AMENDMENT TO PRE-BID MEETING HELD ON DT.12.03.2019 OF THE TENDER
FOR SUPPLY OF LIQUID MEDICAL OXYGEN ON RATE CONTRACT BASIS AND
SUPPPLY, INSTALLATION AND COMMISSIONING OF LIQUID MEDICAL
OXYGEN STORAGE SYSTEM AT THREE MEDICAL COLLEGES

Queries and necessary amendment to Techno-Commercial terms conditions
1. Queries:
Pg.11, Section-IV, Clause no. 4.1
a) We recommend Storage vessel capacity (VIE Tank) should be 20 kL each for
both MKCG Medical College and Hospital, Berhampur and Vimsar, Burla
respectively in order to ensure smooth and uninterrupted supply of Liquid
Medical Oxygen and one additional 6kL tank at SCB Medical College-Cuttack for
requirement of Pulmonary Medicine department.
b) OSMCL needs to clarify whether up-gradation of the existing Manifold system
for all the three Institutions (Cuttack, Berhampur and Burla) is required or not.
Accordingly cost against the same shall be incorporated in the Price Bid.
Or
Scope need to get redefined and get limited to LMO system with hook up only.
Since this tender had been asked for Supply, Installation and commissioning
LMO storage vessel and Supply of LMO.

Amendment:
a) The required LMO storage vessel capacity for both MKCG Medical College and
Hospital, Berhampur and VIMSAR, Burla is amended to single unit of 20KL
from 10KL keeping in view of future expansion of the medical colleges. No
additional tank required for Pulmonary Medicine department at SCB Medical
College-Cuttack and should be connected with copper pipeline from available
LMO storage vessel.

b) It is amended that up-gradation of each existing manifold system has to
be done at all three medial colleges to semi-automatic manifold system
(8X8 with both main and backup oxygen cylinder bank system). The cost
of the upgradation of existing manifold system to semi-automatic manifold
system shall have to be quoted separately in price bid format (Format-B).

2. Queries:

a) Sl No: 7: Provision of Fire Safety major shall be covered under SMPV Rule 16.
Or
Compliance will be achieved as SMPV Rule, 2016 under PESO. Purchaser need
to offer the location for LMO storage tank job that meets the Fire safety rules.
b) Sl No: 9: Provision of emergency back-up for Medical Oxygen supply in
cylinders shall be in the scope of the Buyer and any cost associated in refilling
of cylinders with Medical Oxygen gas shall be borne by the Buyer.
Or
Compressed Medical Oxygen in cylinders supply should be out of preview. Also
No Price format attached in Tender documents.
c) Sl No: 10: No Electrical safety test is required for this installation
Or
Electrical safety tests - Not applicable, since no electricity is required for Liquid
Medical oxygen storage tanks
Original Tender Clause:
a) Sl No: 7: Provision of required Fire Safety major as per latest fire safety rules
b) Sl No: 9: Provision of emergency backup for medical oxygen supply by supplying
required number of jumbo cylinders to the individual manifold room.
c) Sl No: 10: The successful bidder shall provide factory test certificates for the
materials used and also supply complete set of design lay outs, safety manuals,
standard operating manuals for the whole systems and subsystems to be
supplied. The detailed site plan and system layout plan including civil/ electrical
works or other related works shall be prepared by the successful bidder and
shall be handed over to the users after the commissioning of the projects. Final
electrical safety tests, fire safety test, System commissioning tests and any
quality check required shall be done by an authorized third party
agency/personnel after the handover of the project.
Amendment:
a) Pt. No. 7: Provision of required Fire Safety major as per SMPV Rule, 2016.
b) Pt. No.9: The supplier shall have responsibility of provision of emergency
backup for medical oxygen supply by refilling of the existing jumbo cylinders
available in hospital to the individual manifold room during the execution of the
project. However the hospital authority shall bear the cost of the refilling
inclusive of transportation in the approved rate only for a period of 48 hours
only from time of interruption of service of the LMO system caused due
to breakdown of the system or shutdown of the system for schedule
maintenance or exhaust of the liquid gas of the storage vessel due to not timely
filling of the LMO gas due to any mishap happens during transportation of the
transport vehicle or any other possible reason. The supplier has to bear the
cost of refilling of cylinders and shall have the responsibility to provide
backup services to each manifold systems after the first 48 hours
without any extra cost. The rate of refilling of medical oxygen cylinders
inclusive of transportation shall have to be quoted under Format-B of price bid
in PDF file.
c) Pt. No. 10: The successful bidder shall provide factory test certificates for the
materials used and also supply complete set of design lay outs, safety manuals,

standard operating manuals for the whole systems and subsystems to be
supplied. The detailed site plan and system layout plan including civil/ electrical
works or other related works shall be prepared by the successful bidder and
shall be handed over to the users after the commissioning of the projects. The
electrical safety test is required in case of any electrical components of more
than 1000V of in use inside the LMO system.
3. Queries:
Pg.13, Section-IV, Clause no. 4.4
a) Sl.No. c: We will maintain uninterrupted supply of LMO. However during any
shutdown period or to keep manifold in good conditions- emergency back of
Bulk Cylinders reqd. Which can continue with local vendors.
b) Sl No: e: Exact quantity of LMO being supplied by the Supplier shall be
measured by weighment basis.
Or
Supply quantification need to be done based on weighment or Flow meter wise.
Content gauge is old method which is used only as reference for % stock
available in the tank.
c) Sl No: f: All supplies of LMO shall accompany with Purity certificate to be
provided by the Supplier and hence cost of testing and transportation
associated in terms of sending the gases supplied for quality test to a Govt.
approved Lab from time to time shall be in scope of the Buyer.
d) Sl No. i,j,k: We can supply as order on customer or Schedule customer through
Telemetry system installed along with LMO vessel for 0 failure in uninterrupted
supply of Oxygen and manual intervention.
e) Sl No: l: The supplier should pay Rental/Facility Charge other than cost of gases
considering investment being done on the procurement of tanks and associated
accessories.
Or
Will maintenance of the equipment for first 5 years + 5 years further will be the
responsibility of the supplier. However a Facility Charge on monthly basis
should be included as part of the price schedule for as maintenance charge due
high cost of spares & high initial investment of the equipment, as the size and
quantity of equipment varies from each hospital.
Original Tender Clause:
a) Sl.No. c: The bidders should be able to maintain uninterrupted supply of LMO
and medical gases even in emergencies. The bidders shall give undertakings to
the Hospitals and make alternate arrangement for the supply of gases at their
risk and responsibility.
b) Sl. No: e: The Supplier shall ensure that exact quantity of LMO is being supplied
by proper measurement (volume of LMO through properly calibrated content
gauge), which shall be arranged by him, failing which, the supply shall have to
be replaced by the supplier on his own cost.
c) Sl. No: f: The gases supplied will be sent for quality test to a Govt. approved
Lab from time to time and the cost of testing & Transportation or any other
incidental charges will be borne by the supplier.
d) Sl. No. i,j,k: i) Failure or delay in supply of life saving medical gases shall result
in financial penalty and any other levy as decided by the Tender inviting
authority. j) The bidders shall give undertakings that if they fail to maintain

standards of tank and cylinders, gases and if some mishap occurs, they shall be
responsible for the same. k) The bidders shall give undertakings to the
hospitals that they will provide uninterrupted supplies as per demand of the
hospitals.
e) Sl. No: l: The supplier shall not be paid any rental/facility charges other than
cost of gases.
Amendment:
a) Pt. no. c: The bidders should be able to maintain uninterrupted supply of LMO
and medical gases even in emergencies. The bidders shall give undertakings to
the Hospitals regarding the same and make alternate arrangement for the
supply of gases at their risk and responsibility after first 48 hours of
interrupted service of the LMO system for the reasons mentioned
above.
b) Pt. no. e: The Supplier shall ensure that exact quantity of LMO is being supplied
by proper measurement through either properly calibrated volume gauge of
LMO or Flow meter or content gauge) which shall be arranged by the
supplier failing which necessary penalty shall be levied on the supplier as
decided by the hospital authority.
c) Pt. No. f: The gases supplied may be sent for quality test to any Govt. approved
Lab from time to time for ensuring the quality of the delivered product and the
cost towards the testing or any other incidental charges will be borne by the
hospital authority. However the transportation of the test sample shall
have to be done by the supplier.
d) Pt. no. i, j, k: The clauses shall remain unchanged. However it is clarified that
the daily monitoring of the status of the LMO tank storage shall be undertaken
by supplier through remote monitoring system or daily routine contact to the
operator or through scheduled period delivery process based on consumption.
e) Pt. No. l: The supplier shall be paid with only facility charges of the LMO
system other than the cost of gas as approved in the tender. The cost
towards the facility charge per tank per month for entire 10 years of
duration shall have to be quoted under Format-B of other price bid format
in PDF file and which shall be taken into account of price evaluation for
derivation of lowest quoted bid. The revised Format-B of price bid is attached at
Appendix-A.
4. Queries:
Pg.15, Section-V, Clause no. 5.1
a) Clause No: 5.1.1: Regret our inability to accept Supply, installation and
Commissioning period within 90 days from the date of issue of Work Order and
Site handover. We request the same to be within 180 days from the date of
issue of Work Order and Site handover.
Or
Supply, Installation, commissioning period should be considered 135 days from
the date of written site clearance from Purchaser or original consignee and
same shall be applicable for Clause no. 6.29.1.
b) Clause No: 5.1.4: Regret our inability to accept Validity of rate as 10 years from
the date of approval. Supplier should be entitled for a revision in price of the
Product as well as for the Monthly Facility Charges for Tank (VIE) usage on the
basis of Power, Fuel and WPI variation

Or
Fixing a 10 years, Liquid Medical Oxygen will be high variable driven product
with key component Power , Diesel and Consumer/ Wholesale price Index is
regularly changing on increasing trend, along with the cost of capital equipment
used each institutions. A yearly fixed escalation should be included during the
contract period, with clear definition on the applicability during the 5 YEAR and
post extension period.
c) Clause no. 5.1.8: Oxygen should be provided 24 x7 x 365 days. No uptime is
applicable.
Original Tender Clause:
a) Clause No: 5.1.1: Supply, Installation & Commissioning period: Within 90 days
from the date of issue of Work Order and Site handover
b) Clause No: 5.1.4: Validity of Rate : 10 years from date of approval
c) Clause no. 5.1.8: Uptime in a year: 95%
Amendment:
a) Clause no. 5.1.1: Supply, installation and commissioning period shall be within
120 days from date of issue of work order and site handover whichever is later
and is also applicable for Clause no. 6.29.1. (Another 30 days from the tender
schedule of 90 days is felt sufficient to execute the project and also to avoid
further delay for functioning of the project)
b) Clause no. 5.1.4: The approved price of liquid gas and facility charges shall have
an escalation of 3% per year on the approved base rate subject to
production of Govt. notification on hike in price/service/taxes.
c) Clause no. 5.1.8: Uptime is not applicable. Hence deleted from tender as
already period of back up service and scope of supply has been defined earlier.
5. Queries:
Pg.15, Section-V, Pre-qualification of the bidder
a) Clause No: 1.2.2: Manufacturing Unit of the supplier shall be within 750 km and
not 500 km distance from the concerned institution for convenience and
avoiding delay in emergencies.
Or
Should retain the clause of having manufacturing plant within 500km distance
from the concerned institution for maintaining uninterrupted and reliable supply
avoiding cross state product movements.
b) Clause No: 1.2.6: Turnkey word may please be omitted for setting up Liquid
Medical Oxygen Storage Vessel and supply to at least 5 nos. of Govt./Corporate
Hospitals/Private Hospitals/Medical Colleges each with bed capacity of at 500
beds and not 750 beds during last three financial years.
Or
Should be there for better experience and management of this scale and size of
the Govt. hospital project.
c) Clause no. 1.2.7: Should be at least 500 Crs. as LMO supply of three MCH is
part of tender. As supplier has to have large ASU, along with sufficient tanker
and working capital for enabling services required for the Healthcare Institution
under Govt.
Original Tender Clause:
a) Clause No: 1.2.2: The bidder must have at least two manufacturing units of
Liquid Medical Oxygen in India, out of which, at least one manufacturing unit

must be within 500km. distance from the concerned institution for convenience
and avoiding delay in emergencies.
b) Clause No: 1.2.6: The bidder must have executed the turnkey job of Setting up
of Liquid Medical Oxygen Storage Vessel and on supply process of Liquid
Medical Oxygen in India in at least 5 nos. of Govt./Corporate Hospitals/Medical
Colleges each with bed capacity of at least 750 beds during the last three
financial years i.e. 2015-16, 2016-17 & 2017-18. Project completion and
commissioning certificates shall have to be furnished as proof of supply, failing
which the bid shall be liable to be rejected.
c) Clause no. 1.2.7: The bidder must have a minimum average annual turnover of
Rs.10 Crores in the last three financial years i.e. 2015-16, 2016-17 & 2017-18,
to be certified by a Chartered Accountant in Format T8.
Amendment:
a) Clause no. 1.2.1: The bidder must have atleast two manufacturing units of
Liquid Medical Oxygen in India, out of which, at least one manufacturing
unit must be within 750km. distance from the concerned institution for
convenience and avoiding delay in emergencies.
b) Clause no. 1.2.6: The bidder must have executed the job of setting up of Liquid
Medical Oxygen Storage Vessel on turnkey and on supply process of Liquid
Medical Oxygen in India in at least 5 nos. of Govt. hospitals/ Corporate
Hospitals/Medical College hospitals each with bed capacity of atleast
500 beds during the last three financial years i.e. 2015-16, 2016-17 &
2017-18. Project completion and commissioning certificates shall have to be
furnished as proof of supply, failing which the bid shall be liable to be rejected.
c) Clause no. 1.2.7: No Change
6. Queries:
Pg.38, Clause no. 6.30
a) Clause No: 6.30.1: Regret our inability to accept with no advance terms
b) Clause No: 6.30.2: Our agreed payment terms shall be as under:
i) 40% advance along with Work Order
ii) 30% within 7 days from the date of receipt of material supply at site duly
certified by the buyer through Stock entry certificate
iii) 20% within 7 days against civil construction and installation of the tanks at
all the sites
iv) 10% against successful training and commissioning of the tanks at all the
sites
Or
LMO project will have two parts: one turnkey work i.e. civil & pipeline and regular
payment of LMO supply bills: 1. Supply bills should be payable within 30 days. 2.
Turnkey projects payment bill will be payable just after hand over certification with
stock entry certificate etc. i.e. as per NIT.
c) Payment against LMO shall be within 30 days from the date of receipt of
material at your Hospital sites
d) It may further be noted that cost of statutory requirements/statutory fees along
with shall be borne by the Buyer directly.
Or
Directly payable by consignee/ Individual Hospital, as License charge payable to
Govt.as per statutory requirement.

e) The Buyer shall provide tested and certified crane, of appropriate capacity as
specified by supplier at Buyer’s own cost for unloading of the tanks at all the
Hospital sites and loading the same on the foundation. However, total
supervision shall be done by supplier and supplier site in charge designated for
this job.
f) Clause No: 6.32.5 and 6.32.9 may kindly be withdrawn.
g) Regret our inability to accept Clause No: 6.43.5 against Liquidated Damages
h) Regret our inability to accept Clause no: 6.44 (Termination of contract) which
needs revision as under:
This Agreement shall be terminable:
a) By either party giving not less than 60 (sixty) days’ notice in writing to the other
party for breach by the other Party of any of the terms and conditions of this
Agreement save as otherwise stated in clause 12.1c below and provided such
breach shall not have been rectified by the end of the said notice period.
b) By either party forthwith by giving notice in writing to the other, in the event of the
other going into liquidation compulsorily or voluntarily, being declared insolvent or
in the event of the other consenting to amalgamation, merger or take-over.
c) Notwithstanding anything contained hereinabove, timely payment of the equipment
usage charges and price for the products supplied is the essence of this Agreement
and a breach of this obligation by Buyer is a breach of terms of this Agreement and
notwithstanding any other remedy stated hereinabove, shall entitle Seller at its
discretion to suspend supplies of Product or terminate this Agreement forthwith. In
either case, the Buyer shall be solely liable and responsible for all consequences
thereof, including any death or injury to any of the patients consuming the Product
at the hospitals where the Product is being supplied hereunder.
In the event of termination of this Agreement:
a) Buyer shall pay for the supplies already made by Seller and the Equipment usage
charges as long as the Equipment remains in the custody of Buyer in terms of this
Agreement.
b) Buyer shall forthwith return to Seller, the Equipment and every part thereof and
any other equipment or assets of Seller, which may be in or under Buyer’s control,
without demur or protest and without making any claims or demands whatsoever.
c) Seller shall remove the Equipment within three (3) months of termination of this
Agreement.
d) It is expressly agreed between the parties that in the event of termination of this
Agreement Buyer shall pay to Seller all the expenses incurred by Seller, towards
decommissioning & transportation of the Equipment. However in the event of
earlier termination of Agreement due to breach of any of the terms of the
Agreement by Buyer, Buyer shall bear twice the expenses incurred by Seller,
towards decommissioning and transportation of the Equipment.
Or
Clause no: 6.44.1 and 6.44.5: The clause should be extended to Suppliers also
(Reciprocal), with a clear notice to be given to the individual institutions to have a
common approach on termination of contract.
Original Tender Clause:
a) Clause No: 6.30.1: No advance payment shall be made to the supplier.
b) Clause no. 6.30.2: 90% of the cost towards civil construction/ modification/
development work, Cost of expansion of copper pipeline system/ up-gradation of

gas manifold system (excluding CMC Cost) + 100% of the liquid medical gas
filled in the tank, Cost of Statutory requirement/statutory fees and installation
cost if any + 100% tax shall be paid to the supplier on receipt of the stock entry
certificate, installation and demonstration/ training of the item from the
consignee.
c) Clause no. 6.32.5: The prospective bidder, who are manufacturers, shall submit
an undertaking in the Format T6 & T7 from the Original Equipment
Manufacturers (OEM) that they are willing to provide spare parts for the period
of warranty as mentioned and also during the additional CMC period, if awarded.
The OEM shall also assure continuity of service to their product, in the event of
change in dealership or the bidders – their existing dealers - couldn’t provide
service during the warranty / CMC period.
d) Clause no. 6.32.9: Complaints should be attended properly, maximum within
the time mentioned in clause 5.1.9. In case, the repair/fault duration is likely to
exceed 72 hours, the period of warranty or CMC period shall be extended for
2days for every 1day delay maximum up to 15 working days. On exceeding the
15 working days, the performance security of the successful bidder shall be
forfeited and deemed action shall be initiated as per the procurement guideline.
e) Clause no. 6.43.5: Liquidated Damage
f) Clause no. 6.44: Termination of Contract with sub clauses as mentioned in
tender document
Amendment:
a) Clause No: 6.30.1: No Change in clause, Advance payment shall not be made
to the supplier.
b) Clause no. 6.30.2: No Change, Payment schedule shall remain same as
specified in the clause.
c) No payment shall be made for only delivery or receipt of the goods.
d) Cost towards statutory requirements/statutory fees/Licensing fees shall be
paid to the supplier as per the Govt. approved rate. No additional
consultancy fee/ liaising fee/Supervising fee shall be paid to the supplier.
e) As a part of the installation & commissioning work, all kind of heavy duty
machineries such as Cranes/excavator/hydra required during project shall have
to arrange and cost towards necessary job shall have to borne by the supplier.
f) Clause no. 6.32.5: The prospective bidder, who are manufacturer of the liquid
medical oxygen shall have to submit an undertaking in the Format T6 only. Rest
of the point under the clause is not applicable.
g) Clause no. 6.32.9: The clause is deleted as warranty and CMC costs are not
applicable.
h) Clause no. 6.43.5: No Change
i) Clause no. 6.44: No Change
7. Queries:
Pg.9, Section-III, Clause no. 3.1.5
The liquid oxygen system will be built, owned & maintained by the supplier.
Customer have also demanded for Performance security deposit. So here warranty
of the equipment should not be applicable, since the point had got covered in the
above 2 points.

The successful bidder shall furnish a performance security in the shape of a
Demand Draft/Bank Guarantee issued by a Nationalized Bank in favour of Tender
Inviting Authority for an amount of 10% of the annual contract value. The annual
contract value shall be the cost of liquid gas for a year i.e. Approved Rate per Cubic
meter (M3)×50,000 (Cubic meter per month)×12 (months)×3 Units (assuming
consumption of 50,000 m3 per month).
Amendment:
Performance security of specified amount shall have to be submitted as
part of the tender clause. However warranty and CMC is not applicable.
CORRIGENDUM
The typographical error in value of cubic meter at Pg. no. 11, under importance
notes, the pt. no. 1 is corrected as follows,
1. The bidders shall have to quote the price of liquid medical oxygen per cubic
meter for each medical college in the respective row of BOQ (attached as
excel file) in the e-tender portal. However, for evaluation purpose, total cost for
1,00,000 cubic meter unit for SCBMCH-Cuttack, 60,000 cubic meter unit for
MKCGMCH-Berhampur and 50,000 cubic meter unit for VIMSAR-Burla will
be taken into consideration based on the quoted rate per institution.

added together for evaluation of lowest quoted bidder.
N.B:
1. The amendments mentioned above are to be treated as amendments in the
technical specification(s) and term(s) and condition(s) of the above tender reference.
All other technical specifications and terms conditions remain unchanged.
2. Since any text in the price BOQ can’t be changed in the e-tender portal, the
