It was the 200th anniversary of the date when the state's general assembly transferred the assets of the College, Academy and Charitable School of Philadelphia, founded by Ben- jamin Franklin, to a new board of trustees for the institution, henceforth to be called the University of the State of Pennsylvania. In doing so, the University of Pennsylva- nia became the first institution in the United States to be designated a University. To mark that anniversary, noted jurist and University trustee, the Honorable A. Leon Higginbotham, Jr., a member of the U.S. Appeals Court for the Third Circuit, presented the President's Lecture for the fall semester. His lecture, "On the Rights of Mankind." a 200-year perspective, was the 11th in a series inagurated in 1974 and sponsored by the office of University President Martin Meerson. The following are excerpts from that lecture. Birthdays and anniversaries offer strateg- ic opportunities to reflect on the growth and purported wisdom of individuals and institutions, a chance to reevaluate our values, to ponder whether eternal truths previously announced have some vitality and relevance to today's problems, to even have the temerity to question whether the good old days were as grand as some claim they were, and to think of how the experiences of two centuries ago can be applied to the turmoil of today... From a standpoint of realism and personal privilege, I am compelled not to be too romantic with excessive glorification of the "good old days:' for realism requires recognition that in 1779 1 would not have been permitted to join Benjamin Franklin, Benjamin Rush, James Wilson or the other six Pennsylvanians as signers of the Decla- ration of Independence. And even a decade later, I would not have been one of the framers of the United States Constitution, nor would I have been permitted even to vote for it as a mere citizen, despite the fact that the preamble declared to the entire world that the "People of the United States" were establishing a constitution to "form a more perfect union, establish justice... and traces the rights of mankind over the past 200 years In addition to his position as circuit court judge, Higginbotham is an adjunct professor in the sociology department of the Wharton Graduate School. To use a Jeffersonian phrase, the "self evident truth" is that during those times in Philadelphia I probably would have been a slave, perhaps even a slave to one of the framers of those revolutionary documents... But if the gods had been particularly generous to me, I would have been a "free" Negro, a free Negro in a land which insisted I never receive equal justice under the law. My subservience would be sanctioned by both the rule of law and the customs of the time... Despite the pernicious practices there were many noble ideals in the Declaration of Independence, even though their time had not yet come. We salute the drafters for expressing even those egalitarian thoughts they did not practice. But the reality is that in 1779-200 years ago -our nation had only white forefathers, no foremothers, and repressive slavery for blacks. But was there hope in 1779? Despite the harshness and cruelty of 200 years ago, was it self-evident that blacks and their posterity would be doomed for all time to remain slaves, individuals who had no right to marry, no right to own property, no right to protest, no right to minimum dignity? Was there any perception that there were certain fundamental rights for all mankind, for all persons regardless of their race? Fortunate- ly, almost a century before we were designated a University a group of Quakers and Germans in Germantown, Pennsylva- nia in 1688, were the first to formally protest against slavery in the colonies... Pennsylva- nia enjoyed the distinction of sponsoring the first organized protest against slavery in the colonies. [Nearly a century later] on March I, 1780, Pennsylvania passed the first emancipation statute in any of the states... But this resolution called for the gradual remission of slavery. This statute did not free one slave then in captivity. In a real sense, the 1780 statute was a profound beginning. Pennsylvania's ac- complishment in passing the gradual eman- cipation act cannot be underestimated. It was a changing of the tide toward ultimate freedom for blacks. Its impact went beyond Pennsylvania and helped trigger similar legislation in other northern states ... .where did the founder of this great university, Benjamin Franklin, stand (on slavery)? We know that in many ways he was a practical person. Despite the pernicious practices therewere many noble ideals in the Declarationof Independence, even though their time

New Governing Board for WXPN Announced

President Martin Meyerson announcedlast week his appointees to the new govern-ing board for WXPN-FM, the University'sradio station that had been engaged in afour-year dispute with the Federal Com-munications Commission.With the new board, the University moves

closer to the completion of its plan for aradio station that will bring educationalprogramming of distinction to the GreaterDelaware Valley region.The governingboard is made up ofGeorge

Gerbner, dean of the Annenberg School ofCommunications; Robert 1. Shayon, pro-fessor of communications and widely knownauthority in radio and television; GloriaTwine Chisum, clinical psychologist andUniversity trustee; Maury Weinstein, asenior in the Moore School of ElectricalEngineering, and Curtis R. Reitz, professorof law. Reitz will serve as chairman of thegoverning board.The University currently operates

WXPN-FM under permission granted bythe Federal Communications Commission,which approved the University's request fora construction permit on October 10, 1979.

According to Brian Madden, counsel forthe University, the granting of the construc-tion permit was the last substantive legalissue in the way of a new operating license."Everything from here is administrative:' hesaid. The station still operates on interimauthority from the FCC, but should soon begranted "program test authority" which is"for all practical purposes the same as beinglicensed:' Madden explained.

WXPN's original operating license wasdenied renewal in the spring of 1979 becausethe FCC felt that the Universityhad failed tomaintain sufficient control over the station'soperation.The University then reapplied for a license

on the same frequency. During the summer,in considering the case, the FCC waived itsrule barring stations which have been deniedrenewal from applying for one year. TheFCC then later granted the new constructionpermit.The governing board held its first meeting

November 20. Among the board's prioritiesis completion ofthe new license application."We expect to make formal application,probably by early December:' Reitz said.

After that, he continued, "applicationswill be submitted to the Corporation forPublic Broadcasting and to the Departmentof Commerce for financial support:'

Reitz feels that the exhaustive search for aboard ended in success. "It is a fine board,'he said. "I'm certain it will be helpful to thestation:'The radio station signal is at 88.9 on the

FM band. Operating with effective radiatingpower of 1.9 kilowatts, the station cat, Deheard in southeastern Pennsylvania andsouthern New Jersey. The station hasexistedwithin the University since the mid-1940s.Permission to broadcast to the largercommunity was first obtained 15 years ago.With the advent of a new license and arevamped governance structure, WXPNleaves behind the legal difficulties that havetroubled the station for the last four years.

More Women Students in Vet SchoolFor the first time in the history of the

University's School of Veterinary Medicine,women outnumber men in an incomingclass.

This year's statistic-55 women to 54men-follows half a dozen years when thenumber of men and women in incomingclasses see-sawed from 60-40 infavor of themen to nearly even, according to Dr. JosephF. Skelley, associate dean of admissions atthe School of Veterinary Medicine.

Cornell was the first school of veterinarymedicine in the nation toadmit a class with amajority of women. The University ofPennsylvania, said Skelley, is the second."We admitted women here before most

schools of veterinary medicine would con-sider them:' Skelley said.Most people thought veterinary medicine,

particularly large animal practice, requiredgreat physical strength, but that is just nottrue, Skelley said.

"It is a question of using your head. It isnot like you haveto 'manhandle' theanimal:'he added.

Since the school started admitting womenin the mid-1930s, "we have not noticed anydifferences in the quality of work betweenmen and women, even in the areas ofclinicalpractice with large animals:' Skelley said."We find that 85 to 86 percent of our

graduates go on to practice veterinarymedicine. And there is no noticeabledifference in that percentage between menand women:' Skelley said.When women were first admitted there

were some reservations among the facultyand among practitioners, Skelley said. Butthose reservations quickly disappeared.

Today, he said, "we get very warm, verystrong letters of recommendation, urging usto accept women:' Significantly, he noted,some of those letters come from the samepractitioners who earlier wrote him of theirreservations about admitting women.

"It is true:' Skelley conceded, "that somewomen take time off to have a family. But,they maintain their careers. "Most of themyths about women in this area of medicineare just that: myths. The women are reallyholding their own now:'

We were gladto see her gracious and informative letter inthe October II ALMANAC, which correctedsome of your distortions and also gave amuch better explanation of her approachthan your "quotations"

Your editorial response to that letterstruck us as highly inappropriate. First, iftheeditor insists on quarreling with any letterthat seeks to correct or amplify his accountof campus events, Speaking Out will nolonger be an open forum for readers'comments on University issues. In additionto this dampening effect, your editorialquibbles have other unfortunate implica-tions. The campus community is interestedin Professor Jouille's work and her philo-sophy of affirmative action. Whether or notyo" understood her remarks correctly is nota matter of general interest. But by includingthat misleading statement in your article,and insisting in your note that she reallymade it, you have once again mistaken thefunction of ALMANAC. The ALMANAC editorshould not act as an adversary to themembers of the University community. Heshould be working to facilitate our commun-ication with each other.

Committee Forming for Presidential Search

There has been a good deal of activity thisweek among students, faculty, and trusteeswho are interested in serving onorcontribut-ing to the still-unformed presidential searchcommittee.The committee, according to an outline

presented by the trustees in October, willconsist of six trustees, fourfaculty members,and two students.The trustee component is virtually in

place, with five of its six members alreadyhaving agreed to serve. Trustee ChairmanPaul Miller said this week.

Miller said he expects to name a sixthtrustee to the search committee very soon.He had earlier hand-picked the other fivemembers, he said.They are: Mrs. Jacqueline G. Wexler, who

will serve as vice chairperson; Dr. KarlKaysen; Dr. F. Otto Haas; and Mr. CharlesS. Wolfe. Miller did not identify the fifthtrustee named to the committee.

Both Wexler and Kaysen are members ofthe trustees' executive board. Miller, whowill act as a non-voting seventh trustee onthe search committee, basically for monitor-ing purposes, said that Wexler would in factoperate as the group's chairperson.He said that no trustee had rejected his

request to serve on the body. "I had certainconsiderations in mind when 1 was looking

for members:' said Miller. "One was theabilityto put in the time. And the geographyhad to be right. I couldn't expectsomeonetobe coming in from California every twoweeks.

"I'm on the whole fairly satisfied:' saidMiller of the trustee contingent.Responding to a question concerning

Jacqueline Wexler's appointment as com-mittee chair in light of campus discussionthat she might herself be a candidate for theUniversity's presidency, Miller said, "Earlyon if the committee decides that she is aserious candidate, she would have to bereplaced. She obviously does not see herselfas a candidate or else she wouldn't haveaccepted this job:'The faculty have not been able to match

the swiftness of the trustees in naming theirrepresentatives to the search committee.

According to Walter Wales, Senatechairperson, the SAC "was unable to reachagreement on the procedure" to select itsrepresentative when that body met earlierthis month. The SAC was scheduled toreconvene last night, having solicited advicefrom the Faculty Senate on what selectionprocedures might be equitable.Meanwhile the Graduate and Professional

Student Assembly is meeting tonight tointerview five candidates from among those

University Council Discusses A-21 Ramifications

Louis A. Girifalco, vice provost forresearch, reported to the University Councilrecently on how the University plans toimplement the personnel activity (effort)reporting system which is called for in theGovernment's controversial OMB CircularA-2 1.

Girifalco told those at the November 14thsession that the effort reporting system,though burdensome, is essential if theUniversity intends to keep its share offederalresearch monies. He acknowledged itsunpopularity among many academicsaround the country, but nevertheless urgedPennsylvania faculty to cooperate in com-pleting the new forms until the Governmentsaw fit to modify or dispense with themechanics of A-21.

Provost Vartan Gregorian noted duringthe Council meeting that A-21 is "wasteful oftaxpayers' dollars," that "it is an intrusion onprivacy:' and that it is "nonsensical"

President Martin Meyerson called thecircular "a tragedy:' This year the Universitywill spend something in excess of $3 milliondollars, said the president, just to keep upwith paperwork mandated by the Govern-ment.

However, it was announced at the Councilmeeting that the University has asked for

and been granted a one-year extension onthe implementation of new guidelinesrelating to the budgetary treatment oftuitionremission for graduate students in connec-tion with OMB A-21.For Fiscal Year 1981, therefore, graduate

three students; they will forward their namesand credentials to Trustee Chairperson PaulMiller, who will make the final selection,probably by next Thursday.

In 1969, when the trustees set up a searchcommittee to locate a successor to departingPresident Gaylord P. Harnwell, its composi-tion was similar to that established this fall,except that faculty and students were bothallotted five representatives per constituen-cy.The search committee's final recommen-

dation of a candidate is, of course, strictlyadvisory to the trustees.

its November meeting. The first called forthe adoption of a number of Council bylawschanges that had been recommended earlierin the year. These revisions will be publishedin a future issue of ALMANAC.

On the matter of Young Alumni Trustees,the Council voted approval of a variation ofthe recommendation that had been writteninto the Task Force on Governance(1978-79)Report. The ratified recommendation reads:"One Young Alumni Trustee from the

undergraduate schools and one YoungAlumni Trustee from the professional andgraduate. schools should be elected everyyear for a term of two years. Nominationswould be made by the Nominating Commit-tee of the General Alumni Society and frommembers of the current year's graduatingclass. Election would be by members ofthatclass. Election should be between April 1stand Commencement. The Young AlumniTrustees should assume office by the follow-ing January after attending the June andOctober meetings as observers."

Provost's Statement on A-21

My October 18, 1979 memo described theimpact of federal regulation A-21 on thecosts associated with graduate teaching andresearch assistants. At that timeweexpectedto be required to charge tuition remissionsfor these graduate assistants to the benefit-ting academic department or grant/con-tract. We also expected to receive federalapproval not to charge indirect costs onthese remissions.Our negotiations on this issue have not yet

been successful. Representatives of theAssociation of American Universities andthe Council on Governmental Relationshave been meeting with H.E.W. representa-tives and have now scheduled a jointH.E.W.-O.M.B. meeting for later thismonth. It still appears, however, that H.E.W.will require that tuition remissions beincluded in the indirect cost base.

Because of the lead time required toprepare proposals accurately and prepareour own 1980-81 operating budgets with the

proper benefit rates, we have asked ourfederal negotiators in this region for anextension of one year before implementingthe new treatment of graduate assistants'tuition remission. This extension has beengranted; it will not, however, affect other A-21 issues such as effect reporting or equip-ment maintenance.

This change will mean that tuitionremissions for graduate assistants willcontinue to be covered from employeebenefits in FY 1981 and that the rates in thechart below should be used for all budgetplanning and proposal preparation.The University's decision to change this

extension is based in part on our reluctanceto engage in any change in our managementor accounting practices while negotiationsbetween the government and the Universitycommunity remain incomplete.

DEATHS

Dr.Oscar V. Batson, emeritus professor ofanatomy, died at his home November Il. Hewas 85.A professor of anatomy at Penn for 37

years and chairman of the anatomy depart-ment in theGraduate School of Medicinefor35 years, Batson received his A.B. and M.A.degrees from the University of Missouri andhis M.D. degree from St. Louis University in1920.

In 1927, at the age of 32, he became theyoungest anatomy professor in the country.

Recognized for his studies of vertebralvenous circulation, Batson described thevertebral vein system which now bears hisname. Because ofthese studies, Batson is oneof 225 pioneers listed in Classic Descriptionsin Diagnostic Roenigenology; he is the onlyanatomist so honored.

Batson is survived by is wife, the formerEleanor H. Neumann, a son, Dr. A. PeterBatson, and two grandsons.

colonists "we must all hang together or wewill surely hang separately" Though build-ing a strong national Union was paramountto him, did he also have concerns about theevilness of slavery? Was he willing to movethe abstract diatribes on slavery to theagonizing positive actions which wouldeliminate slavery in the market place? Didhe have concerns beyond slavery-thuswhat were his views as to the options whicha free black in society should have? Did hebelieve, as apparently did Jefferson, thatblacks were inherently inferior? Did hequestion whether education was of value toblacks?Did he advocate education and better

employment opportunities for free blacks?Did he understand what centuries ofslaverywould do to the spirit, aspiration and eventhe conduct of blacks?...

I'm pleased to say that Franklin's actionsand his concerns place him at a specialplateau of esteem and admiration reservedfor the relatively few individuals whocaredand, most important, acted. There were atleast three aspects of Franklin's concernswhich made him different and moreenlightened than many of his contemporar-ies: his opposition to slavery; his belief inthe intellectual capacity of Negro childrenand his interest in the education andemployment of free Negroes; and finally, hisexceptional commitment and devotion tolearning and education.

Franklin was not a Johnny-come-lately.He noted his opposition to slavery as earlyas 1728 when he printed a book "againstkeeping Negroes in slavery". In 1736 hepublished another thoughtful tract oppos-ing slavery. However, his finest hour waswhen he became president of the Pennsylva-nia Society for Promoting the Abolition ofSlavery and the Relief of Free NegroesUnlawfully Held in Bondage, the firstsociety for the abolition of slavery in any ofthe states. He looked at the institution ofslavery in a unique way: he said the slavewas an "unhappy man who has long beentreated as a brute animal" and "toofrequently sinks beneath the commonstandard of the human species."As we celebrate the 200th anniversary of

Franklin's university, we must ask somebasic questions. Are we here today merelyfor another flashback to applaud Franklinas a heroic figure? Arewe here to rest on thelaurels of Franklin's excellent quotes? Arewe so content with the past that in ourgeneration we do not have the capacity todevelop a Franklin type of consciousness,wisdom and vision? Robert Kennedy oftensaid "some men dream things as they are,and say why. I dream things which neverwere and say, Why not?" Such was the toneand the vision of Franklin to dream thingsthat never were, and to do more than say.Why not? He acted, he planned and we alltoday are the beneficiaries of his greatercommitment.
