    On April 11, 2019, Licensee entered into a Stipulated Order with the Board for unprofessional or

    dishonorable conduct; gross or repeated acts of negligence; and willful violation of any rule

    adopted by the Board. This Order reprimands Licensee; places Licensee on probation for a

    minimum of 10 years; requires Licensee to remain enrolled and in good standing in a monitoring

    program; restricts Licensee from prescribing any controlled substances; requires Licensee to only

    practice at pre-approved sites; requires Licensee to maintain a therapeutic relationship with a

    On April 11, 2019, Licensee entered into a Stipulated Order with the Board for unprofessional or

    license, however the revocation is stayed; assesses a $5,000 civil penalty; places Licensee on

    probation; requires Licensee to enroll in a monitoring program; requires Licensee to obtain a pre-

    approved practice mentor who will provide quarterly reports to the Board; prohibits Licensee

    from prescribing any Schedule II, III, or IV medications; requires Licensee to only practice at

    pre-approved sites; and subjects Licensee to no-notice chart audits and office visits by the

    Board's designee.

    Dooley, Ericka Regina, LAc; AC140943; Portland, OR

    On March 25, 2019, Licensee entered into a non-disciplinary Consent Agreement for Re-Entry to

    Practice with the Board. In this Agreement, Licensee agreed to complete a 200-hour mentorship

    with a Board-approved clinical supervisor; and complete 15 hours of continuing education units.

    *Erickson, Carl Michael, DO; DO12690; Portland, OR

    On April 5, 2019, Licensee entered into an Interim Stipulated Order to voluntarily cease the

    initiation of chronic pain treatment with opioids; taper current chronic pain patients to 90 MED

    or less or transfer care of the patient, unless the patient is taking buprenorphine or

    buprenorphine/naloxone; limit prescribing for acute pain; taper concurrent benzodiazepines or

    transfer care of the patient; cease prescribing concurrent benzodiazepines or muscle relaxants

    with opioids; and obtain an annual EKG for all patients taking methadone pending the

    completion of the Board's investigation into his ability to safely and competently practice

    medicine.

    On April 11, 2019, the Board issued an Order Terminating Interim Stipulated Order. This Order

    terminates Licensee's 2019 Interim Stipulated Order.

    *Hopson, Jane Katherine, PA; PA01299; Hillsboro, OR

    On April 8, 2019, Licensee entered into an Interim Stipulated Order to voluntarily withdraw

    from practice and place her license in Inactive status pending the completion of the Board's

    investigation into her ability to safely and competently practice medicine.

    *Joyner, Lisa Camille, MD; MD21092; Milwaukie, OR

    On April 11, 2019, Licensee entered into a Stipulated Order with the Board for unprofessional or

    dishonorable conduct; gross or repeated acts of negligence; willful violation of any rule adopted

    by the Board; and prescribing controlled substances without a legitimate medical purpose or

    without following accepted procedures for examination of patients or for record keeping. This

    Order reprimands Licensee; assesses a $10,000 civil penalty, $5,000 held in abeyance; places

    Licensee on probation for a minimum of 5 years; subjects Licensee to no-notice chart audits and

    office visits by the Board's designee; restricts Licensee from prescribing, dispensing, or

    distributing buprenorphine/naloxone to any patient; restricts Licensee from accepting any

    patients needing Medication Assisted Treatment for opioid use disorder; restricts Licensee from

    prescribing, dispensing, or distributing opioid medication to any patient; and restricts Licensee

    from prescribing any benzodiazepine to any patient being prescribed opiates for chronic pain.

    *Kahn, Heather Alaine, MD; MD22858; Grants Pass, OR

    On April 11, 2019, the Board issued an Order Terminating Stipulated Order. This Order

    terminates Licensee's 2017 Stipulated Order.

    On March 25, 2019, the Board issued an Order Terminating Consent Agreement for Re-Entry to

    Practice. This Order terminates Licensee's February 6, 2019, Consent Agreement for Re-Entry

    to Practice.

    *Ottenheimer, Edward Joseph, III, MD; MD20394; Roseburg, OR

    On April 11, 2019, Licensee entered into a non-disciplinary Corrective Action Agreement with

    the Board. In this Agreement, Licensee agreed to complete a CPEP evaluation; contract with

    CPEP for the development of any education plan; complete the CPEP education plan; and

    complete a pre-approved course on professionalism.

    *Patel, Jitendra Chunibhai, MD; MD15202; Brookings, OR

    On April 11, 2019, Licensee entered into a non-disciplinary Corrective Action Agreement with

    the Board. In this Agreement, Licensee agreed to complete a CPEP evaluation; contract with

    CPEP for the development of any education plan; and complete the CPEP education plan.

    *Popowich, Yale Sands, MD; MD26661; Portland, OR

    On April 11, 2019, Licensee entered into a Stipulated Order with the Board for unprofessional or

    dishonorable conduct; gross or repeated acts of negligence; and willful violation of any rule

    adopted by the Board. This Order reprimands Licensee; suspends Licensee's license for a total of

    90 days; assesses a $10,000 civil penalty; places Licensee on probation for 5 years; requires the

    presence of a medically trained chaperone for all clinical encounters; subjects Licensee to no-

    notice chart audits and office visits by the Board's designee; restricts Licensee from scheduling

    his own patient appointments; restricts Licensee from having social media contact or electronic

    communication for personal purposes with patients; requires Licensee to have a pre-approved

    practice monitor; requires that Licensee enter into treatment with a pre-approved healthcare

    provider; requires that Licensee develop and submit a plan for maintaining boundaries and

    professionalism; requires Licensee to undergo a reassessment at Acumen Assessments; and

    requires Licensee to undergo polygraph compliance monitoring.

    On April 11, 2019, the Board issued an Order Terminating Corrective Action Agreement. This

    Order terminates Licensee's 2018 Corrective Action Agreement.

    On April 4, 2019, Applicant entered into a non-disciplinary Consent Agreement for Re-Entry to

    Practice with the Board. In this Agreement, Applicant agreed to complete a 160-hour

    mentorship with a Board-approved clinical supervisor.

    O n April 6, 2017, Justin R obert Adam s, M D (Licensee) entered into a Stipulated O rder

    with the Oregon M edical B oard (Board). This O rder placed L icensee on probation w ith certain

    conditions. O n January 31, 2019, L icensee subm itted a w ritten request to term inate this Order.

    The Oregon M edical Board (Board) is the state agency responsible for licensing,

    regulating and disciplining certain health care providers, including physicians, in the State o f

    Oregon. Jodee Marie Anderson, M D (Licensee) is a licensed physician in the State o f Oregon.

    2 .

    On March 2 0 ,2 0 1 9 , the Board issued a Complaint and N otice o f Proposed Disciplinary

    Action (N otice) in w hich the Board proposed taking disciplinary action by im posing up to the

    maximum range o f potential sanctions identified in ORS 677.205(2), to include the revocation o f

    license, a $10,000 civil penalty per violation, and assessm ent o f costs, against L icensee for

    violations o f the M edical Practice A ct, to wit: ORS 677 .190( 1 )(a) unprofessional or dishonorable

    conduct, as defined in ORS 677.188(4)(a) any conduct or practice contrary to recognized

    standards o f ethics o f the m edical profession or any conduct or practice which does or might

    constitute a danger to the health or safety o f a patient or the public or any conduct, practice or

    condition which does or might adversely affect a physician's ability safely and sk illfu lly to

    practice medicine, ORS 6 7 7 .1 88(4)(b) willful performance o f any surgical or medical treatment

    which is contrary to acceptable m edical standards, and ORS 677 .188(4)(c) w illfu l and repeated

    ordering or performance o f unnecessary laboratory tests or utilizing m edical service for diagnosis

    or treatment w hich is or may be considered inappropriate or unnecessary; ORS 677.190(13)

    gross or repeated acts o f negligence; and ORS 677.190(17) w illful violation o f any rule adopted

    by the Board, to include OAR 847-015-0010, Schedule III or IV Controlled Substances -

    Bariatrics Practice, and OAR 847-065-0055, Health Professionals’ Services Program (1IPSP)

    Licensee Responsibilities. Prior to the issuance o f the Complaint and N otice o f Proposed

    Disciplinary Action, on January 29, 2018, L icensee entered into an Interim Stipulated Order with

    the Board in which she agreed to voluntarily withdraw from practice and place her license in

    Inactive status.

    3.

    Licensee and the Board desire to settle this matter by entry o f this Stipulated Order.

    Licensee understands that she has the right to a contested case hearing under the Administrative

    Procedures Act (chapter 183), Oregon Revised Statutes. L icensee fully and finally waives the

    right to a contested case hearing and any appeal therefrom by the sign ing o f and entry o f this

    Order in the Board's records. L icensee neither admits nor denies, but the Board finds that she

    engaged in the conduct described in the March 2 0 ,2 0 1 9 , Complaint and N otice o f Proposed

    Disciplinary Action and that this conduct violated 677.190(1 )(a) as defined in ORS

    6 7 7 .188(4)(a), (b) and (c); ORS 677 .190( 13); and ORS 677.190(17), to include OAR 8 4 7 -0 15-

    0010 and OAR 847-065-0055. Licensee understands that this Order is a public record and is a

    disciplinary action that is reportable to the National Practitioner Databank and the Federation o f

    State Medical Boards.

    4.

    Licensee and the Board agree to resolve this matter by the entry o f this Stipulated Order

    subject to the follow ing terms and conditions:

    4.1 Licensee is reprimanded.

    4 .2 L icensee is placed on probation for a minimum period o f 10 years and shall report

    in person to the Board at each o f i ts quarterly m eetings a t th e scheduled tim es for a probation

    interview, unless otherwise directed by the Board’s Com pliance O fficer or its Investigative

    Committee. Additionally, at the Board’s discretion, interviews may he held electronically

    between L icensee and the Board’s Com pliance Officer (or its designee) using Board established

    protocols for the location and electronic transmission o f the m eeting. L icensee is responsible for

    maintenance o f the equipment and technology necessary for the electronic m eetings to occur.

    Licensee will be notified i f and when such m eetings are scheduled in lieu o f an in-person

    appearance.

    4.3 Licensee must remain enrolled and in good standing in the Health Professionals1

    Services Program and in com pliance with any monitoring requirements as long as she is licensed

    in the State o f Oregon.

    4 .4 L icensee must not prescribe any controlled substances to any individual.

    4.5 L icensee may only practice at sites that are pre-approved by the Board's Medical

    Director.

    4 .6 L icensee must maintain an on-going therapeutic relationship with a healthcare

    provider(s) pre-approved by the Board’s M edical Director. L icensee m ust sign all necessary

    releases to allow direct com m unication between the Board and L icensee’s healthcare providers,

    who w ill provide written quarterly reports to the Board’s M edical Director. At the Board’s

    discretion, the frequency o f the required reports may be reduced. Additionally, after two years o f

    continued com pliance with this term, Licensee may petition the Board for a reduction in the

    frequency o f these reports.

    4 .7 L icensee’s medical practice is subject to random, no notice chart audits and office

    visits by Board designees.

    4 .8 The Interim Stipulated Order o f January 29, 2018, terminates effective the date

    the Board Chair signs this Order.

    4 .9 L icensee must inform the Com pliance Section o f the Board o f any and all practice

    sites, as well as any changes in practice address(es), em ploym ent, or practice status within 10

    business days. Additionally, L icensee must notify the Com pliance Section o f any changes in

    contact information within 10 business days.

    4 .10 L icensee must obey alt federal and Oregon state laws and regulations pertaining

    to the practice o f m edicine.

    4.11 L icensee stipulates and agrees that any violation o f the terms o f this Order shall

    be grounds for further disciplinary action under ORS 677.190(17).

    18 Licensee for violations o f the M edical Practice Act, to wit: ORS 677.190(l)(a) unprofessional or

    19 dishonorable conduct, as defined in ORS 677.188(4)(a) any conduct or practice contrary to

    20 recognized standards o f ethics o f the medical profession or any conduct or practice which does

    21 or might constitute a danger to the health or safety o f a patient or the public or any conduct

    22 which does or might adversely affect a physician’s ability safely and skillfully to practice

    23 medicine; ORS 677.190(6) conviction o f any offense punishable by incarceration in a

    24 Departm ent o f Corrections institution or in a federal prison; ORS 677.190(17) willful violation

    entered into an Interim Stipulated Order with the Board in which she agreed to voluntarily

    in ORS 677.188(4)(a); ORS 677.190(6); ORS 677.190(17); ORS 677.190(23); and ORS

    677.190(24). Licensee understands that this Order is a public record and is a disciplinary action

    that is reportable to the National Practitioner Data Bank and the Federation o f State Medical

    Boards.

    4.

    Licensee and the Board agree to resolve this m atter by the entry o f this Stipulated Order

    subject to the following terms and conditions:

    4.1 L icensee’s medical license is revoked; however, the revocation is stayed.

    4.2 Licensee is assessed a civil penalty o f $5,000.00. This term will be held in

    abeyance contingent upon Licensee complying with all other terms and conditions o f this Order.

    4.3 Licensee is placed on probation for a minimum period o f five years and shall

    report in person to the Board at each o f its quarterly meetings at the scheduled times for a

    probation interview, unless otherwise directed by the B oard’s Investigative Committee or its

    Compliance Officer. Additionally, at the B oard’s discretion, interviews m ay be held

    electronically between Licensee and the Board’s Compliance O fficer (or designee) using Board

    established protocols for the location and electronic transmission o f the meeting. Licensee is

    responsible for m aintenance o f the equipment and technology necessary for the electronic

    meetings to occur. L icensee will be notified i f and w hen such m eetings are scheduled in lieu o f

    an in-person appearance.

    4.4 Licensee m ust rem ain enrolled and in good standing in the Health Professional's

    Services Program as long as she is licensed in the State o f Oregon.

    4.5 W ithin 30 days from the date Licensee gains employment as a physician,

    Licensee must, at her own expense, enter into an agreement with a licensed physician who is pre

    approved by the B oard’s M edical Director to serve as her practice mentor. Licensee must meet

    with the approved m entor at least tw ice a month, and the mentor m ust review, on an ongoing

    basis, at least 20% o f charts for patients seen by Licensee. The m entor is to provide quarterly

    written reports to the Board on Licensee's ability to safely and com petently practice medicine,

    Licensee m ay request to term inate this term after one full year o f compliance, four quarterly

    reports from the m entor, and a recommendation o f termination from the mentor.

    In order to address the Board’s concerns, Licensee and the Board agree to the entry o f

    this Interim Stipulated Order, which is not an admission o f any wrongdoing on the part o f the

    Licensee. This Order will remain in effect while this matter remains under investigation, and

    provides that Licensee shall comply with the following conditions:

    3.1 Licensee must not begin treatment for chronic pain with opioids for any new or

    existing patient. For the purposes o f this Order, chronic pain is defined as pain that persists or

    progresses over a period o f time greater than 30 days.

    3.2 Licensee must not begin treatment for substance use disorder with any scheduled

    medications for any new patient.

  • 3.3 Licensee may transition current chronic pain patients to buprenorphine or

    buprenorphine/naloxone, or continue to prescribe buprenorphine or buprenorphine/naloxone to

    any current patient taking the medication.

    . 3.4 Licensee must immediately begin to taper opioid medications for any chronic pain

    patient with a morphine equivalent dose (M ED) over 90 by at least 10% per month until patient’s

    M ED is 90 or less unless the patient is currently enrolled in hospice or is currently receiving end

    o f life care. If this exception applies. Licensee must certify on the written prescription that the

    patient is a hospice patient o r receiving end o f life care. Licensee may elect to transfer the care

    o f any patient with an M ED over 90 to another physician.

    3.5 For patients taking buprenorphine or buprenorphine/naloxone, Licensee may

    continue to prescribe above 90 MED.

    3.6 Licensee m ay treat patients for acute pain for no more than 30 days per year, with

    a m axim um M ED o f 50.

    3.7 Licensee must not begin treatment with benzodiazepines for patients taking

    opioids.

    3.8 For patients taking benzodiazepines and opioids (other than buprenorphine or

    buprenorphine/naloxone), Licensee must begin to taper benzodiazepines after opioids have been

    tapered !o 90 M ED or less. Benzodiazepines must be tapered by at least 10% per month until the

    patient is weaned o f f benzodiazepines. Alternatively, Licensee m ay transfer the care o f any

    patient for whom he is prescribing benzodiazepines and opioids to another physician. Licensee

    may continue to prescribe concurrent benzodiazepines to patients who are currently enrolled in

    hospice or who are currently receiving end o f life care. Licensee m ust certify on the written

    prescription that the patient is a hospice patient or receiving end o f life care.

    3.9 Licensee must not concomitantly prescribe opioids with benzodiazepines

    following tapering as outlined in terms 3.4 and 3.8. .

    3.10 Licensee must not concomitantly prescribe opioids with muscle relaxants.

  • 3 .1 1 Licensee must obtain an EKG on all patients taking methadone at least once

    annually.

    3.12 Licensee understands that violating any term o f this Order will be grounds for

    disciplinary action under ORS 677.190( 17).

    3.13 Licensee understands this Order becomes effective the date he signs it.

    At the conclusion o f the B oard 's investigation, the Board will decide whether to close the

    case or to proceed to some form o f disciplinary action. If the Board determines, following that

    review, not to lift the requirements o f this Order, Licensee may request a hearing to contest that

    decision.

    This order is issued by the Board pursuant to ORS 677.410, which grants the Board the

    authority to attach conditions to Licensee’s license to practice medicine. These conditions will

    remain in effect while the Board conducts a complete investigation in order to fully inform itself

    On July 12,2018, the Board issued an Amended Complaint and Notice ofProposed

    Disciplinary Action (Notice) in which the Board proposed taking disciplinary action by imposing

    up to the maximum range ofpotential sanctions identified in ORS 677.205(2), to include the

    revocation of license, a $10,000 civil penalty, and assessment of costs, against Licensee for

    violations o f the Medical Practice Act, to wit: ORS 677.i90(l)(a) unprofessional or dishonorable

    conduct, as defined in ORS 677.188(4)(a); ORS 677.190(13) gross or repeated acts of

    negligence; ORS 677.190(17) violation o f a Board order or any rule adopted by the Board,

    specifically OAR 847-001-0024(2); and ORS 677.190(24) prescribing controlled substances

    without a legitimate medical purpose or without following accepted procedures for examination

    of patients or for record keeping. Prior to the issuance of the Notice, on February 9,2018,

    Licensee entered into an Interim Stipulated Order in which she agreed to specific limitations in

    her prescribing of controlled substances.

    Licensee and the Board desire to settle this matter by entry of this Stipulated Order.

    18 report in person to the Board at each of its quarterly meetings at the scheduled times for a

    19 probation interview, unless otherwise directed by the Board’s Compliance Officer or its

    20 Investigative Committee. Additionally, at the Board’s discretion, interviews may be held

    21 electronically between Licensee and the Board’s Compliance Officer (or its designee) using

    22 Board established protocols for the location and electronic transmission of the meeting. Licensee

    23 is responsible for maintenance of the equipment and technology necessary for the electronic

    24 meetings to occur, Licensee will be notified i f and when such meetings are scheduled in lieu o f

    25 an in-person appearance.

    26 4.4 Licensee and her practice site(s) are subject to no notice office visits and chart

    27 audits conducted by the Board’s designee.

    2 (Suboxone) to any patient.

    3 4.6 Licensee must not accept any patients needing Medication Assisted Treatment for

    5 4.7 Licensee must not prescribe, dispense or distribute any opioid medication to any

    6 person, with the exception of atropine/diphenoxylate (Lomotil) and eluxadoline (Viberzi).

    7 4.8 Licensee must not prescribe any benzodiazepine to any patient being prescribed

    8 opiates by any provider for chronic pain. Licensee may prescribe benzodiazepines to patients

    9 who are prescribed opiates for the treatment of acute pain which is defined as pain lasting a

    10 period o f 3 0 days or less.

    11 4.9 Licensee must inform the Compliance Section of the Board of any and all practice

    12 . sites, as well as any changes in her practice address(es), employment, or practice status.

    13 Additionally, Licensee must notify the Compliance Section of any changes in her contact

    14 information within 10 business days.

    1 1 education evaluation, Licensee agrees to sign all necessary releases to allow full communication

    12 and exchange of documents and reports between the Board and'CPEP. Licensee agrees to ensure

    ] 3 CPEP submits the education plan and reports directly to the Board.

    (4 4.2 Licensee agrees to sign the appropriate paperwork indicating that he will enroll in

    6 investigation, Licensee and the Board agree that the Board will close this investigation

    7 contingent upon Licensee agreeing to the following conditions:

    8 4.1 W ithin 30 days o f the effective date o f this Order, Licensee agrees to contract

    9 with CPEP for the developm ent o f an education plan. The cost o f the com pletion o f any CPEP

    10 recommendations and the development o f an education plan will be borne by the Licensee.

    11 Licensee agrees to sign all necessary releases to allow full communication and exchange o f

    12 documents and reports between the Board and CPEP. Licensee agrees to ensure CPEP submits

    13 the education plan and reports directly to the Board,

    14 4.2 Upon approval o f the educational plan by the Board’s M edical Director, Licensee

    15 agrees to successfully complete the CPEP education plan, including any post-education

    16 evaluation and any recom mendations, w ithin 18 months from the date the educational plan is

    17 approved. Any educational m entor required for the completion o f the education plan must be

    18 pre-approved by CPEP and the B oard’s Medical Director. AH costs associated w ith the

    19 approved education plan w ill be borne by Licensee, Any educational m entor m ust be pre-

    20 approved by CPEP and the B oard’s Medical Director. Licensee agrees to sign all necessary

    21 releases to allow full comm unication and exchange o f documents and reports between the Board

    22 and CPEP. Licensee agrees to keep the Board apprised o f his compliance with the CPEP

    23 education plan throughout its duration.

    24 4.3 Licensee agrees to provide the Board w ith written p roof from CPEP upon

    25 successful completion o f the approved education plan, including successful completion o f any

    26 post-education evaluation and any recommendations, as defined above.
