Title IX of the Education Amendments of 1972“No person in the United States shall, on the basis 

of sex, be excluded from participation in, be denied the benefits of, or be subjected to 

discrimination under any education program or activity receiving Federal financial assistance.”

OCR: Sexual harassment of students, staff, and faculty, which includes acts of sexual violence, is a form of sex discrimination prohibited by 

Title IX.

The Office of Civil Rights (OCR) issued a Dear Colleague Letter (DCL) reminding colleges and universities about how to appropriately respond to and resolve 

reports of sexual harassment.

Summary of Institutional Obligations

If institution knows or reasonably should know (put on notice) about sexual harassment that creates a hostile environment, Title IX requires immediate action to eliminate the harassment, prevent its recurrence, and address its effects.

Must designate at least one Title IX Coordinator, publish notice of nondiscrimination, and adopt and publish grievance procedures.

• Investigate complaints adequately, reliably and impartially.

Title IX and Law Enforcement• Campus law enforcement are responsible employees.

• Responsible employees must report to the Title IX Coordinator.

• A criminal investigation does not relieve the institution from conducting it’s own investigation, and can not be determinative of a Title IX violation.

Title IX and Law Enforcement• The entire case should be resolved within 60 days.• Law enforcement investigations can be used as part 

of the Title IX investigation, but CANNOT TAKE THE PLACE OF IT EVEN IF YOU ARE CAMPUS EMPLOYEES. 

• The institution can delay only approx. 10 days to accommodate an active law enforcement investigation.

• Title IX will not report to law enforcement on behalf of the victim if they do not want to report.

“Any agreement or Memorandum of Understanding (MOU) with a local police department must allow the school to meet its Title IX obligation to resolve complaints promptly and equitably.”

Title IX and Law Enforcement• School should instruct law enforcement employees:

• To notify complainants of their right to file a Title IX complaint in addition to the filing of a criminal complaint.

• To report incidents of sexual violence to the Title IX Coordinator if the complainant consents. 

• Law enforcement should be trained on the school’s grievance procedures & any other procedures used for investigating reports of sexual violence.

• Law enforcement should receive copies of the school’s Title IX policies.  NACUA, 2013

Title IX and Law Enforcement

• MOU should include clear policies on when a school should refer a matter to local law enforcement.

• MOU should not prevent a school from notifying complainants of their Title IX rights, the school’s grievance procedures, or taking interim steps to ensure safety and well‐being while the law enforcement fact gathering is in progress.

Title IX and Law Enforcement• Title IX Coordinator should be given access to school law 

enforcement unit investigation notes and findings as necessary for the Title IX investigation, so long as it does not compromise the criminal investigation.

• Title IX Coordinator should be available to provide assistance to school law enforcement employees regarding how to respond appropriately to reports of sexual violence.

• School should notify a complainant of the right to file a criminal complaint, and should not dissuade a victim from doing so either during or after the school’s internal Title IX investigation.

UMD MOU• Ongoing communication is key.• MOU between TIX Office and UMPD:

• Investigations will be coordinated whenever possible.• Lead UMPD investigator will share information to the greatest 

extent possible.• Request to delay a TIX investigation generally cannot last past 10 

days.• UMPD will provide notes, findings, and other evidence as long as it 

will not compromise an ongoing investigation and vice versa as allowed by law.

• A police investigation cannot take the place of the TIX investigation.

• Training by TIX office for UMPD.

Lessons Learned

Items that we have found that need to be added to the current MOU:

• Discussion about Clery numbers

• Timely warnings

• Level of privacy maintained for anything turned over by UMPD to TIX
