covered by other forms.This form must not be used for any family or private life applications or protection or protection (asylum) claims.

In accordance with paragraph 34 of the Immigration Rules, this form is a specified form for the purpose of the Immigration Rules as of 05 November 2018 and must be used for all applications made on or after that date for the purposes stated on this page and listed in section 3.

Payment Guidance

The FeeIf you are a single applicant on form FLR(HRO) and no dependants are applying with you, the normal specified fee is £1033 for standard applications made by post.

Applications can be made in person at a Premium Service Centre for a same day consideration of your application. There is an additional fee for this service and all fees will be taken when you book an appointment. You can only make on-line or in person payments by using one of our accepted credit or debit cards (see below). For more details and to book an appointment please visit www.gov.uk/ukvi-premium-service-centres.

The fee charged is for the processing and consideration of the application. This fee will be payable once the application form is received by the Home Office or its payment processing agent, regardless of the outcome of the application. If your application contains errors or is missing information it may be rejected as invalid. Your application will not be considered and your fee will be refunded less an administration fee of £25 for each person included in the application.

We cannot begin the consideration process until the payment has cleared. We allow 5 working days for payments made by cheque to clear, credit/debit cards and postal orders will clear immediately.

If you are claiming an exemption from paying the fee because you are applying to stay in the UK under the European Convention on Human Rights and want to apply for a fee exemption because you are destitute and unable to pay the fee, tick the box at item 5 on the payment details page to confirm this. (Information about what we mean by destitute can be found on our website).

If you tick the Nil payment box you will need to complete Appendix 1 FLR (FP). Failure to complete Appendix 1 FLR (FP) will result in your application being rejected if you have not sent a fee.

Biometric Enrolment FeeAs part of your application you are required to enrol your biometric information. You will be charged an additional handling fee for this service, payable to the Post Office Ltd. You must pay the fee by cash or debit card when you attend Post Office Ltd to enrol your biometrics. Each dependant included on your application must also pay this fee when they enrol their biometric information. Do not send the biometric enrolment fee with your application fee.

Applicants on some immigration routes are exempt from paying an enrolment fee at the Post Office Ltd. If you are in one of these categories you will be informed of this when we send you a biometric notification letter.

Your application may be rejected as invalid if you do not enrol your biometrics when requested. For more information about enrolling biometrics and the current fee, please visit the following section of our website: www.gov.uk/biometric-residence-permits.

Who May Apply With You?You may include your spouse, civil partner, unmarried or same-sex partner and/or children under the age of 18 if they are applying as your dependants. However, they must pay the full specified fee if they apply separately.

If this is the first time you are applying for leave in this category you cannot list dependant children over the age of 18 on this form. However, children who were initially granted leave in this category at a time when they were under 18 but who are now over 18, may continue to be included as a dependent child (subject to an adult fee). It is your responsibility to satisfy yourself that you are familiar with the definitions and can answer the questions accurately on behalf of yourself and any dependants who are applying with you.

War crimesGrave breaches of the Geneva Conventions committed during an armed conflict. This includes an internal armed conflict and an international armed conflict. The types of acts that may constitute a war crime include wilful killing, torture, extensive destruction of property not justified by military necessity, unlawful deportation, the intentional targeting of civilians and the taking of hostages.

Crimes against humanityActs committed at any time (not just during armed conflict) as part of a widespread or systematic attack, directed against any civilian population with knowledge of the attack. This would include offences such as murder, torture, rape, severe deprivation of liberty in violation of fundamental rules of international law and enforced disappearance of persons.

GenocideActs committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group.


Terrorist activitiesAny act committed, or the threat of action, designed to influence a government or intimidate the public and made for the purposes of advancing a political, religious or ideological cause and that:

• involves serious violence against a person

• that may endanger another person’s life

• creates a serious risk to the health or safety of the public

• involves serious damage to property

• is designed to seriously disrupt or interfere with an electronic system

Organisations concerned in terrorism• an organisation is concerned in terrorism if it:

• commits or participates in acts of terrorism

• prepares for terrorism

• promotes or encourages terrorism (including the unlawful glorification of terrorism)

• or is otherwise concerned in terrorism


Section 7 - Passport, travel document or national identity cardIt is mandatory to complete this section. Please note this application will be invalid if you do not.

You must provide your original valid passport or (except a PBS applicant), a national identity card as evidence of your identity and nationality. If you do not have these, your most recent passport or (except a PBS applicant) national identity card. If you have neither of these, you can provide a travel document unless these are not available for reasons beyond your control. If your document is lost or stolen, you should replace it before making your application unless there are reasons beyond your control why you cannot (see note 4 below).

If you are applying as a domestic worker who is a victim of slavery or human trafficking, we will consider you to be unable to provide your passport for reasons beyond your control if your passport was retained by your previous employer or other person in circumstances which led to being considered to be a victim of slavery or human trafficking.

For which applications must you use form FLR(HRO)?

Form FLR(HRO) must only be used if you are applying for an extension of stay in one of the following categories:

• discretionary leave (DL) where you have previously been granted a period of DL but have not previously been refused asylum or granted less than 4 years Exceptional Leave (who should use form FLR(DL))

• medical grounds or ill health • human rights claim (not including claims on the grounds of family or private life,

claims on the basis of family dependencies between a parent and a child, or protection (asylum) claims)

• leave outside the rules under the policy concessions in the “Leave outside the rules guidance”

• claim for leave outside the Immigration Rules because of compassionate and compelling circumstances

• other claims not covered by another form

You can find out which applications are covered by another application form by going to the gov.uk website: www.gov.uk/government/collections/uk-visa-forms. You and any dependants applying with you must be in the UK to apply. You must not use this form:

• to make an application for asylum or international protection (this includes an application for humanitarian protection or an Article 3 European Convention on Human Rights (ECHR) application made on protection grounds) or to make further submissions on asylum or human rights grounds after the refusal or withdrawal of an earlier asylum or human rights claim

• if you are applying for leave to remain based on family or private life in the UK – use the relevant form, either the FLR(M) or FLR(FP) or the digital equivalent where available

• if you can apply on one of the routes in form FLR(IR) which were previously on

the FLR(O) - (forms FLR(IR) and FLR(HRO) replace the FLR(O)) Who may apply on this form

You and your partner and/or children under 18 if they are applying as your dependants. “Partner” means a spouse, civil partner, unmarried or same-sex partner. If this is the first time you are applying for leave in this category, dependant children over the age of 18 may not be included. However, children who were initially granted leave in this category at a time when they were under 18 but who are now 18 or over, may continue to be included. You must show that he or she has not formed their own family unit or is leading an independent life.

The fee

Please note that when making large or multiple payments using your credit card, the anti-fraud measures that banks operate sometimes stop the full payment being taken. This is can happen for a number of reasons. To prevent this, you may wish to inform your bank of your intention to make large or multiple payments in advance so that your bank allows the full payment to be taken when you submit your application. Please be aware that not all banks offer this service. If you do not pay the specified fee, the application will be invalid and will be returned to you, unless you are applying on a route where a fee exemption applies or you are applying for a fee waiver using Appendix 1 FLR(FP): www.gov.uk/government/publications/application-to-extend-stay-in-the-uk-appendix-1-flrfp-flro. We will not refund the fee if we refuse the application or if you withdraw it. For information about methods of payment, please see the payment details guidance on the form. When to apply

You and any dependants applying with you should apply before the end of your or their permitted stay in the UK. Making sure your application is valid

Paragraph 34 of the Immigration Rules specifies certain requirements with which an application on a form specified for the purpose of the rules must comply. To make a valid application, you must:

• apply on the current version of form FLR(HRO) • pay the specified fee by one of the methods specified in the payment guidance • ensure the correct payment has been made towards the Immigration Health

• provide an original valid passport or (except a PBS applicant) a national identity card or travel document for yourself and any dependants who are applying with you as specified in the application form, as evidence of your identity and nationality, unless it is not available for reasons beyond your control

• complete all sections of the form as required, including all mandatory sections of the form

• sign the declaration as specified • send the application by prepaid post to UK Visas & Immigration at the address

If you fail to do any of these things, your application will be invalid and we will return it to you. Ensuring your application is complete

You do this by completing every relevant section of the form as required and providing all the documents specified for your particular application. If you do not do this, we reserve the right to decide your application on the basis of the information and documents provided. It is important, therefore, to provide an explanation if you cannot give us all relevant information or documents when making your application. Completing the form

Please use a black pen to complete the form; write names, addresses and similar details in capital letters. In the payment details and other sections where you give personal details and addresses, leave an empty box between each part of the name and of the address. Please note that we always use the personal details in an applicant’s passport, national identity card or travel document for official purposes, including any residence permit if the application is granted. Take care to complete all sections as required, including the Personal History section. Follow the guidance on the form when completing the payment details. Read the notes in various sections of the form. You must enclose a letter of explanation if you are unable to provide all the required information or any relevant specified documents. For your application to be valid, it is mandatory to provide your original valid passport or (except a PBS applicant) a national identity card. If you do not have these, your most recent passport or (except a PBS applicant), your most recent national identity card. If you don’t have either of these, you can provide a travel document. You also need to include the valid passport, national identity card or travel document of any dependants applying with you as evidence of your identity and nationality, unless these are not available for reasons beyond your control. Reasons beyond your control may include where you do not have a national authority to provide a document, or where you have applied for a document and your national authority cannot provide one in time for you to make your application. If you


cannot provide your passport, national identity card or travel document, then you must provide an explanation as to why this is. If it has been lost or stolen, you must provide your crime reference number and reasons why you have not been able to provide a replacement document. If your passport is already with the Home Office, you must tell us and provide information as to why we already hold your passport, national identity card or travel document. If you are not enclosing an original valid passport, national identity card or travel document, then you must provide alternative satisfactory evidence of your identity and nationality, which must include your full name, date of birth and nationality.

Documents

Any documents which are not in English must be accompanied by a reliable English translation. Make sure passports or travel documents are signed Applying by post: the address

If you are applying by post, the address to which you must send an application on form FLR(HRO) is as given on the front of that form. Posting it to any other address will not only delay your application but could make it invalid. This address is only to be used when sending your application. Please use the address listed under ‘contacting us after you have applied’ for any other correspondence about your application. If you use Recorded or Special Delivery, this will help us to record the receipt of your application. Make sure that you keep the Recorded or Special Delivery number. We will return your passports and other documents by Recorded Delivery. If you would like them to be returned by Special Delivery, you must provide a prepaid Special Delivery envelope which is large enough. You will receive a letter of acknowledgement within a few days of your application being received, unless there is a problem concerning the payment of the fee. The validity of your application will then be checked and we shall contact you in writing if your application is invalid. Applying in person

UKVI offers a service to people who apply in person at our Premium Service Centres. This service is available only for applications which are straightforward and do not require further enquiries. You can find more information about which routes

For the latest information on service standards for deciding charged applications please go to our website. Applications which are not straightforward, or which need further enquiries, take longer to decide. These include applications by people who have remained here unlawfully after the expiry of their permitted stay. As we cannot tell in advance how long it will take to decide particular cases, our general advice is not to make any non-urgent travel arrangements until your passports, national identity cards or travel documents passports or travel documents are returned. If you and any dependants apply before the end of your permitted stay in the UK, your/their existing immigration status, including any permission to work, will continue until your/their applications is/ are decided.
