13th Circuit Court Community Corrections Grant Application to MDOC for FY 2020

WHEREAS, on May 2, 2019 the Antrim County Board of Commissioners was

presented the yearly Plans and Services Grant Application for the Department of Corrections,

Office of Community Correction has been submitted to the board of commissioner for approval,

and

WHEREAS, the grant is for one year starting with October 1, 2019 and is

consistent with the prior year’s funding amount of $264,256 and,

WHEREAS, now, application requires approval from the Antrim County Board of

Commissioners to continue funding for the next fiscal year with no changes or amendments.

NOW, THEREFORE, BE IT RESOLVED BY THIS BOARD OF

SECTION II: ANALYSIS & STRATEGIC PLAN Introduction and Instructions for Strategic Plan: Strategic Issues, Goals, and Priorities have been established by the Office of Community Corrections in accordance with Public Act 511 and Key Performance Indicators. CCABs will be required to establish Objectives and Strategies based upon OMNI Felony Disposition, JPIS, CCIS and local data that will support State Goals and Priorities. Strategic Issues are identified as Felony Dispositions, Recidivism and Local Priorities. OCC will provide the CCABs with relevant data to complete the application. CCABs shall analyze this data along with local CCIS data (reports run locally from Case Manager) and develop Key Objectives and supporting Strategies that will lead toward attainment of Goals and Priorities established by the State Board and OCC, as well as local objectives and priorities promoted in the comprehensive plan. A thorough review of the data should include:

• Overall PCRs, rates within sentencing guideline ranges, PCRs within Group 1 and Group 2 offense categories, status at time of offense and technical probation violation PCRs

• Reference to changes in PCRs compared to prior years • Other changes in your CCAB/area that influence changes (new stakeholders, policies, emerging crimes, offender

characteristics, etc.) • Review your past OCC funding proposals for ideas

Example: For the Strategic Issue of Felony Dispositions, consider the stated Goal and Priority as outlined on the following pages and complete an analysis of your county’s prison commitment rate data provided by OCC. Establish objectives related to prison commitment rates. For example: 1. Reduce PV commitment rate from 32% to 25% 2. Reduce the Group 2 Straddle rate to from 43% to 35% Under each OBJECTIVE outline in bullet form those STRATEGIES (steps) to be taken, including continuing, new and revised programs, or established and revised policies or practices, that will support the attainment of the objectives you have specified. Identify if these are “new”, “continuations,” or “modifications,” or for short term (this fiscal year) or long term implementation. Keep in mind that all of the programs for which you are requesting PA511 funding should be identified as strategies. Additionally, policies and practices you propose (such as targeting specific populations or characteristics) are also strategies. Strategies may apply to more than one objective and should be repeated under each objective as appropriate. For example, the objective of “Reduce PV rate from 32% to 25%” may have the following strategies:

1. Initiate structured sentencing with jail followed by RS followed by community Cognitive Behavioral Treatment program that targets probation violators. (New, FY 2017)

The same strategies (with modifications) would be appropriate for the objective of reducing the PCR of Straddle Cell offenders. Further OMNI data analysis may support an additional strategy of:

2. Target CJRP eligible straddle cells, especially those from Group 2 without MDOC status, for local sanctions including ________________.

A: Felony Disposition Analysis (NOTE: Regional CCABs should complete analysis for each county. Carriage returns are permitted in this section.) Strategic Issue: Felony Dispositions Public Act 511 of 1988 stipulates that counties shall develop a community corrections comprehensive plan and provide an explanation of how the county or counties’ prison commitment rate will be reduced by diverting non-violent offenders, and promote recidivism reduction while public safety is maintained. The Act is intended to encourage the participation in community corrections programs of offenders who would likely be sentenced to imprisonment in a state correctional facility or jail, who would not increase the risk to public safety, have not demonstrated a pattern of violent behavior, and do not have a criminal record that indicates a pattern of violent offenses. Goal: Reduce demand for prison resources and related budgetary requirements. Priority: Reduce prison commitment of offenders who can be safely and effectively sanctioned and treated in the

community by following the principles of effective intervention (i.e., risk, need, responsivity). Your analysis forms the basis for your objectives and strategies. A weak connection between data analysis, objectives and proposed programming (strategies) may result in denial or conditional approval of your plan. In the two categories we specifically target offenders in, there has been a reduction in both the Intermediate and Straddle Groups. Intermediate for 2017 was 16% and 2018 was 12%. Straddle for 2017 was 58% and for 2018 was 50%. WE have seen increases in utilization of our Pre Trial program and pairing that with the DDJR portion of our Sobriety Court, Drug Court, Case Management and MRT, we are seeing meaningful changes in our statistics. This is the second year of reductions in these categories.

3. Provide information regarding policies, procedures, program operations, pertinent issues or opportunities whichemerged, or other factors which have positively/negatively affected the achievement of objectives--for example, localchanges regarding early jail release, implementation of required program fees, stakeholders--CCAB manager or staff,judges, magistrates, prosecutor, sheriff, contractor/service providers. Briefly describe the impact and, if negative, howit was addressed. A new Judge was appointed at the end of 2016 and he supports all of our programs and services aswell as the sitting Chief Judge. They welcome any new opportunities for offenders. Our Pre Trial program has shownsuccess as this population were never supervised in the past and with supervision now, they have significantly lessviolations and more are being shown to be supervisable in the community. Our Drug Court and Sobriety Courtprograms directly divert felons from possible prison sentences.

4. What steps will you take if you find that you are not meeting your objectives or your strategies are not beingimplemented as planned? Program utilization will be monitored on a constant basis by manager. If anyunderutilization of programs occur, staff will take steps to increase participation as well as encourage DOC staff toutilize our programs. If goals are not being met, CCAB Manager will discuss with CCAB what steps they want to taketo address any problems. Also manager will meet with Judges, DOC Supervisor and Prosecutor to addresschanges/needs to encourage our alternative options to prison. Manager also contacts grant coordinator often aboutprogram objectives and utilization. Manager has always worked closely with the OCC staff in Lansing to address anychanges needed.

identify them as strategies.1. Objective #1 is intended to impact the overall prison commitment rate – please state the Objective: Reduce the Overall

Prison Commitment Rate (PCR) to 38% or lowerPrograms in support of Objective #1 (number and separate strategies by using carriage return [enter]): 1. I25-Gatekeeper- Each offender after arrest will be given a Praxis screening and if appropriate a substance abuse assessmentas part of Gatekeeper (Continuation)2. F23-Pre-Trial Services- Offenders will be monitored for drug/alcohol usage, AA/NA attendance and placed in residentialservices as needed. (Continuation)3. D08-Pre-Trial Electronic Monitoring- Pre-Trial offenders requiring a GPS as a bond condition will be placed on electronicmonitoring allowing them to be released from jail. This will allow to them to remain employed, participate more fully in theircourt case, and be supervised in the community instead of jail. (NEW)4. I24-CBCM- Once an offender has been sentenced and served their required minimum, they are placed in jail alternativeoptions and monitored through CBCM. (Continuation)5. C01-MRT- After completion of PRS or DDJR, jail alternative clients will be sent through MRT group counseling. B: Recidivism Analysis The updated Public Act 511 mandates that CCABs “Provide improved local services for individuals involved in the criminal justice system with the goal of reducing the occurrence of repeat criminal offenses that result in a term of incarceration or detention in jail or prison.” As such, CCABs are required to address recidivism within their comprehensive plan, with a specific emphasis on how the plan is intended to impact the local recidivism rates. The State Board has defined recidivism as “Probation Violations, either technical or new sentence, resulting in prison,” and has identified Probation Violators as being indicative of performance in this area:

While not a large number, this is the second year we have experienced reductions in PV prison sentences.

Briefly describe the impact and, if negative, how it was addressed. In response to the opiod epidemic in our region, starting in the Pre-Trial phase, new felony offenders are targeted to participate in our Drug Court program as well as any other diversion practices the prosecutor deems appropriate. WIth education and awareness of addiction and available resources provided by our CCAB, Judges as well as DOC Agents are taking advantage of new practices available and diverting those who traditionally would remain in circuit court as a violator, but are now allowing them to participate in availalble diversion programs. This is having a positive impact on not only our Violators, but our overall PCR.

4. What steps will you take if you find that you are not meeting your objectives or your strategies are not being implemented as planned? Program utilization will be monitored on a constant basis by manager. If any underutilization of programs occur, staff will take steps to increase participation as well as encourage DOC staff to utilize our programs. If goals are not being met, CCAB Manager will discuss with CCAB what steps they want to take to address any problems. Also manager will meet with Judges, DOC Supervisor and Prosecutor to address changes/needs to encourage our alternative options to prison. Manager also contacts grant coordinator often about program objectives and utilization. Manager has always worked closely with the OCC staff in Lansing to address any changes needed.

This will allow to them to remain employed, participate more fully in their court case, and be supervised in the community instead of jail. (NEW 3. C01-MRT - Increase referrals from DOC agents to MRT and PRS. Meet a minimum of montly with DOC staff and Judges to remind and encourage them to refer offenders to CCAB staff in lieu of a formal probation violation. Also , if an offender is before a Judge for a formal violation, instead of sentencinging an offender to jail or prison, encourage Judges to order MRT or PRS. While under Pre Trial supervision- violators can be recommended by staff to the prosecutors for participating in Drug Court. Drug Court can be offered to those already on felony probation who are arrested for a new felony drug related crime. Thus resulting in a diversion from a possible PV prison sentence as well as a new offence prison sentence.

Pre-Trial Services, MRT. Target offenders right from arrest during the pre-trial phase, place them in treatment up to and including PRS, make recommendations to Prosecutor about offenders ability to be supervised in the community. Supervise offenders very closely while in the pre-trial phase to ensure compliance to bond condition and if violations occur, address them immediately in hopes of any further violations occuring. Drug Court- Once offenders have successfully completed this program, they will have been given a very long sober period, employment, intensive substance abuse counseling, and healthy lifestyle tools. This will directly reduce recidivism.

C: COMPAS Criminogenic Needs Profile 1. Please list the top 3 needs scales as identified within the COMPAS Criminogenic Needs and Risk Profile provided by OCC

or as presented by your local needs data. Additionally, present both the local and OCC strategies that will impact theidentified needs scales: Needs for all three counties were averaged together to compile the top three due to the lownumbers of offender data in Antrim (3) and Leelanau(1).1. Substance Abuse:

LOCAL STRATEGIES: Clients are assessed by NMRE our local PIHP for any SUD levels. Clients are placed in the appropriate treatment recommended. Our local PRS facility is used for almost all male offenders. If they complete Residential Treatment they then step down to the PRS facility and participate in outpatient treatment including MRT.

OCC FUNDED PROGRAMS: I24 CBCM, I25 Gatekeeper, F23 Pretrial, D23 Intensive Supervision/Drug Court, DDJR Funding. C01MRT

Gatekeeper identifies which programs offenders are eligible for, Pre trial offenders can be sent to residential treatment or PRS during this phase with the recommendation of Pre Trial Officer to the court- case is paused until treatment is completed. D23 Drug Court, those with a drug problem participate in this intensive supervision program addressing all their needs. DDJR- Manager screens all OWI 3rd offenders participating in Sobriety Court for eligibility of PRS, MRT, CBCM and supervises offenders while in those programs. 2. Non- Compliance History:

OCC FUNDED STRATEGIES: MRT- This program targets a change the thinking patterns involved in criminal behavior. 3. Criminal Involvement:

OCC FUNDED STRATEGIES: MRT- Targets the cognitive thinking patterns of offenders. NON OCC FUNDED PROGRAMS: Our counties fund treatment for Theft related convictions, Domestic Violence &

Other violent behaviors as well as TREM (which targets Trauma for females) which is typically funded by NMRE (PIHP). Offenders are placed in whichever program correlates to their needs.

2. Provide information regarding policies, procedures, program operations, pertinent issues or opportunities whichemerged, or other factors which have positively/negatively affected the achievement of objectives--for example, localchanges regarding early jail release, implementation of required program fees, stakeholders--CCAB manager or staff,judges, magistrates, prosecutor, sheriff, contractor/service providers. Briefly describe the impact and, if negative, howit was addressed. Manager now participates in the CJCC, Is on the panel for Substance use coalitions in both GrandTraverse and Leelanau, she also advocates for better SUD treatment and processes by the local PIHP as a BoardMember of the regions CMH. These involvements are all educating local stakeholders and policy makers in our regionand having a positive impact.

3. What steps will you take if you find that you are not meeting your objectives or your strategies are not beingimplemented as planned? I will discuss with my CCAB what steps they would like to take. Work with my grantcoordinator, Judges and local MDOC staff.

D: Local Vocational/Educational Initiatives Please explain in detail what is being done locally to address the local vocational/employment needs of offenders. Include both local and OCC funded initiatives. We have no OCC funded programs in this area. Our local Michigan Works program is well run and offers many programs and assistance to offenders to help them obtain employment. CCAB staff also works very closely with their CBCM participants to help them obtain employment. They assist with resumes, job applications, interview

techniques and can also provide transportation to job interviews as needed. Goodwill Industries of Northern Michigan also has a Work Skills training program. Offenders are referred for training and once complete Goodwill will place them in a paid position.

E: Local Initiatives to Address Persons with Substance Use Disorder(s) Please explain in detail what initiatives are in place to address offender substance abuse needs. Include both local and OCC funded programs. CCAB Manager is a participant in coalitions in both Grand Traverse and Leelanau Counties which are targeting the Opioid epidemic. Manager also participated in 2018 with several local agencies to develop programs and policies which are geared to creating a "Systems Map" of treatment and resources available in our local 5 county region. Our Drug Court was created in response to the Grand Traverse Drug Free Coaltion. CCAB staff are always updated with programs and treatment facilities available in our area and throughout the state. In Grand Traverse County there are numerous agencies, therapists and programs available for offenders to receive the care they need. Grand Traverse county agencies also serve Antrim and Leelanau for those needs. Manager was assigned to serve on our 6 county Community Mental Health Board in March 2019, this board is under the umbrella of the local PIHP, therefore Manager has conversations with the PIHP and it's board memebers on a regular basis to address issues or problems in our region with Substance Use Treatment. Our CCAB has never requested funds for Substance Abuse because we have such valuable resources available to us.

F: Other Local Initiatives 1. Present any local priorities such as development of criminal justice coordinating councils, Specialty Courts, public

education, etc., which have not been identified in the above sections, but have an impact on the performance indicators:Grand Traverse County implemented a CJCC in 2018 after a lengthy delay in the creation of it. Manager attends thosemeetings and is an active participant in discussions in regard to our local Judicial organization. While this CJCC is in GrandTraverse County, our Judges and Court systems serve all three counties, therefore the processes in these areas can havea positive effect for all three counties. For example at our last meeting issues regarding Bond were discussed, managerwas able to provide information in regard to our Pre Trial process and then take the issues identified back to the Judgesand Court administrators who will need to make adjustmens and/or address the problems identified.

2. Please explain how the Comprehensive Plan, in coordination with the above Local Initiatives, will impact the State BoardPriorities, and ultimately offender success: The Comprehensive Plan provides us the opportunity to administer our OCCfunded programs, as well as arrange opportunities for offenders to participate in local initiatiatives not funded by OCC,which are numerous. We are fortunate to have a fairly "rich" area in treatment options, public interest and support.The Comprehensive Plan enables us to fill the programs that aren't provided in the community and that work is done bystaff who are funded by the Grant. Each of the programs we have, directly target the state board priorities of reducingprison commitments and violations. Our Judges support the programs we have and know that these services cannot beprovided anywhere else in our legal system. We have developed a good system using OCC resources fiscally responsibly,as well as local initiaves to create individualized plans for each of our participants. Those plans target the direct needs ofeach person and address their addictions, criminal thinking/activites, education needs and life skills, thus creating asituation where they can be successful. Our Community Corrections department and staff are often the first line inaddressing needs when the Judges don't know where to place someone for the help they need. We have always beencreative and problem solving when given numerous difficult situations. Our goal is to address any need presented by thecourt and arrange resources to offenders who no one else is serving in those areas.

felon, and also not a large difference in misdemeants.

Leelanau county there was an increase in all categories except for sentenced misdemenanants which decreased by 1. The numbers in the jail as a whole are very very low, most days showed less than 6 or7 offenders per category in the jail.

Grand Traverse had the most increases, particularly in unsentenced felons of 22. Because I am using snapshot data, I feel one of the days I used (first of April) really skewed the data, as there had been over 20 new felons that week arrested, when normally we have 5 or 6. I do an avergage of the whole year, so there is an increase even taking that one months data out, but it would be more in line with 10 for the increase. Interestingly there has been a very large decrease in sentenced misdemenanats, I don't have data for that reason.

V. Appointing MERS as the Plan Administrator

The Employer hereby agrees to the provisions of this MERS Hybrid Plan Adoption Agreement and appoints MERS as the Plan Administrator pursuant to the terms and conditions of the Plan. The Employer also agrees that in the event of any conflict between the MERS Plan Document and the MERS Hybrid Plan Adoption Agreement, the provisions of the Plan Document control.

VI. Modification of the terms of the Adoption Agreement

If the Employer desires to amend any of its elections contained in this Adoption Agreement, including attachments, the Governing Body or Chief Judge, by resolution or official action accepted by MERS, must adopt a new Adoption Agreement. The amendment of the new Agreement is not effective until approved by MERS.

VII. Enforcement

1. The Employer acknowledges that the Michigan Constitution of 1963, Article 9, Section 24, provides that accrued financial benefits arising under a public Employer’s retirement plan are a contractual obligation of the Employer that may not be diminished or impaired, and prohibits the use of the Employer’s required current service funding to finance unfunded accrued liabilities.

2. The Employer agrees that, pursuant to the Michigan Constitution, its obligations to pay required contributions are contractual obligations to its employees and to MERS and may be enforced in a court of competent jurisdiction;

3. In accordance with the Constitution and this Agreement, if at any time the balance standing to the Employer’s credit in the reserve for employer contributions and DB benefit payments is insufficient to pay all service benefits due and payable to the entity’s retirees and beneficiaries, the Employer agrees and covenants to promptly remit to MERS the amount of such deficiency as determined by the Retirement Board within thirty (30) days notice of such deficiency;

4. The Employer acknowledges that the DB wage and service reports are due monthly, and the employee contributions (if any) and Employer contributions are due and payable monthly, and must be submitted in accordance with the MERS Enforcement Procedure for Prompt Reporting and Payment, the terms of which are incorporated herein by reference;

5. The Employer acknowledges that employee contributions (if any) and employer contributions must be submitted in accordance with the MERS Enforcement Procedure for Prompt Reporting and Payment, the terms of which are incorporated herein by reference;

6. The Employer acknowledges that late or missed contributions will be required to be made up, including any applicable gains for the Defined Contribution portion of Hybrid, pursuant to the Internal Revenue Code;

7. Should the Employer fail to make its required contribution(s) when due, the retirement benefits due and payable by MERS on behalf of the entity to its retirees and beneficiaries may be suspended until the delinquent payment is received by MERS. MERS may implement any applicable interest charges and penalties pursuant to the MERS Enforcement Procedure for Prompt Reporting and Payment and Plan Document Section 79, and take any appropriate legal action, including but not limited to filing a lawsuit and reporting the entity to the Treasurer of the State of Michigan in accordance with MCL 141.1544(d), Section 44 of PA 436 of 2012, as may be amended;

8. It is expressly agreed and understood as an integral and non-severable part of this Agreementthat Section 43 of the Plan Document shall not apply to this Agreement and its administration orinterpretation. In the event any alteration of the terms or conditions of this Agreement is made oroccurs, under Section 43 or other plan provision or law, MERS and the Retirement Board, as soletrustee and fiduciary of the MERS plan and its trust reserves, and whose authority is non-delegable,shall have no obligation or duty to administer (or to have administered) the Hybrid Plan, to authorizethe transfer of any assets to the Hybrid Plan, or to continue administration by MERS or any third-partyadministrator of the Hybrid Plan.

If action is not taken ASAP, we will not have the radio until late fall. The radio can be utilized for events scheduled throughout the County all summer.

I. Grant Purpose(s)

Funds provided by the Great Lakes Energy People Fund (GLEPF) will be appropriately accounted for and usedfor the purposes described in your proposals within the grant period listed above. The conditions of the grant andthe expenditure of funds may not be modified without the written approval of the GLEPF.

II. Nondiscrimination

The Antrim County Office of Emergency Management coordinates federal, state, local, voluntaryand private resources during emergencies and disasters. The department also addresses allnecessary state and federal county requirements as directed by the Department of HomelandSecurity.Further, we provide support to our local fire, ems and police forces as requested.

biggest issue for us with any event, large or small; planned or emergency. With so many areas of the County getting limited to no cell phone reception, alternatives need to be promoted. While our fire departments utilize VHF communications, law enforcement and EMS utilizes the State’s 800 MHz system. The County is starting to make the conversion to 800 MHz radio’s for the fire departments, but this program will take 2-3 years and several million dollars to complete.

Antrim County Emergency Management is working to grow its 800 MHz radio opportunities for use at emergency and planned events. It is our intent to build a cache of 10 radios to be utilized by volunteers, firefighters and non-profit event hosts. When not in use for events, the radios will serve in training and exercising our first responders and volunteers.

To do this, we are in need of an additional 6 radios. Each radio costs $1750 plus a $250 activation fee. Emergency Management hopes that the People Fund will assist us by sponsoring one radio at a total cost of $2000.

To authorize the Board Chairman to execute the State of Michigan FY 2018-2019 Hazardous Materials Preparedness (HMEP) Planning Program Grant Agreement (CFDA Number: 20.703, Grant Number: HM-HMP-0558-16-01-00) for an amount of $2,500.

2. Background and Current Situation – Concisely include pertinent facts, dates, etc.

Each year, each emergency management program in the state is invited to apply for the Hazardous Materials Emergency Preparedness Grant program. The total money to be allotted is not known until the end of the year and is dependent on the amount of applicants and the amount of sites deemed hazardous in the governmental emergency unit. We receive somewhere between $1000 and $2000 each year. Historically, this grant is income into the LEPC (Local Emergency Planning Commission) budget – 101-287. The funds are used for our full-scale exercises. Last year was $1900

3. Goal – Why the action is necessary; What is the specific target or outcome desired?

The application is due June 25, 2019. Without the funds, additional general fund dollars will be needed to fund county training and exercise.

4. Financial – Budget-related information

I will perform the tasks associated with the grant whether we receive it or not. The tasks now include loading all hazardous sites into a program that is compatible with the MCTs. Before last year, all information was stored in notebooks. When complete, all files are available to all emergency service agencies in the County.

This is a yearly grant. Review of the original agreement was performed and nothing has changed in that time besides the amounts awarded, the total awarded from the feds and the due dates.

Submit grant and begin review and input of data beginning spring of 2020. I am currently doing this for the 2019 grant. Submissions of info to State are due in July 2019 from last year's grant.

Failure to approve will result in no funds for 2020 but work will still be completed as it is important emergency preparedness information for use by all emergency responders.

It has been very costly to fix. We have received three bids, and Captain’s Choice Marine was the best price for both motors for a total cost of $29,343.12. The other bids were: Irish Boat Shop $36,131.72 and Dewitt Marine $37,659.06. 3. Goal – Why the action is necessary; What is the specific target or outcome desired? Marine motors are costly to repair and have spent good money on old motors. The goal is to keep a reliable fleet of vessels from which to run the Marine Patrol Division of the Sheriff Office. 4. Jan Clark was the employee whom I was requesting on behalf of because I felt that her hourly rate was not at all appropriate for her job responsibilities and was not at all in line with the food service coordinator position. This position is the one that steps in whenever the food service coordinator is not available It is responsible for ordering food and supplies, ensuring that all of the daily meals are prepared in compliance with ServSafe procedures and are ready to be delivered and served at the appropriate times – keeping with our published schedules. Now that I have a vacancy in the kitchen, I intend to fill the cook position (as classified in the collective bargaining agreement) rather than the assistant cook position, as it better represents the duties and responsibilities required. However, a budget adjustment is needed to do so. 3. Goal – Why the action is necessary; What is the specific target or outcome desired? To attract and keep high-caliber, qualified, experienced, and desirable employees who deserve to receive an hourly wage that will provide life essentials for their families. Since our full-time assistant cook (Jan Clark) accepted the position that was vacated (food service coordinator) by Paul Tate (who took a very similar job with Charlevoix County that offered higher wages, better benefits, and more growth opportunity), her position is now vacant, and I intend to advertise the opening with the, more appropriate, cook’s starting wage of 13.12 per hour which already exists on the General Unit – 2019 Wage Scale. 4. Financial – Budget-related information We cannot afford NOT to do this. I am requesting the additional funds be put into the “Other Wages” line items for both the Congregate Meals (672) and the Meals on Wheels (674) departments of the COA fund as this position serves both functions. Fund Balance is adequate to maintain the request, but I have not yet had a chance to run and confirm the exact amount with Deb Haydell. 1. Action Request/Suggested Motion To authorize the Board Chairman to sign a revised easement agreement with Consumers Energy, which will supersede the easement adopted on December 13, 2018, amended February 7, 2019, and dated February 28, 2019, to install electric service for the Dam Beach and Fishing Park Restroom Facilities.

2. Background and Current Situation – Concisely include pertinent facts, dates, etc. In 2018, the County was informed that the Village of Elk Rapids was interested in constructing a bathhouse at the “Dam Beach” on the property they lease from the County. The County approve letter of support for the grant application on May 10, 2018. In December of 2018 the Board of Commissioners approved the following motion:

It was moved by Smith, seconded by LaVanway that the Board authorize the Board Chairman to sign an easement agreement with Consumers Energy to install electric lines for the Dam Beach and Fishing Park Restroom Facilities, contingent upon civil counsel’s review and provided the lines are installed underground. Motion carried as follows: Yes – Heeres, Zelenak, Bargy, Boettcher, Smith, Ricksgers, LaVanway, Helwig, Marcus; No – None; Absent – None.

We later learned that Consumers Energy was unwilling to put all of the power lines underground and on February 7, 2019, the motion was amended and the following was approved:

It was moved by LaVanway, seconded by VanAlstine, to amend the motion previously adopted on December 13, 2018 to now read, that the Board authorize the Board Chairman to sign an easement agreement with Consumers Energy to install electric lines for the Dam Beach and Fishing Park Restroom Facilities. Motion carried as follows: Yes – Heeres, Watrous, Bargy, Boettcher, VanAlstine, Ricksgers, LaVanway, Helwig, Marcus; No – None; Absent – None.

After the easement was approved and signed by the Board Chair, Consumers Energy ran into problems with the adjoining land owners and was forced to change the easement to the current proposed version. The language and the total length of the easement is the same. However, instead of 164’ of overhead power lines there will be 199’ of overhead power lines - the balance of the 524’ total feet of power lines in either scenario will be buried underground.

May 31, 2019 TO: Antrim County Board of Commissioner FR: Peter Garwood, Administrator RE: Administrator’s Report – June 6, 2019 ADMINISTRATION RELATED MATTERS:

1. Zettel vs Antrim County: As was mentioned in a past Administrator Report the plaintiff had

filed a motion for reconsideration of the Court’s original decision dismissing the County Treasurers in Counts II and Ill of plaintiff's Complaint. The Court rendered a Decision and Order Denying Plaintiffs' Motion for Reconsideration on April 26, 2019. As mentioned in a past report, Count I remains until a case at the Michigan Supreme Court is decided. A second motion to dismiss has been filed. The hearing is scheduled for June 14.

2. Northern Lakes Economic Association (NLEA) Formula Discussions: A meeting was held on

April 22 which included the representatives of each of the member counties and representatives from Emmet County at which all parties agreed to a tentative arrangement for Emmet County to rejoin the NLEA. The NLEA Board met on May 7 and approved the agreement. Emmet County met on May 23 and approved one but not both provisions of the ad hoc committee’s tentative agreement. They approved rejoining the NLEA for the remaining months of 2019 but not the provision that would have provided a commitment for the remaining three years. Both provisions together reflected the complete tentative agreement reached between the representatives of all four counties and the NLEA. Based on their action, Emmet County is not a member of the NLEA.

3. Street & Road Numbering Ordinance Amendment: The 911 Board made a recommendation to the Board of Commissioners that the Ordinance be amended to allow for vacant lots to be assigned an address upon request. A meeting will be held on June 5 with the Sheriff, 911, the Road Commission, Equalization, Building Department, GIS Technician, and me. I have also invited Scott Kendzierski from the Health Department. The group will review the information and a recommendation will be generated for Board action likely for the second meeting in June or one of the meetings in July.

4. Committee Appointment Policy: Although discussion has taken place on this issue, no time has been dedicated to this issue as of yet.

5. Warner Township - Corridor Improvement Authority: Nothing new to report, but have left in the following overview: With assistance from the NLEA, Warner Township is teaming up with Elmira Township to establish a “Development Area” under the Corridor Improvement Authority Act. The proposed Development Area includes: Parcels at the intersection of US-131 and M-32 (west toward Charlevoix) and along US-131 south to the intersection of US-131 and M-32 (east toward Gaylord). Additional parcels are included headed east on M-32 to the corner of Ray Street and M-32. Sherry Comben, Treasurer, and I have been reviewing the proposed map along with the statute. Once the Townships create a plan, which will likely include capture of Antrim County ad valorum taxes, the County will be notified. We will have a sixty- (60) day window to respond. At that point, in accordance with County policy, I will bring a recommendation to the Board to opt out of the tax capture district. Once we have negotiated a Tax Sharing Agreement with the Township, I will recommend action to approve an agreement with the Township and take action to opt back in the tax capture plan.

6. Insurance for Police Car Equipment: I have sent an email of inquiry to our insurance representative, but have not heard back yet. However, I recently was at the county administrators’ conference and asked the other administrators during our idea exchange session, and they were all under the impression the equipment was covered. I will let you know what I find out for my next report.

7. Michigan Association of County Administrative Officers (MACAO) Conference: I attended the MACAO spring conference held at Crystal Mountain Resort from May 22 – 24. Sessions included Positivity in the Workplace, Specialty Courts, Liability & Inmate Medical Care, Legislative Update, Cybersecurity Overview and Protection Best Practices. I reviewed my notes on the cyber security session with Valerie Craft, IT Director, and was happy to find out that, by and large, we have purchased and are operating the proper equipment and are performing what is considered appropriate functions toward best practices.

8. Fee Structure for GIS Data: Julie Weston is currently reviewing information I have received from various counties. It is anticipated an update will be available for the July 18 or early August Board meeting.

9. First Rights of Refusal: The County Treasurer has provided my office with a list of tax foreclosed properties. After review, if there are any properties which are identified as potentially beneficial to the County, a recommendation will be brought to the Board.

10. Vehicle Policy Administration: A retired Sheriff Office vehicle was sold on GovDeals in the amount of $800.00. Another vehicle is currently still out for bid.

HUMAN RESOURCES RELATED MATTERS:

1. County Employment Opportunities: The bulletin board outside the HR Office lists the current openings at the County.

− COA Homemaker and Certified Nursing Assistant (CNA) – PT: Continuing to recruit. − COA Clerk II – FT: A second round of interviews was held on May 29. − Sheriff Marine Patrol – Seasonal: Janet Schwenzer, Kayla Moore, Tanner Plumb, John

Leach, and David Lewis have been hired. Training is beginning for the new hires. - Barnes Park Attendants – Seasonal: Seeking one more candidate. - COA Kitchen Assistant – PT: Pre-employment screening is taking place. - Plumbing Inspector – FT: The Building Official is hoping to contract with someone to

cover the responsibilities. Filling the position is currently on hold. - Animal Control Officer – FT: Pre-employment screening is taking place. - Elk Rapids Day Park Attendant – Seasonal: Robert Jones has been hired. - Airport Maintenance – Seasonal: Charles Dickenson has been hired.

2. Employee Trainings/Workshops: Two “lunch and learns” have been scheduled for June:

a. June 13: Tom Jordan with the Municipal Employees Retirement System (MERS) will be presenting on MERCER, a new health exchange available to MERS retirees. He will also cover the Health Care Savings Plan (HCSP) available through MERS.

b. June 25: Rob Joyce with Edward Jones will be presenting on using IRAs as an investment tool.

3. Employee Handbook: The handbook was distributed to department heads and elected

officials for their feedback. The deadline for their responses is May 31. If all goes as planned, it will be ready for release to the Board in June and potentially on the Board agenda for action in July.

4. Sheriff Office - Command Unit Contract Negotiations: The Fraternal Order of Police (FOP) has

officially filed for arbitration. In the meantime, we are in the process of scheduling mediation for the afternoon of June 10 (The mediator has booked the date, we are waiting on the union to confirm.). In the meantime, conversations continue between the Human Resources Director and the FOP Business Representative regarding outstanding issues.

HEALTH & PUBLIC SAFETY RELATED MATTERS:

1. Michigan Indigent Defense Commission (MIDC): The FY 2020 compliance plan and budget for 2020 were submitted on May 15. Deb Haydell, Finance Director worked on the budget with me and Carol Stocking, District Court Administrator was a big help on the content. I have included a request for additional funds to hire an “attorney/administrator” to take over the functions of overall administration of the program. The financial obligation of the County remains the same as last year plus 2.2%

2. Sheriff - Short-term Rental: Banks Township has drafted an agreement between the Township and the County Sheriff Office for the Sheriff’s assistance with concerns that might arise from allowing short-term rentals in the Township. It is still in the Township's court.

3. Local Emergency Planning Committee: On May 14, the Committee (I am a member) toured

the Jordan River Fish Hatchery.

4. Gift of Life Agreement: A communication from Gift of Life Michigan was received requesting approval of an agreement with the County and medical examiner to facilitate organ and tissue donations. This matter will be brought to the Board once I have thoroughly reviewed.

BUILDINGS, LAND, & INFRASTRUCTURE RELATED MATTERS:

1. Veterans Affairs Office Move to Old Equalization Office: Due to my attendance at the MACAO conference, I have not had an opportunity to address this matter. An update will be provided at the July 18 Board meeting

2. Facility Master Plan Update: Networks Northwest will be presenting the report on the Facility Master Plan surveys at the June 20 Board of Commissioners meeting.

3. County Building Security: As a result of recent walkthroughs of the County Building with

Commissioner VanAlstine and me, we have received one quote thus far. As quotes are received, they are being evaluated by myself, the Maintenance Director and the IT Director. Chris Corbett has indicated he will be providing information to my office by June 10.

4. Cairn Monument: A three-way agreement to be signed by Milton Township, Antrim County,

and the Road Commission will be drafted at some point.

5. Elk Rapids Day Park Fence: The gate is open as of May 21.

6. Bank Building Demolition: The demolition project has been advertised as follows: The Antrim Review and Elk Rapids News on May 30, Traverse City Record Eagle on May 25, and the Petoskey News on May 31. Information was also sent to Builders Exchange and posted on the County website. Additionally, five local contractors were supplied with the specifications. The deadline to submit bids is June 12 at 4:00 p.m. Since the RFP was sent out I have had a couple of contractors indicate they will not be submitting a proposal because we have not had an asbestos and lead study completed (in the RFP it is required that they do the study - this is the way the insurance adjuster wanted it structured). Since then, the insurance adjuster arranged for ServPro to do a study as quickly as they can.

7. Chain of Lakes Hydrology Study: No new information to share at this time.

8. Capital Improvement Plan (CIP): The CIP Committee met on May 30. Projects were reviewed with answers to questions and additional information to be gathered by the Administration Office prior to the next CIP meeting scheduled for June 27.

9. Policy for Use of Grounds: A policy will be drafted and presented for your review at one of the two meetings in September.

10. Antrim Creek Natural Area (ACNA): The ACNA Commission met on April 24. The programs to be held at the ACNA and conducted by the staff from Grass River Natural Area were approved. The Commission also approved the addition of gravel and grading on both the north and south entrance (which has been completed). On June 7, I will be meeting with Wendy Warren, Antrim Conservation District Executive Director, to discuss/explore the possibility of using their AmeriCorp worker to do some work this summer at the Antrim Creek Natural Area.

11. Consumers Energy – Dam Beach Road Easement Revision: Consumers Energy has informed me there was recently a project re-design due to complications from the neighboring condo association requiring a slightly revised easement from the County in order for the Village of Elk Rapids to proceed with their project. It is on the agenda for this meeting with a recommendation for action.

12. Village of Bellaire Water System: A communication was received by the Village Public Works Supervisor regarding State mandated upgrades to the water mains and lines if determined to have any lead. I will be discussing with the Village the requirements for a water system large enough to handle the County facility’s sprinkler system.

13. Outside Entrance Door Motion Light: Public comment was made on April 18 requesting a motion light be considered at the entrance door used for night meetings. Maintenance Director Dave Vitale is currently exploring. It is anticipated the request will be addressed prior to October when we begin losing light in the evenings.

CONTRACTS/AGREEMENTS: − reviewed by Civil Counsel and/or the County Administrator, − approved by the Board of Commissioners, − and tracked for future follow-up of expiration (where necessary).

1. Lease with North County Community Mental Health for office space commencing June 1, 2019.

2. Chain of Lakes Water Trail Signage Agreement with Paddle Antrim. 3. Agreement with ePaint Recycling to collect, transport, and recycle waste latex paint at three

CIVIL/LABOR COUNSEL REVIEWS: 1. A question from the Sheriff Office pertaining to subpoena for documents vs. FOIA request. 2. Labor counsel addressed potential arbitration and ongoing negotiations.

COMMUNICATIONS, NOTES OF INTEREST:

1. Active Assailant Exercise: The date of the Exercise is June 19, 2019, and is taking place at Central Lake High School with the first session to begin at 9:45 a.m. The second session is scheduled for 12:30. Please contact Leslie Meyers ASAP if you are interested in participating in some capacity.

2. AT&T Cell Coverage Improvement: I was contacted by and had a conversation with a representative for AT&T looking to possibly use and/or improve County facilities to locate a new antenna to improve their cell phone coverage in the Bellaire area. There is nothing new to report at this time.

3. Supreme Court Administrative Order 2019-1, Establishment of Court Security Committees: This

order requires that a chief judge be designated by consensus (of the judges) to establish and chair a standing courthouse security committee. There is nothing new to report at this time.

4. Vacation: I will be on vacation from June 14 – 23. Please contact my staff if they may assist you prior to my return to the office on June 24. I will not be in attendance at the June 20 Board meeting. Travis along with Tina and Margie will be available to answer any questions you may have that evening.
