Box 10100 MS S4B20 Reno, NV 89520 TEMPORARY CONSTRUCTION AND UTILITY EASEMENT The CITY OF SPARKS, a Nevada municipal corporation and the CITY OF RENO, a Nevada municipal corporation, (collectively, “Grantors”) for One Dollar ($1.00) and other and good valuable consideration, receipt of which is hereby acknowledged, grants and conveys to Sierra Pacific Power Company, a Nevada corporation, d/b/a NV Energy (“Grantee”), its successors and assigns, a Temporary Construction and Utility Easement on the real property commonly known as APN 021-020-02 situated in Washoe County, Nevada (“the Property”): 1. to use an area totaling approximately 59,429 s.f. contained in two separate temporary easement areas for construction, installation, operation, maintenance, addition to, and removal of temporary overhead primary service electric power and communication lines/facilities, poles and anchors, including, construction staging (including but not limited to parking vehicles and storing materials), pulling cable, wire tensioning, energizing, and providing electric service in the location legally described in Exhibit “A” and depicted in Exhibit “B” attached hereto; 2. to perform final cleanup of the Temporary Easement Area; 3. for the unrestricted passage of vehicles and pedestrians within, on, over and across the Temporary Easement Area; and 4. for the unrestricted, contiguous ingress and egress of vehicles and pedestrians along and through the Property to and from the Temporary Easement Area. Grantee has the right to permanently remove or clear any and all materials, trees, brush, debris, and any other obstruction from the Temporary Easement Area, which in Grantee’s reasonable judgment may interfere with or endanger Grantee’s use of or activities on the Temporary Easement Area. Grantee will be responsible for any damages, proximately caused by Grantee’s negligent use of or activities on the Temporary Easement Area, to any tangible, personal property or improvements owned by Grantors and located on the Temporary Easement Area on the date Grantors sign the Temporary Construction and Utility Easement. Grantee shall bring the ground surface back to similar elevation as existed prior to grantees use after removal of temporary power lines. This Temporary Construction and Utility Easement will terminate one (1) year from the date of approval of this document by the Grantor and, upon termination, has no further effect.
