareprohibited.ApplicationofnonstandardpatternsissubjecttoALCapproval.

B. Driveways may not be replaced by non-stressed or garden pavers, bricks, orflagstone.Suchconstructiondoesnotprovideanacceptablesurfaceforvehicles.

C. TheconcretedrivewayprovidedbytheDevelopermaybecompletelyremovedandreplacedbypre-stressedconcretepavers.Suchworkmustbeperformedbyalicensedcontractor specializing in the replacementof concretedriveways, andwiththeengineeringexperienceneededtobuildareplacementdrivewayhavingstructural integrity.Theside footingsandanycopingmustbeat least6 inchesdeep.Compactedroadbaseorfoundationbasematerials(ABC)mustbeusedasabaseforthepavers.AnyreplacementdrivewaymustbecapableofsupportingavehicularweightatleastequivalenttothatoftheoriginaldrivewayinstalledbytheDeveloper.

D. The replacement driveway must preserve the water runoff into the gutterprovidedbythepreviousconcretedriveway.Anydamagetotheroadwaycausedbyimproperdrainageresultingfromdrivewayreplacementwillbeentirelytheliabilityofthehomeowner.

Thesestructuresmaynotbeconverted foranyuseotherthanthat forwhichtheywere originally intended. Garage roofs and door framesmay not bemodified toaccommodatemotorhomesorotherlargevehiclesexceptforspecialvehiclesforthehandicapped.Drivewaysandgaragefloorsarenottobelowered.

A. Garageadditionscannotbebuiltwithinthebuildingsetbacklines(BSLs).TheBSLsare5’ for thesides,and10’ for therear.Additionally, for the front,noconstruction is permitted further than 5’ in front of the existing structure(usually the existing garage). No overhang (e.g. gutters, eaves, etc.) mayprotrudeintothenobuildzones.RefertoAppendixNforBSLsforeachunit.Theheightofanyadditiontoanexistinghomemustnotexceedthatof theoriginalrooforparapetline.

B. Garage additions must be of a design and materials equal to the existingresidence. Detailed plans for any additions alongwith a plot planmust bepresentedtotheALCwhenmakingthePermitApplication.

C. The garage additionmust be placed on the same side of the house as theexistinggarageandsharetheexistingdriveway.Whenspaceisnotavailableon the garage side, the addition may be placed on the side of the houseoppositeoftheexistinggaragewithsideentrypreferred. Thedrivewayforthenewgarageaddition in this casemust connect to theexistingdrivewayacrossthenearfrontofthehouse.Hardscapeand/orlandscapingcanbeusedtominimizethevisualimpactofthedrivewayconnection.

D. ItistheresponsibilityofthehomeownertoobtainallnecessaryPinalCountypermits.

E. Photographsof theexisting structure canbeveryhelpful to theALC in thereviewprocessandwillfacilitateapproval.

• FluorescentLighting:

CompactFluorescentLightBulbs(CFL)andLEDlightsareapprovedmethods of providing lighting under ceilings and patio roofs.Fluorescentstriplightingisnotanapprovedformoflightinginsuchlocations.

3. Housetrimmustbepaintedwheneverthehousestucco/bodyispainted.

28. Patios,Walkways, Decorative Pavers and other Hardscape Elements –ALCPermitRequiredA. Detailed plans, drawn to scale, showing the patio and any elevation must be

Drawings of the proposed planters must be submitted with the PermitApplication for ALC approval. The drawings must be to scale and dimensioned

31. Ramadas/Pergolas–ALCPermitRequired

1. Adetaileddrawingoftheproposedstructure,drawntoscalewithcompletedimensions must be submittedwith the Permit Application. The drawingsmustshowsitelocation,plans,elevationsandmaterialswithalldimensions.

2. Ramadas must be constructed within the Building Setback Lines and notencroach into easements, as shown on the plot plan furnished by theDeveloper.(SeeAppendixNfordetails.)

B. Roofcoatings:AnALCPermitisrequiredinallcases.Thisincludespatioroofsand Territorial model roofs. It includes all applications of roof coating forwhateverpurpose.Thepreferredcoloristan;brightwhiteisnotallowed.

C. Samples:WhereveranALCPermitisrequiredforroofwork,acolorsampleordocumentation of the color to be used must be provided with the PermitApplication.

33. SatelliteDishesandAntennas

2. Anantennaonemeterindiameterorlessdesignedtoreceivewirelesscableortoreceiveandtransmitfixedwirelesssignalsotherthanbysatellite.

3. Commerciallyavailableanaloganddigitaltelevisionantennas.4. Antennasexceedingonemeterindiameterandotherexteriorantennassuch

as devices for two-way fixed,wireless internet broadband, amateur “HAM”radiosorCitizen’sBand(CB)radiosareprohibited.

B. RulesgoverninginstallationandlocationofSatelliteDishes:

1. The SatelliteDishmust be installed solely onandwithin the homeowner’s

property, not encroaching on adjacent common areas or anotherhomeowner’sproperty.

2. Satellitedishesorotherdevices,wheneverpossible,mustbeinstalledinthemostunobtrusivemannerandmustbeshieldedfromviewfromotherlots,thestreet, the golf course and common areas, including walking paths, to themaximum extent possible, while still allowing for acceptable quality signalreception.

3. Approved satellite dish antenna installations are limited to the standardsingle-legmastsuppliedwithsatellitedishantennasandboltedtoaconcretepad,block,“trailer”anchor,propertyorcommon/perimeterwallorstraightmastdrivenintotheground. AnyexceptionsmustbeapprovedbytheALC.Tripod mechanisms or similar methods of mounting satellite dishes areprohibited.

4. TheSatelliteDishmustbepainted,dependingonwhereitisplaced,tomatchthehouse,rooforwallcolor.However,ifthedishisplacedinanenclosedyard

whereitisnotvisiblefromthestreet,neighbors,orgolfcourse,paintingthedishisnotrequired.

5. Approvedinstallationlocations:

Approvedinstallationlocationsareforbackandsideyardonly,andarelistedbelowbyorderofmostacceptable to least acceptable. These locationsaredesignedwithemphasisontheeffecttothepresentandfutureaestheticvalueofthecommunity.

a. Freestanding on the ground with no part of the dish over 48” high asmeasuredfromtheground.

b. Attachedtothesideorrearofthehome,uptoandincludingtheeavesor

overhang. If placed on the eaves the attachment should not be at thehighestpoint(apex)oftheroof.

c. Attachedtotheback-halfsectionofthemainroof,orpatioroof,andmustbemountedsuchthatthedishdoesnotextendovertheroofpeak.

d. Attachedtocommon/perimeterorpartywalls,withnopartofthedishover

48”highasmeasuredfromtheground.Note:Attachmenttothetopofthesetypesofwallsisprohibited.

6. Ifthedishisinstalledinalocationotherthanoneofthoselistedabove,theALChastherighttorequirethesatellitedishbemovedatthehomeowner’sexpense,tooneoftheacceptablelocationsprovided:

a. Themovementtotheacceptablelocationdoesnotincuran“unreasonable

cost”.ProofofcostmustbeprovidedtotheALCbythehomeowner.Or,

b. The signal strength at the approved location is acceptable for satelliteservice.

C. MaintenanceandRepair:Homeownersareresponsibleforthemaintenanceand

repairofantennas.Antennasmustnotbeallowedtofallintodisrepairorbecomesafetyhazards.Note:TheserulesareinfulleffectuntilanypendingFCCamendmentsarepassedintolaw,atwhichtimethissectionwillberevisedaccordingly.

34. ScreenDoorsandSecurityDoors–ALCPermitRequired

AnALCPermitisrequiredwheninstallingnew,orreplacinganexisting,ScreenDoororSecurityDoor. InstallingorreplacingaslidingglassdoorscreendoordoesnotrequireanALCPermit.

A. Security doors may be constructed of steel, wrought-iron, or heavy-gaugealuminum,providedthedesignisofsquaresolidortubularmaterialandhastheappearanceofawrought-irondoor.Nowoodorlight-weightscreenorsecuritydoorsareallowed.Perforatedmetalscreeningorpolyscreeningmaterialpanelsmaybeusedasbackingonscreendoorsandsecuritydoors.

B. Adrawingof theproposeddoormustbe includedwiththePermitApplication.Screendoorsandsecuritydoorsandtheirornamentationmustbelimitedtooneortwoofthefollowingcolors:

1. Screendoorsandsecuritydoorsmaybethesamecolorashousestucco/bodyortrimcolor,black,darkbronzeormattefinished/agedcopper.

2. Ornamentation may be accented by use of black, dark bronze or mattefinished/agedcopper.

3. Security doorsmayhaveone feature such asa cactus, roadrunner, or sun,consistentwiththeSonoranDeserttheme,inanaccentcolor.ColoranddesignmustbeapprovedbytheALC.

Note:Doorandscreenmaybeofadifferentcolorwithintheabovechoices.

35. ScreensandSunshades–ALCPermitRequired

A. StandardexteriorwindowscreeninsertsdonotrequireanALCPermit.

B. Freestandingsunscreensornettingtoshadeplantingsand/ortheerectionofprivacystructuresareprohibited.

C. Rolling sunscreens may be black, bronze or a solid color approximating thehousecolor.Rollingscreenframesmustapproximatetheexistingtrimcolor,arelimitedtothesideorrearofthehouseandmaybeverticalonly.Whenloweredtheymustbesecured.Exteriorsunshadesmadeofplastic,reed,woodorbambooareprohibited.

D. SecurityWindowScreensareallowedandmustapproximatethehouseortrimcolor.

36. ShuttersonWindows–ALCPermitRequired

A. FixedshuttersatthesidesofwindowsarenotallowedexceptwhereinstalledbytheDeveloperasanoptiononaspecificmodelandelevation.

B. InThePreserve,theshuttersmustbepaintedthecolorspecifiedforthembytheDeveloper in the color palette used on the rest of the house. Elsewhere, theshuttersmustbepaintedthecolorofthehouseorthetrim.ShuttersmustbemadeofthesamematerialasthoseinstalledbytheDeveloper.

C. RollingShutters:

1. Color: maybeblack,bronzeorasolidcolorapproximatingthehousecolor.Rollingshutterframesmustapproximatetheexistinghouseortrimcolor.

2. Placement:Limitedtowindowinstallationonly.RollingshuttersmaynotbeinstalledaspatioorArizonaroomenclosure.Theyarelimitedtothesideorrearwindowsofthehouseandmustbeverticalopeningonly.

D. Material:Whenloweredtheymustbesecured.Rollingshuttersmadeofplastic,reed,woodorbambooareprohibited.

37. Signs

Final suitability of all signage is subject to approval by the ALC andmust be inaccordance with Arizona statute 33-1808. Signs of a general nature and thosecontaining“quaint”sayingsthatarevisiblefromneighboringpropertyorfromthestreet are prohibited. Where applicable all State and County regulations takeprecedence.

A. Permanentsigns

Twotypesofsignsareauthorizedtobepermanentlypostedtothefrontofthehomeorinafrontyard,“NoSolicitation”signsandhomeowner’sname(s)signs.

1. No Solicitation”, “No Soliciting”, or “No Solicitors” signs may be posted byhomeownerswiththefollowingguidelines:

a. Theremaybeonesignperhouse.

b. Thesignwillbeblackletteringonasilverbackgroundorsilverletteringonablackbackground.

c. Thesignmustbenomorethan12”x2”insizeandbeplacedwithintwo(2)feetofthedoorbellorataCourtyardGate/Entrance

g. Letterscanbeblack,bronzeormatchhousetrimaslongasthecontrastbetweenthesignbackgroundandthehousecolorisclearlyevident.Whenplacedonstone/slate,lettersmaybepaintedusingcolorsdescribedabove.

h. Otherornamentationonthesign,ifany,islimitedtoitemsconsistentwiththe Sonoran Desert/Southwestern Theme – i.e. cacti, flora, fauna,kokopellis,etc.(SeeYardandWallart).Suchitemsmustbeproportionaltotheoverallsizeofthesignandgenerallylimitedtonomorethan20%ofthetotalsurface.

i. Signsunderthisprovisiondonotsatisfyorreplacetherequirement forhouse numbers found under ARTICLE III House Numbers of thisRequirementandGuideline.

B. TemporarySigns:

1. Construction/Contractorsignsareprohibitedfrombeingplacedonanylot.

2. Politicalsigns:

a.HOA2followstheArizonaStateStatute33-1808whichstatesthatpoliticalsignscanbeplacedonyourproperty71daysbeforeanelection,andmustberemovedwithin3daysfollowingtheelection.Nopoliticalsignsshallbeplacedinanycommonareasincludingstreetcorners,orattachedtostreetsignposts.Politicalsignsputincommonareaswillberemoved.

38. SolarPanels–ALCPermitRequired

39. Spas–ALCPermitRequired

Allspa installationsrequireanALCPermit, includingprefabricatedspasplacedonthehomeowner’sbackpatio.SpainstallationsaresubjecttoanALCsitevisit.SpasmustbeinstalledinaccordancewithallthelatestPinalCountyordinances.ItistheresponsibilityofthehomeownertoobtainallnecessaryPinalCountypermits.MoreinformationonPinalCountypermitscanbefoundinARTICLEIV,Section3PinalCountyPermits.

A. Whenthehomeowner isawayformorethantwoweeks, thespamustbekeptdrained,tightlycoveredand/orregularlymaintainedbyathirdparty.

B. Masonry(in-ground)spasmust followall theregulationsof thePinalCountycode for swimming pools, and the ALC Guideline on Swimming Pools (seeSwimmingpoolsintheIndex).Thisincludeswallsandlockinggatessurroundingthe location of the spa or pool, together with the screening requirements forpumpingequipment.

C. Prefabricated(above-ground)spas:

1. Allprefabricatedspasmusthavealockingcoverforsafety.

2. Prefabricated spasmaynotexceed three (3) feet, six (6) inches (42 inchestotal)inheightabovesurroundinggradelevel.Thesidesofthespamustnotbe visible from the street, golf course or neighboring lots. The masonryenclosing walls must be no higher than the highest point on the spa, amaximumheightofthree(3)feet,six(6)inches(42inchestotal).

Mostprefabricatedspashaveaself-containedheaterandpumps.However,ifseparate pumps are required, a site plan drawn to scale and completelydimensionedmustbesubmittedshowingthelocationofthespa,heaterandpumpequipment,andthedistancetoneighboringhomesfromthespapumps.Pumpsandequipmentmustnotbeplacedbetweenadjoiningproperties.Allspapumpsandequipmentmustbescreenedbyblockwallsoraplantthat,attimeofplanting,coverstheviewofthespaequipment. Wallsarepreferredfromadjoiningneighborstominimizenoisetransmission.

DrainingaSpa:Allwaterdrainedmustbedischargedintothestreetandmustnotflow onto neighboring property or common areas. Check with Pinal County foradditionalrestrictions.ContactinformationforPinalCountycanbefoundinARTICLEIV,Section3PinalCountyPermits.

40. Speakers(sound)Exteriorspeakersarediscouraged,asaresoundemittingdeviceswhichmayimpingeonneighbor’speaceandquiet.

41. SportsCourtsandSportsEquipment

Sportscourts,suchasbasketballcourtsandtenniscourts,areprohibitedatindividualhomes.Puttinggreensareallowedinbackyardsonly.

Sports equipment is not allowed to be permanently installed in the ground orattachedtothedwellinginthefront,sideorrearofanyhomeorgarage.Thisincludes,but is not limited to, basketball backboards/hoops, weightlifting or other fitnessequipment,battingcages,volleyball/pickleballnets,etc.

Temporary or portable sports equipment, where its use does not impinge onneighbors’peaceandquiet,canbeusedinbackyardsonlyaslongasnotvisiblefromthestreet,neighboringlotsorthegolfcourse.

42. StoneVeneer/Ledgestone–ALCPermitRequired

Stone veneer/ledgestone, hereafter referred to as veneer, may be installed onSBHOA#2modelsandelevations,subjecttocertainrestrictionsdescribedbelow.

Homeowners must submit a Permit Application for approval, and attachphotograph(s) or a detailed drawing of the existing home showing the proposedlocation and placement of the veneer together with the type and color, and theexteriorcolorofthehomeifphotoisnotincluded.

A. OnlyveneerofthetypeandcolorofferedattheSaddleBrookeRanchDesignCentermay be used. Current samplesmay be seen and obtained from theDesignCenter.Ifthehomecurrentlyhas“ledge”stylestoneandstoneisbeingaddedtoanewlybuiltaddition,casita,orgolfcartgarage,matchingstonemaybeusedevenifnotofferedattheSaddleBrookeRanchDesignCenter.

B. Ahomeownerwithafrontentranceportico,whichhasaflatfacadeandapop-outoraroofeave,mayinstallveneerontheportico.Theveneerplacementmustbeinstalledtothebottomofthelowestpop-outor,iftheporticodoesnothaveapop-out,totherooflineandthebottomofthestuccoedwall.

C. Veneermaybeaddedtoexternalentrances/entryways.Thisdoesnotincludetheentirefronthouseelevation,nordoesitincludemoreofthefrontfaçadeofthe house than the entrance. See Appendix K for examples of allowableinstallations.

D. InthePreserveeachmodelandelevationincludesorexcludesstoneveneerandchangesarenotallowedtotheoriginaldesign.

43. StorageContainers&PODS

A. Rubber or plastic type exterior storage containers are allowed in back or sideyardsbutcannotexceedalengthof72inchesandaheightof48incheseachandmustnotbevisiblefromthestreet,golfcourseorneighboringproperty.

B. Onetrashcontainerandonerecyclecontainer,providedbythegarbagecompany,arenotconsideredstoragecontainers;however,theymustnotbevisiblefromthestreet,golfcourseorneighboringproperty.

C. Storageshedsareprohibited.

D. Compostbinsareprohibited.

E. Waterharvestingcontainersareprohibited. TheALCandHOAareresearchingWaterHarvestingandtheoptionsforthepossibilityofallowinginthefuture.

F. Dumpsters may not be placed on the street; a Permit is required from theAdministrationOfficeandthedumpstermustbeplacedonthedrivewayorotherportionofthelot(referenceSBHOA#2Rules&Regulations).

45. SwimmingPools–ALCPermitRequired

A. Abovegroundpoolsareprohibited.

B. Allitemsrelatedtothepoolprojectarecoveredunderthissection,andmustbefullydescribedinthepermit.Theseitemsinclude,butarenotlimitedto,gas/solarlines,electricalconduits,drainlines,poolpumps,patioextensions,walls/fences,andlatchinggatesandscreendoors.Someoftheseitemsarealsocoveredintheirown dedicated sections of the ALC Requirements and Guidelines. (SeeGates,Returnwalls,Screendoors,Solarpanels).

C. AllpoolsmustbeinstalledinaccordancewiththelatestPinalCountyOrdinances.It is the responsibility of the homeowner to obtain all necessary Pinal Countypermits.MoreinformationonPinalCountypermitscanbefoundinARTICLEIV,Section3PinalCountyPermits.

D. A site plan, drawn to scale and completely dimensioned, must be submittedshowingthelocationofthepool,screenwalls,equipment,andrelatedhardscape,set-back lines, house location and property lines. The distance to neighboringhomesfromthepoolpumpisalsorequired.DrawingsmustbedroppedoffattheAdministrationofficewiththePermitApplication.ThedrawingswillbereviewedbytheALC,andasitevisitwillberequiredpriortoissuingaPermit.

E. TomeetPinalCountyCoderequirements,theheightrequirementsforpartywallsandreturnwallsinyardscontainingswimmingpoolsmustbeaminimumof60incheshigh,measuredfromtheoutsideofthewall.RefertoparagraphIII.49.fordetailedrequirements.

F. Ifthepoolplansincludeapatio,thendetailedplans,drawntoscale,depictingthepatiomustbepresentedtotheALCattimeofreview.Patiossurroundingthepooloftenareconstructedof“cooldeck,”whichisallowed.

G. Self-closingandself-latchinggatesthatopenawayfromthepoolandscreendoorsarerequiredforentrancetothepoolareaperPinalCountycode.ThesegatesareattachedtoreturnwallsandarewroughtironbuilttotheALCstandards,i.e.,postoneinchandone-halfinchbars.

H. J. When the homeowner is away for more than two weeks, the pool must beregularlymaintainedbyathirdparty.Atnotimemaythehomeswaterand/orelectricitybeturnedoffforanyextendedperiod(inexcessof72hours),unlessthepoolhasfirstbeendrained.

46. Tiles,Exterior–ALCPermitRequired

CeramictilesareallowedONLYonPonyWalls,Stairwaysandaspartof thehousenumberinfrontyards.ArtisticpresentationsmaybepresentedtoandconsideredbytheALC,andifapprovedwillbeconsideredapieceofYardArt.

47. Trees–ALCPermitRequired

AnALCPermitisrequiredtoaddorsubstitutethespeciesofanytree.(SeeAppendixA foralistofprohibitedtrees/plantsandAppendixBforalistofFocalTreesMostCommonly Planted). “Volunteer” trees or cacti that naturally sprout must beapprovedfortypeandlocation,iftheyaretoberetainedinthelandscape.

FOCALTREE:AFocalTreeismandatoryforeveryhome;oncedesignatedasaFocalTree in theoriginallandscapeoranyothertime,anychangeto itrequiresanALCPermit.IfaFocalTreeisdead,knockeddownbyastormorisremovedbyanyothermeans,thehomeownermustobtainaPermitforplantinganewFocaltreewithin14daysandmusthavethetreeplantedwithin90daysofissuanceofthePermit.AnewlyplantedFocalTreemustbeatminimum5(five)feettallwhenplantedandthetrunkofthetreemustbenolessthan2inchesindiameter.

Trees,otherthantheFocalTree,mayberemovedorreplacedwithoneofthesamespecies,withoutaPermit.

Trees,plantsandshrubsmustbeprunedregularlysotheydonotoverhanganywallorlotboundaryintoneighborlots,streets,sidewalksand/orotherareasadjacenttoanylot.

48. Trellises&LatticePanels–ALCPermitRequired

A. Trellisandlatticepanels,definedasflat,twodimensionalpanelsmaybeinstalledandusedtosupportlivingplants.Thepanelsmustbesecurelyattachedtothehouseorwallandmustbeinstalledflatandparalleltothewalltheyaremountedupon.AllTrellisesandLatticemustbeconstructedofmetalandmustbepaintedblack, dark bronze,medium to dark brown or the color of the house orwall.TrellisesandLatticeconstructedofwoodorplasticareprohibited.

B. Freestandingtrellisesandlatticepanelsareprohibited.

C. Metal arbors, “teepees”, andobelisksmeant to supportplantsorvinesmaybeinstalledinthesideorbackyardofthehouse.Theymustbeconstructedofmetalandmustbepaintedblack,darkbronze,ormediumtodarkbrown.Metalarbors,“teepees”,andobelisksconstructedofwoodorplasticareprohibited.

49. WallsandFences—ALCPermitRequired

This section covers definitions, Permit requirements, design and constructioncriteria,paintcolorsandhomeowneruseforwallsinSBHOA#2.TheCC&Rsdocumentrefers to “Party Walls” and “Perimeter Walls”. These ALC Requirements andGuidelinescontainmorespecificreferencestowalls;thedefinitionsofeachkindofwall,togetherwiththedifferencesbetweenthetermsusedhereandtheCC&RsaretobefoundbelowinWalls.

Homeowners are required toobtain neighboring homeowner authorization,usingthe ALC ‘Permission to Enter’ form, when any wall (masonry or wroughtiron/aluminum)tobealteredorerectedis,orwillbe,sharedbetweentwoadjacentlots.Theformmustbesignedbytheneighbor(s)andmustaccompanyanyPermitApplicationforalteringorerectinganywalls.HomeownersmayobtainablankformfromtheHOA#2Website,atanALCmeetingorfromtheAdministrationOffice.Theformgivespermissiontoraisethewallwithwroughtironorblockstone,entertheproperty, to complete the wall and do clean-up work.Written permission is notrequiredinthecaseofwallsadjoiningcommonareas.

A. Theresponsibilityforcompletingbothsidesofthewallbelongstothehomeownererectingoralteringthewall,exceptforwallsinThePreservethatarenotpainted.Completing the wall includes stucco and painting, as appropriate, so that theexteriorofthewallonbothsidesisasitwasbeforethewallwasraised.

B. Walls/Fencemustbeconstructedofmasonryorwroughtiron. Blockwallsarenotdesignedtoretaindirtorrock.Homeownersarenotallowedtoplaceraisedlandscapebeds,plantersorraisedmodelrailroadbedsagainstwalls. Doingsocouldresultincompromisingtheintegrityofthewall.Ifanycommonareawallbegins to, or does fail as a result of this situation, the homeowner will beresponsibletorepair/replacethedamagedportionofthewallwithoversightbytheHOAmanagement,usinganapprovedlicensedcontractor.

C. Alllotswithagolfcourseview,evenifborderedbyacommonarea,arerequiredtobewroughtironoraluminumfence.Exceptionsforacornersegmentextensionmaybegranted.

D. Walls

i) Common/PerimeterWalls: Walls surrounding SBHOA#2 that are on thepropertylinebetweenprivatehomeownerlotsandcommonareassuchasgolfcourses.ThereisaspecialgroupofthesewallswhichwereconstructedbytheDeveloper on the boundary between SaddleBrooke and surrounding areassuchasCatalinaandLagoDelOroParkway.

Special restrictions and circumstancesmay apply to thesewalls, especiallythose separating SaddleBrooke from the surrounding areas. AnymodificationsoruseofthesewallsisprohibitedwithoutpriorauthorizationfromtheboththeALCandtheSBHOA#2GeneralManager.

The HOA common area side of Common/Perimeter Wall must beSaddleBrookeWall color. The homeowner side must be either Palo Tofu,SaddleBrookeWallorhousestucco/bodycolor.

ii) Party Walls: Walls constructed by the Developer on the property linebetween neighboring lots. Party walls belong equally by both neighboringhomeowners.EachOwnershallhavetherighttousethePartyWall,providedthatsuchusedoesnot interferewiththeotherOwner'suseandenjoymentthereof.Noplanters,plants,artorotheritem,materialorsubstancemaybeplacedatopaPartyWallthatisnotmutuallyauthorizedbyallownerssharingthatPartyWall.

HomeownerswhowishtomodifytheheightofpartywallsmustfirstobtainwrittenauthorizationfromtheneighboringhomeownerpriortoapplyingforanALCPermitasnotedinA.above.Thetotalheightofpartywallsmustnotexceedsevencourses,or60”,ofeight-inchblockortwocoursesofeight-inchblockplus48inchesofwroughtiron.Theheightofthewallsismeasuredfromthe ground on the highest-grade side of the subject wall as left by theDeveloper.Themaximumheightofallcommon/perimeterwallsmustfollowanygradechangealongthewallsothatnomorethansevencoursesarevisibleatanyonepointalongthewall.

PartywallsmustbemasonryorwroughtironandmatchthedesigninstalledbytheDeveloper.Masonryusedtoraisepartywallsmustmatchthetype,style,andsizeoftheexistingmasonryusedbytheDeveloperforconstructingwalls.Toensurestructuralintegrityandpreventmid-levelmoisturebleed-through,thesolidblocktopcapmustberemovedpriortoraisingwallsandreinstalledontopofthewall.

ThehomeownersideofPartyWallmustbeeitherPaloTofu,SaddleBrookeWallorhousestucco/bodycolor.HomeownersmaycontinuetousePaloTofu,iftheadjacentwallisstillpaintedinPaloTofu.

SWIMMINGPOOLEXCEPTION:

WallssurroundingyardswithswimmingpoolsmaybegrantedavariancetomeetPinalCountycodescallingforaminimumfive-foot height measured from the outside of the wall. This

requirementcanbeachievedbywallsofconcreteblockonly,oracombinationofblockandfence.

Depending on the finished-grade elevation of lots immediatelyadjacenttotheonewithapool,sevencoursesofeight-inchblockmay be insufficient to meet the County’s five (5’) foot heightrequirement.Ifthesewallsaresolidblock(meaningtheyarenota combination of block and wrought iron as required for golfcourselots),itmaybenecessarytoaddoneadditionalblock.

Afive-footheightmayalsobeattainedbyreducingtheheightoftheDeveloper-installedthree-coursepropertywallbyremovingonerowofblocksandaddingastandard48-inch-highsectionofwroughtironfence.The48-inch-highsectionofwroughtironalsomeetsthePinalCounty45”step-overrequirementforfencesatopblockwalls.

iii)PonyWalls:Wallsdesignedtoscreenfront-yardpatiosandprovideameasureofprivacy.Theycanalsobeusedinrearyardstoscreenequipment.

The wall should be proportionate with the house, blend with neighboringarchitecture, and be no higher than 48 inches, including pilasters. It mayextendnomorethanfive(5’)feetinfrontofanypartofthehouseclosesttothe street, including the garage. Those located in the front yard must bestuccoedandpaintedtomatchthehousestucco/bodycolor.Brickorflagstonecapsmaybeused.Adobebrick,kiln-driedbrick,stonetomatchwhatisusedonthe frontof thehouse,orslumpblockareapprovedalternatematerials.Thesewallsaresubjecttoutilitymaintenanceaccess.

iv)RetainingWalls:Wallsconstructedalongaslopetoholdbackorsupporttheearthintheslope.

v)ReturnWalls: Walls that connect a party wall to the nearest wall of theresidence.ConstructionmustbeofmasonryorwroughtironandmustmatchthewalldesigninstalledbytheDeveloper(SeeAppendixE).Wallheightshouldbenohigherthansevencourses.A“weepblock”isrequiredatthebottomofsolidreturnwallstoallowforproperdrainage.

Masonryreturnwallsmustbepaintedtomatchthehousestucco/bodycoloronbothsidesandhaveastuccofinishonthesidefacingthestreet.

vi)SeatWalls:Seatwallsarebothdecorativeandfunctionalsmallstructureslike a concrete bench. Constructed of concrete block finished in stucco or

concretecastandpaintedtomatchthehousestucco/bodycolor.Seatwallsare18”-22”inheightfromthegroundtothebenchsurfaceandsometimesincludeaseatbackwhichislimitedtoa48”height.Theseatbenchmaybecappedinflagstoneortile.

B.Common/PerimeterWalls

Specialrestrictionsandcircumstancesmayapplytothesewalls,especiallythoseseparatingSaddleBrookefromthesurroundingareas.AnymodificationsoruseofthesewallsisprohibitedwithoutpriorauthorizationfromboththeALCandtheSBHOA#2GeneralManager.

HOAcommonareasideofCommon/PerimeterWallmustbeSaddleBrookeWallColor.ThehomeownersidemustbeeitherPaloTofu,SaddleBrookeWallorhousestucco/bodycolor.

C.ThePreserve

PartywallsandPerimeter/CommonwallsaretobeconstructedwiththesameunpaintedbrowncoloredblockusedbytheDeveloperandmaynotbestuccoed.

Occasionally,whenexistingwallsareraised,repaired,replacedorextended,thedyeusedinthemanufacturingprocessmayvary,thusresultinginafinishedlooksimilartoastripedorcheckboardpattern.Forthisreason,theALCprovidesanexceptiontothepaintingrule:

a. Any ALC issued Permit for altering a Common/Perimeter or PartywallwithinThePreservemaybeissuedwiththecaveatthatifthenewblockcolordoesnotmatchtheexisting,andcreatesasignificantstripedorcheckboardpattern,paintingmaybeauthorizedasanexceptionuponinspectionofthefinishedwork. When the homeowner requests this exception, itmust benotedonthePermitbytheALC.b. The homeowner becomes responsible formaintaining both sides of thepainted common/perimeter wall(s) in perpetuity, thereby transferringresponsibilitytonewhomeownerswhen/ifthehomeiseversold.TheHOAwillnotberesponsibletorepaintthecommon/perimeterwallswithinThePreserve.c.Theexceptionshallnotbegranteduntilafterthewallisraised,repaired,replacedorextendedandinspectedbytheALCtodetermineifitresultedinasignificantstripedorcheckboardappearance.

E. Fences

WroughtironfencesmustmatchthoseinstalledbytheDeveloper(SeeAppendixE).Adrawingoftheproposedfenceormodificationstotheexistingfencemustbe submittedwith the Permit Application. The drawingmust be to scalewithindicated dimensions. Top and bottom railsmust be one-inch square, verticalspindlesmustbeone-halfinchsquare,andsectionsmustbeattachedtothesidesof pillars/columns. They cannot be attached to tops of pillars for structuralreasons.

Wrought iron fences, whichwere part of theDeveloper’s construction on golfcourseand/orgreenbeltlots,maynotberemoved.However,suchfencesmaybereconstructedtoaheightofnotlessthantwenty-fourinchesabovegrade.

Whenraisingfencesinlocationsalongthegolfcourse,wroughtironmustbeused.Atnotimemaytheheightofthefenceexceedfivefeet.Theheightofthefencemustparallelanychangeingroundelevation.Fornewfences,aluminumfencing

isanacceptablesubstituteforwroughtironprovidedthestyleanddesignarenotchanged.Wood,screen,metalscreenorchainlinkfencingareprohibited.

SBHOA#2 (excluding The Preserve) may be painted either Black, Bronze,SaddleBrookeWalloroneofthecurrenthousepaintcolors. AnywroughtironPartyWallmusthavewrittenandsignedapprovalfromtheneighboringpropertyowner.

Wrought Iron Fences in The Preserve may be painted either Black, Bronze,PreserveWalloroneofthecurrenthousebodypaintschemecolors.Anywroughtiron PartyWallmust havewritten and signed approval from the neighboringpropertyowner.

F. Wall/FenceElevationDrawings

Whenpartywalls andcommon/perimeterwalls aremodified, awall elevationdrawingmustaccompanytheALCPermitApplication.Thedrawingmustshowthe number of courses of concrete block by which the wall will be raised orloweredandthenumberofwallsectionsthatwillbealtered.Ifthewallsaretobemodifiedbyacombinationofconcreteblockandwroughtiron,thedrawingmustshowboththefinishedheightofthewall,theheightofthewroughtironandtheheight of the concrete block. Paint color for both the concrete block and thewroughtironmustbeshownonthedrawing.

50. WeatherRecordingEquipment–ALCPermitRequired

Weatherrecordingequipmentand/orweathervanesmustnotbeplacedontherooforchimneyofanyresidencewithoutthereviewandapprovaloftheALC.Adrawingisrequiredshowingtheplacementoftheequipment.

51. Weeds,Trees,PlantsandRubbish

TheCC&Rsrequirethat“Noweeds,deadtreesorplants,rubbishordebrisofanykindcanbeplacedorallowedtoaccumulateupon”any lot,andthatnotreesorshrubsmustbeallowedtooverhangstreets,sidewalksandotherareasadjacenttoanylot.WhenaReportofViolationisreceivedthatayardhasanyoftheseproblems,theALCverifiesthattheproblemexists,andthensendsaNoticeofViolationletter.(ReferenceArticleIV,Section9ReportofViolation).

52. WindowsandSlidingGlassDoors–ALCPermitRequiredA. AllwindowinstallationsandreplacementsrequireanALCPermit,exceptwhere

onlytheglassisbeingreplaced.

ArtinyardsandonwallsvisiblefromthestreetmustbeconsistentwiththeSonoranDesert/SouthwesternThemeandlimitedinnumbertopreventclutter.

A. YardArt is anyobjectplacedon thegroundasadecorativeaccent inanarea

visible fromthe street and is limited to ten (10)pieces. Maximumsizeof anysinglepieceofYardArtmustbelimitedtofour(4)feetbythree(3)feetby3(3)feet.Nomorethantwo(2)piecesoftheYardArtmaybeatthemaximumsize.Allremainingeight(8)piecesmaynotexceed(1)foottallbytwo(2)feetwide.

B. FocalYardArtarepiecesof“themed”YardArtplacedtogetherinthefrontyardofthedwellingandarelimitedtoone(1)groupofthree(3).Maximumfinishedplacementsizeonthegroundnottoexceedfive(5)feetwidebyfour(4)feettallby3(3)feetdeep,measuredbythetotalstreetfacingsizeafterplacementintheyard.NoindividualpieceofFocalYardArtmaybeinexcessoffour(4)feettallbythree(3)feetwide.

C. WallArtisanypieceattachedtotheexteriorwallsofahouseorthesurroundingwallsofadwellingthatisvisiblefromthestreetandshouldbeinproportiontothewall area.Wall art cannot comprisemore than20%of thewall areauponwhichitisplacedandcannotprojectlengthwisebeyondanyportionofthewall.

TheSonoranDesert/Southwestern themeArt includes itemswhichare consistentwith traditional SonoranDesert/Southwestern culture and environment includingMexicanandNative-Americanartaswellas,traditionalartreplicationsofthesmallSonoran Desert birds, reptiles and mammals. Also included as SonoranDesert/SouthwesternartareAbstractArtpiecesthatdonotattempttorepresentanaccuratedepictionofavisualreality,rathertheyinvolvetheuseofshapesandformstoachieveitseffectandusesonlydesertcoloringofbrowns,blacksandrust.WhiletheALCregulatesYardArtandthetype,sizeandnumberofpiecesallowed,theintention isnot toprohibitpieces that enhance theaestheticsof thehomeowner’sproperty and the SBHOA#2 community.The ALC therefore reserves the right toapprove/disapproveYardArtbasedonthecommittee’sassessmentofhowwelltheitemsupportstheoverallaestheticsoftheSBHOA#2community.YardArtnotconformingtotheseRequirementsandGuidelinesmaybesubmittedbya homeowner and considered for approval by the ALC. ARTICLEIV:ALCPROCEDURES

1. Overview

TheALCmonitorsandguidestheenvironmentaldevelopmentofSBHOA#2througha formal reviewof homeowners’ landscape and architecture plans and an on-sitereviewprogramaftercompletionofwork.ThisprocessassurescontinuationofthestandardsofexcellenceestablishedbytheDeveloperandsubsequentlybyindividualhomeownersandhelpstoprotectpropertyvalueswithinthecommunity.

2. PermitApplicationProcess

Where these Guidelines stipulate a Permit is required, it is a violation of theseGuidelines toperformsuchworkwithout firstobtaining thePermit and thereforemay be subject to fines and/or require removal of such unauthorized workperformed.

A homeowner may request their contractor act on their behalf with the ALC inplan/drawing review, submitting Permit Applications and obtaining approvedPermits, however, the homeowner must first complete and sign a “Contractor asHomeowners’ Authorized Agent form. This form expires at the expiration of thePermit, or sooner if terminatedby thehomeowner inwriting. This formmustbesubmittedwitheachPermitApplication.

TheALCisavailabletoissuePermitsandtoassisthomeownersinthecompletionoftheirprojects.

InordertoensuretimelyALCreview,thefollowingproceduresmustbefollowed:

A. AnALCPermitApplicationformmustbecompletedbythehomeowner(printedor typed), along with any supporting documents and sent electronically [email protected],orpresentedtotheAdministrationOffice.OnlythemostcurrentApplicationformwillbeaccepted.

B. ThePermitApplicationmustcontainthedateandsignatureofthehomeownerorthe homeowner's Authorized Agent. The most current version of the PermitApplicationFormisavailableonlineattheSBHOA#2website.

C. PermitApplications for full or complex landscape, golf cart garage additionorextension, room additions, casita additions, ramadas/pergolas, pools and spaswillrequireanOn-SitePreviewInspection.

1. HomeownersmustdropoffacopyofthePermitApplication,withsupportingdocumentsincludingdrawingsandPinalCountyPermit(ifrequired),totheSBHOA#2AdministrativeOfficeorsentelectronicallytoaskhoa2alc@sbhoa2.org.Alldrawingssubmittedmustbetoscale.

2. An ALC Permit Team will review the plans and, if necessary, call thehomeownerordoanOn-SitePreviewInspection.IfallisinorderaPermitwillbeissuedandsentelectronicallytotheALCAdministrativeAssistantwhowillcontactthehomeownertopickuptheirPermitattheAdministrativeOffice.

D. AcopyoftheDeveloper’splotplanmustbeincludedforallconstructionprojectsandclearlynoteanychangesto thehardscapeor fixed items,suchasramadas,plusdimensionedplacementofthestructureonthesiteplan.Theplanmustshowall the proposed additions or revisions, items to be removed, and existingconstructionwithlocationsdimensioned.Nostructureispermittedtoencroachonthebuilding-set-backlines(BSLs)asshownontheplotplanorAppendixNofthisGuideline.Theowner’sattentionisdirectedtotherequirementsforelevationdrawingsofhardscapeitemsprojectingaboveoriginalgrade.Alldrawingsmustbedrawntoscaleandfullydimensioned.

E. Any timea contractor is changed from thatwhich is shownon thePermit, thehomeownermustnotifytheALCtoreportandrecordthechangeincontractorsassoonasitisknown.Thenewcontractormustberecordedpriortothestartof,orcontinuationof,constructionwork.(ALCe-mailaddressandALCphonehotlinelocatedonthecoveroftheseALCRequirementsandGuidelines).

F. Whereitemsaretobeinstalledandcolorisinvolved,suchasyardart,ramadas,canopies,awnings,sunshades,etc.,colorcatalogsorsamplesmustbeprovidedbythehomeowner.ThisinformationmayberetainedbytheALCuntilcompletionofthehomeowner’sPermititems.Ifanyquestionsareraisedaboutcolor,samplesaretobeprovided.

G. TheALC has the absolute right to denyany Permit Application itdeems to beincomplete, should the Application not be accompanied by the requiredsupportingdocuments,suchaslandscapedrawingsdrawntoscale,etc.

H. Itistheresponsibilityofthehomeownertomaintainlandscapeandconstructionrecords. TheALCstrongly recommends these recordsbepassedon tobuyerswhensellingthehome.

I. Performancebondsarenotrequired. Homeownersarefullyresponsibleforallcleanup of work conducted on their property by either contractors or by the

homeowner.Failure to fully cleanup thepropertyupon the completionof theworkortheexpirationdateoftherelevantPermit,whicheverdatecomesfirst,ordumpingorstoringanydebrisormaterialsatanytimeonaCommonAreaorinthestreetisaviolationandwillresultinafine.(SeethesectionFeesandFines).

J. Homeowners and contractors are encouraged to request RCI approval beforestagingconstructionmaterialsonvacanthomesites.Failuretodosomayresultinthe contractor having to remove such materials, adversely affecting cost andscheduleoftheproject.

K. FailuretosubmitaPermitApplicationpriortothestartofanyworkwillresultinalateapprovalfee.(SeeFeesandFines).

3. PinalCountyPermits

ItistheresponsibilityofthehomeownertoobtainallnecessaryPinalCountypermits.PinalCountycurrentlyrequiresapermitforallelectricalandplumbingworkwhichisnotrepairorreplacementlikeforlike,naturalgaslines,allswimmingpoolsandspas, exterior construction alterations, amongst other work. For completeinformation,thePinalCountyBuildingandSafetyDepartmentislocatedat31NPinalSt,BuildingF,FlorenceAZ85132;itmaybecontactedinFlorenceat520-866-6442,fax 520-866-6517. No ALC Permits will be issued until all required Pinal CountypermitsareobtainedandcopiesareprovidedtotheALC.

4. PlansandDrawings

A. Homeowners must submit two copies of plans and drawings to the ALC. Alldrawingsmustbedrawntoscaleandfullydimensioned,alongwithacompletedALC Permit Application prior to making any exterior additions, alterations ormodifications to their property, including landscaping and hardscaping. Allhomeownersareresponsible foradherencetoallstandardslisted intheseALCRequirementsandGuidelines,aswellasallrequirementsoftheCC&RsandPinalCountycodes.

B. To expedite approval, it is recommended that either the homeowner or theirauthorized agent (Contractor as Homeowners’ Authorized Agent’ form isrequired),mustbepresentwhentheplansanddrawingsarereviewedbytheALCinordertoansweranyquestionsormakeneededchanges.IfitislaterdeterminedthataPermitwasapprovedbasedon incorrector incomplete information, thePermitmayberevokedbytheALCandthehomeownersonotified.

1. IncaseswhereaPinalCountypermitisrequired,acopyofthatpermitmustbeprovidedtotheALCpriortotheissuanceofanALCPermit.

2. Allplansanddrawingsmusthaveatitleblocklocatedinthelowerright-handcornerwiththehomeowner’sname,address,telephonenumber,unitandlotnumber,thenameofthepreparerandphonenumber,plantitle,anddate.Inthetitleblock,showtheparticularscaleusedfortheplan.

C. Landscape plans and drawings must be submitted in duplicate and contain adetailed and complete description of all landscape elements, including thefollowing:

1. Asitelandscapeplanwithcompletedescriptionofalllandscapeelements.TheALCwouldpreferthelandscapeplanbedrawnonan18-inchby24-inchC-sizesheet at a scale that fills the sheet, to a scale that is noted and fullydimensioned.Minimumscaleis1/8inchtoonefoot,zeroinches.

2. Allplantmaterialsandtreesaretobedepictedontheplananddrawingsatmaturesize.

3. Allplantmaterialsandtreesmustbelabeledwiththecommonnameandthebotanicalname, aswellascontainersize,suchas five-gallon,15-gallon,24-inchbox,etc.

4. Theplananddrawingsmustidentifywhetheranypartywallsaretoberaised.Allhardscape,includingsuchthingsaswalkways,ponywalls,patios,BBQ’s,fireplaces,planters,etc.mustbeshownontheplananddrawingsalongwiththetypeandcolorofmaterialstobeused,includingalldimensions.

5. The location of all mechanical equipment, proposed and existing,must beshown,includingtherequiredscreening(suchasareturnwallorthetypeandsizeofplants.)

6. Thecolorandsizeof therockusedforgroundcovermustbeshown.Riverrock/riplocationsmustalsobeindicated,togetherwiththelocationandsizeofanymoundstobebuilt.

7. Thedirectionofsurfacedrainagemustbeindicatedontheplanbyarrows.

8. IdentifyNorthdirectionontheplan.

9. OncethelandscapeplanhasbeenapprovedbytheALC,nochangesmaybemade except for the landscape features listed in ARTICLE I. If any otherchanges (either hardscape or trees) are to bemade, the homeownermustappearbefore theALC forapproval. “Volunteer” trees thatnaturally sproutmustbeapprovediftheyaretoberetainedinthelandscape.

10. After the landscapinghasbeen installed,noALCPermit is required for theaddition, change or removal of small shrubs or plants as noted above.However,anALCPermitisrequiredtoadd,moveorsubstitutethespeciesofanytree.

D. Building/residence modification plans must be submitted in duplicate andcontainadetaileddrawing,includingthefollowing:

1. A site plan and drawing, drawn to scale as noted above, and showing thelocationofallstructuresonthislot,easements,set-backlines,undergroundutilities,sidewalks,driveways,patios,retainingwallsandrelatedgrades,bothnewandexistingmechanicalequipmentwithscreening,grademodifications,proposedandexistingdrainage,andexistingandproposedpartywalls.Theplan must be complete with all dimensions. Exterior construction over 30inchesaboveoriginalgrademusthaveelevationswithdimensions.

2. Acompletesetofconstructiondocumentsmustbesubmitted,includingfloorplans,elevations,roofplansanddetails.Theplansaretobedrawntoscale,dimensioned,andincludenotesforallmaterialsandcolors.

3. The roof plan, the pitch, color and typeofmaterials proposed and parapetheights,whenappropriate.

E. UponcompletionofthereviewbytheALC,theoriginalsetofplanswillbekeptbytheALCandonesetofplansmustbereturnedtothehomeowneralongwithacopyofthePermitApplicationformand,ifapproved,originalPermit.

5. ALCApprovalProcess

A. ThePermitApplicationandall theassociateddocumentationwillbeevaluatedwithregardtothisALCRequirementsandGuidelinesdocument.

B. Ifthehomeownerdoesnothavethecompletedocumentationnecessary,thenthePermit isnot issuedandthePermitApplication isdenieduntil thehomeownerprovidesthenecessarydocumentationtoproceed.

C. APermitwillbe issued forapproved itemsdetailedon thePermitApplicationform.ThehomeownermustdisplaythePermitonafront,streetfacing,window,easilyaccessibleforviewing/reading,orotherprotectedlocationvisiblefromthestreet until the project is completed. The permit may be removed by theHomeowneruponcompletionofthework.

D. HomeownerswhoproceedwithitemsontheirsubmittedPermitApplicationformthatwerenotapprovedandmadeapartoftheapprovedPermit,mayberequired

attheirownexpensetoremoveanynon-approvedworkthathasbeendone.Ifthework is not removed within the time specified by the ALC in writing to thehomeowner,suchhomeownerswillbesubjecttofines,feesand/orpenalties.(SeethesectionFeesandFines).

E. WorkmaynotbecontinuedonceaPermithasexpired.Homeownersmustapply,inwriting, foranExtension inadvanceof theexpirationdateonthePermitormakeanappointmentforanewPermit.

6. VerificationProgram

A. AllapprovedworkforwhichaPermitisissuedissubjecttoanon-siteverificationbytheALC.Uponcompletionoftheprojectafinalverificationwillbecompletedand, if all work has been completed, the Permit is closed and filed in thecorrespondingLot file. Verificationsmay alsobe conductedwhenaReportofViolationisreceived.

1. ThepurposeoftheVerificationProgramistoverifythattheoriginalplansanddrawingsapprovedbytheALChavebeenfollowed,nothingatthepropertyisout of compliance with the CC&Rs and/or the ALC Requirements andGuidelines and to complete the file. On large, ongoing jobs such as fulllandscape, home addition, casita, etc.,multiple interim verificationswill bemade throughout the project to ensure the progress and completiontimeliness.

2. WhenverifyingworkcompletedpursuanttoanALC issuedPermit, theALCMemberwill ring thedoorbellorknockat thedoor, ifnobodyanswers thedoor, verificationsmaybe conducted in thehomeowner’s absenceandALCmember may enter onto the property for the purpose of performing theverification. Any member of the ALC has the express right to enter thepropertyofahomeownerforthespecifictaskofperformingaverification.

3. ReportsofViolation:TheseReportsaremostoftenofsomethingvisiblefromthefrontofthehomeandthusmaybeconfirmedorrejectedwithoutaccessingtheproperty. ALCMembermay ring thedoorbellorknockon thedoor tospeakwiththehomeownertomitigatetheReportofViolationfromescalatingtoanALCComplaint.Ifthehomeownerisnothome,contactwillbeattemptedviatelephoneorUSMail.

4. Notice of violation: Once a violation is verified a letterwill be sent to thehomeownerdetailingtheViolationandactionrequiredtobringtheViolationinto compliance. Thehomeownershallhave21daystorespond,bring theviolationintocomplianceorAppeal.Ifaresponseisnotreceived,onorbefore

the21stday,oriftheresponsedoesnotprovideasatisfactoryexplanation,andtheviolationisnotcorrectedthefineprocesswillcommenceonday22ndandaNoticeshallbemailed.

B. IfitisdeterminedbytheALCthattheapprovedandPermittedworkcompletedisnot in compliance with the approved Permit, these ALC Requirements andGuidelines and/or the CC&Rs, (orwork in progress in the case of a Report ofViolation),orthatlandscapinghasnotbeencompletedinatimelymanner,ortheproperty is otherwise in violation of these ALC Requirements and Guidelinesand/ortheCC&Rs,theALCwillnotifythehomeowneroftheviolationinwritingvia first class mail (“Notice of Violation”) or personal delivery if homeownerresideswithinthecommunity.

TheNoticewill specify theparticularsof theviolationadvising that correctiveactionmustbecompletedwithinaspecifiedtimeperiod.Thehomeownermustremedy the violationwithin the specified time period ormay providewrittennoticetotheALCinaccordancewithARTICLEIV,Section10,Appealsbelow.Failuretoprovideawrittenresponse,correcttheviolationandsoadvisetheALC,ortonotifytheALCofareasonablecourseofactiontocorrecttheviolationwithinthespecifiedtimeframe,mayresultinfinesand/orthematterbeingreferredtotheSBHOA#2BoardofDirectors.Suchhomeownersmaybesubjecttofeesandfines.

7. ResaleDisclosures

A. TheALCreceivesanHOADemandRequestwhenahomethatisforsalereceivesanofferandthepurchasersecuresatitlecompanyandproceedsintoEscrow.AsrequiredperARS33-1806.3(e),aResaleDisclosureStatementisprovidedafterareviewoftheassociationrecordsastowhethertherecordsreflectanyalterationsor improvements to theunit thatDO orDONOT violate theDeclaration. ThestatementisthensenttotheFinanceAccountingSpecialisttoincludeintheTitleCompaniesHOADemandRequestpacket.

8. FeesandFines

ThecurrentPermitfeeis$15andmustbereceivedbeforeaPermitwillbeissued.Allfeesarenon-refundable.FeesformodificationsofcompletedworkmaybewaivedatthediscretionoftheALC.

AllALCFeesandFinesareestablishedbyandapprovedbytheBoardofDirectorsasshown below and also noted in some areas throughout these Requirements &Guidelines:

5. Ifahomeownerdoesnotformallyrequestanextensionforprojectsextendingbeyond90days,theextensionfeewillautomaticallybeassessed.Nowaiveroffeeswillbeconsideredinthesecircumstances.

B. FINES:

2. Fine for Notice of Violation not brought into compliance within 21 days:$125.00

3. InitialLandscape:Newhomeownershave90days fromcloseofescrowto

completetheirinitiallandscaping.IntheeventapermithasnotbeenappliedforandapprovedbytheALCwithin90daysfromCOE,afineof$125willbeassessed.If,after120daysfromCOE,nopermithasbeenappliedfor,afineof$250/monthwillbeassesseduntilapermithasbeenissued.ThefeestructureofIV.8.A.2above,alsoapplies.

4. StoringMaterialsontheRoadway:

a. A$200Citiation/Finewillbeassessed to thehomeowner foreachdaymaterialsareplacedonthestreet.TheFinemaybeissuedbyPatrolasacitiationortheALCasanoticeofFine.

5. StreetClean-upandDamage

Damagetostreet:Anydamagetothestreetcausedbyacontractorortheirsubcontractors,issubjecttoafinetothehomeownerof$125ortheactualcostofrepair,whicheverisgreater.

6. EscalatingFines:PerIncident:1stFine:$125.00ifnotcorrectedorAppealedwithin21days 2ndFine$250.00ifnotcorrectedafter60days(additional) Thereafter:$250/monthuntilcorrectedIf theviolation isnotcorrectedwithinsix(6)months, itwillbesent to theBoardforconsiderationofrevocationofhomeownercommunityprivileges.

9. NoticeofViolation

A Notice of Violation may be issued by the ALC under several conditions. Theseinclude,butarenotlimitedto,theapprovedandPermittedworkcompletedisnotincompliancewiththeapprovedPermit,aCommitteememberobservesaconditionnotincompliancewiththeseRequirementsandGuidelines,oraReportofViolation(ref.IV.10.below)submittedtotheALCbyahomeowner.A. Onceaviolationisverified,aletterwillbesenttothehomeownerdetailingthe

Violation and action required to bring the Violation into compliance. Thehomeowner shall have 21 days to respond, and bring the violation intocomplianceorAppeal.UponreceiptofsuchNoticeofViolation,thehomeownerwhoisthesubjectoftheNoticeofViolationmayprovideawrittenresponseorappealtotheALCinaccordancewiththesectionAppealsbelow.

B. Ifaresponseisnotreceived,onorbeforethe21stday,oriftheresponsedoesnotprovide a satisfactory explanation, and the violation is not corrected, the fineprocesswillcommenceonday22ndandasecondNoticeshallbemailed.

C. All Notices, letters or other correspondence sent via US Mail will be deemedreceivedunlessreturnedbythePostOfficeasundeliverable.AllNoticesaresenttotheaddressonfilewithSBHOA#2AdministrationOfficeforthehomeowner.HomeownersaresolelyresponsibleforadvisingtheAdministrativeOfficeofanychangestotheircurrentmailingaddress.

10. ReportofViolation

A. When a homeowner believes there exists a violation of these ALCRequirementsandGuidelinesand/ortheSBHOA#2CC&Rs,awrittenReportof Violationmay bemade by completing and submitting anALCReport ofViolationform.TheALCwillonlyacceptwrittenandsignedReportofViolationforms;noReportofViolationsareacceptedbyleavingmessagesontheALC’svoicemail. The formmay be obtained from the SBHOA#2 AdministrationOfficereceptiondesk,oronlineattheSBHOA#2website.

B. ToassisttheALC,photosmustbeattachedthatclearlydepicttheviolationandprovideaclearanddefinitivedescriptionoftheviolation.AnyphotosorothersupportingdocumentationsubmittedwithaReportofViolationbecomesthepropertyoftheALCandwillnotbereturned.

C. WhenaReportofViolationisfiledwiththeALCitwillbeinvestigatedandanon-siteverificationinspectionwillbeconducted.

1. AReportofViolationwillbedealtwithinaconfidentialmannerbetweenthetwohomeownersinvolvedandtheALC.

2. Ifaviolationisfound,aNoticeofViolationwillbesentbytheALCviafirstclass mail, or personal delivery if homeowner resides within thecommunity, to the homeowner againstwhom theReport of Violation ismade.

3. PursuanttoArizonaStateStatute,theNoticeofViolationwilldiscloseonlythe name of the person submitting the Report of Violation to thehomeowneragainstwhomtheReportofViolationismade.

11. AppealsProceduretoappealanALCNoticeofViolation:

ownedbythehomeownerisinviolationofthecommunitydocuments,withoutregardtowhetheramonetarypenaltyisimposedbythenotice,mayprovidetheAssociationwith awritten response by sending the response by certifiedmailwithintwenty-one(21)calendardaysafterthedateofthenotice.Theresponsemustbesenttotheaddressidentifiedinthenotice.

E. Within ten (10)businessdaysafter receiptof the certifiedmail containing theresponsefromthehomeowner,theassociationmustrespondtothememberwithawrittenexplanationregardingthenoticethatmustprovideatleastthefollowinginformationunlesspreviouslyprovidedintheNoticeofViolation:

1. Theprovisionofthecommunitydocumentsthathasallegedlybeenviolated.

2. Thedateoftheviolationorthedatetheviolationwasobserved.

3. Thefirstandlastnameofthepersonorpersonswhoobservedtheviolation.

12. Severability

13. LimitsofLiability

A. ALCapprovalofplansorspecificationsusedorreferencetosupportissuanceofanALCPermitdonotconstitutearepresentation,warrantyorguaranteethatsuchplansandspecificationscomplywitharchitectureorengineeringdesignpracticesor with zone or building ordinances, or other governmental regulations orrestrictions.Byapprovingsuchplans,drawingsandspecificationsinconjunctionwithissuinganALCPermit,neithertheALC,northemembers thereof,SBHOA#2nor any member thereof, nor the Declarant or any of its related entities oraffiliates,assumesanyliabilityorresponsibilityforanydefectinthestructureorprojectconstructedfromsuchplansorspecifications.Noneoftheaforementionedshallbeliabletoanymember,homeowner,occupantorotherpersonorentityforany damage, loss or prejudice suffered or claimed due to (a) the approval ordisapprovalofanyplans,drawingsandspecifications,whetherornotdefective,or(b)theconstructionorperformanceofanywork,whetherornotpursuanttotheapprovedplans,drawingsorspecifications.AllpartsoftheCC&Rsregardingthissubjectremaininfullforceandeffect.

Theamountofwaterneededbyanyplantwillvarybasedonexposuretothesun,climaticseasonsandchangeswithintheseasons,locationoftheplantrelativetothehome(howmuchsunlightreachesthatlocation),andsoiltypes.However,whentheplant,shrub,ortreehasestablisheditself,thenwateringcanbereducedinsomecasesby70%.
