Editorial
Promotion Panels & Court Orders
Promotion panels of Assistant Executive Engineers, Executive
Engineers in our department for this year 2020-21 are not approved
citing various Court Cases and Court Orders. Even though estimate of
vacancies of these panels are approved in right time, Court Cases /
Orders become a hurdle in the approval. The case of giving merit based
or roster based promotion divides our member Engineers and the
Government still unable to take a concrete decision in this issue.
The ultimate sufferer in this issue is our member Engineers who
are holding more additional charges and many of them who are not able
to get their promotion in due turn. Even route to temporary promotion
is blocked citing Court case (Stay Order). It is unclear whether the
Government or Court will alter their position in near future. We once
again appeal to those involved in these Court Cases to solve this issue
by accepting temporary promotion in this year.

Minutes of the Urgent Central Executive Committee Meeting of AOE & AEA held on AOE & AEA office premises via “Google Meet app” 10.10.2020.
An urgent Combined Central Executive Committee Meeting of Association of
Engineers and Assistant Engineers’ Association was held on 10.10.2020 by about
10.35 AM via “Google Meet” app streaming from our Association office premises,
Chepauk, Chennai-5 to discuss the following subjects.
1) Opposing Employment of retired Engineers/Bureaucrat in the “Tamil Nadu Water Resources Conservation and Rivers Restoration Corporation”
2) VIIth Pay Commission – present Stage of PGRC. 3) Court Cases with respect to Promotion of Assistant Engineers to Assistant
Executive Engineers
4) Promotion panel of Executive Engineer, Superintending Engineer and Chief Engineer.
5) Any other Subjects. The meeting was presided by Er.K.Prabakar, President, AOE, the President
invited Er.K.Murugan, GS, AOE, to brief the members about the subject agenda.
Er.K.Murugan, GS, AOE and Er.M.Dhanasekaran, GS, AEA explained the members
about the subject agenda. The President, AOE invited CEC members to speak in

Er.M.Suganthi, Secretary, ENGIBEF, AOE briefed the members about the enrolment of members in the 5th Phase of ENGIBEF and the active interest shown by the branches in this regard.
She also requested all the CEC members to enroll more members in this scheme so as to increase the benefit to the family of deceased Engineers. Er.P.N.S.Mahesh Babu, Resident Engineer, PRI informed the CEC about the ongoing external plastering in one side of PRI building which was exposed due to the demolition of nearby building. He requested all the CEC members to collect the building fund for PRI, so as to improve the facilities in PRI and refund the loan obtained from ENGIBEF. After the detailed discussion the following resolutions were passed unanimously.
1. Resolved to request the Government to disband the “TN Water Resources Conservation and River Restoration Corporation” which is employed by retired bureaucrat / Engineers and which causes additional financial burden to the Government. To obtain external funding, a separate wing under a serving Chief Engineer may be created as Chief Engineer “External Aided Projects” and services of in service Engineers are utilized in this wing.
2. Resolved to meet Hon’ble Chief Minister of Tamil Nadu and request to implement 7th Pay Commission Pay Scales to our Engineers equivalent to the present Pay Scales receiving as per Court Orders.
3. Resolved to appeal to the Government to take effective steps for approval of Promotion Panel (2020-21) of Assistant Executive Engineer, Executive Engineer and Superintending Engineers in Public Works Department. Er.A.Abdul Khudus, President, AEA proposed vote of thanks on behalf of

ORDER:
In the letter read above, the Engineer-in-Chief, Water Resources Department and Chief Engineer (General), Public Works Department has stated that the scheme Inter-Linking of Cauvery - Agniyar - South Vellar - Manimuthar - Vaigai - Gundar Canal was prepared for “Peninsular River Link Surplus’ by the National Water Development Agency of the Government of India. Under this scheme, a barrage was constructed during 2014 across the river Cauvery in Mayanur village of Karur District. It is now proposed to construct a flood carrier canal taking off from the downstream of this barrage to divert the flood water of the river Cauvery to South Vellar river. 2. He has further stated that in G.O.(Ms.)No.101, Public Works Department, dated 27.04.2020, the Government have accorded sanction for acquisition of 572.56.0 hectares of patta lands and transfer of 83.80.0 hectares of Poramboke lands in Pudukkottai District for the formation of a Flood Carrier Canal from Cauvery (Kattalai) to South Vellar river to divert the flood water for the benefit of the drought prone area. 3. For carrying over the above work the Engineer-in-Chief, Water Resources Department and Chief Engineer (General), Public Works Department has proposed to form a Division at Kulithalai under the control of Superintending Engineer, Special

Project Circle, Trichy under the control of the Chief Engineer, Trichy Region, Water Resources Department by redeploying the Thervaikandigai Reservoir Project Division, Thiruvallur along with its Sub Division No.II, III and IV at Thiruvallur to Kulithalai. He has also proposed to attach the Sub Division No.I at Thiruvallur to Kosasthalaiyar Basin Division at Thiruvallur for carrying over the remaining works and maintaining the records and files pertaining to Thervaikandigai Reservoir Project Division, Thiruvallur. The Engineer-in-Chief, Water Resources Department and Chief Engineer (General), Public Works Department further informed that the expenditure towards shifting of offices can be met out from the available budget provision under respective office contingencies. Hence, no additional funds and no additional staff will be required. The Engineer-in-Chief, Water Resources Department and Chief Engineer (General), Public Works Department has requested the orders of the Government on the above proposals. 5. The Government after careful examination of the proposals of the Engineer-in-Chief, Water Resources Department and Chief Engineer (General), Public Works Department, decided to accept them. The Government accord sanction for the formation of Special Project Division at Kulithalai, under the Control of Chief Engineer, Water Resources Department, Trichy Region for carrying over the work of formation of a Flood Carrier Canal, from Cauvery (Kattalai) to South Vellar river, to divert the flood water for the benefit of the drought prone area, by redeploying Thervaikandigai Reservoir Project Division, Thiruvallur along with its Sub divisions No.II, III and IV at Thiruvallur from the Thervaikandigai Reservoir Project Division, Thiruvallur and attach it to Kosasthalaiyar Basin Division at Thiruvallur, for carrying over the remaining works, maintaining of the records and files pertaining to Thervaikandigai Reservoir Project as detailed in the Annexur I, II and III to this order, subject to the condition that revival / creation of any division for Thervaikandigai Reservoir Project, Thiruvallur will not be entertained. 6. This order issues with the concurrence of Finance Department - vide its U.O.No.26543/Fin(PW II)2020, dated 19.082020.

ORDER: In the Government Order first read above, sanction was accorded for
further continuance of 3129 numbers of various temporary posts, in the
Division Establishments of the Water Resources Department for a period of
three years from 01.01.2016 to 31.12.2018, subject to the condition that the
posts which were kept vacant for more than two years should be filled up only
after obtaining the approval for revival of the posts from the Government.
2. In the letter fourth read above, the Engineer-in-Chief, Water
Resources Department and Chief Engineer (General), Public Works
Department, Chennai has sent a proposal for filling up of 87 numbers of
temporary posts of Assistant Engineer (Civil) that were not continued in the
Division Establishments of the Water Resources Department. He has also

stated that in Government Order first read above, continuance had not been
sanctioned for 96 numbers of posts of Assistant Engineer (Civil), since the said
posts were kept vacant for more than two years.
3. In the Government Order second read above, among others, sanction
has been accorded for further continuance of 7 numbers of posts of Assistant
Engineer upto 31.12.2021. In the Government Order third read above, among
others, sanction has been accorded for 2 numbers of posts of Assistant
Engineer that were erroneously included in the list of posts vacant for more
than two years in the Government Order first read above.
4. The Engineer-in-Chief, Water Resources Department and Chief
Engineer (General), Public Works Department, Chennai has also stated that
the Tamil Nadu Public Service Commission vide its Notification No.18/2019,
dated 29.05.2019, has, among others, invited for applications for direct
recruitment of 129 numbers of posts of Assistant Engineer (Civil).
5. The Engineer-in-Chief, Water Resources Department and Chief
Engineer (General), Public Works Department, Chennai has therefore,
requested permission to fill up the 87 numbers of temporary posts of Assistant
Engineer (Civil) in various Divisions in the Water Resources Department.
6. While the above proposals is under consideration of the Government,
the Engineer-in-Chief, Water Resources Department and Chief Engineer
(General), Public Works Department, in his letter fifth read above has stated
that appointment orders have already been issued to the candidates allotted
by the TNPSC ON 04.02.2020 and joined duty in Sections where they had been
posted which includes the 87 numbers of Assistant Engineer temporary posts
in the Division Establishment of Water Resources Department. He has further
stated that the above said posts are essential as the Government have
accorded sanction for construction of 11 numbers of new Medical Colleges and
Hospitals in the various districts of the State and also in anticipation of

essential works to be carried out in the newly bifurcated districts and for
carrying out the Kudimaramath works in Water Resources Department. He has
further stated that many Assistant Engineers of Water Resources Department
are diverted for carrying over the medical works related to COVID-19. He has
therefore, requested the Government to ratify his action of having filled the 87
numbers of temporary post of Assistant Engineers in Water Resources
Department.
7. The Government after careful examination have decided to accept the
proposal of the Engineer-in-Chief, Water Resources Department and Chief
Engineer (General), Public Works Department, Chennai. Accordingly, sanction
is accorded for revival of 87 numbers of temporary posts of Assistant Engineer
(Civil) in the Division Establishments of the Water Resources Department as
detailed in the Annexure to this Order, for filling the said posts, which are
essentially required at present. The Government also ratify the action of the
the Engineer-in-Chief, Water Resources Department and Chief Engineer
(General), Public Works Department in having filled 87 numbers of temporary
posts of Assistant Engineer (Civil) in the Division Establishments of Water
Resources Department in anticipation of revival of such temporary posts
vacant for more than two years.
8. The Engineer-in-Chief, Water Resources Department and Chief
Engineer (General), Public Works Department, is hereby instructed not to take
such precipitate action without orders of the Government in future and prevent
a fait accompli.
9. This order issues with the concurrence of Finance Department vide its
U.O.No.24985/PW-II/2020, dated 09.09.2020.

ORDER:
In the Government Order first read above, orders were issued that the Superintending Engineers of Public Works Department in-charge of execution of Building works, be vested with powers to approve, wherever necessary, of the shifting of the Headquarters of Sub-Divisions and sections in charge of execution of Building works, even when extra expenditure is involved, in relaxation of the provisions of the note in paragraph 59 of the Tamil Nadu Travelling Allowance Rules. It was also ordered that the delegation of powers will be in force for a period of three years from the date of that order and the Superintending Engineers should send a report to the Chief Engineer, Buildings, whenever such changes are affected.
2. In the Government Order fourth read above, orders were issued that the delegation of powers to the Superintending Engineers of Buildings Organisation of Public Works Department for shifting head quarters of sections and Sub-Divisions wherever necessary shall be continued for a further period of three years from 07.08.2011 to 06.08.2014 (inclusive of both days) subject to the recommendations and re-organisation of Buildings Organisation of Public Works Department.

3. In his letter fifth read above, the Engineer-in-Chief (Buildings) and Chief Engineer (Buildings), Chennai Region, Public Works Department, Chennai has
stated that from the year 2014, the necessity of shifting of head quarters / sections did not arises and much at present many new schemes such as
Construction of 11 Numbers of New Government Medical Colleges, Construction of Integrated Animal Husbandry Project at Thalaivasal Cootu Road, Construction New
Collectorate Buildings, etc., have been sanctioned by Government and are under progress. Hence, shifting of Head quarters / Sections have to be done based on
the necessity, accessibility and workload, etc. The delegation of powers to Superintending Engineers of Public Works Department is issued to act swiftly to
change the Head Quarters of Sections / Sub-Divisions according to site conditions so as to avoid extra expenditure to Government.
4. The Engineer-in-Chief (Buildings) and Chief Engineer (Buildings),
Chennai Region, Public Works Department, Chennai has requested orders of the Government for delegation of powers to Superintending Engineers of Public Works Department, Building Organisation permanently for shifting the Head Quarters of
Sub-Divisions / Sections wherever necessary, with effect from the date of issue of Government Order.
5. The Government after careful examination, accept the proposal of the
Engineer-in-Chief (Buildings) and Chief Engineer (Buildings), Chennai Region, Public Works Department, and hereby direct that the powers delegated in the
Government order first read above to the Superintending Engineers of Buildings Organisation of Public Works Department for shifting head quarters of sections and
Sub Divisions wherever necessary will be in force for a period of three years from the date of issue of this Government Order, subject to the recommendations and re-organisation of Buildings Organisation of Public Works Department.
6. This order issues with the concurrence of Finance Department vide its U.O.No.25183/PW-I/2020, dated 08.09.2020.

ORDER: In pursuance to the orders issued in the Government order read above, the following notification will be published in the Tamil Nadu Government Gazette:-
NOTIFICATION In exercise of the powers conferred by the provisio to Article 309 read with Article 313 of the Contitution of India and of all other powers hereunto enabling, the Governor of Tamil Nadu hereby makes the following amendment to the Fundamental Rules and the Instructions thereunder.
2. Amendment hereby made shall be deemed to have come into force on the 23rd day of March 2020.
AMENDMENT In the said Fundamental Rules, in Annexure-VII, under the Executive instructions regarding Casual Leave under ruling (3) under rule 85, under the heading “II. Special Casual Leave”, after rule 14, the following rule shall be added, namely:-
“15. Special Casual Leave for six days in a calendar year shall be grated to Government Servants having children with special needs on production of a supportive document obtained either from the authority competent to issue the certificate of disability under the Rights of persons with Disabilities Act, 2016 (Central Act 49 of 2016) or from a Registered Medical Practitioner attending to the child, certifying that he/she is a special child suffering from disability that requires parental support for daily life activities.”

This Office Lr.No.0065/CPS/2019, Dated 19.08.2020 In the reference 2nd cited, the Government have directed that while sending the Final Authorisation proposal for the CPS subscribers, the Drawing and Disbursing Officers (DDOs) shall submit the proposals with details in the annexures given in the references 1st and 2nd cited (Copies enclosed) along with scanned pages of the Service Register duly attested by the DDOs concerned to ensure the correctness of the particulars of the individual so as to avoid risks in handling the original Service Registers through post/courier.
Consequently, all the HoDs were addressed to issue suitable instructions to the DDOs under their control with a copy marked to the PAOs/DTOs to issue sensitise the DDOs in their Bill Audit control.
However, the DDOs are continuing with the practice of sending proposals for Final Authorisation of CPS for their employees enclosing Service Registers instead of attested copies of Service Registers.
I am therefore to request you to instruct the DDOs under your Bill Audit control to follow the above revised guidelines while sending the Final Authorisation proposal for the CPS subscribers.
You are also requested to inform the DDOs that proposals received along with the original Service Register would not be accepted by this Department and the same will be returned to the sender.
