May 15, 2009 Supervisory Committee of the Mobile County Personnel Board Mobile, Alabama Dear Members: As Chairman of the Personnel Board it is a pleasure to submit on behalf of the entire Board the 69th Annual Report of the Mobile County Merit System as prepared by its Director and staff. The Personnel Board along with Leadership at the Personnel Department had a strategic planning meeting focused on identifying short term and long-term improvement opportunities. Several broad areas of discussion allowed us to bring focus to strategic improvement opportunities designed to improve effectiveness, and decrease process cycle time. Currently, we are facing difficulty with our national economy. Many of our leaders are facing critical decisions to address the rapidly changing economic landscape. The Personnel Board stands ready to partner with all our constituents to ensure a successful outcome as we work through these difficulties. We thank you for your continued support and will continue to look for ways to provide better service. Again, we ask that you constantly engage with us as we work to improve our Merit System. Chairman and Members The Personnel Board for Mobile, County, Alabama Dear Members: 2008 in reflection was a year of highs and tremendous uncertainties. Our local economy

began with news of many promising economic opportunities. However, our national economy has

brought caution to our overall economic outlook. It is increasingly more important to continuously

look at efficient and effective work processes to ensure we are providing a service that adds value.

Over the last two years our training offerings have increased dramatically. Our payroll

department audits and processes in excess of $200,000,000 dollars of combined payrolls annually.

We wish to continue to partner with the jurisdictions to provide these significant services. As you

read on, you will notice we have been able to sustain the gains in productivity realized over the

past two years. Our challenge is to continually improve our service offerings. We are carefully

evaluating those opportunities that will bring a step change in our ability to add value.

We have experienced a slight increase (2%) in the number of applicants this year {7,464 to

7,619}. However, the largest increase in applicants occurred towards the end of 2008. Again, this

is a positive sign and a reversal of the decline seen in 2006.

There were 1,276 examinations (open competitive, promotion) and 1,481 tests (written,

oral, appraisal, demonstration) administered in 2008. These activities, coupled with continued

work with jurisdictions implementing the results of the Condrey study, represent an enormous

amount of activity within our department.

Additional areas of positive results:

• An increase in the number of successful applicants – 4,357 versus 3,736 (~16% increase) • An increase in merit system appointment – 1,248 versus 1,138 (~10% increase) • An increase in number granted veteran’s preference – 345 versus 264 (~30% increase)

PERSONNEL BOARD

At the annual meeting of the Supervisory Committee held June 10, 2008, the Committee re-

elected Mr. A. Earl Broadus as Board Member Number Four to represent Personnel Board District

Four.

Mr. Sydney Raine currently serves as Chairman and Mr. William Bridges serves as Vice-

Chairman of the Personnel Board.

The Board held 12 regular meetings and 18 special meetings during 2008, including 22

meetings at which public hearings were held, for a total of 30 meetings. The Board also held 24

public hearings on disciplinary matters.

HEARINGS ON APPEALS

During the year 2008 the Board held sixteen hearings on appeals from dismissal. The

Appointing Authority was upheld completely in five cases and four dismissals were modified to

suspensions. Five hearings convened and settlement agreements were read into the record. At

two hearings the employee did not appear so the appeals were dismissed for want of prosecution.

The Board rendered two orders that carried dissenting opinions. One decision was appealed to

Circuit Court.

There were five suspension hearings held by the Board. The Appointing Authority was

upheld completely in one case and two appeals were settled during the hearings. In one case the

length of the suspension was altered and one appeal was withdrawn after the hearing convened.

The Board held two hearings that were appeals from demotion. In one case the Appointing

Authority was upheld and in one case the matter was settled during the hearing.

The Board convened a hearing for one employee that involved both an appeal from

dismissal and an appeal to step three of the grievance procedure that was filed before the

employee was dismissed. After the hearing convened, a settlement agreement was read into the

record.

GRIEVANCES During the year 2008 there were twenty-four grievances filed. A total of fourteen were

settled at the first step hearing. Of the nine grievances that were taken to the second step hearing,

the grievant prevailed in two cases and seven were upheld in favor of the department. Of these

grievances one was processed to the third step before the Personnel Board.

LEGAL Listed below is a summary of all court cases filed or continuing in 2008. The Attorney and

Assistant Attorney for the Board also rendered legal opinions on the application of laws, rules and

regulations, and conducted hearings on appeals from dismissal, demotion, suspension, and

grievances.

GEORGIA McCANN V. MOBILE COUNTY PERSONNEL BOARD, JACK TILLMAN, IN HIS OFFICIAL CAPACITY AS SHERIFF OF MOBILE COUNTY, MICHAEL HALEY, INDIVIDUALLY AND IN HIS OFFICIAL CAPACITY OF WARDEN OF THE MOBILE COUNTY JAIL, DAVID TURNER, INDIVDUALLY AND IN HIS OFFICIAL CAPACITY AS DEPUTY WARDEN, MELISSA BOUNDS, INDIVIDUALLY AND IN HER OFFICIAL CAPACITY AS CORRECTIONS LIEUTENANT, United States District Court Case No. 05-CV-00364-WS-B. In this civil action, plaintiff Georgia McCann contends that she has been a victim of racial

discrimination, subjected to a hostile environment, and also retaliated against in her employment

as a Corrections Officer with the Mobile County Sheriff’s Department. McCann further contends

that she has been denied promotions in the Sheriff’s Department. McCann has been employed in

excess of twelve (12) years as a Corrections Officer with the Sheriff’s Department.

In July 2004, McCann was suspended for ten (10) days by her employer, the Mobile County

Sheriff’s Department, for conduct unbecoming an employee in the public service. McCann

appealed that decision to the Mobile County Personnel Board. After a full and complete

evidentiary hearing, where McCann was represented by counsel, the Personnel Board increased

her suspension from ten (10) to fifteen (15) days. Under Personnel Board Rule 14.7, the Board

has the power to rescind, modify, alter or affirm any penalty imposed by an Appointing Authority,

such as the Sheriff of Mobile County, or it may impose an additional or different penalty as may be

warranted by the evidence adduced at the hearing.

The action of the Board in increasing or imposing additional discipline on Plaintiff McCann

was not in any way based upon her race or any other impermissible or illegal factor. It was strictly

based upon the evidence presented to the Board at the evidentiary hearing.

Any complaints by McCann that the Board’s selection procedures discriminated against her

are without foundation. Those procedures fully comply with all appropriate Federal laws and

regulations including, but not limited to, Title VII of the Civil Rights Act of 1964, 42 U.S.C. §2000e.

et seq. and 42 U.S.C. §1981. Furthermore, those testing procedures did not violate any of

McCann’s constitutional rights as may be asserted under 42 U.S.C. §1983. Simply put, the

Board’s selection process does not discriminate against any applicants, including McCann, on the

basis of their race, sex, or national origin. Finally, the Personnel Board has referred McCann for

promotion on several occasions but she failed to receive a promotion from the Sheriff.

Summary judgment was granted on behalf of the Personnel Board on April 5, 2007. Final

judgment was entered the same day for all Defendants, and McCann filed for appeal on April 10,

2007. The appeal was initially dismissed July 31, 2007 on lack of jurisdiction grounds, but was

subsequently reinstated on October 4, 2007. The U.S. Court of Appeals in Atlanta by written

opinion on May 9, 2008 affirmed the decision of the lower Court.

ROBERT L. HARDIN V. MOBILE COUNTY PERSONNEL BOARD (Case No. CV-2006-3981)

The employee, Robert Hardin, Public Service Worker I with the City of Mobile Urban

Forestry Section – Urban Development, was suspended from his employment for five (5) business

days effective June 26, 2006, by letter dated June 19, 2006 for conduct unbecoming an employee

in the public service, intoxication while on duty or public intoxication while off duty, violation of any

lawful or reasonable regulation or order made and given by a superior officer, and violation of the

City of Mobile Substance Abuse in the Workplace Policy. The employee filed Notice of Appeal on

June 23, 2006, and the hearing on the appeal commenced before the Personnel Board on August

22, 2006. On September 5, 2006 the Board entered an Order which modified the suspension to a

termination. The employee appealed the order to Circuit Court, and it was set for trial before the

Honorable Sarah Stewart on May 9, 2008. The Court remanded the matter back to the Personnel

Board and the City of Mobile subsequently settled with the employee by allowing him to retire.

WINFRED JULY V. MOBILE COUNTY PERSONNEL BOARD ET AL (Case No. CV-07-316)

The employee, Winfred M. July, Equipment Operator II with the Mobile Area Water & Sewer

System, was suspended from his employment on September 12, 2007 for a period of fifteen (15)

working days without pay for absence without leave, insubordination, and violation of any

reasonable regulations or order made and given by a superior officer. The employee filed Notice

of Appeal on September 12, 2007, and the matter was set for hearing before the Personnel Board

October 18, 2007. On November 1, 2007 the Board entered an order affirming the suspension.

The employee appealed the matter to the Circuit Court on November 9, 2007. On March 4, 2009

the Honorable Roderick Stout entered an Order affirming the Board’s Order.

KENNETH HENDERSON JR. V. MOBILE COUNTY PERSONNEL BOARD (Case No. CV-2007-1494) The former Fire Service Driver for the City of Mobile Fire Department was terminated from

his employment January 22, 2007 for conduct unbecoming, insubordination, neglect of duty, and

violation of the City of Mobile anti-discrimination policy. The termination was appealed to the

Board, and heard on April 17, 2007 and continued to April 19, 2007 for additional testimony. On

May 3, 2007 the Board entered an Order affirming the termination.

On May 11, 2007 Mr. Henderson appealed the Board’s decision to the Circuit Court, and

the matter was set for oral argument before Honorable Michael Youngpeter. On May 30, 2008 the

Court issued an order that denied Henderson’s appeal and upheld the Board’s order.

MOBILE COUNTY COMMISSION V. MOBILE COUNTY PERSONNEL BOARD IN RE LISTER PORTIS (Case No. CV-2007-1493.51)

The Youth Service Officer III was terminated from his employment on May 5, 2007 for

conduct unbecoming, and disorderly or immoral conduct. On May 7, 2007 the employee appealed

this termination to the Board, and the matter was set for hearing on June 28, 2007. The Board

entered an Order dated July 27, 2007, which modified the termination to a suspension from May 5,

2007 through July 13, 2007. The Appointing Authority appealed the matter to the Circuit Court

which, after oral argument was heard, upheld the Board's Order that modified the termination. The

Appointing Authority appealed the matter to the Alabama Court of Civil Appeals which affirmed the

Court’s Order without opinion. The County Commission did not file a petition for a writ of certiorari,

and the matter is now closed.

KENNETH ISAAC V. MOBILE COUNTY PERSONNEL BOARD and WATER WORKS AND SEWER SYSTEM OF THE CITY OF PRICHARD (Case No. CV-2007-1928) This Lift Station Mechanic for the Water Works and Sewer System of the City of Prichard

was suspended for five (5) days for conduct unbecoming and insubordination. He appealed the

suspension to the Board, and after a hearing on August 14, 2007, the Board upheld the discipline,

but modified the suspension to three (3) days. Mr. Isaac appealed the Order to the Circuit Court.

The Honorable Roderick Stout heard oral argument on April 24, 2008. On June 19, 2008 the Court

affirmed the Board’s Order.

KENNETH ISAAC V. MOBILE COUNTY PERSONNEL BOARD and WATER WORKS AND SEWER SYSTEM OF THE CITY OF PRICHARD (Case No. CV-2008-581) This Lift Station Mechanic for the Water Works and Sewer System of the City of Prichard

was terminated from his employment on September 15, 2007 for conduct unbecoming and

insubordination. He appealed the termination to the Board, and after a hearing on December 11,

2007, the Board upheld the termination. Oral argument was held on March 18, 2009 before the

Honorable Sarah Stewart. On April 1, 2009 the Court issued an Order affirming the termination.

MARK NENO V. THE CITY OF MOBILE and MOBILE COUNTY PERSONNEL BOARD (Case No. CV-08-0435) Mark Neno filed his complaint on February 28, 2008 demanding among other claims,

declaratory judgment on whether he was entitled to seventy-five percent (75%) of his accumulated

sick leave pursuant to MCPB Rule 3.5(C)(a) after he resigned/retired from his Merit System

employment after having opted out of the City of Mobile Police and Firefighters Pension Fund. The

matter is currently pending before the Honorable John R. Lockett.

ROBERT TOMLIN V. MOBILE COUNTY PERSONNEL BOARD and MOBILE RIVER DELTA DEPARTMENT OF THE MOBILE COUNTY COMMISSION Robert Tomlin appealed the August 5, 2008 decision of the Personnel Board affirming his

twenty (20) working day suspension from employment. The transcript, exhibits, and Board Order

was filed with the Circuit Court. On February 5, 2009 the Honorable Charles A. Graddick granted a

Motion to Dismiss filed on behalf of the Board after Tomlin failed to pay the appropriate filing fee.

RAYMOND J. SHELLY V. MOBILE COUNTY PERSONNEL BOARD and the CITY OF BAYOU LA BATRE POLICE DEPARTMENT On December 22, 2008 Shelley appealed the December 16, 2008 Personnel Board Order

affirming his termination as a Police Corporal with the City of Bayou La Batre Police Department.

The transcript, exhibits, and Board Order was filed with the Circuit Court. The matter will be

assigned to a Circuit Judge upon payment of the filing fee by Mr. Shelly.

MOBILE CITY COUNCIL V. PERSONNEL BOARD (Case No. CV-08-9018.70)

The City Council has sued the Personnel Board over which entity has discretion to approve

the salary of the City Clerk. The case turns on construction of Personnel Board Rule 5.2(b). An

answer has been filed and the matter is pending.

AMENDMENTS TO THE RULES IN 2008

A public hearing was held June 8, 2008, to consider proposed amendments to Personnel

Board Rule 3.1(c) and the public hearing was continued to June 10, 2008. At the meeting of the

Personnel Board on June 10, 2008, the Board approved amendment of Rule 3.1(c), Payment for

Overtime, to now read as follows:

Payment for Overtime. 3.1(c) Employees not engaged in fire protection or law enforcement activities, non-exempt from the provisions of the Fair Labor Standards Act shall be compensated for overtime for all hours worked in excess of forty (40) hours per week at one and one half (1 ½) times the employees' hourly rate of pay, or in the alternative, shall be awarded compensatory time in accordance with the provisions of said Act. Employees engaged in fire protection or law enforcement activities shall be compensated for overtime in accordance with applicable law. The foregoing notwithstanding, any Appointing Authority may opt to compensate any non-exempt employees for overtime on the basis of hours paid rather than hours worked. Overtime, at the option of the Budgeting Authority, may be paid in the pay period within which it was earned, but in any event shall be paid to the employee within fifteen (15) days after the end of the month within which such overtime was earned.

At a public hearing held August 5, 2008, the Personnel Board approved amendments to

Rule 5.2(b), Promotional Employees. Rule 5.2(b) now reads as follows:

PROMOTIONAL EMPLOYEES. 5.2(b) Upon promotion, employees shall receive not less than two steps or 10%, no more than the maximum rate established for the class at the discretion of the Appointing Authority, with the exception of the Mobile Fire Department, in which case promoted employees shall receive two steps or 10% unless it would exceed the maximum.

At a public hearing held August 5, 2008, the Personnel Board approved amendments to

Rule 5.4, Individual Merit Increases. Rule 5.4 now reads as follows:

INDIVIDUAL MERIT INCREASES. 5.4 Salary advancement within a range shall not be automatic but shall be made upon specific recommendation of the Appointing

Authority, with a similar recommendation of the Director, and the approval of the governing body. Each advancement shall be based upon quality and quantity of work as indicated by service ratings or other measurements of performance, with due respect to length of service and shall be referred to as merit increases or special merit increases, dependent upon the circumstances. Merit increases and special merit increases may be made in increments of 5% or 2.5%, to be determined by each budgeting authority prior to granting the first merit increase in each fiscal year, with such notification provided to the Personnel Board once the determination has been made.

POLICIES APPROVED IN 2008

On January 3, 2008, the Personnel Board approved the request of the City of Saraland to

amend their Educational Incentive Pay policy and it now reads as follows:

COLLEGE EDUCATIONAL INCENTIVE PAY POLICY CITY OF SARALAND EMPLOYEES

All full-time, permanent City of Saraland employees from entry level through the entire structure, who can substantiate through certified official transcripts from a recognized college or university with an accredited program in academic degrees shall upon approval of the Director, be granted a one-step (5%) educational incentive pay increment upon satisfactory completion of an Associate's Degree or at least 96 quarter hours/64 semester hours (in which course grades of "C" or better were attained) that included at least 25 quarter hours or its equivalent directly in the specialized course leading toward the degree. Only internet courses/degrees that are accredited through the crediting bodies which are accepted by the Mobile County Personnel Board will be approved. All employees who have been approved by the Educational Committee, ratified by the Council and approved by the Mobile County Personnel Board will be recognized for incentive pay. Further, upon satisfactory completion of the requirements for a Bachelor's Degree the educational incentive pay increment shall be raised one additional step (5%) for a total of 10%. Upon satisfactory completion of the requirements for a Master's Degree the educational incentive pay increment shall be raised another one-step (5%) for a total of 15%. However, to qualify for the total 15% by virtue of attaining a Master's Degree, the recipient must also meet the criteria established for receipt of both the 5% and 10% incentive pay increments. It is the intent of the City of Saraland that educational incentive pay be limited to a maximum of 15%. If this policy does not address a specific fact scenario to determine eligibility, then a determination of eligibility shall be made by the Mobile County Personnel Board.

PROMOTIONS

There were no promotions requested by the Appointing Authorities under Rule 9.6 in 2008.

This rule provides that in a situation where there is only one employee in a department who meets

the qualifications for the promotional position, that employee may be considered for promotion

without examination.

There were 411 promotional appointments resulting from 151 promotional examinations

processed in 2008.

CLASSIFICATION AND PAY

The Personnel Board adopted specifications and salary grades for fifteen new classes in

2008. In addition, there were amendments to the pay plan for already existing classes as well as

fifteen revisions to existing specifications. The City of Saraland approved a 5% cost of living

increase for their employees effective February 16, 2008 and the Mobile Housing Board approved

a 5% cost of living increase for their employees effective January 10, 2009.

INFORMATION SERVICES

During 2008, the majority of our agencies adopted salary changes based on our 2006

salary survey. We worked closely with the agencies, providing updated salary information and pay

schedules based on the Pay Table they adopted.

We combined our two training areas into a single Training Lab, with an updated network

and software. This allowed an increase in the number of seats available for training, and the ability

to increase the number of applicants tested in office skills.

We upgraded several outdated PCs, giving our staff equipment that improved efficiency.

Several of our agencies have implemented electronic transfer of payroll information.

Participants in Payroll Register Transfer are Mobile County, City of Mobile, Mobile County Health

Department, Mobile Area Water and Sewer System, Mobile Public Library, Prichard Water and

Sewer Board, and Mobile County Racing Commission. Participants in Electronic Transfer of daily

time reports are Mobile County, City of Chickasaw, City of Prichard, Mobile Area Water and Sewer

System, Prichard Water and Sewer Board, and Mobile County Racing Commission. We have

begun working with the City of Mobile to implement electronic transfer of daily time reports. This

will reduce the time required to process their payroll, and will allow us to certify their payroll more

efficiently.

We continue to evaluate Applicant Tracking Systems, so that we can provide on-line

applications, more efficient work flow, and improved access to our applicant information.

Plans for 2009 include fine-tuning our on-line application system, upgrading our website

and training equipment.

VETERANS

A total of 594 employees received paid leave to participate in military training during 2008.

At the beginning of the calendar year 2008, seventeen of our Merit System employees were still on

military leave and nineteen additional employees were granted leave during the year. Eighteen

employees safely returned to their job during the year, leaving fourteen employees still out as of

December 31, 2008.

Also, extra points were awarded to 345 veterans who applied for open competitive

examinations during 2008.

TRAINING

The responsibilities of the training area within the Personnel Department are three-fold and

include employee training, recruitment/communications and proficiency testing. Specific

responsibilities include the following:

Conduct and schedule training events and classes for jurisdiction employees Provide on-site jurisdictional training upon request Conduct system orientation for new employees Review applications for employee development salary increase requests Recruit applicants through career/job fairs and presentations

Conduct typing and dictation proficiency tests; public offering of keyboard training

Preparation of newsletters and recruitment materials Coordination of safety training for Personnel Department staff

In 2008 there were steady increases in these areas:

The most notable achievement during 2008 was the coordination and scheduling of two

community career/job fairs for Merit System positions. In Spring 2008, the Personnel Department

along with many of our jurisdictions held two area fairs. The first was held at Hank Aaron Stadium

and the second at the Saraland Civic Center. Both events were viewed as being very successful

based on attendance.
