ANE Bureau Cooperative Agreement N. 0056-A-00-6048-00 Quarterly Report N. 12 January 1 - March 31, 1989 1989 opened with IDLI's 35th program, a two-week seminar entitled "Investment Treaties and Joint Venture Agreements" (IBT-11E), followed by a French-language seminar "Contrats de Gestion et de Consultants" (IBT-12F). The 1989 Development Lawyers Course (DLC-6E) opened on March 5 and will run to May 27. This year the course is under the management of William T. Loris, Senior Program Legal Counsel and Yohannes Kassahun, Progran Legal Counsel. Of particular note is the large number of women lauyers attending DLC-6E, comprising nearly 50% of the class. In addition, Mr. Loris spent a week in February traveling through the Caribbean on a diagnostic trip in preparation for a two-week workshop on International Project Financing and Contracts to be held i n Barbados from June 4-17, 1989. This workshop is being organized in conjunction with the Caribbean Justice Improvement Project. The funds for the workshop will be provided by USAID. Two other workshops are being prepared by Mr. Gilles Blanchi to take place in Congo from October 23 to 26, 1989 and in Zaire during the late spring of 1990. Mr. Blanchi recently returned from a "diagnostic" trip to Brazzaville (Congo) and Kinshasa (Zaire) as part of the preparations for these workshops. The first program of the year "Investment Treaties and Joint Venture Agreements" (IBT-11E) took place from January 22 - February 4, 1989. Mr. Yohannes Kassahun managed the seminar, which was attended by 24 participants from 19 countries. We are pleased to note that five countries were represented for the first time : Bangladesh, Bolivia, Fiji, Sierra Leone and the Solomon Islands, bringing the total number of countries that have benefited from IDLI training to 96. Over half of the participants were between 30-35 years of age and were employed by

f o r t h e s e workshops.

The f i r s t program o f t h e y e a r " Investment T r e a t i e s and J o i n t Venture Agreements" (IBT-11E) took p l a c e from January 22 - February 4 , 1989.

M r . Yohannes Kassahun managed t h e seminar , which was a t t e n d e d by 24

p a r t i c i p a n t s from 1 9 c o u n t r i e s . We a r e p l e a s e d t o n o t e t h a t f i v e

c o u n t r i e s were r e p r e s e n t e d f o r t h e f i r s t t ime : Bangladesh, B o l i v i a , F i j i , S i e r r a Leone and t h e Solomon I s l a n d s , b r i n g i n g t h e t o t a l number of c o u n t r i e s t h a t have b e n e f i t e d from I D L I t r a i n i n g t o 96. The 1989 francophone programs opened with the seminar, "Contrats de Gestion et de Consultants" (IBT-12F) from February 12-25, managed by Mr. Gilles Blanchi, Senior Program Legal Counsel. The seminar was attended by 23 participants from 19 countries, including one new country, The Comores. Six of the participants were from Arab countries (Egypt, Tunisia, Morocco, Mauritania), representing 26 percent of the entire class. The following IBT-12F participants received ANE fellowships:

The I n L I a d m i n i s t r a t i o n o f f i c e has devised a s e t o f general g u i d e l i n e s f o r t h e use o f a d m i n i s t r a t i v e funds under t h e ANE Cooperat ive Agreement. With an eye t o keeping month1 y e::penses a t t r i b u t e d t o t h e g ran t a t a r e g u l a r l e v e l o f appro:.:imately 926,600 ($320,000 over 12 months), a l i s t o f bas i c o p e r a t i n g expenses t o be covered by t h e g ran t was rnade. For t h e month of June, I U L I i s reques t i n s reimbursenrent c r f expenses i n c u r r e d f o r 1 ocal sa l a r i e s and communications.

Fu tu re p lans . Al though ILILI conducted o r p a r t i c i p a t e d i n t h r e e t r a i n i n g workshops and conf erences d u r i n g t h e summer months, no r e r u l a r IDL I courses t a k e p l ace d u r i n g JLI~ y and August. Therefore incoming t u i t i o n revenue i s low f o r t h e p e r i o d . The ANE g ran t w i l l be used i n t h e nex t q u a r t e r t o cover a p o r t i o n of bas i c o p e r a t i n g expenses. Th i s w i l l enable us t o beg in u t i l i z i n g funds rece i ved f rom o t h e r sources f o r investment purposes.

I t appears t h a t due t o i t s sub jec t mat te r t h i s seminar has s t i r r e d cons iderab le i n t e r e s t i n t h e va r i ous donor agencies we deal w i t h on an ad-hoc bas i s . Therefore, candidates have had g r e a t e r success i n d i r e c t l y secur ing t h e i r own f e l l o w s h i p s f o r t h i s p a r t i c c t l a r seminar. I n a d d i t i o n , many candidates f rom state-owned e n t e r p r i s e s a r e be ing sponsored by t h e i r employers. We have t h u s opted t o rese rve t h e ANE f e l l o w s h i p s funds a l l o c a t e d f o r IBT-7E (approx. US$ 15,000) f o r d i s t r i b u t i o n t o an a d d i t i o n a l qua1 i f i e d cand ida te t o t h e Development Lawyers Course (DLC-4E). Quarterly Report N. 11 October 1 - December 31, 1988

During the Quarter, IDLI completed the French-language Development Lawyers Course (DLC-5F), which ran from September 11 - December 3, and held a seminar entitled "International Transport of Goods: Contracts and Insurance" (IBT-10~) from December 4 - 17. Information on participants to DLC-5F was included in the Quarterly Report N. 10. Mr. William T. Loris, Senior Program Legal Counsel, managed the December seminar which was attended by 28 participants from 21 countries.

In addition, IDLI designed and conducted a workshop for Arab and African Arbitrators in Cairo ( Egypt) in collaboration with the Regional Centre for International Commercial Arbitration in Cairo. During the quarter, IDLI's activities in Arab countries also included the Director's participation as a visiting expert in various roundtable meetings on privatization in Ankara

(Turkey ).

1. Fellowships:

Two participants from Jordan received fellowships to attend IBT- 10E under the ANE Cooperative Agreement as follows:

Mr. Al-Mutase Abduldaiem Head of Insurance and Claim Section Jordan National Shipping Lines Jordan

Mr. Kamal Gharaibeh Assistant Freight Supervisor Jordan National Shipping Lines Jordan

Mr. Abduldaiem and Mr. Gharaibeh deal directly with the seminar's subject matter in their positions with the Jordan National Shipping Lines. Taking into account the preference the ANE Bureau has expressed for sponsoring Arab participants, they were awarded ANE fellowships.

2. Administration:

After a study of alternative office equipment to replace our present wordprocessors, IDLI signed a rental contract with Olivetti for a new word processing system with personal computer capacity due to be installed in February 1989. The additional computer capacity will make a significant difference in support staff's ability to handle the Institute's increasing information needs.

IDLI received grant funds from the USAID Bureau for Private Enterprise (PRE) from September 1985 - January 1988 to provide fellowships for private practitioners to IDLI programs and to sponsor two in-country training workshops on subjects connected with private enterprise issues. In December 1988, the PRE Bureau completed its assesment of IDLI programs under PRE funds. Using the goals of the Cooperative Agreement as parameters, the assesment was favorable and recommended renewed assistance.

In November, Ms. Maria France Fabre of the French Ministere de la Cooperation visited IDLI on a two-day evaluation mission in which she interviewed participants, visiting instructors and IDLI personnel. Her favorable report on IDLI programs and operations led to increased fellowship support from the French Government for 1989.

The Government of Italy has renewed its ongoing institutional and fellowship support for the year 1989.

A new Program Legal Counsel for French-language programs has been selected. Mr. Alexandre Cordahi, a Lebanese lawyer, will join IDLI in February 1989.

ANE Cooperative Agreement administrative funds for the quarter consisted of expenses incurred for courier service, printing costs for general material, maintenance and repairs and communications.
